I want y'all to back up. I don't want to be responsible for y'all with this man. >> Or >> give me about 10 ft. Do what I ask, please. >> We We gave you about 20 ft. >> I'm asking you. >> You're about to have more problems than you could ever imagine. Boy, >> that's right. Boy, >> do you know how many cameras are already here? >> But since you're asking for camera footage and video, it's going to be the 45 because it's considered confidential information. >> Oh, okay. So, it's 45 what? >> Business days. >> 45 business days. Oh my gosh. It actually only takes me 45 business seconds to retrieve my own footage. He told me I don't need to record my own footage because they are recording footage. >> And they did. >> You know how many cameras are already here? >> But it takes 45 days to get it. So I'm in Midland, Texas in a parking lot getting ready to head into a building to do an investigation when a guy in a white car drives by and says, "Hey man, a meteor is going to hit the earth in 7 years. You better get right with Jesus before then." Now, I couldn't care less what this guy had to say. But it never crossed my mind that, hey, maybe I should call the police on this guy cuz he's talking about things I don't care about. Little did I know, someone he tried to preach to earlier had called the cops on him, and the Midland police rolled up on him right after he spoke to me. At first, just one cop car pulled up, but as a second, third, and even fourth pulled up, and they had him removed from the car, I thought, "Holy smokes, this is a serious felony stop. We are probably about to record the end of a six-month manhunt on a serial killer." They pat him down and start rummaging through stuff inside of his vehicle. >> It's not on. The whole gimbal's not on at all. There's a lot of cops here. Turn it on. >> They walk to the front of the police car and start talking to him. >> Sleep it. >> Top left button. There you go. >> We'll We'll stay. >> Oh, yeah. Out of your way. >> Okay. We're pretty sure based on the response we're seeing and the fact that now a second cop is reaching inside of his vehicle that surely they have a felony warrant for this guy. Then all of a sudden the chief of police walks up and starts trying to pick a fight with him. >> Dude, that's not what happened. Why does this happen? >> What do you mean? >> All right. Just not go back to ask a question. I tell them that's it. That's how I do it. Okay. See, they're going to take care of the job. >> Okay. You go back to the city. >> So, you're doing your job, but my rights to pay water. >> No, you can pay your water bill. You better have a water bill again. That's not what you were doing today. >> Yeah. >> That's not what you're doing. >> I Okay, that's fine. That's fine. But you got to understand >> I I understand you got understand I don't have a problem. >> I don't have a problem. I don't have >> Okay, now these are things. I'm telling you that's the way that it's going to be. You're over there. >> That's cool. That's cool. Don't No disrespect to nobody. You understand me, sir? >> I got a job to do that. We got business here. This is the way it's going to be handled. Okay. You lied right to me. If you're over there, it's not going to happen. >> How the [ __ ] she's sitting down? What are you [ __ ] And I was turn around. I was turning around like this. I said >> now the detective gave away what's really going on and everything kind of changes. He walks up and starts bullying the guy and telling him, "If you go into city hall again, you'll be arrested." But the guy isn't having any of the bullying and tells him, "You're not going to disrespect me." Now, watch when the video restarts how the cop on the left actually waves the chief away. He tries to tell him to leave because he's escalating the situation. He obeys, but now he's mad because this other guy won't take his crap and his subordinate told him to back off. So, he brings his triggered ego over to me. I >> was turning around like this. I said I was said, "Sir, I was turning around just like this and talking to him. talking to her. >> Hey, you you know what I mean? Hello. Was talking to her. Talking to her, dude. And they say, >> I want y'all to back up. I don't want to be responsible for y'all with this, man. >> We're >> Give me about 10 ft. Do what I ask, please. >> We We gave you about 20 ft. >> I'm asking you to give me >> You're about to have more problems than you could ever imagine. Boy, >> what are you? >> That's right, boy. How far do you want me >> away from me? >> Okay. >> I want you out so I don't have to worry about >> Hey, officer, can you can I get one of you over here? Now, I've been told that 99% of cops are good. Since I found the 1%, I'm asking the 99% to come over and tell him to leave me alone. So, now we know what's going on. This guy's inside a city hall. One of the staff members doesn't like him, so they call the police on him. The police show up and mass numbers to bully him. He's not having it. And now it's all caught on camera. You're used to bullying people, aren't you? >> No, just conducting business. >> Yeah, you're bullying. >> You're bullying people. >> No, that's not You don't know anything about this. >> Keep your camera pointed towards them. >> It doesn't matter what I do and don't know. You don't need to bully me. >> I'm not. >> You were. >> No, I wasn't. >> You like starting trouble where there's not me. >> I kept my mouth shut. You walked up to me and ran your mouth. >> The guy, >> man, that's pretty good. >> Yeah. >> Pretty good. >> There's no problem. >> You did the same thing to him. These officers had everything under control. You wanted to walk up and try and escalate and piss him off, try to cause a problem. We watched you do it. We recorded you do it. >> Do you know how many cameras are already here? >> Oh, I know how long it takes to get your body cameras. Hell, I requested one 6 months ago. I still don't have it. >> I bet you don't. >> Yeah, that's right, boy. >> What are you requesting for? What is it you do? >> Don't matter. It's probably time for you to retire >> before you catch yourself a criminal charge. >> I don't think so. I think I got plenty left in me out on this job. Do you know anything about those? >> I know what a job is. I've got employees just like you. >> People who need to be told what to do all the time. need to be given specific instructions and still can't follow them properly. >> Think you're funny though, don't you, boy? >> I think you might catch a criminal charge. >> I don't think so. >> No. >> No. >> No federal charge? >> No, there's been no violation. >> Not here. Not with me. Not yet. Not today. But >> I'm just saying I >> I've made it 30 years with that one. I think I'm good. Yeah, >> 30 years. But there's only been cameras for about five or 10. Really? >> Well, cameras that you don't own and don't control. I've ended careers for cops that have been in the business for 40 years. >> Probably a bunch of them that need it. >> Yeah. >> What was your name? >> Chatwell. >> What was it? >> Chatwell. >> Chatwell. >> Yep. >> Okay. Thanks, man. You have a good one, brother. >> Hope to be better next time. >> Jesus is is returning. >> And what were you doing? I was just saying >> telling about Jesus. >> Telling about Jesus. But I'm doing it like like back then. >> And the spaceship. >> Yes, sir. What y'all said? The spaceship. It's not a spaceship. >> What? Oh, I'm sorry. >> Wormwood. >> The Wormwood. Okay. And you were telling them about Jesus in the Wormwood, >> which you can do. You can tell them about anything you want on that public sidewalk. But there's always more than one side to a story. So, we went into the Midland City Hall to get their side. Since I had a clipboard, everyone was perfectly willing to answer all my questions. >> Hey, how's it going? >> Good. How are you? >> Good. >> Is there something I can help you with? Uh, which office was Jose in earlier today? A few minutes ago? >> Um, he was here. >> Do you know was he in the whole area or what? >> Um, can I ask who you're with? I'm sorry. >> I'm an investigator. >> Oh, okay. He was just here in this lobby. >> Okay. Was he bothering you? >> Um, he he had actually made a phone call um and was speaking to the girl that was covering the front and then he walked in while he was on the phone and I assisted him. >> Okay. Uh, why did he get kicked out? >> Why did he get kicked out? Give me just a second. >> Sure. >> So, I'm not too sure exactly the reason why. Um, I just know that he he was um he walked out on his own. We didn't we didn't kick him out. >> Okay. Nobody here asked for him to be removed or anything. >> We just asked if there was something we can help him with. >> Okay. Okay. What was it? Can I write down who I talked to? >> Yes. My name >> Just saying. Yeah. Do you know if someone called the police on him? >> No. >> Nobody did? >> No. >> Okay. >> Not today. >> Not today. Previously though, >> I'm not too sure. >> Does he often stand outside and bother people, too? >> I'm not too sure. I actually don't work in this area. Okay. >> I'm just covering the desk today. >> Okay, I'll ask her. I think she knows more. >> This gentleman's asking questions about this. >> Okay. >> Hey, so was he in here bothering people today? >> He was in the building. I don't know all about his bothering, but in here. >> Okay. Did someone ask for him to be trespassed? >> Um, he was in the building and he was removed from the building. He was very aggressive. So, in that case, we're protecting our staff. So, we had him removed from the building and anytime we have that situation, obviously police is part of us. So, they responded. >> Do you know who he was being aggressive with? >> Um, we had um one of our receptionist are covering for our receptionist. >> Okay. So, the receptionist, she's covering for her now. >> Correct. She is now, but this is who was here earlier. >> So, he was bothering whoever was here. Correct. And that person has now been removed for their >> back in their desk >> for their safety. >> They were just covering. No, they were just covering. So, we normally have a receptionist here. She's out today. >> Can we move over here? I just don't want to block any Who was it that was here at the desk? >> Um, I don't know if I want to release that just for privacy sake. It's not, you know, >> it's just for our report so that I can send it back. >> She's just one of our HR staff members. >> HR staff. Okay. >> And he was being aggressive with her. >> Was he swinging at her, throwing things? >> Um, verbally aggressive. >> Verbally aggressive. Okay. And uh so she um asked for the police to have him removed. >> No, the police didn't remove. Another staff member was here. Uh a male staff member was in the building just walking through, saw it, intervened and escorted him out of the building. Just asked him to leave. Okay. >> And once he left, she had notified PD that he had been here. He was aggressive just so that they were aware. >> Okay. So the male staff member just asked him to leave and he did voluntarily. >> Has he I understand there's been repeat incidents. >> Are they normally inside of the building or is it often outside or is it both always inside? >> We don't deal with anything on the outside of the building. It's once they walk into the building that we have concerns. >> And he's in here often. >> He's been here a few times in the last week. >> In the last week. Yes. >> And what I think I know what he's doing, but what is he in here preaching? >> Um that's part of it. Yeah, some more some ramblings on different things and things regarding council members, but a large part is just some some preaching >> things regarding house members. Is it >> council members? >> Oh, okay. >> Concerns he has with council members. >> So, um cuz I >> we saw him preaching so we already knew about that part. So, >> preaching and and criticizing council members. >> Yeah. >> Okay. >> Hey, how you doing? >> This is Steuartic Communications. >> Hi, I'm James. We're just doing an investigation about Joseé Hereda. >> The gentleman that was in here earlier that was here last week as well. >> Okay. >> Um, >> are you okay if I just kind of >> I'm totally good with it. Yes, sir. >> Okay. >> And he's here. He does our media with the city. So, it's just kind of an added >> Okay. >> Just so you're not like, "What the heck?" >> No, I'm fine. More people the better. >> Yeah. >> More more perspectives, more stories. Have you dealt with him before, too? No, I'm just and I haven't and but if you don't mind, I just like to kind of um watch Nicole do her thing. >> Okay. What's your position here, Nicole? >> HR director. >> HR director. >> Strategic communications officer. >> Strategic. >> Mhm. >> That's the title they gave me. So, >> can you give me any strategies on communicating? >> You seem to be doing a pretty good job [laughter] of it. Yeah. >> Okay. Um, was he trespassed the last time he was here, too? >> No. >> Okay. >> Uh, and you don't know of him being trespassed today, right? >> Don't just whatever the police did is what they did. Okay. You guys didn't ask for him to be trespassed. >> All right. I I think that might be all I have. >> Okay. >> Um, I appreciate it. All the employees are good. >> Y, >> everybody's safe. >> Yep. Everyone feel >> at the end of the day is just making sure our staff is safe. >> They did. Did Did she feel safe? Unsafe at some point. >> Um when he was aggressive verbally towards her. Yeah. I mean normal behavior from those people that come in the building. So >> yeah, >> we want to feel welcome in here, but at the same time we also want to keep our staff safe. >> Do you know specifically anything that he said that >> that she felt was aggressive? >> It's just the tone of his voice and just coming kind of directly at her and being aggressive towards her. I wasn't present when it actually happened, so I can't say exactly what he was saying. >> All right, cool. Thank you so much for your time. >> Anytime. >> All right. I'm James, by the way. >> Nicole. >> Nicole. Good to meet you. >> Stuart. >> Steuart. >> Good luck with everything. >> All right. Thank you, sir. >> Have a great one. >> You, too. But I got one more thing I want to address. Earlier today, we were recording the police. And the chief of police said, "Do you know how many cameras are already here?" Now, he didn't tell us we can't record. He didn't tell us to turn off the cameras. But to me, the implication was you recording is completely unnecessary. So, I thought, let's just assume I'm a brand new reporter. I support the police. I don't want to make him mad. So, I take his implication and say, "Yeah, you know what? You're right. I should just turn off my camera and walk away. I'll get your footage later." [music] >> You're about to see the reality of how you are. If your plan was to rely on the government for anything, >> I was just across the street recording um the police stopping Joseé. >> Okay. >> And a detective told me that we don't need to record. >> Okay. cuz we can just have all their body cams. >> Okay. Yeah, just request it with recorders department. >> How do How do I do that? >> Uh you're going to ring that doorbell right there by the pink sign. Let them know that you're requesting body cam footage. >> Okay. >> Um in regards to >> Jose Herrera. >> Okay. Yeah, we >> stop outside his town hall. >> Okay. Yeah. I don't know who that is or what you're referencing to, but they can help you figure that out. >> Okay. >> Okay. >> Sounds complicated already. >> No. Well, we're non-emergency line, [music] so we are civilians. We don't know exactly what you're speaking of. >> Oh, >> yeah. >> Nobody's heard of it. >> No. >> Okay. Can maybe we can call ask the detective to come down here then? Cuz he told me that I could just have all the body cam footage. So, if we turned off all the cameras, then we would need that footage right now. So, I assume he's just going to bring it to us. >> Yeah. >> Did he tell you he was going to give it to you right now? Well, he did tell me that there's no reason to record because he has the footage. >> Well, y'all are more than welcome to record, but the thing is is we can't We're a different department. That's the records department. You still have to go through a process of requesting camera footage or any kind of copy of a report. >> This already sounds a lot more difficult than pulling my SD card out of my camera myself and just having the footage. >> It's just our policy, sir. >> And that's all she had to say because if there's one thing I understand, it's just following policies. gloves for >> it's just uh it's policy. >> Okay. >> Yeah. Whenever someone's uncooperative or doesn't tell me what I want to know, it's policy to put gloves on. I don't know. Again, I don't know. I don't question why we do the things we do. It's just policy. >> Sure. >> Doorbell that pink sign. Okay. >> All right. Thank you. >> You're welcome. >> Gosh, this is already a lot harder than pulling my memory card out and uploading it to you. >> Hi. Can I help you? >> Yeah. Um, I was just recording uh the police stopping Jose outside of town hall a minute ago. >> Okay. >> And um they told me I don't need to record because they have body cams going. >> Mhm. >> And I can have their body cams. >> Okay. >> Um so I'm just here to pick those up. >> Okay. So there's a process that you have to go through. >> Oh gosh. So it's not as simple as me just saying I want their body cams and I get them. >> Well, you have to do a request. >> Oh gosh. >> It's an open record request. >> O. Okay. How long does that take? So, it depends. >> Okay. >> Um, non-confidential is 10 days, confidential is 45. >> What does that mean? >> So, non-confidential is a basic redacted report. There are certain things on there that's redacted like uh names, account numbers, dates of birth, and that's for the other person's protection. >> Um, this right here is confidential. It's a little bit more detailed information, but since you're asking for camera footage and video, it's going to be the 45 because it's considered confidential information. >> Okay. So, it's 45 what? >> Business days. >> 45 business days. Oh my gosh. It actually only takes me 45 business seconds to retrieve my own footage. He told me I don't need to record my own footage because they are recording footage. >> And they did. >> They did. Well, I'm sure if they had >> But it takes 45 days to get it. >> Do you know how many cameras are already here? >> Well, through the legal department, >> that's their requirement. >> Oh gosh. When he told me that when we turned off all our cameras, I assumed I was just going to come down here and they were just going to hand them all to me. >> No. >> So, 45 days to publish the story. >> Yes. >> Gosh, my boss is going to kill me for turning off the cameras. >> I'm sorry. >> He told me to get the story. >> Okay. >> Oh my god. Somebody's going to get the scoop on this now. Okay. 45 business days to get the footage that I could have recorded just now all by myself if the officer didn't tell me to stop recording. >> I wouldn't know I wasn't there. >> Oh god. Okay. Yeah, sure. I'm sorry. I'm just >> No, you're fine. >> I'm just freaking out right now cuz I'm I'm afraid I'm going to get fired for not having the footage today. >> So, if you're looking at getting that footage, um you have to fill this information out. You also have that option right there. There's a QR code. >> Okay. >> There behind you. >> Okay. >> You can scan it and you can do it online as well. Um, it really >> I'm like shaking. I'm like nervous right now. I think I'm going to lose my job for not having this footage. >> Okay. >> They were trying to publish tomorrow. >> I'm sorry to hear that. Um, so you're going to go ahead and fill this out. If you decide to do it paper form wise, it'll be your name, um, your information. You have an option to leave your email address. >> Okay. Oh gosh. So, I got to give all my personal information too to get it. >> Well, so this is the reason why. If you decide not to leave your email address, they have to mail it to your house. >> Okay. >> Okay. If you leave your email address, then obviously they'll send you an email. [snorts] >> Okay. Could I put a fake name on there? >> It's as long as I put a good email where you can send the records. It doesn't have to be a legal name, does it? >> I don't know. Okay. >> So, I'm limited on the information I can give you, >> okay? >> Because I'm not the legal department. >> Okay. >> Um, so you'll fill this out. This section right here is >> for the record that you're requesting. Uh you'll have to put the name and date if you happen to have it on the person that you happen to have had this incident with. Location, the date of the incident. Since you don't have a report number, you can just leave this blank here. You need to be very specific about what you're requesting. So if you just put in you're requesting a report, that's all I need to do. >> Okay, I'm just going to put in my notes. Um lots of work. Okay, go on. >> Um you can choose the box either nonidential or confidential. Okay, and then of course this one right here is uh basic information. You can either choose this or you can not. It doesn't matter. You're going to check this off here and date. Basically, this is just verifying that you are the person that >> I got to sign. So, if I put a fake name, then I'm probably going to be signing and that might be fraudulent then. Okay. I'm just trying to figure Yeah, it's my It's my first time turning off a camera cuz a cop told me to. And I was like I was like, "Oh, man." I I was really impressed. I was like, "Oh, that is so cool that Midland Police Department just like, "Hey, you don't need to record. Come to the station. I'll give you my footage right now." And I was like, man, this guy is so nice and now it seems like he just hemmed me up and I'm probably going to get fired for not recording it. >> I got to go through all this work now. >> I got to wait 45 days. Is it going to cost me money? >> No, this is zero. >> It's free. >> It's free. >> All the footage is free. All the body cam footage that I want >> that you're requesting. >> Okay. Nothing [snorts] is free. Somebody's paying for it. >> I'll probably also at this point have to hire a lawyer to try to help me through the legal le loopholes. Unless you have one. I said I don't work for the legal department, so I have no idea. >> Where are they at? Maybe I can get them to help me. The legal department. >> I can give you the number to the legal department if you'd like. >> Are they at city hall? >> I'm pretty sure they are. >> Maybe I can just go over there. >> You Okay, cool. Thank What was your name? >> My name is Elsa. >> Elsa. And uh what's your position? >> I work for the records department. >> Elsa with records. What's your last name? >> Just Elsa. >> Just is your last? Just Elsa. >> Just Elsa. So just is your first name? >> No, sir. My first name is Elsa. >> Oh, okay. Okay. What was your last name? >> I don't need to give you my last name, sir. >> Okay. Um, I'll go ahead and just do this records request and hand it to you. Okay. So, I'll put >> There's a bell right there. You can go ahead and ring it and I'll come back and pick. >> Okay. Cool. Thank you, Elsa. The request is for the last name and salary for Elsa in police records. All right, I got it ready. So, uh, got a name and email, and the request is for Elsa's last name and salary. >> Okay. Oh, you didn't check anything. >> What do you mean? >> So, remember, you have to choose a box, either confidential or non-confidential. >> Oh, I really don't know what that means. Do you can like >> I've already explained that to you, sir. >> Yeah. And I'm not a legal genius. >> Neither am I. I don't work for the legal department. >> Okay. So, neither one of us have a clue what's going on here. I like I explained to you about non-confidential and confidential. If you'd like, you can reread these. They briefly tell you what they mean. >> Okay. So, I So, your first and last name and salary would is not confidential. So, do I just put non-confidential then? >> That's really up to you. I cannot >> Well, I'm trying to understand which is which. So, uh I want confidential information means that they're going to have to do redactions. Is that right? >> Non-confidential is a basic redacted report. >> Okay. Confidential is a little bit more detailed this year >> with no redactions. >> No, I didn't say that. >> Okay. Gosh, this is Oh my god, I feel like I need to have gone to law school for eight years to understand how to do this. >> Check one of these boxes. I cannot submit it to the legal department. >> Sure. I'm just trying to make a choice. >> Yeah. No, I'm So, I want confidential information. I'll mark this one right here. >> I wish I had a law degree so I could figure out how to do open records requests. So, these are legal determinations that I've got to come to here, right? >> Yes. You'll need to certify that you are the one requesting it. So, make sure you check this box. And I need a date. >> Okay. >> All righty, sir. So, are you good with leaving everything else blank? >> I think so. I think it's a fairly simp Yeah, they could just email me your name and salary. You You didn't want to give it voluntarily? >> No. >> You want to be uncooperative? >> I never said that. >> Okay. Well, I'm trying to do an investigation here. So, you can either voluntarily cooperate or we can do things the hard way. Which way do you want to do it? Oh, okay. That's fine. >> Which way do you want to do it? >> Um, so if that's the case, we're complete. I'll submit it over. So, they're going to actually tell you that it'll take 10 business days. >> 10 days. >> Yep. >> So, 10 days to get your name. >> You chose non-confidential. Non-confidential is 10 business days. >> Oh, okay. What's the other one? >> The other one was the 45 business days. >> Okay. So, confidential. >> 10 days to get your name, 45 days to get >> uh video. >> If that's what you requested, business days. 10 days. >> 10 business days. So, >> yes, sir. >> More like 14 maybe 14 days. >> So, records works Monday through Friday. As for the legal department, you'd have to speak with them. >> So, it'll be 10 Monday through Friday business days. >> I don't know. I don't work for the legal department, sir. >> Man, government is so efficient. 10 days to get Elsa's last name when you could stand here and tell it to me right now. >> Okay. Uh, is there anything else, sir? >> Can you believe how complicated things are through government? >> Is shocking. >> There's your copy. Is there anything else I can help you with? >> Um, I don't think so. I'm just going to mark you down as uncooperative and let my supervisor know. Okay. >> Just Elsa was uncooperative. >> If any private business out there were this inefficient at anything in life, they would no longer be in business. And you're forced to pay for all of this.
