I'm just saying seeing the warrant that popped up, >> right? I want to know why you're pulling me out of a car when I was >> Because we're going to walk a K9 around the vehicle. Okay. 10. That's THC. >> See how it's already turning purple, >> right? >> That's THC. telling me that that that >> this is weed. >> I know, but are you telling me that that delta 9 isn't a form of THC or what? >> It's a form. It's illegal. >> Has THC in it? Well, we're a concentration of uh.3%. >> I guess I do look like you see right here. All this all this dark purple right here. That's all purple. Same color as that for THC. You want me check? I'm going to test the stuff up top in the back. >> All right. We also got a scale with some white res. >> Okay. I'll search for stuff. >> At least he said those are his pants, >> huh? This long and No, this was he's talking about the beer. The beer is in his pocket in the back seat. You need a lesson. >> All right. >> I need a lesson. >> Remember last time we caught the guy? That's right. The second time we caught the guy driving your car. >> Yeah. >> Yeah. Yeah, that's the second time. >> Those break keys. >> Those keys. >> Those weren't Those aren't her keys. >> Holding these in her hand. >> It's for my storage. I have those for my storage. >> Opening this. She's just staring at me. >> That's for my storage. You >> stared at me pretty hard opening. Can you do a follow call search on her, please? She's under arrest. You can face right here. You don't have anything on your person that's going to [ __ ] me, sick me, nothing. No drugs that I'm going to find. >> Obviously, you and I will know once you get into the jail. >> It's never a good thing. >> There you go. >> All right. Do you want to try this again or >> Okay, I'm just going to read your rights real quick, bro. Cuz I want to talk to you. I want to ask you a couple questions. So, >> obviously, you're in handcuffs right now. So, >> you have the right to remain silent. Anything you say can be used against you in court. Have a right to talk to a lawyer. Have him or her present with you while being questioned. Can't afford to hire a lawyer. Won't be appointed to represent you before any questions upon your request. decide to exercise his rights at any time, not answer any questions, make any statements. You understand the rights to ride to? >> Yes, I do. >> Where were you guys heading? >> Um, I was asking for a ride. You wanted to be more like that. >> Where were you getting picked up from? >> Where picked up from? >> Yeah, you were asking for a ride. >> Oh, no, no, no. I mean, I I asked for >> Where were you coming from? >> Coming from home. >> Where do you live at? >> On the W section. >> You don't stay in the P section no more? >> Providence or whatever it was. Where you standing in the W? >> Um, well land. >> How do you know her? >> That's your opinion. >> Um, >> so the dope that was on you, is that did she give that to you? Is that yours or something? >> So, we're talking about the weed, right? the meth that was in the bar. >> No, that Yeah, that's not >> Okay. Is it How How would it have gotten on you? >> I just explained to this guy. >> Yeah, I don't know. I I wasn't I was searching. >> Well, you know these I just got these from uh well from >> We need the car key. Oh, earlier today. >> Oh, today you got it? >> Yeah. Okay. >> You have a receipt or anything? >> Sure. Um well, not on me, I don't think. >> Okay. >> You don't use meth? >> No. >> Have you ever used meth? No. >> Do you use anything else than weed? >> Um, no. >> You see nothing? No. >> I mean, you can't drink, >> right? I mean, >> arguably a drug. Some people call it a drug, some people don't. >> Well, it's a drug when my brother drinks it. >> Yeah. >> Yeah. >> So, as far as you knew, the methyl was in your pocket. I mean, you're you're not it's just I've been in this game for a little bit. All right. She's got meth. She's known to use meth. >> Every time we stop her, she has meth. And now you have meth. It's just very strange. >> Make it make sense. >> Yeah. I don't know if >> do you at least see where I'm coming from or >> I do. Come on. No, I know. I mean, no, cuz I play this game with some people and they have no idea what I'm talking about. That >> and to tell you the truth, my my ex-wife >> normally uh what do you call keeps my uh what do you call it? Uh my medicinal card, >> you know, up to date. So it's really strange that you know I realize that I actually rather the delta you know 9. >> Yeah. Yeah. Yeah. When's the last time you got Delta 9? >> You're buy you buy it off the street as Delta 9 or you get it from gas station? >> No. If it's not a gas station, >> it's the uh the new um >> smoke shop or whatever. >> Smoke shop. Yeah. So then once you over here >> once you get it, you put it in a plastic bag. >> Yeah, definitely. >> Okay. >> So you move it from the container into the plastic bag. Center console, you can see it's completely pulled out and like goes almost down into the transmission. >> This in the car. >> Is it hot? >> Yeah. >> Yeah. >> You want to move down a little bit? >> What do you want? We start on 50. Uh yeah, we got 81 already on the way. So yeah, >> yeah. >> Is there any other you you've never used hard narcotics? >> You've never used any kind of hard narcotics or anything like that? No. Some people do, some people don't. It's just on my back. Right. My bra. Yeah. Like I said, I mean, it just doesn't make sense to me. So, I wanted to give you the opportunity to maybe clear it up a little bit. So, >> I hope I did. Do >> you want to just transport them both with her? >> Yeah. >> Yeah. I think both those she gets those IDs that are what they're IDs that are on my hood. Make sure >> Oh, yeah. You got >> Where'd you put the rest of the stuff? >> Oh, wait. >> The evidence. >> You want to get more done real quick? Yeah, I'm going to get another one >> right there. >> I'm going to get one more search before you go in the back of the car. We'll do it back here >> just cuz he's standing there. It's a little awkward. We'll head back to the black pickup. All right. >> You see the front of the white car there? >> Yeah. >> We'll head to that. >> Okay. >> A thrown cigarette is a violation of Florida statute 590.125. trivial on its face, but it is a lawful basis for a traffic stop, and the Fourth Amendment asks only that, a lawful basis. The passenger was making repeated movements toward his waistband while still seated in the vehicle. Terry versus Ohio, decided by the Supreme Court in 1968, holds that an officer may conduct a protective patown when specific articulable facts suggest a person may be armed and dangerous. Waistband reaches during initial contact are exactly that kind of fact. The detective detected a marijuana odor on approach. That odor is independently significant. It extends the legal basis for detention beyond the original infraction. Under Pennsylvania versus Mims and Maryland versus Wilson, both occupants can be ordered out of the vehicle during any lawful stop. No additional justification needed. The K9 deployment is where this stop's legal architecture becomes interesting. Florida versus Harris. A 2013 Supreme Court ruling that originated in Flaggler County itself holds that a certified K9 alert establishes probable cause to search a vehicle. No warrant required. The alert is the authority. Once that alert fires, United States versus Ross controls. The 1982 decision allows officers to search anywhere inside the vehicle where contraband might reasonably be found. the trunk, the center console, on the occupants persons. The automobile exception swallows the car whole. The passenger, Christian Highly, claimed the crystallin substance found in his pocket was legal delta 9 THC from a smoke shop. That argument collapsed the moment he admitted he had transferred it out of its original container. Florida law requires legal hemp products to remain in their original labeled packaging. That distinction is what separates lawful possession from a controlled substance charge under Florida statute 893.13 subsection 6A. The roadside conversation before High's arrest did not require Miranda. Burkimer versus McCarti 1984 establishes that routine traffic stop questioning even with a detained subject is not custodial interrogation. Miranda attaches at arrest, not detention. Highly talked freely the entire time. Every word was admissible. After handcuffs went on, the detective read Miranda highly acknowledged understanding his rights and kept talking. That implicit waiver continuing to speak voluntarily after advisement is constitutionally sufficient under North Carolina versus Butler. The post arrest statements highly made about the substance are in play at trial. The driver, Stacy Pringle, presented a different legal picture entirely. Multiple prepackaged bags recovered from her keychain and clothing are not a personal use quantity. Florida statute 893.13 subsection 1A defines possession with intent to sell as knowingly possessing a controlled substance with intent to deliver it. Quantity and packaging are the primary circumstantial indicators courts use. Both are documented here. The detective noted on camera that every prior stop of Pringle's vehicle has produced methamphetamine. That prior pattern does not by itself prove intent, but it is the kind of documented history a prosecutor puts in front of a jury to argue this was not a one-time mistake. It is a distribution pattern. After arrest and during booking, deputies found additional narcotics concealed on Pringle's person that triggered Florida statute 951.22 introduction of contraband into a detention facility. A thirdderee felony carrying up to 5 years separate from the possession charge. It is its own criminal act. Highly faces a thirddegree felony for methamphetamine possession up to 5 years in state prison. A thirdderee felony in Florida is not a county jail sentence. It is state prison. It strips voting rights, creates a permanent felony record, and affects professional licensing and federal housing eligibility for life. Pringle faces a seconddegree felony for possession with intent to sell up to 15 years plus five more for the contraband introduction charge run consecutively. That is a 20-year ceiling. She has prior law enforcement contacts, no documented mitigating factors, and an independent criminal act committed after arrest. First offender treatment is not realistic here. The detective receives an A minus. The stop was legally grounded. The K9 sequence was proper. Miranda was administered at the right moment and the interview technique produced documented inconsistencies without a single constitutional violation. The case was built correctly from first contact. Highly receives a D. He talked at every stage before arrest, after arrest, on and off camera without invoking the right to silence once. Pringle receives a D. Multiple distribution quantity bags, a documented enforcement history, and the decision to conceal narcotics after arrest added a second felony to an already serious case. Three things worth taking from this stop. A thrown cigarette opened the door to two felony arrests. Officers need only one lawful reason to make contact. The rest unfolds from there. Knowing that does not mean every stop ends this way. It means every stop carries the potential. Highly spoke for nearly 30 minutes without counsel. The fifth amendment right to silence cannot be used against a person at trial. Every voluntary statement made without a lawyer present can be. The gap between those two outcomes was every word he chose to say. Let us know if there is an interaction or legal topic that you would like us to discuss in the comments below.
