I'll call. >> You guys didn't shake hands and and make up. Like, what what happened to him? What? What did you do? >> I just hit him. >> Did he ask for help? >> Uh, no. He He was He was trying He was He was asking me if I need help. >> On New Year's Day 2021, Florida police received a report that 52-year-old Jose Mandelas is missing. He hasn't been seen since December 29th. Officers head to Jose's apartment complex to meet several of his co-workers. >> So, yesterday we called him. He didn't answer. >> Okay. I'm like, "What happened?" So, he was the one that told me cuz I was working too. I couldn't really come to church for the 4 days program. >> Okay. >> So, yesterday I was able to go to church after work. >> Uh-huh. >> So, when I get to church after the program, we finish we get the new year. So, he was telling me I said, "Where's he supposed to hear be here? He's the music director. He's not here. What happened?" >> Is it like usual? Is he normally? >> No. That's why we concerned about it because he's not like that. >> Okay. You call Jose, you leave a message. >> Uhhuh. He >> next 30 seconds is calling you back. >> Okay. >> So we were right there. I like when he told me about it. I said, "Okay, no problem." I call him right away like around 2 last night. >> Mhm. >> The phone just like ping that's it. >> Can't leave a message. You can't do nothing. I said what happened? >> Said maybe his phone dead. >> So we were laughing at him like you need to buy a new phone. Blah blah blah. We left. >> Okay. >> So this morning I went home after church all of us went home. This evening I went go help one of our church member change uh the tire car and everything. >> So I said let me go home and sleep then I go to work. So he call me he called me say oh bro. He still don't hear from Jose. Very unlike Jose. >> Mhm. >> So you still don't hear from Jose? Say yes. I said call tell your wife. Say the wife know the sister. Tell the wife call the sister. >> Let me call him again. I call him the same thing. So I went home, I said, "Let me know what happened. Whatever happened, we going to come over here and check what is going on." >> Mhm. >> So when we came, something strange cuz that boy is very careful with his things. >> Mhm. >> When we came, we got in here. >> I said his car, he always park his car back there. So we walk towards the car, >> the four windows is open >> and nobody's inside the car. He got a chair back down. >> I'm like, this is strange for it to open. Mhm. >> So we went in there, >> knock on his door, >> keep knocking on his door. Keep knocking on his door. No respon. So we call the sister again. >> So the sister sister don't speak English that she speak Korean. So we bring the sister, the sister, the husband, my pastor, all of us right here like, "Okay, you know what? We need to call the police cuz unlike him that when you call us >> Mhm. we going to call you." >> I'm telling you in three less than 3 minutes he's going to call you back. >> Okay. said not to call nobody at this time. Something is wrong. >> Is his vehicle still open? >> Pastor Pastor John. >> Hey, how you doing? Nice to meet you. Good. >> You who was the caller? >> Yeah, I made the call. >> You call you have your ID? >> Is it Is it down there or we I mean we can start walking down? >> It's uh right down there. >> That's my man because Hey, my name is Ken. >> All right, cool. We'll meet you down there in front of the apartment. Now, is his car still open? >> The car is right there. That's why we The whole thing is surprising. Like >> he's somebody that's very careful with his things. >> You understand me? >> If he come to church right now, his computer, his laptop, everything he put in the place. Okay. >> You understand me? >> When was the last time you guys spoke? >> But for him to get >> I talked to the last person he talked to. He was the last person they talked to. >> How long ago was that? >> Uh he was on the 29. Let me double check. >> I was supposed to go somewhere with him. Okay. >> On the 31st and then uh he he never showed up. >> So nobody since Tuesday. >> Tuesday is 29, right? When is 29? >> Tuesday. >> So the last time is Tuesday. >> Tuesday. >> Tuesday was the last day. >> Remember what time? >> 6 p.m. >> Is it 6 p.m.? >> No. The last on the last time we spoke to him, I was the one that spoke to him. was at 11:29. 1 11:29 girlfriend hanging out with nobody know his life is just from one church to another. He play keyboard different churches. You understand me? So you can't really predict where he's going to be. So you say man no I'm running late. You know he just running do his thing. He play keyboard. He play for a couple of churches. >> Did you guys contact anybody at the other church to see if he even showed up? Where I I don't know the church. I don't even know the church. We don't know the church. I don't have information about the church. He he has his own personal business. You understand me? I got you. >> The only thing I worry about when he comes to our church, he's with family. >> That's it. But when I don't see him in church, when I came to church, we got three days program. >> I wasn't able to make it out of those three days because my schedule at work. So yesterday, I said, "Man, crossover must be in the church." So we came over there. >> Mhm. I'm like I saw him playing the drum. The jet guy is not there. The keyboard guy is not there. I like what happened cuz I got there late. >> So after the service everything we finish the service. So I asked him I said where is Jose? So that's when he explained everything to me. Say oh he call him they were supposed to go to somewhere. So he was waiting for him. He never come to pick him up. >> I said never come to pick you up. I said okay. I pick up my phone right away. I call him. He didn't answer. I could try and locate his house >> because our pastor live on this same road. Yeah, that's the building right there. So, we park right there. We work with somebody inside. >> Then we start checking everything. We went to the I saw the car. I said, "No, we got you." >> No activity on the social media. >> No. >> Jose update his profile four days ago. >> Oh, four days ago. >> What? That's what that's that's him. >> Yeah, that's him right there. Four days ago. They >> have his uh his his uh date of birth on there. >> No, I don't know the date of birth. I don't know. >> She knows the year that he was born. >> Your mom is sick. >> Oh my god. >> She can deal with this. >> That's 52. >> He's 42. >> Yeah, that's what they told him. >> She spoke to him. I think she said it was already. >> Okay. All righty. All right. Thank you. >> Does anybody have the key? >> No. >> The car key? >> No. No. >> No. >> That's a problem. >> Uh, yeah. We can look around the exterior, but we can't break the door down. >> Yeah, but the car is right there. >> No, I understand that. >> I'm not saying we don't know if anything's happened to him, but I can't can't force our way into the house cuz there's no signs of any of anything bad. He's just missing right now. So, we'll go around look around the apartment, make sure that we see anything out of the ordinary, we'll try to get our scary, but we don't see anything out of the ordinary. I said, we're going to have to uh list them as missing at this point. >> Where's his vehicle? >> His vehicle is over here. >> Yeah. >> This one Curtains. Air conditioning is on. There's no blood or flies on the window. Curtains, things. Again, things I'll be looking for. I see blood. I see flies. I see, especially given how many days it's been. If he was, you know, something happened to him inside the apartment, we would see signs of that on the outside and the neighbors would have called saying, "Hey, they smelled something or whatever." >> Uh, which is this car over here? >> Yeah. >> Which one? >> This one. >> Windows are down. >> That's his bed. He normally >> Did any Did anybody touch it? Did anybody go in here? >> No, we don't touch nothing. That's his he normally have his laptop and all this equipment in there. And on the other side we see his cards. He know he he would not let his card out like that. His personal belonging like that. Yeah, windows are down. It's got a debit card down on the floor. There's a fingerprint over here. Looks like a grease the food, but there's like uh some fingerprints. >> Okay, somebody >> can reach in and grab that receipt. I want to see the date on the receipt. Anybody? I can't reach in >> the receipt on the center console. I supposed to see what dates on it. I can't reach into the car. >> Uh there's >> are we are allowed to >> I'm if he wants to come and complain that you broke into his car, he can do that. But I can't break into his car. So if he he's not here to complain about you breaking into his car, but I need to know what date is on that receipt. >> So if he want to call and complain later on, we'll do that. But there's no criminal intent for you by doing that. You know, she's I doubt if he's going to say that's his sister. He's gonna if if he is okay that he's going to say, "Oh, my sister broke into my car." >> If we go into his car and he says, "I didn't authorize you guys to go into my car." That's true. >> Exactly. So, we can't do it. >> So, spoke to my sergeant and he's like, "We we legally cannot reach inside his car." So, like I said earlier, if he when we find him eventually, he wants to call and complain that you guys went through his car, he can do that. We're not really going to entertain it, but I we can't proceed any further without the information from those receipts. So, somebody needs to reach inside the car and grab us a receipt so we can add a time frame for you. >> Hey, wait a second. Hey, listen. You want to look for your brother or what? >> Okay. So, he got McDonald's yesterday at 9:30 p.m. >> Oh, yesterday. >> Yeah. Who's John Pierre? Yeah. M John Pierre. That's him, right? >> 9:00 p.m. >> M John Pierre. >> Yeah. >> That's not his name. >> These are all his. >> Yeah. What? That's how he's going. >> Yesterday, right? >> Yesterday at 7:30. He got Pash Pash transfaction. >> 7:30. You he was supposed to pick you up by 7. >> Yeah, he was supposed to pick me up. >> Uh what is this? 9:30. He's in Miami Gardens. >> 9:30. >> The whatever car bought in Miami uh food in Miami Gardens. Not one of these. But so I don't know who >> is not under his name. >> No, I know. I don't know who M Jump here is. I don't know if it's a friend of his. whoever he's hanging out with, but the car and whatever was down in Miami Gardens at at 9:30 last night. So, he could be at so and so's house. He could be anywhere at this moment, but there's activity yesterday. >> So, he was still here yesterday at night. >> So, he didn't pick me up. So, >> maybe he was busy with >> Maybe he's busy. Maybe he decided to go go out. Maybe he, you know, >> go play at 7:00 somewhere in the church. >> He doesn't meet church. He miss like three services. >> Yeah. You want to call it, you know. Okay. We don't know. >> Oh, the sister. Give it to the sister. >> Yeah. So, at this moment, you got to find other churches. Maybe he went to play those other churches. Maybe he decided to stay late. I mean, still. >> So, I don't know if I should try to contact the church that he was supposed to go. >> I would want to have her pop the trunk. >> Yeah. Do >> you want to open the trunk? >> Yeah. Have the sister pop the trunk. >> Excuse me, Mom. Please, can you open the trunk by the side? >> Suitcase. >> No, he don't normally leave. >> Yeah, >> he don't normally leave his stuff like that. >> Pick up somebody. >> It's here at the back. So maybe he's going to sleep somewhere. >> Oh, he pick up somebody. >> Yeah, he got to cuz that's that's not his stuff. I don't >> cuz that I know we don't pick up. He got blanket. Got pillows. He's playing to sleep somewhere. >> If it's his own. >> That's cool. >> We got his bag. >> I don't think this is his bag. >> Okay. Yeah. So that if y'all don't recognize that bag. No. No. >> Yeah. We're not going to open his bag. >> You're not going to go through his stuff? No. >> Oh, >> but as of now, like there's nothing we would see as as play anywhere. >> Oh, then yeah, if you want to go ahead and grab that. >> Yeah. take the laptop >> and then uh >> either way we're leaving the car with you guys. The car is going to be as as is. So whatever you want to take of value and then so when he calls you and he's like, "Hey, where's my stuff?" You can give him the stuff back. But I would definitely secure whatever is valuable. >> Pick up the bag. That's a laptop. >> He always carry his laptop cuz >> his music >> Oh my god. >> Yeah. But does he drink? >> No. Oh, >> he's a drink. He's a doctor. He's a He do surgery. >> He's working surgery. >> Yeah, he's a surgeon. Like a surgeon assistant. >> Okay. >> Yeah, he does all those things. Check his Facebook. >> Yeah. >> What about his job? Y'all say where does he work? >> That's >> You guys haven't called the hospital. >> I never know where I don't know the hospital he works at. I He was working at >> me. You just call the hospital. Hey, I'm looking for my relative. So and so to tell you I don't know that >> I'll check the jail. >> Is that his wallet? It's a wallet in there. >> Oh, the wallet is on. >> There's a wallet right there. >> Big wallet. >> He's got headphones. Yeah, I mean his phone is there. >> Those are things they can pick up. >> Yeah. It doesn't It doesn't look like a phone is there. >> The phone is there. >> No. He definitely has a lot of mass. >> Yeah, he does. >> He's very careful. He walking in hospital. >> Just uh put that string back in and we can just close it. Add his girlfriend. >> His what's his girlfriend's name? >> I'm not sure. >> You don't You know where she lives? >> Mommy Gardens or anything like that up here? >> No. Should be over here. >> Should be. Okay. But he has a girlfriend for sure. >> He got I don't know. He got multiple girlfriends. >> Multiple girlfriends. >> Okay. >> So, if I go in the house, I find Jose in the house. Yes, sir or no. >> I'm not sure. >> You're not sure. You only know about the car? >> Yeah. >> All right. Hang. Let me turn this AC off. >> Hey, Marvin, do you have a key to the apartment? >> Yeah, I do. >> Where is it? >> It's on car keys. >> On the car keys? Where'd you put the keys at? >> With the car keys. >> Where are the Who has the car keys? >> You have on you still or is it in the car? >> With the car keys. With the car key. >> It's where the the keys are the car. Perfect. All right. Thank you. >> Key the apartment is with the car. We still have it. Police find the key to Jose's apartment on his car keychain. They ask Jose's sister to use the keys to admit them. >> Is driving the vehicle has the keys to your brother's apartment. So to our knowledge, he's been staying with >> your brother. Okay. So we have the car key, we have the house key. In order for us to go to the apartment, you guys have to be willing, mainly you, the welfare of your brother. >> So, the only way we could do anything is if she we have the key, she gets the key, >> and she opens the apartment. So, we could just make sure that he's okay. >> We don't have the proper >> evidence >> for us to go in. Like we don't we don't we don't have >> because guess look at this cuz >> he has a key. He's been staying with your brother per se for like the last month. >> No no no nobody you >> No no no no. Listen you she won't go in. All you would have to do is just open the door because >> okay you guys understand you know. So I have to have consent from >> all right >> from S. So he didn't say where is Jose or something? >> No, he said he hasn't seen him. >> Uh-uh. >> That's a main guy. >> So why is he running with the car? >> I have no idea. >> Let's go to the Let's go to the house and and and confirm what >> Okay. So are you okay with that? >> Is she okay? Like I'm not saying that she has to go in there. I'm saying that >> we can't open the door. That's her that's her brother. Are you going to are we going to go with the car? >> No, no, no. >> Well, I'm going to have >> I'm going to open the door. >> The officer will go with us. >> Who Who is this gentleman here? >> Is the family cousin? >> He lives in the estate >> in the next estate. Right opposite the estate to this area. >> Who's the immediate family? >> This one. So that's >> that's the person. >> Okay. So are you okay with that? Yes. No. >> Let's go. >> You okay with that? go to the >> Okay. Um, in the event of all of that, the vehicle will be released to you. >> Okay. But we can't do anything with him unless we know where your brother is. >> Yeah. >> Okay. So, you guys you guys understand that? >> So, they're going to release him? >> No. No. >> Nothing. >> They don't have any evidence because he was living like two months, >> right? Right. Exactly. So, he has the key. So, he has he has rights. >> He got the right to get the key, >> right? To drive the car. Okay. You got to get back and head back over to the apartment. Okay. And then we'll figure out the rest from there. Let your husband go. Let your husband go with her. Hello. >> You don't you don't have to go inside. You just open the door for us. Okay. You give us permission then we check. Okay. >> Okay. >> So, she's going to open the door for us. Give us permission. She's really concerned for the safety of her brother. This is all related to the call >> the signal 10. >> Okay. >> So, once she opens the door, we're going to go ahead and do a welfare check. Okay. But she's going to open it for us. >> Ya. >> Delta. >> Okay. Is there a balcony or like a a terrace on that side? >> Okay. And it was all closed, right? You guys couldn't see. Okay. At Walmart, >> we'll check it from you. Thank you. You can go back over there. >> My police. >> What's his name? >> Jose. >> Jose. My police. >> Anybody home? >> All right, guys. I'm going in. It looks like it's heavy left, but it cuts right. So, I'm going to go right first. Got a room here. Hold on. Clear. >> Good. >> Yeah. I don't think there's anything. >> All right. Post left. Good. This hole right here. >> This is outside. >> Yeah, >> that's it. >> Yeah, this this one here. >> Huh? >> No, he's in He's in there. >> He's in there. >> Yeah, he's >> Oh, >> yeah. He's in the blankets there. >> All right. say, uh, start a currency log. >> Mhm. >> All right. And, uh, that's it. Turn on the lights. Get out of here. Let me call Brent. Going off camera. >> Light on that wall right there. >> I knew it. Hey, what do we say to them that they're all standing out here? >> Officers take Marvin to the station for formal police interrogation. >> Hey, I'm in the garage. >> All right, Marvin, come on out. Watch your head. this way. >> See right there. You know what we can do? Actually, I want to calm down one more time. >> Listen, to make you a little more comfortable, we're going to handcuff you to the chair. Are you good with that? >> Yeah. >> Okay. Uh, you know what? It's going to be both you here. Just Yeah. Just go ahead and come from the front. >> Okay. You good, man? You going to be hitting yourself? >> Yeah. >> Okay. Cuz we don't want to hurt you if you do that. Okay. >> We'll be cool with you. You be cool with us. All right. >> You need anything? >> You good right now? >> All right. >> In a few minutes, someone's going to come talk to you. Okay. >> All right. I finally sat down and watched the Raiders game. >> That was nice. >> Yeah. >> When did you watch it? Uh, I was getting my hair done. So, like this this past weekend. >> Okay. No, >> Tuesday. >> The fourth quarter was nuts. >> Yeah. >> Out of nowhere. >> Yeah. Now, that pass that Fitzpatrick threw was just >> And then apparently now he has CO. >> Yeah. Well, you know, hopefully next year it's just goes back to normal. Well, I got strain number two around in England. So, >> yeah, I know. >> And they got to be the first case over here already. But >> yeah, and I saw I think there was one one case in Florida, I think, >> over the new one already. >> Yeah, >> they're making, you know, sessions and restaurants are open. >> Yeah. I hope it just goes back to complete normal soon. No, >> I don't see that ever. I don't think we're ever go back to complete normal, but What's up? How are you? >> Yep. >> You can uh Okay, you're good. Okay. Thank you. >> Hey, how's your day? >> Yeah, I'm Mark. This is Danny. >> Oh, those are from his talk, by the way. >> Did you uh did you feel the comfort with the handcuffs on? >> Yeah. Police read Marvin his Miranda rightites. >> Marvin, what happened tonight? What? What? What brought us all together today? >> What kind of car you still? >> And uh whose car was it? >> Who's your friend? >> Jones. You know his last name? How long have you known him? >> Uh probably. >> How did you guys meet? We uh you guys good friends? Talk all the time. >> Yeah, we talk. >> We talk >> every day. >> And uh >> you talk on phone or just what? >> We just started talking. >> We just started talking. But you've known for a while. So you guys kind of just reconnected? >> Yeah. >> So what was the uh situation that brought you two together? >> What happened? at your home or something. Your parents >> fight with your dad again. >> You left your house and you uh you just called him up or you just showed >> you >> you called him. >> You had his number. >> Yeah, >> he has your number. >> The uh just just so we know what this is. Uh is this the same guy, Jose? Is that your friend? >> Yeah. I showed you Jose Mandelis. So when um so does this week or last week you uh went over stay with him? >> Last week. >> Last week. You know what approximate time? Yeah. If you can't remember a specific date, was there something going on? Was it Was it after Christmas? >> No. When did you We're trying to narrow down when you moved in with him. Was it after Christmas or was it before Christmas when you moved in? >> Uh, I didn't I didn't really move in. I just kind of slept in for a week. >> So, when when did you start sleeping? >> Uh, I really before Christmas. >> Before Christmas. >> Okay. >> And where were you sleeping? >> Uh, in the bedroom. >> In the bedroom. And is this um does he have a two-bedroom, one bedroom? >> One bedroom. >> One bedroom. Um, forgive me for asking, were you guys sleeping together? >> No. Where was he sleeping? the living room. >> In the living room. The uh How come How come he uh gave you the bedroom and he took the living room? Yes. >> And the uh and you guys got along and everything good. >> It was all right. >> It was all right. The uh And how did you end up with this car today? >> Since you already had it. >> Yes. Yeah. >> He gave it to you. >> No. >> Okay. >> And uh so you just decide why why why' you take it? >> Oh, yeah. You told the on scene you were uh you going to leave town? >> Where were you going to go? >> Where? Where did you think he was going to go? Did you have any place in mind? What? >> Not a good uh >> about four days ago. And you've been driving around for 4 days. Going back to the apartment, sleeping in there. >> Just going back for what? Okay. So, um you took the car about four days ago. You've been going back and forth. Um have you ran into Jose uh in those four days? When was the last time you seen Jose? I'm not sure. Do you know where Jose is? Did he leave? Where do you think he went? You guys are okay, right? >> No. No. Or you don't know? >> I mean, I don't know. I don't know how he's about. >> You don't think? Why? What happened? It's not like you guys ever fight. It's normal. I've been partners with him for a long time and weekend fights once you're on football season. But, you know, friends fight. It happens. It's not a big deal. What? What were you guys arguing about? >> He was He was getting feelings for you. >> Yeah. >> And uh but you didn't have feelings for him. No. The um Did he uh make a pass at you or something like that or something happened? Makes you feel uncomfortable. Tell me about that. It's okay, man. Yeah, it's not to be ashamed. So, you were in your house. I mean, you were in his house and did he ever touch you inappropriately before? >> Not really. Cuz I was the uh when he asked you, did it piss you off? Make you feel comfortable? those times. There's been more than one thing, correct? >> Yeah. We're just going to we're just going to, you know, talk about him. The uh how many times in in in his that period he was with him, how many times did he touch you? Every day. Touching was probably a little more than just back rubbing, wasn't it? >> Yeah. >> Did Did he say anything to you or anything like that? >> Not directly, but indirectly. >> What would he say indirectly? >> Just like it would it would be off of what I said. >> Like if I see something, he sees something. >> You see something, he sees something. >> Yeah. >> And I guess >> Yeah. Like if I tell you to go get some water, let me ask you. Um when you were sleeping in his bed, when he was sleeping on his couch, at any point he come into the bedroom. >> What would happen then? >> When you say he was doing his thing, what was his thing? through his stuff. >> Searching through his stuff. >> Yeah. What can you say? He come in a bedroom when you're in the bedroom and you go searching through the stuff through his drawers. >> But did he ever uh he was in the bed sleeping? Did he ever come into the bedroom with you? >> No. >> So he never touched you in the bedroom. sexual skin any any time when he touched you, you know, did uh did you have, you know, did you have to forcefully tell him to stop it or did it ever get, you know, a little pushy little defend to defend yourself? Tell me about that. How did you How did you defend yourself? >> Sh. Shook it off. >> Shook it off. When you shove it out, you mean pushed him? >> No. When you say just blew it off. >> Yeah. That's his business. >> Yeah. To make you feel comfortable. You never knew about that before, right? >> Yeah. >> It was just recently when you started staying there. >> Okay. >> So, is this uh is this why you took his car started going to leave the area? >> Yeah. >> Was you mad at him for what he did to you? >> Yeah. You have a Do you have money? I put gas in the house. >> Not much. >> Did he let you some money? >> No, I had some I got some stuff. >> Um, last Friday we was Christmas, right? Okay. So, between last Friday Christmas, and today, how many days have you stayed at that house? every day since Christmas. >> Uh in Yeah, I've been there since Christmas. >> Like if you if you haven't slept there in the last week, any any particular day, where did you sleep? >> Cousin's house. >> Who's that? >> That's my cousins. >> Okay. >> I don't have a piece of >> So did you stay in in Myar? >> Okay. Who um in the last Who who who did you stay with? >> Cousins. >> Who are they? >> Multiple cousins. >> But they all live in they all live together. That's where they live. I just stay there whenever I can. So, it was I'm sorry. Was it after Christmas or before Christmas when you uh moved in with uh Jose? >> I didn't really move in. >> I mean, you started crashing. >> Yeah, I started crashing. I kind of crashed in before >> the Christmas when they got executive whatever. That's when it was probably uh I needed it cuz uh when I got out of the hospital, I needed a place to stay because I couldn't stay with my parents. So that's why he came. >> Yeah. When did you which hospital were you at? Jackson. When were you down there? >> I'm not sure. You got >> When When did you When did you leave there? Was it before Christmas or after Christmas? >> Before. >> Couple days before. >> Yeah. And then uh when you when you were discharged from the hospital, you went you went straight to uh Jose's apartment. Jose, >> he offered you to come say his house >> cuz you guys were apparently talking on the phone then, right? >> Yeah. >> So, we knew he was going through a rough time. >> Yeah. >> So, he offered you in his house. >> Wasn't even nice enough to let you sleep in the bedroom. He sleeps on the couch. So you you left the house because of the inappropriate touching. >> Yeah, just the whole vibe too. I'm not supposed to be. >> You weren't supposed to be with the other man. I was not. I just >> How'd you meet Jo? >> Uh she was church. >> Okay. So Marvin, what were you in in the hospital for? No reason. Voluntary. >> Voluntary or involuntary? >> Involuntary. >> You went there on your own? >> Involuntary. Okay. Involuntary. >> Who took you there? >> Uh the cops. >> For what? >> For whatever. They try to They try to find a case. They trying to >> Yeah. They're not going to take you to the hospital if they're trying to put a case on you. >> They were trying to. They were trying to pass. >> Which cops? What city? I think so. >> Okay. And so, how long have you been in the hospital? >> Eight days. >> Okay. And then they finally let you go. >> All right. So if I were to tell you if I were to tell you that um you know in today's um in today's day um a lot of people feel that they can go and and you know protest and break store windows and steal [ __ ] and all that stuff. Do you think that's right? So, if just some some guy was walking down the street, um do you think it's okay to come up and hit that guy in the back of the head and and run away? >> Why? >> It's two different. So, >> why should you not hit some guy walking down the street though? >> It's not like that. It's the walking down the street just to my mother to be going out there because I don't really need much for >> Okay. Do you have a doctor? >> A doctor? >> Yeah. That you see often? >> No. >> Psychiatrist? >> No. >> Any medications? >> No. >> You're not on any meds? >> No. >> Okay. And try to um >> What I do got is I got these two things that they've been given. So, I haven't taken they gave me these two things. So, this I don't really need some >> Do you still take them? >> I did. I did. Then I >> What kind of medicine? What's the medicine called? >> Like Ripple. >> Okay. >> But who gave it to you? I was at the hospital >> when adventures. >> Yeah. >> How about before that? Were you on medication? >> Okay. What did you do today? >> I was on holiday. >> Out. Going where? >> Driving. >> Driving in Joe's car. Okay. Um, did you stop anyone? Did you see anyone? >> Not really or no? Not really. >> No. >> No. >> How about yesterday? What did you do yesterday? >> Same thing. >> Just drove around. Where'd you stay last night? >> Okay. So, when's the last time you were in Joe's house? >> Uh, just >> Okay. And what did you do? >> Did you watch TV? Did you play video games? >> No. >> Okay. Did you see Joe? >> No. >> Is he work? Did you know him? >> Sure. >> Okay. But you can't remember the last time that you actually saw Joe. >> Uh >> so it was Friday. Friday night. You remember seeing him yesterday? >> If you seen the last time I seen him? >> Yeah. >> No. No. When's the last time you actually saw Jo? [ __ ] >> Do you have a key to his house? He gave you a key? >> That's awesome, man. Do you have to pay him um any money? Like if you stay for a week or something? Did he asked you for money? >> No. >> All day today you drove around, but were you inside his house earlier today? Like when the police got there? >> No. >> Okay. Um, and the day before you drove around in his car and then slept in his car. >> Yeah. >> Okay. Well, you earlier you said that you sleep in he let you sleep in his bed, right? >> Uh, that was like days. >> All right. So, today's Friday. >> Yeah. >> Yesterday you slept in the car. How about uh Wednesday? The day before sleeping just slept in his bed. Okay. >> And I stayed there six days, six, seven days. >> Okay. >> So, let's talk about the car. Um, you said that he let you take the car. You have a key to his house, but you're telling us that you took it without his permission? >> Yeah. Random. >> I'm sorry. >> Yeah. Just round >> round. >> Random. >> Random. You just you took um when did you take his car? >> Was it Thursday night? Should have been sleep >> Thursday night. So that's last night. >> No, definitely not. >> So it's Friday. >> Last I took cuz I didn't take I don't just take the car out. I thought I was going to give it back to him. Of course, I took the car off for like to leave. I was about to leave because deal. So when I took off the car to leave was about two days ago, but he all just let me just take it out to >> Well, he didn't report he didn't report the car stolen. So um but um maybe Officer Am you guys got there and he was at the house or he >> No, we uh we got there and the car was unsecured. Um we while we were while officer Stewart was talking with the family and I was talking to another officer um he just noticed the car leave. So >> Oh, gotcha. >> Yeah. >> So do you remember seeing the police there and you were like, "Oh [ __ ] I'm in trouble. I got to go." >> Yeah. You remember or Yeah, that's what you were thinking. >> I saw >> Then why'd you leave? >> I just left. How come? >> Okay. Was this last time that you were at Jackson? Was that the first time you'd ever been in a um mental hospital? >> Okay. Um did they say that you have any any mental issues or it was just one of those things where it's like, hey, maybe it just needs to cool down. >> Definitely not. What? No issues. Okay. I don't think you have an issue because you're smarter than pretty much any anyone that I've already spoken to today. So, obviously you have no issues. Um but we need to talk about um you being in that house. Um did you notice that there was a smell inside that house? Like does the garbage not get taken out or something? >> No. Should the garbage >> I'm sorry. You did you take the garbage out or does does he take the garbage out? >> I said that we lost the garbage. >> Do you remember when that was? >> Four days ago. >> Okay. >> No, actually not four days ago. >> Today's Friday. So, do you know and you can't remember the last time that you actually saw Jose? >> Okay. So, um you know that the police officers went inside Joe's house to check to make sure he's okay. Do you know his family? >> Okay. The family was was there. They were worried because they hadn't heard from him um in a bit of time. So, they wanted the police to make sure he was okay. Um so, it's really really important. Okay. Um I'm not really going to get into what the police officer saw when they went in to check on him. My main thing is I want to make sure that he's in a state or he's in a condition right now um because of you, but I want to make sure that it was because it was something that you wanted to do because you were, you know, kind of out there and just wanted to hurt somebody or he did something to you and you protected yourself. So, which one of those two is it? >> Protecting yourself. >> Yeah. Tell me about that. This is really important right now. How did what what did he do that made you have to protect yourself? >> Okay. When was this? >> Okay. And um did he have clothes on or or no clothes? >> No. >> No clothes. Do you remember what time of the day this was? >> Night. >> Like now night or middle of the night? Okay. Were you sleeping? >> No. >> Okay. And then what did you have to do to protect yourself? Because this is bad. I mean, you didn't ask for it, right? >> Yeah. >> I hit him. >> You hit him. Okay. With fists, with a bat, with a rock. >> Iron. Okay. Where'd you get him? >> Oh, you threw it out. >> Okay. Where'd that hit him? >> Okay. Did you knock him out? I mean, did he like fall on the ground? >> No. >> He comes in, surprises you, tries to run up on you and advance on you in in a sexual manner. >> Do I have that correct so far? >> Your clothes were off? >> Yeah. >> Okay. So, you were sleeping with no clothes and the door was shut and he came in with no clothes. Okay. And then like what woke you up? Did he touch you or you heard him? >> Touch. >> Okay. He touched you and you were in the bed. >> I jumped. >> Okay. You jumped out of bed and then what? >> Yeah. >> I'm sorry. >> It's black. It was already dark. >> It was black. >> Yeah. >> Okay. But at some point you were trying to protect yourself. Yeah. >> Yeah. >> Okay. So, at some point you're trying to protect yourself. He's coming at you trying to advance on you and whatever for whatever. >> Do I have that correct so far? >> Yeah. >> Okay. And then um was the iron right next to you? Was it on the other pedest? >> Okay. So, how far away from him were you when you >> like me to you? >> Yeah. >> Okay. I [ __ ] like >> So, it's possible that you actually just went to throw it, but he was so close that you hit him. >> Kind of launched. Yeah. I didn't kind of launch literally launched his face cuz he was uh Yeah, I was close. Basically, I swing it. >> Okay. Like by the cord. >> Yeah. Basically, yeah. Yeah. So it was kind of it kind of it kind of uh flew out my hand but I kind of angle kind of ripped it. So boom flew out my house it didn't get I don't know got his face. >> So he was naked. Did he have anything in his hands that you saw? >> Uh he was reaching for stuff. He was reaching for stuff and I hit him. >> What? I'm not sure it's dark >> like around him or like obviously he didn't have any pockets because he had no pants on but >> looking for stuff. >> Okay. So he was looking for something in your opinion. >> Yeah. >> Okay. >> Okay. And you felt that you had to defend yourself and you swung the the iron and hit him in the head. >> Yeah. >> How many times would you say you hit him with the iron? >> Just one time. Okay. I don't know. I guess it wasn't close to swing and it fell out right here. >> And then what happened at that point? He fell. >> Yeah, he kind of fell. He was still looking. >> Okay. So, did you need to hit him again because he was looking for something to hit you with? >> No. >> Not really or no? >> No, I just kind of kind of left. >> Did you feel you were you in fear? I was not on the wall right there. >> Were you afraid? >> Yeah, definitely. >> Okay. >> I was trying to see. >> What were you afraid for? >> Just Just I don't know. I don't know. >> Weird. It's weird. >> Okay. >> It's uh bad feeling. And it was like I was like scared scared just like I'm scared scared just like thinking about like being raped whatever reason just got me mad I'm not the kind of person. >> So do you think he was he was going to try to rape you? Like it. >> Sound like it. >> So you hit him the first time and then he stumbles and then you hit him again. Yeah. >> Uh not really. Uh I dropped the kind of I kind of just threw it. That's how I felt. I just pretty much threw it. I was swinging for his face, but it pretty much she pretty much kind of like went to back, but I kind of it flung anyways kind of hit him and then I see stumble stumble back for whatever. >> And then at some point, what happened at after that? Obviously, you >> you guys didn't shake hands and and make up like what what happened to him? What did you do? >> I just What kind of what would they sound like? >> Okay. >> Did he ask for help? >> Uh, no. He he was trying he asking me if I need help. >> Okay. >> Well, that's nice of you. >> And it wasn't like much of a like a force. It was uh I kind of just like Yeah, it was just like I just lunged it out. Literally it >> and uh got him on the side of his face. I see him. I see him the way he is. >> I didn't see him like that cuz I should never threw that first place or whatever I do. >> You should have never threw that iron because the iron really started the the confition much. Well, hold on. Him coming into the room naked that >> Well, yeah, that that starts that starts. Yeah, that's But I'm not Yeah, I'm not really much of a person to like to make it a big deal. Big deal. Cuz I dealt with people in the past. I got a family like that. So, he's panicking himself. So, I feel like I was panicking too because after that, I found out what he was trying to do after. So, um, now we both know the answer to this. He never left the room. >> He's still in the room. >> Okay. So, um, and this is really important because after speaking with you, you're you're a good dude. Like, you're not a you're not an evil person. I can tell you have feelings and you just don't want to be played, right? >> Who who covered them up? Was that you or >> Yeah, I wrapped them up. >> Okay. And what did you use to wrap him up? >> Carpet. >> The carpet. Okay. And where was the carpet? >> Okay. Okay. >> At that point, did you know that um that he died? >> Yeah. He don't advance. I don't know. It was looking back. >> Well, he didn't talk after that, right? >> Yeah. He's looking back. It's safe to say that you may have covered him just out of respect. >> I didn't really try to consume whatever. I don't know what was going on. >> Is there a lot of blood in there? That's good. And you cleaned it up. You clean like it was on the floor like did you Where's the island? Is it still in the room? >> Trash. >> Where? Where? >> I trashed it in the store. >> Um trash. >> Oh, you guys have like a trash shoot over there. >> Okay. When did you do that? Wednesday. >> Yeah. Same. >> And this was at night time. >> Oh, middle Well, early Wednesday morning. Yeah. >> Okay. And then what else did you clean in there? Like where was where did you have to clean? >> It was a much It wasn't too much cleaning. It was just like >> So did you put him in the in the carpet that night or was it like a day later or two days later? Yeah, I put him I put him in the carpet. I kind No, I let No, I let it I kind of just let it stay there for for a while. I let it stay there. >> Let stay there. I just stay. I don't know where he It was gone. So, I don't know much much about it. I just left him there and then I was I left. I left and then I came back last year. >> Did you think about um did you think about calling the police to say that he um tried to rape you? >> Why not? >> I don't feel like >> you feel like what? >> I don't feel like >> you don't feel that the police would believe you because I know I would. officer. >> This is a slot of stuff. >> Moving forward, if anything like this ever happens again, hopefully it doesn't, they'll call the police. Okay. Um, and if they don't believe you, they you can get me personally and I'll I'll speak to the cops. >> At least we can get you someplace else to stay, too. >> Yeah. So, you wrapped him up in the in the blanket or I'm sorry, the same blanket. um in the carpet and then you put you said you put him in the closet. >> Yeah. >> Okay. So, h how how many times did you go in the um did you go inside the apartment after this fight happened? >> Four or five. Okay. Um so you decided to put him in the closet um that night and after he stayed there. He stayed there. I left the house like a whole day >> until until afternoon. So like afternoonish 2ish came back to see. >> So is that when you put him in the carpet? >> Yeah. >> When you left and came back? >> Yeah. >> Okay. >> Was he breathing when you came back at 2 o'clock >> that you know of? >> Was he talking to you? >> Oh, no. No. When I came back, it was more of a I don't know. I never heard I never heard a sound like that. He was like it was like he was in like sleep. >> Can you do the sound as best you can? So I have an idea. >> And this is after you left and came back or at that time. Yeah. I see him just like the floor. So I just I just like somebody like he was actually sleeping or something. So I kind of just like I just left my stuff. I was packed. I was already packing cuz I was just pl >> Well, did you did you notice over the course of a couple days that um he started to smell? >> Yeah. That's why I decided to move. >> Okay. What was your plan? >> Put him in the closet. Okay. >> So, but what were you planning on doing with him? You had to do something, right? >> I was going to leave him to be honest. We have >> But you weren't doing it to be mean. >> Oh, definitely. >> You were doing it. It sounds like you had out of respect. >> Definitely. just just cuz like the way the way the way he was just acting that's and the way he was like being sneaky with it like you know most people already direct what they want and what they do. >> What made you what made you throw the iron away though? >> Cuz I know it's just the weapon that I >> Why would you throw it away? Soon as I seen kind cuz kind of kind of the way the way I dented his face was kind of weird cuz I kind of looked like >> While you were there after this happened, did anyone come by the apartment? >> Was this phone ringing? >> Yeah. Yeah. I turned the phone off. >> Turned the phone off. Is it still in the apartment? >> Oh, it's in his car. >> The one that you had. Does he only have one car? >> Yeah. >> Okay. Um, so we uh phone was going, you turned the phone off. Um, how about Did you get his ATM card? Did you Does he have any cash that you that use maybe to get some gas? >> I mean, I got I got I got like probably like three cards. >> Three cards? Yeah. >> Did you try to use them? >> Yeah, I tried to use one of them, but I was just It's just not uh I just try to use that out. >> You came in kind of like in the middle. I don't know if they have anything out there. >> They see you took some ice shampoo soap. What? >> Yeah. Orlando, wherever you decide you want to go. >> Yeah. Water. >> Is that suitcase in the back seat in the trunk yours? >> Yeah. Or is that his? >> No, it's yours. Okay. >> And that's some of his parts from this his apartment is in that suitcase. >> Oh, no. No. Everything uh everything in the suitcase. Everything in the bag is But everything that's came out. >> Oh, in the back seat in the Okay. And it's just it's not really much but just like lotion bottles and >> stuff you would need to >> Yeah. Just like Yeah. >> Keep yourself clean for the whole day. >> You you actually tied him up, right? >> Yeah. >> After you tied him up and wrapped him in something. >> I wrapped No, I I wrapped them up first and gave him a tie. >> Oh, okay. >> Okay. I just move and you I'm sure you told me how you put him in the closet. >> No. How come? >> Cuz you hit him with the iron. You hit him just one time. >> Yeah. >> And the iron broke. >> Yep. Like uh uh cuz uh I was just Oh, yeah. I wasn't Yeah. I was just so much a razor. I was just trying to just like and I just sw it left my hand and just kind of just smacked into another smash or whatever. >> What were you wearing at the time? >> Oh, he changed to after the incident shower. >> Yeah. >> So, what what clothes were that? What were >> I should have been wearing? I should have been wearing uh black pants. on a big t-shirt. >> But when But you were you were laying naked in bed, right? >> Oh, no. No. You talking about Oh, no. No, no, no, no, no, no. You talking about when I was awake. >> Mhm. >> No. When I was awake, I Yeah, I was before I go to sleep, I always take my my clothes and everything. But so when I was awake, Yeah. I was wearing black pants. I was wearing [ __ ] cuz I'm Oh, yeah. No, when I went after him, I put on my shirt and everything. >> So, you put your shirt on and then you went after him? >> Yeah. Yeah, definitely. >> And that's when you got him in the living room. >> Yeah. Yeah. It wasn't like wide away. >> Not completely naked, just shirtless. So, >> so when I had my shirt, when I seen my shirt, I just took my shirt and I just I threw it on being mad and stuff trying to go after him cuz I was trying to figure out like what he was trying to pull and what was going on and he was talking still talking whatever. So, but it wasn't it wasn't so much it wasn't so much talking like and we were talking it was just like it was just just crazy environment to be honest. just the way like like you like he ran off to go get something like I was mad or something. >> I mean like he was mad or something. >> So >> and then uh so he ran off, you jumped out of bed, put your shirt on. >> Yeah. >> Then you chased after him into the living room. >> Yeah. No, not really. Not really. All Well, it's cuz it's cuz the room is so small. >> Yeah. >> Yeah. It's just like literally Yeah. >> It'd be just like you stepping outside the door. did. Yeah, exactly. And I just And I just went I just went to confront him just like just kept kept doing this like this act whatever acting in the way. I just >> And the iron was in the living room. >> Yeah. >> And you guys were facing facing each other. >> Yeah. >> And then when you hit him with the iron, you just hit him one time. >> Yeah. >> And he fell. >> Yeah. >> And then when he >> No, he didn't. He he stumbled like kind of like kind of like I can tell he dozy but he still he was awake though. He was awake definitely awake aware. >> Then when you hit him with the arm the arm broke >> and he didn't did he fall down or he's still upright? >> Yeah, he stood up. He stood up standing. >> Okay. And then at what point did he fall to the ground >> after the after like sec second time? >> What did you do the second time with what? >> My hand. >> Your hand. You're a right-hand. >> Yeah. >> You're a right-handed person. >> Yeah. >> And um and then uh how many times did you punch him? >> Two plus two times. >> And then that's when he fell to the ground. >> Yeah. No. Yeah. He was he was already he was already like on the way to the floor. >> And when he fell, was he faced up or faced down? >> Faced up. >> Faced up. Uh then when he was laying there, did he say anything to you? >> No. >> Um what did you see? I was to be honest went to sleep. >> The noise you just demonstrated a little while ago. >> Okay. >> And then u what did you do? >> Uh left >> left the apartment. >> Yeah. >> But you got a shower first, right? >> Yeah. Oh. Well, yeah. I not not technically a whole shower, but yeah. I got off the blood. >> You you got the blood off off your hands? Off your It was on your clothes. No, just on your hands. >> Yeah. And did you actually went into a full shower or just in the sink? >> Just in the sink. Just in the sink. I washed my face and I wash I wash because it wasn't it wasn't like like crazy blood everywhere or something like that. It was just like I just see a little little stuff on my hand stuff. But that's not what I took a shower. >> And then uh when when you left the apartment, was was he alive then? What was he doing? >> Uh Yeah. Yeah. >> Did he say anything like they want me or >> No, just all this country. >> Where did you go then? >> Um I didn't really I didn't I didn't go nowhere actually. I just kind of I stayed out there and stayed stayed outside. >> You didn't you didn't go to Jude's, right? >> Jud Jud and Jackie, I'm sorry. >> Yeah. Yeah. Yeah. Definitely. I didn't go No, I didn't go nowhere. I stayed outside. Okay. So, that was um this happened Wednesday into Thursday. >> Um so, the Did you go back to the apartment on New Year's Day? I mean, New Year's Eve. >> After the incident, after the incident happened, we're we're assuming it's Wednesday. >> Mhm. >> When did you go back to the apartment next? >> After the after the incident, I I literally went back uh I went back, but I I just went back. But when when did you go back? The very next day. >> Yeah. The very next day. >> So the 31st. >> Yeah. >> So New Year's Eve. >> Yeah. >> And when you went back in the apartment, where was he at? >> Same position. >> Same position. Laying near the in the living room >> face up. >> Yeah. >> And then um and did you do anything at that point? Did you move him? >> Uh yeah. No, nothing. Kicked him. She she uh she >> when did you kick her? Shorty. >> Should >> just see nothing any. >> Okay. >> Then you picked up your stuff. >> Oh, yeah. I just Yeah. Scram. Yeah. >> That was That was the 31st. Then did you came back again, didn't you? >> Yeah. Yeah. Cuz I seen I was like uh I came just >> I don't I didn't want to call the police. >> Did you think about calling the police? Uh, not really cuz I didn't know like the whole situation. It was so bizarre. So, it's like I feel like it's just been worse than me. >> Do you think it was wrong or >> I don't feel like I was going I feel like I feel like I made a mistake, dude. But I don't feel like I was wrong to because it just like feeling like I don't I don't want to feel like that towards people, but like I just kind of wanted to hurt him for that cuz he just kind of like I was going through a lot anyways. So kind like touch me or like that. And I never I don't I'm not a person to be like, you know, showing showing people that like whatever. So he kind of did that. He kind of like sent me and I was already in bad sleep. Bad sleep. >> So So I don't know. Uh well, I don't know what he was going. You you felt you felt he deserved it. >> Yeah, >> because of what he did to you or tried to do >> that. You you you agree it's wrong, right? >> Yeah. No, definitely. Definitely. I was just trying >> after that incident. You didn't go to anyone else's house. >> Well, yeah. No, just my cousins just to just to chill. >> You You actually went to uh June's house or Jackie's house? >> Jojo's house. >> Jojo's house. Okay. You actually went there and slept there? >> No, I didn't. I I didn't sleep. I'm not I sleep. I usually just sleep in the car. I'm just I'm just like just awake all the time. >> You have a hard time sleeping since the incident? >> Yeah, I had a hard time sleeping ever since the hospital. Like my sleep the quality of my sleep hasn't been the same. Like I sleep for probably like for every two hours when I wake up again. It's not it's not good sleep. I can get a good six hours in like a good eight hours. I'm more like you think that was because the with the because of the hospital stay. >> I think it's just because of the moving too much moving. I've been moving out my life just like I've been uh I've been in and out of houses way too long for way too way too much. So yeah, my sleep just been deterior deteriorating after that. So don't get much sleep at all. So I don't know nothing when it went down just went down very quickly. >> Do you feel rel much more? Hey Marvin, um do you think um do you think you should get in trouble for this? Like >> should you be punished for anything that we talked about? >> No, I I don't think I should be punished, but I know it's not going to be like >> about stealing his car. Do you think you should be punished for that? >> Uh no. Well, yeah. Yeah, I know. Yeah, but not not really. Well, yeah, cuz I don't know >> which one. Yes or no? >> I'm only asking. >> It's like, you know, cuz it's like, yeah, I I did ended up stealing it. It's not It's not really what I wanted to do. You know, I rather rather just like I kind of just work for myself. I don't really do much stealing. So, but yeah. No, I I should definitely get >> when when uh when you were in school and stuff, what were your grades like? >> C average. >> Okay, that's good. >> I just just cuz I wasn't putting too much effort into I should have put more effort. >> Came to you easy though. >> Yeah. Yeah. Yeah, definitely. >> I I'll get you that candy bar. How about make that happen? We'll go uh three here. I'm just going to have you hang out for a little while while we uh talk to some people. >> Needing to find the murder weapon, investigators take Marvin back to the apartment complex to show them where he threw the iron. What we're going to do, man, I want you to show me where you Okay. >> 973, bro. >> You guys want me to go with you or you're good? >> Sure. >> All right. >> Want me to turn this? Leave this. Leave it on. >> All right. Yep. What with which one? >> Oh, which one? >> You just threw it in there? >> Yeah. Shot it right in there >> by itself? >> Yeah. >> The iron? Just the iron alone? No. None of your clothes? Nothing like that? >> Yeah. Yeah. >> Just the iron. >> Just the iron. >> And uh And you just threw it in there? >> Yeah. >> Could you throw it just straight back? >> Yeah, I threw I threw it all in the back. Yeah. >> Okay. All right, man. What did the iron look like? What color was it? >> It was a It was a white. >> Is that it? >> Yeah. >> All right. All go back to the car. >> Next pro. >> At trial, the defense team argues that Marvin killed Jose with an iron out of self-defense to prevent being assaulted. The prosecution puts forward their theory that Marvin had no place to stay. Jose welcomed Marvin into the apartment until he could get back on his feet. Marvin then attacked Jose, striking him in the face with an iron. This didn't kill him, so Marvin bound Jose's legs and placed a bag over his head, suffocating him. Marvin then wrapped the body in a carpet and stuffed it in a closet for days before it was found by police. The jury agrees with the prosecution's theory. Marvin Jeanpierre is convicted of first-degree murder and sentenced to life in prison.
