I'M NOT PART OF THE group of the Washington State. You can't do nothing to me. >> Nothing at all. >> Nothing. Look it up. >> So, explain the 1040X to me. I'm not going to give it to Ray. >> You have no authority to give it to my boss. >> I'm just by the time I'm not going to give it to you because by law, you don't have the authority to do so. >> Because I know law. >> Constitution. >> She educated the [ __ ] out of me. >> I am definitely educated. Why are you still screaming at me? Cuz I'm not yelling at you. I don't appreciate that. >> I greatly appreciate that you take the bad people off of take the immigration, >> not the people of America that wants to keep our beautiful city together. >> But I thought you're sovereign. >> I am sovereign. >> That would make you an immigrant of America. >> I am not an immigrant. I WAS BORN HERE IN NEW YORK. >> YOU CAN'T BE BOTH. You can't be an American and sovereign. Do you understand that? >> I am not PART OF THE RESERVE. >> THAT'S RIGHT. M >> I I'm sorry, sir. >> You're welcome. I'm going to lower my temperament and I apologize. >> But do you understand that part? >> But I understand. >> Once you separate yourself from the American government, you then become an immigrant. >> But I also signed the paper of the 1040 uh the 1040X. Then I am not part of the Federal Reserve. I am sovereign. >> That makes you a not American citizen. Right. A >> No, I am an American city, not part of the corporation of Washington DC. >> Sir, I know where I am. That would make you an immigrant. >> No, I'm not an immigrant. I live here. I'M NOT A CATTLE. >> SO DO IMMIGRANTS. >> I am not a cattle. I WAS BORN in New York, Long Island, Port Jefferson. MY MOTHER SIGNED A PAPER. She didn't know that signed away from me. Not my kids will be as well. >> I love you, Mom. Just please calm down. >> Yeah, just got to take it easy. >> I'm just telling you I will not be part of the system. We're the only country that >> Okay, Miss Miss Gibs, I understand all that. How about you just lay back and calm down? All right. >> We just love God. God gave us a sovereign nation. We'll >> pray for yourself right now. Okay. We'll pray for you. Just sit back and relax, sir. That's right. >> I understand. Please fight for our country. >> Please fight for our country. Can you provide us more information on Stephanie? >> No, I have the right to remain silent. >> I understand that. >> So, go. >> Well, we're trying to find Stephanie, correct? >> Yes. I don't know where she ran. >> So, go find her. >> Well, we need some information. I don't have no information cuz I have no right to name her silence. >> I wish I could help you guys. I don't know. >> I have a beautiful daughter and I'm not leaving. >> You're more than free to go if you >> Stephanie will be back. Bye. >> I hate leaving you. Can you please get a hold of me as soon as I can? >> I love you, too. Please just get your [ __ ] together. Okay, just pray for me. Thank you. I know law and I love you. I'm 48, sir. >> I I should be a lawyer. >> I'm asking you to look up 1048. >> I'm asking you to show me that. >> I don't have to LOOK IT UP FOR YOURSELF. DON'T HURT YOURSELF. >> NOBODY told me TO ASK YOU TO ASK ME. >> You're You're claiming that that's what you represent. So, you would have to provide that proof. >> I exempt myself from the Federal Reserve. IT'S YOUR RESPONSIBILITY NOW to know when someone says look for a 10 uh 40x is on your responsibility. I did my responsibility. >> No, it's it's the same as >> No, it's not. >> Listen, it's the same as if somebody if I >> if if a police officer pulled me over, I would have to provide >> God, please help me. Jesus, >> let me explain to you. We're having a conversation. >> Just give me a second. I just need a prayer. >> Okay. >> Jesus. Just We're living a lie. We're living a lie. We're living a lie. They're attacking us. I'm not a crazy person. Listen to me. 1040x, please do it on your own reserve if you care. >> You would have to provide that information. >> I don't have to. THAT'S WHY I'M SOVEREIGN. I'm sovereign. I don't have to give you a damn nothing. Then I don't have to believe that you signed a 1040X unless you provide me with that information. >> I gave you it 1040X. >> You show me in the Constitution that I have to show that I have another person to show me that I have the right. >> Go to your car and look it up and show me. >> Show you what? >> But you're trying to tell me that I have to give my freaking boss. >> Well, look, I'm I'm trying to explain it. >> I'm a passenger. >> I'm trying to explain. I'm telling your passenger. I will have him tow this truck to his authority and I will not drive. You show me otherwise. >> But before I >> show me otherwise. >> Show you what? >> The law. >> It's a Florida state statue grand theft motor vehicle statue. >> I have no grand theft. >> I would need to confirm that this vehicle. >> It's no matter what you have to say. You show me the statue. No matter what, it's like beyond that. But I never got behind the wheel. >> Like I said, as I was pulling pulling in, I witnessed her get out of the driver's seat. That's not true. Passenger seat. >> Stephanie ran that way. I never drove this car. >> You say it was not the person Stephanie with your daughter. >> Said something does not exist. >> Yes. >> They came from the Chili. Had some drinks. They go from the Chili over here. >> Yes. her apartment. >> I never said her daughter said Stephanie doesn't exist. >> No, my daughter said Stephanie get her. >> Hey, Melissa. >> Yes, sir. >> How are you? Good. >> How are you? >> Come talk to me out here real quick. >> Would you like me to get out of service? >> Yeah, if you don't mind. >> I didn't drive, so I'm not going to do any kind of driving cuz I will not drive because I was always in the passenger seat. So I as my citizenship and my constitutional rights would not with behind that wheel other than him that does not have any video surveillance. So I will not do any tests because I have been studying law and I know my rights. So I'm going to sit in this car and you can decide what you want to do sir. >> Okay. You you don't want to walk over here? >> No. >> Okay. Well, I'm going to read you something real quick. Okay. >> Yes, sir. I he to remain silent. Oh, he he raised he rages my memorand right to do it twice. I don't I HAVE THE RIGHT TO NOT HAVE TO DO IT twice attorney want to be appointed. >> I have the right to do it twice if you wish. I have the right to do it twice in law. He already did not statements. >> Did you give me my Miranda rights, sir? >> No. No, sir. Did you give me my Miranda rights? Tell him that. NO, YOU DON'T HAVE THE AUTHORITY TWO TIMES. I know that by law. >> You say each of these rights I've explained. You >> have these rights in mind. Do you wish to talk to me? >> I'm sitting in my passenger seat and waiting for my driver to come. >> Have those rights in mind. Do you want to talk to me? >> No. I already talked to that guy and I don't have to talk to you by my rights. >> Okay. Hey, step out of the car. Okay. >> No. >> Step out of the car. >> No. Step out of the car, Melissa. >> I don't have to. >> You kind of do. >> No, I really don't. I know my rights. I study law. >> Okay. Come on. Come here. >> You don't have her right. >> Come here. >> What did I do wrong? >> You're under arrest. >> For what? What? >> I didn't drive, sir. You never saw me drive. >> What? >> He saw you in actual physical. >> No, he did not. He Stephanie ran >> 29 Chevy Lodge driver seat. He has nothing on video. He told me he has nothing on video. He saw a girl running away. >> I don't know why I'm being arrested. >> Sorry. I never drove. >> I've been in a passenger seat. >> You never drove my car? >> I never drove that car, sir. >> Have a seat, please. Thank you. >> Yes, sir. Can I have >> Watch your hand? >> Yes, sir. >> Legally, the charges listed at the end of this encounter are addressed under several Florida statutes. The DUI allegation is governed by Florida Statute 316.193. The refusal to submit to DUI testing is addressed under section 316.1932. The obstruction allegation corresponds to section 843.02, Florida's resisting or obstructing without violence statute. And driving with a suspended license is addressed under section 322.34. But there's an important distinction. Being charged with an offense is not the same as being found guilty. Each charge still has to be supported by evidence and satisfy the legal elements required under Florida law. The deputy had a difficult situation from the beginning. He was dealing with conflicting stories about who had actually been driving, questions surrounding the driver's license status, and a passenger who repeatedly disputed the deputy's account. The situation became even more complicated when Melissa began relying on sovereign citizen arguments to explain why she believed the law did not apply to her. Deputy Low receives a B+. He continued trying to establish what happened, gave clear instructions, and warned Melissa about the consequences of refusing to cooperate. Most importantly, when she ultimately invoked her right to remain silent, the questioning stopped. Melissa receives a C. Her repeated sovereign citizen arguments did not resolve the underlying questions surrounding the vehicle or her involvement. Her refusal to cooperate made the encounter considerably more difficult. However, she did make one important decision correctly. Once she clearly invoked her right to remain silent, she stopped answering questions. And that leads to the biggest lessons from this encounter. Lesson one, claiming sovereign citizen status does not automatically exempt someone from state traffic laws. Lesson two, simply denying that you were driving does not necessarily end an investigation when an officer says they personally observed you behind the wheel. In this case, the deputy specifically stated that he saw Melissa getting out of the driver's seat while she continued to deny driving. Lesson three. If you believe you are being wrongly accused, arguing legal theories on the side of the road is rarely the most effective strategy. Objections can be preserved and challenged through the appropriate legal process. Lesson four. Once you're in custody and have been advised of your rights, clearly invoking your right to remain silent is an important legal safeguard. Melissa eventually did exactly that and the deputy stopped questioning her. In the end, what began as a dispute over who was actually driving turned into an arrest involving DUI, refusal to submit to DUI, testing obstruction, and driving with a suspended license. According to the video's stated outcome, this case is a good reminder that knowing your rights is important, but knowing when and how to exercise those rights can be just as important. If you found this legal breakdown useful, like and subscribe for more police and counter analysis, and let us know in the comments. Did Melissa make the situation worse by refusing to cooperate?
