hey guys sorry it took so long to get the final chapter to this story published i was waiting on records requests that were finally filled but even after they were filled the video from lori's phone was in such low quality that i'm not even using it in here to catch you up on what happened i went to torrance county i recorded in public i was bullied by these two cops i went to do records requests to get body cam footage dispatch calls and other things from the incident the staff at the county offices were extremely rude and played games with me trying to get me to give my home address in order to retrieve public information after almost an hour of arguing with these people they finally decide that they're going to give me the records without getting my home address now they want exact change the problem is i've been here for a long time and i've got other appointments to get to i don't have any more time to deal with it so i leave to come back the next day i come back the next day thinking i'm just going to slip 25 under the glass they're going to give me the records well they decided they want to play games again and we're back to square one rather than just hand over the disc and end this they send the deputy county manager out to say stupid things for the camera how you doing man how you doing oh good i understand you're looking for a reaction uh this is a professional office i'm looking excuse me this is a professional no no what'd you say before that that you're looking for a reaction what does that mean i'm looking for records what is your name my name is phillip phillip county manager philip you can go ahead and go back to your office thank you there's no reaction needed bye you're dismissed so are you if you're dismissed i can stay here and record as long as i want yeah you can yeah you're dismissed this is a professional office no it's not you're dismissed you're you're dismissed sir so you're telling me i'm looking for a reaction and you came over here and you came over here to give me a reaction no you're not very bright then are you if you were smart you would have sat at your desk and kept your mouth shut wouldn't you what's that i said i'll see point i'm not thinking i'm going to get the records at all i just want to go live and show the world what these people are doing many of you were there for the live stream i believe we peaked at 800 start to finish i'm just going to show the parts that tell the story here today but they've got the entire they've probably got the entire sheriff's department headed over here right now the reason that they their attitude completely changed today from yesterday is because every one of them made the point we saw your youtube we know what you do we saw your youtube we know what you do so their you are only required to provide name and address and phone number if it's in writing this does not apply to oral requests okay so i need to make an oral request hey lori got one more piece of to give can i just give our point for just a little bit my understanding sure and it's really for our accounting in order to have any kind of revenue that comes in we have to give an account for that with our account uh our auditor and so that's the reason if when she showed me the alleged state law too so i'm not i'm not going to argue that i'm just saying that you know i want the records i mean if you guys aren't going to give them you're not going to give them i just gave her an oral request for the record so and the law states that i have to give a an address a name and a phone number for a written request but i just did an oral request and and so there's no pull that up okay because we certainly want to comply by the state statute and if that is the case then we will work and i understand that sometimes the statute is wrong and that's so that's sometimes why we have to go to the ag and or you know or get something changed and if that's where we're at then that's where we're at but my whole point though and my viewers agree you know i i'm constantly recording government and people say oh you're such an antagonist why are you recording but look at this you know i can't get public records right and that's the problem with me too and we're not trying to make this harder but i'm also trying to follow state's debt understood what we are required to do as far as having our audit and making sure we have our internal controls taken care of i get that that's my my management my way of making sure i'm protecting both sides of things and and yesterday everyone was polite you know they were they were not experienced and that's why i came back live you know i mean we all make mistakes i've been in business for a long time that's not what i'm concerned about it's you know it is what it is she gave me a law that said she doesn't have to give me the records i was going to move on publish the story as is and maybe it's the law that needs to be changed maybe i go to the ag and say i mean you can see how that law can be discriminatory against homeless folks right yeah um i mean every member the public is entitled to these records and so all right so if you give us sure i'm gonna see if i can get that information and we'll see if we can get a remedy to this okay i appreciate it so i don't think the law actually needs to be changed it says that you have to give an address so that they can correspond with you an email address is plenty sufficient it doesn't say that it has to be a physical address and it certainly doesn't say that it has to be the address of where you sleep 14-2-8-a right and that's what i have here okay okay so in the first section which is on new mexico statutes 2006 section 14-2-8 procedure for requesting records and then it has a any person wishing to inspect public records may submit an oral or written request to the custodian however the procedure set forth in this section shall be in response to a written request to respond to an oral request shall not subject the custodian to any penalty so that's where i think everything that we've been doing is in response to asking people to put everything in writing okay and a lot of it has to do with our own accounting making sure because we have certain guidelines that we have to follow by state statute respond in a reasonable amount of time and if not we provide a letter that if it would be cumbersome as far as the amount of time that it may take that would be a problem keeping communication with the person that's requesting the record so given that we do have this state statute which states that we follow everything as if it's written we're going back to still the same response that a written request shall provide this because it says that um everything in the statute the procedures are set forth in the section shall be in response to a written request right so and it says um so those things aren't required for an oral request and i can give an oral request and you can fill it if you so desire but i you can't be held accountable for choosing not to fill it does that make sense so it doesn't mean you can't fill my request without a name it means that it's on the the only you guys can choose what you want to do i mean go ahead and reread it let me know if i'm wrong there but the the thing is you can choose to do it if you choose not to there's no punishment though but whenever you go down into further and it says a written request shall provide the name address and and i know resonating right the oral part of it and for us because we do have a written requirement that allows us to track everything we will make sure that we have the name address all those because we will be receiving money for this so for example you can give them to me for free they are a matter of public interest as you can see there's 1300 people watching lori says no see lori no matter what she just does not want to fill this custodian right and so she is the one that's on the hook for whether or not we follow this and so even though the county manager she's the one that is well-versed in this with us well she's not she i actually have her on recording yesterday saying she's only been doing it for a few months and she really doesn't have a handle on it yet which is fine i get that i've been on i've been in new jobs before too laurie it takes time with the guidance of our county attorney right right and what i'd like to do just so that i make sure that we don't do anything wrong and not that i'm trying to get out of giving you something if this is actually an oral request and we're allowed to fulfill this way i'd like to be able to run this past our county attorney sure and he's due in tomorrow okay are you still in the area tomorrow would you be able to come back i was supposed to be leaving last week but after this i'm probably staying for about six months okay yeah uh we yeah we got somebody in the county to let us stay with them and we'll be here for a while so would i like to actually do you have a good real estate agent i actually probably should buy land out here well we always enjoy having people move into our county so i could probably work out get you some information i would agree that would be awesome okay cool um but in the meantime if uh you don't mind we can set up a time for you to come back tomorrow yes because i don't read emails but how else were you supposed to let me know you know come on work both ways here yeah well so for today just to recap um it says that you can give me the records based on an oral request but you do not have to yeah or written requests yeah and then all the procedures that are in here our procedures are set forth in sections shall be in response to a written request but i see his point of view where it says this is all for written and not necessarily for oral but i want to make sure that we comply with everything and so i'll be checking with our county attorney all right so the oral is up to your discretion that is totally your choice you can say yes you can say no there's no consequence either way right but that doesn't make us the best in the way we handle i would agree and i think the public would agree and that's where i wanted to make sure that we take care of that excellent okay i'm not trying to i i knew they were lying when people told me this county was corrupt just laurie i appreciate but um i know it still comes back to the issue if you do pay for this but we have to give an accounting for all the revenue that we do receive i mean i've been in business for so long and i've never i mean i go to lowe's they don't need my my home address and my name for accounting reasons i go to you know what we were told by okay okay and again you know this may be another thing this may be another thing where it's the law is the problem and you guys are abiding by the law but that's what the problem is and that's where i need to go you know maybe that's this is what was reported to me so that doesn't mean that i'm not willing to go through and investigate and make sure that we're following things the right way or something's too cumbersome if there's a way that we can handle things better for the public because we certainly don't want to stop the public from getting any information that they're it's you know allowed to have excellent i love that i'm not trying to be a problem let's find the solution you've been absolutely wonderful oh thank you i'm trying because i know this is an important issue not just for you and was willing to give me all the records that i need right here right now once again i had been here too long and i had other appointments that i needed to get to so i left anyways and came back the next day to get the records i come back the next day what is this the fourth or fifth time to retrieve the records i had also looked up the attorney general's recommendation on how much should be charged for a dvd which is two dollars and seventy five cents i believe that lori is the one who will be taking the money so i show up with two different chunks of change i've got 275 and one cup all in change and 25 dollars in a separate cup all in change i figure the more that lori wants to charge me the more she gets to count unfortunately janice is the one who gets to take the money and i get to be the douchebag giving change to janice to count out after she's been incredibly nice to me the audio is horrible because of the wind but janice came out while i was out there to get me and let me know that she was ready and had my records ready for me i told her that i wanted lori to get my records for me because i had a special present for her the change she informed me that laurie wasn't here today and she probably wasn't going to be back for quite some time did she quit i can't talk about personal okay all right no problem how you doing today sir [Music] i did have you on my list of people to call today because i have the records ready i appreciate it um now the other thing was that she uh she had said that it was going to be 25 for the dvd the attorney general recommends 275. um i don't know where she got the 25 dollars from if she just made it up or i'm not sure okay i can check with our county attorney he is here today okay so we can find out exactly where the 25 no no this video i'm going to have to put up my email so that you can contact me and let me know what a douchebag i am seriously though guys people make mistakes we all do it these county employees made mistakes i'm not going to deny that for a second but you know what's incredibly rare for me to see is for government employees to make mistakes and then turn around and say we made a mistake and make it right one of my biggest problems with government and one of the biggest reasons that i started doing this wasn't just because government employees make mistakes it's because they never admit that they're wrong well janice the county manager in torrance county new mexico is different i cannot think of a single time in all of my years of doing this where government employees have stopped and checked themselves and changed their own behavior without me or my audience or others escalating to a point where they have absolutely no choice janice the county manager made a proactive decision to try to do the best that she absolutely could to do the right thing she's truly doing her best to try to protect the employees from abuse from the public while trying to protect the public from abuse from the employees in the weeks following this i did a number of public records requests through the county i provided an email address but i did not provide an address for where i sleep at night all of my requests were filled in a timely manner and the staff was friendly and polite i genuinely cannot thank janice enough for turning this thing around really all i wanted was the records she didn't just give me lip service and tell me what she was gonna do she solved the problem she got it done and her customer service skills while doing so were second to none while this story didn't start out great i feel like the conclusion was better than any other that i've published yet to janus and the staff at torrance county i want to say thank you you are a light shining in darkness stop to do this
