I wasn't gonna come up and testify but after hearing Cleveland police who are untrained and know nothing historically existed to terrorize terrorists policing and gangbang can be put on the same spectrum even there's more of us than there are with you hi that wasn't threatening than you guys when I reach to get my notes out guys a few months back I shared a story with you guys about someone who was arrested for a Class C misdemeanor he was actually arrested for failure to signal within a hundred feet of his turn I thought that this was completely bogus when he first came to me with it and told me that he had been arrested for this I later found out that it's a pretty common practice recently in the Texas state legislature legislature there is a bill introduced to make it so the police can no longer arrest people for Class C misdemeanors or fine-only offenses the purpose of this video is going to be to show you what's happening in the legislature I am going to recap some of the old video just to give you a full picture of exactly what's going on good how are you good I will in a couple of minutes I'm gonna are you a supervisor yeah what's what's your name lieutenant pal okay cool yeah I do have a few questions I just go check out the area first sure then I'm gonna do some now get to go back upstairs if they're the questions for me your mama would shoot right now okay [Music] see when I got to be a vehicle while all sedan that we are okay is it also common procedure for you guys to arrest somebody for failing to use a turn signal within 100 feet it happens frequently you guys actually arrest people for that yeah it happens frequently just pins on the totality of the circumstances so that wouldn't necessarily be the only element that would cause you to arrest somebody or is that it I'm not sure I understand you said it depends on the circumstances so meaning that the circumstances might be that it wasn't just a turn signal but there's other things that's pretty disturbing to the people I can tell you that you know but it sounds to me from what he's saying from his side of the story which like I said I know there's another side is that he was arrested more based on retaliation because he asserted his rights and the police didn't really like that they're they're not comfortable with people asserting their rights and and that in itself makes the police suspicious which again is very disturbing that for an American citizen to assert their rights is suspicious to an officer that can't be used is against them right or it should absolutely absolutely and can I stay here and tell you that never happens in the young face no I can't tell you that first of all I'd be lying and I don't want to do that and secondly I don't think you would fall for that even if I were when the officers start saying do you smoke weed isn't let's go to the beginning of time so you were sitting on the side of the road right because your new driver the guy's house was parked in front of them did not like me parked there you know and so he came out and asked me what I was doing there just to go even back a little bit further than that the reason why I'm parked in a public street in front of somebody's house is because like I said I am and I do deliveries and so in between deliveries I don't want to be just driving around burning up my guy so I was parked at the northeast mall about five minutes up the road from there in a secluded part of the parking lot where there's no traffic hardly at all and so security harassed me basically said I was loitering I'm like we're having so I was thinking to call him I'll leave but because it's private property they didn't like the fact that they said well you're not a customer here so I went and bought a drink from Subway now I'm a customer that apparently didn't sit well with them and so they got me criminally trespassed from there so since I'm getting criminally trespassed trying to work and make a living in a private place and I just going parked in public places where I can't get criminally trespassed everybody you know that's why we're sitting there okay so anyways so he calls the cops four of them for Hearst SUVs show up and they got my car surrounded have I committed a crime with what's going on and you know for the most part they had the trainee talking to me Scott if I'm not breaking the laws and legally I'm not required to give it to you I'd like to keep that it's like okay what do I do next so the other one so the second one I don't know what his name is because think I just have all the names like I gave you but I don't know who's who he came up and he started you know being a little bit more weed in there you smoke weed and he even said why are you shaking and I said I'm not shaking at all I said but in my defense I am surrounded by a bunch of people with guns you know he kind of dismissed that and went on to some other question so anyways I got a call at that time I got a water on my phone and I'm just like you know what after he went the whole weed route and you're shaking around I said I don't want to miss her anymore your questions I invoke my Fifth Amendment right I'm out of here and he kind of walks off and I Drive off so this time at this point you haven't given ID or anything done anything you've been interrogated you've been asked for ID but they couldn't articulate a crime yeah so I Drive off seeing where the water is on my phone I'd see where it's at put my blinker on like I always do didn't think anything of it I see him kind of following following me a little bit and as soon as I go through the intersection they put on the sirens and lights and then they got ID they got my information and then they and they said can you step out of the car but they put me behind in the car put your hands like this which hands behind your back he said you're under arrest for failure to signal a hundred feet before eternal and I'm just thinking you got to be kidding me buddy but I remembered like I told you when I talked to the grandparent Police Department four years ago and he's like yeah anything I can write your ticket for I can him so clearly in this case this law was used to retaliate against a man for asserting his rights well a lot of other people saw problems with this too and so in this legislative session a bill was introduced that would make it so that cops could not arrest on Class C misdemeanors also known as fine-only offenses well guess who showed up to defend this sort of bad behavior that's right Texas police madam chair my name is Chris Jones I haven't seen the substitute that I am opposed to the bill is filed with the combined law enforcement associations of Texas and I got kind of castigated the other day when I said that this is a tool of law enforcement and really didn't get to explain what I meant by that because of the time limit said I was under I'm going to talk a little bit about that the other day we'd had a hearing and law enforcement spacious painted in this way that all we do is go out here and arrest these poor folks on classy tickets testimony was that there was 27,000 arrests last year in 2018 for Class C offenses finally Hopkins's what the person didn't bother to tell you was if that was based on 4.6 million traffic stops so less than 1% I would make the point that the violators conduct a lot of times precipitates the decision to arrest rather than the officer just deciding to an arrest we have a segment of society that doesn't want to cooperate with the police and they won't identify themselves was man can I have your ID and I said if I'm not breaking any laws and legally I'm not required to give it to you these folks is sovereign senators citizens we also have people who refused to identify themselves when they're stopped what are we supposed to do if we don't have the ability to take someone in custody well we can't verify who they are if I'm not breaking any laws and legally I'm not required to give it to you you as the legislature is given the ability to enforce these laws but if we can't enforce them because we can't buy the ticket because we don't know who they are what are other options do we have let me tell you this somebody said the other day that oh you're just arrested people because a peop and they went on to say this was pissing off the post witch hands behind your back he said you're on your rest for failure to signal a hundred feet before I turn and I'm just thinking you gotta be kidding me well I got to tell you there are a lot of times we use this to give somebody a break we make mistakes absolutely and those people have to be accountable and that's why we supported body camera legislation transparency some of this other stuff that we've done to try to bring out the transparency in the job that we do and if somebody violates somebody's rights on one of these traffic stops it's gonna be on body cam my biggest problem like I said is information being with him if I can't get the whole story all I can give is the partial story and people can and only people can only make assumptions for that right honestly I think it will go poorly for you but I don't know until I see it so I'm going to cut most of this testimony in the interest of time if you want to see the entire thing I'll give you the link to where it is on CJ's channel committee members my name is lynn ho from justice peace pursuit for bender county i'm here representing JP CA i'm a retired law enforcement officer i put a judge's hat on 15 years ago so what i'm going to do is talk to you from a judge's point of view on this bill it starts out by saying that law enforcement judges prosecutors missionary corps government bodies municipality will have a meeting and determine the policies for handling class ii misdemeanors in their jurisdiction judges don't do that judges do not involve making our our cannon says that we must be neutral and guys pay attention to who's for and against this bill all of those who want to continue to throw people in cages for petty class c finable misdemeanors our government agents we're talking about police officers judges and politicians all of the people who come up and testify against throwing people in cages for petty misdemeanors finable offenses are citizens who are not on the government payroll clearly based on who's testifying for which side you can see that this bill benefits the people and damages the government what are the two part actually is it Democratic Republican or is it government and the people oh good evening at this point has more executive director with us is Justice Coalition for this bill I just want to say I find it odd that somebody can come up and be a hint Sabeel that they haven't read the committee substitute I find it odd that a judge we just sit instead judges can have an opinion about policies regardless matter has an opinion about it and just to be quite friendly with you you know signing day is right around the corner this was supposed to be a legislative session where we were going to take some criminal justice reform seriously that does just not seem to be the case I don't speak for any of the other criminal justice reform groups but I can't tell you this if it was one bill passed in a sphere the criminal justice reform that could help as many Texans on different spectrums and different backgrounds this would be this bill this bill will keep millions of Texans out of jail for petty reasons that they don't need to be in jail calendars and ic2 Krishnam testifying for the spill on my own behalf and my own behalf only I because I get so frustrated that you know the law has a delineation and calls them peace officers and why would a peace officer come up here and talk about wanting to throw people in jail through violence to the threat of force for a Class C misdemeanor for a fine-only offense why would a law enforcement officer a peace officer come up here and actually want to throw people in jail for things that are just fines because why because their their ego was hurt oh they didn't do what I told him to do that they refused to identify because they didn't have to well they hurt my feelings so I'm gonna throw you in jail it happens this GOP stuff happens and it happens a lot more with minorities but I am living proof that if you don't bow down and do everything you're told in the exact way that those guys tell you do it even if it's a minor offense they will throw your ass in jail leave you there for 24 hours you've got a bond out you're stuck in these disgusting conditions why because the police officer couldn't handle the fact that someone had the gumption to stand up to him and put him back in his place when he gets out of his place now I've been respecting police officers when they deserve respect but there are times the cops don't deserve respect and in those cases a Class C misdemeanor should not be elevated because a police officer has the power to kidnap you and throw you in jail by force what does that force me to shoot you if you even don't want to go to jail because the Class C misdemeanor this is where we are does it happen a little bit yes does it happen a lot no but the fact that it happens is the problem and that's what this bill is trying to fix I talked about the blackstone ratio of it's better than ten guilty people go free than one innocent people a person be thrown in jail that this is another example that why would anyone that serves people that serves as a public servant want to throw people in jail and look for an excuse to do that it boggles my mind on why that's something that we're gonna come up here and fight for and I hope that they can add this to their video as well thank you what CJ means by I hope they can add this to their video as well is that Clete put out a propaganda piece rallying people to war against anyone who would have the gumption to tell police no no you cannot have what you want no you cannot punish people for not bowing to you and kissing your feet if there's one thing that I hope you guys realize from this video it's this that the police the judges and the politicians are all working together for their benefit and against the benefit of the people not only that but the reason that these people have all of this time and all of these resources to be able to fight people like me and you and to be able to take rights from individuals like you and me is because you and I have to work for a living but these individuals receive all of their money by taking a portion of the fruits of our labor and using it against us I wasn't gonna come up and testify but after hearing CLE police who are untrained and know nothing historically existed to terrorize terrorists policing and gangbang can be put on the same spectrum even more of us than there are with you that wasn't threatening than you guys when I reach to get my notes out what do we need a police department you
