I'm trying to say I'm done giving y'all information now because >> Okay. >> Literally, it's like this been going on for a So, either I don't know what y'all want me to say. >> Okay, well, at this point I'll get to the point where I'm just going to take you to jail, okay? >> You can't You have no reason to to take me to jail. >> Well, unfortunately for you, in the state of Georgia, everything is an arrestable offense, okay? So, we either find out who you are >> We got to take me to jail. That's not my place to for you all to find out who I am. You said you was coming with all the stuff. I got out cooperated. >> Okay. >> The stuff You have no reason to arrest me. Yeah. >> I was barely even speeding. >> You were going 77. >> You know what barely speeding means? Speed. Welcome to Georgia. So, there's nothing else for us. That's it. >> I don't what you want or else you want me to give you. >> Your social. Something Something that can identify you. >> You also have a fake address. >> What fake address? I gave it to you. >> Circle. I mean the the >> Barber Circle is not a valid address. >> Okay, I don't know. Keep trying to think. I told him earlier I don't remember none of the addresses in my heart. I don't remember. I'm not I never saw the I don't remember the addresses. I literally told him everything on Broad Street in Indiana. So, all of that could have got I don't know what else y'all want me to do. >> What's your Facebook name? >> I don't have a Facebook. >> Do I need to search for you? >> I don't have no social media. And I'm not That's what I'm trying to say. I'm not lying about it. I don't care about any of that stuff. I don't have it. That's my We have the same father. >> The same father? >> Yeah. >> Okay. So, if I go ask him in his phone what your name is saved as. >> That's a good one. >> All right. All right. I'm I'm apologizing. If I ask her what your what your name is saved as. >> I don't know what she got my name saved as. I literally just showed him my number and my >> Telephone number? Yeah, I'll try that. I want to give you every chance. >> Do you know your Indiana phone number? The 317 number you started giving me? >> Um 317 I think. Don't go I don't want y'all to keep telling me I'm lying. >> that phone >> Um that's So, my number is Um Wait. Let me get the home number right. I'm not good at remembering numbers. >> I'm going to look it up on my phone. Yeah, >> look it up. Is it coming through? So, I'm not quite understanding the issue. Like, what's >> It's not. Like, I was doing 60 before I got to him. Before I got to him, I did 60. Before I even got to him. Look it up. Look it up. It's not. I gave you my phone number. It's my number. It's my number. >> But, anyway, she's just not coming back. She's giving me an Indiana name, date of birth. She's not coming back out of any any state. >> He just said my name's not running up. >> What's What's your last name she gave you? >> Phillips. >> And then the one you pulled up was Georgia Phillips, right? So, my guy's got a fingerprint scanner. You want that now? >> He's got one, but he can't log into it. >> Oh. >> And that's what I got out for. >> Okay. The issue is, I just watched you pull up a contact for the name >> That's not my That's what you asked me for my number, and that's what I gave you, my number. >> What's that phone What's that phone number? >> This is my other phone. There's no number This is not ringing. >> Just take it. >> There's no number here. You cannot. >> You're a liar. >> I know. I'm going to make sure I I This is >> I'm not calling No, I'm not calling I got it. I'm not calling you a liar. But, what I am saying is that there's some things that we got >> I know what you're talking about. >> All right. We got to change >> It's never this serious. There's nothing on my name. Even that name y'all pulled up. What is so What the What's criminal Anything y'all pulled up, period. For you all to even try to be this deep on anything you pulled up. >> Well, right now you're an unlicensed driver. You started >> I'm not an unlicensed driver. >> I told you that earlier. If you don't switch your your address within 30 days in the state of Georgia, you're considered unlicensed. >> Okay. >> Please do not go through my stuff. >> under arrest. >> That's an ID. >> Why didn't you just give me this? >> Well, I didn't know this was in my package. Literally, you see me standing here. >> I just want to make it clear, you're under arrest. I'm searching you incident to arrest. >> You have no reason to arrest me. >> go take a seat in the back of my vehicle. >> Hey, man. You were bad. Handy. >> Come on. >> Look, give my phone to her. >> grab it. Come on. >> Jeez. >> Let's go around this side. >> You're kind of >> We have to do it this way. >> Why are you doing this? Why are you doing this? Why are you doing this? Why are you doing this? Why are you doing this? >> Why didn't you just give me your driver's license? >> If it was that deep, you should have wrote a ticket. Why are you arresting me? >> That's the way it works in the state of Georgia. >> Unfortunately for you. >> is not how it works. It's not how it works in the state of Georgia. >> Okay. >> Can y'all Now she got to This She's really >> Put your leg in. That's the name she gave you? >> It's all coming back to me now. Everything. >> I don't know why she just wouldn't give me this. >> Have you already looked up the O and everything? >> Everything. Well, not the O. He just ran the O. I'm sorry. >> Okay. Let me run the O. They don't match, right? >> Yeah. One second. >> I mean, that's the name, date of birth, everything. >> Indiana license is required 12 numbers. >> It's not the name she gave. >> What is the name she gave? >> It's a fake ID. Is it really a fake ID? >> Look what it says. Requires 12 uh >> Well, I was going to control it more accurately. >> Let me run through Central and make sure. >> I just did. >> Run Run through Tower accurately. >> I'll be accurate. It's a problem. >> What a pain, dude. Why did she do all that? >> Uh I say we search the car at this point for more >> All right. So, this is your sister, right? Then you're not So, she's under arrest. Okay. She We found her ID. It's still not coming back. Yours came back out of Indiana. Hers is coming back as a possible fake ID out of Indiana. Is that her name? Like this is your time to be honest with us. Okay. Why Why wouldn't she just give me her her license if it was on her? All right. >> Yeah. That's Yeah, it says no class on this one. It also says operator license but no class. >> No class >> It's not even an ID. Yeah, you're right. It's fake. >> Let me see. >> Let me see. Hey, can pay Will you ask them for >> Can I see your license again, please? >> It's not a license. It's a picture of it. >> Yeah, that's fine. >> Let me see that name real quick, dude. >> Your brother? Okay, that's fine. I'm just going to hold your phone right here. >> Yes, sir. >> Hey, 274. Is there any way we can call Indiana? Oh, never mind. >> 300 Rogers Road is where the call is coming from. >> I think Never mind. I think Cameron just found it. Sorry. Sorry, you're fine. Thank you. >> Sorry, it was We got the address wrong. Now Same as that. Okay, Julie. Hey, where is her social? Uh She has two socials. >> Are you the owner? >> Yeah. >> Go ahead. >> All right. Um I guess she Your sister's good to go. >> Okay. >> So, she is going to jail. She gave us She had a fake ID, fake name. Um so So, she's she's going to be going with us. Um do you have any questions or anything? >> Probably not. >> You got what's going on? >> Uh >> My sister's actually doing good. >> So, what happened basically what happened is we caught She was on 77 and 55. She immediately saw my blue lights come behind her. She pulled in here, acted like she was going to go inside. And then and then we we went from there with saying she has no license, no ID, no anything. And then we found ID on her. And then we found out she's got a different name. That's what brought it up. Um as far as the car, it's good. We did search for any fraudulent IDs or anything like that. >> The other ones besides the one she had on her. >> Um Your sister's good and and you're good. You take the car or leave it here or whatever you want to do. Did you walk here? >> Not to here. >> Oh god. All right, man. You be safe, okay? >> Motto or whatever that is. She's suspended, I guess. >> Yeah. >> So, she's got a fake name, fake address, fake date of birth. >> Um fake ID. >> Fake ID, open container. >> What's the What's the hold on her Indiana license? >> I don't know. >> So, speeding, suspended, obstruction, fake ID. Anything else? >> Open container. >> No. >> I It was underneath the driver seat. >> I'm not going to do that. >> Listen here. Joey Lewis >> Let me talk to her real quick. >> All right. Uh I'm going to drive over there. I got to put it in. Guys, it's It's awesome. Thank you. >> You got that ID from our computer, didn't you? >> Yeah, I got it. >> Anything for me? >> I don't >> All right, miss. So, we called Indianapolis. They found a Joyce with your license number a different license number from this one. >> Okay, yeah. You checked the same as semi is you. >> Okay, so they're saying we called Indianapolis said your license is suspended as well, so you're going to be going for that as well. I'm just letting you know, okay? >> My license is >> Okay, well, according to Indiana it is. We just spoke to them. And I also found it in our system as a Joyce >> Okay. Okay. >> with a maiden name of Well, that's what you getting booked in as, okay? >> Okay. >> And you're getting charged with fraudulent ID, obstruction of law enforcement speeding and suspended license, okay? >> Just a moment. >> Okay. >> So, how did a simple speeding stop turn into an arrest? First, speeding. The deputy says she was traveling 77 mph in a 55 mph zone. Under Georgia Code Section 40-6-181, drivers are prohibited from exceeding the applicable maximum speed limit. In this case, the alleged violation was straightforward. 77 in a 55. Second, driving with a suspended license. Officers contacted Indiana and were told that her driving privilege was suspended. Under Georgia Code Section 40-5-121, driving on a public highway while a person's driving privilege is suspended, disqualified, or revoked is generally a misdemeanor for a first conviction. And importantly, this is different from simply forgetting your license at home. Georgia Code Section 40-5-29 requires a driver to have their driver's license in their immediate possession while operating a vehicle and to produce it when demanded by law enforcement. But, the most serious part of this encounter involved the driver's identity. Officers repeatedly attempted to verify the name and information she provided. Nothing was coming back through the databases they checked. Eventually officers located an identification document that they determined was fraudulent. That brings us to fraudulent identification. Under Georgia Code Section 16-9-4, it is unlawful to knowingly possess, display, or use a false, fictitious, fraudulent, or altered identification document. A first violation under the relevant subsection is generally classified as a misdemeanor. Then there was obstruction of law enforcement. Georgia Code Section 16-10-24 A makes it a misdemeanor to knowingly and willfully obstruct or hinder a law enforcement officer who is lawfully performing official duties. Georgia case law also recognizes that providing false identifying information to officers can support an obstruction charge under appropriate circumstances. And that's important here because this wasn't simply a situation where she forgot her driver's license. Officers spent a significant amount of time trying to establish who she was. Her name and identifying information repeatedly failed to produce a matching record. While the information eventually discovered by officers pointed to a different identity and a fraudulent ID. According to the video, the final charges were fraudulent ID, obstruction of law enforcement, speeding, and driving with a suspended license. The video reports that she ultimately received 2 days in jail and 12 months of probation. The lessons. So, what can we learn from this encounter? Lesson one. Don't underestimate a traffic stop. What begins as a speeding violation can become much more serious when additional legal problems are discovered. Lesson two. Your identity matters. If officers cannot verify who you are, the stop can take a very different direction. Providing information that doesn't match official records can create additional legal problems. Lesson three. A suspended license is not the same as forgetting your license. The physical card may be missing, but the legal status of your driving privilege is what matters. In this case, officers ultimately received confirmation that the Indiana license was suspended. Lesson four. A fake ID can turn a traffic stop into a criminal case. Once officers determine that an identification document is fraudulent, the situation is no longer simply about speeding or failing to carry a license. And finally, lesson five. Don't make an already complicated situation harder. The officers gave her multiple opportunities to establish her identity, but the longer the information remained inconsistent, the more serious the situation became. What started with 77 and a 55 eventually resulted in an arrest and multiple charges. The biggest lesson is simple. A routine traffic stop can become a much bigger legal problem when your identity, license status, and identification documents don't match what law enforcement finds. What do you think? Did the officers give her enough opportunities to explain herself, or did this stop become unnecessarily complicated? Let us know in the comments.
