well I'll call your representative now whether Kathleen is your representative or not this bill affects every single person in the entire United States this is a bill that she is carrying that says that if we as the government deem you to be annoying we no longer have to fill your records requests it's House Bill 139 in the state of New Mexico introduced by Kathleen Kates 505986 4432 I'll throw people are always like well if you have a problem with it call your representative there you go see what good that does you huh let's look at this legislation that she has proposed section 24 vexatious requesters a public body May file a petition asking the state Commission of public records to request relief from a person that the public body claims is a vexatious requestor there's a whole lot in in that one little phrase right there a public body meaning any government entity a police department the city of sanf the City of Albuquerque cfd Child Services any government entity May file a petition asking the state Commission of public records now a state Commission of public records does not currently exist so we're going to be creating a brand new government Body by the way more government jobs that you're going to pay for asking the state Commission of public records to request relief from a person that the public body claims as a vexatious requestor to request relief saying we don't have to fill public records for this person because we claim they're a vexatious requestor oh this is good this is real good vexatious causing or tending to cause annoyance frustration or worry so if you annoy them or frustrate them or cause them to worry by requesting your public records then they can submit to this brand new government entity that you're annoying that they don't like you and therefore they should not have to fill your public records requests you can't make this up this is presented by Kathleen Kates let's go back and let's just put it into layman's terms if we don't like you we don't have to give you your records not only do you already pay all of these people to to do certain things for you as Servants of the public they refuse to do it and now they're saying let's hire more people at your expense to make it easier for us not to serve you they're going to use it there are news agencies who will make hundreds of public records requests in a month I talked to someone who works for krq at that time when I was talking to him we were in the middle of the month and he had already requested made over 40 public records requests to the City of Albuquerque for the purposes of disseminating news to the public the City of Albuquerque hates them for that make no mistake the news agencies will be put on the on here as vexatious requesters any body who is requesting information especially to help the public see things that the government is doing that they shouldn't be doing you will definitely be a vexatious requestor according according to them it will contain a description of the conduct the government entity claims demonstrates that the respondent is a vexatious requestor which may include a description of conduct directed towards public bodies other than the one filing the petition a description of conduct directed toward public bodies it doesn't even have to be about making public records requests any conduct directed towards public bodies can be used to determine that you are a vexatious requester anybody that they think is annoying or frustrating to the government no matter whether you're making public records requests or not you'll be put on a list saying you don't get to make public records requests because you're annoying and frustrating no Discovery may be allowed on a petition to declare a person of exous request her so once you have been determined to be a vexatious requestor once you have been determined to be annoying to the government no public body shall be obligated to respond to requests for inspection of public records from a person who has determined to be a vexatious requestor for 3 years after the designation is made so once the government designates that you are annoying you are no longer entitled to any public records from any public entity anywhere in the state of New Mexico for 3 years the state Commission of public records shall maintain on the commission's website an alphabetical list of all the persons ever declared to be a vexatious requestor and copies of all decisions petitions filed under this section it's HB 139 section 24 if your government thinks you're annoying now this annoyance can be based on all types of things including conduct directed towards public bodies like for example if you go into a city hall meeting and you tell the mayor and all of the city Council you guys are all trash you're all a bunch of criminals you're all a bunch of thugs screw you and then you go and make open records requests for documents proving that they are actually Thugs and criminals who don't obey the law then they'll they'll file a petition and say oh look you know this guy he's vexatious he even said in our public meeting that he hates us he's clearly vexatious we don't have to give him records showing that we're breaking the law have any of you guys called her office yet the Municipal League of New Mexico is trying to push these uh anti-transpirant to their benefit and it keeps biting them in the ass they keep getting sued and losing because they're taking AJ Forte's advice matter of fact I think I've got his phone number here
