up the casings which are likely going to tell a different story than Anderson so tell one or three shots it was more than three shots but here's the thing like I can ask an officer who's been involved and he got hit over here that's when he fell down okay that's why he was still running he got hit he falls down all right what I don't understand is why you're over him shooting them while he's down help me understand that this one two three three shots want you let you fall he said I was not he say I I saw him again and he was on the ground yeah because you can hear the shots while he's already down and we see the casings right there by him so here I can see what's happening is that he's running you're chasing okay and he falls no once he facing he's facing once I see him he can see me he's facing this way and you're right here you fire the first shot he bolts that way you're chasing him and shooting while he's running and with one of those shots he falls down to the ground while he's down to the ground I can say forensically okay because the doctor can tell me where that bullet went in and what direction it went and I've got those shell casings there on scene right next to them remember it comes out the gun okay it's going to be in the general area where it's shot from so that's how I can say you shot and chased is because those casings are running too you see what I'm saying and all these up here by him and with him being shot on the ground I know that he was shot while he was down why this is where Anderson loses his case for self-defense not only did he Ambush purcel but he shot him while purcel was down and not an immediate threat I thought he had a gun I thought he was trying to kill me I thought he was going to kill okay I thought he was going to kill us but if he goes down why not run this way why keep going you see what I'm saying look he he was he was with people and they and they they he talking about H them this them that so so right now I got I got I got to watch I got to deal with I got I got to deal with d y'all yeah you actually ran in the direction that they were already standing and I know that he didn't have a gun reaching saying he kill you I've got a gun and I'm going to kill you and they reach into their pocket like they're getting a gun what do you think I'm going to do as an officer okay I understand that part okay um what I'm telling you is he's definitely not got a gun waving it out at you up here he's down he got hit he ain't moving and I know that cuz we got the video so help me understand why why stand over and shoot that's what I've got heartache about I don't get that part when I did that the gun jammed it was jam it was it was jamm these are spent cartridge casings okay meaning that the gun successfully fired a bullet the projectile out of it and those struck him so the gun wasn't jammed at that point now could it have jammed after that yeah because I hear that click the click that you're talking about I remember hearing that and that was after three shots standing over him so what you're saying is I I I I stood up here and shot him three times only shot three times no it's okay that you don't remember how many times you shot okay because we have officers that don't remember how many times you shot no I'm telling you I know how many times I shot and I'm telling you there are more shell casings than that and all the shell casings came from the same gun so I know that you shot more than three times so you heard so what you telling me you heard more than you heard more than three shots on the live M that's W I know how many times I shot I ain't tripping you shot three times up here but you also shot down here while he's running so what you saying what you saying I want defending myself I don't I don't know what you're defending when you're up here this again okay he's saying that he's going to come here that he's going to kill you guys he is on his way and you see him fiddling around by his pants okay I get that but at the point that you shoot and he starts running and you start chasing I know you got these two pools to deal with okay I get that but at the point that he's down why shoot him more that's what I don't get and I know that that part doesn't have to do with these guys because you actually ran back the same way that they were I it was going to be hard to hear but they were actually the ones that have the guns you have any explanation that you can give me for that part while I stood over him I thought I was to die night bro I was think about my life if you saying you going to come do this and that saying you going to come kill us what else for me what else for me to do I hear you but think about your expectations for law enforcement okay so I'm out with somebody they say that they're going to shoot me that they're going to kill me okay and they reach into their pocket all right and they start to pull something out I can explain maybe a shot or two until I understand what it is right because I have almost shot somebody over his cell phone okay all right so I understand this position that you're in because I almost had to do that okay and I remember how terrifying that was okay the detective shows some empathy when Anderson begins to panic because he realizes that he is going to have trouble getting anyone to believe his self-defense plea thank God I didn't have to shoot anybody I was never in that same position that you're in okay but as a law enforcement officer what's your expectation okay once I realize that it's not a cell phone that there's no longer a threat there I stopped shooting right okay otherwise what is it that's bad okay that's not an officer you know enforcing law or anything like that no I would have to have an explanation for why for him he's running away and he's down and I know he ain't got a gun you have any explanation for why you stood over him and shot him like that three shots what you saying it was seven I know that up here there was three okay this was just to give you a path of what I'm talking about okay I don't remember exactly how many are down here all right but I know that up here it was three and then you hear that empty click of you pulling the trigger all right but no round being fired you know what I'm talking about does matter it been people had to got people that that been people that didn't that didn't that somebody come to kill them they run and they still they still got a chance to turn around and shoot you they still got a chance to do what they want to do at the end of the day but the difference here is that you weren't standing your ground and defending your ground okay in this he ran away and you chased him you see the difference is that all right so like I'm standing on my property I have every right to be there and somebody comes and they're trying to hurt me I can defend myself okay but I can't chase him all the way down orang Avenue shooting at him you know and I'm not saying that that's how far he went okay obviously it's not but I don't understand you know I can understand a few shots while he's running away but at the point that he's down and he hasn't pulled pulled a gun on you he hasn't shot at you I don't understand why you still think there's a threat there and if you put that into officer terms right our expectations for our Law Enforcement Officers we wouldn't be okay with our cops doing that standing over somebody shooting them like that I just there's no explanation for that part these shots up here I totally get this here I don't but it's like it's like when was off I don't think nobody was hit nobody don't think nobody was hit what do you mean sh to that shot wasn't nobody H okay but when it fell it was obviously got hit oh I don't know maybe could trip maybe he could have got hit no okay but he's already run away from you he's not coming to your house at that point right he's running away from you and he's down and I know that he didn't pull a gun on you I know he didn't point a gun at you I know he didn't shoot at you cuz we only have your casings there so that's what I don't get that's the only thing that I have heartache over I get the rest of it I get him being on live saying he's going to come there they're talking about about the guns that he's going to shoot you up that he's going to try and get Daniel he could hurt anybody in the house I get that okay I don't get why you're chasing him and why you're shooting when he's already down that's the part I don't understand I don't know I I I just thought he still had a the ability to kill it doesn't matter whether or not purcel could have eventually retaliated all a jury will care about is that he never fired a weapon and was incapacitated at the time Anderson shot him had ability to kill me or for him to go to his house or for his friends to go to my house with guns it was two of them with guns on way to somebody house yeah did they say anything when you ran past them I don't want to I don't know if I did but I was running I believe were they still here in the middle or were they over by the Woodmore I I I stand over cuz like my stand over is like like actually like standing over somebody not like not faring you no you were definitely close anything else you think I should know about what happened need to call them back real quick I'm waiting actually did call them back and I had to leave a voicemail so I'm waiting for her to call me right back so I can tell her this final last bit and then I'll have an answer for you the interrogation is over and Anderson has to wait and see how the state prosecutor decides to proceed given the recent details it doesn't look promising okay so so so I might be going to tonight you might be going tonight um you might not be um I said we bring them all the evidence and testimony and stuff like that so after they hear this last bit then it's going to be up to them but understand if you do go to County tonight there's a chance you would have a bond and things like that and be able to get out and deal with it in court later if you needed to or if your attorneys do it I won't know until she calls me back because she was initially going to make a decision based on what we had before you decide to give everything so now I have to go and tell her that and make that argument to her okay and I know you told investigator Bailey a lot of it you told her everything I caught the end it cuz I was on the phone that whole time I was on the phone because you know there's a whole eight Monon investigation that's gone on so I had to tell her eight months worth of stuff before we get to this part so now I just got to add this part so as soon as she calls back I will fill her in that you that you did you know explain it and explain your fear and all that kind of stuff and and everything the reason why you did what you did okay um and I'm gonna send that I'm going to tell her that and send her the video so she can see the video so she can see what we saw okay and then I'll have an answer do you want me to call your mom and tell her the last three shots that investig told you that you remember when you had the jam yes okay so what they're going to do is they're going to present it to the Grand Jury yes and let the grand jury make the decision they're going to present the law for self-defense and stand your ground and show them the video and if you want to testify you can come testify that's your choice to explain kind of what you did with us about why you felt you had to defend yourself okay and those and then the Grandeur will decide whether or not to indict you so you're going home I'm going to explain it to your mama so she knows go to school tomorrow just keep doing good you know and just doing whatever and then I'll let you know when the grand jury is going to go so so so so it ain't going to be nothing about no about no years H I said I said so it ain't going to be done by no years yeah you don't know any of that unless the grand jury decides to indict you if they decide that you did not act in self once they're presented the law what the law says in the video in your statements if they decide that then they'll indict and then you'll talk with that with your attorney with them if the grand jury sees says he acted in self-defense he was defending himself you know they'll know everything that happened the month before and things like that they if they see that and they said he acted in self-defense we're not going to indict him then it's all over with and done and you'll never have to hear about this again so it's the grand jury making that decision so you're going home you take me out of here yep I'm about to take you out there and take you home I haven't even called your mom yet I just got a phone with them I had to wait for them to call back call the main State Attorney and then call me back you just tell them when we get there yeah I'll tell when we get there so we can go and get you out of here you bathroom again before we get on the road the interrogation is over and Anderson has to wait and see how the state prosecutor decides to proceed give the recent details it doesn't look promising Anderson should enjoy his time at home because he is going to have a limited amount of freedom to spend with his family before his trial Donis Anderson agreed to a plea deal and was charged with second deegree murder he was sentenced to 15 years in prison followed by 10 years of
