are bound by the Constitution yeah no clerks don't take an oath to the Constitution ma'am police even if you don't want to be bound by the Constitution just be a good person at the end of the day stop being a bad person this is my baby she belongs to me I never confirmed that I wanted her taken I never signed no contract I want her back baby back baby back baby back baby back give me my baby back okay file the paperwork do your job ma'am ma'am Ma'am why don't you do something with your life all right Sade Renee L All rights reserved perhaps she didn't understand overstand understand or stand by the fact that Julia's already told you that you have lost both appeals that you've sent to the state supreme court your appeals have been denied both times that's all she's got for you now speaking of court cases okay so what do you do when you lose at the state supreme court level well if you're a more or a sovereign citizen you file a federal lawsuit claim against everybody that ruled against you and this lady is no different this is actually what she filed in her federal case which was really nothing more than what she had filed and lost at in the this is a state supreme court so I'm going to go through uh this very rapidly and let you see what she has done she's actually just uh called it uh her amended complaint and it was her informal brief in her case in the state supreme court and she of course uh the whole thing was the termination of her parental rights she had her child taken away from her and lost all parental rights to it so she goes through and she gives her her version of what happened she arrived in an empty public parking lot grocery lot and she her goal was to just charge her phone and evidently somebody called in about a suspicious person or something I don't know what but anyway the officer found that she was DUI and had a baby laying in the back seat with a dirty diaper around its head or something it's pretty pitiful but anyway she lost her child and she fought the the state and made all these uh claims and allegations of what they had done to her and as you can see she was very prolific in filing a bunch of stuff but I've got a couple of things pointed out here that I just wanted to draw your attention to before we move on is that she admits that she have sent she had sent over 300 emails demanding her child back with also over 80 affidavits and the uh what their fascination with affidavits uh really astounds me but also she calls her child her property I thought that was kind of interesting and again she makes all of these claims and all of these uh criminal laws that were passed and I thought it was interesting here all law is a contract so therefore they got to produce a contract that she agreed to to all this stuff so anyway this is like I said this is just kind of silliness and it's funny here she admits again that she is continuously filed with the clerk of the court affidavits like I said I don't know why they get so hung up on affidavits they think that it's truth so therefore if you don't rebutt it uh you agree to it so uh that is what was uh she played in the state court and she went over and she pled it into the federal district court as well claiming that uh they had violated her constitutional rights and uh so this is really it's he or she I think she's got 17 defendants here and I won't go through this because it's really just a rehash of what she had filed and lost in the state court but it's kind of interesting here for the jurisdiction of course and for that it needs to be a federal question and or a diversity of citizenship she claimed both which was true and then she added her own little boxes of rights violations and Rico thought that was cute and of course she claims uh the Treaty of peace and friendship of 1789 between Moroccan Empire and the United States as some reason for it being a federal question as well as the uh of course the United States Constitution and what she thought was relevant she doesn't even bring out the diversity of citizenship but I guess it's would be self-explanator and of course the amount of controversy she hits It's a 75 000 because that's what it has to be and uh let's just go through briefly here uh here's what I found real interesting is here's what she's claiming they they all did and what's interesting here there's only one thing there that is relevant all these other things are are crimes and you know you can't have a private action for an alleged crime that has to be taken by a prosecution but her 42 USC 1985 three counts conspiracy to interfere with civil rights is uh you know a a claim that's recognized and she also brings in the Universal Declaration of Human Rights which is not relevant and then Canon rule I don't know whether that's uh biblical stuff or religious stuff or not but that is basically what her claims were all about that she filed in the uh federal court and now we're going to see how what the federal court responded on that now we're going to take a look at the paperwork from the uh federal district court and her claim and the first one we're going to look at is uh from April of last year and these are this is a report and recommendation of the judge after reviewing the case and her complaint and she's a flight of course for uh informal paparis in other words she can't afford to pay the filing fees or anything and uh it's kind of interesting the court here looks notes that the plaintiff's amended complaint appears to be her appellate brief in a Nevada court case in the title appellate informal brief planet has crossed out the word informal and replaced it with the words amended liberally construing or filing the court accepts this as her amended complaint however the court will not accept filings on another Court's form in the future to the extent plaintiff wishes to file an amended complaint the court directs her to the United States Court website where plaintiff can find a pro se civil Complaint Form now this is important to remember but I thought it was interesting the judge could tell that well she just you know crossed out some words and refiled the same thing but anyway he did uh Grant her to proceed in informal prosperous so uh the thing is is then then he takes a look at uh the case because when a judge looks at a case from somebody's filing in in uh former poppers they have to say is this a good is this a good claim can it withstand uh a motion to dismiss for failure to State Acclaim and without getting too far in the weeds what the judge looks at is have they made an actual claim have they given us enough alleged facts to realize that there is a claim under this particular statute and instead of just saying okay this statute says they can't do this and they did that is not sufficient you have to you have to allege facts of how they violated it and she really doesn't go into that at all which the judge is looking at so he uh he looks at all her and here of course is the discussion about her being parked in the grocery store and what happened and such is that but let's just go on here to what the judge looks at is for her complaints first of all the judge recommends dismissing her action on the criminal statutes that I was talking about before because as the judge says each of these is a criminal statute that does not provide a private right of action so naturally they were he just wants to dismiss all of those statutes with prejudice secondly he recommends dismissing the claims against the immune defendants with prejudice because judges in courts have absolute civil immunity for their judicial acts unless there is a clear absence of subject matter jurisdiction which there was not so gonna go to get rid of a lot more of the uh defendants if you will but then they look at dismissing the the uh the real claim the 1985 claim without prejudice and doing this he's not foreclosing her to refile and suggests is that therefore she should refile he's going to allow her to refile uh you know amended complaint to where she will actually allege facts that will create a basis for which a claim can be recognized and see the court also dismisses her unreasonable search and seizure and unlawful rest and do process violation claims without prejudice so she could perfect those so that's what the judge is doing he's saying is therefore recommended that the planet's claims brought under the criminal stuff be dismissed and the people with with prejudice and the people that are immune those their action is dismissed with prejudice and but they uh allow the claims to go further of without prejudice so she can like says the plaintiff will be given leave to file a second amended complaint to the extent she believes she can cure the noted deficiencies so there were the recommendations that the judge said so let's look at how they took those recommendations this coming down from November 2nd of last year and this is the order denying her motion to extend time and closing case now what she'd done is she had asked for an extension of time and the judge granted her an extension of time to file her amended complaint uh then she came she she was going to miss that deadline she came back and asked for another extension and that was granted and she missed that date and filed late and the judge looked at it and he said nope I'm denying your motion to extend the time you were given ample opportunity you've you haven't really perfected your claims and it looks like you're just saying the same thing over and over again so uh there's no way this will be successful therefore I am dismissing the whole thing and closing the case and as we go down here and he says very clearly it's ordered that the plaintiff's motion to extend is denied and that this case is dismissed with prejudice meaning she cannot bring it back again and the clerk of the court is directed to close this case no other documents may be filed in this now closed case so that that's the whole thing it says that the judge said says I find that allowing further amendments would be futile in other words she hasn't perfected her claim and it doesn't look like she's going to and she didn't do it on time anyway so I declined to allow it and direct the clerk of the court to close this case and this is what happens with many if not all pro se litigants they fail to understand their duties and their obligations as being a quote unquote an attorney so there you go that's what it was like and I think uh facts of frauds for allowing me to uh present this to y'all [Music] and thanks for joining Baxter frauds make sure you hit the Thumbs Up Button you're subscribed and ring that Bell for notifications so that I
