At just before 5 in the morning, police in Clovis, New Mexico were sent to a house for what sounded like a burglary in progress. A 19-year-old named Darren Munoz told dispatch that someone had broken into the home while he was inside. >> Clovis 91. When was the location of your emergency? >> Someone in my house. >> But by the time officers reached the house, the call had become something far worse. Darren's father, Oscar Steve Munoz, and his stepmother, Dena Munoz, had both been shot. 26 video got a sixoot at the garage door. Close video unknown. >> Watch the back. >> Watch the back. >> Yeah. >> 26. Any available unit? I got a 68. Sounds like somebody's inside. Nobody's advising if they're inside. IT'S A CLOSED POLICE. NO. NO. COME ON. YOUR HANDS UP. EMPTY. 26D. Make commands inside. Nobody's responding. 68 to the front door. I'm holding until more units get available. >> COME TO THE DOOR. PUT YOUR HANDS UP NOW. Got contact with one. Hello. What's going on here? >> What's going on here? We just got a call that somebody's trying to burglarize the house and I'm making announcements. Can hear somebody inside, but you're not responding to me. >> I just got up. >> You just woke up. Is your front door and garage door usually open? >> No. >> Okay. Are you the only one here? >> No, my parents are here. >> Your parents are here? Where are they at? >> Asleep. >> They're asleep. Okay. Well, we just got a call that somebody was trying to burglarize the house and the front or the garage door and this door are wide open. So, I'm trying to figure out what's going on. Does that make sense? I'm not trying to scare you or anything. >> I got >> I got you. >> Scared me. >> I got you. Is your parents in their room? >> Yeah. >> Okay. Where are they sleeping? >> Yeah, they're in my room. Right there. They're down the hall. >> I got you. 26. Just 49. I got contact with a resident that stated that they were asleep. I'm going to attempt to make contact with the homeowners. All right, let's go talk to your parents. >> You want to wake them up first or >> I mean, if they're not up. Yeah, I'd like to wake them up cuz like I said, we got a call for a burglary in progress. >> You want to wait here? I don't think they will. They They don't sleep with clothes on. So, most >> Okay. Yeah. If you want to go tell them to wake up. Is everything good? Nobody's Nobody else is in here that I need to know about. >> Okay. 26 to unit in the back. You can come around to the front. 26 other units. If you're responding code, you can go ahead and go back. 108. Everything appears temp for here at the moment Charlie 26 video. Who is the caller on this? Come here. Come here. >> What's going on? Pool of blood. 26. We got a pool of blood. Stay outside. In the back where? >> Back. >> Back. >> Officers find Oscar, Steve Munoz, and Dena Munoz suffering from gunshot wounds. Dena is pronounced dead at the scene while Oscar is taken to the hospital where he later dies. In only a few minutes, the case changes from a reported burglary to a double homicide investigation. Clear the house. >> Go ahead and step out for me. Go outside. He was in this room. I can't tell if they're shot or what's going on with their head. Go. >> Hey. We're going to go backwards. Open. >> Clear. Ready. >> One, two, three. >> Clear. Ready. One, two, three. Quick. Go. Keep moving. Holding. >> Clear. He was in this room. I can't tell if they're shot or what's going on with their head. I'm not either. >> Who else lives here? [snorts] >> Who's just us? >> Just you three? >> Yeah. You have family members >> uh across the street. My uncle and uh aunt >> Your uncle and aunt live across the street. >> All right. >> Told to come and um see if you guys would be willing to come down to the police department to talk to one of our lead investigators. That's okay. >> Sure. >> All right. Um y'all can get dressed and get y'all's own vehicle, drive down there. It's not like we're taking you guys down there or anything like that. Okay. Um >> is it that bad? >> Yes, ma'am. Somebody was shot. My brother was shot when he shot my brother, didn't he? >> We don't know that. We don't know that. >> But my brother's in the hospital because he has a gunshot wound. >> Yes, ma'am. Come with me. Stop right there. Stop right there. Come on. No. inside in the bedroom. Go inside to the right. >> We cleared. We didn't find anything yet. All right, just have a seat, man. We'll figure out what's going on. Okay, Charlie 26. Just for 49. We have one male detained at this time. Just for 49. He stated he was asleep during all of this. I don't know where my flashlight went. Back door secured. Where did that flashlight go? >> So, both of them both of them have a big pool of blood coming from Step inside. He's got a pool of blood coming from his head. She's got blood coming from nose. Possibly. >> I think he's abnormally bleeding. So he he when I first got here, garage door wide open, side door wide open, started making announcements, the one that I just put in his unit. He walks out of this room >> like he's asleep, like he's dazing confused, right? >> He comes and talks to me and says, uh, everything appears fine. My parents were sleeping. I was sleeping. >> I was like, well, it's kind of weird that the door's open. >> Yeah. I told him to come to the front door. >> Detectives still needed to determine what had actually happened. Was there really an unknown burglar inside the home, or was the burglary report covering up something else? They began collecting video footage from the surrounding area and examining the property. As they reviewed the available evidence, their attention started to shift from what Darren said to what the footage and investigation could confirm. >> Well, let's start over. What did you guys do yesterday? >> Um, they weren't home. over town and um I can't um um it's called 0720. >> It was >> Were you gone all weekend? >> Yes. >> Okay. When did you stay by yourself? >> Yes, sir. >> Uh when did they leave? >> Uh Friday. when and then they got back yesterday. >> No, today >> Sunday. >> Yeah. So, today's Monday. >> So, Sunday. Sunday night, would you say, or >> during the day? >> Oh, during the day. >> 7:00. >> Um, and everything. I mean, do you have a pretty decent relationship with your parents? >> Yeah. and your stepmom. You get along with her pretty good. >> Okay. And I think you guys have family across the street. >> Yeah. My brother, uncle. >> Where did he go? >> I don't know. >> Yeah. >> When was the last time you saw him? >> Who? >> I know. I just I know he hasn't talked to he told me things he said he like but you don't know what kind do you know if they were like rifles handguns like this oh sorry >> um do you know what the what they look like >> I think You just had you know what you know what caliber or anything like that? >> No. Are you a gun person or not really? Okay. >> Are you a shot at firearm? No. No. >> Darren tells investigators he has a decent relationship with his dad and stepmom. He says he's not really into guns and barely uses them. He also says he was asleep when it happened and claims he doesn't know anything about what took place. But investigators find that Darren does own an AR-15. He also has what's known as a ghost Glock, a handgun without a serial number. Then they find messages between Darren and a friend named Julio. The two talk about guns, ammunition, and accessories. They even discuss buying more firearms instead of trading the ones they already have. So, the picture investigators are getting is a little different from the one Darren gave them. These conversations show that guns were something he was familiar with and actively talked about. And there's another detail that stands out. The conversations didn't begin after the murders. They go back weeks before them. >> Hey Darren, >> sorry the ball. Got a search warrant here to collect your clothing and get some photos and stuff taken of you now. Everything okay? Can I get you to stand up and towards that wall? Yeah. The reason for this uh obviously with what happened this morning, the fact that you went in the room and everything, we just we have to take these steps in order to process everything. Okay? So, I'm going to take photos of you. I'm going to have you I'll tell you give you direction on what we're going to be doing and then I'll take swabs of your hand. I'll get have you take swabs of your mouth, stuff like that. Okay. >> There DNA swabs. Okay. >> Close. >> Huh? >> Yeah. I have I have a like a suit that you can put on. Okay. All right. So, if you just want to [snorts] stand still, I'm going to start taking photos. Okay. There you go. Take that one and swap the left side of your cheek. Go ahead and take your shirt off for me. Thank you. You didn't get no blood on this as you can see. >> What if you need that? >> What did you need? >> Hello. >> A what? >> Hello. >> Okay. So, you are at this point real quick. Okay. Um, you have every right >> that you have a right to the to an attorney. Okay. So, what's going to happen is you're going to uh remain here. Okay. Is he still alive? Yeah, still is. You have the gunshot doing too. He's dead with the 9 mm. It's not I don't think it doesn't turn out to you. You go, man. Like I said, I mean, I'm not going to ask you any questions, okay, man? But I'm going to let you know what's going on, okay? This whole home invasion thing. >> What's going on? >> It's not happening. >> Yeah, >> we know. I believe we know what happened. And we're giving you the courtesy to come see us with him. And then, you know, by him saying that, you know, he doesn't have guns, you have access to guns, but he's on video stucking a gun into his waistband actually came back. >> So, if she ain't willing, >> bro, she's going to give you consent >> one way or another. >> No, bro. What if she's a minor, bro? >> Only if she's above age. >> But that girl that you're texting, is it? >> She is. >> No, she's not. >> Just turned 18. >> She's 17. >> She's fresh. >> She's actually 16. Turning 17. What are you talking about? >> Oh, legally, it's all right. >> 16. You're 19. >> She's 19. >> She's 16. Turning 17. >> See, I'm waiting till she's 17. Things legally be all right. Are >> you still talking to her? >> I asked her what her name and how old she is. Crazy. That's talking. >> How long have I been here? >> I don't know. >> I know you're Have you eaten? >> Oh, I look so you can't see him. Trust me. Let me see if I can get you some according to you have on Instagram. >> Pictures of drugs and all that. >> The fake photos are fake. Clearly, all of my PD comes from [clears throat] >> Darren has made jokes before about hurting his dad for hurting him in ways that I I'm sure he doesn't want to say or I wouldn't say for him. And, you know, I've always took it as a joke and blown it off, you know, because like my parents said, he's always been a [ __ ] You know what I mean? And um so he was going to get to do it, but one of our really close friends. So instead of Darren having do it, he had Julio do it. >> Okay. Basically, they had traded guns and then that Julio was down to kill Steve. Right? Right. >> Okay. So basically Darren had planned this. That's why the cameras had cut off, right? and um [clears throat] has Julio's gun because Darren had built a ghost lock which was the gun that was used to kill his dad and um Julio had took his ghost lock traded it with and went to go do it >> but I know that Darren was going to get money from his dad dying cuz um he owns all the allups and then he owns a couple buildings you know >> police then focused on Julio Zamora the friend accused of taking part in the man. Investigators alleged that he entered the home and fired the shots that killed Darren's father and stepmother. The evidence they were building was not based on a single detail. It was a combination of the emergency call, the alleged surveillance video, witness accounts, and later statements to detectives. >> You have the right to talk to a lawyer before we ask you any questions and to have him or her here with you during any questioning. If you can't afford a lawyer, one will be given to you at little or no cost if you wish. >> Yes, sir. >> If you do not wish to talk with me or investigator Munas, you can stop at any time. Right there. [snorts] >> All right. Do you understand what I just explained to you? >> Yes, sir. >> All right. If you was just initially Yes. There you go. [snorts] And do you want to talk with us? Yes or no? >> Yes, sir. >> Okay. I see no problem with it. All right. >> Did you graduate from high school? >> No, sir. >> So, what grade are you in? >> Uh, I dropped out and I was trying to get my GED, but I really haven't been trying. I've been busy with work. >> Where'd you work at? >> Uh, I do landscaping. Me and my dad work as a landscaping and [ __ ] like that. And he's doing more work now, but the season slowed down. So, >> all right. So, what was the last grade you completed? >> Senior. >> Senior year. >> I dropped that. Uh, >> dropped that your senior year. >> So, you completed 11th grade? >> Yeah. Junior. >> All right, man. You don't mind right there for me? >> Right here. [clears throat] [clears throat] >> All right. Now, that's Do you have any idea why you're here? Not necessarily. They just before they took me in, they said I was a suspect of a crime. >> Okay. >> That's all they told me. And they didn't tell me much more. >> And what? >> I don't know what they what crime they're >> talking about. >> Talk about. Yeah. They just told me crime. That's all they told me. >> You haven't seen anything on Facebook, Instagram? >> No, I don't. I only be on Instagram to text. I'll be on Snapchat to text, too. I don't be on Facebook. Only time be on Facebook. It's marketplace. Just bouncing around. >> Okay. Um, so do you know Darren? >> Uh, Darren? Yeah, he's one of my homies. >> One of your homies. How long have you known Darren? >> I knew him for about a year. >> A plethora. A bunch. A search warrants. We've interviewed a lot of people. And you're one of the last people to serve in this interview room. So, I'm going to give you the opportunity to be honest with the both of us and tell us the truth about when you saw Darren last when you talked to him last and the nature of your guys friendship. Okay. All right. Please don't. Okay. So, what's going on? >> So, last time I seen him was actually which yesterday. >> Okay. >> Yesterday when he got off work. >> What time was that? >> Around 3:30, 3:40, 4:00 around there. >> Okay. >> Somewhere around there. I'm not good with time. And after that, we picked up one of my other homies, Vincent. >> Vincent. >> Vincent. We picked up [clears throat] Vincent Rally. And then we went to one of my other homies. Went to his crib. Me and kind of got into an argument and said that we're so stupid. But we talked out. We worked it out and like that. I said that. Last time I seen him was after he dropped me off, which is around 5 actually around 5:36. M he dropped me off around that time. After he dropped me off, I was chill out my crib and then after that I was chill with the girl. [snorts] >> After you chill with this girl, what did you do? >> Nothing really. Just mainly with my brother at the house. >> So at 1:00 chilling with the girl, what time did she leave? >> She left by like 1:30. >> Then >> I dropped her off. >> Mhm. >> You dropped her off? Yes, sir. >> Where'd you drop her off at? >> Her house. >> Where's her house? >> Uh, it's over there on I can't remember the name of the street, but it's over there by Road Walker. >> Okay. And then after you dropped her off, what did you do? >> I went back to my house. >> And then you stayed there for the rest of the night. >> Yes, sir. >> With your brother? >> With my brother and my dad. >> Who's your brother? Your brother is >> I took off around like again like 5:00 in the morning get my dad some donuts and milk and me a bag of chips and a drink. >> And where did you get donuts milk from? >> Allips on uh Mayberry and Sigar. >> That was at 5 >> around 5:14 5 somewhere around there. >> Okay. [clears throat] And that's the truth. Or are you still leaving some stuff out? Because I see that before and I still think you're leaving some stuff out. >> No, sir. >> How about uh about a week and a half ago? Did you buy ammunition from Burns? >> Oh, yes sir. I just made my day on the outside. >> That's okay. What kind of ammunition did you buy? >> Uh I bought 9 millm rounds. >> You got 9 millm? >> Yes, sir. I bought it for a friend. >> Okay. Who friend? >> Sorry about that. >> That's all right. So, you bought uh which one of them are who uh like he told you, you know, we've we've done we've talked to a lot of people, you know, at this point. I would hope that you're picking up that we know a lot more than you think. Okay. So, we know about this ghost block that Darren had. Okay. >> Um you guys go and buy Well, you go in and buy 9mm ammo. >> Yes, sir. >> Is that right? >> Okay. They wanted 9 mm rounds for your gun. So I >> Who did? >> They he wanted a 9 mm round for his gun. I said, "Okay, it's not I didn't see much of a big deal with it because >> um now he's like that. I'm going to buy him something like that." But >> what what was going on around that time that you guys wanted to buy this 9 mm ammo for? >> Just go out shooting. just gone on the range shoot cuz I have my aunt or he has somebody else he knows too I guess. >> Okay. >> And we go out there and shoot. >> Do you uh remember talking about getting a silencer? >> He talked about wanting to get a silencer on. He wants to get a barrel for his gun. And I told him that's up to you. It's his gun. >> What? What can you describe the gun? >> Uh it's it's built. It's fully built like that. It has a bottom. It bottom is black and the top is like a yellow yellow looking kind. >> Mhm. [clears throat] >> And that's really all I know. It has a twisted burl. >> Okay. And did you guys make some kind of trade at some point? >> No, we I made a trade with somebody else, but then we traded back and I that's about it. >> Okay. We've talked to all those people and we already know about this plan. Okay. and they've thrown you under the bus pretty much. So, at this point, I mean, there's >> he talked about like stuff like that, but >> stuff like what? >> Like stuff like wanting to do stuff. I really don't really know much about it, but he was talking about wanting to do different things. >> We know everything at this point. >> Yeah. And I really I really wasn't really much into it. I'm like, that's a bad idea cuz I'm not that type of guy. Yes, I love my guns, but I'm not that type of guy. >> And what did he ask you guys to do? >> He asked us to do him a favor, >> which is >> kill somebody. And I'm like, I'm not doing that cuz I'm not a killer myself. I don't have the guts to courage to do that. >> Kill >> kill his parents, I guess. I don't know. >> You know, man, just be straight up. >> He told us he wanted to kill his parents. I'm like, I'm not doing that cuz that's not something I would do. >> What? How long ago did he come up with this? >> He came up with it about two months ago. >> Okay. >> How much did he offer you to kill his parents? >> He was trying to offer me money about I can't I don't remember how much. We He offered me something and I just declined him. >> He was talking like 100 bucks,000 bucks. >> Few hundred >> few hundred bucks. >> Few hundred thousand. >> Few hundred thousand. >> Where you going to get that money from? >> I don't know. That's that's why I'm like no cuz like he has a job. He only makes maybe like 800 two weeks every two weeks. So I'm like I don't know. No, I'm not doing that. Even for that much money, I wouldn't do that. Go throw my life away and drink. [snorts] >> So he did try to broker a deal with you to kill his parents. >> Yeah, he tried. [snorts] >> And you said no. >> Yes, ma'am. >> Okay. But his parents somehow end up dead anyway. >> His parents are dead. >> Don't Don't >> I know. I promise you I don't know anything about it. >> No, I I don't play down with this at this point. Okay. >> I know he was talking about it, but I didn't know his parents were dead. >> Yeah. And he's here and he told us your part. So, we just want to know when he asked you to do this, how he asked you to do this, and whether you just kind of went along with it, or did he orchestrate this whole thing? >> What do you mean like went along with it? like if I went with it, just like act like I was cool with it. >> I mean, I really didn't say much about it. I mean, it's his idea and it's not my idea. It was his choice. I didn't do anything really much about it. I just kind of blew it off. >> How How did he say it should happen? >> He tried to say like how it should happen is we break it. Well, one of us break in and all this stuff stuff and just do it and then try to rob stuff and like that and then make it look like a whole big accident coincidental like try to say, "Oh, go in there, rob stuff. Go in there, shoot them, go and then come in my room, make it look like you did this." >> How you got in? >> The garage door was open. Okay. And was he messaging you when to come in? >> No, ma'am. >> He just told you he was going to leave the garage door open? >> He really didn't tell me nothing. Like he he didn't tell me he was going to leave the garage door open at all. >> So you just went in? Just >> kind of guess. Okay. >> Did he know when you were coming? >> No, ma'am. But you did in your in the garage at the camera for the shows. >> I did in in the garage. >> And then what did you do? >> Honestly, in my opinion, I should have never did anything. I should have just walked off. >> I understand that. >> I was there for a good 10, 15 minutes. >> Can you tell us what happened when you were in there? >> I was I mean, I I held the gun against my own head debating it cuz I didn't want to do anything. I was scared. I >> was daring up. >> I don't know. I don't know if it was up or not. >> So, you had the So, whenever you're walking up to the garage, we hear you get it ready. And you did you know where to go? >> No, ma'am. >> So, how did you find your way? >> I was looking around and I heard people. I heard them and I'm like I was still looking around for a second and after I heard them I walked in there and I was in there for like 10 minutes. Didn't know what to do. I was going to run off and just leave it alone. >> Did you end up doing it? >> Yes, ma'am. Now I feel guilty about it and I I don't know. >> What were you thinking? >> I wanted to kill myself. That's what I was thinking. Was the gun that was found in the car with you the gun that you used? >> Yes, sir. [snorts] >> Have you talked to Darren since? >> No, sir. >> Darren, he he wanted that gun back and he wanted to keep that gun for himself. >> So, what was the plan like after it was done? Like what was what was the next step? >> I didn't know the next step after it was done. Where did you go afterwards? >> I just ran. >> Where'd you run to? >> I don't know. I just running for a while. I forgot where I was running to. I just went blank. >> How did you get there? >> I walked >> from where? >> I was I walked from Hillrest. >> And you want to tell us? Darren is another thing because Darren he also said if he also said that he would kill me if I didn't do anything. >> So you were scared? >> Yes. That's that's really what it was too. I was scared cuz I didn't want to >> Did you see him this morning at all? >> No. >> No. Do you know he called 911? >> No. Did Vincent play any part of this other than volunteering to do it if you didn't? >> Uh, not that I really know of. I know he wanted to do it before anybody else. >> Two people were killed after a call that initially sounded like a burglary. The central question for investigators became whether that call was the beginning of the emergency or the final step in an alleged plan. The defendants are presumed innocent unless proven guilty in court. Stay vigilant. Stay recorded. This is badge files.
