On August 11th, 2024, an officer in Western Kentucky executed a warrantless arrest of a mother who admitted on camera to striking her 17-year-old daughter in the mouth during a household argument. [music] This analysis focuses exclusively on the legal architecture of that encounter. >> [music] >> What is going on? Can you describe what took place? >> [music] >> Do you have anything to add to what I already have here? >> I'm sure about what's going on. >> [music] >> What would you guys tell me what what's going on? >> We had >> Or what happened? >> We we were just arguing, got into a verbal argument, and she was up in my face screaming at me. If you do this, if you do that, you're not going to tell me what the F I can do or what I can't do. She was mad cuz I told her she couldn't go to her boyfriend's house anymore because when she went, she never came home. Came home at 5:30 in the morning. And then tries to tell me that she did nothing fucking wrong. She just fell asleep and to get the fuck over it. No, ma'am, we're not going to act like this. You're not going to do that. You're not going to talk to me like that. She gets in my face, refuses to go back to her room, puts her hand up like this like she's going to Go to your room. She continues to get up in my face even more [clears throat] like her nose is touching mine screaming fuck you, you're not going to tell me what the fuck to do. And so I popped her in the mouth. I sure did. I kids not going to talk to me like that. >> She was already upset at me because um I been gone with friends all day. She claims that I didn't tell her I had plans which I did, but that's besides the point. Um so she was already in a bad mood and then um my friends both left the house that night and then she asked me to go find her a wireless charger. And she wanted me to go downstairs and get the one from my grandmother and I told her hang on, let me check my room. I did have one at one time. If I told her if I didn't already give it to you, then I'll just go downstairs and I'll grab it and then if not, I'll go downstairs and get the other one. So I'm in there and look sorry. I I just walked all the way across the room. >> No, it was already going >> Anyway, um went in there and looked. I didn't have it anymore. So I told her I was like, okay, yeah, you're right. I don't have it anymore. I'm going to go downstairs and get the other one. Went downstairs and got it and then came back upstairs and she started arguing with me saying I never gave her another one to begin with and I told her I was like wasn't anything recent like I've had that thing for years. Not a big anyway. She started arguing with me and I was like I'm not doing this. I'm going to bed. I shut the door and I I shut the door and I walked out and then she accused me of slamming the door, followed me into the kitchen, continued screaming at me, getting in my face, asked for the back up and then um that's when she started getting a little more violent which doesn't normally happen. She started pushing at me and then she hit my glasses which I'm pretty sure is what caused that but it was hitting my glasses. And then she did end up popping me in the mouth at one point which caused my braces to stick right here on my mouth. And then um continued screaming some more. My grandma came upstairs and then she just completely backed off and went to her room and I went to my room and then that was the last of it. >> So when you said she became more violent, what what do you mean by violent? >> the pushing and the hitting. >> Okay. And when she hit you, how how did she hit you? >> I think it was an open hand. I think it was meant to be a slap but I also wasn't looking at her hand. I was looking at her face. >> I apologize. >> But I was looking at her face not her hand so I don't know for sure. >> So do you you know about how many times she hit you? >> I know it was at least two. I but it wasn't I know for a fact it was not more than three times but I like I said >> So two two to three times? >> Yeah. >> So I I was I I see this this here you said there was a place in your mouth. Was there any other >> No. That was it. And this is mostly healed up now and you couldn't really see it to begin [clears throat] with. >> Yeah. >> But >> So was this I hate to say normal but I mean is this a regular occurrence or because the who whoever called like I said was >> [music] >> That's pulse trying to come in. Um was concerned about your safety. And said that this is a kind of something that reoccurs and so our dispatch was trying to look at calls for service and that you know that they have had calls uh complaints about that in the past. >> Yeah. Most there was only I think one complaint in the past and that one wasn't on her. That was my stepdad but he's gone now. But um she's never gotten violent like that before. Um her not her getting little erratic and screaming that Erratic is that the word? >> Mhm. >> I don't think so. >> Mhm. >> Erratic. >> I got it. Yeah. >> Erratic. >> Her screaming on that guy is more normal. But as far as actually hitting them >> So and and I'm just trying to figure out what her mind frame would be and like to your knowledge when this occurred would she have been in intoxicated or on anything >> a fact there was no alcohol in the house other than [clears throat] my grandpa's beer but she does not drink beer. And as far as any kind of other substances I don't know. >> Okay. >> I try to mostly stay away from her anyway. So >> What what was that if you don't mind me asking? >> She's really snippy towards me always. Um we have a few good moments a month and then other than that it's just always a bad attitude or screaming at me for something and so I just stay away from her. >> Okay. So you It's my understanding you live in the same place same house as your grandparents? >> Yeah. >> So who who all lives in the house? >> Um it's me and my mom and 12-year-old [clears throat] little sister, 8-year-old little sister and then my grandma which is her mom and then her stepdad. So step grandfather? >> Yes. Okay. All right. Dragon now. That's all right. My my wheels were turning. They're slow sometimes. Um Who Who all was in the house when this happened? >> Um me, her, and then both our grandfathers. My little sisters were with her then. >> Both Both little sisters were not there? >> No. >> Okay. Did Did anybody else see it? Just maybe grandma heard it and kind of come in >> She heard it. >> Put a stop to it. Okay. >> Cuz she was already mostly awake anyway. She was already downstairs and did that charger. So. >> Okay. And Do you remember the social worker's name again? I'm sorry. >> Michelle, I think. >> Okay. >> I think that's what she said on the phone. I'm not positive. >> Did Did she leave a number? Did she call? >> I have the number she called me off of. >> Okay. May I get that? >> Yeah. Um 270 943 9590. >> And do you have Is your mom like you said she just left the house? Like do you like the Life360 or something? Or how do How do you know where she's at? >> Yeah, I have Life360 and we have Find My Phone. >> So you think she'll be going to work or where? >> She's at home right now. I really don't know where she's going, to be honest. It says she's at the Minute Mart right now. That's all right. >> Okay. So You seem to me You're You're 17, right? You seem to be very intelligent. Uh you seem to to to have it together and be very mature, okay? So um I'm not one to really like beat around the bush or or try I mean like you seem super intelligent for your age. So I'm just going to be honest with you, okay? Um And and I hope you know that it's not okay for a parent or anyone to to hit you like that. >> I know. >> Okay. Um so that being said um sometimes this could put you in a bad situation. Okay? But by law, there are actions that I have to take because at the end of the day your safety is more important to me than my life. All right? So I'm going to do whatever I can do to keep you safe and to keep your two little sisters safe, okay? How many times did he hit you? >> Just once. >> Open hand, closed hand? >> open hand. I just popped her in the mouth. Said, "No, stop. All right, told you about your mouth. You're not going to talk to me like that." >> No. >> And then she's literally in her room and my mom comes upstairs and she's in her room screaming bloody murder, throwing shit around like I'm killing her, screaming, "Don't touch me. Get away from me." And I'm nowhere near her. I'm in my bedroom. She's in her bedroom. And my mom is sitting in the middle in the living room going And she had to "All right, you need to calm down and chill out." Like she was out of control. >> No. Oh, did you know of a place or anything when that happened? >> No, I didn't. >> Who Who else? Was there anybody in the room when it happened? >> No. No, my mom didn't come down until after. And she finally went down. >> Okay. And I guess this is your your mom out here? >> Mhm. >> Okay. All right. Well, I'm I'm going to slip out and talk to her real quick, but while I'm waiting, do you have a your identification with you? It's in my car. Okay, listen. I'm going to be there. All right. >> I'm out of my driver's license and I'll let you want to >> Well, listen. I'll I'll get it in just a minute. I'm going to go over there and talk to her and see what she says. She hit her one time? That's it? >> Yeah, just one time in the mouth. I told her, "Stop. You're not going to cuss me like that. You're not going to talk to me like that. You're not going like she was body bumping me. Like she was bumping me. Trying to fight. And I kept telling her I'm not fighting with you. Like that. Like I'm your mom. >> How did she get the black eye? Was it on her >> She has glasses on and she would put her arm up like that and she hit him. I didn't go anywhere near her eye. But she was crying about her glasses. You're going to break my glasses, that's what she said. But I didn't even touch her. I didn't go anywhere near her eye. I popped her in the mouth just like that. >> Okay. So, so your mom come up there after it was over with and all that? >> Well, we screaming like I was killing her. Screaming don't touch me, get away from me and I wasn't even near her. in the bedroom with her and I was in my room. Across the house. >> Okay. All right. Well, how do you say I'm going to go talk to her real quick and then I'll be right back. Is that okay? >> Yeah. >> I'm just going to sit with her real quick before I come back. Is that all right? >> [clears throat] >> Ma'am, what what can I call you for short? >> Caitlin. >> Caitlin? >> Caitlin. Cait- Caitlin. >> Caitlin? >> Caitlin. >> Caitlin, okay. So, what what happened the other day, I guess 2 days ago when your daughter and your grand daughter got into it? >> Oh, yeah. I don't know. I heard them but I don't know what happened. >> Okay. So, you didn't say anything? >> I didn't say anything. I didn't really say anything. >> What what did you hear? >> Both of them yelling at each other. [clears throat] >> Did it sound like any any either one of them started it or could you tell? >> I couldn't really tell. I heard Caitlin first at the top of her lungs, but I couldn't understand what she was saying. Yeah. But I I understand what she was saying because we live downstairs. >> Okay. And they live upstairs. So, I couldn't It wasn't all going to be for me to understand what she was saying. >> Do you want Do you have your other hand just like me jump down to speak with you? So, did Did you see the the cut in her mouth and the her swollen eye, your grandaughter's? >> No, I didn't. >> What's your phone number, ma'am? Okay. Yeah, thank you so much. >> You're welcome. >> Thank you so much. >> You're welcome. >> The charging statute is Kentucky Revised Statutes Section 508.030, assault in the fourth degree, a class A misdemeanor. The elements require intentional or wanton causation of physical injury to another person. The mother's recorded statement, quote, "I popped her in the mouth. I sure did." satisfies the intent element directly. The injury element is satisfied. Kentucky Revised Statutes Section 500.080, subsection 13, which defines physical injury as substantial physical pain or any impairment of physical condition. A cut lip and visible facial swelling meet that statutory definition on their face. The mother's only viable defense is the parental discipline justification under Kentucky Revised Statutes Section 503.110. That defense imposes two cumulative requirements. The parent must believe the force was necessary to promote the welfare of the minor and the force must not be designed to create a substantial risk of death, serious physical injury, disfigurement, extreme pain, or extreme mental distress. The second prong likely favors the mother. An open hand slap producing minor lip injury does not rise to serious physical injury under Kentucky law. The first prong is where the defense collapses. The mother framed the strike as a response to verbal disrespect. Quote, "My kid's not going to talk to me like that." That is vindication, not welfare promotion. Kentucky case law, including Commonwealth versus Craig, restricts the defense to good faith disciplinary purpose. Retaliatory force triggered by being cursed at falls outside that purpose. Next, the probable cause analysis. Under Beck versus Ohio, probable cause exists when the facts within an officer's knowledge would warrant a prudent to believe the suspect committed an offense. Here, the officer possessed visible injuries on a minor, a corroborating witness statement from the complainant, and an unprompted detailed admission from the suspect. The probable cause foundation is overwhelming. The constitutional authority for the workplace arrest comes from Atwater versus City of Lago Vista, which holds that a warrantless misdemeanor arrest in a public place is reasonable under the Fourth Amendment whenever probable cause is established. The Miranda question deserves precise treatment. The mother's extended admission was given before any custodial restraint. Under Berkemer versus McCarty, Miranda warnings are required only when a suspect is subjected to custodial interrogation. Workplace questioning of a non-detained suspect is not custody. Every statement she made before the officer announced the arrest is voluntary and fully admissible at trial. >> The next witness >> [clears throat] >> This one? >> Mhm. >> That would make it a little more serious since she does have a bad cerebral traumatic injury and through her face and then you hear him say >> I didn't like wham hit her, I just popped her. That was it. It wasn't a oh my god I'm going to knock her clear across the house or whatever. No, it was not that serious at all. >> So what what was her injury? What >> I don't know. She was in a car wreck last year in November. Um she was T-boned at 70 miles an hour and it basically split her in half. It crushed her pelvis. She has five screws holding it together. Fractured her spine in the bottom in two spots. Um >> Was it >> [music] >> accidental or >> Scott's Ford >> Longreen Road out there. >> with three girls. She spent a month in Vanderbilt after the year. Cuz I mean they just were fractured her pelvis, they wouldn't let her walk. She wouldn't even want to get out of bed. Because of that she's been babied and gotten away with all this stuff that she probably normally otherwise wouldn't have. You know, a little bit more leniency is cuz she died. I mean they brought her back. They had to give her three units of blood before they put her on the helicopter. >> So >> [clears throat] >> so much you don't hear here's kind of the predicament that I'm in. Okay? Uh I obviously wasn't there and I'm not God so I don't I don't know what happened, okay? All I can do is make the best judgment call that I can make. >> Okay. >> All right? And at the end of the day people way more smart smarter than I am make way more money than I am make make these kind of decisions, right? Okay? But at the end of the day, we received a complaint um that she had injuries. Um I went and verified that. Okay. Um like I said, I I wouldn't I don't know if she she chest bumped you or or whatever. I went and talked to your mom. She didn't say that she wasn't there. She was just there for the aftermath. So, I have no witnesses. All I have is a 17-year-old with some facial injuries. Okay. >> So, are you going to give me to jail? >> Yes, ma'am. That being said, I have no choice whatsoever. The law gives me no no choice whatsoever. So, that's what I'm saying. I have no um I I I don't make the final say. I just can make the best judgment call that I can here, okay? Like you you have no injuries that I can say you you know, complain. You said she didn't hit you uh and she has two two facial injuries. Um uh minor injuries, yes, but >> No, she did do it herself. You got what she put her hand on with her with her glasses. That's what caused her black eye. And it's >> Well, like I said, that that that's somebody that's that's, you know, got way more education and money than me that makes that decision, not not me, okay? So, with [clears throat] that being said, um I just need to get you to stand up turn and put your hands behind your back, please. >> Can you do this to my arm? >> Yeah. >> Don't hurt me like this. Like I think I'm going to cry in a minute. >> I want you to like Put your hands behind your back. >> Tell her the kids get off the bus. Can I call them now? >> They're going to go to Nance's house tonight, right? >> Yes. >> Okay. >> What time are they going to say what time they are? Just don't talk to me, please. >> Ma'am, we're just trying to make >> like that. >> We're trying to make sure that your kids are safe. >> They are. They will be there at 5:00 when she gets off of work to get them. >> Okay. I understand. So, the best thing you you do when we're trying to help you is stay calm and not lash out at us. Okay? >> You're not helping me though. You guys are not helping me. >> Well, I'm doing what the law requires me to do. >> What's their last name again? Is it young or is it somebody else? >> Martin. >> You said that's William's sister. >> Yes. >> Now, do you have any weapons or drugs on your person? I have to ask. >> No, I don't. >> Okay. Cuz I'm going to pat you down the best that I can as a female, but they're going to check you at the jail when you get >> I don't have anything. I have absolutely nothing on me. >> Can I finish? >> Yeah. >> Okay. Not to say that you would, but if you take anything inside of the jail that's a felony offense. >> Okay. I don't have anything on me. I don't have anything on >> I just have to warn you. That's it. All right. >> I literally have nothing. >> Okay. That's fine. I just You got your check. >> You can do anything you want to do with me. You can do anything >> No, listen. So, we'll give this to your mom outside. Did you get everything you needed to get? >> Yes. I want to talk to her when she gets out early next week. >> Do you have a business card by chance? >> I won't get out until early next week? >> No, I'll talk to you early next week. >> Oh, I was like, oh my god. So, you guys do know that give me my which is exactly what she wanted to. She's still with her boyfriend's house tonight and probably not coming home all day on the weekend. It's perfect. >> So, so you're blaming me for what happened last night? >> It's perfect. Y'all have no Y'all know what I'm saying? >> I guess we're done today, so >> Well, okay. Wait, I gave you all my information, cell phone Y'all people Y'all >> Okay. All right. Perfect. Thank you so much. >> Thank you. >> And I'll I'll be doing the jail search there so I'm sure to come through but you've already got all that stuff. >> Thank you. >> Ma'am. >> Yes. >> Cut the fucking shit. >> I'm I'm just saying this is ridiculous. Like Yeah, I feel like I'd beat the hell out of her. I really popped her in the mouth. Yeah, I was asking her to >> I mean this is like you were going to you were going to pop me in the mouth? >> I mean if I'm up in your face screaming and cussing you and saying fuck you, I'd expect it. Yes, sir. >> Well, I don't respect this attitude. >> Okay. Well, take me to jail. Yeah. They're taking me to fucking jail. Because of you they would have done the same thing to me, right? >> Yeah, you shouldn't have hit her. >> Thank you. All right, how long do you need her here? >> I'm going to call the jail. >> I don't know what to do. This is not okay for her to just run off the cameras now because that's what you're on. >> 321 going. >> You want to play little miss innocent? She did nothing wrong. >> 555 I'm going to assume this one's like an active domestic violence call. After this they're going to come. >> Now, the most significant legal error in this encounter, and it belongs to the officer. He told the suspect three separate times that the law gave him, quote, "no choice whatsoever." That statement is wrong. Kentucky Revised Statutes section 431.005, subsection 2, paragraph A, provides that a peace officer may arrest without warrant on probable cause of domestic physical injury. The operative word is may, not shall. Kentucky is not a mandatory arrest jurisdiction for first incident domestic violence. The Kentucky Coalition Against Domestic Violence has confirmed this in published guidance. The arrest was discretionary, not compelled. Mischaracterizing permissive authority as mandatory authority displaces the officer's personal judgment onto a statute that does not carry it. The officer receives a B, technically clean investigation, correct? Probable cause foundation, no Miranda violation, peaceful custodial arrest, held down by the repeated misstatement of Kentucky arrest law. The mother receives a D, voluntary admission supplying every element of the offense, paired with post-arrest conduct that affirmatively destroys her parental discipline defense. The daughter receives a B plus, articulate, credible, qualified her own observations, contributed to escalation but not legally culpable. The grandmother receives a C, neutral, non-cooperative, but non-obstructive. Three lessons from this case. First, for parents, verbal disrespect from a teenager is not legal provocation. Kentucky's parental discipline statute protects welfare-promoting force, not retaliatory force. Striking an near-adult child in the face during an argument is criminal assault. Second, for suspects, spontaneous admissions at your workplace are admissible. The Fifth Amendment protects against compelled self-incrimination, not voluntary disclosure. If an officer approaches you about a possible offense, the legally rational response is to decline to discuss it and request counsel. Third, for officers, accurately describe the authority you are exercising. A discretionary arrest framed as a legally compelled arrest misinforms the suspect and erodes public understanding of police judgement. Permissive statutes should be described as permissive.
