The deputy now reads her rights before asking whether she wants to talk. >> I was on my way to surrender myself and I have proof. >> Okay. I'm going to read you your rights before you say anything else, okay? >> Okay. I know my rights. I have the right to remain silent. Blah, blah, blah. I just got arrested the other day. >> [snorts] >> You're pretty good. Well, let me read them from here, okay? You have the right to remain silent. Anything you say can be used against you in a court of law. You have the right at this time to talk to your lawyer and have him present with you while you're being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you before any questioning if you wish. You can decide at any time to exercise these rights and not answer any questions or make any statements. Good. Do you understand each of these rights I've explained to you? >> Yes. >> Negative. You can disregard. Thanks. Um assuming YCD's behind you, they can take care of the the rest. Okay. Having these rights in mind, do you want to talk to me? >> Uh yeah, I don't mind. I was coming in to surrender myself. I wanted to. >> Okay. >> I was coming to get me gas, to bring it back to come >> you in just a sec, dear. >> to come get it done. That's why I would like my phone is because I was talking to my mom about this, not my birth mother, who I'm sure has custody right now. Uh But, um because we're trying to get everything figured out. >> That's fine. And listen, I want you if you want to give your side of things. They are happy to hear that. The Yakima Police Department is the one that's handling it. I'm with the Sheriff's Office, okay? >> Okay. >> So, they're going to want to chat with you and get your side of things. >> Okay, well, they're still going to have the dash cam footage, so. >> They're going to what? >> They're still going to end up getting the dash cam footage probably from this case. >> Oh, yeah, I'm sure. >> So. >> Yep. All right, so just let's lay low. Do you need anything or >> I need my phone. >> And that's in the car? >> Yeah. >> That's what you're holding in your hand? Is that your phone? >> Yes. That's my phone. >> Okay. >> I I need to call my um lawyer while I'm up here because I don't have cell phone service. >> Yakima Selah State no look industry yards. >> And then my key will be going so that my car is not impounded. >> Okay. A witness now describes seeing her drive around the resort earlier that morning. >> How are you? >> Not bad. >> What's going on today? >> I don't know, dude. I mean, I got a phone call earlier this morning saying she was driving around the park. >> This gal? Oh, okay. >> And we have most of her clothes out. >> Got you. >> go there, you know, but she was driving in a circle and the lady told me that she was down by the dumpsters in our park for a while. >> Interesting. >> And then, I didn't think anything about it, you know, and the girl that usually opens up her own, she's not open today, and I don't know why, but I walked up to check the mail just now, and 2 minutes ago, and she was parked there, and I read the back of her car, and she just said that she needed somewhere where she could use a tap-to-pay card. >> Okay. >> Almost everywhere has those. >> Right. >> You know. >> Yeah. >> Us being closed, I don't know why she didn't go on. And she's still out there. >> Yeah. >> Um >> Yeah. >> So, I wish that someone would come and find out what's going on, if something happened. >> Yeah, it's a Yakima police case. I'm not sure how much info they'll You'll see it on the news, I guarantee it, but >> Oh, that bad. >> It'll be a little bit, yeah. >> That dude. >> So. >> I'm sorry. >> But we will uh YPD is taking the car. We have a tow truck coming, so it'll be a little bit. >> Okay. >> Yep. >> Okay. I'll just have to have to know. >> Yep, we will get it out of here on a tow truck as soon as they get up here, and we get a tow truck up here. >> All right. >> Back in the patrol car, the argument turns to her vehicle. Police intend to keep it as evidence. >> Bro. >> What's that? >> Um so, I I hear you say yes to um me getting the key. Just don't [ __ ] me, please. Just be honest. If YPD is taking the car, um I would like to know if it's going to be impounded or not. >> Yeah, I believe their plan is to impound it, just so you know. >> Okay. So, I would like to know to get it from the impound lot. >> Okay, I will >> Just don't Like I I am I'm not I was >> I'm learning uh what's going on here just as much as you are, okay? >> No, you're not, but >> So. >> You're in control of the situation, so you get to lead, and you get to lead with honesty, as I am trying to do, too. >> Well, let me be honest with you, okay? The Yakima Police Department requested a tow for your vehicle for evidence, so they're going to be taking that, probably to apply for a search warrant for it, okay? >> Okay. >> So, that's if we're being fully transparent, that's what's going on. >> Okay. Well, we can also have the key and it can get a search warrant from her. Can it not? >> No. Because we keep what's called chain of custody. >> Okay. Well, I >> going to let a stranger take that car and do whatever they want with it in the meantime we apply for a search warrant. We maintain it from the time that it was stopped the investigation until the time we do our search warrant, okay? >> And what about the items that I like to keep special in the car? >> Yeah. Like the Was that your baby's bracelet? >> Um no, not particularly, but >> What was that? >> Everything in that car is special. >> Okay. >> And everything is put in place. >> Okay. >> Um I do have marijuana in the side door. Uh that's the only thing that I know is in there. Um and that was part of my uh testimony that I was coming in to have done. >> Fair enough. >> I was I have recordings by the way on my like I I was sending them >> Like I said, is it Kylia? >> Uh I'm just gabbing to you at this point. I get it. >> everything you say to me >> I know and everything that I say to you will be everything that I say to anyone else. >> Fair enough. >> So, more I say it, the more it is. >> Sure. Well, uh White PD is going to love to hear what you have to say and they're almost here, okay? >> I know. >> [snorts] >> I wanted to come surrender myself so that I wasn't put in handcuffs, you know, and dragged around. >> Nobody dragged you around, ma'am. >> Well, girl, you kind of dragged me out of the car a little. >> Well, I told you to step out, okay? >> I know and I was getting my recording for my uh thing. >> after I'm giving you lawful commands to put your hands behind your back. You're lucky you didn't end up on the ground, okay? So, >> I'm aware, but at the The time I do deserve the right to have my own video for my >> No, you don't. If you can tell me what right that comes from, then I'm all ears. But, ma'am, I've been doing this job a while. There's a camera right here facing you. I wear a body camera. All right, so let's not play those silly games, okay? >> Yeah. I am all for police, but body cameras are easily Now, do I get to Well, I get my lawyer. >> What's that, ma'am? >> What? >> What did you say? >> I get my lawyer, but I need to talk to my mother about my lawyer. So, I request my >> You can work through all those things in the near future, okay? >> Okay. Well, I need Wi-Fi to do that. And I'm saying that now, cuz I'm not going to be put in a place where, you know, I am left. >> So, what's going to be happening? I know she wanted you guys that How are you guys involved? >> These are just my friends. They were just with me when I found out and they just went with me because I was rushing to get here. >> So, YPD is going to be taking her. Obviously, you could probably have an idea of what's going on here today. The car is going to be going with them as well on a tow truck for evidence. >> Okay. >> Um so, you guys aren't needed up here. They do want to talk to you guys at the police department in the city of Yakima. Do you know where that's at? >> I don't. >> Okay. Uh do you have a phone or something you guys can write with? 200 South 3rd Street, the Yakima Police Department. >> When? What time? >> You guys can leave here and go there. Do you guys have an idea what's going on? >> I'm not at work. >> You have work? >> Yeah. I'm supposed to be at work at like 3:00. >> Can your bosses make an exception for you for a little bit and you can tell them the YPD and the Sheriff's Office needed you for an investigation? >> Yep, I can do that. >> I can even give you a business card if you want, okay? >> Is it 200 South 3rd? >> 3rd Street. That's the Yakima Police Department. >> Okay. >> Yeah, they're going to want to know what you guys have to say and maybe what she told you and all that. So, if you guys can leave here and go there, I'll let them know you're coming. >> Okay. Yeah, can I go home and put on a different shirt? >> Yep, take your time. Are you going to be You're this? Okay, sounds good. Thanks. >> Yakima police take over. Another witness helps establish when Tolly arrived and what she said she needed. >> Officer Hamlin, I obviously work for YPD. I'm wanting to see what you know about that car that that was sitting up there today. Did you talk to that young lady at all? >> She's been here since like at least 6:00 a.m. She was just circling. >> Okay. >> And >> So we were like, are you lost? Like cuz they're kind of hard to read the numbers. >> Sure. >> She said she was out of gas and couldn't get reception. And then she just parked. >> Okay. >> She'd been parked there since like 6:00. >> Really? >> Yeah, it's been all day. >> When you said circle, did she circle in her car or circle on foot? >> Car. >> Okay. And then just you guys told her that she could get Wi-Fi there and she parked there and stayed there? >> "I want to know more about staying here." And I said, "You don't you need to go up to the store." And I said, "They have Wi-Fi there if you need reception." >> Got you. >> And the password's right in the door. >> How are you? >> I'm good. >> Good. And that's really your whole interaction? >> Yeah. We were kind of keeping an eye on her just cuz no one knew her. >> Would you have it on your doorbell cam there? >> I can check. Do you want to go in the house? >> Yeah, that timeline of when she showed up would be awesome. >> Yeah, let me go back to >> You guys' interaction with the camera. Was she here for very long before she came up and talked to you guys? >> So, she came through at like 6:00. She left. She came back through. She tried to go that way. It's blocked off. She left. She came back. And then nothing. >> Okay, so she was here several times. >> Tolly later pleaded not guilty to five felony charges including manslaughter, criminal mistreatment, and family abandonment. That plea was reported in March 2025. We have not verified a final court outcome. The arrest footage and the allegations are not a finding of guilt.
