Interesting. All right. Well, there you go, Mr. Pelosa. By taking this to trial, you just got one count to go away. >> Kathy McKay has been trying to sell her house for 3 years. >> I say it's moving ready, technically. >> But McKay can't sell because she's the victim of fraud. A fake lien, a lien her neighbor filed claiming he actually owns the house. >> This has been a nightmare. >> This does keep me up at night. >> As soon as Platte County prosecutor Christopher Wright learned about the latest fake lien, he had it invalidated and reported the man who filed it to the Platte County Sheriff's Department. Platte County's prosecutor charged Gary Michael Pelosa with felony fraud for filing false documents. >> Your Honor, he has another case, his MR case, I believe it's called. >> Yes. Yes, [snorts] we have to take that up. All right, Deputy. Leave him there for a minute till I figure out what this is all about. Uh You want Mr. Patterson to help you on that one? This is on the record in BU 2026 MR19. State of Kansas versus Gary Michael Pelosa and Mr. Patterson, what's this about? I've got like >> I think >> five counts of duty of governor to arrest person charged who has fled from justice. Is that just extradition? Is that what that is? >> Judge, I haven't seen that case. I don't even know if I was appointed. Maybe I was. I don't remember. >> Well, they The judge >> I Can I say something? >> If you dare. Mr. Patterson usually doesn't like his clients talking too much, but go ahead. >> Well, you should have received a a notice today. It was delivered to uh, the court, on that case. Uh, the case that's in question that has a warrant [clears throat] was defective, and, uh, there was no service done, so there was a no-show, so there was a bench warrant, but in the docket, which I have right here, uh, shows by the clerk that there was no service, so that's a defective warrant, and that I've got a currently a, uh, a notice to the court judge, Miss Casey, that, uh, it's defective, and she should, uh, be pulling that recalling that warrant, uh, that caused, uh, >> Well, it is a fugitive and it does look like an extradition. It looks like a fugitive warrant, Mr. Palosa, the, uh, Let me Let me pull up the complaint information in that. Says fugitive information. Mr. Regueira filed that as a fugitive information. Operating a vehicle on a highway without a valid license. Now, two, owner operating moving vehicle without maintaining financial responsibility. I don't know if It doesn't say Okay. >> Those are not extraditable, uh, they're tickets, ma'am, and that's interesting. >> I I I'm going to probably have to get Mr. Regueira to explain what he has filed. It looks like from the way he's worded this fugitive information, you have a warrant out of sixth judicial circuit in Platte County, Missouri, for operating a vehicle on a highway without a valid license, and he gives the case number. And then, in count two, he says a warrant was signed the same day, November 18th, 2022, in the same court, for operating a motor vehicle without maintaining financial responsibility, and he gives the case number, which is a little bit different than the one in count two. In count three, he charges uh the bill on November 8th, '22 in the 6th Judicial Circuit, Platte County. You're charged with displaying possession of a motor vehicle TRL plates of another person and case number and it's a different case number. Count four, he says on that same date you in Missouri, same jurisdiction you committed an offense against the laws of the state of emergency of Missouri, failure to yield emergency vehicle sounding siren and displayed lights. And then in count five, he gives yet an another case number out of that jurisdiction saying you failed to register your motor vehicles. In all my years, I don't recall ever seeing this type of charging document. But it to me looks like there must be a warrant out of Missouri somewhere wanting the fugitive return on a failure to appear. And I do see a note, February 6th there was an extradition hearing. So, let me take a look at the notes on that. Judge Lee presiding. Attorney Darren Patterson uh present via Zoom at a separate location. Defendant wishing to rep- uh represent himself. Uh Mr. Patterson requested to withdraw. Well, the defendant's wanting to file his own motions. Not well then the the then the defendant was not willing to represent himself. With standby counsel, as you said, you don't want standby counsel. You were challenging the court's court's jurisdiction. So, Judge Lee sent it over to my docket for trial today. And Mr. Patterson ordered to be at the hearing as standby. With the bonds to continue. Case caption 26 CR 25 and 26 MR 19. But counsel, I without Mr. Aguero here to say if what this is, he doesn't make reference to a a Missouri bond number, so we could advise the defendant that he has a right to file motion and for extradition. Do either of you counsel want to take a gander at what this is? >> And And Judge, I'm trying to pull it up and I can't even pull up the MR case. >> Oh, gosh. Do we know, Destiny, why he can't get that because it says he's appointed in that 26 MR 19? >> tickets. There's traffic tickets and there's one There's one other case that I'm having them recall the warrant because it's defective. The warrant >> I understand I understand that those appear to be Missouri cases. What I can't understand is why they're on my docket if they're Missouri cases unless our jailer has a warrant for those cases in Missouri and I need to be entitling you to extradition rights or allowing you to sign a waiver of extradition to go back voluntarily if you want to. So, again, counsel, if you >> Could Could I inquire what What's the last digits on the MR MR-what? >> 19. >> And Judge, I I can I think give a bit more information when ready. >> Okay. Let's give Mr. Patterson a a to pull that up if you can. Did you get it? >> I was able to pull that up now, yes. Thank you, Judge. >> Okay, now if you want to take a look at that and tell me if you've ever seen it filed like that. Maybe that's the way it should be, but it's not what I'm used to seeing. All right, Mr. Baca, you had something else you wanted to say while he's looking at that? >> Your Honor, it's not much more than the complaint or information you're looking at, but we do have uh a copy of a warrant for arrest from Missouri uh in our documents at what as well, and it does look like um it covers a couple different cases. So, I can at least answer the question that I do believe Platte County, Missouri does have a warrant for his arrest for a failure to appear on those cases. >> All right. Like I said, that may be the way to file it. It's just but I'm just not used to it over the years, so It was the fugitive warrants. Not that particular document. >> And Judge, do you have the af- what's called affidavit in the um court file that I'm seeing which is actually copies of the warrants. >> Okay, the warrants are filed under affidavit. Okay. Yes, it is a warrant for arrest. So, Mr. um Pelosa >> And and Judge, I'm reading the warrant. >> What? >> I'm not sure it applies. >> I'm not even sure it applies to >> Is it Okay, now I just reading the paragraph about if they have the following which doesn't apply here. And And as you know, Judge, um on a lot of these, if it's a misdemeanor, they're not usually state they won't come and get them in a different state generally. So, that's what I was trying to look on here. Is it even extraditable? >> Yeah. I I see where you're questioning that. >> The ticket >> here's the deal, uh Mr. Peluso. I'm going to set this over just a little bit just to kind of Do you Do you want an attorney? Do you want Mr. Patterson to represent you on this? You can have an attorney on an extradition. Or do you want to just sign your waiver and go back voluntarily? >> Well, when would I go back? >> Well, that's a good question. I don't want you going back until you've at least gotten on probation in this case. So, you need to call your probation officer like I told you to. >> Well, then I won't sign the waiver because By time By time my paperwork gets in to recall the warrant, it'll recall the warrant and that that warrant will be recalled and it won't have to I won't have to be extradited. >> All right. So, do you want an attorney or not? >> Um If Mr. Patterson wants to continue on, I I guess so because it's a it's an easy deal there. It's just getting it recalled and I can show him the evidence. Uh I have already got one in front of Judge Casey in Platte County that the case is dismissed. >> I don't know that it's an easy deal or not. Getting any case dismissed can be a challenge sometimes, but Mr. Patterson, do you want to represent him on this? >> Judge, if the court would appoint me on it, I will accept the appointment and represent him. >> All right, you will be appointed on this uh MR case, which is an extradition. And so we need to >> I would just ask that a formal appointment be filed and >> That's what I was getting ready to say also that we need to get a an order appointing out to him Destiny on all of the on this case that has five counts. It's one case though. It says he's been appointed, but let's make sure he does actually get an actual order appointing, and then let's set this for a review date. We will do that on a Monday morning, Mr. Patterson. >> Judge, yes, and I would just ask that we set it as soon as possible. This might be the only thing holding him in jail at this point. >> Okay. So Destiny, what do you have available for us to review this as soon as possible? >> Yeah, your honor, I'm I'm taking a look cuz it looked like the soonest that I had was June 15th. And so I was seeing if there was any other dates open in the system. >> days. That's nearly 60 days out. We could put it on a Monday at 1:30 if we have anything there. No, a Wednesday at 1:30, but Mr. Patterson's on. >> And I have one next Wednesday. A case with you next Wednesday at 1:30, so adding this wouldn't cause any extra burden. >> What day of the month is that? >> That's April 1st. >> Can we do that, Destiny, April 1st at 1:30? >> Your [snorts] honor, that's an interpreter docket. I'm checking a couple other dates with Michelle right now. >> Okay. Those days are those interpreter dockets are kind of challenging. >> Yeah. >> Okay, Your Honor, we can actually put him on the Monday misdemeanor control at 9:00 a.m. March 30th. So, just next Monday. >> Monday I mean I already believe Monday is March 30th at 9:00 a.m. How about that, Mr. Patterson? >> That will work. I'll get out there to the jail and talk with Mr. Peloza and we can be prepared. >> Sounds good, Mr. Baca. Are you going to have Mr. Regier back by then? >> Yes, he should be back by this Friday. >> You might let him know that he needs to be on top of that, figure out what in the world is going on. I think I I think we've got it figured out, but since he filed it, he can Thank you. Thank you all. And Mr. Peloza, for now you're remanded to the custody of the sheriff unless they decide otherwise when they do the math on your sentence and but you're still going to have to be held on this one, Deputy. He's to hold him on this one until Monday, March 30th at 9:00 a.m. so we can make sure we don't let him go when Missouri's got a valid warrant. If it is valid, we'll find that out. >> I got a question. Can I have a ask a question? If if if the warrant on the one case that's holding me gets recalled, then what happens? >> Well, if if you can get all of these get them recalled on all these charges, it would go away, but but just taking one of the cases away isn't going to make them all go away. >> Well, the the traffic tickets are not extraditable. >> All right, well, talk to Mr. Patterson. He he knows all that stuff very well, so respect his knowledge of Kansas law and his years of experience of Kansas law and let him help you work on that. >> Okay. >> All right. He knows He can answer that better than I can for you. All right, at this time we will be in recess. We are here in the 13th Judicial District District Court of Greenwood County, Kansas, a court of record on the waiver of extradition of Mr. Palosa, Gary Michael Palosa, in case BU26MR19, BU23TR300001 as they result as these cases result to defendants warrants out of Platte County, Missouri. Thank you. Now, we've got the paper copies, too. Um Mr. Palosa appears in person and by counsel, Darren Patterson. Mr. Palosa being in custody at the Butler County Jail Detention Facility and his attorney, Mr. Patterson, from separate location, both via Zoom. Also, Jared Regier, is it or is it Mr. Barker? Mr. Barker, Assistant County Attorney for the state of Kansas. Uh Mr. Palosa, I understand that you do recognize in the Sixth Judicial Circuit, Platte County, Missouri, a warrant has been issued by Judge Dennis Carl Eckold to Gary Michael Palosa, um Platte City, Missouri. Do you recognize that? >> Yes, ma'am. >> Their case number 22 AE-CR02925, court ORI number M00 83033J. And they're saying that your date of birth was mar- a certain day in March of 1958. Do you agree that that's your date of birth? >> Yes, ma'am. >> And the last four of your social, do you agree is 0762? >> Yes, ma'am. >> And that you do have Looks like a Kansas driver's license or ID card. Is that correct? >> Yes, ma'am. >> Is it ID or is it driver's license? >> It's an ID. >> Okay. And you are a white male, correct? >> Yes. >> Is your height 70 inches and your weight about 170 lb? >> Yes, ma'am. >> Is it your belief that you are one in the same, Dennis Eckold, that they are trying to return to Missouri? >> Yes, ma'am. >> And apparently they they believe you failed to appear on a charge of operating a vehicle on a highway without a valid license, what they call a D misdemeanor with an offense date of August 25th, 2022. Are you aware of that charge? >> Yes, I am aware of that charge, and that was during COVID, and I did appear at court, but they didn't have court, and they didn't notify me that it was on Zoom, so it was there there was a miscommunication. That's why the non-appearance happened. >> All right. So, they charged you with failing to appear for the another something also on here about owner operator uh motor vehicle without maintaining financial responsibility, what we would call no proof of insurance also dating that date a be misdemeanor. Now, if you do not believe you are the person in this warrant, you can fight extradition and then the governor of Missouri would have to contact the governor in Kansas and the paperwork would have to be accomplished to have a forceful return of you to that county to respond to those charges in that county of state. Do you understand that? >> Yes, I do. >> And knowing that, you wish to go back voluntarily to Missouri? >> Yes, ma'am. >> And you do have the right to an attorney to fight extradition, but you don't want an attorney to help you fight extradition? >> Uh I don't need to I'm not going to fight extradition, so I don't need an attorney for that. >> All right, but you know that you could hire or have one appointed if you could not afford to hire one. >> Yes, I understand that. >> And you wish to waive that? And you understand that by um signing this waiver, you're not going to hold the the Butler County Sheriff responsible for your delivery or pick up by the other state's officers. >> Yes, I understand that. >> All right. Now, let's look at this waiver of extradition. It and I'll just read it to you as you read along. Do you have the copy in front of you? >> Yes, I do. >> Mr. Patterson, you're not appointed to him, right? >> I I'm appointed, Your Honor. Yes. >> You are appointed. All right. Do you have a copy of the waiver? >> I don't have it here with me. I'm familiar with him though and and as court reads it, I will acknowledge it. >> All right. The waiver of extradition reads, I Gary Palosa do hereby freely and voluntarily agree that I am the identical Gary Palosa against whom criminal proceedings have been started in the county of Platte, State of Missouri and I hereby freely, voluntarily, and without promise of reward or leniency agree, consent, and elect to return to the county of Platte, State of Missouri without requisition papers, warrant, rendition, or other legal forms. >> [snorts] >> I Gary Palosa sign this agreement and waive extradition without reference to my guilt or innocence. This agreement shall not be considered beneficial nor prejudicial to my case and is not in any way an admission of guilt or stipulation to violations. Further, I exonerate and hold blameless in this matter the Sheriff of Butler County, State of Kansas and all persons acting under him and agree to accompany any peace officer who may be sent to take me to the State of Missouri for criminal proceedings. This waiver is made in the city of El Dorado, County of Butler, State of Kansas this 30th day of March, 2022. If you agree with all that, sir, please sign by the X between the X and the word defendant. >> [snorts] >> Now, this particular format calls for two witnesses in addition to the judge. Mr. Patterson, do you want them to get that to you, or do you want to offer an electronic signature? How do you want to do that, or do you want two people at the jail to do it? >> Yes, as attorney, I probably should not be a witness. So, yes, if there's a couple people at the jail who want to do it, that's fine. >> All right, Deputy, can you find two witnesses there at the jail? Yourself and someone? >> Yes, I'll do it myself, and then I'll find another one. >> All right. And then if you want to electronically file that, I can get that back to you pretty quickly. >> Okay. >> And I do have I do have a copy of that warrant, as well. All right. Is anything further from anyone? >> Your Honor. >> Nothing from the state, Your Honor. >> Thank you. Then we'll be in recess, and uh the defendant is re- manded to the custody of the Sheriff. Thank you, Mr. Pelosi. You may go. >> Thank you. >> You're welcome. >> But the problem with the law is he just didn't show up. >> There's now a warrant out for Pelosi's arrest, but McKay still can't sell her house, because no title company will touch it until Pelosi is found and convicted. Fox 4 Problem Solvers paid a visit to Pelosi's last known address, right next to McKay's home, where she's lived for 25 years. >> I don't even know why you guys are harassing my family. >> To put it lightly, the woman living next door wasn't happy to see us. She was the girlfriend of Pelosi, that filer of fake liens, but she tells us that Pelosi is now her ex-boyfriend, and has moved to Georgia. >> He no longer lives here because of the that's going on. >> She wouldn't tell us where exactly in Georgia he's living, and all Platt City Police know is that he's on the run. >> I'd never get my house sold. >> This isn't the first house Palosa has tried to steal. According to court records, he's been successfully sued another time for trying to lay claim to another property he doesn't actually own. The actual property owners had to sue him to get him to go away. Palosa always acts as his own attorney. He considers himself to be a sovereign citizen. In his mind, he doesn't have to abide by local, state, or federal law. Right says sovereign citizens wreck havoc in recorders offices filing fake liens against everyone from homeowners to governors. >> A quick update on Mr. Palosa. Following his extradition back to Missouri, he entered guilty plea to the misdemeanor charges stemming from the original traffic stop. However, [music] one charge remains, filing false documents, a first-offense class D felony under Missouri law carrying a maximum sentence of 7 years in prison. And yes, some of the filings we've looked at throughout this series, including the famous notice [music] and demand and correspondence sent directly to the court, are now part of the larger Missouri case. As you've seen from Fox 4 reporting, the homeowner ultimately got title issues corrected, sold the property, and moved on. Mr. Palosa, however, remains in Missouri awaiting proceedings on that felony charge. >> I'm attorney Scary H. Parker, and I work for you. Listen to these satisfied clients. >> I was in an accident. My husband removed the brakes from my car, and I plowed into a concrete wall. Scary Parker got me $25,000. >> Why are you sitting at home when you could be in a car accident right now earning a nice chunk of change? I'm Scary H. Parker, and I'm ready to fight for you. >> I stretched my body across the tracks of a roller coaster at a world-renowned amusement park. I was split down the middle. Scary Parker got me two settlements. >> [snorts] >> Don't waste your time in front of the TV. Get out there and get hit. My office is open 24 hours. Operators are standing by, just waiting to make you rich. I'm Scary H. Parker, call [music] me. 1-800-NO-BONES. Remember, the bigger the gash, the bigger the cash. >> Scary H. Parker got me $2.1 million. >> The previous testimony is from a head on a plate. There is no guarantee that you will live. Death and dismemberment a great possibility. No purchase necessary, void where prohibited. >> If you enjoyed today's episode, make sure to hit the like button. Subscribe if you're not already, and share the video around. And as always, let me know what you think in the comment section. And a very special thank you to every single one of our Facts or Frauds channel members. Your support helps keep this channel going, and I appreciate every one of you. One issue, thank you. At its core, the entire [music] saga serves as a reminder that the legal system may move slowly, but they do eventually respond to fraudulent filings, false claims, and attempts to weaponize the paperwork against other people. The documents may have been elaborate, the theories may have been creative, [music] but court proceedings ultimately turn on facts, evidence, and the law. And in this case, that process is still playing out in Missouri. Till next time, I'll see you soon.
