In December 2023, a routine traffic stop in Bu Idaho escalated into a federal lawsuit that's sparking debate about police conduct and constitutional rights. Today, we break down what happened, who's involved, and where the case stands. What's up? >> So, I stopped him for speeding 41 and a 25. He pulls in right here. He's originally parked here. Um, I get out to get my ticket book out of the back of the patrol car because it's in my patrol bag in the trunk. And he pulls up here, gets out of the car. I tell him, "You're not free to leave. You're detained at this time." Uh, he proceeds to ignore me and proceeds inside the house. Uh, requests my supervisor said that I'm not detained. You have no way to prove that I was speeding and enters the house against my orders. >> Is this is this his house? On December 21st, 2023, Eli Johnson, a former Sacramento County deputy and military veteran, was pulled over for allegedly speeding 41 MPH in a 25 mm zone. After pulling into his driveway, Johnson exited his vehicle, leaving his ID with the officer, and entered his home. The officer claimed Johnson was detained and not free to leave. When Johnson refused to come out, Bull Police Chief Jeremy Angbomb arrived. After a heated exchange at the doorstep, officers entered Johnson's home without a warrant, tased him, and arrested him in front of his wife, April Horesco, and their four-year-old daughter, AJ. >> What's his name again? >> Elijah. >> Hey, is Elijah here? >> Uh, he is. >> Can I talk to him? >> Okay, I'll let him know. >> Okay, thank you. >> Okay, you're welcome. Do you know this Elijah character? >> You want to take him in custody? >> What's that? >> Take him into custody if he opens up. >> If he's willing to cooperate, then >> Elijah, come here so we can talk to you for a minute. >> No, I'm not coming out there. This is my home. >> Okay. Well, we need to issue this citation. So, >> and that's fine. >> So, can you give this officer a chance to So, we have two options. Okay. Here's the thing. We can issue this citation and you can ple your case to courts. >> Mhm. >> Or I'll take you to jail right now for obstruction and delay. >> Okay. >> So, do I mean it's up to you. >> I said he could give me the citation already. >> Well, then come on out here so he can finish this up. >> I don't need to go out there for him to issue a citation. There's no further >> Yeah, you do. You need to stand next to your vehicle cuz he he told you you weren't free to go yet. He needs to issue citation. So, please go there. by wait by your vehicle. >> Mhm. >> So that way he can issue citation. >> That makes no sense. I have things to take your >> Eli Johnson, a retired law enforcement officer and devout Baptist, was the primary target of the arrest. His wife, April Horesco, and their young daughter, AJ, witnessed the incident. Johnson's attorneys claimed the tasing caused physical injury and emotional trauma to the family, particularly to AJ, who was present during the arrest. The lawsuit alleges violations of their Fourth Amendment rights, citing an unlawful home entry and excessive force. >> Have two seconds to go by your vehicle and let him issue citation. I'm going to place >> going to come on my property >> or you're going to be placed under arrest for obstructing. Take your pick. >> Obstructing what exactly? >> You're obstructing his investigation into a traffic. He's trying to issue a citation. >> No, there is no >> If you feel that the injustice has been or whatever, you can apply. You can take it up with the courts, but I need you to go buy your vehicle so he can give you the citation and you can be on your way. You're you're stretching this out way longer than what it needs to be. It's a speeding ticket. >> Uh-huh. >> Okay. >> It's a speeding ticket. So, can you tell me even how he would determine speed? What is your >> That is something you're going to have to take up with the You can fight that part. >> Okay. Cuz I'm getting tired of you guys hanging out here. This is my home. You're going to sit here and try to do a speed trap right here. So, no. If you want to issue a citation, you go ahead and issue a citation. >> Come out here, wait by your vehicle. >> No, I am not. Come out here. Wait. >> No, because then once I leave my private home, then that gives you reason for arrest. I am on my private home. >> You're right now. You're about ready to go to jail. >> Yeah, I don't trust you guys. I'm going to go ahead call my lawyer and call that city attorney and then we will >> come out here and have your >> You have no right into my home. You have passed the threshold. Get your foot off of my door. >> You need to come out here to finish this. >> Go ahead. Call the attorney. >> That's fine. You're more than welcome to. >> You have no right to come in here for a speeding ticket. Okay. >> Get your foot out of my door. But you're obstructing. >> I've already heard about you as a chief of police. You're cricket. Get your foot out of my door. I know you have no problem breaking the law. Get your foot out of my door. >> Dude, stand right here. Then do me a favor. Stand right here so he can issue you a citation. >> The sheriff's department. >> Sheriff's department's right here. >> Okay, good. So, go ahead. Call your attorney. >> Bull Police Chief Jeremy Angbomb, who has served since 2001 and became chief in an unspecified year, led the response. Angbomb's team argued that Johnson's refusal to comply with orders and his engagement with officers at his door justified the arrest. They claimed the interaction occurred in a public setting, making a warrant unnecessary, and that the taser was used to ensure compliance after Johnson resisted. >> Okay. This is not necessary over a speeding ticket. Okay. >> Call uh call uh >> Yeah, I know. Exactly. What are you saying that for? Of course, this isn't necessary. Go ahead. call um call our neighbor here and call Silus as well. >> Okay. >> Okay. So, come on out here so we can issue. >> Okay. >> Go ahead. >> Okay. [Music] >> Yes. >> So, are you going to come out here so he can issue the citation? >> Not at this time. No. Until I have further witnesses to do. >> Well, you have a Kappy here. So, you have two options, like I said. >> No, that one's very crooked. Okay. >> Eli Johnson was tased multiple times during the arrest, resulting in physical injuries from the taser probes and potential emotional distress. The lawsuit highlights the psychological impact on April Horesco and AJ who witnessed the event. Specific medical details remain undisclosed, but the family claims significant harm from the encounter. >> Was going to work. >> No, it's not. >> Okay. You're under arrest. >> No. Open the door. You're under arrest. Get the out of my house. >> Our house. You get the out. >> I'm coming to our house. >> Open the door. You're under arrest or I'm going to tase you. >> Open the door or you're going to get tased. >> Open the door. >> Open the door. >> No, you cannot open the door. Dispatch 200 call. >> Johnson, Heresco, and AJ filed a federal lawsuit against Chief Angb and the city of Bool in April 2024, alleging constitutional violations. A hearing in August 2024 saw both sides present arguments. Johnson's team insists the warrantless entry and tasing were unlawful.
