Come into the house. >> Danny, come here. >> You are coming in the house. >> Come down and talk to us. >> I would rather not. >> No. Danny, come >> and talk to him, please. >> And shut that door. >> Come here. Come this way. >> Come over here. >> Come on. >> No. You're coming to me. I'm here. >> Okay. I'm I'm going to relocate. >> Yeah. Yeah. You You're not allowed to see. >> I'm just getting you out of this. Hey, no. I understand that. >> They don't want you in the kitchen where there's knives. So come on in your pockets or anything. I have cigarettes in a lighter. I have basketball shorts on. Okay, I got you. >> So that's the only reason. Okay. >> All right. Only reason. Okay, cool. We're done. All right. I don't need to be anywhere else. >> Don't do that. It's an officer safety thing. It's not that I wanted to leave your door open. Okay. >> Okay. >> All right. So with everything else going on, what happened tonight? I was sleeping and I got awoke and after that I was explained that I left the door open apparently and my door was open. So it was obviously inviting invitation to bother me when I was sleeping. Okay. I wake up at 3:00 every morning to go to work. Okay. Okay. And apparently when that happened, my mother woke up and I had an issue with that because I was awoken up enough. Mhm. [clears throat] And I worked 12 hours today. I was awake for 18 hours yesterday. 7 hours of it was because I had to take care of my kids or whatever. And I got her woken up from from leaving a door open. Okay. Apparently. And all the lights on. Boom. So, my young brother comes in my room to tell me that. And that was the second time he was in there cuz he didn't hear my dog. I didn't hear my I didn't hear my dog the first bark the first time, but I heard him. Hey, you left the door open. Okay. Then my mom comes in the room and says, she didn't even say anything. I was already awake at that. I said, "Can I help you with something?" And she closed the door. That's right. >> Okay. >> Yeah. >> So, I'm like, "Fuck." I look at the clock. It's 11:30 at night. The hell's going on? So, I open her door. I ask her, "What's going on?" And then she tell explains to me what's going on. my young brother Mikey comes upstairs and she call me Mikey comes upstairs and then starts trying to explain to me what's going on which doesn't make a whole lot of sense because I thought since it's 11:30 my mom normally doesn't get home until 10:00 she apparently was already sleeping and because my dog barked because he proceeded to walk down the hallway which my dog does she sleeps with me was barking which woke my mouth and I said did you and him get into an argument out He was recording me down there. He's still yelling at me. >> Okay. >> And I was upstairs here yelling at him and I found out he was recording at me. >> And I I said something and he said something and he proceeded to walk up the stairs in a defensive manner. So I had to defend myself. >> Okay. >> This isn't the first time you guys have been here with me and him arguing with [ __ ] Last time I had to go to work with a black eye cuz he pushed his thumb in it and just decided to choke the [ __ ] out of me. So, and it's what it's what we we've been fighting for years. So, on and off for some stupid [ __ ] odd reasons and he proceeded to come upstairs aggressively. So, I had to defend myself. >> Okay. Well, why'd you spit on him? >> I didn't spit on him. I did not spit on him at all. >> He has a recording of it. I did not spit on him. Okay. Where did you spit then? I Where did I spit? >> Why would you spit at all? >> Yeah. Why? Why' you spit at him? >> Spit at him. >> Why' you spit at him? Why'd you spit on him? Why'd you do that? >> Cuz he was recording me. >> So you spit on him? >> I did not spit on him at all. He has no spit whatsoever on his body at all. >> Okay. So then he comes up the stairs. >> A No. No. He ran up the stairs. He did not just come up the stairs. He ran up the stairs to fight me. >> Okay. And then And then what happened? Explain the fight. >> Explain the fight. >> Yeah. >> He said, "Oh, I got this all recorded. Blah blah. If it was an actual fight, he would have fought." >> Okay. >> But he didn't. He proceeded to allow me as him interrogating me and being the aggressor in the whole situation, awaking me from my sleep. That's how it all started. He was aggressing the situation in order for him to start recording. Number one, >> number two, he came up here to fight me. That was his whole intention of this whole thing. >> Okay? >> Because he already knows how this [ __ ] turns out. Okay? >> So, I have the one with the marks on me. Look, look, look. He bit me. You [ __ ] bit me. You see that? >> Okay. Well, did you have him in a choke hold? >> I have no idea. >> Okay. So, you don't know if you put him in a chokeold? >> No. All I know is that he was running up the stairs to fight me because I've got my ass beat by him plenty of times. >> All right. Danny, what's is your first name D? Cuz here here's what we have. So, I'm going to explain to you fully what he's telling me. >> Mhm. >> And and everything that's going here. He comes home, doors are open. Whether you left them open on intentionally or forgot to close them, whether they weren't open or not, regardless, that doesn't [ __ ] matter. >> Exactly. >> So then he comes So then he comes to your room, check to see if you're there cuz he's he's unsure of what's going on cuz he's he's concerned. So hold on. >> Okay. >> He's he's concerned about all these doors open and whatnot inside the house, right? Comes to check on you, leaves. Whether he comes back a second time, I don't know, but he comes back to check on you, and then he leaves again. You then come out of your room, and you guys get into an argument out here. He came up here to argue with me. By the way, I was talking to my mother. I just want to clarify that. >> And so then at some point he's down there, you're up here. You spit in his direction. He comes up the stairs. You guys get into a fight to where then you put him in a choke hold and then he bites you. He allowed me to do that, by the way. >> What? Put him in a chokeold. What does that even mean? He's a He's 50 He's 50 lb heavier than I am. You saw Look at me. I'm 5. He's 5'9 down. He allowed that to happen in order for you guys to be here for this to >> to come into effect. >> There's no marks on him whatsoever. >> Okay? I just want you to understand that's about as tall as you are if you didn't stand face to face talking to him. About, you know, maybe >> double the size. >> Okay. But I have to defend myself, you know. >> And you know what? Check him out, too. >> Okay. >> Cuz he's bit. >> So, >> I didn't bite him. >> Are you hurt at all? >> No. >> No, I'm not hurt. >> Yes. Say you are hurt. >> Well, hey, quit telling him what to do. I I'm not hurt at all. >> Look, you're [ __ ] >> No. No. I wasn't the one who called in order for this to happen. >> Yeah, but he wants to press charges against you. >> How does he want? He's became at me aggressively. I don't know how that works out. >> Yeah. >> No, no, no, no, no, no, no. That's not how it happened. >> This guy came over here. >> Spitting or not, he came at me aggressively no matter what. >> You don't know how these conversations happen. >> Can I Can I help you? >> No, I can't. >> Whatever Whatever we're going to do, we're going to do it. That's our decision. All right. >> You need to check both of them out. >> Okay. I can't force myself. >> You need I am not signing anything. I did not call the police. So ma'am, these are two full grown adults who can make their own medical decisions decisions. We don't need you telling them what they can and cannot say. >> But I can tell my son we're not in this. >> This is her house though. >> We'll see if this guy is going to sign for sure. And if not if he is for sure, >> but if he's not going to come to station, >> besides everything that's going on, I said work for the fire department. I appreciate it. Okay. So, we were called here by the police because of the altercation that happened. Do you want to be evaluated by us and have a report filed and have a medical document for Do I have like I don't have to do anything? I I'm fine. You don't have to do anything. If you want a report filled out because you're injured or there's damage or anything going on, we can fill in a form. We can have you evaluated, meaning document everything that's going on on a medical end. If you don't want me from us, you can refuse that at any time and you don't have to do anything. There's still a report that goes into our computer system. I understand that. And that shows that we just came out here. That was there's not going to be any medical that happened last time and I had just fully blown black eye. My eye was pushed in. If you want us just to do that side of things, we can do just that side of things. If you want an actual medical report filled out with your information in it and everything on there, we have to talk insurance. >> Okay. >> Yeah. >> So, if you want that if you don't, you know, I have to go outside and order this. >> No, I can bring somebody in here. We can do it right here. I don't want any more people cuz I'd rather >> we're going to keep everything separate. All right. We're going to keep everything separate. Check out your brother, your cousin, your brother. He lives here, too. Yeah. Well, I'd rather not have you guys by each other because he's being evaluated by somebody else. They rather keep you inside if possible. I just bring one person in. That's it. And they're just going to check your blood pressure, make sure everything's cool, look at whatever mic you have and fill out a form, check that blood pressure. But we want to make sure that everything's normal. We want to make sure that, you know, I I have I have a really slightly like uh low like high and if anything's abnormal, we can't force you to do anything. You don't want to go to the hospital, you don't have to go to the hospital. We This is just part of our medical documentation that we are here. We checked you out and everything. Okay. >> Okay. That's fine. Just give me one minute. >> So right now he's >> Are you the responding officer? >> That's the officer in charge. The one I just walked out. >> Okay. >> So depending on this decision, we we'll advise you. All right. As right now everybody just >> need everybody to calm down, right? I know I know this is I know I know right now you are. But you know earlier when everybody's trying to do what they want to do, this just not how things work. We need to be safe with us cuz I I want to explain to you guys, right? I don't want you guys to think we're jerks. Nothing like that. >> No, I like the first police department part was fine, but it's >> officers officers get hurt the most during the >> This isn't a domestic violence like >> Well, it is. You guys live together. You're brothers and you guys are fighting. That's a domestic issue. >> Okay. However you want to domestic issues are like >> you could be not you could be not you cannot be related and live in the same household and still. So, at this point, he wants him arrested and he wants to press charges. >> That's what we're figuring out. >> He needs to get checked out. He needs to show what he did to him because this is just an altercation that shouldn't arrest anybody. >> Not even bugs in the house. Yeah. I don't want to press charges against him if that's the case. >> Whatever your guys' decision makes, I don't care. Like, he's the one who came home. Like, I don't even know where the [ __ ] he was, honestly. What you guys need is sniper. >> That's what we're That's what we're doing. >> That's what we're doing. >> How did he get here? >> Outside. >> That's what we're doing. >> Maybe you want to question him or what he was doing tonight. I have no idea. What does What What does What's mom's name? >> Her name is Debbie. >> Debbie. Miss Debbie. Could you close You could close the door if you want. >> Close my own door >> like a little bit. Just keep it. But you got to understand like if if it was just a door open like it could have been easy as closed and that was that should have been it for me like who cares what I was doing or where I was at that point. I was sleeping dude you know sir sorry sir >> the point the point of us being here is to make sure things do not progress to where someone is eventually hurt. >> Normally in experience man like after you guys come like we're fine. We were fine >> in the initial after the whole thing like he would have went to bed. I would have went to bed. But like >> the whole recording thing to me, like that [ __ ] is like childish. Like we're we're brothers, dude. Like like come on. Like >> go over the top and stuff. >> You got to be like I'm going to do your work. I'm going to do your work. Like you're both adults. You're both adults. >> You could easily walk away, close your door, and just stay in your room. >> Yeah. You really >> That's what you need to do. >> All right. Next time that happens, >> like I got woken up in the middle of the night. Daniel. Daniel, I'm just explaining to you, right? So that way you can explain it to we can't we can't say it's he, she, you know, it's >> what it is. It is what it is. >> You don't have to have your Bible saying we're still going to do the report. Do you want a blood pressure taken and get checked? >> No. I I I would I would I mean I'm already hyped up if my blood pressure taken. Like I'm I'm over I'm over hypertension at this point. >> I'm over hypertension at this point, you know? My my heart's raised. I I can already I can tell you that by now. I'm I'm like I'm like 180 over 30. >> Don't need the bag. Eric, >> I can tell you right now I'm 180 over 30. >> Eric, you don't need the bag. >> So, at this point, I would really like one of them to leave because I don't want to be woken up again. I got to go to work in the morning. I got to wake up in 4 hours or work. I'm not going anywhere. Seriously, where am I going to go? If I go somewhere, I can't go to work tomorrow. >> 2:30. Actually, I was already sleeping. You guys told the report from last time you were here. It was the same. >> Are you going to the hospital? >> No. >> You're not going to see my medical? >> Going to work. >> I I have to tell them that I don't want to. Daniel, this is what's going to happen underneath. Are >> you serious? On your back. >> You can't. Please stay back. >> I AM. >> STAY BACK. MOTHER, stay back. >> Don't you dare. >> Mother. Mother, relax. >> Stay back. I can't believe you guys are doing this. By the way, >> I'm talking to the chief of police. >> Do it. >> What round? Don't talk to my mother like that. By the way, I can't believe you guys are doing this right now. For a domestic battery for what? He has no marks on him. >> He doesn't have to have marks on him. >> For what? >> For domestic battery doesn't have to have >> I don't understand that. How does that work? >> Every everyone's statements, the stories, the video, all of it together. We're going to walk. >> That's [ __ ] And you know what? YOU JUST NEED TO PAY for that [ __ ] new. MY TAXES pay for it already. >> I live in an apartment, ma'am. >> I don't care. How do I GET HIM OUT? >> [ __ ] SERIOUS. WELL, UH, >> I have the last time this happened. Do you have a pair of shoes that you want? >> I I got a restraint order. Any of these shoes? >> Which shoes are yours? >> Take the phone. I'll be at the police station. >> I I Which shoes are yours? But >> no, man. You guys are taking me how you are. That's how you're going to arrest me. Trying to offer these shoes. I'm leaving. >> Can I have one of those? No. You like seriously? This [ __ ] suck, man. [ __ ] suck. Is this because they didn't uh require medical attention? >> No, it's not at all. Do you want not want a pair of shoes? >> You guys should look at your last report. Find out where you Okay. You don't want a pair of shoes? >> No, man. You guys are taking me how I am. I guess I'm arrested. Let me go that way around the bags and stuff. I see. Ask him how he got here. Ask him how he got here. Who drove here? That's his truck there. He just got home at 10:30. >> I'm going to have Schaefer do them. >> I'm going to have him do >> I want you guys to do that. Ask him how he got here and how he is right now. >> Him do. >> He's Yeah, you guys are both drunk. Okay. So, why isn't he arrested for DUI then? >> I didn't observe him driving a car. >> So, what he's still And when did he tell you he got home? >> You know that for a fact, right? When did he get here? You know, when did he get here? Los Angeles. >> Yeah. I don't I don't [ __ ] care. >> Okay. Well, I do. >> But you you guys got him on report saying he just got home, correct? Correct. No, he never told me he just got home. >> Okay. So, I did. He just got here at 11:00 when all this happened. Correct. >> Well, I'm not arguing with it about it anymore. >> Well, you should. Then you can get two for one tonight. Okay. >> You can get a two for one if you want. >> I don't care about a numbers game. Well, >> that's more money than this whatever this is. Oh, you didn't even tell me to watch my head or anything, man. I wasn't being disrespectful to you at all, Mr. M. I never said you were being disrespectful. >> Yeah. Well, not a single point. >> Yeah. >> The paramedics needed one signature from you for >> I'm not signing anything. They didn't check me out. It's a refusal. >> It's the refusal that you just didn't need to go to the hospital. >> I don't care what it is. It's not my What law is that that I have to sign something for? >> Hey guys, >> me up to do all that [ __ ] Like, come on, man. Like, >> dude, I am not saying that I don't feel for you. >> You don't. It's your job. >> I don't like taking people to jail. >> Yeah. Well, if it's necessary. I mean, obviously, probably in this situation, you don't like, >> but I'm not willing to risk >> I'm not willing to risk my job over you. >> I get your supervisor wasn't there. I know your supervisor. [laughter] I mean, come on, man. >> Huh? >> My supervisor is well aware of the fact of the case. >> Yeah. Well, I I I understand. I know he wasn't there cuz I asked for him last time he was there cuz he wanted to press charges against me. That responding officer was like, "Man, this guy got [ __ ] up by him." And there was nothing he could do in that situation. I wish you were there last time. Honestly, you might have even saw what I looked like last time. I didn't press no charges. >> What's that? >> Sometimes I go to places like that, man. And I don't make arrest, but when I make arrest because >> I really I really hope that you guys were listening to me, too. If you ever see that truck past 8:00, past 9:00, just he's he's drunk, okay? So, I'm just letting you know like and it's parked on the street every single night. >> All right. I really hope you do because this is going to cost me I'm this man. This is going to cost me a lot of money, but I I I just want to let you know. Um I really hope that my courts are on your PTO because and I hope that you're actually a really nice guy and I appreciate everything that you do. Like I said, >> like I've said since the start, you have not been through me and not treated me any kind of way. I have nothing against you. So, >> all right. Well, I hope I hope you I hope you feel that way if you see me driving down the street cuz I always wear my seat belt by the laws, man. I very rarely I very rarely get out tickets. >> You just arrest people who got woken up from asleep to get [ __ ] started with. >> Man, dude, come on. That's all I'm thinking about honestly, man. Like really? Like [ __ ] This is going to cost me a lot more than just my night, you know? That kid gets to go to sleep. He ain't going to do [ __ ] He ain't going to do [ __ ] Man, I got like six hours of sleep in the last two days because of [ __ ] My >> boy had a baseball game on Wednesday.
