Number two, the tag cover around you surrounding your tag. That's the second reason. What do you mean? >> This traffic stop starts with what looks like a routine license and registration issue. But things are about to take a serious turn. The officer says the driver's license is suspended because of an insurance issue, while the driver insists he has valid insurance and believes everything is legal. Then there's a problem with the vehicle's tag, followed by a disagreement over citations and a supervisor request. Keep watching because what begins as a paperwork dispute eventually turns into a physical confrontation and an arrest. >> Your mind is suspended. >> How is it suspended? >> I don't know. I need your license, registration, insurance, please. I have to check that out. You're the registered owner, right? >> Yes. >> Okay. I got to grab it. All right. Just hang tight. Okay. You're going to have a court date. Fix all that. Get your license reinstated. Get your insurance. Get your registration. Bring it to court. And if you get all that and bring it to court, most likely the judge will throw it out. Most likely. I cannot tell you they will, but it's a possibility. If you come with everything, all good. Okay. So, with that being said, I just need you to sign here with your sign admitted to your sign saying you're going to show up to court. Your court dates, I have them right here. Cuz I was just trying to check that. >> There's nothing I could do to help you with this, sir. So, I just need you to sign right here. >> Look, dude. I can't I can't have you take my tag. What are you talking about? >> You can't drive, sir. >> Huh? >> You can't drive. >> All right. >> Call Call No. I need you to call your man your your officer right now. Your your manager right now. I need you to call your manager cuz I am legal. Everything is legal with >> I'm going to ask you I'm going to You want a supervisor? Is that what you want? >> Yeah. I'm going to ask you before I call a supervisor. Are you going to sign citations? Why should I sign a citation? >> I'm letting you know if you don't sign the citations, you're going to jail. >> So, are you going to sign before I call myself? That way, I can let them know two things at one time. You want to >> Yeah, but you're you're lying to me right now. Or no, you may not be lying to me, officer. What What you're receiving is information that may be not legit. I could call my insurance company right now and let you know that I have insurance. >> I'm not saying that you don't have insurance, but they suspended. There might have been a time that you didn't have and it suspended. I don't know. I don't work for the DMV. I don't work for the insurance. I don't work for Tallahassee. I'm letting you know in the state of Florida system that I have. You are suspended in July. Okay. Now, >> but that's bull because then they would have they I would have got something in the mail stating that I had no car insurance. Okay. >> My car insurance people would not insure me if I was suspended. They have been insuring me all this time. They contact DMV. The insurance company contacts DMV when a person is suspended from their license. That means that they're they're nonvalid or they are suspended. They contact they never contacted DMV. Uh >> okay. I I understand what you're telling me, sir, but I'm letting you know that on the system you're suspended. So, what I what I need from you? What I >> And you checked the another system? No, >> this we only have one system we go by. Okay. So, with that being said, I need you to sign here. Okay. That's just saying that you're going to show up to court. I need your fingerprint. I'm going to take that tag with me and you need to call somebody to come pick the vehicle and you up cuz you cannot drive. Sir, just hold up. He goes, "If I'm legal, okay, which I'm telling you that I'm legal, you know, so my driver license is legal. My tag is legal." Why were you saying that my tag's not legal? >> I never said it's not legal. >> You said the thing around the tag is not is not >> Okay, what I said that's a traffic infraction. Okay. You cannot have anything around the tag touching any letters or numbers. You see where it's touching the sunshine state, the my Florida, you cannot have it touching any numbers or letters. Okay? All right. I'm not giving you a citation for that. I'm just telling you that's one of the reasons I pulled you over, sir. >> Okay. I'm not giving you. But I do have a cease tag order from the state of Florida. Take your tag. So, I will be taking your tag. >> Well, where show me where you have that? Show me. >> It's on my system, sir. >> Can I see it? >> No, sir. >> Why? >> Then I'm not required to show you that. Okay. I'm treating you with the most up respect. All I'm asking you is to sign this. Give me a thumb print. I'm going to take your tag and then we're going to or you're going to have to call somebody to come pick you in the vehicle up. Sir, >> we're not going to stay here all day. >> Can I go show you my insurance? >> Right now, no. That's not going to matter. I'm telling you. >> Well, I want your supervisor then cuz what you're doing to me is illegal, bro. you're going against my rights as a United States American citizen. Hold on. You are because you want you threaten to take me uh away and and arrest me. That was number one. Number two, you're saying that I'm not I am not legit on the road. And I'm telling you that I am. So that's two things that two infractions that you're going against me against my rights as United States. My question to you, I want your supervisor here so I could explain these things to you. >> I will call the supervisor. Okay. Are you going to sign citations? >> Traffic 13 and traffic 12. >> This is where the situation takes a sharp turn. Up until this point, the disagreement has mainly been verbal. The driver believes his insurance and license are valid while the officer is relying on the information available through the state system. The driver asks for a supervisor and the officer says he will call one. But before that can happen, the officer again asks whether the citations will be signed. Watch what happens next because the driver's decision to move toward the vehicle changes the encounter from a disagreement over paperwork into a physical arrest almost instantly. >> Sir, come here. Listen. Sir. Sir. Sir, come here. Getting my key. >> No. Put your hand behind your back. No. No. Listen. Don't Don't stop. >> Put your hand behind your back. >> No. You're not going to arrest me, bro. >> Put your hand behind your back. >> I'm not illegal. I'm not illegal. Don't stop. >> All right. Calm down. Calm down. Calm down, bro. Just calm down. >> Get your hand behind trespassing. You're trespassing. >> Get your hand behind your back. Give me your hand. Put your hand behind your back. Put your hand behind your back. >> Dude, you you could go to You could get in trouble for this. >> You could go to in trouble for this. >> Give me your hand. >> Do you realize this? >> Give me your hand. Do you realize >> Put your hand behind your back. >> You could get in trouble for this. >> Give me officer. You could get in tr you could get in trouble for him. >> Give me your hand now. >> Put your hand behind your back. >> You could get IN TROUBLE. >> PUT YOUR hand behind your back. >> I'm legal, bro. >> Put your hand behind your back. Put your >> Put your hand behind your back. Put your hand behind your back. >> Driving 12. Give us traffic, mother. Put your hand behind your back. >> Put your hands. >> PUT YOUR HAND ON YOUR BACK. PUT YOUR HANDS ON YOUR BACK. MY HANDS ARE BEHIND my back. I'm not resisting your [ __ ] Let go of your hand. >> Let go of your head. >> I I'm not touching my hand. Everything's fine. Got it. Good. Traffic 12, slow everybody down, >> stupid. >> Roll over. Stand up. Can you get Can you get my glasses, please? My glasses flew off my head. Please sit inside aside. All right. All right. Hold on. Hold on. >> Now the physical confrontation is over and we get the officer's immediate explanation of what happened. He says the driver refused to sign the citations, requested a supervisor, then began walking toward the vehicle. According to the officer, he attempted to stop him. The driver pulled away and the struggle followed. That explanation matters because the body cam shows the commands and physical struggle, but the officer's later account gives additional context about what he says triggered the arrest. What do you think? Should the driver have stayed where he was and waited for the supervisor? He >> didn't want to sign the citations and he wants the supervisor said, "Okay, are you going to sign the citation?" Yes or no? That way I can tell supervisor the two things I want. And then he start walking to the car and I grab him. He pulls away and then and I'm trying to grab him. He put his hand behind back. So he went like that to me. I said, "Oh, that's it." I heard I heard 12 to I heard you asked for me. Yeah. Can I see I just pulled away and then >> Yeah, that's fine. Took a little bit and I pulled you up and I saw you here, but then it was saying Baywinds. Baywinds is back that way. >> That's where I first lit him up. >> Okay. >> You have your stand on. >> Yeah. >> Yeah. Okay. I just not >> just just for your own safety, stay in the vehicle next time. If he starts shooting, you're staying out of your car. Turn your turn signal and try and get in. If you'd like, I'll hold traffic. Go ahead. Anyone fight? Oh. Step out of the vehicle. >> Then right here in the back arrest is going to check you out. >> What happened? >> Uh he just has to sign some citation and then he decided to fight. So we were here on the floor having a little scuffle. >> Is he complaining about anything >> as of right now? No, but just to get him checked out in case he comes in after. >> Hey, did I tell you complain about uh his wrist. Now, >> after the struggle, the focus shifts to the aftermath. The officer explains that the man needs to be checked. Even though there is no immediate complaint of injury mentioned at that moment, that is an important part of any physical arrest. The incident doesn't simply end when the suspect is restrained. Officers still have to deal with the person's condition and document what happened. And now we are about to hear the actual charges and more importantly which of those charges ultimately stayed in the case. >> As a result of his actions, the 52year-old man was given five charges. Two counts of resisting an officer without violence, one count of battery on a law enforcement officer, one count of driving while license is suspended, and lastly, possession of a driver's license while having your license suspended. The last three charges, battery on a law enforcement officer and the two driver's license charges were eventually dropped, but the two counts of resisting an officer without violence, the man was adjudicated guilty on these two counts. And as a result, the man was sentenced [music] to 3 days inside county jail. Let me know your honest thoughts on this case down below in the comments. Stay safe out there, and I'll see you in the next. >> The outcome is especially important because the initial five charges did not all lead to convictions. According to the information provided in the footage, the battery charge and the two driver's license related charges were eventually dropped. The two resisting an officer without violence counts, however, resulted in guilty adjudications, followed by a 3-day county jail sentence. So, while the original traffic issue sparked the encounter, the final consequences centered on what happened during the confrontation and the officer's attempts to gain compliance. Do >> you have insurance now? I don't know, but they they suspended in July. Okay. So, with that being said, I'm not taking you to jail. I'm just giving you a a court date, a criminal citation. Okay? >> I'm legit. I'm legit. I have a license, registration, and insurance. I am completely legit. I'm telling you the truth. >> Explaining to you. I'm not saying that you're lying, but I'm letting you know that the system in the state of Florida is showing you suspended. >> I want your supervisor here so I could explain these things. >> I will call the supervisor. Okay. Sir. >> Sir, come here. My key. >> No. Put your hand behind your back. No. No. Listen. Don't Don't stop. Put your hand behind your back. >> No, you're not going to arrest me, bro. >> Put your hand behind your back. >> I'm not illegal. I'm not illegal. >> Oh, stop. >> All right, calm down. Calm down. Calm down, bro. Just calm down. >> Get your hand behind trespassing. You're trespassing. >> Get your hands behind the back. >> There is one major lesson running through this entire encounter. A disagreement during a traffic stop can become much more serious when the parties stop communicating effectively. The driver repeatedly insisted that his documents were valid and wanted a supervisor. While the officer repeatedly relied on the information displayed in the state system and instructed him to comply. Once the driver moved toward the vehicle and the officer attempted to stop him, the situation escalated physically. Whatever viewers think about the original suspension, the physical confrontation created a completely different legal
