This is the state of Michigan versus Lindseay Daeski. Appearances for the record, please. Ashley Mo on behalf of Miss Daeski's state your name. Ma'am. Lindsay and Daneski. Okay. Thank you. Today is the date and time set for an arraignment in this matter. And it does not look like you have been previously arraigned on this. What I have here is a misdemeanor complaint that charges that on or about December 9th of 2023 at 69 Mhler Avenue, you did attempt to commit the following listed offense and in the attempt did act towards the commission of that offense but failed in the perpetration or was prevented in the execution thereof to uh assault, batter, wound, resist, obstruct, oppose or in danger. Raul Pacheco Garcia and or Marco Campouri, sheriffs or sheriff's deputies of Washington County that you knew or had reason to know were performing their duties. This is otherwise known as attempted uh assaulting, resisting, or obstructing of a police officer. Do you understand that charge against you? I don't understand it because I didn't I mean I didn't Miss Di uh I wouldn't we're going to plead not guilty. She's just understanding. Do you asking do you understand the charges? Well I I'm objecting to jurisdiction so I wouldn't understand the charges. I I comprehend them but I I don't understand them. Okay. So yes, I want to make sure that you do in fact comprehend the charge against you and what I am saying. I am not asking you if you agree with it. Okay. Yes, I I do comprehend them. Okay. Thank you. So again, this is a misdemeanor. It has a maximum penalty of up to one year in jail, a $1,000 fine plus court costs or both. Do you comprehend that? Yes, I do. Okay. Count two charges that you did make or excite a disturbance in a street, lane, alley, highway, public grounds, or park located at Mueller Avenue. This is otherwise known as disturbing the peace. Do you comprehend that charge? I do, but I was on private property, so I don't see how that applies. Okay. And we The purpose of the hearing today is an arraignment. I am informing you of the charges against you and their potential penalties for disturbing the peace. The potential penalty is up to 90 days in jail, a $500 fine plus court costs, or both. Do you comprehend that? Yes. Okay. So, further discussion of the case can take place during the pre-trial that will be held in front of the judge. as the magistrate. I am not hearing any other than uh you said attorney Motton that your client is going to stand mute. Although I suppose I should ask Miss Daeski, do you wish to be represented by a public defender? I prefer to represent myself. Okay. How do you plead to these charges? Well, I'm object I don't plea. I object to the jurisdiction because there's no jurisdiction whatsoever to bring them. Plus, they never notified me of the charges at all. And I was told there would be no charges brought against me. Okay. So, that's why I'm not even sure where these charges came from because they arrested me and then they said it was a mistake that they arrested me and they let me go. Okay. Thank you for the information. As stated, any issues such as those being brought up will be dealt with at the pre-trial in front of Judge Washington. Yes, ma'am. Is that a jurisdictional hearing then? She can address jurisdiction at that hearing. Yes. Okay. Thank you. At this time, the court will set a pre-trial conference date of May 29th, 2025. That will be at 9 in the morning over Zoom in front of Judge Washington. The court will be entering a plea of not guilty at this time on your behalf. Could you do it as the no contest one instead or does it make a difference? I cannot give you legal advice. The court will set bond with the following conditions. You are not to use or possess alcohol, marijuana, or illegal drugs. You are not to leave the state of Michigan without the court's permission. You are not to engage in any sort of criminal activity whatsoever. You are not to purchase or possess any firearms, ammunition, or other dangerous weapons. Any that you do possess are to be surrendered. You are to appear for any and all dates set for you by the court. The next one in this matter being that May 29th Zoom hearing at 9 in the morning. And do you know when you are getting out? I'm working on it. I'm working on it. Um they they um were supposed to do some kind of report and they never did it. So I got stuck here longer. Okay. But hopefully 28th of April is my next court day. So hopefully that's when I'll be able to get out. Okay. At this time the court will set a $10,000 personal recgnissance bond in this matter. So, what that means is you're not paying anything to get out on this case. You are basically promising to appear for the next court date and to abide by all of the bond conditions. If you fail to appear or violate any bond conditions, then your bond is going to start at $10,000. Yes, ma'am. Okay. Also, I don't believe that I advised you of your rights. You do have the right to remain silent. Anything that you say out loud or in writing can be used against you in court. You have the right to be presumed innocent beyond a reasonable doubt. You have the right to a trial by judge or by jury. You have the right to be represented by an attorney during all stages of these court proceedings. That is before, during, and after trial. You are not required to disclose citizenship status to the court, but you do have the right to consult with an attorney to see if this case has any effect on your citizenship status. If that part doesn't apply to you, then don't worry about it. So, any questions about your rights? Okay, you have your next court date.
