okay you cross over the line like five times okay okay [Applause] Masters very nice and wet okay so just above the legal limits oh great you've recorded us calling you all kinds of names and saying this thank you Las Cruces Police Department originally spoon you over for better to maintain your lane backward okay you cross over the line like five times awesome okay is everything all right yes okay where are you coming from downtown downtown okay do you live here in town now um visiting your parents okay just if I were to send you some mail would you get at this address yes it will yeah okay what year were you headed to right now um [Music] drink something Okay Okay the reason I was asking is I can smell it okay so yeah all right I'm gonna ask you to submit this the Saturday night's field sobriety tests okay go ahead and step back that's fine how long ago did you have that drink um maybe like 30 minutes ago 30 minutes ago what was it [Music] um you wanna put that down yeah we're going to the sidewalk over here okay let me um let me turn off these lights real quick okay [Music] I can step up to the sidewalk first thing I'm gonna do is I'm gonna check your eyes okay stand like that hands down to your side foreign with your eyes and eyes only without moving your head and keep falling until I tell you to stop you understand foreign this is kind of inclined so we're going to go over here what's level okay oh yeah yeah all right so we're gonna be facing this way okay can you imagine a straight line in front of you [Music] I'm gonna talk you through this okay first thing I need to do is put your left foot on that line like this okay now you're gonna put your right foot in front of the left foot with the heel of the right foot touching the toe of the left foot heal the toe like this and now put your hands down to your side okay now remain in this position until I tell you to move do you understand when I tell you to start what you're going to do is going to take nine here to toe steps on that line when you get to your ninth step you can leave your front foot on that line step out with the other foot take a series a small step to turn around I'll show you how to do that and then you're going to take nine here to 12 steps back on that same line okay now on each step I need you to look down at your feet count your steps out loud so that I can hear you keep your arms down to your side and don't start this test until it's been completed do you understand okay I'm gonna demonstrate the test okay it's gonna look like this okay one two three up until nine step out like this so he's a small step to turn around one two three okay do you understand do you have any questions the second nine sorry did I do that right should I do it again as instructions [Music] and we'll go back over here on the sidewalk well actually no that's a good incline so let's go back over here where it's level all right just face me all right but this next one what you're gonna do is uh first start off be together hands down to your side now don't move from this position until I tell you to move do you understand okay when I tell you to start what you're gonna do is going to raise your your foot either left or right doesn't matter it's up to you you know raise it approximately six inches from the ground okay like so all right if you notice my foot is parallel with the ground so don't Point your foot up don't point it down but parallel have your legs straight hands down to your side now hold in this position you're going to look down at the elevator foot the whole time you're counting this manner 1001 1002 1003 and so forth until I tell you to stop do you understand I do do you have any questions okay just a second what's up I'll tell you I'm sorry okay okay you may begin [Music] awesome plan 2013 2014 and 2015 2016. 2018. okay you can stop all right let's go uh walk back over here who's that vehicle registered to where it is to my parents okay all right you need to turn around okay put your hands behind your back we're under arrest you're diving under the influence usually keep in the car that needs to go with you for example a cell phone a wallet [Music] I don't know like what what will happen after this point at this point we're going to take you to the station okay and I need to read you a couple of things and then we're going to conduct another test should you uh want to submit to it okay will this go on my record or uh right now you're not convicted of it you're just being arrested and charged with it okay uh it's the courts I've decided you're convicted of it and then will it be the New Mexico courts or okay I'm supposed to go to back to California on Mondays so what I how would I proceed with that what's today today Thursday you'll see that you'll see the ditch tomorrow and then you'll be able to ask the judge you know what Arrangements you need to make okay okay let's go back this way again uh do you have a cell phone uh and a wallet in there okay I'll get it for you okay okay step down right here let's see uh where's your uh wallet and cell phone in the middle console or something um my uh cell phone should be on the driver's seat and um the driver's seat and then the wallet I think should be in the center console or maybe on the passenger seat okay I'll look for it okay you're right with you can we see [Music] Miss Smith um you said that does belong to your parents okay do they uh well let me give you the option do you want to call them to come pick it up or somebody to come pick it well actually it has to be your parents if it's registered to them I can't release it to anybody else otherwise I do have to tell you and of course you'll be able to get it tomorrow it's uh depends which uh company picks it up and I don't know which one it is we just go with the on-call tow truck okay give me a second I'll be right with you okay Uncle 46 please stand by [Music] from earlier ones hey come on foreign thank you okay got your wallet and your cell phone okay I need you just gonna be careful okay I'm gonna tell you something important listen to me I'm about to tell you something important you are under arrest for driving under the influence the New Mexico like and syntax requires you to submit your breath test to determine the alcohol content of your blood after you take our test you have the right to choose an additional independent test if you choose to take this additional independent test you the right to a reasonable opportunity to to arrange for a position a licensed nurse laboratory technician or technologist who is employed by a hospital or physician of your own choice to perform an additional chemical test the cost of this additional test will be paid by the law enforcement agency agreed to take our test okay so find out what you meant for the tow truck as soon as you get here then we'll go to the station we'll do that test okay yeah yes um I was just wondering so after the vaporizer pass and what happened I'll take you to the station but while we're at the station um I'm sorry take you to the detention center but while we're at the station after we take the test if you need to call somebody I can give you your phone so you can make arrangements to somebody to come get you out uh you won't be able to get out until you see the judge though which is tomorrow morning or today hopefully okay okay you're still under arrest what's that man yes ma'am yes ma'am well it's not a pass or fail it's just whether you show signs of impairment or not and and that will all be in my report the specifics and all that that will be in my report yes ma'am what's that yes ma'am well you have to go through to the department to get it and or through your
