In July of 2025, I joined Mark in the city prosecutor's office where he was attempting to file some new motions in his case where he's being charged with disorderly conduct for saying Tucson police suck and trespassing for being on a public sidewalk while saying it. If you're not familiar with that incident, I linked to it below along with previous videos of us visiting this office and being kicked out under threat of arrest along with a video of the head prosecutor telling someone to blow him. When I arrived, I was met by Wayne, who explained the head prosecutor, Alan Merritt's new rules. >> Oh, who's here now? Batman. >> Batman has arrived. >> Check that out. >> All right. >> Hey, how's it going? >> I forget you, >> James. >> James, sorry. I should know that one of my buddies named James. Am I Am I >> Am I live right now? >> No. No, we're not live. >> I was gonna say hello. >> You were going to shout out? You can still shout out. and I can publish it later. >> Give your channel name or >> I I got to say I know you guys have been in here I don't know I don't even know how many times even before I was probably up here but um they told me that um if you guys are recording we can't do business like file the proceeds for you if you're recording. So >> Oh. So why can't I take their business and walk over there and do it? Cuz I'm not recording. If there's >> I'm not recording. >> I hear you. >> And recording is >> And I'll uh >> And I can't. But But if there's recording going on in the lobby, I can. >> Who told you that? >> I know. And I hear you. >> You know what? >> And I get >> Who told you that? >> So Alamare >> the uh >> Alamare. So you know what? >> It's not even >> You realize you guys are violating our constitutional right to record you. >> I'm I'm just a tool. >> Who Who told you that? >> It's I my bosses. >> Which one? >> So do you know the law? Do you know the First Amendment law? >> He doesn't care. It's irrelevant to anything. So, the guy in the background you hear talking about the Constitution and First Amendment is a retired lawyer that goes by Slinky. He was a lawyer for long enough that he should understand that no law, constitution, or anything else written on paper has any bearing on what government will or won't do. These guys have spent the last 6 years in Tucson and Pima County telling the government that they're breaking the law and violating the constitution. Nothing has changed. I only came in here today to document the fact that the city of Tucson will threaten, bully, intimidate, even arrest, and or attack you for recording your business with them. I wasn't here to try to change what they do or try to educate them on what the rules or the laws or the constitution say. They don't care. But some people will pop off about rules, laws, and constitutions their entire life while getting their teeth kicked in by their government and never learn a damn thing. Power does what power wants. I just want them to be gracious enough to allow me to document it so I can show it to you. >> Do you know the law? Do you know the First Amendment law? >> He doesn't care. It's irrelevant to anything. >> So then why don't you bring out somebody here who does know the law? >> Hey, I've told you what our policy is, guys. >> Sure. Hey, can uh So >> So who told you that? >> Yeah. >> You know, my my boss is >> a manager. So >> which one? >> I can't >> I can't. We need the policy. I told you what it is. And >> was it >> YouTubers out there? >> Was it Allan? >> You know, I can't comment. Come on. Then you know I hear you and I actually watch his channels and you know. So anyways, >> you know the story. You can't do business while the recorder's going on. And so >> so if somebody records, they don't get due process. That's basically what happens. >> I >> Yeah. If they got a camera, if they're recording what you're doing to them, they don't get to file their motion. Yeah, of course. I mean, not that it's a big deal, but I still got No, it's >> I'm not I'm not going to argue it's a big deal. >> It's the first amendment to the country. >> You know how many amendments there are to the >> He used to work here. You know that? >> Yeah, he used to work. >> 10. And the first amendment is the first one. >> Is Alan Merritt here? He wants to talk to Alan Mer. >> Well, this was fine. >> It's not over with yet. >> Is anybody live? >> No. I'm thinking >> you want to go live now. >> Hey, you calling Wrad? You going to call Wingrad up here? >> Perfect. I better do it. I better go. >> Yeah, go live. >> All right. >> Security's coming up here now. >> Did you say call 911? >> I don't know. He said >> security. >> Are they calling 911 or are you calling security? >> I still have a video. >> So, these are Allen's orders and Allen is the one who offered someone a plea deal. >> That's what we think. Yeah, he wanted me to >> perform uh oral on him the last time I was here in order to get Mark off. That's the weirdest thing about it. >> Oh, he was a watcher. He's >> he wanted me to do an oral on him to get Mark off. It's like what? >> Well, >> so you know what's funny about this? The lawyer Slinky you see here in the purple shirt actually used to work in this office under Alan Merritt back in the late 80s or early 90s. Mark finishes writing his motion and goes to the window to give it to him, but nobody will come to the window. >> Any information that I give him, you can have. >> Well, well, I know, but he's saying he's not going to even serve you if >> which is stupid. >> If the camera is here, you're >> right. >> Which is stupid because we have been discreetly recording them for years. And as long as they can't openly see the camera, >> Well, they say that they're not going to come out even to >> They're sending security up to make you quit recording next. Come on. >> Oh, there's a bunch of uh cops coming into the courthouse right now. >> How do you get noticed from outside the front door? >> Bunch of cops coming in. >> Guys, I'm waiting. What's that? >> I'm waiting to turn in my from outside. >> He told me to killian said, "Run, James, run." >> I'm going to step outside here because >> I'm old. I'm too old to go to jail. >> This really sucks. I hate to abandon you, but really I am old. I'll be right behind you, man. >> You just stopped. >> I don't want to go to jail for this. >> Hey, Mark, just say the words and I'll turn it off or I'll go out there. >> Nope. >> I'll head out. >> No, I'm doing business here. When you're not recording, that's when they take you to the back room and beat you down. So, >> yeah, I know. >> Let me know when you guys are ready cuz I'm going to wait here until you're done. They told me to come up here and do this. >> Hey, just stay quiet because they're going to try and escalate and create a disturbance and yell and scream. We got word they're coming. You're good. >> Okay, that's cool. Just so you know, officially I got to say uh I have to ask you guys to leave, but you know that's >> I'm here to do business. >> I hear you, brother. >> Hey, can I turn it in now? >> Couple guys are anyone's recording. Here's like someone who's not >> Okay. So, if I don't if I don't leave, then >> Oh, >> can can I stay or do I legally have to leave? >> I'm not a Law enforcement officer mess. >> You got to >> You got to do something. I'll go over here. >> I'll go over here. Do you mind being on camera? >> No, I don't mind. >> You don't mind? You're cool with it? >> You guys are good. >> Right on, brother. >> You guys are protecting our rights. >> Appreciate it, man. >> Sometimes they like to abuse us. >> They do like to use us. >> Never. Sometimes. >> Yeah, you're right, too. >> There's other people waiting, too. He does. He's waiting. >> I understand that. Thanks for the update. >> Yeah. Well, >> we need to obtain some documents and video and audio. >> You here for disclosure? >> Yeah. >> Um, >> all right. So, he's going to help this guy now, which is good. He should. Wayne wants to be a good guy. He's got a good heart, but he's being told to do evil things by evil people. And I'm pretty sure Wayne's got a family to feed, at least himself. and he's caught in a pretty tough spot. He wants to be a good guy. His heart is good, but he also doesn't want to lose his paycheck. It's a tough situation. I feel for Wayne. Let's help Wayne out by getting rid of his bosses that are trying to tell him, "Hey, you're not allowed to serve people if they're recording." Because Wayne himself is perfectly happy to serve us while we're recording. He said it the last time we were here. He said it multiple times. >> Yeah. Yeah. No, no. They're they're all on their right. >> This guy doesn't mind me recording, but I'm also live and anything caught live is on the internet forever. I don't know what kind of information might be accidentally slipped. And I'm not here to record other people's business anyways. I'm specifically here to record Mark's business with his permission for a documentary that I've been working on for the last 6 months and will be working on for the next few years. I politely thanked the gentleman for being cool about it, but also told him, "I don't need to record your personal business. I'm going to step out anyways. We're not here to bother other people. We're here to document Mark's process." >> All right. You too, brother. >> God bless. >> You, too. >> Hello. >> Hey, how's it going? Great. >> Excuse me. >> Yes, sir. >> Wow. It's a lot of them. >> Paul Gustafo is here. >> There's quite a few of them. >> Some people who watched live were asking why I was telling Mark what to do or telling him to quiet down. These people pull the same stunt every time they come in and they try to create a disturbance. Mark naturally has a very loud voice when he's just talking. >> Just your normal talking, Mark. I thought you were yelling out in the corner out there. You were just talking. >> I was like, "Fuck, talk's in trouble." I ran out there. James like, "Stop. Stop." He's just talking, dude. That's the way I talk. >> I can't help it, guys. >> In order to try to prevent the thugs from having any excuse to violently attack Mark, myself and Roy constantly reminded him to whisper. >> Go ahead. Go ahead. >> I'm waiting for them to hand me paperwork as I just told you. >> Okay. I'm waiting for them to hand me paperwork and I ain't answering any questions from you. They are not. >> Are you going to ask me to stop recording? Are you going to ask me to stop recording? Is that what you're saying? >> I'm telling you that if you are recording >> Are you going to ask me to stop recording? >> I am telling you. >> I'm telling you. I ain't going to tell you whether I'm going to deal with you. >> Well, I'm waiting for them to give me my paperwork. >> What? >> Well, then you guys got to stop giving me charges here if I can't do my >> When have I charged you, Mr. Brown? >> What's that? >> What' you say? >> When have I charged you? >> You You guys have the police department. What do you think I'm here for? I'm doing motions on my case. No, wine. You guys, your gang, your gang bangers did. You're the gang bangers. >> Yeah, your gang bangers did. >> Mr. Brown, it's pretty simple. If you are recording the and then they will ask you to leave. >> What is it a crime to record? >> Yeah, you criminals. You want to do all your dirt when we can't record what's happening? Huh? Okay, I've explained it pretty sufficiently. Now, the guy in the police uniform that was just talking to Mark is Benjamin Weingrad. And he is not an onduty police officer right now. He's working as court security, but wearing his full police uniform. Notice as he walks back to the onduty police officers saying, "I think I explained it sufficiently." He nods his head to the side, trying to tell the onduty police officers to go ahead and arrest us. Benjamin Weinger is already in deep [ __ ] for unlawfully arresting somebody while off duty. Notice though how all three of the cops look away from him and look down at the ground as he approaches to avoid eye contact with him. You can see that none of these cops want anything to do with Werad's [ __ ] I make sure that they know if they threaten me with violence or arrest, I'll do anything they say like a good slave. >> Take him into custody. Take him to jail. >> Do we have to leave under threat of arrest? >> I need my paper to jail. >> Hey, >> you not criminals. Hey, if I need to leave under threat of arrest, just let me know, >> right? >> They don't want to let us know, though. They want to they want to sneak attack >> because they're they're dancing around. >> They're dancing around it. Now, pay attention to this because Wayne and this other woman whose name I didn't catch are probably going to need our help. They both agree that this is ridiculous and they just want to help Mark with the business that he has to conduct. And that's exactly what they do in direct defiance of their boss, Alan Merritt, who told them to treat the public like crap. >> No, I'm I'm not recording. Okay, here. I want this paperwork done. I got to go. >> Do you want me to get out? >> Hey, last No. Last time they filibusted me and they we couldn't do our thing cuz they're out at 4:30. That's what they're doing now. >> Yeah, this is this is really literally just about him filing his paperwork. That's it. >> I want my paperwork. >> But they they don't want it documented. live on YouTube. >> Was that >> You're running live on YouTube. I'm watching it right now. >> So, >> I'm running live on YouTube, too. >> So, >> so just serve me. Just get this done. All you have to do is give me the paperwork >> with the Tucson City Pro. >> If not, let's move this to another court. If we can get this moved to another court that well served me, you know, cuz you keep calling your goons on me. You want to take me down to the dungeon? anyway. I already got all my paperwork turned in. If you're not going to do it, give it back to me. >> I need you to get used to the fact you're the only one who's not entitled to due process. >> Yeah. You don't get any process. You are a camera criminal and you deserve no process here, right? Get over it. Just get down and adjust to it. >> Now the lawyer is beginning to get it. >> What time is it? >> I got >> I have no idea what time it is. Is that what they're doing? Is trying to wait you out until they close. It's >> 2:51. >> Yeah. >> What time? >> Go out and pay my meter again then. >> What time do they close? They closed at 4:30 the downstairs. >> I still have No, my meter's almost out to >> I think they might be doing your >> I think she's done it. >> Thank you. Finally. Gosh. >> All right. >> So, I still got to go down to 104 and turn these in. >> So, last time we was here, this guy delayed us so much. We got out and it was already closed. So that's what I think you guys are trying to do again. So I can't get due process here because of him. Because of that guy right there, one man, the guy that takes people in the dungeon and chokes them out. Pretty tough, huh? Why don't you come out here? You going to take You want to take me to the dungeon, huh? Boy, you want to take me to the dungeon? >> He does want to take >> Yeah, he does. Look at that face. Want to go to the dungeon? >> He does want to take >> You want people to pay master? Stand up. Sit down. I watch your whole body cam. >> Do you know that? So, gee, what? How come all these police are here for you, Mark? >> Mark, did you commit a crime? >> I think they're here against a law. >> I think they're here for you. >> Yeah, that sure should be you. >> Okay, I believe it. >> I'm a loud mouth. >> I know. >> Okay, I believe it. Oh, you're not worse than me. >> She's doing your stuff for you, right? >> I think so. >> Okay, good. >> I might. >> Maybe I won't get arrested that day after all. >> I think they just show up for bullying. >> Four cops, one for each of us. >> So, they So, it looks like they never did intend to use the violence this time. >> I have 15 motions to file. >> They were just here to bully and intimidate and hope that >> All right. Is that two of them? >> All right. I'm going to go do these two. >> We're all set, man. Yeah. >> All right, let's roll. >> Let's roll. >> You got your bag of stuff. >> I got to go downstairs and turn these in. >> Wow, man. >> Thanks, guys. Hey, next time, can we just get service without bringing the guns? We didn't bring any guns. >> We didn't We didn't You know how ugly that looks, right? When you try to get due process and you call a bunch of guys with guns to come threaten and intimidate us. It doesn't look good. Doesn't look like due process. >> Looks like mafia [ __ ] >> You guys can follow me down. Have a good one, guys. >> Outside, we end up talking with the headquart administrator who says he's willing to talk to us about what's been going on for the last few years and how we can solve the problem. Some of the guys that have been dealing with this for the last 6 years, getting beat up, taken to jail, arrested, charged, just don't have any patience at all for any of the people in charge of this building, which I can understand, but I still try to always assume the best about people until they prove me wrong. >> You guys don't follow your own rules. >> Well, well, is your name is Vernon, right? Is that right? >> Slinky. >> Slinky. Nice. I would love to make sure that everyone is following the rules and your sign out there says it's absolutely prohibited. >> And that is a violation of the rule because the rule says you're supposed to post the sign that shows what your actual rights are. >> Fair enough. I >> Oh, fair enough. So, you're violating the rule. >> I'm going to I'm going to show you actually how we we need to make some >> There's no way that Let me show you the other side. Oh, it says what? You can record. >> It does explain. It does. >> It explains past your sign in the front. >> So, we need to fix some signage. That's fair. >> Well, I would That's fair. >> I'm happy that you're coming to that. >> But, but you're right. If you look at this sign right here, Slinky, Mr. Slinky, >> what sign? >> This sign right here. >> And that is what that is what you're talking about. And it does explain that it's prohibited here. Prohibited. Right. Right. Basically, it says you can't record. >> Is that the discretion? >> That's in the courtroom. It doesn't say that you can record. This sign this sign totally, you know, this sign totally violates the rule 121 that says video recording is permitted. This says it's not permitted. It's not permitted. It's not permitted. >> Let's look. Okay. >> No, let's look at what you don't understand what not permitted is. >> I do. And the rule says that it is permitted here. But this doesn't say that. This just says it's not permitted. And that's a violation of the rule. And the rule says you should fix these damn signs. >> We'll fix it. >> Can I We'll fix Can I go downstairs to the first floor with you and just address one thing real quick? >> Sure. >> Can I real quick? That's all I've got because I know you're busy and I I know we'll set a meeting and we'll talk about more stuff later. But >> I was serious about that. I will talk. >> I left you. I called you earlier today to try to let you know. No, you're fine. >> I just wasn't trying to surprise you when we popped in today. I wanted to make sure >> everything was set and that they knew I was coming. >> Cuz I want to avoid violence. I watched these guys be violently attacked multiple times by people who have no jurisdiction. I watched one security guard almost get pushed over a 15t balcony because he attacked somebody. And if he had fallen over that balcony and his head splattered all over the tile, I'll bet you anything. >> We don't want anybody. >> No. Neither do I. But had that happened, I guarantee that the charges were dismissed on the guy that pushed him because he had no right to touch him. And and so I mean, I'm just I see that I don't know if you've seen what's going on over the last 6 years, but it's escalating and it needs to stop. >> That you want to stop and talk about what the rules are like why your signs don't comply. >> So we go downstairs and I go to the exact location where Patrick was attacked by offduty officer, security guard Benjamin Werad for recording a police officer. And I ask him if I can record here. So, my my one question is, can I record right here >> and in the rest of this lobby? Can I record a police officer right here? >> Yes, I >> Yes, >> you can record in this area cuz >> Can you record it? >> They they still keep calling cops to come and threaten us. I don't know. I'm pretty sure you're the guy who's in charge of >> what goes on here. Can you just ask them chill out? >> I am working I am working with everyone so we follow the rule correctly. are make sure if there are corrections to be made, we'll make those corrections. Whatever 501 chooses, that's that's outside of the court because it's not part of the court, right? It's in the building. And as you you know, cuz I know you read it, 122.1 says that other agencies that might be in the same building but are not part of the court are are not considered the courthouse for the rule. >> Right? But that doesn't mean they can't have their rules or whatever those may be. >> Alan Merritt's not coming out. He's hiding back there shaking in his boots. >> And he's telling his employees not to serve you. >> Yes. >> If you're recording, Alan Merritt's got to go, man. >> He's conspiring to violate rights, too, cuz he's telling his employees how to how to uh work around the rules in order to get you arrested for trespassing. Right. That's exactly what Alan Mer told his employees >> to tell you to leave if you're recording and if you don't leave if if it's an authorized representative of the property, you get arrested for trespassing, right? So, it's a setup. That's what they're doing to set it up. Just your normal talking. Mark, I thought you were yelling out in the corner out there. You were just talking. >> I was like, "Fuck, Tuck's in trouble." I ran out there. >> James like, "Stop. Stop." He's just talking. >> That's the way I talk. >> I can't help it, guys. >> 122.1. Good. >> I'm afraid they don't hear me. See, here's the here's the thing, guys. I've been telling them that for 5 years. They ain't heard me yet. So, I'm talking too low. >> Contact information for the mayor and city council members is in the description and the pinned comment below so that you guys can reach out to them and ask them if we can please have some more freedoms. If it pleases the crown, we would like to be allowed to record and document our own interactions with our government. While I do plenty of trolling of government, which I will never stop, I do believe that documenting this process is extremely important. Not just to be able to show the general public today, but even more importantly, to be able to show people 100 years from now. I genuinely believe that most of what government does is nothing more or less than a mafia model. And the truth is, I really don't even want to try to stop the mafia. I just want them to allow me to document what they're doing and allow me to mock them. Please, Massa, you say that your First Amendment allows me to record, document, and even criticize you. I know you guys are nothing more or less than mafia thugs, but if you want the general public to keep believing that you're some type of legitimate authority, I would strongly recommend that you at least pretend to follow your own rules. >> We already know who you are. Yes, sir. I know your birthday. I know your social security number. Been over here.
