did you fear for your life there were times that I did for sure with knowing that he could do it once what makes you think he can't do it again you decided you wanted to record the conversation yeah why because I didn't know it was going to happen in that conversation and possibly maybe there'd be a confession of some sort the fact that you're lying was so easy for you to do in front of me over and over and over over makes me think that I could murder my wife that you could lie about something that I could murder my wife yes this video contains the interview of a man who murdered his wife in an attempt to hide the fact that they were losing their home Heidi Fergus had been married to her husband Nicholas for 4 years and couldn't have been happier the couple had a loving and fun relationship and they were both involved with jobs they enjoyed as as well as various Community projects if Heidi had been a little less trusting she may have lived what Fergus hadn't told his wife was that they were deeply in debt and that they had fallen so far behind on their mortgage that the lender had decided to foreclose fcus was deeply embarrassed and couldn't handle a thought of dealing with what people would think of him the day before they were supposed to vacate the house Fergus staged a break-in and shot Heidi in the back of the head what we're going to try and do here Nick is like I said I'm just going to try and you know I know this is a very traumatic situation okay and I'm just going to try and ease into it okay so what we're what I'd like to do is just trying to kind of backtrack a little bit you know try and go back maybe 24 hours or so yeah um like on we can start on Saturday okay all right what what time did you wake up on Saturday morning um I think we got up around 10:00 a.m. 10: a.m. okay and you both woke up mhm okay and now your bedroom is where in the house it's um upstairs in the back so the south side of the house upstairs South Side so it kind of faces the alley though that's great okay all right then what' you guys do after you woke up I my wife kind of hung out in bed I went to the Grand View Grill and bought his Grand Grill you brought it back to the house yeah okay back to bed okay so after that happened um um my wife I went to REI to pick up a sleeping bag for my that I bought for my wife all right a sleeping bag and then my wife it was meeting a friend at our house cuz they were going to go to the Mall of America for some spring shopping all right which RI did you go to Roseville Roseville and how'd you get out there I took um my wife's car your wife's car what kind of car is she got she's 2005 H navy blue Civic ladyy blue all right and your wife went to wife met a friend Y and who is that uh her name is Jolene and I'm blanking out her last name right now she's a work friend so hung out with her much actually it was the first time I met her okay so did jie come over the house then she did she came over to the house to pick up Heidi what time you think that one at 130 in the afternoon in the afternoon okay all right so they left then or did you leave first yep no they took off like I I got back at 1:30 because I wanted to meet Jolene okay um he WR all the fuss was about for my life and and then I stayed at home while they left all right so you got back and then they left mhm all right you met Jan for the first time yep all right so they went to the Mall of America you said that's right okay and you stayed at home MH okay all right what what did you do while they were going yeah I read for an hour or two to go a little bit of a nap yeah and then um kind of play it around my computer all right burkus shows little emotion about his wife's death When a Killer tries to act as if they are at ease during an interview they usually come across as uncaring you we stop over uh no okay just the M man all right how long you guys live there for uh two and a two and a half years a little over two and a half years okay all right so what happens next you're there Heidi Heidi got home about 6:30 and we ordered dinner from Green Mill had it delivered okay which Green Mill one in u h Grant okay they deliver huh yeah what time you think that was uh I took about 45 minutes so about 7:15 okay it's when they showed up all right it's just a two you just a two of us okay a burger cve all right was he had Burgers yeah we I shouldn't say we had a good burger crave not a okay he's PR oh I so you eat dinner and then what happens you watched Avatar okay did you want a rent it uh we owned it which we've never seen it before but I figured it was the best movie in the world that everybody saying so I just bought it all right where' you buy it in tet in the Midway I bought it on Friday how much did it cost you um I think it was like $15.99 something that's it yeah thought they Jack the price you usually the week it comes out yeah it's on sale and then it's Jack so all right that's I guess convenient then yeah all right so you watch the Avatar yep which took us till you know about 10:45 11 o' cuz it's pretty long yeah where' you guys watch it at Yeah in our living room downstairs just faces the street okay all right and then what happens next around 11:00 uh we went upstairs to bed um I stayed up till midnight or so to watch the rest of the Stanley Cup Playoffs we um Colorado San Jose game who won San Jose three to two think that means wait it was five to two because I scored a couple empty NS five to two yeah I think s Jose they it yeah okay stop W the bend all right all right so you so did he go to sleep right away or did she kind she kind of drift in out she she toled around in her iPhone a little bit and she got an iPhone mhm okay and then um I yeah she's addicted to this be jeweled game on iPhone so she yeah sure I'm stall it right I'm sure it's yeah all right what time do you think you want to sleep at I probably want to sleep about 12 12:15 all right all right and then when you went to bed or before you went to bed did you did you lock up the house or anything or yeah I mean we were pretty religious on uh throwing bolts and locking up the house cuz that's kind of how IA was raised but okay I if I'm honest I I don't know if I remember to throw the Bol P to the delivery iy came I think I just shut the door door in so you say the bolt you mean like the deadlock yeah the dead bolt yeah okay but all of our doors we've got we've got them set you get the two locks the Lo to be locked yeah you got the key lock down for you know and then you got the dead bolt up there that's correct so if you would have closed the door the the key Auto it been locked so the key lock would been locked all right and do you have an alarm system there at the house um I think we we bought the house it had an alarm system but it's hasn't been activated since we owned it so we don't pay anything to maintain an alarm system okay so the alarm system was there when you bought the house in light of their financial situation burkus had likely canceled the alarm system at some point if one existed I just released another extremely intense interrogation on my patreon bathroom you don't remember if she went to the bathroom at all last night I don't I'm pretty heavy sleeper okay so but she she does a lot of sleep talking and some sleep walking and all that so okay so you don't remember if she got up or not no and then you didn't get up no okay you guys drinking at all last night we had one gu I want dinner each okay what kind of white or red or was a a red Rex Goliath what what what's it called it's called Rex Goliath is mar Goliath yeah it's a cabinet it's kind of our stable cheap line all right was it was it already open or we opened it okay that night up for work about 6:00 every morning yeah I kind of got up but we didn't need to be up until about 9: to go to church so I got up and went and got a glass of water from the bathroom okay so you woke up what time is about 6:00 a.m. is there a glass in the bathroom already or you have to go upstairs get in um no I was just kind of sucking off the faucet okay she get mad at you CU you do that she is she's out cold all right Sometimes women always get a little y she well she does it when she brushes her teeth all right you know sometimes like guys take drinks right from like the orange ju whole container the milk container y all right so you're up around 6: a.m. go to the bathroom get something get some water yep go back to sleep I just kind of fully sleep for 10 or 15 minutes and then I hear our I heard the screen door open which which screen door I don't know um sometimes the one in the back pops open if it's really windy okay but usually that sets off the motion light if it does that and the motion light didn't go off all right your screen door open yeah all right so what I did is um kind of let it go for a little while but then I started hearing fing with our door knob what door knob I didn't know but I was assuming because of how well I could hear it it was the front door knob okay but you weren't 100% sure no okay all right and like what were they doing they just going like this yeah kind of like that yeah just shaking the knob and shoving the door all right and is Heidi still sleeping then yeah okay like a rock yeah and um so what I did is I I grabbed my shotgun out of the closet okay what kind of shotgun is it it's a bcal side by side 20 gauge B Cal yeah b a i k it's a Russian what gauge is it 20 it it was in your closet yep I keep it in there was it in was it in one the hard shells or soft shell cases or uh no I keep it out of the case the soft shell cases in the basement I used to keep it in the basement but it got so much moisture down there s Rost so upstairs where in the closet did you have it um we've got like a vertical cabinet um kind of a 12in wide full height vertical cabinet on the other side there's two rods and I had it tucked against the wall on the I guess the best way to say it is if you walk into our closet and turn right the cabinet's right here yeah I had it on this side so you like just draw it up yeah so that's our yeah perfect so we've got we've got the cabinets right here yeah there's two rods yeah and I have it right here okay so soon as you go through the soon as you go through the closet it's right to the right exactly so you have to go around the cabinet to get to it cuz I just don't want to just T yeah so she already get upset because you had the gun sitting there she did um she didn't like it there um but what I told you know a couple other things I told her as well is if if for any reason whever in a situation that's not safe um it'll be in the basement plus it really started to rust out really bad being in the basement so that was one of the probably the driest places in the house that I could keep the weapon was was conveniently placed early enough that the victim would be used to its presence which would help fcus to keep the element of surprise okay yeah all right is there a reason why you didn't keep it in a in one of the cases then well what I what I heard um from my friend Peters if you keep it in the case and case traps humidity it can continue to do that okay can continue to cor out so and it it hasn't been up there a month I probably brought up a month ago so I wanted let the case dry out and let the gun kind of I oiled it and then I wanted to let it breathe for a little while so how long have you own this thing before the gun um probably three or four years okay where' you get it from I bought it from my my friend Jordan worked at a camp um called Deep porridge Jordan's my best friend okay what's his last name Kimble how much you paid for it I paid $150 for it I bought it from Jordan who had inter bought it from the camp that he was working at okay so you don't do any hunting with it or anything like that do hunting yeah that's the reason I bought it is cuz I wanted the unloaded or I I don't keep it loaded I keep it unloaded but I like on top of the cabinet I I keep two shelves for it just in case things go weird so on top of the cabinet up here so two shs on top of the cabinet yep so when I heard things uh this morning I did load it but that was that was the concession that I made with my wife and I great you know F that ble at all okay it's no point so you're hearing these noises someone's you know kind of walkking around the door downstairs you go to the closet and grab the shot M and then I wake up Heidi okay and I she's uh when when she gets woken up from her sleep she gets startled yeah in general and I I said he somebody's deing with her not and trying to get into our house let's let's get your shoes on and let's go out to the garage let's get out of here okay why go to the garage though cuz that's where our car is and we just wanted we didn't want to be in the house if somebody was trying to get in the house okay and so I said call 911 and then let's head to the garage okay all right so who she called 911 then she called 91 okay that's right and then she just grabbed some shoes what kind of shoes were she wearing um I don't know what shoes she grabbed so do she use your phone or her phone to she used her iPhone and what she wear um she wear jammies or yeah she wears like black sweatpants and she had a t-shirt on so black sweats and a t-shirt a black T-shirt I think it was a black T-shirt yeah okay what were you wearing I was wearing my green sweats and a white T-shirt green sweats mhm and a what kind of shirt white T-shirt t-shirt shirt okay and these all right so you your brown sandals yeah but I did I grabbed my my jeans because it has my wallet and I I think it might have my fallone in it too I just grabbed my jeans to are they are they full length jeans or yep yeah they're not shorts what color were they dark blue okay and your wallet's in there yeah I have my wallet in there and I just wanted to make sure I had that with me all right so which which hand do you have jeans in which hand do you have a gun in guns in the oh wait no guns in the left grab the jeans with the right all cradle and you down the stairs all right so the guns in the left the jeans are in the right yeah and which hand do you usually shoot with the right hand shooter okay all right so you going for St the stairs or is she is she behind you or is she in front of you or what um she's in front cuz I'm kind of trying to move her along quickly yeah and then I'm right behind her yeah and then she stops at the console table to grab her wallet which is sitting on the console table console table where right in front right by the front door okay when you come down our house yeah there's the front door here we had to get past the front door through the kitchen into the into the back door to the Gage Okay so is a console table in the in the living room or is in the if you if you walk in the front door you could drop your keys right on it 10 seconds all right now do you have I can't remember now do you have a one is it your front door is it just all is it all wood door door and then porch it's a steel uh exterior door okay but you're like you said the door to your door in your house is there any Windows there's like a a fight at the a small half moon at the top okay so like up here is like a little yeah little light up here did you take a peek through there to see who's in there I who's on the other side I didn't I didn't want to stop I just wanted to keep going okay and there is there people at all there is a people and I didn't I didn't poke through that either okay I didn't look through there either no she was terrified all right so you guys come down the stairs since there was no Intruder Heidi had no reason to fear it would have been fairly simple for ferus to wait for an opportune moment during her typical morning routine cuz the stairs are coming here you're coming down this way turn left yep she swipes her wallet off the console table so like the console table's right here she grabs that and then be lines it to the as soon as she grabs it the door opens okay and so I have the gun on my left Y and so I try to shove the door shut but it gets forced open and the guy that was there I think he saw it and he I think he he grabbed the barrel and down towards the trigger more towards the top yeah so and are you still holding your jeans on your right hand not anymore I D I think I dropped my jeans okay and then um I because I don't I don't count is really fast yeah what this guy look like he a white guy black guy Asian guy I think he was a black guy Fergus makes up a description off the top of his head later his lawyer will advise him not to cooperate with a police sketch artist to avoid further questioning instead they will hire one of their own which will result in an innocent man being detained for questioning with a dark hooded sweatshirt that was dra I if I remember right it was drawn up pretty tight yeah but I did not get a good look cuz I was looking for Heidi yeah and trying to wrestle the gun away so we can bail all right so just try this then okay so this is this is we just say was really big yeah how big are we talking I'm 510 511 on a good day okay 220 lb my twin brother's uh my twin brother's 61 6'2 so he was that big he was probably that big yeah so he's 6'1 but he was he had more weight than my brother I would how much you think you weigh May 200 lbs maybe okay well that's kind of skinny for 200 for being 61 62 yeah cuz I'm 220 and I'm I'm not in shape I used to be have you stand up CU you're like but if I'm the bad guy coming through the door and I got the door swings open swings open that way so it's the other way yeah so it swings towards the stairs all right so you and I would be so you'd be standing right here you and I are like this yeah and then the gun goes off M okay and it goes off down yeah I I mean I know it hit Heidi I just I know it did okay I know it did I don't know where it hit her but I know it I know did hit her in chest the back she was in the she was running away so definitely hit her in the back this doesn't explain why she was there supposedly Heidi was terrified and had gone to another room so why would she come out only to turn and run away way hit her in the back yeah okay all right the back her back or the back of her area would likely have enough security cameras to show that no one entered his property all right so you and this guy are still standing in in the foyer yep okay and then I get I get it up and up and over so you pointed that him no it would like straight up and over like that barrel down oh so the barrels down mhm cuz I I grabbed on my right and pulled that and that's what it went off the second time and hit me in the knif all right so you're so where does it hit you in the leg left leg it's me in the left leg now where if you want to point to my leg you can just that's right my wound is I rolled her over and I was getting okay this wouldn't be an out-of-place action if the scenario ferus described had been true and it also gives a reasonable explanation for the position of the body not being perfectly consistent with his story to make himself sound more authentic Fus produces tears uh I was getting no response from Heidi at all uh did you see where the blood was coming from she had blood on her face yeah uh I saw a hole in the back of her t-shirt before I rolled her over but I just needed to I was just trying to to look at her and trying to see if she was okay yeah that's uh and then and then you guys came okay all right and I was just lost I was lost it all right what's uh Heidi's mom and dad's name John and Linda Ericson where they live in they live in 19 40 oh wait no and a half ago we had the St Paul police department sounded like they had some information that somebody was at our house who they want to deserve a warrant to oh arrest somebody you mean yeah okay and so they were banging at our door but we were both sleeping through it and then we heard it at the very end and by the time we got down there there was nobody there but we called the police because we it was pretty obvious what was going on all right we just somebody was beating our door down they sound like the cops so well no they returned and said yeah that was us I can't explain what was going on all right but you have any problems with other Breakin burglaries nothing like that nope nothing that I nothing that I can confirm or anything but you know every now and then we'll find our garage door open or something like that but nothing's missing like the main overhead door or the side yeah the main overhead door really yeah but nothing's missing and we don't lock our drive because both of the keys we at De Bol and locked just like our house both of those are kind of okay so you don't lock this like the access do we'll call it yeah okay is there anything in a garage with stealing um I have my fishing poles a ladder okay it would have made more sense for a burglar to try the garage rather than the house at that time of day especially since according to Fergus the man wasn't carrying his own weapon I mean like you know riding along mower uh you know ATV still whe motorcycle no the the most thing of value to me in there is my fishing pool okay so besides the Honda Civic do you guys own any other vehicles a monster Pro it's a 2000 Master prot yes sir two door four-door it's four-door what color is it white where's that car it's currently parked at my office because I have my clean van home for the weekend okay are you look on call then or what um well I'm the director of operations so kind of but I was also going to clean my life's um upholstery or a car okay um so was okay so the last day you worked was Friday then yeah okay we both work Friday what kind of places or what kind of jobs do you guys usually do to clean up we're mostly residential carpet cleaning okay um is the division that I run um but we have some commercial stuff as well okay and when you're when you're cleaning up the carpet I mean are you just are you just uh trying to get stains out or I mean you full we clean W wall carpet all of it um we're a pretty high-end service do you you specialize in any one service or well we purchased our Crew 2 purchased Crew 2 is my family's business we do installation services for the Home Depot okay and so what we did is we purchased and chemy franch is cuz we install all the carpet for own Depot in about 12 States okay and so we know who has carpet so we we purchased some chem dry franchises and that's what I run I run that side business of the carpet cleaning so it's chem dry it's chem dry and that's for that's just to clean the carpet yeah it's a it's a whole franchise system just like if you would buy a Subway or something like that okay all right um remember that vehicle parked up in front there I think I had like a dog on the side I if it was dog stains or just human or what well 70% of our customers are P owners okay all right you know you know guys don't mix around than any of that uh because there's certain other we have some cleanup response teams that go to scenes of you know yeah we're not we're not insured so you guys don't do like you know biolog clean up you know like BL we've done we've done we did one blood clean up maybe three weeks ago yeah was that you or it was me and and a trainee that I just hired where was that where did that take place place at the lodge which is a senior housing community in in mon the Asian there um how long AG you said 3 weeks about 3 weeks ago okay what kind of what J clean up there it was blood and uh was it in one of it was in one the the units that the residents died and she fell and and hit her head and um but probably about the size of your de blue tablet there there's a stain fergus's knowledge of stain removal could have come in handy if the murder didn't go according to plan that big what the size of oh this thing yeah it was it was fig of that we would have not done it cuz that would have maybe 8 by 8 by 10 okay but we we clean that if it was any bigger than that we would have referred it okay away and what did you use to clean that up actually just hydrogen peroxide we don't have any special chemicals to take care of BL so we use hydrogen peroxide on if it's a neutral based neutral color all right was there any uh you know any kind of mechanical device or yeah we have um a little vacuum vacuum in fact in that case we use the one that we can spell the size of a suitcase we just put now in it a small carry on suitcase is that in the truck right now um that particular piece of equipment is not okay is that back at the office then um in fact it's actually in my in my car back at the office yeah in your car mhm okay why would it be uh cuz I it's that piece of equipment is not just reing up bought it's just a portable yeah solution in vacuum and I had all of my guys out on Thursday or Friday okay so all of our vans are out and I needed to go take care of a customer so I just threw it in the back of my car okay and went over to her place all right that was three weeks ago was three weeks ago yeah all right did you now did you have to clean that out is there a way you clean that thing out the the piece of equipment yeah yeah we clean it out with commercial based product called Milo qgc that we just Y and QVC qgc qgc and the and what that is is a hospital grade um sanitizer so it's for eliminating bacteria and viruses and things like that that was at the office and you do that yeah my my traine did that Chris okay how what was it clean out the same day that same day yeah okay you know I don't think it was three weeks AG it might have been a week ago it was a week ago Friday all right one we all right there up M it's called The Lodge it's called The Lodge yeah okay all right all right um so after this whole thing took place you know this guy left out of there did he take anything you know of no he only came 3 4 You Know 3 4 ft into the house okay so I don't think he took anything all right and the only thing you grabbed was like you said you had the shotgun in the left hand and then the jeans in the right and you left your phones are The Upstairs Downstairs my phones I think both of my phones are up on my bedside stand and Heidi took hers what side of the bed is yours if you're standing at the bottom of the bed I'm looking at it's the right side right side okay goes this to our door all right so you're on the right side and she's on the left side that's right okay all right all right um is there anybody you want us to call I mean do your parents they're all here okay your parents are already here yeah I think the gentl that brought said they're upstairs okay what about Heidi's parents I don't know if they're here or not I think they might be okay let me go let me go check on that I'll be right back then okay do you need to go to the bathroom at all or anything or um can I wash my hands yeah yeah yeah on [Music] there grab grab help yep fcus has an answer for everything but he has had time to plan and knew that he would be questioned closely all right when at what point did you guys or did you or Heidi call 911 it was Heidi that called 911 yep and we were still upstairs okay so you're going downstairs mhm okay was she still on the phone the whole entire time as you guys going down yeah okay and what is she saying she's saying she's just saying people are trying somebody's trying to get into our house we're at 17 that for ha so people are trying get into the house yeah she was really scared really panicky and then she gave the Ed said 1794 West Minah I think she just said Minah okay was she screaming or is she kind of she was pretty calm because she was panicky okay all right she was whispering a she was trying to whisper a little too I don't remember very exactly okay and you you didn't have your cell phones to call either um I had mine but I didn't want to which one did you which one did you have well I I'm sorry I had mine accessible to me but grab it I didn't grab either okay are they both a nightstand or something exactly okay all right I got to ask you this question it seems kind of odd to me that you guys are going to leave your bedroom there's only one way in one way out to go downstairs then go all to a garage that's not secure I mean that just seems a little odd to me well we were going to get in our car and leave okay was the Point all right but and we can lock it from the inside it's just a matter of the key part of it doesn't like when we stick our keys in it's really sometimes it's really rough but we could have dead bolted and everything in the in the garage but the whole point was to get away from the house and get out how many ways are there how many how many different ways are there to get upstairs to your house just one just one stair staircase so there's not like a front staircase and a back staircase it's just the one just the one staircase okay so what would have prevented you from just sitting at the top of the stairs with the shotgun waiting for them to come upstairs then um well when the last time that when we when the police came about a year and a half ago yeah um Heidi and I had a just we had a conversation about what do we do if something like that happens again like yeah you know in that case it was the police but what what do we and that's just the plan that we came up with is to go to the garage is to just get in the car and leave okay and just get out of there cuz we knew we could get out of the house and into the garage quickly yeah um and then B and then bolted behind us we knew we could do that and so because you know part of part of the reason we had that conversation is because I was I I wasn't quick to act and it frustrated Heidi yeah because I you know I was like oh my what we do to me stay here do we go and I at that time I didn't have my shotgun with me yeah where was it then it was in the basement collecting rust so um so yeah at that at that time you know all the only thing that I had that I could have potentially used as um the weapon as a weapon was my room ball stick okay so that was way back when that was a year ago year and a ago all right um so that's just kind of you know was not the best plan little B it was kind of if they're not in the house yet if they're in the house then our plan is you know we'll stay upstairs well I'm just you I said I mean you know maybe it's just a cop of me thinking though but you know I'm sitting here thinking that if if I'm in my house in my bedroom and someone's breaking in my place you know she's call 911 I'm Wai at the top of the stairs and say hey anybody comes up here you know it's you know last stand at Fiji you come upstairs you know hate I hate to tell you this but my house you know I'm Justified and killing you if you can come break it into my house I Fe for my life you know that's what I'm thinking you know yeah and I guess the compassionate person to me is not pulling the trigger game so I think that's that's the hard part about it for me what which is why we came up with the point let's just get out of there it's just a house if we can save ourselves let's let's do that instead of getting into a situation where uhuh where we're vulnerable did you break your glasses in this thing no they've been broken for S months all right cuz you're missing like one of the yeah pieces me a little crazy okay yeah I've been there before I've done that so yeah um did you guys do any laundry on Saturday night last night we did we did uh I put the I put towels in at 130 right after hiding left okay and then forgot to put in the dryer till she reminded me at 8:00 last night so so Shi them over the dryer all right are they still in the dryer yes they are okay all right now I mean I I said when you went to when you went to Heidi she and she faced down when I woke her up no when after this after this guy left yeah she was face down she was face down and you're not sure if she was hitting the back or the back of the head or I know she was hit in the back I just it was high in the back and probably like up towards the shoulder blades I think so 100% certain all right so then you you rolled her over okay and would she she did she say anything or nothing nothing she was totally like all right and what what she have around her um well she had her sweatpants on and her and her t-shirt did she have her her little purse purse and her phone were there too okay that was right next to her yeah I think so okay and then did were you able to then call 911 then yeah I recalled 911 to make sure that they were coming and could make it and all that all right now when when you called 911 did it go to the r County dispatch or did it go somewhere else first I believe went to the same person because because they asked if I was they I I think that they asked if I was in St Paul okay ha uhhuh so may have been the same person that he had talked to because I think I I had to read itle 911 I don't know exactly what happened but I had already die okay all right how long you had you been married for for four and a half years you guys uh have any problems or anything like that just the normal just the normal stuff like U you know stresses about finances everyone described Fergus and his wife as a loving couple while Fergus knows the finances can be checked and it would be a bad move to lie about them there was never any indication that Heidi was aware of how dire their situation was quality time and vacations and all that stuff yeah but I would say we we still best friends okay very like we're having a great time Saturday night all right you guys aren't behind in the bills right we have a hide in in the bills um which is a little stressful in fact we were planning on moving tomorrow um moving where well we hadn't figured that out yet we were and and this is a a hard it's a hard place for us we were're foreclosing on our we foreclosed on our house okay we have to be out by Monday tomorrow one of the reasons I brought the van home was also because it has a trailer H I was going to go back to the office and grab a trailer um you had to be open by Monday we do up by Monday we've been this has been kind of a private struggle for us so we were going to move as much of our stuff into the garage as we possibly could okay and then start taking stuff to a storage place and then either crash at we hadn't ran the by our folks up but we were going to kind of talk to everybody about it tomorrow and crash up their place or get a hotel and find a place to well that's kind of I mean kind of close notice it is and I think the reason is because we're both kind of dealing with the shape of the whole thing um because we're embarrassed um that I think that one of the challenges is um that we haven't been able to be honest with our friends about our struggles yeah and um Fus was deeply embarrassed over the possibility of losing their house friends and family members say that if Heidi had known she would would not have had a problem discussing it and that she felt comfortable opening up about difficult subjects and it's not be it's not to discredit our friends or or anything like that it's just we just don't neither both of us are are too stubborn to admit that we're failing okay well so it was it was really a hard decision um you know we we have a bunch of boxes and we were just we had a really good plan to efficiently start puming things out of our house tomorrow we feel like we can get it done that day and then Monday morning so you you and her never mention us to either either set of parents none of our parents or none of our friends no one knows about this except you and I and Heidi and Heidi that's right okay and who who get your mortgage through US Bank how far behind of you um months or yeah months several months maybe over a year well part of the reason is you we were making a decision to leave the neighborhood because we realized that we couldn't um raise a family there and we wanted to go back to renting for several years so we could build up enough money to come in and quite a significant down payment because we bought two years ago and what how much did you pay for the house 200 um 225 225 and what was your mortgage payment it was uh we have a first and a second same here on the same B yeah we're our first is about 13 to 1400 a month that say it's 300 okay something like that and what's your what's your gross income I make 41,000 a year and then what about Heidi she makes about 30 30 right around there okay all right what about credit cards I'll B you in that in that well we're the middle of some conversations with uh we a credit card 3 US Bank there's been some fraud that we're trying to figure out what's Dr and what's ours yeah so a year ago we went on a um like debt assistance with them okay we don't want to we don't want to settle we want to pay it all off we don't want because we're already having such a big what what's just out of curiosity what's total for the credit cards then where you're at just it's a little over 15 all right and do you owe any money on the car no both cars are paid off in January okay so both cars are paid for any other bills that are kind of high no okay all right so that's kind of our that's kind of mine in Heidi we our marriage has been tempered by this I think we're we're in the best spot like last night one thing I forgot to tell you last night we started putting our budget stuffff together on how much we're going to yeah start paying down our credit card debt and um putting in the savings for the house and things like that so yeah so that was right after we ordered our green maill we did that for about an hourly we talked our budgets we talked about where we're at with either if we pay all right what our monthly expenses are um like any most people today's society you guys got insurance policies on each other life insurance policies no we don't no life insurance no we were part of the I I met with a a guy who offers Insurance packages like that maybe three weeks ago his name is Peter fche and we've been trying to meet with him Peter fi f c hi we were trying to meet with him face to face for a couple weeks but our our schedule's been the detective is surprised that there is no life insurance policy and the absence only makes things look better for Fergus since it doesn't give him a financial motive made work who's he through I'm Northwestern I think or North yeah something like that okay is he here in St Paul or minol Northwestern Mutual or whatever it's called you know is number by chance or no okay no I don't all right so you have no life insurance on each other no policies nothing like that okay um besides the financial things any other kind of problems you guys got going on well you know probably the only other significant one is just the our our level of intimacy and our relationship it's not we've kind of figured it out but it's just having sex is really painful for how you so okay we just don't do it we just don't do it all we do other things okay um you know like I said it's guy to guy here M you know every guy's got needs and urges concerns however you want to put it are you stepping on at all by chance to other women yeah no absolutely not all right I'm not here to judge you okay Nick you if you're doing what you're doing that's you know that's it's your business okay but I just I'm just trying to you know like I said make sure I understand a complete picture of everything that's going on here for sure in life and everybody else's life here that's involve this thing for sure so you know I appreciate you being honest with me and you know I know it's not a easy situation to talk about with regards to the timing and everything going on here but the more I know trying to help you I do your job I appreciate that ni and you know it's you know every little bit helps and I know being a guy you know much like yourself you know you don't want to talk about certain things you especially somebody he just met me a couple hours ago all right but um you know that's a thing that you know pops into my head is if you guys aren't you know having sex that sometimes I'm not saying all the time but sometimes guys go elsewhere you know what I'm saying yeah we just kind of figure out how to keep some intimacy going okay complete details well I know what you're saying but never okay never even considered it do you are you afraid or thinking any concerns that she was stepping no absolutely not okay absolutely not we had a we had a lot of trust in that part of our relationship for sure okay so there's no mysterious things going on no random emails text messages nothing like that nothing okay in today's technological breakthrough of society are you in that Myspace or Facebook Facebook both of us are both you on Facebook all right since I'm not a you know I just I can't break down to do it is there a certain account or name how how would it go we both it's just under our our first and last names first and last names okay so Nick and IDI yeah so like Heidi has her own and I have my own so Nick Fergus and Heidi Fergus we are two separate okay all right and then you know when you log into them it's just your email address okay that she used to log in and you can look at hers and she can look at yours okay so there's no you know what TR no there's no like scandalous secret okay accounts like no right we're we have full access to each other's okay communication and you don't have another cell phone number out there or nothing like that you keep away from her and she doesn't have one from you that you found out about or nothing like that no okay all right uh you know I I came to the house you know I'm looking around the main floor a little bit there yeah and I saw Sun boxes in the dining room area yeah there weren't a lot of boxes there it's a whole bunch in the basement whole bunch in the basement okay and then we were G to go to Home Depot when I went to pick up a trailer and buy and buy a whole bunch more I've moved out of houses before and I've helped friends move out of houses before too Nick and it just seems like you're kind of you know putting yourself against the clock I mean if you're if you KN if you knew this train was coming you know you kind of get ready for it yeah I think a part a part of it is just for us a significant part of it is the shame of the whole thing we're pretty crippled by it the I think a good thing for us is we're organized people so we've got a lot of stuff in like rubber containers that we can just start okay we felt like it could take us eight or 10 hours to have most of our stuff out that's ready like most of our the lack of preparation is another red flag indicating that Heidi had no idea about the eminent foreclosure and things like that well how you where you guys going to put the furniture we were going to keep in the trailer for work okay what kind of trailer are we talking about how big is this trailer well it's a i well let me qualify that by saying we were going to put a significant amount of it into the garage and then and the reason is is because when I was talking to the people who are managing kind of our our world with the forclosure stuff yeah they said that if we can get it out of the house and into the garage that they they still let us come back and pull some stuff out okay and who are you dealing with um it's a CER in in Wood Mary I can't I can't remember his name it's in my files where will your files be at up in the office in our desk okay is it a drawer is it a it's a drawer it's a file drawer what's it labeled as um this one's well we just we just bought this desk so that one isn't labeled yet but it's the only bright orange folder in there it's orange folder is left side right side it's the left side top bottom shelf or bottom shelf okay or bottom drawer bottom drawer sry the thing ni is like I said in this day date and time a lot of people have been going through problems like this I mean this isn't something that's you know that immune to everybody there's a lot of people here in this country who are going through foreclosures yeah you know and understand you you're a proud man and you're going to ask for help I understand that you know I can respect that too is that you know man wants to provide for his family and take care of him you know but there's a there's a point too though Nick where you know you just got to ask for help yeah I was prepared to do that tomorrow morning when we when we started to move stuff out if I was in over my head I was prepared to we both were prepared to just col we we know our circle of ritts pretty tightly I mean we know that they would come to the table for us and and help us at least get our stuff out but yeah was we were going to I I have a we were going to check out there's a garage storage place on 280 in University that we were going to see if we can get us a a place there just to play put our just to put our stuff into kind of figure out where we were going and we wanted to sell a whole bunch of stuff too so okay but Heidi's going to the Mall of America to go spring shopping yesterday yeah with a she had a very tight small budget it was mostly just so she could spend some time with her kind of her new friend Jolene at work so just I'm just thinking to myself though n is that you know you know hey honey at what point do we draw the line in the sand yeah you know yeah well I what I would say is I I got some tips out work the other day so she was going with cash in hand yeah and it was extra it was extra money that we count that we hadn't put into the budget and you know we it wasn't much it was you know $3 $40 but it said you know if you you know if you want to go spend time with chill that's fine but here's a this is trying to yeah you know' kind of trying to keep it relatively tight for a while all right um now after this whole thing took place and you call I don't want again um do you stay upstairs until the cops show up or stay on the main floor right by all right so when the cops come in I'm right by here okay all right and are you like cradling her are you standing over hand and okay yeah okay did you look down at your injury at all a little bit Yeah okay was it bleeding a lot no didn't look like it was bleeding too much didn't feel like it was bleeding either no did they did they bandage it up yeah okay did any of the cops take pictures at all several okay so they took pictures at the AL do at the hospital yeah and I looked at it too and it's it's it's two holes about this big it looks like it went through there's about a quarter inch of skin and to this one time is smaller than did they do an x-ray all or anything like that no okay so they didn't see if there was still no broken femur they didn't think there was going to be any shots still in there any pet still in there like that that's what they said that there wouldn't be but they said if it starts ping to come back in okay with the placement of a main artery being shot in the thigh has the potential of being life-threatening having plenty of time to aim carefully Fergus was not overly concerned all right so you didn't go downstairs at all into the basement yeah no there's no way I I wouldn't have be able to walk okay all right I st I stayed right by High and I didn't want to leave her when the ambulance came they took you they took me and I kept asking him what what you know I still don't know I mean I'm assuming the were so he but I so nobody gave me any answers on what was going on with her but I mean but you didn't go downstairs at all no cuz there's a lot of blood downstairs there a lot of blood downstairs yeah well um I'm trying to figure out how that got down there the only thing that I can think of is if it went through our that particular area in our kitchen the flooring is really in terrible shape so that's the only the only thing I can think of as if it if it ran into the basement that's thing I can think of okay well the thing is Nick is this is that um you know there's guys who are helping in this case who do certain jobs my job is here to talk to you and my other co-workers are got other tasks okay yeah and one of my other co-workers right now is looking at that blood and he's got a lot of questions as to how that blood got down there in the basement now some of it might be explained like you say coming through the floor you know down there in the basement you know and it leak through from lack of a better word all right but there's other blood that's down there that you know left me scratch my head going okay how did that get there and he's going to be looking at that trying to figure out okay what's a reasonable explanation is to the location of the blood is compelling but a full answer never came to light how that would get there mhm um I'm going to give you for instance here a few weeks ago uh my coor and I were involved in an incident where we got sent over to the east side of St Paul where two brothers got into an argument okay and one brother for whatever reason decided to take a shotgun out and he he shot his brother and killed him okay and um when he shot him there was a bunch of blood and other stuff scattered about now we both looking through the house you know the same kind of situation that we're looking over there okay I mean we're looking for evidence to try to help us you know solve this thing okay and I compare what I saw over on the east side versus what I see over here at your place Place mhm and we did a little demonstration with with the shotgun how this guy fired you and this guy were wrestling for the shotgun and it fired down down the hallway towards the kitchen where Heidi was at mhm now when we start looking down that way am I going to find pellets lodged into the cupboard and everywhere else I know I mean I mean what's it going to say I mean if there's a hallway there's a hallway area and there's no pellet there yeah you know I mean well I mean we're talking 8 89 ft too so that mean the pattern I mean like you know as a hunter as you know the pattern starts to expand the further R further down range you get yeah I mean it's not going to expand I mean I'm not a gun expert but I know it's going to expand a little bit Yeah but if there's no pellets in the area where you tell me this where the shot was fired at I'm going to start to have some questions okay you know and I want to make sure that I have there were multiple curious points about this case and there should have been enough questions to keep the investigation going at the very least fcus should have been scrutinized more closely those questions answered before oh yeah for sure for sure so so you asking I'm trying to figure out then okay is if what you're telling me is is is the right way is there is there any other way that this situation could have happened not at all okay it's exactly the way that I get out to you at least okay I just like I said Nick I want to make sure that you and I are both on the same track yeah that you know we're under the same understanding that you and this guy are in the foyer wrestling over control of the shotgun MH and it goes off yeah and it goes down range down down the hallway and it hits Heidi as she's trying to get out of the house okay and now what I'm saying though is is that if there's pellets in in the in the cupboard you know or you know on the hallway or wherever they're going to be all if we find pets yeah if we find pellets down there then you know what you're saying is is straight on all right but I I always play both sides of the story understand so if for some reason there's no pellet where you're selling where you're saying that the shot went off I'm going to start thinking to myself okay why aren't the pellets here what else is going on here you know and that's the reason why I asked you a few different times if you're sure that this is is where where it took place at oh yeah absolutely okay all right it wasn't for instance like say for example this you know I say I use the words what if and for you know for instance for example as a as a possible explanation maybe this guy got the gun away from you and all of a sudden forces both you and Heidi downstairs and then for whatever reason and this guy flips the switch to Psycho and decides to shoot Heidi first and then you and him start wrestling over the shotgun and that's where you get shot mhm is that a possibility no okay no everything happened in the in the full air and kitchen hway okay all right all right so this guy didn't go upstairs he didn't go in the basement he had 4T into the house that was it okay all right the other thing too Nick is this is that um when we were in the foyer area of of your house MH um where your do at yeah you can see a bunch of pets like in the lower portion of the door mhm now if you're with this guy wrestling with a gun like this mhm how do the pellets go through your leg bounce off the floor and then go into the door well I think I think there might have been a point in that SCU we might have spun but I'm not 100% certain okay cuz I know I know the door got came open he came in in the scuffle got shut of it all yeah and then and then I happened pretty quick but I think we might have I think we might have spun a little there all right is it possible that this guy maybe maybe you got the better of them and you got him on the ground so he's laying on his back like say for example I'll kind of lay down like say for example I'm you okay all right I'm laying here like this all right and you and him are fighting with a gun like this yeah yeah no that didn't happen no so you're not on your back no and the shot didn't go off and hit the door like that no okay all right so you're you're not on your back this guy's not over standing over you with the shotgun no and those pellets didn't go in like that no okay the only thing that I can think of is if we is if we twist it around or something like that all right you know because the guys from the you from the crime line going to take a look at that and they're going to do the measurements and try and figure out okay what would be the angle yeah proper angle and all that stuff about how those will get in there so all right and and then Jolene was the only person that stopped over yesterday at the house and the greenmail delivery guy Green Mill delivery guy all right so other than those two those are the only two that stopped over yesterday yep okay and did you talk to anybody on your cell phone at all by chance yesterday yeah um I talked to my my new guy at work Chris when I was heading to alari no when I was heading to the um growland no the grand new for the breakfast breakfast and I talked to my friend press when I was going to Ara you talk to Preston you said yeah that's on the way to uh okay what would you guys talk about um with Preston in particular I was buying the same sleeping bag that that he bought so we were kind of we're both really outdoorsy guys and Gearheads so I we were talking about that okay with Chris he had called me earlier so I was just return against called to see why he called me all right so how you think he talked to press for roughly um 5 minutes yeah the detective must also consider the possibility that ferus was not working alone in this case his embarrassment over anyone finding out about his money problems made it almost certain that he didn't have help keep 10 10 minutes okay same with Chris okay all right other than that I didn't T anybody else on myself that day okay all right you you you text message at all I do okay but nothing yesterday no text yesterday I received one but didn't reply okay who' you get a text from from my friend Nick ay Nick what's his last name ay a r y Au r y r y okay what that text say uh he wanted to know if I can get some tax strip for his carpet at his house this is the company that work for his installation okay that was the only text you got yeah I I rep to him because I didn't know okay do you have any questions for me Nick um well I just want to know the final answer on the final answer on he um and I want to know I just just want to know if you found anything yet as far as the guys that did this well this is you know there there's a couple parts on my job that I really hate and this is one of them she didn't make it I figured that I mean now this guy that your [Music] R see he's a black guy see light skin dark skin I'm pretty certain it was lighter you lighter skin yeah I couldn't really tell so possibly light skip that's right okay he said he about 61 62 that's what I would yeah okay 200 to 220 he had a dark hooded sweatshirt on he had up over his head yeah you have a mask or anything covered his face I don't think so mustache beard goatee glasses uh I couldn't tell maybe a beard but I'm not 100% certain okay um you didn't see remember seeing anybody else no okay just this guy just him is all I saw okay and I don't know if he came with in a car I don't I didn't see anything like that you see which way he went after this whole two place no I didn't okay I didn't all right cuz I was I was facing the other way all right and the cops got your clothes that you were wearing they took your clothes I think I think well they cut in half so okay all right um but you you said when you got you get shot in the leg you didn't remember if you seeing blood dripping from here there everywhere I I don't remember it was it's dark in our house so all right I didn't pay attention to that okay all right um and then you were you believe that that Heidi got shot in the upper upper shoulder blade area yes okay and it was only you said it just the one one shot yeah okay and there wasn't any kind of other than you and him kind of wrestling for the shotgun there was no other fight anywhere else in the house or nothing like that okay everything that took place took place right there Then fo then right there okay all right um Nick this is like you said this is the thing is that my co-workers out there at the scene they're doing the search war in the house they're Gathering the evidence um you know going as there as we're going to go um would it be possible that later this week um we can may be talking yet absolutely okay yeah all right absolutely okay I don't I don't know what I'm going to do now so yeah um well I can tell you one thing for sure is like I said the house is going to be you know we be out there doing the search War until later tonight and then going from there um we could probably give you a call when we get done and then give you the phones you know assume you going go to your parents place yeah okay and your parents we living over on the tough questions all right and that's a you know that's a tough question going to ask you know there's no there's no easy way to do it you know and you know with the information you gave me and
