I'm not drawing down on you." >> I see. So, you did your job. You did you did your job pretty much. >> Correct. I didn't walk up with a gun up. I'm comfortable with someone having a gun. That's your That's your second amendment right. I have no problem with that. >> That That That's my main focus was that a firearm was drawn and pointed at me. And I wouldn't >> Let me see. >> I said I wouldn't let go. That's the only thing I can't >> Let me Let me >> The tackle was fine. The I could have gotten a few cuffs in my face, it would have been fine. But the firearm pointed at me, I'm not going to let that go, bro. >> Let me continue. So, I walk up. I start giving you commands. I say, "Let me see your hands." You're not listening to me, okay? >> Right. >> Then you take your vehicle out of park, say you're not getting out when I tell you to get out, and you start driving. >> Right. >> And then you stop again. And then was pointed at you. >> Yeah, cuz we were we were going to go to our cars cuz we were taking off. >> All right, but I exited and a gun was pointed at me. That's my main focus. A firearm was pointed at me and that's the only thing I can Everything else that you guys did was right except pointing a firearm at me. >> I I'm I'm legally allowed to point a firearm at you. >> Right. No, unlawfully, no. No. No. That wasn't That was unlawful. You can't point a firearm at an unarmed civilian, are you? >> There's a gun sitting right next to you. >> In my vehicle. I'm not armed. I didn't point a firearm at you. >> And also, you have one >> Did you Did you search me? Did you search me? >> Yes. >> I find a firearm. Did I point a firearm at you? Did I come with a cutlass or a knife at you? Did I jeopardize his safety? Did I jeopardize his safety? >> I can 100% >> I did find a Okay, you may be dead at funds, but I did basic. But at an unarmed civilian, it's wrong. >> I don't know if you're armed. You're sitting in your car. You step out like you're going to >> Oh, was anyone's lives in jeopardy or safety? >> Absolutely. You ran across the road. It could have got any of us killed. >> Right. >> You have a firearm sitting right next to you. >> Right. >> When you got out, did I not put my gun back in my holster? >> Oh, no, it was pointed at me. That's what I recorded. I recorded it. >> I put my gun back in my holster once you started moving. But I can absolutely give you commands with a firearm drawn. >> Oh, no. No. No. That's unlawful. That's unlawful. Yeah. >> Enlighten me on the law, case law, any of that. Let me know. >> All right. All right. But >> I've been doing this for a significant amount of time. I know what I can and can't do. If I was worried, I would have came up gun drawn and called you out of the car. I did not do that. >> Right. No, it was pointed at me. Having a firearm drawn is different than pointing it. >> From the immediate time I got there, I could have I could have If you >> I I didn't mean to spoil the day. So, you have a wonderful day, sir. >> doesn't bother me. I get paid the same either way. >> You You have a wonderful day, sir. >> I'm not going anywhere. >> All right. >> But I can 100% pull my firearm at you. What you did was not necessary. It It was just quick as getting out. >> I I was wrongfully arrested. Uh there was malicious prosecution. Uh I was pointed A firearm was pointed at me. Yeah. Yeah. Yeah. Malicious prosecution. Yeah. >> We will see how this goes in court. >> I'm listening to you. Yes, sir. >> I promise. >> [clears throat] >> From my uh >> He was with resisting or obstructing officer without violence. He spent just one day in county jail before bonding out on $1,000. He was sentenced to 6 months of probation along with fees, court costs, and an order to submit an apology letter to the deputies involved. His probation officer later filed a violation after determining that the letter showed no remorse and he still owed $170 in supervision fees. According to the probation report, he told his officer that he refused to pay the supervision fees because he believed he had been illegally arrested and the state should be responsible for paying them. He was arrested again on violation of probation and released on a $200 bond which was eventually applied toward the remaining balance and satisfied his probation requirements.
