I'm I'm not sure who called us is all, but what what's going on today? >> I asked for a divorce and he just called me. >> Okay. >> I can't say what he was going to do. I just want to leave. >> Okay. All right. Um, what time did he get home? >> I picked him up at the airport at 6:00. >> It's almost 6:00 a.m. now. So, 12 hours. When did you guys start having your talk about having a divorce? >> When you got to pick them up. >> Okay. So, you guys just been talking the whole time or off and on. >> Okay. What did you mean by you can't tell me what he was going to do? >> I just I just went out. I went I just want to help. >> Okay. All right. Well, we're we're here to help, but we need to make sure. >> If I can, I'll be okay. >> You absolutely can. I'm not going to keep you here, man. That's not my intention at all. I just want to make sure we're on the same page and kind of figure out what happened. >> I think I I woke up in time. So when >> Okay. When you woke up, where was he? >> Okay. You were you were up here or in a different room? >> Here. >> And he was standing over you on that side over there. Did he have anything in his hand or did he say anything? It's going to be my word against this. >> I know, but that's why I'm here. I'm here to hear both sides of the story and figure out. >> I just want I don't want I want to hear I just want to cause >> Okay, I get that. But when your safety is in question, it's not causing problems. It's protecting yourself, right? >> I just want to grab a baby. Okay, we're we're going to allow that to happen. Do you have a bag or a suitcase up here or do you want me to grab one for you? >> Is there anybody else here in the house? No. >> Okay. >> Anything like tonight? >> But I see. Okay. >> First time that. >> Are there any in the house yet? >> I'm sure there is. [Music] I I found a clip when I came out to the bathroom that was gone. >> Okay. He He seems pretty calm down there right now. Was there a point? Well, and I I get that, but was there a point where he wasn't Was he yelling? Was the argument like a >> Okay. So, he's always kind of just that calm. >> That's what's weird. >> Okay. All right. >> I know what I seen. I know what he was going to do. >> What do you think he was going to do? Do you think he was going to pull you? >> Okay. And why do you think that, ma'am? >> I'm sorry. What was that? So, what's the issue? Cuz she wasn't really talking to me. >> Uh, the issue, uh, is right now she kind of just wants to leave. >> Okay. >> Okay. So, she's packing a bag. >> That's fine. >> Um, she mentioned she thought she saw you standing over her when she woke up. You were just standing right beside her. Did that ever happen when >> No, I was sitting during >> sitting. Okay. >> What What's the issue with the magazine? She she says she saw one and with the demeanor she saw from you tonight um she was a little alarmed and she saw the magazine and made her even more alarmed. So >> she's saying she's you said she's spooked. >> Mhm. >> About what? About what? >> She's not doing a lot of talking, sir. >> Um please give us a call if you want to report something else. Okay. please. Okay, thank you. [Music] Well, and the the bubbles are still it's kind of looks like it's fairly fresh. [Music] You got the bubbles and all that stuff in your pictures. >> Yeah, cuz the bubbles are still they're popping right now. None of this stuff is already done. This is how they split everything 50/50. take a photo of that. And then this is going to be a mandol their divorce paperwork that we have not looked at. So take a photo of that. Can I go in there? >> You can >> sit on the couch. >> Where do you want to sit? >> I I'll just stand over here. >> Can I get a drink of water? >> Hey, you just can't wash your hands. Yeah. >> Get the boys a cup of coffee. >> I thank you. >> Hey Dan, how you doing? How about you? Would you mind coming over? I got my condolences. This is That's just a bad night. I don't wish on anybody. Okay. So, what uh what was going on tonight? Well, h they're having marital problems. >> Mhm. and uh finalize uh like is this a divorce has already been decided or is it >> No, this open for discussion >> about her. She wants a divorce one day, she doesn't the next. >> Okay. So she brought home divorce papers just preliminary ones. Long time coming. I work remotely. Okay. So I filled out divorce papers. Let's see. And then I uh I listed out our stuff and uh you know we're split 50/50. Well, she she just wanted us to go through one lawyer and the other one make it rubble and fast. I said, "Okay." And I said, "I already filled these out." And she goes, "You filled them out." Like, she didn't want me to fill them out, but she gave them to me. And uh so I split up the stuff. We agreed. And then one of them was she was buying a house and she wanted to split this house and I said, "Okay, we're going to split that house, too." Oh, she went off her. She got pissed off. >> You guys own the house? >> No, she's buying it. >> I guess she >> What was the plan there? >> She was going to move down there eventually once this was done. Um, >> why didn't you want the divorce? >> I just grew apart, I guess. What was that one thing she always said to you? The one complaint she had. >> Which one? >> I don't know. That's what I'm asking you. >> The one. >> What's the big thing? >> I wish I knew. I don't know what the big thing is. Uh I guess I I don't do enough stuff with her. >> Is that where you were? Were you downstairs when this happened? >> Yeah. >> In the basement? I was down there watching TV, getting the fire going. She first it was okay and then and then the and it wasn't and she she didn't she didn't like the idea of uh liquidating the house down there. >> Was that discussion tonight or was that previous? >> Tonight. Okay. >> Where did the gun come from? Oh. I bought that for her years ago. And uh uh uh I'm sorry I can't think straight. Um I had it in in my safe till uh Sunday and that's we had the you know most of the list done. We finished it tonight. But on the list, she was gonna let me have my safe and guns. You know, she picked something and I'd pick something and one of the things she wanted was her gun. So, I went her gun. >> Was it loaded? >> Where's your safe? >> It's out in the shop. There's one out there. Okay. Christmas. So then what happened? So you're downstairs doing your paperwork. >> Yeah. So I gave her gave her the gun. It had >> And was that tonight that you gave her the gun or did you Sunday? >> Sunday. So um Monday I went down to my dad's Lucille and come back today. You know, she picked up some from the deli and and went down there and finalized it and she flipped when she realized that the house has to be liquidated too. And uh she went upstairs and she always takes a bath before bed every so I hear the bath running and and uh and uh is that the TV down there? I think it's the guys talking. Oh. Anyway, uh I heard something hit the floor, I guess. Didn't sound like a I didn't think it was a sh. And uh stand down there watching TV, drank a beer, looked at my list, trying to think, you know, uh I don't know. Well, I guess I lost track of time, but I come upstairs. >> So, you were coming upstairs to do what? >> Check on her. I had heard anything. >> Was the bathroom door open or shut? It >> was open. She never shuts the thing. She tells, "Well, we we should split up." And I agree with her, then she'd go the other way. How long has this been going on? >> This hitch, last hitch, we're pretty distant, you know. I knew something was up, but last month. >> Yeah. Whatever that turned out to be. Yeah. Pretty distant. Do you suspect she was cheating on you again? I asked her that I asked her that to give me closure cuz you know that would be it. But she said she hadn't been. >> You believe it, >> man. Her behavior I I don't know. It just doesn't add up. Okay. >> What does it add up? >> She's behaving the same way she was before. And uh when she said she didn't want a divorce or she does want a divorce, it changed about every other day. And >> did she ever talk about wanting to divorce last time? >> No, she never did. Did she? >> I left and then uh she asked for me back and I did. I came back. Fore speech. Fore! Foreign! Foreign! Have you talked to him tonight? >> They wouldn't let me. >> So he doesn't know. >> I asked for No, he doesn't. I I I don't know what to say. He uh you know we he's downstairs here is when we had our first problems. She's upstairs with that gun. We were having problems and I told her I said I said I can't work out. She had her hand. She put up to her head. Freaked me and uh I thought for sure, here we go. And uh dropped the gun. Shot through the floor. So I shot through the floor and hit the tile by the wood stove. And so I repaired some things downstairs. I took gun away. >> Same nun. >> Same gun. They are up here. What do you mean you don't hear them? They are They're right here. What? What are you talking about? Oh, you got to be kidding me. No, I'm not. I'm not saying more. I don't I told her to we're liquidating the house houses both of them. And uh Okay. >> Who was that? Dan. >> Dan. >> She just accuse you of this. Let's see what it sounded like. Why would you do that? Yeah. I did. Why would you think you did this? I don't know if she does. Dan, I was across the room and I got to hear her. Oh my go She's angry. She [Music] Why would think you did this? What in the world would give her that impression? There's >> no way in the world she believed your mom would want. believe their moms would do that. They also don't want to believe that their dad would do it. >> Yeah. >> So why would she I haven't heard somebody that angry in a long time. >> She's emotional. >> I'll be honest with you. I was not expecting anything like that. Me neither. [Music] [Music] Damn. >> What did you do this? >> No. >> What did she ask you about the gun? pointed. [Music] >> What's that? >> I don't know what she said about the camera. They were pointed at you or something. I can't remember. Why does she think you her mom? I don't know. And what in the world is she going to say to us? I mean, there's something else going on. You need to talk to us now. >> I don't know what else is going on. There's a lot. I don't know what's going on. >> Well, because they're close, so I'm guessing that that Kindy probably shared a lot of stuff with her. >> Okay. >> So, what is she going to say? Yeah. think you have no idea >> cuz I got to tell you that phone call put chills down my spine. [Music] How >> many people? >> You did it, didn't you, Dan? >> No, I didn't. I didn't think so. But now after listening that I think you did, didn't you? >> How the hell how the hell? She doesn't know. She wasn't here. She knows what she knows that there's a divorce going on. >> What does she know? She knows something. She wouldn't have reacted the way she did. Well, >> I don't know what it is. Well, >> you think you think all you want. >> I think you did. >> No, I didn't. Hey, speech speech. Um, so and then the phone rang at 5. So I as I picked it up, she didn't I can hear her being distraught in the back, but I could not hear. She didn't like wasn't talking to me. It was just like she dialed my number and >> got you on the line. >> Got me on the line and I'm like, "Hello, hello." And I can hear her saying like, you know, "Nobody, nobody's nobody. I'm not calling. not talking or not talking to nobody and click it hung up. >> She said that um Dan was kind of standing halfway over well she she woke up. She said something just kind of startled her. She woke up and Dan was kind of standing kind of halfway over her by the bed. Um and so it startled her and she got up and I know what he doing and she said he had his hands hidden. He was all dressed in black and that he had a black glove on. I think he said black latex glove on. >> And she's like, "What are you doing? What are you doing?" And he just was looking at her and uh she said, "Show me your hands. What do you have in your hands?" She's like, "Nothing. Nothing." She's like, "Why do you have gloves on?" >> Well, I'm outside working on the motorcycle. This is what she told what he told her. >> He said he was working on the motorcycle. >> Yeah. That's what That's what she told me. >> 5 in the morning. >> What? Yeah. What are you doing at 5 in the morning? work on a motorcycle, right? If I wouldn't have woke up, she goes, "I know he would have look and saw looking in his eye. I've never seen him look like that before." You know, she just sobbing on the phone. She's telling me this and she I know he was in I know he was. And she says, "So I had to say something and I said, so I said, Dan, I said, listen, I know we're having problems, but I think we can work through." >> That's what she said she called him at that moment. And he said, "So you think we can work through them?" And she said, "Yeah, I think we can work through them." She goes, "I had to tell him that at that point because to try to calm him down or something." And she goes, "At that point, he said, can I put something in his pocket?" I said, "He puts something in his pocket, which still wouldn't show his hand, but in his pocket, and then he took a glove off." >> Um, I feel like he was very mean to had no I had no like ill disillusions, illusions about that. He was not nice to her like um >> the entire time growing up. >> Yeah. Always. >> Even before her affair. >> Always. >> So that's her. >> I remember I was probably So I remember the first vivid fight I can remember. I walk out and they're screaming at each other. The only reason it stuck as such an imprint is he I think he and he the wall or against the wall and there was a Coke can on the counter and he went like that it and I just remember the Coke being on the floor and we weren't supposed to have Coke on the carpet and so in my mind that's the reason like so a big deal. >> Yeah, it's been like this all always. It's never been he's never been nice to her even Yeah. before then too. I think it got worse after the eight years. >> And she even said multiple times she's like I don't care if we had no money. I don't care if I walk away with, you know, with nothing. I don't care. Like, I'm happy either way. >> And what about uh you told me there was or there was a bunch of medications at the house, right? >> Oh, yeah. And the they save every like most people do, you know, you have surgery, throw your pills in the counter, your cabinet. Yeah. >> Okay. Do you know was she taking anything for depression or >> Not that I know of. >> Anxiety or anything like that? >> Not that I know of. He did tell her she needed pills um a lot in the last few months. He said that she was crazy and needed medication and she was like okay like >> why was he saying she was >> because all of a sudden she started fighting back like you know she started >> making plans to leave him. >> Yeah. She started >> How long has this been have they been talking about separating you think? >> How long has she has it been that she's >> seriously where it's been a serious in motion kind of thing? Two monthsish I would say. been on for a couple 2 three months. >> 2 3 months. That's when I noticed he started even trying like he'd try a little harder. Like um all of a sudden he's like we should go to Mexico, you know. And she was like, "Nope. Like we you've had 20ome years take me to Mexico. You never want to do anything. Like I'm not going anywhere with you." And that was probably two wish months ago. I don't know if it's been told that this is petty and stupid, but um he he had message me Monday morning and say that they're getting their own phone plan and me and figure ours out. So 5 days after that's his concern. >> Yeah, money is very important. >> That's just that's what and that's what that showed me. Like you are supposed to be mourning right now and you're concerned about having to pay the you know $65 or whatever of a phone bill. >> So Dan text >> which he didn't pay for the record. I paid them every month. >> Where did they get all their money? They have quite quite a lot of assets >> and a pretty good for on a cop salary >> I would think so I don't know um one he's very frugal he they don't go on vacations really they don't do a whole lot of stuff um from what said he did pretty good with the cementing or whatever he was doing concrete whatever for when he was doing under the table and that's why >> what do you got the phone call from Dan where were you >> I was getting ready to go to work I was at home >> can can you tell me how that phone call went >> um so I had a text he texted me so it all started as I was like literally picking up my lunch bag you know and like heading out the door um he texted me and said like there's been an accident some you know call me so then I saw I had a mis call from him so I called him back and he said um something along those lines and I know I said no I screamed no and I hung up on him and that's when I called 911 because I didn't know anything you know I didn't know that this had all been taken place earlier And then he called me back about an hour and a half later or so. I think he asked are you okay? Um so and I told him no. Um what do you think? I remember I said you shot you killed my um remember he's like trying to act consoling you know like I would never do that something along those lines. And I was like do you think I'm stupid? Like and he said no I don't think you're stupid. And that's like okay red flag. Like he would never reassure me before that I'm stupid. He totally like, "Yeah, you're you guys are all dumb." Like he was one to always tell me dumb. Like no way would he like say I'm not stupid. [Music] forchech. Fore! Foreign! Foreign! Fore! Foreign! Foreign! Fore speech. Fore! [Music] Foreign! Foreign!
