Hello. >> Can someone be on their way right now? Because I need my kids out of here. >> Okay. Relax. Relax. Yep. 104. We're uh we're with the complaint. We're with somebody out here. >> Yes. >> Hi. >> I was just woken up out of my sub. We're out. I'm I already have a ride on the way here. >> Hold on a second. >> I have a ride on the way here. >> Real quick. Real quick. Real quick. Real quick. >> I need my daughter out of that house. >> Look at me. I We have no custody agreement. He will not give me my daughter. >> Can you do me a favor and stop talking for one second? Okay. Can we put the child back in the house and put a coat on or something? >> I have my key. >> Let's focus on that. >> She can go in my car. >> She is not going back in the house considering they're already hurting the other child in the house. >> Okay, that's fine. That's fine. Listen. Focus on the task at hand. >> Stop talking around me and trying to talk at her. I'm telling you to do something right now. Okay? And that's for the child. Okay? That's what I need you to focus on. You're worried about the phone. This is not their first time. I'm telling you right now, I've had a restraining order against him because of one of these incidents of when I was pregnant with my oldest daughter of >> You're not listening. >> Okay. But my whole >> These are very simple tasks that I'm trying to get to you. Okay. >> Is he will not give me my oldest daughter because his mom is obsessed with being her mom. I have a ride. I have somebody coming here for my kids because of the simple fact of her dad just woke me up out of my sleep, Gary Antonio Brooks Franklin, and was choking me out and smacking me in my face. And that's why his friend Andrew Beer >> I don't see any marks on your face. >> He was sitting here. He He yanked me awake. He knows every every way to get out of it because this is not his first rodeo. I've had an order of protection against him actually before and I can literally show you. These are things I have to hide because he'll take my phone. This is not the first time his mom has. >> So, what brings you over here today? >> We have two kids together. >> We have been now since the order protection, he has he after our oldest daughter started having seizures. So, that's what started us talking again after the one order protection because I had a faulty lawyer got dropped because he actually I had CO at one point. Okay. and he didn't tell us when the date was really rescheduled. >> So the order protection got dropped. >> Okay. >> And so me and him, >> okay, >> our oldest daughter has seizures. He started we obviously started, you know, co-parenting and that led to us, you know, doing other things. So we've been in a relationship now for 2 years again. Okay. And for the last maybe four weeks, his grandparents, both grandparents just died. And one died on Christmas and one died in June. And ever since then, he has never been the same person. And I mean, I'm I mean, every weekend, his mom even knows this, so she can lie all she wants for her son. The fact that he has been hitting me again. He has been dragging me up and down those stairs by my hair. He has been doing everything under the sun of just abusing me yet again. And this is >> why are you at the house then? >> Because today, well actually yesterday we had my nephew's birthday party which I can prove to you that he has started every fight in the book because last night he was out. >> You're kind of going off course. What brings you here today? After my nephew's birthday party because of a FaceTime call because when I was sitting at my house when I had already drove home with my actually my Life 360 will prove I was already home. Okay. >> I was being told that my house was going to be burned down if I didn't come over here. >> Okay. >> And this is not the first time he's done this. So, I came over here. I actually live in Bloomingale. >> Okay. >> And he's telling me my house is going to be burned down with our kids in it. >> Focus. >> And so, we came over. >> Told me so far is that there was a nephew's party. I'm trying to figure out why you're here at this restaurant. >> Because we've been we've been dating for 2 years. Okay. Had my nephew's birthday party. He started a fight with me at 3:40 in the afternoon. >> Party ended at 4:00. >> Came here after because he's telling me he's going to burn my house. >> This is where the party was. >> No, this is their dad's house. >> So, he's telling me they're going to burn my house down because he's because I'm not coming here fast enough for him or I'm not coming here because he's calling me a fat [ __ ] because after I had two kids, that's his favorite thing to call me. >> Okay. And then now his mom, she has an obsession with being my oldest daughter's mom because she can't have kids anymore and she's only had one son. So she thinks she's my oldest daughter's mom. >> So she's like in there trying to play Lord Savior because she's obsessed with her son and they're [ __ ] each other, whatever they're doing. But she's making up all these lies when I have literal bite marks from him biting me and him sitting there and legit acting like a lunatic when I'm saying can you give me my daughter because I literally called my aunt. >> So what happened literally in the last hour that caused >> if you want to call Andrew >> he sat there. >> I'd like to >> he came upstairs. They got belligerently drunk at the bar. I had five drinks tonight. That's all I've had. And I wasn't planning on driving home. I was planning on having my aunt come and get me and my kids cuz I can't handle this anymore. >> Okay. >> I was sleeping in the bed and like I smoke vapes. I don't know if you know that. Okay. So, I smoke vapes and I was just woken up by being choked out of my sleep, told I'm a [ __ ] and stuff and asked for my vape because I'm a [ __ ] and I'm not [ __ ] him right now. That's literally what started all this was because I was sleeping and I wasn't having sex. And this his mom can lie all she wants, but this is not the first time that he has done this because I fell asleep and didn't have sex. >> Okay. >> But this is literally how he acts. >> Okay. So, he just woke you up choking you. >> Yes. Because he's he's raging because I won't have sex. And she'll tell you that this is this is literally how his dad acts. >> Okay. >> Yeah. Like this is And then now she's going to lie and he's going to lie and they're all going to lie because they're all liars. His dad's in there doing crack. His dad's a crackhead and he he has he has history for that. >> His dad literally does crack. >> So if you guys are taking what Gary Franklin says, maybe you guys should look him up because he's a literal crackhead. >> So >> what's your last name? >> Gosp. >> How do you spell that? >> G O S P O D A R E K. >> E R A K. >> E K. >> E K. And your first name? >> Angelica. A N G E L >> I see A. >> I see A. Do you have a middle initial? >> M. >> M. >> What's your date of birth? All right. Did you get physical with him? >> Yeah. After he's sitting there choking me out and I came up to see my child and him and his mom are literally >> Why don't you stand on a flat surface? Come on over here and just stand right here. Okay. >> Can you guys get my oldest daughter? Cuz there's no custody agreement and I >> We'll talk to them in a minute. >> She literally just kicked me in the stomach. I have a double hurry and a tear in my stomach. >> She's drunk and she's trying to take the kids out of the house and I'm just trying to stop it. >> Where did she kick you at? >> Literally right in my stomach cuz she knows which I'm going for a procedure tomorrow. >> Okay. Do you have any marks in your stomach? >> I I do not. >> I can lift it up and I doubt >> you if you don't have any >> I don't have My son's got them all over his neck though. >> Does she allegedly do that? >> Yes, she did it in front of me. >> Stand up. >> What's up, man? Why is my baby mama kicking my mother in my stomach, grabbing >> both? They were both out drinking, came home. >> And like my problem is she plays [cough] victim all the time. And like I I need I need someone to support me and my kids for once. Bro, >> this is the second time that this has happened and she's one also. >> I literally need somebody to support me and my kids for once. >> They take the kids away. She files fake restraint. >> Hold on. >> Let me finish. This is now the second time she's done this. The first time she literally took the child for 6 months. >> Filed a a restraining order. We went through the whole court process. They dropped it because she doesn't finish doing nothing. Let me finish. >> When she's done arguing with him, then she wants him back. But in the meantime, she takes the kids away. This is a procedure she goes through. She's intoxicated trying to take the kids out. I stopped it. I was holding her. She's reaching over pulling my hair out. >> My mom in her stomach when she has a hernia. I'm not going to allow her to take her right now. >> I'm not going to stop her from taking her kids, but she's not taking them today because she's drinking. Okay. >> And she was on the phone with her father the whole time. >> What's your name, man? >> Gary Antonio Brooks Franklin. >> I'm sorry. I can't write that fast. I'm >> Gary A. What? How do you spell your last name? >> B R O K S F R A N K L I N. >> Is it two last names or is it >> I got hyphenated last name. >> So it's Brooks Franklin. >> Yes. Yes, sir. >> Okay. So I need you to tell me in your own words what happened tonight. >> We were all out drinking. My mother was at home with the girls. >> Where were you guys drinking at? Uh caps right there park. Yeah. >> We all drinking. >> We come home. It's a problem. It's >> I'm taking my girls home. Like and like no that's like I'm sorry but like she's been drinking with me all night long. You are not about to drive my kids home right now. >> That's reason. >> Waking them up out of their sleep at what time is it now? >> 10:45 in the morning. Yes. Waking them up at 4:00 a.m. trying to drive my kids while she is drunk out of the house. I'm sorry, but like >> that that's not acceptable. Those are this >> No, I get I get that point, man. So, let's get let's move forward past that part. >> So, how does what how does the argument start between you guys? So, I'm assuming that was the argument. >> So, that was the argument that she was trying to leave with the kids. How does it result in getting physical with you and your mom? She started kicking my mother. >> Started kicking her and pulling my mother's hair. How is that acceptable? >> How do you get the marks on your body? >> BECAUSE SHE STARTED GRABBING ME. >> DID YOU SEE? I I have to ask because you didn't tell me. >> I'm sorry. I'm sorry. I'm sorry. >> So, did you try to stop her from kicking your mom and that's when she started hitting you? >> Yes. Yes. She started attacking everybody. That's not okay. >> How did she Did she grab you? Did she punch you? How did that how did that >> I was grabbed by the neck. My mother was being kicked in the stomach while she if you look up her medical records, my mom has a double hernia going on right now. >> And this girl is kicking my mother in the stomach at 4 in the morning. What is wrong with you? >> Okay. Um, what's your girlfriend? >> That's my baby mama. >> Baby mama. What's her name? >> Angelica Gospere. And like I'm sure you guys this is actually ridiculous cuz my kids were sleeping and she wants to wake them up to take them home while she's kicking my mom in the stomach. >> Your kid um J E M Y >> J M N Y >> Middle Right. [clears throat] >> No, I got you. Why is somebody kicking my mother with a double hernie in the stomach? Thinking that's okay. >> Uh, we're both >> So [clears throat] is his friend Andrew? >> Yes. >> Where's he at? >> I don't know where he left. >> He left. >> Literally, he walked out the door. >> He said, "Yeah, I'm not dealing with this shit." >> Assuming dad was sleeping. >> Yeah, Dad was there sleeping. >> Jason, my brother, was standing there watching the whole thing. He can tell you, too. >> Yeah. But like it's it's honestly like I've been framed for like I haven't been able to see my kids for 6 months because of this [ __ ] before in the past. >> We went to every court date trying to >> and like she kept resuming the court dates whatever and like I'm honestly like this isn't fair to me anymore. >> I got you. All right, give me a minute. All right. >> Yeah. Can someone go get my other daughter? Because I'm going to be with my kids. >> Because you guys are going to I'm going literally on Monday to get a restrain order. >> So, they're leaving with my one daughter. That's for damn sure. >> Her aunt. Her dad's almost here. >> How come she can't get the baby? We can bring them home. >> We're just trying to figure the whole situation out. I don't know anything. >> She's willing to go home peacefully. I understand, but you guys have weren't here during the whole incident. You're knowing one side of the story. >> Very true. But it's still her daughter. She can leave. >> I I understand that. But >> so can you guys go ask what is going on? Because I want to leave with my child. >> You'll come out in a minute and tell us. >> Oh my god. He is sitting there for 20 minutes listening to him while you listen to me for two seconds. >> What do you mean now? They won't. You going wild? >> Cuz they don't want to do their job because this is how the park comes. >> Calm down. Your daddy don't come. We'll take the car and everything. >> No. No. No matter what. No matter what. Take my car. >> Yeah, we'll take your car. >> Thank you. Take my car. >> Take my car. No matter what. He is not to ever see my kids. That's it. Because his mom's sitting there trying to press her. Take a matter of fact, leave with my car right now. No. No. Yeah. Because sitting in my car and no one's allowed to console her because of these police. My child's sitting in my car. >> You can open the car. >> No, the guy told me I'm not allowed to open the car. >> Drive the car. You can open the back door. >> No, the guy literally said I'm not allowed to open it. I'm not allowed to go near my car. >> He doesn't want you driving it. >> Just calm down. >> You can console the child. >> The fact that he's sitting there taking notes with her with his fat ass mom. They have to investigate and get everybody's point of view. >> Angelica, calm down. >> Don't instigate anything or you're going to get in more trouble than where you are. >> I want to hear what they're saying. >> Angelica, stay out of the house. >> Angelica, >> stay out of the house. >> Stay out of the house. >> Child, can you just help me get my child? >> Stop yelling at me until we figure things out. >> Come on. They going to arrest your ass. Let's go. Let's go, man. >> This is what they do. >> You don't want to get arrested, dude. >> Jenny and Tony do. This is what they >> You're not making it any better. >> Calm down. You have to calm down. They will arrest you. >> Yes. >> This is what Jenny and Tony do. >> Just relax. >> This is fine. But you still have to talk. >> Give me my daughter. And this is what Jenny does. She's not going to give me my daughter. >> Yeah. You don't you don't get them. You don't get the kids. The mother is running. They're literally her mom is trying to fight me, right? His mom is trying to fight me, but that's okay. But they're not going TO GIVE ME MY DAUGHTER. >> I know, honey. >> Put your coat on. You Where's your coat? Okay. Bye. >> They're literally not going to give me my daughter. >> Yes, they are. >> I'm going to leave the keys myself. This is literally what they're going to do to me because they know >> that this is what they this is legit what >> investigation. You don't get the kids. Just >> this is what Tony's mom does. This is what she does to me because she is abusive. They're not going to give me my daughter and that's the end of it. They're literally like this because they know that I don't spend any time away from my child. >> They have no right. They have the woman control it all. They have no >> right. His mom is alive. She literally was sitting in there saying I kicked her. Please grow the [ __ ] up. Stop saying I kicked you. You're just fat and you have a double hernia from having too much sex cuz you're a [ __ ] >> Lie. >> It will lie. Laugh. I don't really >> smell it as soon as I not to drive at all. Even if she does leave, she's not dead. >> Yeah. No, not at all. >> Just to be safe. >> That's why we all her father's on his way and her stepmom. So we going to take the car. I appreciate your >> Hello. >> Hello. >> Hi. What? Uh, what's up? >> Oh, no. I I thought you say Oh, no. It's all good. It's all good. I got a little bit of a Is he okay? >> Okay. Same thing. >> Okay, cool. Um, can you I know you kind of explained everything here to the officer. Can you kind of run that through me one one time? >> What happened? >> I am honestly just fed up to this point. I have lost this this little girl for seven. I just kind of want to know what happened tonight. What? Like what caused everything? >> Nothing. We were out drinking. >> Uhhuh. >> We all came home and it it it was a problem. Like it literally was a problem from her. >> Okay. >> And it was I'm waking the girls up. I'm taking them home. Drive driving driving home. How are you driving home? >> Okay. >> Literally drinking all night. >> Okay. And that was it? >> What do you mean? >> No, I'm asking that that's that's all that the that's all that happened. You guys came home. Were you guys sleep? Was everybody sleep? >> Everybody was pretty much Can I tell you or No, you want to hear? >> I'm just trying to finish up what he said. Okay. But yes, like literally everybody was sleeping. We all came home. It was me, me and her basically, me and my buddy up. >> And it was just >> like, okay, we can't get along. I'm taking and this is how this has been for pretty much a year now. >> Okay. >> Pretty much a year or two. It's like anytime we get into any disagreement, any argument, it's I'm taking you to court, I'm taking your kids. You'll never see them again. >> Okay. So, probably moving on forward, you probably you guys should probably separate, especially when there's alcohol involved. >> Yeah. >> Okay. I don't know. Are you mom? >> Yes. >> Okay. Maybe you could probably help facilitate that. >> I do. Trust me, you know, I don't allow that at all. I work until 8:00 at night when I come at home. They don't do this. This is literally now the second because I have a problem with it too >> because they cannot get along. This is the second weekend in a row they went out drinking. >> Mhm. >> And both came home and said, "Yeah, we can't drink with each other cuz we don't get along." >> She's immature. She's young. She's very jealous. So even if he does one thing wrong, it's an issue and it doesn't stop. >> So all night long I can hear them bickering. >> Gotcha. >> And that's literally He was up here with his friend. They woke me up out of my sleep. He went down to bed. His friend was here for about a half hour just talking. When we heard both of them come upstairs, she came up, >> started screaming, "I'm sick of this [ __ ] I'm done with it." Goes to the bathroom. He came upstairs like 5 seconds behind her. Then she proceeded to go into the kitchen, scream at Andrew about taking him out drinking and she's tired of it. Came in here and said, "I'm taking the girls leaving." I said, "Time out." I said, she she came up here and said, "I'm taking the girls and I'm leaving." I said, "No, nobody's taking anybody anywhere." >> She said, "Bullshit." She ran downstairs and I know she's drunk. So I Kaani was laying there awake. I grabbed and I was holding her just like this over there. She came upstairs tried to take by her arm pulling her out of my arm and I did this and I said, "You're not taking her." >> So then she goes and grabs the other one where she can get her >> and put her jacket on and she comes over again and tries to pull her out of me. At that time she then >> I was on the phone with the 911 operator. She can tell you everything. Hold on. Okay. >> She proceeded to kick me in my stomach, grab my hair like this, and I literally was screaming, "Operated Caner. Angelica, stop. Stop." And I pushed her back like this on the couch. She was literally sitting next to me screaming. She He yelled, "Don't kick my mother." She jumped up and attacked him. They both went flying that way. She grabbed the baby money out the door. All this was going on while on the phone with the 911 lady. >> She attacks my mom. Attacks me. >> She kicked me cuz she knew I was having a procedure tomorrow. That's all that is. >> Okay. >> Do you want anything done? Do you want to sign complaints against her for anything? >> Can you also do >> Hold on a second. >> Do you need any medical attention? >> I do not. I do not. >> All right. So, you don't want to be you don't want to be seen by an ambulance? >> No, I do not. I'm going tomorrow, like I said. Yes. >> Okay. All right. Do you want to have Do you want to pursue any uh sign complaints against her? >> Here's my problem. I would love to sign a complaint of the fact that she kicked me and pulled my hair. >> Okay. >> But I know how she is and I'm deathly afraid of losing these kids again. >> Yes. My problem. I lose my kids. >> I've already asked you to hold >> I don't I don't want to be disrespectful. >> You understand? Thank you. I appreciate that. Go ahead. >> So, I'm torn. I'm literally torn to be honest with you guys. >> Okay. >> She's done this before. We've lost this one for 6 months. Like he was telling you, we followed through the procedure. We were there every day. We don't want full custody. Nobody wants full No kid should ever be away from both parents. >> Gotcha. >> The problem is it won't get there with her. And she's for 6 months. >> We lost those kids. >> Gotcha. >> And there's nothing done. They got back together, had another kid, >> and this is her weapon. >> Gotcha. Okay. >> She filed a restraining on them last time and it wore off because it was lies. And that's literally what she's threatening to do again. >> Okay. >> So, I don't know what to do, honestly. So, what you can do, you could possibly you can get an order of protection against her. Okay. I'm going to write a a report. >> Uhhuh. >> Well, it's that's up to you. Okay. So, it that you know, the whole family court thing, the whole family court thing is going to be between him and her. Correct. >> And whatnot. You know, you can always, you know, do a child custody thing at the police department if they want to hang out with the kids. you know, if you want to see the kids, you can pick the kids up over, you know, at the police department so she's not violating the order if there is one and whatnot. Okay? So, I can type everything up. You could take the report and then you can go to the county uh office and then see if you can file for order of protection. That'll be completely on you, though. >> Okay. Then I want to do a report. Yeah, I do. >> Okay. >> I do. This is not going to >> This is not fair anymore. I'm never going to see my kids again. >> What are you talking about? >> She took Don't you just >> She took her away from me for 6 months already. She's only 2 years old. >> What's your last name again? >> How do you spell that? >> B R O K S. >> Like this is not fair. >> What's your first name? >> Jenny. >> Can you hold on? What's I'm sorry. Jenny N. >> Is that how it appears on your driver's license? >> Absolutely. J E >> and I apologize. I'm now a Pike. My license is like one half of me is Pike. One Evans Brooks. I'm transferring over. I just got married. So, put >> So, how does it appear on your driver? >> I got my license. I apologize. >> P I K E. >> P I K E. Yes. >> And Jenny, what's your middle initial? >> R. Rebecca. >> What's your Uhhuh. >> Okay. >> And like I told her, I don't care if her parents come. >> Okay. >> If her parents are coming, I got no problems with them taking the baby. >> Okay. Where is my >> Where's your dad? No. Is your dad there? >> Inside. Inside. >> Come in. >> Inside. I don't want I I don't want Not not right now. >> Well, her dad can come in and get the babies. >> I don't want to talk about that right now. Okay. What do you What's your name? >> Tone. Gary. Tony. Gary. Name. Gary. Tone. >> You don't want to shake your hand. >> Do you It's not that I don't watch. I I got I'm a little bit under the weather and stuff like that, so I've been kind of using trying to clear everything up. [snorts] Um, >> what do you want to do about the situation with this with her? >> Okay. Obviously, things got a little bit physical of some sort with you two. >> Okay. >> Yeah. With >> Do you need Do you need any Do you need any medical attention? >> No. No. >> Okay. Do you want to pursue charges against her? >> Yes. >> Okay. For domestic battery? >> Yes. >> Okay. All right. So, she's going to be placed under arrest. She told me that you woke her up because you guys didn't have sex. Okay. And there's >> that >> I'm just letting you know. Okay. So, all right. So, hang tight. Let me just run uh run things past her. Let me find out what's going on. Okay. >> And it got the kids and stuff like that. I don't know how this is going to end like that. You're going to have to run this story past me one more time. >> I was sleeping in Tony's. But can she stop looking at me? Can she go? Why is she allowed to be intimidating? This is the third call to this house that she's being intimidating at. >> We need to focus >> because Okay, focus. >> I'm laying in the bed sleeping. Mind you, we came home at 3:00 a.m. You can ask Ally and Leo at Cap Sports and Bar. Okay, now this is You wanted the story >> everything here. >> I go to bed. Ask call Andrew Ver. He lives right. He would they would tell you Andrew Ver. He is Tony's best friend. They got extremely belligerently drunk. Okay. I had five drinks at all the bars we went to collectively. I had um one drink or two drinks at Caps, one drink at Dito, two drinks at Josephine, and one drink back at Caps when we just went five drinks. That's all I drank for the whole night. >> Gotcha. >> Okay. >> And I'm I'm only up to that. I'm 21 years old. I'm allowed to go out and drink. I never was trying to drive with my kids. Okay, I'm going to I'm sleeping downstairs and he comes up. He goes to the bathroom, piss in his sink, and then he comes up to me and starts choking me up, looking for my vape, which I no longer have. >> Okay. and he's looking for my vape and telling me that I'm a [ __ ] because I'm not [ __ ] him and choking me up because with the blanket everything like sitting there yanking me around the bed and then he lets go. He he goes and walks away. So I walk upstairs. I go to the bathroom. >> Mhm. >> And his mom is up. Both my kids are awake. She's talking to Andrew Ver on the on the um living room floor. And >> so I say to them, I say, "I am done with this. I am not dealing with this anymore. This is now three weeks in a row that he has on the weekends literally just started beating my ass when he's drinking. Okay. >> Because he's mad I'm not either having sex with him or he wants something from me. >> So, have you learned your lesson about this whole situation? Obviously, the alcohol is obviously >> the deciding factor between you two. >> Yes. And I'm I'm like actually done with him. >> Okay. So, what do you want to do about the situation that occurred today with you guys getting physical? >> Nothing. I want my kid. I want to move forward. I want to go to court now. I want to get a child custody agreement and that's it. >> Hang tight. You're not free to leave. >> Okay. Can I see the officer said you had some marks on your neck? >> Back shoulder area. >> Yeah. Lift it back some. >> But yes, I always grab >> Watch out there. There's what he's talking about. All this here. >> Okay. I I mean I see maybe like some redness. >> That's what he was talking. No, that's not part. >> Okay. [clears throat] >> I talked to her. She said that I, you know, it did get, you know, you guys did kind of put hands on one another and whatnot. Um, so I'm just trying to see who the primary aggressor is and whatnot. Um, so like I said before, you said you did want to pursue this matter. You can either, you know, there's a couple of options. I should have, you know, explained this a little bit more. You know, I can, you know, document the incident. Um I can give you you know some uh resources uh to kind of see what you can you know kind of pursue you know >> I kind of would and >> whatot yeah >> okay you are going to go to court and everything like that for you know for for domestic you are going to go to court and whatnot sign complaints and everything okay >> all right yes that's what I have to that's what I'm ask I'm asking you know do do you want you know I can either you know we could sign the complaints Or I can just have this documented and you can follow up at a later time, you know, and just put it on record. It's kind of up to you. >> Do you have Do you have a preference for me? Cuz I'm >> This is completely up to you. >> My kids I'm literally thinking about for my kids. >> No, I I understand. I understand. Um if I place her into custody. Okay. What are we going to do about the kids? >> What do you mean? What do you mean? >> Are the kids going to stay here? >> The kids are going to stay with the father. Yes. I'm just want to make this incident being drunk tonight. >> He's a little bit under the, you know, influence and whatnot. So >> that's why I've been there. Correct. >> Okay. All right. Sounds good. All right. So, I'm going to place her in custody and then for domestic battery. >> Okay. All right. Can you I need to take some photos >> of your neck. Right. Can you give little one over to mom? >> Yeah. I'm going to go right over here. >> Can you go back? Can you go by Nani? >> Slide over here by Nani. This is so sad. >> Can you just pull your shirt up? >> Yeah. This is so sad, man. >> I need to see. I I >> He needs Take your shirt off, Minnie. >> You want me to take >> Sure. That's fine. >> That'll help him out. >> Turn your Yeah. >> I mean, it's so damn faint now. >> I just don't see I I I I I don't see the redness. That's all. I don't know. >> You don't see this like toe bone area there? a little bit. Okay. All right. >> And then you can see the marks here, too. They go on. >> Gotcha. Okay. All right. Uh like I said, okay. I'm gonna place her into custody. Uh and then uh I'll keep you posted. Okay. >> Are they bringing the other baby in? >> We'll once we, you know, >> figure that part out. Okay. >> Thank you. No problem. >> Parents are the parents allowed to talk to me? >> We'll wait until she's gone and whatnot and then you guys can all kind of chat and whatnot. Okay. Okay. >> So, basically, just to kind of recap, you guys were hanging out >> and we were at the bar. >> We're not worried about the bar. I'm worried about right here. What happened tonight? What caused the whole >> him and his friend Andrew up here hanging out? Literally, >> he went downstairs. I don't know whether to go to sleep or whatever. Wasn't even down there 10 minutes. >> Mhm. >> She came up screaming. He came up behind her and then that all escalated. >> She all of a sudden just came up. >> My mom came up and [ __ ] >> Yeah. She came up screaming. Yes. had an argument with him. Hold on one second. Okay, >> please. >> Okay, she had an argument with him. >> Like I said, they were down there not even 10 minutes. There was no yelling. There was no yelling. She came up the stairs and said, "I'm sick of this shit." She yelled at Andrew, his friend, which we can get him if you need him. >> Okay. >> Uh she yelled at Andrew and said, "This is your fault for taking him out drinking, continuing to drink." And then she went, >> "Was she at the bar with you?" >> Yeah. >> Okay. >> Yeah, that was at the bar. And that was it. After that, she came out of the bathroom and said, "I'm taking the girls. I'm leaving." I said, "No, Angelica, you're not." >> Okay. That's when you had little one in in your arms. >> They were Yes. No. No. I didn't pull little one up till she came upstairs. She came fly climbing upstairs to grab the girls. She came and sat in my lap. >> Mhm. >> And then started screaming at me like I said, "Grab the other one." Cuz she knew I couldn't hold both at the same time. >> Mhm. >> I was literally sitting right where she's at. She came over, literally kicked me in the stomach. And what did she do? What was mommy doing? >> I Come on. >> Okay. She was anyhow puna from your her arm. I tried to get her out of my arm. I wrapped my arm so she wouldn't pull it upwards. All this you can hear the 911 call. That's when all that was going on. >> Okay. And you said that she kicked you in your stomach. She kicked me sitting down right here. Right here. Right here. Okay. >> Literally I went to the ground with the baby like this. Got >> on the floor. Pulled you into her. Okay. >> Correct. >> All right. And then that's when she grabbed the other one. No, she's literally the whole time she's doing she's picking and >> Okay. >> All right. Sounds good. >> Yes. His mom's trying to literally put scratches on him and I'm watching this now. I'm going to start recording this because never once did he look at my body without a shirt on. That's actually crazy because his mom's sitting in there scratching him in front of the police officer. No, >> we have body cameras that record. >> Somebody better [ __ ] house. >> No, because this is ridiculous that they are doing all this for Tony, but they can't even look at me besides the police officer rushing me and asking me what do I want to do? I said child court because is this the first report of him? Is this a report of him beating my ass or did I HAVE DOUBLE BLACK EYES two [ __ ] years ago? Is this the same report of the house? Pull it up after right after St. Patrick's Day. Pull up the report because this is his house. >> No, this is ridiculous that they are doing this for Tony and kissing his ass because he has one [ __ ] head with his crackhead daddy who got a warrant in the house. Maybe you guys should run that Franklin. >> Run Jenny Brooks, too, cuz she got a warrant too. The mom who's holding my daughter has a warrant. No, cuz this is ridiculous. Tony has had a warrant because he has a DUI. Let's go. Like, oh, this is Villa Park for your best friend. You have four, Listen to me. You have four or five people telling you to calm down. Maybe you should console your daughter instead of screaming at us. >> No, I'm not allowed by my daughter. I'm not allowed to go by my daughter. You guys have literally said I'm not >> You stop being dramatic. I told you you could go. That guy has said you could go console her. You can't get in the driver's seat cuz you've had you've had a lot of drinks, but you could go console your daughter. You got to calm down. They don't >> they won't get >> and she is going to be abused by her father like everybody else is >> again >> okay so you're going to be placed under arrest for domestic battery. Okay. >> You see this is [ __ ] [ __ ] because of Tony. Are you [ __ ] kidding me? Put your hands behind your back. Stop letting this happen. Here comes a donut. >> Take my phone. Take my phone. Take my phone. Put your hands on your back. >> What do I do? How do I get out? [ __ ] pay because of his mom. >> I want you to calm down. >> No. This is Tonyy's doing because they don't want me to. Wait, are we kidding? The babies >> live with us. They live with us. They live with us. >> They live here. >> No, they live at my house. NO. [screaming] NO. NO. THEY LIVE AT MY HOUSE. Help me. Mom, how can I get out? Can you talk to me? >> I already did. >> I already did. >> No. Can you just tell me what's going on? >> You're getting arrested for domestic violence. >> But for what? >> You put your hands on him. >> BUT HE PUT HIS HAND ON ME. >> What about this? >> What about this? You guys aren't arresting him for putting his hands on me. If the father says he's got apparently marks on his neck of her scratching around, >> how do you know they're not self-defense? They both need to go to jail. She said that's he said, she said. I want him arrested as well. >> Listen, because one has >> It doesn't matter. It had fights all the time. Everybody's going to jail. She said she was as well. She can She can [ __ ] file a police arrest. Do >> you want to keep yelling or you want me to answer? No, you can [ __ ] arrest them both. >> Don't just take one. >> You're going to be like that now? >> That's [ __ ] stupid. She said she was being beat on. >> Have I been nothing but nice to you guys since you guys got here? >> She's been beat on as well. That's not fair. That's not fair, man. That's not fair. One word to the next. The mother's in there. She was being beat on as well. >> That was the first and they were hitting her. I could hear them hitting her on the phone. >> Okay. >> All right. So that >> both of them were attacking her. >> There's no other witnesses other than >> she said there's a guy. Call him. >> She said there's a guy that he kicked out the house. Call him. And he witnessed it with his own eyes. >> She called in. I don't want those babies left with [ __ ] crazy people. >> There's not much that I can do. The babies have to say with the father. >> Okay. >> You guys are insane. Why don't you call the witness and see if he was he was >> completely unwilling to be a witness if he left? >> Yeah. Yeah. >> No, they kicked him out the house. >> They said he left. She said that, too. >> The only thing I have is that she called. He said they were beating her ass. There's a [ __ ] problem beyond her. >> It's not going to change him. >> It is. The babies need to go with their grandfather so that they're safe and not with [ __ ] [ __ ] people. >> Okay. Let me ask let me ask them to see if they're willing to take >> They don't have to take the other child out. Yeah. >> Okay. Let me talk to my grandfather. >> But they did. They did. She called me. I don't know 30 minutes ago. Obviously. >> You can hear the lady. >> I'm sorry. Who are you guys? >> I'm the grandfather. They live in my house. >> Angelica's dad. >> Angela's dad. >> All right. And you guys are >> and uncle. That's That's the father right there. We have no >> grand your uncle to >> Angelica. Angelica's dad. >> Yeah. that the kids can go with her parents. >> No. >> No. >> He's the guardian. They can come back and get him in the morning. >> Is there the primary residence is not here. >> I'm just trying to listen. I'm trying to >> Look, I'm not doing She She's under arrest. She's under arrest. So, she's not going to have the kids tonight. >> Okay. I understand that. And there's no problem with them staying here tonight and they can come back and get them in the morning. I'm not >> This is the morning. It's already It's 5:15 in the morning. So, I'm trying to I I'm I'm trying to make everyone I'm trying to get everybody >> where there is >> This is where I'm going to have an issue. This is where I'm going to have an issue. >> I'm going to have a big issue with this. >> Why? Yeah. Why? >> Time out. Why? Why do they feel it's right that the grandparents and not the son, the father take care of their children? >> Where did the Well, he can't take care of the kids. >> Correct. And And I'm here influence >> and I'm here and he's the father. I mean, technically, if we want to, you know, if we want to really get into it, then, you know, if he's under the influence, he can't care for the kids, then maybe maybe I have to call DCFS then to come take custody of the kids then, since both parents are under the influence >> of alcohol. I don't want to get into all that. I'm just trying to I'm trying to make things, you know, I'm trying to make things right for the children. I'm trying to make I'm trying to make things right for the kids right now at this point. >> And so am I. I'm just asking. I'm not trying issue. I'm not trying to rip kids out of houses, please. >> That's what's going on. I just trying to do >> If you were gonna bring the baby in, but because she overreacted out there. >> No, that's going to leave the baby. Go with her. >> It's not even that. It's not even that. Well, that that's kind of besides the point. It's not going with her because she overreacted. She's under arrest. That's why she overreact overreacted. I'm talking about her parents where she resides, where all the kids where the kids reside. At least that's what the grandfather's telling me or her father is telling me. >> And if you want I'm just asking. I understand. But if you want to go there, >> they're here. Time out. >> Cuz now I'm aggravated. So time out. >> They're at that house two nights a week. >> They live here more than anything. Their address goes there. Their daycarees down the street. They're here five of the seven nights. So that's a lie right there. All right. >> So, don't don't don't go out and if you don't mind me talking. I got no problem with obviously you do because they're telling you they're saying that they want to take the kids, you know, for the night. So, I don't want to have the argument. >> If they could have them, that's fine. >> Give me Yeah. Does have a little baby have a jacket on? I don't know what >> she Yeah, she threw a jacket in. She's in car seat. >> Yeah, she's in the car. She's been the whole time. >> What do you want to do? Can you give me a minute and let me make sure he's okay with it? and then I'll get her jacket on. Okay, >> that would be great. >> You guys want her? But like I just want to know like is this right to me? Honestly, >> slide up. >> If you don't have a custody agreement, then you don't really have a choice. >> Illinois is a state. >> Mothers have mothers have 51% custody from birth. >> Unless you have a custody agreement, you don't have a say in anything. >> Okay. >> Correct. >> I know I knew that. >> I know it's unfair. I know it's messed up, but fathers in Illinois really have to fight for custody. >> No, I get that. But like, >> can you guys see my goddamn daughter with me right now? Like, >> can you do me a favor? >> I don't doubt that she loves you. And I don't doubt that you love her. >> Unless you let me take her out, >> she's not going to go to either one of you. >> No, we're not going to ask. We're not going to try to No, no, no, no. I'm just saying I couldn't hand [laughter] you. Okay, >> let me talk to them for a second. Let's Let's get her out cuz I don't want to keep doing this back and either. >> Let me find out. >> Let's have her come. They're willing. >> I was able to have her bring out so we're not [ __ ] Okay, >> maybe we can dial it we can dial it back a little bit. I understand emotions are high when especially when children are involved. We're all parents. We all understand. >> I don't Yeah, I don't think they have the ability to >> I have been here a lot. I know it's an unstable household. I already know all the I already know all the history for the most part. >> I'm driving. >> We're trying to tell her to stay calm. Okay. So, just situated with the child. >> Is there going to be an issue if she comes out here? Is there I don't want a screaming match. >> I've actually only met him like >> No, I'm pregnant. The child's not going to come down. >> That's fine. >> Hello. >> Hello. >> I'm going to go get her jacket. >> Okay. Thank you. >> I need another jacket. >> What do you need, Mom? She has socks. Socks and shoes. >> Yeah. Get her jacket. Get you some stuff. Okay. You got to go by Button. Okay. I know. I'm going to go by Button's house. Okay. >> Oh, I see you got Bluey Bluey PJs. Those are nice. >> Okay. I got a Mickey Mouse one. >> You have Mickey Mouse ones? Wow. >> How do you fall going up a stair? Slow down. >> You need help with your >> do [snorts] pumpkin. >> You need help. >> Watch out. jacket. >> I got shoes. I got shoes. I just need a jacket. She probably has it in her car. >> But how are you? >> It's Yeah, it's the big one. >> The big one. The puppy one. >> Yeah, that one. >> Yeah, the big one. Yeah. Once we get to the car, we can talk to >> And is right there. >> Okay. >> Soon as she's out, I just got to ask a couple questions and we'll be out of here. >> So, uh, she's going to go to jail tonight. Uh, she's going to be transported out to DuPage County. That's just standard with all domestics. If she makes it on time, if we're done with the process, she might see the bond judge in the morning. Morning being probably 8 or 9:00 today. If she misses that, there's another session at 1 or 2 in the afternoon and then she'll be released with conditions to not have any contact with you. So, >> you guys can figure it out from there. >> Yeah, >> maybe you >> Mommy Mommy will be Mommy be home soon. >> She will be home soon. >> She'll be home soon. Okay, don't worry about that. Mimi's outside. Button's outside. Okay, we're not gonna hurt you. >> Wait, Tony, let me get out of this. Let me stand up and let me get out of the standing up position. >> I know. >> Come here, man. >> Let me You're not going out by them. >> I don't >> You're not going out by them. >> Yeah, let's just for a little bit. >> No, it's not. You don't understand. >> It's okay. >> Come on. >> She wanted to do tonight, but now it's a problem. So, I agree with you. However, the officer or whatever you guys worked out inside where the kids can go stay where they >> didn't we were told we had no choice. >> Okay. I don't know. >> Which which I know is a lie. >> I get that Illinois is a 51% where the kids normally stay at night. >> Five nights of the week they're here. >> Well, they say the opposite. >> Of course, they're going to say the opposite cuz that's their daughter. And I would do the same. But that is out and out lie. Okay. >> So, >> that woman is here from Tuesday until damn near Monday every night. Half the time it's six nights. >> I don't know what to tell you. I'm not the one who decided that the the guests were the kids were gonna go. I don't have that answer for you. >> Yeah, you're going to go a [ __ ] [ __ ] I'm I'm done and that's wrong. It's wrong. >> I don't know what you I'm going to tell tell you, miss. That's what was decided for the night. >> That's the That's the father. >> So, how does he have no rights? >> I didn't say he had no rights. So then why would they say you guys have no custody agreement? >> If you want if >> it doesn't matter. He's the father. He's on the birth certificate. >> You have to have a custody agreement to keep your kid. >> If you want police enforced custody, then yes. >> So what right do they have? >> They're grandparents. They say the kid stays there >> and I'm saying they don't. >> Okay. You're arguing with the wrong person. I was out here when that decision was made. Right. Did I Did I tell you that that's what was going to happen? The officer in there didn't tell you either. >> Yes, he did. here. >> This doesn't look good for her, though. There's so many across the >> I've already go through and you just tell me yes or no. Okay. Um, has she ever in the past, like since you met her, has she ever hit, slapped, kicked you or someone else? >> Yes. >> Um, threatened to harm threatened to harm you if you called the police? >> Yeah. Yes, I do. Um, have you known about her fantasizing about harming or killing someone? >> No. >> Um, has she ever harmed or threatened harm pets or animals? >> No. >> Uh, she ever she's threatened to kill you before? >> No. >> No. She threatened to kill herself. >> All right. Can we be truthful >> since you met her? >> Yes. >> Okay. This is This is the time to be truthful, right? this is going to help you out a little bit and hopefully give her the help she needs as well. Has she ever prevented you from seeking assistance? Like prevented you from calling 911, prevented you from seeking counseling services or anything like that? Have you tried to call 911? She pulled the phone out of your hand type stuff? >> No. All right. >> Has she ever threatened you with a weapon? Like something specific? >> Does she have access to guns? Do you know? >> I I I honestly >> You can say I don't know. >> But yeah, I don't >> unless you know for a fact then No. >> No. Yeah, I won't. I don't. Yeah. >> Uh does she have a void card? Like the firearm card, you know? Uh has DCFS ever been called? >> No. >> All right. Um the kids ever seen any arguments between you two? Like physicals? >> Not nothing. >> No. Honestly, not right. >> Um, [cough] has either one of you recently had either like divorce, job loss, death in the family, anything >> that would trigger anything with you two? >> I had uh two two uh grandparents lost and she had a grandparent loss too. >> We all we all Yeah. All both of us had grandparents lost recently. Okay. >> Uh, do you know if her abuse drugs or alcohol? >> Does she abuse drugs or >> um, >> they both drink sociably? Yes. >> I'm talking to him. Just give me a second. >> No, I'm just mad right now. I'm pissed. >> I know. >> I'm pissed. >> In her past. Yeah, she she was on >> not past. You don't care about past >> watch for uh >> suicide watch cuz she overdos. >> Just give me a second. Okay. >> Yeah, please, Mom. You're not making it any better. I know you're upset and I understand the kids are involved. Okay. But I have to ask him these questions and you cannot answer for him. >> Yes. Just >> this is a legal document that he needs to answer if that makes any sense. >> Okay. >> You're fine. >> Um what kind of do you know or do you use any kind of drugs? >> H >> drugs? >> No. >> Okay. Do you want any kind of treatment, the paramedics [snorts] or anything to come look at you? >> No. >> All right. >> You did she damage anything while you guys were fighting? >> Honestly, I'm more pissed off that she was kicking and pulling my mother's hair. >> I understand. I just need to know. Is there property damage as well as >> No. No. No property damage. No. >> All right. Did she Did she do anything to the kids like threaten them or yell at them or anything? >> What I didn't like kids? >> What I didn't like was she was ripping them out of trying to rip them out of my mother's hands and [ __ ] like >> Okay. >> Other than that, no. >> Where's your phone? >> Do you want the videos? All right. Um, are you concerned about future assaults from her? >> Um, if you want my honest opinion, I am concerned about her assaulting my kids more than me. If you have videos of anything that she did today, not from like two years ago or anything like that. If there's something today that she did, I would like those. If you have them, you can send it to that email address. >> Mhm. >> And then uh I will forward it to the other guy cuz it's going to be his uh his case report. >> Okay. >> Do you guys have any questions about anything? obsessed with BEING >> ME. Why can you not give me >> You're not a good mother. You're not a very good mother. Okay. >> And I'm not her parent, but like she's she's she's >> entire. >> Yeah. That's the only reason I didn't want the babies going out in the car. And that's what we said like we're calling the police. You can come get the baby in the morning. I don't care about that. >> And I told the other officer, you've never been I think both parents should have rights all the way through. >> I agree too. Illinois doesn't agree. >> Like and it's not like I'm trying I I It's not like I don't want girls to matter if you're father of the year. Illinois does not care. >> No. Yeah. >> Unfortunate. Uh yeah, it is unfortunate but yeah >> and I don't agree with it either. >> No, >> I think it takes two people to make a baby. They should both fail equal rights. But >> correct. And I Yeah, that's what I was just I apologize for you. >> I hate when she was started crying like that. That really upsets me and I don't understand why they had to pull from a parent and he said because they're grandparents, but so am I. And they said the baby's there more. They're not. I >> They're You know what I mean? She said, she said it just >> unfortunately this is something that's going to have have to be handled in court and there has to be a child custody agreement. So to avoid future incidents like this, you have to let the paperwork fight for you. So you have to have an agreement on paper that both sides have to legally abide to >> do. Well, now she's going to just try to file a restraining order agreement with her. the court is going to issue an order protection in his name against her for at least for the foreseeable future. While this court case continues, while she's out on release, once she gets released, it's more than likely going to state that she can't have any contact with him specifically. Nothing insulting or provoking. Um, it's going to have limitations or restrictions on child care and where they can be, who they're going to temporarily place custody with. >> That's all based on but that's up to them. That's not up to us. They're going to read our report and see what they think is best. >> Okay. So, but you are the victim in this case. That's why the arrest was made. So, they're going to be more they're going to contact >> no contact whatsoever. She can't text you. She can't call you. She can't use someone like a friend to call you, third party. She still gets in trouble for all of that. She violates that, she goes back to jail. >> And you don't contact her? >> No, that's that's another Even if you do and she shows up here and she's in violation, she's still going to get arrested. But when our report says you invited her here and she's got >> she's the only one that can technically violate it. But yes, it does. >> You need to anything that the court gives you that says she cannot do this. You need to you need to also abide by that. >> Mhm. >> But going forward, you do need to get a custody or a court ordered custody agreement. >> It is going to be >> specific dates, times, >> what they're going to be with. Right. >> So we avoid this whole thing. >> Correct. I agree. >> I don't think the kids are any danger going where they're going to. >> No, I don't either. >> I don't think that's the real important thing here is that the kids are going to be safe. >> I I agree. I don't think so either. I just don't like that they were pulled. They could have stayed there and I understand >> the whole situation didn't need to happen. >> Do you guys going forward so we can kind of avoid these things? Do you guys have car seats for the kids? Dad can't Yeah, we got Yeah, >> that's a big thing cuz that's >> replacement. If you guys don't have car seats then >> No, that's his car. I got both car seats for both kids. >> Like I said, honest to God, that woman lives here. She's here five, six, >> five days a week. Like two days, she's not here. Like this is this is what all the stuff that's going to be have to be handled in court because there's a lot of he said, she said, both. Everybody has their side of the story. I'm not saying you're wrong. >> I'm saying I can't prove it. >> No. Yeah, understand. >> So once it's on paper, we don't have to have any squables. We don't have to have any disagreements. If they violate it, they're screwed. If you guys violate it, you're screwed. It's just the way it is. And that's the easiest, >> unfortunately, the easiest way to do it. There's a lot less leeway because there's a document saying what you have to do. >> Mhm. >> But in cases like this, it avoids situations. >> No. And that's like my main thing is like I don't I don't want my oldest daughter sitting here thinking about this goddamn [ __ ] >> Right. So, you want the custody agreement in place so that she can grow up knowing both of you. >> Yes. and growing up to do whatever she wants to do with her life, right? And instead of just seeing all the arguments and the police showing up all the time, it doesn't solve anything. We can't arrest our way out of the situation. >> No. Correct. >> So, unfortunately, the courts are going to have to handle. >> Okay. >> Okay. >> Sorry to ruin your morning. It's just it is what it is. >> It just sucks cuz I already know I lost her for like six plus months before. >> Yeah. >> Like I said, not for nothing. That's not You're not going to get sole custody today, but that doesn't look good for her. >> I'm just telling you right now. >> Okay. >> Please email uh those videos to us. Okay. Thank you guys. Stay here.
