We're not going to do this. >> It's not working. >> You got a window punch. >> Stepping out. Step out. >> Get out. >> I'm getting out. Get out. You're in restaurant back. Put the thumbs down. >> I'm at Kroger. >> Back. >> Yep. >> Go ahead. Step out for it, man. >> I'm at Kroger. >> Hey, put that down for me. >> What am I under arrest for? Obstruction. What do you mean? Obstruction. I told you run out the window and give me your registration. >> You give me a chance. I don't have to. Give me. That's [ __ ] >> You do what you're told when you're told. >> Okay. Central, we are in custody. We had to break the window. Send a >> next in line or actually hold off on that. >> I don't know. >> Obstruction. >> He's got insurance. >> I've got I've got insurance. I mean, y'all would give me a chance to show it to you. >> We've asked you multiple times. >> Why y'all rolling up on me too deep like this? For what? Three >> for what? >> I'll let you hold your phone. I'm going to hold your purse. >> I can't I can't talk right now. >> What's your name, man? >> Hey. Hey, y'all get my phone number. 7064 706 real quick. >> All right. Your registration suspended, right? We gave you all every chance we would instruction and suspended registration. Suspended registration. I don't have to have a registration private vehicle. >> No, that's not how it works. >> Private. Yes, it is how it works. >> It's not private property. It's not how it works. >> It is priv. I own it. What are you talking about? >> So, to leave this private property, you got to go on a public road. You need registration to drive on public road. That's not how it works. >> You want to release the car to her? >> Got anything on you? >> Speeding. No, I don't. >> Okay. >> What do you want to do with it? >> Well, I mean, I guess have my brother come pick it up. I'm going to take your phone down. I'm not going to take it from you. Put it right here. Okay. And bring it with us. >> Now, you can send you can send her with the phone. >> Okay. If you don't want to bring it with you, that's fine. Checking on the hat. See if you got anything. All right. Back on the go. >> Hey, Riley. >> Come get my phone. You're taking it with you. >> Hey, Sarge. >> No, he's gone. >> Yeah. Well, if he What? If he picks it up, then y'all going to pull him over and y'all are going to do the same [ __ ] to him. >> No, because we're going to understand that he's driving us to private property, so he can't be driven. >> What? What just happened? What What is that? >> Can you pop your logs? I searched him already. >> What just happened is you got arrested for instruction. You were told, "Go ahead and take a seat, boss." >> I don't have to roll down your window. >> I don't have to roll down my window if I don't. >> There's actually a case law that says you do. >> The case law is not law. >> Sam, >> you want to rest for obstruction? >> Case is not law. Obstruction. And >> what's the second word in case law? Well, he gave me his ID, but he wouldn't provide insurance. >> And we can't check the van with him standing right there. I'm not going to stand right here with him right there. >> And why? He just wouldn't step out. >> He just wouldn't step out. I mean I mean >> he's And look look look. Did you see the tag? >> Huh? No. >> Go look at the tag. Okay. >> Do you want to call his brother >> to come pick up the car? >> Yeah, I can. Can I get his phone? >> Do you have a tool to get this off? >> I'll just take it off. >> Tell you what, I'm pissed off about this discount Amazon thing not working. Told me it works. I guess I know to buy a better one now. >> Oh, there's a tug. >> Yes, you do. >> And a bug. >> See if this is the tag that actually goes to it. >> Can you crack your first? >> I'll read them right up. >> Well, I mean, I'm already under arrest now. I mean, >> well, I don't I'm I don't plan to question him, so it's up to you. >> I'm not going to question him. There's nothing to question him about. >> I was going to ask him if his brother has a license. >> He wouldn't roll down the window. >> Hey, boss. So, >> you have the right to remain silent. Anything you say can and will be against you in the court of law. You have the right to talk to a lawyer. If you cannot afford to hire a lawyer, one will be appointed to represent you before any question if you wish. Even if you do not want a lawyer now and agree to talk with us, you can at any time change your mind, ask for a lawyer or stop talking with us. Do you understand you have the right to explain to you, sir? >> I just have a couple questions. >> I understand. But do you understand the rights I've read to you, sir? >> What's the resting officer right here in command? What's his name? >> Sir, do you understand the rights of read? >> Yes, I understand. >> Do you still wish to talk to us? >> Huh? >> Do you still wish to talk to us having those rights in mind? >> I mean, I just want to know the officer's name. >> Okay. >> I'm Officer Shelnut 2281. >> All right, Franco. >> Real quick, boss, your brother's coming to pick up the car. Does he have a driver's license? >> Yes, he has a license. >> Okay, that's all we need to know. >> You have insurance. Your registration's just suspended. >> Yeah, the registration being suspended is not a restful offense. >> No, but not refusing to do what you're told. >> Listen, I don't have to. If I don't feel safe, you came up on me pretty pretty quickly and you didn't verify who you were at all. You Why would I roll my window down for anybody? But that that's crazy. You wouldn't. >> All right. So, you're going to be charged with two three things, sir. >> Uh fixing a license plate with intent to conceal a vehicle's identity. Uh suspended registration and obstruction of a law enforcement officer. >> Obstruction of a law enforcement officer. >> That's for uh refusing to open the door when you were told to. >> Okay. We have to be able to check the registration on a vehicle. >> I I I mean that No, you don't have to. But uh >> you're not allowed to drive an unregistered vehicle in the state. >> I wish you that you knew the law. >> Okay. >> You're free to go. >> You know, >> you're free to go argue all this sovereign citizen [ __ ] in court. >> Hey, man. Hey, just when you get served with >> I will have to go I have to go to court on this. But yeah, you only have to go one. >> Uh, let's seat belt him and I'm going to drive him over to jail. >> Want to charge him with obstruction? >> Yeah. All right. You get on that side. You'll buckle him, man. >> What's his name? >> Aaron. >> Aaron. Hey, Aaron. >> Sir, I'm I'm going buckle your seat belt so you don't get just protect you back here. So, you mind leaning back for me? Yeah. I try lean back as far as you can. Move it down under your shoulder so it don't go over your neck. >> Thank y'all. Yeah, >> you can disre. Did you get your wallet? >> I didn't get it. >> Do you want to take your wallet? >> Be in the car. >> Okay. >> George Williamson. >> Got my ID. >> I got your ID. >> 22 28 central. Coming around 600 1 m. >> Your tag is going to be turned in as evidence. You need to go to the tag office and see what you got to do to get your vehicle >> registered for not uh having insurance letting it lapse for a couple weeks. Y'all find me for being broke. >> I didn't pay the fine and then y'all suspended it. So they suspended >> they tacked on another extra charge for it made it a total of $165 to get my tag. >> The state did that, not me. >> I mean I'm just saying that that's that's a that's a good way to keep it keep a broke man down. >> So they suspended your registration because of the lapse in insurance. >> Yeah, because lapse on insurance. Exactly. >> Well, some people at least yours actually lapsed. Some people change insurance companies and in the process of changing insurance companies, their registration gets suspended and they didn't even do anything wrong. So it it's a mess. >> Anything wrong either, man. >> Well, you can't just put a tag on a vehicle that says private. That's not >> That's my vehicle. I can do whatever I want to with it. >> That's my private vehicle and you broke into it. >> That case law that you're citing >> broke into my private vehicle >> is a bunch of malarkey out. Yeah, because you were you >> kidnapped me. >> You were violating an order. >> A order? I don't have to listen to you. >> You have to >> What gives you right? What? What gives you right? >> You cannot drive an unregistered vehicle in the state. >> That's BS. Come on, dude. That you don't have authority over me. >> Okay. Because you're a sovereign citizen. >> No. No. Because just because you're a police officer doesn't mean that you have authority. >> I have a right to enforce the traffic laws of the state of Georgia. And you cannot just drive a vehicle without >> something good in quit messing with with me and people like me that ain't doing >> If you would have just cooperated, you would have I probably would have gave you a warning for suspended registration. >> The thing is I don't have to roll down my window for you. >> Actually, you do. There's a case law Pennsylvania versus Mims. >> I don't know who's giving you your information. >> Okay. There is case law that if I we can order you out of the vehicle. >> Oh, okay. Well, how would this be tried? Is it going to be civil or is it going to be criminal? >> It's criminal. >> It's criminal. >> We don't arrest people for civil violations. You can only be arrested for violation of criminal law. >> Okay. And what was it criminal for? >> Uh obstruction of a law enforcement officer. You obstruct or hindered me? >> From doing what? >> From >> harassing me. >> From getting your registration to determine >> You didn't give me a chance to get it. >> Uh you were given several chance. >> I I was working on it. I had to get it. I had to have it sent in a message, you know. I mean, I didn't have the piece of paper in my car. Uh, you know, I mean, everything's digital nowadays. >> Registration's not I mean, we paper in there. >> We could have just checked if you would have just handed me your registration paper or told me >> I have a registration paper. >> Well, I need I needed to check the VIN and I I couldn't do that with you sitting there. >> Yes, you could. It's >> I'm not going I'm not going in front of you while you're right here and can shoot me. >> Oh my god. Oh my god. Sovereign citizens are usually crazy people and I'm not going to deal with that. You were told to get out of the car >> and you didn't want to do that. >> I mean, you can certainly go in front of state court judge and argue all this. >> I'm going to federal court judge. >> I'm not going to state. >> Do you think that has ever really worked for anybody? >> All the stuff you see on the internet, you think it's ever really worked? from 0697. >> Okay. Well, good luck. I'm already seeking work. >> 362. >> You violated a lot of my rights. >> Let me guess, your right to travel. Yeah, that's one of them. Leave this here. He got a small cut on his arm. Think he needs a band-aid. We had to break his glass. He wouldn't roll his window down. Go over here. >> Are you uh these your two citations you're getting? Are you willing to sign these? I can >> What happens if I don't sign them? >> Nothing. I can just put refuse to sign. You don't even have to. I just want to see if you'll sign them. >> Oh, I might sign. >> Okay. I'll just refuse to sign. Not a big deal. If you typically refuse to sign a citation, you go to jail. But you're in jail anyway. >> There, huh? >> So, that right. >> What's that? >> We nipped that one in the bud. Huh. >> Well, you actually seem like a nice guy. I wish it wouldn't had to be this way. >> Maybe. All right, man. Here's that. Those are yours. >> I'll go have him print this for me and then I'll be done. >> You're good with him, right? >> Yep. >> All right. >> Thank you so much. That's it. Broken glass in the parking lot for somebody to run over. >> I just had to bust the window around. Just a bit of glass. Oh boy. If >> you wouldn't mind just kind of holding that so I can figure it out. >> Uh, no. Someone with a way better glass tool than >> your knuckles. I had this little thing on Amazon, but it did not work. So, >> good to know, though. >> Yeah. >> They don't supply y'all? >> No. One of my training officers told me to buy this, but I guess >> I'm happy I found out here though versus like a car fire or something. >> Oh, in the back of that car behind you. >> Oh, >> can't really comp comment on anything, but uh >> Right. >> What can you say? >> Uh well, if you get an order to get out of the car, by law, you have to get out of the car. >> That's what it can say. And you also have to have a vehicle registered. Well, >> am I good? Um, I have his permission to grab his phone out or do you have it? >> I have it. >> You have it on the roof of the car. >> Hey, come on out, ma'am. >> Go ahead. Step out for me, ma'am. >> Hey, put that down for me. You got any weapons on you? I'm I'm going to just put pat down with the back of my hand. Just confirm you don't have any weapons for you. Okay. >> What's going on? >> Like what is all this about? >> You ain't You ain't got no machine guns, grenades, nothing like that in your bra. Okay. >> Okay. >> We are in We had to break the >> I'm just going to slide this over here where it's out out of reach for everybody. Do you have any weapons in there? >> We're just here to pick up my prescription and the pharmacy closes at 8:00. So, >> what's what's his deal? >> He's got insurance. >> Our concern is with him, not with you. Okay. But we do need to figure out what what the situation's going on here. >> Sherry, I can't I'm talking to the officer. I can't >> Can me and you can me and you step away from him. I'll let you hold your phone. I'm going to hold your purse. You will get this back before we leave here today. >> I can't I can't hold her down. >> What's your name now? I'm trying to give him the insurance >> here. >> I'm just going to snap a picture on my phone real quick, ma'am. >> And we tried. We gave y'all every chance we could. I'm sorry that had to happen, but he would not listen. Would you mind stepping over here to the front of my car? Is your license in here? Can I Can I go in here and get your license? You want to sit on this bumper? It' be more comfortable for you. So, is your license is it in in this? >> Yes, sir. >> You're okay if I go in here and get it out? Okay. >> Is this your license right here, Brienne Basmo? Yes, >> sir. Very close to pronouncing it, too. >> Very close to pronouncing it. >> Yeah. >> Is it Italian? >> Yes, sir. >> I used to date an Italian girl. How old are you? >> Italian and Irish. 627 per >> 056 533744. >> So what what are y'all doing? You said you're coming here to pick up prescription. Is that >> Yes, sir. >> Do you mind if I pull this pill bottle out? >> Uh-huh. Yes. Can I can I go get his phone for him? >> Do you mind calling his brother? >> Yeah. Yeah. >> Come pick up the car. >> Yeah, I can. Can I get his phone? >> Can I Can I get his phone? >> I'm going to let my my sergeant do it cuz this is ultimately his stop. I came here cuz he asked for backup. Okay. So, this is his call. >> Okay. I don't want >> But um how do you know him? >> He's he's he's not officially a boyfriend, but >> kind of boyfriend kind of situationship. I understand. >> I understand. >> Yeah. He's in a band. I I help promote. >> What you help promote? What kind of band is it? >> Uh kind of indie rock. Playside a lot. >> I love that kind of music. >> This is his brother. >> Okay. >> Hey. Hey. >> Uh they got Aaron in the back of the cop car. Um I'm talking >> the insurance. >> I did. >> You did? What did they say? >> Um >> so >> I'm with one of the officers. >> I think they came back on the registration site and had insurance. The issue I think came from the tag. The tag on his car. You don't have to have a tag. >> Yes, you do. >> No, it doesn't, man. It's not commerce. It's not engaging commerce. It's in your book. In your car. In your car. Go in your book and look. >> I'm not having this argument with him today. So, >> that's not argument, sir. It's in your book. >> Hey, 28. Just so you're clear. His brother's a sovereign citizen as well. >> I'm not that ain't the point, sir. That's not the point. I'm not claiming to be so anything. >> Okay. Look, look. We're not going to have that argument today, sir. >> Carrie, I can't drive his car. I can't drive his chips. >> Me either. >> Can I get his phone? >> Um, I think my sergeant has his phone, so it will go with him to the jail and then he'll be able to get numbers out of it so he can call you or his brother or whoever he needs to call to get him out. He is going to jail tonight for obstruction. That's the whole not rolling the window down, refusing to talk. That's a refusing all that. That's where that came from. >> But yeah, they won't give me his car. >> Ma'am, do you mind if I just look? I know you said no weapons. I'll verify and then I'll give this back to you. Does that sound good? >> Don't worry about it. >> Okay. Well, I'm I'm I'm stranded here, though. >> And I need somebody to drive. >> Sorry. All right. >> Okay. >> All right. Or you can call Mickey. >> So, I'm going to give you this back >> and you understand why I got it for the beginning. Yes, ma'am. I'm sorry that you had to be here for all this, but we have to. All right. Let me let me let me go, I guess. And uh I got to get my script before the pharmacy closes. Hey, 28. You got any reason to hold her? >> You are free to go. If you can keep talking to me if you want to keep talking me. If you want to go in there, get your prescription, you can go get your prescription. But at this point, you are free to go. >> All right. Um, let him know that his brother's going to come. >> Brother's coming to get the car. >> I got a license. I can't drive. >> Okay. >> Wait to ride back with him. That's fine. >> That what >> if you need to ride back with the brother? >> I mean, it's fine. I got to grab my scripts and I'll just wait on them. We're right up the road. >> What's the officer saying your badge number? >> Say, "What's your name?" They got to give it to you. >> I can tell you mine. I can't tell you theirs. I'm Officer Hami, badge number 2262. I cannot tell you theirs. You can ask them. It's up to them if they tell you or not. I have no reason not to give you my but name and badge number. So mine is officer Hamby badge number 2262. >> All right. All right. >> All right. Let me go. Carrie go I'll be this one. >> Okay. Thanks. >> All right. So you were free to go at this point. I know you said you need to get your prescription. We're going to be here for a while. Okay. >> Look, if you need to go take care of what you need to take care of. >> So, what what are they? >> I know obstruction. I don't know any other charges. My sergeant's the arresting officer. He's going to have all that information. >> That he rolled up his window. His first of all, his thing on his window. So, >> I didn't want to say anything cuz I don't want to get involved. >> I understand. >> But the passenger >> Hey, police are scary. I get it. >> Like, >> we try not to be. I try to be officer friendly, but >> but no, he wasn't I feel [ __ ] terrible with me tonight. Give me a ride. >> But >> yeah, if you got you got anything else, any other questions for us? >> Um but he he he legally from what I've I've studied and everything cuz I'm I've just been a lawyer, but um >> Mhm. >> you only have to crack your window 2 in. >> So that's not true. >> He he didn't he didn't mean to roll the window all the way up. So, are you aware of um the there's a Supreme Court case I want you to look up? Uh do you want to write this down or take a note for it? >> It's called Pennsylvania Versus Mims. >> So, I'm going versus what? >> Mims. M I MS. >> M I Ms. So, I'm just going to give you you can read the full story yourself, but to give you the cliffnotes version, this case went before the US Supreme Court. This is like ages ago, but basically what the US Supreme Court said, you know, they're the top dogs. They decide everything. They said on a traffic stop for any reason officer can have somebody step out of the vehicle. Um, and that's all arguments of the vehicle. We can have everybody step out. Technically, if I wanted to push the issue, you know, I told you to unlock the door. You didn't. You're being cool with me. I appreciate that. That's why you're not in handcuffs cuz you were polite. You're being respectful to me. Um, if I wanted to push that issue, I could. You could also be in handcuffs. I'm not going to like I told you D because you've been cool with me and I appreciate it when people are cool with me. But vers by Pennsylvania vims says that any anybody that's in a car that we stop, if we ask them to get if we order them out of the vehicle, they have to get out of the vehicle. That's that's what that case law says. So, go ahead and read on that case. Um, and and read on a lot of Supreme Court cases, you know. Don't don't just go on just some random website. Go on um Justy is a good one. That's where you can actually read the um transcript from it. But um I've really I highly recommend everybody educate themselves on the law. Um and >> and it varies from state to state >> and um I've gotten a lot better at since I've started doing this job cuz if I don't know the law, who am I to enforce it? So I would definitely recommend you researching the laws of the state of Georgia and also the nation. That's for the Supreme Court case law. >> Yeah. the the toll tag like the number that he has on it like >> well said you'll you'll I'm sure you'll be >> so tag those tags are um so >> the only tag in the state of Georgia that are legal is you see how those have Georgia tag on it with those letters and then or if you see you know you've seen out of state tags that look very much like those in the state of Georgia that's the only tag that's street legal what his hat had it just said private vehicle not for commerce taped onto the back that's an illegal tag the saver for not for commerce. So if he had his tag and he just didn't have his update like the sticker like expired cuz that happened to me before I I got arrested I got my first car and I don't pull people over >> I got my first my first very first car and uh >> it uh I knew the registration was good for a year like you renew it every year. >> So we're not >> my birthday's in January so I got the car in November and then March rolled around. And I get pulled over in downtown and they were like, "You're you're here's a $400 ticket." I was like, "For what?" I was like, "So for you to like do on your birthday?" I was like, "Nobody told me that." >> Well, you are good to go, ma'am. I got to knock out some stuff real quick. Um, do you have any other questions for me? >> Uh, does did somebody have to bond him out or do they still do the >> He'll be able to call one of y'all about that. >> I don't know what they're doing. >> I know. I know Clark County was doing like some kind of thing where you get >> I don't know if they're still doing that. Yeah. >> See, our job is just to get them to the jail, then the jail does everything out once we drop them off. So, you're going to have to talk to somebody from sheriff's office about that. >> Okay. >> Um, you got any other questions for me? >> I not I can think of off the top of my head. I'm kind of stressed right now. >> I understand. I'm I'm sorry you had to be there to go through all that. I wish he would have listened and we wouldn't have had to do what we had to do. >> Are the keys in the car? >> My sergeant has them, I believe, but he'll be able to hand them over to his brother when his brother gets here. >> I think that is in there, too. >> Where's your vape?
