Hi there, ma'am. >> Hi. Where are you headed to? >> So, what were you doing back there in the intersection? >> Just turning around because my my um directions weren't coming through very good. >> Okay. So, where were you coming from then? was doing fine, but I'm far away from where I need to be to see some friends and I was just heading back to So, I thought I was almost there, but I wasn't. >> Okay. Is this where you normally live? >> I'm here every summer. >> Every summer, >> but my husband died a year ago, so it's all new to me. >> So, I'm trying to Yeah, acclaim made it. Okay. >> But I don't know. >> I was just heading back to the 30 acres. >> Mhm. >> But I made a wrong turn. Okay. You want to put the car in park for me? All right. Perfect. And you can turn the car right off. Actually, >> I think that does it. >> Yeah. >> Yep. Do you have your license on you? >> Yes. Do you have any drinks at your friend's house? >> I had a glass of wine. >> A glass of wine? >> Yeah. >> Okay. >> I didn't have drinks, but I did have a glass of wine. >> Okay. Well, I did see you swerving on the road a little bit. I saw the car coming at you. You swerved pretty close, crossed over the white line, and then came back in. And then when I went to go stop you turns yellow a little bit. >> Okay. >> Okay. >> You know it was a long trip. >> Okay. >> So I think I think that I thought I was very near home. >> Okay. >> Yes. I lived there for 24 years. >> Do you have a license in New York State or just in Florida? >> In Florida. >> Okay. in this acreage uh that you're staying on this barn with the acres um is that do you own it or are you renting it or >> No, I own it. >> You own it? >> Yeah. >> Okay. All right. Well, um do you mind stepping out of the car for me? and walk right back towards the back of the car. Okay. All right. I'm just going to have you stand at the back of the car here for just a minute. All right. You can lean right up against the back of your car if you want, just to make sure. So, I know you said you had a couple of drinks. You were swerving quite quite a bit. Like I said, as a car was coming at you, I saw you swerve real clo real real uh strong to the right, crossed over the white line, and then you came back, and then when I went to go pull you over, you almost crossed the yellow line, and I activated my lights, and you pulled over to the right. Okay. Um, you also had no tail lights on. When I was coming past you, you didn't have any tail lights on at all. I mean, right now, the vehicle's off, so obviously they're not on, but you had no tail lights at all. You also made a U-turn in the middle of an intersection. Okay. So, you did tell me that you had a couple drinks. I'm just going to put you through a couple tests. Okay. Uh you had your glass of wine or your Chardonnay or whatever um at your friend's house. You know how long ago that was? >> Probably an hour. >> About a half an hour ago. Do you normally drink? Is that is a glass of wine a lot for you or >> Well, I haven't drank in quite a glass of wine. might be a little bit more than used to cuz I was not drinking. >> Okay. >> So, it might have been >> Okay. All right. Um, you want to shut my life off for me? >> Okay. [snorts] >> Still, um, are you comfortable in those shoes that you have? Do you wear those all the time? >> No, I just This is my first time wearing them. This is >> your first time wearing them? >> They're pretty high. >> They're pretty high. >> Okay. Would you be comfortable going barefoot or no? >> Or would you rather have them on? >> I don't I don't know. I mean, >> okay. It's up to you. If you want to leave them on, you can leave them on. If you want to take them off, you can take them off. We're just, like I said, going to do a couple of tests. Um, first, I'm going to take a look at your eyes and then we're going to do a test uh where you walk and stuff. So, I want to make sure you're comfortable with your shoes. Okay. >> Thank you. >> Okay. So, do you want to keep them on or you want to take them off? I'm a little worried because I have always been the only driver. My husband was >> so I've always had to be the only driver. >> I'm very frightened that I could do something that would mess up >> being able to be the driver. >> What do you mean by that? >> Well, have I done something that's going to make I'm not sure what you're asking me. >> Have I done something that's going to like mess up? I don't know. >> Well, I don't know. I guess that's that's up to you right now. The reason I pulled you over, like I said, is because I observed you making you U-turn in the middle of an intersection, a four-way stop sign. You know, you made you made a U-turn right in the middle of the intersection. Okay. When there was a vehicle behind you, >> and then when I came up um behind you, I saw you swerve uh sharp cross over the white line. You tripped back and then when I activated my lights, you were pretty close to going over the yellow line and then you came back and you also had no working tail lights on. Okay. So, that's the reason that I stopped you. Now, since I've spoke to you, I can smell out some alcohol coming off of your uh breath. Okay. And I can also your your speech is very slow. It's very deliberate. Okay. So, these are, you know, showing me some signs. So now I want to investigate more to make sure that you are capable and okay to drive >> drive. Especially because you told me you did have a glass of wine. Now that may be a lot for you. It may not be. Okay. But I still need to make sure that you are capable of driving. Okay. So that you're safe for yourself and everybody else that's on the road. >> I do what you're saying. Yes. >> All right. Do you still have any more questions for me then? >> No. Okay. So what I'm going to have you do is I just want you to turn with your back against your car. Okay. >> Mhm. So, face me. Yep. Now, take one step forward towards me. Can you do that? Perfect. All right. For So, for the purposes of this test, I'll have you leave your shoes on. You're not going to be doing any walking or anything like that. So, I'll have you leave your shoes on. Okay. Um but what I'm going to have you do is I'm going to have you stand with your feet together just like this and keep your arms down at your sides. [music] Can you do that for me? >> Mhm. >> Okay. So, again, feet together and arms down at your sides. Okay. So, what I'm going to do now is this light's going to go above your head. Okay. I'm not going to shine it in your eyes or anything like that. I just need to be able to see you. Okay. So, is that too bright for your eyes? Okay. So, now what I'm going to do is I'm going to hold this um I have the tip of this pen. Do you see the tip of this pen right here? >> Yes, I see it. >> Okay. So, what I'm going to have you do is I'm going to have you watch it with your eyes and your eyes only. Okay. And then follow it with your eyes and without moving your head. Do you understand that? Both are >> okay. So again, you're a little offcentered. I want you to stand with your feet together and your arms down at your side. Can you do that? All right. Perfect. Again, you see the tip of this pen. All right. So, you're going to watch it with your eyes and your eyes only. Do you wear any contacts or glasses? >> I have um something put in my LASIC. >> You have what? >> Las. >> You've had LASIC. >> Lasic. Okay. But do you have any contacts in right now? >> They did. Um >> when they do, you can't see cuz you get >> I don't know how to explain it. Um >> do you have contacts in currently in your eyes? >> A type. >> What type? Um, I had uh we can't see. Trying to think what they call it. Sorry. >> Do you use it for So, you use it for your vision or >> Mhm. >> Do you change them out all the time? >> No. Um, they they they they do something when you get older and you can't see. Okay. But each morning, do you put contacts in your eyes? >> You don't change out contacts or anything like that? Do you wear glasses? >> Reading glasses >> just for reading. Okay. But you don't wear everyday glasses? >> No. Okay. So, nope. You're okay. Just again stand with your feet together and your arms down at your sides. Okay. Perfect. So, again, what I'm going to have you do is watch the tip of this pen with your eyes and your eyes only. Okay. And don't move your head. Do you understand those instructions? >> Yes. >> Okay. >> All right. You see the tip of this pen? >> Mhm. >> Okay. So, I want you to follow it when I move it side to side. I want you to follow it with your eyes and your eyes only. Okay. >> All right. Now, I'm going to turn the pen. Okay. And I'm going to go straight up with it. Okay. >> All right. I'm not going to touch you or anything. I'm just going to go up with it. So, I want you to follow it with your eyes upwards. Okay. >> Okay. Keep an eye on it. Okay. All right. So, now what I want you to do is So, are you comfortable with your shoes? You never answered me. Do you want to keep them on or you want to take them off? >> They're They're comfortable. They're okay on. >> Yeah. >> All right. >> Just a little higher right now. >> Okay. All right. Well, now what I'm going to have you do is I'm going to have you again face my car. So, same position that you were in. Yep. >> Stand with your feet together and your arms down at your sides. Okay. So, what I'm actually going to have you do, cuz you see this white line here. >> Yeah. >> Can you see that all the way down? >> Mhm. >> All right. All right. So, what I'm going to have you do is I'm going to have you put your uh left foot on that line. Perfect. And then you're going to put your right foot in front of your left foot touching heel to toe. No. Okay. These are a little wide. >> Okay. All right. Again, I want to have you stand with your left foot on the line, and then I'm going to have you put your right foot in front of it, touching heel to toe like this. Can you do that for me? >> Yeah. >> I don't want you to fall on me. Are you going to fall? >> Would it be more comfortable for you to take your sandals off and do it barefoot? Maybe. Okay, pop those off and it might be more comfortable for you. >> Yes, they're they're new. I just thought >> that's okay. You might be a little more stable on your feet if you take the sandals off. >> All right. Again, left foot on the line with your right foot in front of it touching heel to toe. the top. >> You don't have to walk. I just want you to stand in that position. Okay? >> That's why I'm trying to Thank you. >> I need you to stand together. I want you to put your left foot on the line. >> Right foot in front, heel to toe. Can you stay in that position or No, I don't want you to fall. >> I think I can. >> If you're going to fall, then we're not going to do it. >> I'm not going to fall. >> I don't want you to get hurt. >> Thank you. Thank you. >> Do you want to take a second here? Stand normal for a second. You can stand normal. You don't have to stand like that anymore. Just put your feet next to one another and stand normal for a minute. >> They're pretty swollen. I don't know why. >> Okay. All right. Well, we're not going to we're not going to continue this one. Okay. Cuz I don't want you to fall. You haven't been able to stand in that position at all without t um leaning and almost falling over. Okay? So, for your safety, I don't want you to do that because I don't want you to hurt yourself. Okay? So, we're not going to do that one now. What I'm going to have you do, just like the other one that I had, can I have you stand with your feet together and your arms down at your sides? >> Perfect. Just like that. >> Andrew, I'm going to stand just behind. >> Um, so again, feet together, arms down at your sides. I'm going to explain some stuff, but I want you to stay in that position. Okay? So, when I tell you to do so, you're going to take one of your feet and lift it approximately six inches off the ground like this with your foot parallel to the ground and your legs straight. Okay? You're going to stay in that position and you're going to count in an upwards fashion of 1,00 200 300 so on and so forth until I tell you to stop. Okay? >> Okay. >> During that, I want you to count out loud. I want you to keep um keep your eyes on your feet and I want you to keep your arms down at your sides and keep your toe pointed with your legs straight out. Do you understand? >> Sounds. >> But you understand my instructions. >> Okay. Do you want me to repeat them or no? >> No. Okay. So, when I tell you to do so, I'm going to have you start. Whenever you're ready, you may begin. >> What do I do? I put a foot out. >> Do you want me to read or say the instructions to you again? >> Okay. So, stand with your feet together and your arms down at your sides. Okay. You're not going to move from that position until I tell you to begin. Do you understand? >> Okay. So, when I tell you to start, you're going to pick whichever foot you would like and raise it approximately 6 in off the ground. keeping your foot parallel to the ground and your toe pointed. Okay? You're going to keep your legs straight, >> arms down at your sides. >> During that um time, you're going to count in an upwards fashion of 1, 1,00, 2, 1,000, 3, 1,000, so on and so forth until I tell you to stop. Okay? Again, you're going to watch your feet the whole time. You're going to count out loud and keep your arms down at your side. Okay? >> Do you understand them now? >> Oh, yeah. >> Okay. So again, you may begin whenever you're ready. All right. Well, that's all right. We won't continue to do that one. Okay. Um, let me just wait for this car to go by. All right. So now again, what I'm going to have you do is I'm going to have you stand with your feet together and your arms down at your sides. Okay. Can you do that? Feet together, arms down at your sides. Mhm. >> Perfect. All right. So, again, I'm going to check your eyes. Okay. I'm not going to do the same thing. What I'm going to do is I'm going to take this pen and I'm going to move it in a circular motion like this. Okay? I just want you to watch it with your eyes and your eyes only. I'm going to bring it in close to the bridge of your nose, but I'm not going to touch you. And then I'm going to bring it back out. Okay? Again, follow it with your eyes and your eyes only. And don't move your head. Okay? Keep following the pen. All right, we're going to do it one more time. Keep following it. Okay. All right. So now again, I'm going to have you stand with your feet together and your arms down at your sides. Okay? So when I tell you to begin, what I'm going to have you do is I'm going to have you tilt your head back and close your eyes. Okay? And you don't have to do it right now, but when I tell you to. Okay? Stand with your feet together, arms down at your sides. You'll tilt your head back, you'll close your eyes, and you're going to estimate the passage of 30 seconds. Okay? When you believe that you've reached 30 seconds, you're going to tilt your head forward, open your eyes, and you're going to say, "Stop." Okay? Does that do you understand those? >> Yes. >> Okay. Again, just make sure you stand with your feet together and your arms down at your sides, tilt your head back, estimate, close your eyes, estimate the passage of 30 seconds, and then when you've completed that, tilt your head forward, open your eyes, and then um say stop. Okay. >> All right. So, Don't start yet. I'm going to tell you when to start. Okay. So, tilt your head forward. All right. You can tilt your head forward now. So, what I'm going to have you do now is again that same position like we have bent. Feet together and arms down at at our sides. I think we're I think we understand that one. Okay. Right. Feet together, arms down at your sides. All right. So, now what I'm going to have you do is put your hands out like this. Can you see how my hands are? All right. Perfect. You got your hands out just like this. Pointer fingers out. Okay. So, you're going to bring them down to just like this. Okay. So, now what I'm going to do is when I say so, you're I'll say either left or right. When I say that, you'll lift that corresponding arm and finger up and you're going to come out, touch the tip of your nose, and then bring it back down. For the purposes of this, you're going to touch the tip of your finger, which is right here under the nail bed, >> okay? >> To the dime portion of your nose, right here at the end, which will be the tip of your nose. Okay? Can you show me your left hand? Perfect. And then show me your right hand. Perfect. All right. So, again, you're going to keep your hands out in that position, and you close your eyes. And when I tell you to, I'll either say left or right, and you'll lift that corresponding hand up and touch it to the tip of your nose and bring it back down. Do you understand? All right. Perfect. You can relax. Okay. You want to just stand next to your car with the deputy there. If you want to put your shoes back on, you can. >> You can go ahead and put your sandals back on. >> You're by yourself. Are you with anyone? >> No. My husband died about a year ago. >> Oh, I'm sorry to hear that. >> So, I It's been a lot of challenges. I understand that. >> But it's good. It's good to be here. Florida [snorts] is so not where you want to be. >> Right. >> All right. So, what I'm going to going to have you do when I say so, um, I'm going to have you put your mouth. Do you see the tip of this right here? >> Yeah. >> I'm going to have you put your mouth around the end of it, and I'm going to have you blow into it. You'll do a nice steady blow just kind of like you're blowing up a balloon. Okay. Um, you blow into it until I tell you um that you're okay. Okay. >> Out of trouble. >> That's up to you. Have you been Have you had enough to drink that's not going to or that you're not capable of driving? >> No, I'm very capable. >> Okay. >> But I don't know. I don't know. I've never been to that point where it scares me. Okay. >> Okay. Well, like I said, all I'm here for is to just make sure that you are capable of driving. This is just one portion of >> I think I'm very capable. I'm very >> Okay. Well, are you willing to blow into this then? >> I'm a little frightened of that though. >> And what makes you frightened? >> Because I've never done it before. >> Okay. Well, it's not. Does it, you know, the action that scares you or you think that you're going to um blow and your numbers are going to be too high that you're not able to drive because blowing into this isn't going to do anything, okay? It's not it's not going to hurt you. It's not going to harm you. It's just like blowing up a balloon and stuff like that >> that they would be. But what if they were then? Oh my god, my whole life is >> What if what was >> what if that number isn't a good number? then I'm in big trouble, right? >> Well, it kind of depends. >> I mean, it's not like you're not going to jail the rest of your life or anything like that, okay? But if it comes back to the where you're the point that you're not capable of driving, then yes, obviously there's more actions that need to be taken. I'm going to be completely honest with you. I have enough >> You have been >> I have enough right now that if you don't blow into this, we're still going to have to do some extra stuff. Okay? you're you're going to um going to have to come back to the station with me and you'll get you'll be arrested. Okay. >> So, if you blow into this, >> that's on to that's on you if you want to, but if you refuse to, that's on you as well. >> Okay. I'm a little over my I'm overwhelmed for a minute. >> Okay. >> Where is your vehicle out of? What? >> I work for the Yates County Sheriff's Office. Our office is located in Penan. >> Oh, Yates County. Okay. >> Yep. >> So, I'm Stuben County. So, >> you live in Stuben County. Okay. Well, you're driving currently and operating your vehicle on this roadway in Yates County. >> Okay. Any more questions? >> Probably, but I don't know what they would be. I'm not trying to be difficult. I'm just trying to distinct. Are you willing to blow into this for me or no? >> Is that if I pass that am I then okay to go home? >> That's not admissible in court. >> I was going to say this isn't going to this is just going >> I just like to get home. That's >> I understand that. But right now I don't think that you are capable of operating your vehicle safely home. >> Okay. No. >> So no. So, it's either going to be to the point where can I park it and get somebody to just >> take me home and be okay. >> Right now, we're not at that point. >> Okay. My friends would come and get me any minute. >> Okay. Well, if if we get to that point, we can we can try that. But you have already operated on the roadway in your vehicle in a manner that I don't believe is safe for you or anybody else. Okay. And now talking to you concern is getting home, right? >> Yes. >> And I don't need to be in trouble cuz it's going to just ruin my life. Okay. >> It's not necessarily going to ruin your life. Okay. No, I know a lot of people, you know, that have either made mistakes, been to jail, and they're out doing great things. Okay? I'm not saying you're going to jail. I'm not saying that you're going to be locked up for the rest of your life or anything like that. Okay? >> My son was legally blind. I did for >> everything. I'm [clears throat] very aware that being able to have a clean driver's license for me is like, >> yeah, incredibly important. >> I understand that. >> So, I don't mean to be in trouble. >> I don't know how to what fixes it or how to >> Well, we're at the point right now of just fixing it. We're past that point. Okay. We can't just, you know, >> snap our fingers and it all, you know, just magically go away or reverse things. Okay? You've already operated on the roadway. You're showing me that you I don't think that you're capable of operating your motor vehicle. Okay. You're showing signs of intoxication. Okay. Your eyes are bloodshot. They're watery. >> I Yes, I have allergies. >> Okay. All right. So, it's much more to do with that than Yeah, I did have a glass of wine. Be the first to admit it. >> Okay. And if that's the case, you can, you know, blow into this and it says that you're zeros and maybe there's other something else going on. You take any prescription medications or anything like that? >> No. Okay. >> Allergy. >> Just allergy medicine. Okay. But you don't take any regular prescription medications by a doctor or anything like that? >> No. Okay. >> But I have extreme allergies because of the animals. And >> did you take o over the counter allergy medicine? You just get it from like Benadryl and stuff like that. When did you take that today? >> Um probably a couple hours ago. >> So you know I'm beginning to get >> Was it [snorts] non drowsy or you don't know? >> I don't know. >> Okay. But I do have to take that because I do get >> allergic reactions to the trays and all that. >> Okay. All right. So again, I'm only going to ask you this one more time. And if you say no, then it's a refusal. Okay. That's fine if you don't want to do it. But I would like you to blow into this and then um we'll kind of go from there. If you don't want to, that's that's your choice. >> I just don't know. What does that do? If I fail something, >> this just indicates that there's alcohol on board. >> It's not a There's no It's just a positive or a negative. That's all it is. >> Isn't going to >> All it is is a positive or negative. That's really all it is. >> I'm not basing my investigation completely off of this. Okay? If you didn't do this, like I said, I I still have enough to show that you are not capable of operating your vehicle. Okay? >> Whether it's because you're too tired or whether anything the case may be, this is just, you know, helping me with my investigation to determine whether or not, you know, what I'm seeing is intoxication or if there's something else going on. You know, you may be having a medical emergency there, things like that. Okay. So, this is what that's what this is helping me with. this is going to, you know, help me in determining whether or not that there is alcohol in your system. Okay, >> I'm sure there's some >> and that and that's fine. If there's some, then we can go from there. Okay, but if not, if we're, you know, past that point, then obviously there's more that needs to be done. Okay, you do you know what the legal limit is in New York State? >> No, I don't. >> A 08% alcohol BAC. Okay, that's what you can have. You have to be lower than that. um to operate a vehicle. Okay. So, if you are above that, then obviously you're driving well intoxicated. Okay. >> Do you are you afraid that that's what it's going to say or >> I don't know. Cuz if you if you don't if you think that you're fine and you think that you don't have a lot in your system and you only had one glass of wine, this is going to tell me that and this is going to help me in determining whether or not I can just either get you a ride somewhere or if we have to go further. Okay? So, this could help you if you're what you're telling me is true and you say, you know, that you have only had one glass of wine, this could help you. Okay? But if you if you haven't and we've had more than that and you're lying to me, then obviously we have to go somewhere else with that. >> So, are you willing to blow into this or not? We're not I don't want to keep standing here. I don't mean to be mean, but I don't want to keep standing here and just going over and over and over again. We're in the middle of the road. All right. Or on the edge of the road here. >> I'd like to be home. >> Okay. >> What does that take? >> That either you blow into this or you tell me that you don't want to blow into this. That's where we're at right now. and then we can go from there. >> Well, I don't blow into something because I I have a small system. So, a glass of wine could show up high on mine. Then at that point, you still are not able to drive on the roadway. Okay? Even if you just have one glass of wine and it's too much for your system, you're still not able to operate on the roadway. Okay? >> So, if I blow into it and it shows fine, I can just go home. I will more than likely get you a ride home if it shows up just just fine. And I don't think there's anything else on board. Okay. >> I don't think there's anything else in I haven't done anything. >> Okay. >> I just don't want to be in trouble. I don't have >> Okay. I understand that. But at Okay. Well, we're at that point right now where we have to figure it out. Okay. >> So, I'm going to have you move towards the back of your car a little bit more cuz we're wandering too far into the road here. >> Okay. >> All right. Perfect. I appreciate it. again. Are you willing to blow into this or no? >> I'll do whatever it takes, but I just hope >> I need a yes or no. Are you willing to blow into this PBT? He can't give you >> anything about it, though. >> I just told you everything. >> No, you can't tell me. How would you know? >> What do you mean, how would I know? I do this all the time for my job. Okay. >> I'm qualified in operating this >> fine. I'm a fairly what would you call it? Not used to drinking much. That could just ruin my life and I don't want my >> Okay. Well, you still made the conscious decision to have that glass of wine not knowing what it was going to do to your system and you chose to operate your vehicle. Okay. So, we're still at a crossroads. Whether it was one glass of wine or not, this is just going to help to determine whether or not there was too much in your system for you to drive. >> It's only going, like I said, >> it could hurt you. >> It could help you. >> I scare you. >> I just I'm I'm just too way past what's going on in my life. I can't deal with it if it ruins me. >> Okay. Well, it's not going to ruin you. I promise. Okay. Okay, >> this isn't going to ruin your life or anything like that. It may be a hiccup in the road, but >> it sounds like you've gone I know, but it sounds like you've gone through a lot that I think you can get through it if this is the case. Okay, >> so >> I know I've said this, but this is the last time. Are you willing to blow into this or not? Yes or no? >> I just want to get home. >> I just need a yes or no answer, ma'am. >> Just yes or no. That's all. Simple. No, but I don't want to be guilty of something. I'll trust you.
