In this body cam footage, an officer approaches a man leaving a Starbucks after responding to a call. The officer admits he doesn't think the man is the person they are looking for, but still decides to stop him, block his path, and press him with questions. What begins as a casual check quickly raises concerns? When does just making sure cross the line into harassment. >> Hey, come on over here. What's your name? >> How you doing, man? >> Hey, that looks good. You having a good day? >> Not too close, man. >> Oh, yeah. Why don't you step over here with me? What's your name? PTSD. I'm not trying to mess with you. >> What's your name, man? >> Why you asking me my name? >> Oh, I'm just out looking for somebody. We had a call and uh I don't think that's you, but I just want to make sure that wasn't you. >> Wasn't me. >> Yeah. Why you sliding all over, my friend? Can't we just chat a little bit? >> Because it's like you just I don't know. I just came out of Starbucks and you just like, you know, I just I'm just I'm just drinking my coffee. >> Yeah. I'm just here to talk to you. What's your name? >> What's your name? My name is officer Yeah. Officer Officer Montgomery. >> Okay. >> Badge number 645. >> Nice to meet you. >> Yeah. Nice to meet you. Like >> sports or what your name is? Or maybe I can see your ID. Can I see your ID? You won't tell me your name. That kind of makes me a little suspicious. I wasn't really suspicious. I just kind of wanted to clear you. But >> can I call my friend and tell him what's going on? Cuz >> No, man. Let's just nervous. Do people walking up? >> No, man. Let's just step over here and have a conversation, man. Like, why why are you kind of trying to walk away from me? Like, >> you got me nervous, man. >> There's no reason to be nervous, man. I'm just saying like, "Let me see your ID. What's your name? Let's Let's make sure you're not the guy I'm looking for. >> My name is A. Nice to meet you." >> Yeah. Nice to meet you. Can I see your ID so I can confirm that? >> I don't have to show you my ID. Not at all. I'm not being detained or anything like you treating me like I'm being detained right now. >> Do you not think that you have to show ID to officers? Well, I'm not sure cuz I'm looking for someone who did something wrong and I'm not sure if you're him. And it would it would make a lot of sense for you to run in and kind of sneak into Starbucks and grab a drink and a snack and make it look like you are just an innocent dude walking outside. So, I just want to confirm that that's all you are. Just a dude enjoying a Frappuccino or whatever it is. >> How does it look like black? >> I mean, he could be black. I didn't want to make it about that, but I mean the black >> I mean, I'm not here to just assume >> my grandmother's white, man. So, how you know you got the wrong person. Well, that's why I just need to see your ID. If you can show me your ID. >> What's it say on your What's it say on your drink? Is that got your name on there? >> Starbucks. The company you should go in and go talk to. Don't worry about me. >> Are they familiar with you? Car, man. >> Would you Are they familiar with you? You good friends with the people in there? >> Familiar? >> Yeah. Like, would they know your name? >> You don't want to tell me your name, my friend. Would they tell me your name? >> Why you being suspicious, man? >> Suspicious about what, man? >> I don't know, man. >> Yeah. I'm just trying to have a good day. Make sure the world's safe, right? Like, >> world safe. I just look you just seen me come out the store, right, with the Starbucks and the coffee and everything, right? >> Yeah. >> And what's the issue, man? You just actually haven't told me what the guy look like. >> I said, "And it's hot out here. >> You fit. You fit in a partial description. We just need I'm sweating. >> I just need to know who you are, man. So that I can keep the the the city safe. That's all I'm doing. I'm trying to keep if you are if you're the guy I'm looking for, I need to take you where you need to go. >> But you never look like I can help you. >> I just need to know your name, man. I got a half a description that you match. So, if you match half the description, I need to know more information. >> So, what's the description? Can you tell me what I'm wearing? >> Well, first of all, you're a male. Are you Are you a male? A man? You look like a man. >> What type of question is that? >> Yeah, you look like a black man, maybe. >> Of course, man. You think I'm not funny, man. Listen, I seen a bunch of guys over there started walking and you need to go check them guys out because you just seen walked out the store. >> They're not acting suspicious to me. >> Walked out the store like, >> "Yeah, I think you snuck in." Well, I don't think anything, but I'm trying to make sure that you didn't just sneak in the store. I just know that you can't search me for my ID cuz I didn't do nothing wrong. You just saw me come out the store. >> How do you know? What are you a lawyer or what? You're a lawyer or something? >> Why you keep getting close to me, baby? >> Because I'm trying to make sure I can I'm trying to make sure I can observe you and and figure out who you are and what you're up to. >> Got my coffee and everything like that, man. >> Listen, >> you from the east coast. I like the way you say coffee. Like you go, man. Coffee. >> Yeah. So your mom on the east coast, what did she name you? >> Or this better. Let let me see the ID and we'll be good, man. >> I told you. Hey. Hey, how you doing? >> Hey. Hey. What's up, man? But that's how >> But I need to see on your ID that you're not the man we're looking for cuz you kind of look like the man we're looking for. >> Harass me at this point. You know what I mean? I got I know I'm got a bunch of lawyers. You know what I mean? I got a bunch of lawyers for different things. Like just keep on bothering. >> Why would you have a bunch of lawyers for different things if you weren't someone that was suspicious >> cuz we dealing with people like you on a day-to-day basis. Look, >> people like me. What? Cops trying to keep the world safe. I mean, like, I'm not saying, bro, that >> I'm just saying, man. >> Listen, listen, man. Listen, man. Please, please stop. Like, I got to I got kids. >> I don't want to have to detain you, man. >> Lady, help me. I got a family. Why you see what's in my hand? >> Just tell me your name and show me your ID. Let me see the ID, man. Yeah. Coffee. >> Yeah. Like, you It's very convenient that you come out of here at the exact time where I'm coming through looking for someone that matches half your description. >> That's all I'm saying. Why can't we have a serious conversation about this? >> Who you calling, man? You calling your lawyer? >> Huh? >> This is crazy. What? >> Let me see your ID. Why don't you show me your ID? I don't know why you don't think you have to listen to an officer. >> Show you my ID. >> What makes you think that? Like is that your like law degree that you just came upon? >> Man, it's kind of >> Are you like a Did you Google that law degree or what? >> Google? >> Yeah. Like where'd you get that law degree that you claiming to have? Like >> anything about the amendments? >> Which one? Like >> any one of them cuz you just Listen, man. You harassing me. >> So what amendment what what what right do you think I'm taking from you? >> You taking my rights? >> Fourth amendment right. >> Okay. >> I know I'm black but I'm educated man. Like I went to school and everything like that. >> Oh, you're educated, black man. Okay. >> Of course. Like >> that's good. >> See, I went to Starbucks. >> Yeah. Does that Starbucks makes you educated? >> Let me walk. >> What? I'm just trying to get some information, man. Why don't you >> Listen, I'm not the guy. >> You just let me know who you are. Then I can clear you. >> I Listen, bro. I just >> Bro, why are you making me be this guy? I'm not trying to be that guy. I'm trying to be the guy that keeps the world safe. >> I try to go home. You told me I'm not being detained. You feel me? You can go look for somebody else over there. Don't look at me. >> Oh, I'm not looking for you. I'm looking for somebody. I'm trying to make sure you're not him. And you won't just you won't participate in a simple a simple exercise that lets me know that it's not you. >> Exercise >> an exercise where you just let me see. >> Yeah, that's what I get paid for. Right. And I get paid for that at all. >> It's literally what I do. This is what I do all day. >> Okay. Go do something else. I don't have to do that. >> Okay. But you do because I'm asking you, man. >> What are you asking? >> I'm asking you to see your ID so I can make sure you're not him. >> You don't have to see my ID. So, >> but you're not even giving me a full answer when I just >> Listen, you are asking me right now. Like, >> so I have reasonable cause because you're being suspicious, man. You won't just answer answer a simple question. >> Suspicious drinking the coffee, >> being walking around not having answers for simple questions. >> Just drinking the coffee, man. >> Okay, you're going to make it a race thing, right? It's not about you just not answering questions. It's because you're a black man and I'm harassing >> questions and I don't even like you right now. >> I asked you the same question four times, which is let me see your ID, bro. >> All I'm saying is, man, like Yeah. I don't know, man. We I I need to see your ID. >> Listen, man. Listen, I don't have to show you no ID. I'm just not for all that. Listen, if you want to go call your supervisor, call your supervisor. Yo, you press me up on me real quick. I'm going have to I'm just saying, man, like listen, I'm not scared of you at all, man. I'm not I'm not >> there shouldn't be any reason to be that guy to be scared of you. >> All right, man. I'm going to I'm going to just cut both of our losses. Just get out of here, man. Like, >> do that. I'm going to assume you want to tell me none of that. I was going to walk out. >> Just get out of here, man. Obviously, you're not going to participate. You're probably the guy. We'll get you. We'll get you, man. bump. >> Here's the reality. In the United States, you are not required to show ID unless you are lawfully detained. And detention requires reasonable suspicion that you've committed, are committing, or about to commit a crime. Simply refusing to answer questions does not make someone suspicious, nor does it justify harassment. In this case, the officer admitted he didn't think the man was the suspect, which means the man was within his rights to walk away. The officer was wrong to block his path and continue pressing him without legal grounds. What should have been a brief confirmation instead turned into a unnecessary confrontation.
