Don't do I mean I'm not trying to cover for him. I just I don't know. >> But but do you see what we're saying? You >> I understand what you're saying and yeah >> because someone someone an officer says, "Hey, did something happen?" As you probably heard all the sirens around here, right? >> I did hear sirens. >> And then an officer comes here, two officers come here and say, "Hey, anything happened here?" You go, "Nope, I was in a thing." >> On February 23rd, 2024, police in Akran, Ohio are called to an apartment complex. There they find Patrick Boer clinging to life, having been the victim of a shooting. >> All right. >> All right. Uh, Storm, get your gloves on. You're gonna put this chess seal on. All right, put your gloves on. All right, so I'm gonna hold the light over here. Unfold this. >> Hey, my man, can you tell us what just happened? >> I eventually know him. You know, I've seen him around the neighborhood and stuff like that, but I don't know what's going on right now. I don't know what happened. >> You know his name? >> His name is Patrick. His name is Patrick Bulgar. He's one of the neighbors that become around this neighborhood. That's the apartment that I stay in right there. I said I was just in my apartment and I heard him outside and heard him outside crying. I was just seeing what was going on cuz I didn't know what was going on. >> I don't even know what's happened to him right now. Do y'all know what happened to him? >> He got hurt at drive. >> You don't know what drivethrough though? >> I have no idea. I wasn't with him. Like I said, I was in my apartment the whole time and I heard him out here crying and stuff. I was about to call the paramedics myself if y'all didn't show up. >> You hear a car pull up or anything? >> Um, yeah. I heard I heard a car pull up. I didn't see who it was, though. >> Okay. So, was he dropped off, you think? >> I think he was dropped off. Yes, sir. >> Yeah. Yes, sir. I think he was dropped off. I didn't see who he was. >> I just heard him not replying, so I just opened up my door to see more. No, my wife sound like that. His name is Patrick Bogart. Yes. His name is Patrick Bogart. >> Yes, sir. Yes. Appreciate your offices. You live up here with anybody else? >> No, I live I live up here by myself. Up here in that apartment right there, number four. I live I live by myself. My name is Wayne Brown Jr. I live by myself. Uh there's a guy that lives there, but he hasn't been there in apartment number three. Prison three months, right? So >> I wonder did he get a shot? He knows. >> There's nobody that lives here all here. >> Yeah. Yeah. The guy Patrick is homeless. >> Okay. >> He He doesn't live here, but he occasionally comes to visit sometimes. And he does visit that apartment down there >> down the bottom. >> Do you know who lives down there? >> Some guy named Edward like he not home now? >> I don't know if he's home now or not, officer. >> It looks very dark down there. >> Yeah, he's probably not even home. Yeah. >> And as far as me, I live up here in the apartment. That's fine up there. >> Well, it didn't happen here. >> No, you know, it definitely didn't happen here. No, I said I seen somebody drove him here in the driveway. They dropped him off and they said something about meeting up with him at the hospital once he gets once he recovers and gets well and calls him to let them know he's up there at the city hospital or something like that. They basically, you know, they supposed to meet up with him up there. >> But yeah, that guy, his name is Patrick Bo, >> the the guy that got shot. >> Yes. Patrick Patrick Bohog and his last name is spelled a certain kind of way. I think it's spelled B O E G E R T. >> Okay. >> Yeah. Patrick Bogar. He said Bogar is how you pronounce his last name. >> All right. >> Anybody live with these other? >> He said the dude down here. There's a guy down here who always visits, but it doesn't look like they're Does he drive? >> Oh, no. He Nobody in this building drives. >> Okay. >> We all get rid. There is a guy that did the corner store in Georgia. He hasn't been there a month. And there's a guy that lives in apartment down there, too. He's there right now, but it's probably sweet. >> All right. >> No cameras. >> No, no cameras. >> All right, man. >> I appreciate your help, bud. >> No problem. >> Ran off the road. >> No, just right here. >> Nothing really happened here. He just got dropped off. >> Yeah. I don't even know what that dude. >> Oh, yeah. Do you know where old dude hangs out at? >> You said do I know where Patrick hangs out? >> Yeah. >> Sometimes he's down there in his apartment. Sometimes he's up in the street. >> Any drive-throughs or anything that he goes to? You know these stores? >> I have no idea which drive through. >> Okay. >> There's a couple of them around here. You got border drive. You also got AB drive up here. >> You know the gas station drive. >> It looked like black SUV. I didn't see who was in the drive. >> You ever seen a car before? All right. Uh I I don't know if I ever seen that car before. No. >> Been a heck of a lot of help, man. I appreciate you, bud. >> Definitely welcome. For sure. >> A lot of people don't even answer the door, man. >> Huh? >> A lot of people don't even answer the door. >> It's cold out here, man. We'll knock if we need you, bud. Appreciate it. >> After telling police he was shot at a local drive-thru, Patrick is rushed to the nearest hospital. As doctors work to save his life, officers are dispatched around town to figure out where the shooting occurred. >> Hey, sorry to bother you. How long has your drive-thru been closed? >> I don't know. How long has the drive-thru been closed? >> I don't know. I just I got just got here. >> You guys didn't hear any gunshots or anything, right? >> Nobody got shot here. >> I mean, I just heard a whole bunch of police. >> Yeah, but no gunshots. That's what we That's what we're trying to find. >> No, we didn't hear any gunshots. >> Okay. We're just trying to find the scene. Sounds like >> somebody said it was in a drive-thru. You guys have a drive-thru. So, we're just trying to figure out what's going on. >> You guys have been here since 10 though. You didn't hear any gunshots? >> Yeah, I've been here. I just got here at 10. >> All right. Unless it's our tour. I don't know. >> All right. I appreciate you, guys. >> Or the AV? >> Yeah, we're taking >> Thank you. >> How long you been here? >> About 10 minutes waiting on her. >> Oh, you don't work here? >> No, she's getting my order. >> Oh, okay. Never mind then. You're good. We're checking the corner store at Georgia and Arlington. >> I've been stopping all night. >> Hey, >> you guys didn't have anything going on here, did you? >> No, not that I know. >> Did you even hear gunshots? Some stuff like that? >> Um, no. I would have been in the back stocking. >> Okay. Is there anyone that would have been out here? >> Um, I have in line. >> Okay. All right. Does that help? >> It might somebody >> down there. >> Yeah, you're good, man. >> Yep. >> So, we had a shooting that happened and our victim said it happened at a corner store. So, we're just trying to figure out which one that might be. >> It's not this one. >> Did you Yeah, we're just checking all of them cuz he doesn't he he doesn't know which one it is. Did you guys hear any shots fired maybe within the last half hour, hour? >> Oh, I mean besides the high-speed chase that passed and then where the hell been going on with the fire trucks and stuff. >> Well, that was the shooting. >> Oh, yeah. >> We were getting to the victim. Yeah. Okay. So, other than that, you guys haven't heard anything. All right. If you guys happen to hear some chatter or anything, please let us know. All right. Thank you. Have a good night. >> What's up, man? Okay. >> How you doing? Um, we just had a shooting happen and we're being told that it might have happened here. Um, I know you guys have had the doors locked. What time you lock them at usually? >> Uh, 10. >> 10. Okay. Uh, you mind if I step in real quick? I appreciate it. >> Let me get my manager here. >> Sure. >> Just want to have a look around. What's up, man? So, uh, we just had a shooting happened. >> Um, >> we're being told it happened out of Wendy's. We're not sure which one. We just came from where >> Nobody was shot here. >> You guys didn't hear any gunfire outside or nothing out of the ordinary? Nothing strange. >> Okay. Um I I don't know for sure that it happened here or anything. >> Yeah. No, that didn't happen. >> Our uh our victim was was pretty out of it. Um you mind if we just walk through real fast and we'll I appreciate you. What's your name? >> Good to meet you. >> Walk around and make sure >> we'll we'll handle that. >> We'll handle that. >> How y'all doing? You guys didn't hear any gunshots or nothing like that? Might have came from outside. >> Okay. Check the bathroom here. You guys already walk all the way around? >> Yeah. Okay. >> There's a There's one on Bogador, but >> No, there's another one in green, right? further down past Killian and there's one on Manchester that it's possible could have kind of happened at the jurisdiction. >> Officers learned that Patrick had been with his friend Sabrina at the time of the shooting. They track her down at her home and conduct a police interview with her, hoping to learn more about how and where the shooting unfolded. >> Yeah. >> Hi. >> Hi. You Sabrina? >> Yeah. Sorry, I was in the bathroom. >> No, you're okay. Is that your car out there? That Equinox? >> Yeah, I know. You're gonna need a statement. >> Okay. Yeah, >> my kids are um in bed. >> Okay. >> Can I get my coat real quick and talk to you? >> Where's it at? >> My coat? >> Yeah. >> In my room. >> Where's your room at? >> Back there. >> Here with your kids. >> Yeah. >> Okay. >> My boyfriend just left. Is there Am I in trouble? >> No, I was at work. >> Okay. Yeah, cuz I was I didn't know if I should call you guys or what, but I was going to wait till the morning. >> I got you. All right. >> Do you mind if I come with you to grab your jacket? >> I mean, whatever. >> Okay. I'm stepping outside to talk to the uh cops real quick. Okay, >> that's all you need. >> Uh yeah, I'll be just [ __ ] you guys. Did I do something wrong? >> No, we just need We're just trying to figure out what happened. >> Okay. Um well, what happened was um me I picked Patrick up from the laundry mat. Okay. >> Okay. >> And uh >> I don't mean to cut you off, but can you tell us which laundry you're at? >> Arlington. >> Okay. >> Toll. >> I'm sorry. What did you say? >> Keep going. >> Oh, yeah. I picked him up from the laundromat and um we stopped at the drive-thru and uh >> which drivethru >> on Arlington >> the 24 No, not the 24-hour on uh flagpole. >> Flaco. >> Flag pole. >> Flag pole >> right by the Rosemary. Yeah. >> And uh so um we stopped there or whatever and we were in line and then like nobody came and took our um order till we got to like the front of the store, you know what I mean? So um the guy came or whatever and my um window doesn't roll down. >> So um my window doesn't roll down. So, he came and uh he was taking my order or whatever and um I was ordering like some gummy bears or whatever and he didn't see him. So, u me and Pat had just seen the gummy bears. So, I was like, "Can you get out and show him, you know, which ones I'm talking about." So Pat was about to get out and the worker he came back up to the car and uh and then he seen Patrick I guess he didn't see him the first time and then he pulled a gun out on him and uh well on us and he said um get the out of my drive-thru or whatever and you know I was just like wait a minute. I was like you know like you know I don't know nothing about what's going on or I don't know the beef or whatever and then he freaking shot him. >> Okay. What this guy look like? Um, it's a white guy. Um, he is like mid20s and Patrick said his name was Tyler. >> Okay. >> Um, I know I mean I don't know the worker but like I had problems with him before just like going through there like buying stuff. He called me like a [ __ ] or whatever one time. So I I really don't go there too often anymore. >> Okay. >> After that incident. But um >> did you see what color hair he had? >> Um he had like a hood on and stuff but he was the only white. Well, I almost said only one. He's really the only There's not a lot of white workers there. Um, normally him and I maybe seen one other white person one other time, but he's more like heavier said. >> Okay. >> White guy. >> Were you inside the drive-thru? Like >> we were inside the drivethrough >> property. Okay. >> Yeah, we were inside the drive-thru. And um >> So Patrick was sitting in the car. >> Yeah. >> Were you guys only two in the car? >> Yeah. >> Okay. And uh so um the dude he had like a hoodie on and this like I said mid20s and he just like pulled a gun like he had a strap and he just pulled it out and put it like through the back window. And so um I don't know a lot about guns but it looked like like not a revolver. >> It was like a handgun though. >> Yeah. Okay. >> So what happened after that? Um, after that, um, he wanted me to take him to the hospital, but, um, I told him I couldn't take him to the hospital. I would call 911 and get him, you know, emergency help. And I called the paramedics. >> So, how did he get over to the other location? >> I took him to that location. >> Dropped him off there. >> Yeah. >> At his request? >> Yeah. Okay. >> Y, >> did he know somebody there? >> That's where he normally stays at. >> Okay. >> He normally stays there. So, um, I was going to like >> try to call him cuz I figured you guys would say for me to, you know, get in contact or whatever. >> So, um, >> name. >> Yeah. His That's what Pat said. His name was Tyler. >> Yeah. Did you see what color hoodie he had on? >> I was like kind of like in shock. I really didn't even notice that, you know, like it went from ordering gummy bears to freaking, you know, like a gun getting pulled out. But if I seen him again, I would definitely know him and I don't have a problem, you know, like testifying or like whatever to try to help because >> like I said, um I had a problem with him before. >> Does he have any facial hair or anything like that? >> I think maybe a little bit. >> A little bit. >> Yeah, I would say maybe blondish hair. >> You said he worked there? >> Yeah. >> And he's been working there for a while cuz >> Wendy's, right? >> Uh >> the garage. Okay. Yeah, he's been working there for a while cuz when I had the incident with him before it was like maybe a year ago and it was in the morning time. So, um I quit going there so often after me and him had the the verbal exchange and then I thought he didn't work there anymore. This was the first time I've seen him since that last time like a year ago. >> Okay. >> Did they exchange any words the two? >> Well, when we when we first got there, Pat I don't know if he didn't notice him. I don't know what the issue is between them, but um you know cuz we were there like a while before he I guess realized who Patrick was. So >> So they they did know each other. I don't know. >> Yeah. And he just said um then when the dude I guess real life, he was like, "Yeah, get the [ __ ] out of my drivethru." And then Patrick tried to say something to him, but um then he just put his gun out >> just shot him. >> Yeah. >> Okay. >> And you said this is through the back driver's side window. >> Yeah. I can take you guys over there and look, but um like cuz my window doesn't roll down and the driver's side and my door doesn't open. So, I'm giving them the order through the back window. Okay. >> You know what I mean? And then it's like a lot of laundry and stuff. And so, um I couldn't really see to tell him where the candy was at. And so, I was asking Patrick to get out and, you know, show him where the candy. So, I guess I'm happy he didn't get out because, >> you know what I mean? >> Did he just fire the one time? Uh yeah, as far as I know, yeah, he fired the one time and then Patrick said um he shot me and so then you know I hurried up and um like pulled off and stuff. >> Okay. >> And why did you drop him off at that house? >> Um that's where he normally stays at. >> Okay. Did he like he told you not to go to the hospital or what? >> He asked me to go to the hospital. So I told him, I'm just going to go ahead and call 911 and get you like, you know, the paramedics on the way because like honestly, I had a situation before where somebody got shot and I didn't have nothing to do with it and I was just trying to help them and I took him to the hospital and then freaking I ended up going to jail and freaking having to pay $700 to get my car out of his hole. So, you know, his safety was first, you know what I mean? But I didn't want to be, >> you know what I mean? freaking self trophies and everything else, you know, if I didn't have to. >> I got you. >> Yeah. >> What time was this around here at the drive-thru? >> Um, it was about I want to say um when exactly when I called you, it was right when it happened. >> You called from that phone? >> Yeah. >> Go ahead and pull up the uh the recents. >> I think I Yeah, you'll be able to see the actual time stamp that you called us. Hold on. >> Do you remember what words were said? I'm sorry. Go ahead. >> No, you're good. >> Uh, >> do you remember what words were said between him and Tyler? >> Uh, well, Patrick didn't get to say much. She just said Tyler just said, um, oh, dude, um, get the [ __ ] out of my drive-thru. >> That was it. >> And then, yeah, then Pat tried to say something and then, you know, he stuck the gun through the runway. It was real quick like and he sucked the gun through the window and ended up shot him. >> Do you know how long you were in the drive-thru for? >> Uh, we were in the drive-thru maybe like 5 minutes because it was people in front of us, you know what I mean? Yeah. And >> normally like how long were like you in the drivethru? Like was he helping you? >> Oh um before it happened it probably was like maybe two minutes. You know what I mean? Like he went he was looking for the candy. He didn't see it. I asked Patrick to get out and show him where it was at or get it. And then before Patrick got out, he realized who he was, I guess, and said, "Oh, dude, get the [ __ ] my drive-thru." And then Pat went to say something and it was too late. The gun was like right there. You know what I mean? >> I got you. >> Yeah. So, I was scared as hell. I didn't think that he was actually going to shoot him. You know what I mean? >> Mhm. >> Then once he shot, you you sped out with that? >> Yeah, I sped out and I called 911. And um >> Did you hear any words after that? Like, did the guy start yelling? Uh, he started yelling to the people that work there, the other guys. >> Did you know what they said? What he said? >> Hell no. I was going after that. No. >> You said it's the one at Arlington and Rose, right? >> Yeah. >> Okay. >> And he's normally the only white gentleman >> there. >> The heavier set white dude in his 20s. A little bit of facial hair. >> Yeah. And he's been working there. He's been working there for at least like a year. >> Okay. >> Cuz I had a problem before, but I seen him in the morning time. And then I anytime I went in there after that, I never seen him until tonight. >> Okay. Does he have glasses or anything? >> No. >> Any particular scars on his face? >> No, not that I've noticed. >> Young baby face. And he had like everything was covered up besides his face. And he had like a hood hat on and just like a baby face. I say like maybe blondish, brownish facial hair. Not a lot. >> Okay. >> Yeah. EV >> and I told well I was trying to tell the operator the drivethru but I don't know if I said uh the name or you know if it register to say what name. >> So you're the one who caught originally. >> Yeah. >> Okay. Makes sense. >> Is he okay? >> Uh they the detectives will go over all that when they talk to you. >> Okay. Oh, I my phone's acting now. Trying to pull that time stamp up. >> I had the best guess though. I would say maybe like 10 o'clock. >> How well do you know Patrick? >> Um, I don't know him too well. Um, it was his associate. It was actually his birthday. So, um, he was helping me with the laundry and I was going give him a few bucks for helping me. So, I just like know from around the neighborhood and stuff with you all day today or was it just >> No, just a few hours. He was I was just picked him up from the laundry mat and was going to the drive-thru and then I was going to drop him off at that location before that happened anyway. You know, I was going to drop them off prior to that. Can I grab my extra phone? My other phone. >> Yeah, that's fine. >> Go in with it, though. >> It's fine. It's my computer. Actually, I didn't I thought I was going to be able to use the phone. >> It might have been like 11 11 o'clock 11ish. >> Oh, you're checking off here. >> Yeah. Well, this is my uh my >> So, what about 11 what? 11:23. >> Yeah. >> Between 11. Okay. >> Who were you guys doing before you guys went to the drivethru? >> I picked them up in the laundry mat. >> All right. Which one? >> Hollands. >> Gotcha. And uh yeah, like I said, was going to the drive-thru and then I was going to drop them off uh either over there or um um on Wil where he normally stays at one of those two places and then that happened. >> You know how long he's been staying there for? >> Um I think maybe maybe two months or so. >> I'm not really sure. I think he kind of like floats around. Yeah. And you said you dropped him off there because last time you had to drop someone else got shot like you got arrested and stuff. >> Yeah. I didn't get arrested because of that. I didn't have anything to do with it, but I just have like um >> warrants and stuff. >> Yeah. Yeah. And uh so you know, but I'm not a bad person, you know. I'm not somebody's like life is more important. You know what I mean? But it would have been quicker because I was like in such shock to like try to get to the hospital, you know what I mean? This time uh because you know I was like right there before um I didn't I wasn't involved. I just somebody got shot and I gave them a ride and then freaking my car got towed and everything and I had license and I had like I said paid 700 bucks. So it was more so that was the best option. The best thing to do was to have the EMS come instead of trying to get to the hospital and the way cuz he like was panicking and then I was panicking. You know what I mean? >> Okay. >> Well, you dropped him off. Did you like pull in the driveway at all? >> Yeah. >> Okay. >> I pulled in, I stopped, and I helped him out. >> Okay. >> Did he end up like making it into the house? No, I told him to sit down because I mean I just thought you want to just like not bleed everywhere, you know what I mean? So I just told him to just sit down. I helped him on the ground said just sit down, hold the wound and uh I know the ambulance is already on the way. I said help is on the way. So >> Okay. >> Yeah. >> Then why why' you leave after that then? >> Why did I leave? >> Yeah. >> Cuz I didn't want I was just going to give a statement. I didn't want to get like my car towed and everything and that's it. I just wanted to make sure he was okay and I don't know if that makes sense or not but you know I just if I stay maybe my car would have get got towed or whatever you know so my main thing was to make sure that he was okay and then you know >> did you give him anything to like put pressure on the wound or anything? >> I didn't know anything about that. He said just hold the wound and that was it. And you could literally hear the person told me the cops are on the way and you could literally hear the you guys on the way anyway. >> So making sure he was okay was just like setting him down outside. >> Yeah. >> And I beeped the horn so that um you know whatever the guy he says with would come out or whatever. >> And uh and that was it. And then I'm like, well, I don't know if I should call or this late or, you know, just wait till the morning, but I was going to try to call him and then call you guys in the morning. >> Yeah, we're open 24/7. >> Yeah, but he was like very coherent and everything. Or if not, then I would have just waited. But since he was coherent and I knew you guys were on the way, then I just, you know, just came home. I knew that you guys were on the way. Was he saying anything to you when you were leaving? >> Um, he was saying like call his mom and tell his mom that um he love him and stuff like that. >> Okay. >> Were you able to contact her at all? >> No, I don't have her number. >> Do you know where she stays or what side of town? >> I don't think she lives in Akan. >> Where do you think she lives? >> I believe main. >> Yeah. Despite hospital staff's best efforts, Patrick passes away, turning the disturbing true crime case into a homicide investigation. The next day, detectives return to the border drive-thru where the shooting occurred and interrogate the staff. >> Jack, >> you don't want to put yourself in this. >> I know, and I'm not in it. >> You are cuz you lied to those officers last night. >> So, let's start over again. >> How did I lie to them? Cuz I was back there stocking stuff. >> Okay. People didn't tell. >> Okay. Well, you told him that you were the only one working and that's not true. So, let's start over. Let's wipe it clean >> and let's be honest. >> Okay. >> Yeah. >> Another coworker. I never said that. >> You did. I'm not going to argue. I watched it on video. So, who was the other guy you were working with last night? >> Um Tyler. >> What's his last name? >> I don't know his last name. >> Can we Is this heated in there? >> Can we go in there? >> Yeah. I just want to >> Yeah. No. Um, I don't know his last name. >> Okay. >> And where where did he go? >> He was here. >> He wasn't here when the officers were here. >> Well, I don't know where he went then. >> Cuz you said to the officers, he said he said, "Was there anyone else out front and you said the car's in line?" So, you were working with another person. Okay. >> I'm We've been up all night. We've been working on our nerves are this long. Okay. >> And I don't I don't even know what happened. >> Please don't bungee jump on my nerves. Okay, cuz I I'm this. Let me explain to you what it be. Complicity to murder. It could be obstructing objecting obstructing justice, which is a felony. You don't need that. >> I understand. >> Okay. So, tell us what happened. >> I do not know what happened. I was back there stuck. >> Okay. And what did Chris or Tyler say to you before he left? >> He said something about that the there's somebody in the drive-thru that had a gun sitting on his lap or something. I don't know. That was trying to rob us or something. I don't know. >> Okay. >> But I mean, that's a >> And then what happened? >> And then guess the gun went off. I don't know. >> Did you hear a shot? Honesty. This is >> I don't Let me go back. The guy's dead. >> Oh my god. What? >> This is a homicide investigation, so continue to lie to me. >> I'm not trying to lie to you at all. >> So, did you hear a shot go off? >> I heard something. Okay. >> Okay. You heard a shot and then Christopher or sorry, Tyler said what to you? He said that the guy was trying to rob us when I came out when I came out of from back there. Okay. >> I said, "Well, um, if somebody's trying to rob us and we need to shut the doors cuz all the cars just went through all the whole line that we had." >> Okay. And what would somebody do if they were almost robbed or somebody tried to rob you? What would be the normal response to that? >> Hit the button. >> Call the police. Hit the button. >> Yeah, we have a button. So then what happened after he told you that? What did he do? >> Um he freaked out and called my boss. >> He called your boss here. >> Which boss? >> Um the manager S. >> S. >> So he called S. >> What did he tell S? >> I don't know what he told. >> Did stay here or did he leave? >> He stayed. >> So he was here when the officers were here. >> Yeah. I don't know where he was at because even soft couldn't find him there. Was did S come down here? >> S ended up coming down here. Yeah, cuz I had a line all the way out to the street. So he came in to help me get it going. >> When what time did S go here? >> I can't even tell you what time it was when all the time >> Sal before it happened. >> Sally before he was gone. He was doing his other jobs. >> Okay. And then he he called and S came back. >> Yeah. >> Okay. >> Did any of those work? I see the cameras that are up there. >> Um I don't know. >> How long after that all went down did S come back? You said you don't know what time you came back, but how long? >> Probably about an hour or so, maybe. >> Yeah. >> So, so Tyler, Tyler's, you heard a noise. You came outside. Tyler, >> yeah, I heard I heard something and I was like, I come walking out and I didn't know what the [ __ ] was going on, and he was kind of freaking out, whatever. And I was like, >> and what what did Tyler say to you? >> He just said, uh, dude tried to rob us. Dude tried to rob us. And I said, "What do you mean he tried to rob us?" And then he's like, "I got to call us out." >> Okay. Did he say anything else about besides to try to rob us? >> Did he go into the store about how >> No, he was kind of like threatening walk around and >> Did he have a gun in his hand? >> No. >> Tyler, >> he didn't have a gun in his hand. >> No, he didn't have a gun in his hand. >> Is there a gun here? >> No. >> There was when the kid got shot here. >> I don't know nothing about that. >> How long have you lived here? >> Um, about a month and a half. How long has Tyler worked here? >> Uh, longer than I have. So, >> if you had to take a guess, >> it looks like there's a DVR up there. >> Uh, if I had a guess, probably a year or so, maybe. Not here because we we just he just got this place. >> I'm going to go out and call S and Okay. >> Tell him he needs to get himself here. Do you understand how how important this is? >> Yeah, I do. And >> like how important it is for you to just to be honest. >> Yeah. >> Because because first off, all right, >> no one ever called us. Right. >> Right. >> Even if there was a rob shots fired, no one calls us, right? >> We find a guy, he ends up dead. >> We're trying to put this all together. And it's important because we we we already spoke to someone, but we also want to hear like what you have to say about it. Okay. >> I understand that. >> And we don't know we don't know. Are you are you part of this or are you are you are you >> but we don't we don't think so. But >> are you are you are you trying to cover for Tyler because you're good or you trying to cover for S because >> is it is this job worth you going to jail? >> Hell no. Here's the thing. You just told us that he came in here and he told you somebody tried to rob him and called itself and all this other stuff. But when that officer asked you did something happen, you said no. You said not that I know of. >> Cuz I didn't think it was. You know what I mean? I don't know. >> Listen, it's it's just going to keep it's going to be like a tumbling. It's going to get bigger and bigger and bigger and you're going to walk yourself right into this. Don't do it. >> It's better to stop early than to keep going. >> No, I'm not I mean I'm not trying to cover for him. I just look you guys I don't know >> but but do you see what we're saying? >> Yes, I understand what you're saying and yeah >> because someone someone an officer says hey did something happened as you probably heard all the sirens around here right >> I did hear sirens >> and then an officer comes here two officers come here and say hey anything happened here and you go >> nope I was in a thing which >> I was I was >> you could be but >> but the thing is is they asked you who was out here waiting on cars or who was out here cuz they know that there's two people working here. There's always two people working here. And you said nobody was out here but the cars. >> People in line. That's what you said. >> That's obstructing justice. >> They were they were backed up always the street, too. >> Well, so you understand where I'm coming from. >> So listen, don't don't work yourself into. >> I mean, I'm obserious. I don't know the rest of it. I didn't even ask for nothing. You know what I mean? >> So, did you see Tyler with the gun? No. Did he pick anything up off the ground with a shelf? >> Not that I know of. >> Have you seen Tyler with a gun in the past? >> How many times have you worked with him? >> Uh, we've worked together like twice a week. >> Okay. >> Do you have his do you have his phone number or picture of him or anything like that on your phone? >> Facebook friends. >> No. Do you know where he lives? >> I do not. I know what usually if we give them a ride. If I can pick them up, you give them a ride here cuz I won't leave nobody out here. >> So, where do you pick them up? >> I mean, don't pick them up, but I mean drop them off. I drop them off down there at the other drive-thru. >> Who's working with you tonight for today? >> Um, what is Saturday? Um, I only I work during the day by myself. >> So, you're telling me that when those officers came here, he was still here? >> Yeah. >> Where was the app? Back to back in the cooler. What was he doing back in the cooler? Probably on the phone. I don't know. All right. Like that is literally busy as [ __ ] with all the cars. So, we're probably not going to be open for a while >> cuz we're going to have to process this scene and stuff like that. >> At least take photos and everything. >> Did Salot say anything to you about it when he came? Like don't say anything or don't anything like that? >> No. I mean, I just, you know, I heard about what happened here. What, >> two months ago or so? Two and a half months ago with a kid that got shot here. >> Mhm. >> All right. >> How's Tyler normally get here? >> Dropped off. >> Dropped off. >> Yeah. >> By who? >> His mom. Well, he says it's his mom, but it's not his biological mom. >> What's she dropped? >> A bean. >> Okay. >> I have no idea. I don't pay that close attention to it. >> How about the color? >> It's like a beige beige. I think it's a light colored green colored. >> Older, newer? >> Uh, I'd say probably late 90s like between say 99 and 2005. Probably. >> What time did his shift start last night? 6 6 p.m. >> He have no clue where he lives. >> You have no clue where? >> I have no idea. No. >> All right. What's his mom look like? >> She's got glasses like a bigger girl. Um >> like brownish hair kind of like dirty blonde. How tall is she? >> I don't know. I don't see her around the van. >> See if it's connected to that. >> Is S coming down here? >> Yeah, he's on the way. >> So, were you sitting here when Tyler told S what happened? >> Cuz I had to get that back room stocked. I got a truckload yesterday and I had to get it put away for today. And obviously I didn't finish cuz I didn't get the outside finished yet either. >> Do you know? >> Patrick. >> You don't know a Patrick? >> No. >> He comes in here all the time. >> Okay. >> Well, seemed too concerned. So, he was just leaving his house when I called him. So, he said it'd be about 40 minutes. >> How long? >> 40. He might get here faster cuz he said this guard shot. So >> investigators need to establish if there's security footage from the night of the shooting. >> Well, unfortunately the DVR that was hooked to it for the last homicide is still at the station. Oh. Um, so there's what looks to be a DVR up there, but who knows what it is >> connected to, but we may take it. Just >> do you remember where the tower was last time? >> It was right the wall wasn't there, but it was right in the same area. >> Did Tyler start working here about the same time as you or >> You mean like during the daytime? >> No, like like you start You said you worked here for like a month and a half. >> Yeah. And now he's been working here longer. >> Do you know how long? >> I said probably maybe a year if I had to guess. Maybe a year. >> So he's fine, too. >> I don't know. >> Please. >> Well, your yours seems to line up with other people called us, but some other managers and stuff here in the past said they didn't have 87. >> Can I have you that way, please? So, we'll see. >> Did you just wander in and get this job or did you know somebody to get hired in? >> A girlfriend of mine's hotel. >> Who's that? >> Eva. Name's Eva. >> Of course, she worked for him. >> Um, down at the uh other direction. >> Never in your conversations with Tyler did you ever ask him his last name. >> I don't know. Yeah. What's he look like? >> My height here. >> White male. >> Mhm. >> Bob, how tall? Your height? How about weight? >> 5200. >> A little bit thicker. >> Yeah. >> The east side. >> I don't know. But >> eventually the manager cell arrives at the scene. All right. Listen to me. Listen, I've been up all night. Okay. I'm not in the mood to last. >> I will I will get you Tyler. I I I >> right now. >> Right now. >> Can I see that? >> Yes. >> Hey, Mike. Trailer in the back behind you. >> What color is the trailer? >> He lives most of his time in that trailer. >> Okay, good enough. >> How you doing? I'm Detective Williams. So, this is Detective Aber. >> How you doing? How are you guys? >> Um, first things we want to get to is Tyler's name. >> Yeah. >> Yep. You can go. You want to go in your office? We're a little warm. It's too cold to stand out here. >> Yes. Let's get >> it. >> Taylor, all I got for Taylor is we >> Tyler >> Tyler >> Brian Lawrence hired him about six, seven months ago at AB store up the street, right? >> Mhm. >> He filled out paperwork, correct? >> No, because because >> Okay, we're we're going to need to go inside and sit down and talk. We're not playing the game. >> I mean, I I if I would know him, I'd take everybody's information. >> Mhm. >> Right. Sure. >> When when we got the store at the street. >> Let's go in there and and so we can talk. >> You're saying that some guy up the street hired him? >> Yes. >> We're going to need to talk to that guy then. >> Yes. >> Street. >> You told me last night that you can get me the name, right? >> Yes. What you told me? Okay. Well, let let's let's tackle that first and then we'll >> go put some stuff away. We'll get acetize merchandise out there now. Drive >> now. Just >> stay here. >> Yep. >> Brian, >> I'm at Borders. What's Taylor's last name? >> Uh, I have no clue. >> Well, somebody's got to have paperwork on somewhere. Is he Is he tax issues there? Is he Is he Is he Is he uh Is he at Arlington now? >> I don't know. I'm getting dressed. >> Can you What's the address of the other one? >> Right there. There's a There's a trailer. Uh right up the street. Send card and see if Tyler's working there. >> There's a trailer. >> He might trailer. Yes. >> Like a >> a house trailer >> right behind the store. Soon as you enter the store, it's right there. The trailer's right there. So, is he >> He might be there >> in the store or in the trailer. >> No, in the trailer. >> All right, hold on one second. >> There's a trailer behind it. He may be in that. >> So, >> what camera system do you have? >> These this this what's showing right here. The camera. >> Uhhuh. >> You guys have the DVD. >> The DVR, right? DVR. Right. >> Right. >> Which I released. >> Okay. I told you I should off bring the DVR DVR DVR for the last two months. Tuesday, I installed these right here. >> The round ones? >> Yes, I bought those. >> Where they go to? >> To my phone. >> Okay. And there's some outside there, too. Right. >> There's one right here. >> Yeah. >> One right here. >> And then there's one right there. One right here. >> Okay. >> There's one back here. >> Okay. So, can you pull those up for us? Show us to them. Show them to us. Can you roll it back to around 11:00 last night? >> Which one do we want to see? >> Um, >> it's not working. >> I mean, it's >> How long does it stay? >> Something. >> Normally, >> they say 24 hours. >> Okay. Well, we're well within 24 hours, >> right? Right. I mean, here's yesterday. Okay. >> So, where do you keep your employee records? >> At Lorenzo's. >> Where is that at? >> 422 East Exchange. >> Okay. >> Here's the deal. >> All this is not for just something stupid. >> No, no, no, no, no. >> Okay. >> Because see, >> hold on, hold on, hold on. >> Let me tell you what happened. >> We left here at 10:00 last night. Did you come back? Yes, I did. >> Okay. Why did you tell me that last name? >> Because what happened when he called me? He said, you know who called you? >> Taylor. >> Tyler. >> Tyler. >> When Tyler called you, >> he said, "There's a guy trying to rob us." >> Okay. >> I said, "What do you mean?" He said, "I tried to rob us. I shot in the air." >> Okay. >> I flew out. I flew back here. I flew back here. Right. >> So, when I got here, I said, "What the [ __ ] happened?" I said, "Tell what happened?" Tyler was in a pool. >> Mhm. >> She said, "I heard a shot." Right. So I said, "So what? Where did you shoot?" He said, "I shot in the air." Mhm. >> He said, "Sale and I dropped the gun in the safe." In what? >> This right here. >> This place right here? >> Yes. >> Okay. >> They dropped in. >> Is it still in there? >> No. >> Why not? >> Because I gave it back to him. He said, "Give him a gun back." >> Is it his gun or is it your gun? >> His gun. >> Does the shop still have a gun? >> No. >> Cuz when the when the kid got shot, the shop had a gun. >> No. No guns here. >> Okay. So, >> when I called you, >> yes, >> you had a good idea what it was about then. >> A shot like in the ear. >> Okay, let me explain something to you. >> Yes, >> the guy's dead. >> This is a homicide investigation, so we better dial it back. Okay, >> and if you deleted those off that phone, >> All right, listen to Listen, I've been up all night. >> Okay, >> I'm I'm not in the mood to play. >> We need Tyler's last name. I will I will get you Tyler. I I >> I will get you Tyler >> right now. >> Right now. >> Can I see that? >> Yes. >> Trailer in the back behind >> trailer in the back behind it. >> Yes. Yes. >> Does he live there? >> He lives most of his time in that trailer. >> Okay, good enough. So, >> here's the thing. >> Officers came here last night. This young lady lied to them and said that she didn't know about anything. If if you were >> This place almost got robbed. What what would a normal person do? >> Call the police. >> Absolutely. That didn't occur. So that makes me think >> if I were known detective, >> I'm not saying you knew that the guy was shot. I know. But I I called you at 3:00 or 4 in the morning. Woke you up after calling some other somebody else and waking them up to get your number. >> You knew why I was calling >> because of what happened >> last night. >> I shot a piece of I shot. >> I understand. I swear to God. I understand. But you can understand why I feel like people are for deceiving us. >> No, no. Me and >> I will I will go I will find him. I will I will get his dad's address. >> Then I got his >> Somebody has to have his name, birth date, social security number, all that stuff. >> Somebody has to have it. And normally I think it's a requirement that it's kept on site, but I could be wrong. >> No, no, you're right. You're right. I mean, it's a [ __ ] kid he hired off of the streets. >> Well, I understand that. But here's the thing. I don't want to wrap you up in it. I don't want to wrap up in it. >> No, no, no. I mean, >> so the the videos, did you look at him to see what he did? To see if >> I tried to look this morning because >> No, no, no. Last night when he called you, did you look on those videos to see if he was lying to you? >> No, because because when I when when I came back, I shot in the air, you know. I said, "To," she said, "I heard a shot." So I thought, you know, no, you know, no big deal. >> Didn't see a shot in the >> No, no. He he said he was over here. Look for >> I get description. Okay. >> It's it's it's here. I mean >> I mean why I can call this company. I mean they have >> from stuff from this morning history. >> You know what this let me explain this >> complicity to act to murder >> is the same as murder. >> Oh I'll go. >> No no no. I'm just telling you. Did you delete those? Because very very >> It will show if it was deleted. It will show. >> How will it show? >> Because I can call the company right now. >> Well, I mean, let's call the company. >> Well, first of all, let's get Tyler's last name in case he's not in that trailer. Like, we really need to know who he is. >> And this is his father's number. >> How do you know that's his father's number? >> That's his father cuz he works up, you know, up the street. Look at this. >> Yes. >> This is today. >> Yes. I called him. Why'd you call his dad? >> Because I I because I need I need to know where's Taylor. You >> called your attorney this morning. >> Yeah, he called me because I owe money from a previous case. >> Do you care if I look at those up there? >> Phone number? >> Yes. >> Do you do you care if we get our crime scene unit to come out here and take pictures? >> Is that Yes. >> Isn't that the one we already had? >> Might have been. I can't remember. I know it was a 234 number. So yesterday, >> do you have Tyler's number in here? >> Right here. >> What's his dad's name? >> That one? >> Yep. >> That's the That's the one you said was his dad. >> No. >> 234. >> That's the father. >> Yeah. So, where's Tyler's number? >> Just call me right now. See, Taylor >> 234. >> What is it? What? So, >> so you understand how it's kind of weird that all this morning stuff of us walking around in here is in here, but nothing from yesterday. Detective, I swear the god, this thing. This thing. Where is it? Is this DVR sitting up here hooked to anything >> to this? Because about about soon as we took soon as I took over here about a couple weeks I said a I need the this thing doesn't record. So they went in the back. >> So that's not a DVR sitting up there on >> it is a DVR. It is DVR. >> Okay. >> But I don't if I don't know if it works or not. >> Okay. >> They tried. Yes. Yes. >> We'll figure it out. We'll find somebody that smarter at it than we are. And >> cuz here's this here right here, right? >> See, there's nothing in yesterday. >> See? No. I mean, here's yesterday. I mean, look >> here. Let me Can you mind? >> Yes, please. Police tried to retrieve the security footage from the previous night but are unable to. >> Hello. Yeah. Hey, the detectives are here. So the so the kid here last night shot at someone and killed them. The the guy that works here killed killed killed the the the the the guy. He shot at him. >> Oh, you're clear. >> He said he shot at the air to scare him cuz he thought he was robbing us. >> It's not shot in the air. He shot at him. >> That's not what >> Yeah. >> Yeah. See? So So they're here. Let me see. I'm about to call you back. >> Okay. Thank you, bro. >> Let me try that. All of yesterday is >> Tara. Uh uh pull up ADT number for me, please. >> Yeah, all of yesterday's deleted. >> It's not deleted. >> No, it's not there. Everything from this morning is is here, but everything from >> Where's the day before? I mean, the day before. >> You said 24 hours. >> That's what they told me. >> Well, it wouldn't it minimum it would be 24 hours. >> Try try over there. Yes. >> At minimum it would be 24 hours. Some are 7. It's not even 12 hours yet. >> No, that's what I'm saying. It should be there. >> What's the icon thing? What does that say? >> Says end of video history. You've >> seen triple north mainfare check. >> How about look these three dots right here. Health settings feedback cancel. >> So, >> so you can understand. >> I completely understand. I completely understand him. Oh, if you shot the guy Oh my god. >> I mean, it was a couple months ago, one of the employees here got shot. >> Yes. Yes. >> We solved that. >> And 10 10 years ago, my brother got shot and died. >> So, I know. >> So, that's why, like I said, it's it's pretty weird, but then I get the fact that we still have your >> your up here, man. >> What is that? See what's what these supposed to be DVRs and here's there's the ones for them. >> So they're DVRs >> when I took over. You guys have the original ones, right? >> Yeah. >> So I say actually I need some, you know, the cameras. There's no DVRs. So they went in the back and got them from somewhere. I said, "Do they record?" He says, "They don't know." So we don't know. We don't know. And let me see. Let me see if I can try to get the password. >> We're going to need these. >> Please, please. So, >> call is busy. It says 1800 ADT ASAP. >> Is this when uh Taylor called you? >> Right here. Let me show you. >> Oh, kitty kitty. >> It's 11:25. That's it right there. Taylor 30 second call at 11:25. All right. So, you talked to him at 11:22 for 37 seconds. >> He called me. >> Mhm. >> He said, "Someone's trying to someone's trying to rob us. I'm trying to rob us." I said, "What? What?" He said, "Yeah, don't worry." But I I scared him. I shot in the air. >> Okay. >> Right. So, I hung up and then I I I flew over here. >> Then he called you again at 11:25. >> Is it Which one? >> Two two calls. >> Is it incoming or outgoing? incoming and outgoing. So, you call him back? >> Yeah. When I when I I called back. >> Can you open that safe for us so we can see it? >> Yes. Yes. Yes. >> Does Does Taylor normally carry a gun when he works here? >> Yes. >> Is it his gun? >> I don't know. >> Well, I mean, it's not yours or the No. No. No. No. No. No. No. No. >> Is he allowed to do that? >> I mean, it obviously your preference employee rules. >> I mean, of what happened here? I >> like I said, I was here There's a gun. Uh, >> oh no, that's a motor case. My bad. My eyes just tired. Is that a >> seen Taylor yesterday? >> Yes, you are. >> No, I didn't see him do that. >> Close it. >> Yeah, good. Thank you. Appreciate that. And he was 12. >> Do you know his father's name? >> James. >> James. James. >> And he he works like two three hours, you know, every now and then. >> Okay. So, >> this is a Google home system. >> Yes. >> When you look at it prior, can you look up stuff prior to there? >> No. Detective Williams said I deleted it. How would I delete it? No. >> But you you've used the system before though, right? I mean, I when when I go to the other store, I log in here, you know, make sure everything's the right >> and you look at prior things that happened the day before, right? And you look at prior >> I never did that. This is this is since Tuesday. It said >> delete video history. >> Well, we can take the phone and have it. It'll probably show it, I think. >> Absolutely. Absolutely. >> You can have your phone >> to solve. Yes. Absolutely. >> Okay. >> Absolutely. We're going to have you sign a form. >> Yes. >> We'll uh we'll do is they forensically dump it and it shows everything. >> When we got to have it back. I mean cuz all my bank stuff is in there. >> Probably Monday, Tuesday. >> That's fine. That's fine. >> Hopefully. >> Just I'm not promising. I'm trying. >> I need your number because >> I I get a card for you. You want to get >> I will I Listen, if this [ __ ] [ __ ] shot a guy >> he did. I I tell you unequivocally that he did. >> I will. I will. And and and and he got Listen. And yesterday he came late. His grandmother's in a hospital. >> Mhm. >> I'll find out which hospital. >> He was there. >> We were going to hope to have him. We need to talk to him before. >> Is he up there or not? >> I I have you heard anything back from them >> now? We haven't. So, how sure are you that he's living in that place? >> Oh my god. He stays there. I mean, I know that. >> Okay. >> I know that. >> Okay. >> All right. My uh battery is not doing so great. I might There you go. Oh, your battery is not doing great. >> Mine's getting tired, too. >> Is your cell phone here, too, or no? >> No, you have my cell phone. I called you on it. >> No, this is unknown. Really? >> Shouldn't be. >> How old was the kid? Uh, actually was a 46 year old man. >> Did Did he have a like a gun on him? >> We uh interviewed the girl that was with him. She said no, but we have the car that he was in in our impound and we're probably going to do a search warrant on it tonight. So, we won't know that until we come back here >> after we get We got to get out of here first. But, so we'll probably know tonight if there was was a gun. It does not sound like it was. Do you know a uh >> copy 1027? >> Do you work here much? Like, do you actually most of my time right here? >> Have you had any problems with anybody in here? I mean other than other than uh you know >> music >> I didn't even think I lost it. >> Okay. >> Unless you know the normal you know I'll you mother watch your >> I know. But anybody anybody that's a that's a constant. >> Do you do you regularly ban people and tell them they're not allowed here? >> Yes. Yes. Yes. Since I've been here. Yes. >> Okay. Do you know of anybody that you banned or? >> No. Nothing like life-threatening, you know, banning, you know. >> Well, I know, but just telling somebody that they're not allowed here. >> Just a few guys, you know, like, you know, like crackhead, something. >> You ever see that guy before? >> It's not the greatest picture in the world, but I mean, I look like a lot of customers. You know what? James uh James, you know what? His last name is on a report. Register report. >> Who? The dad. >> The dad. >> The dad. >> That's Brian Lawrence. That's the manager of Upper Street. >> Yeah, we met. >> Yeah. >> When your dad passed. Yeah. >> You were on TV the other day, too, weren't you? >> Yeah. For what? >> Uh because of uh the guy that got hit on the little bike. >> Electric bike. >> So, Channel 5 came first and we told him no. >> I didn't really want to be on TV. >> What's James last name? Dez. Dez. It's on the rich to report. Tyler, what's >> No, it's De's D's. That's what he put it in there as. I think it's Bartley. >> Tyler. >> Yeah. >> Bart Bartley. >> Yeah. >> B A R E T L E Y. >> Listen, his parents and everything are up there waiting for you guys to pull up there. >> Where? Where? >> Up at the other drivethru there. >> Yes. >> Is he there? Where? >> Wait, Tyler's there. >> Yes. >> Tyler's at the other drive-thru. >> Yes. >> Okay. try to >> Well, we have people about to knock on the thing. >> This is going to sound really stupid. >> The day after your dad died, maybe two days after your dad died, did you go to eat at my >> place in detective? >> No. >> I saw you there. >> I was like, I'm going to fill that out. I just >> I'm still in the phone after you guys. >> We'll see. But yeah, maybe. So, it's Taylor. B A R T L E Y. >> Yeah. You happen to be free. >> M I asked you this morning, what's his last name? >> Yeah, I couldn't I just woke up >> and then when I left you last night, >> do you know a birthday date or anything? >> No. >> How is his last name spelled? >> B A R T L E Y. >> Let me ask you a question, detective. When I hire my >> What's Tyler in right now? Is he in the drivethru? Is he in a car or what? >> He was. >> He's working the drivethru. >> Yeah. >> Stocking [ __ ] like that. >> Does he know we're coming? >> Yeah, I told him. >> Okay. >> He didn't know drive through working. >> Okay. >> No, no, no, no, no, no, no. Not up there. I thought you were talking about last night. No, he's he's up there waiting >> on us or just >> on you guys? Yes. >> Okay. He's supposed to wait. >> What's address if I tell my employees? If I tell my employees if you see anything wrong like a robbery coming toward our toward ours, right? >> Mhm. >> Shoot and then we ask questions later. Is is that illegal? Is that >> Well, I mean, how trained are these employees on recognizing what's going on? >> Obviously, what happened? Let me talk. Obvious grew up in the hood. I grew up in the ghetto. Literally the day the dude got hit on the bike, 5 ft from in front of me, there was a [ __ ] shootout. >> Mhm. >> You know, cops didn't even ask me. [ __ ] They're all walking around the neighbors and everything. I'm out there working on a car, changing a radio out in a car. >> Are you talking about where do you live at? >> Uh on Well, right now I'm staying about the shootout up on Fifth. >> Uh no, not Fifth. Okay. >> It was on pardon. Yeah, just reference that last no longer needs to speak. >> So obviously with what happened to the kid here, >> you know, I tell everybody to be on guard. >> Sure. >> You know what I'm saying? Because anything can happen. I stop people from [ __ ] walking up to this door every time I come here, >> right? >> Because I tell them, "No, nobody passed that beyond that point." >> I I don't doubt. Now, the story that I got was the kid. >> Yeah, that's fine. >> The guy and his wife or whoever was in the car. >> They are. >> So, we're going to thank Okay. >> So, can I have the phone, please? >> No. >> No, we're going to we're going to we're going to still need to dump it. >> Oh, thanks. >> This is your phone. >> I thought he was handing me my work phone. Well, here's the thing. >> He [ __ ] got the kid. I said I I know that you're friends with him. >> Not friends, but >> co-workers. Fair enough. >> Go ahead. >> You weren't here. I wasn't here. >> I've talked to people that were here >> and got their story. And that's why we need to talk to him. >> But as a reasonable human being, >> if somebody tried to rob your store, what would be the first thing you do? Call 911, I think. No, not call 911. Not in this [ __ ] neighborhood. If if you have security here, I'm sorry, but the act of police are [ __ ] here. >> Okay, let's go back. >> The guy the guy robbed is trying to rob you and you shoot him. What's the next thing you do? >> Well, yeah, you call the police. >> That didn't happen. >> So, there you go. >> Well, I mean, okay. So, it's Akan. It's Akran. What? What? What? Really? Realistically, what happens? Because guess what? Four years ago, when I was working up there, a dude damn near [ __ ] pulled a gun on me over a goddamn bottle of Paul Msan. >> Okay, >> what are the cops going to do? Nothing. They're going to take a report. They're going to be like, "All right, we'll ask the dude to not come back." >> That's not necessarily true. And I'm not going to argue with you. Yeah. Yeah. About it. When the young man was killed here, >> I saw the homicide in a couple days. >> Okay. >> So, I don't know what your dealings are with it. I'm not going to debate it with you. But if you didn't rob at some point, whether you shoot the guy, don't shoot the guy, >> you call the police. >> Because if you didn't do anything wrong, you don't really have any reason not to. >> He's I mean, he's also a kid. These kids nowadays, they >> I don't even I don't I don't know how old he is because he reported the shootout that happened against that. That's the problem. >> Guarantee the shoot. >> Ain't nothing going to happen. Okay. >> Kids that were walking up and down the street. >> I watched them walk down the damn way. >> Could you tell them they're blocking the driveway? >> The police. Could you tell them if they can make up? >> Yes. >> Come, please. >> Okay. Going to take care of Okay. >> Thank you. >> I mean, it's nothing against you, bro. I just every dealing that I've had with police >> these units out >> and I'm not saying I I don't I'm not going to argue what your experience was at all, >> but I'm telling you that >> at some point in time a reasonable person hey when you get up there you have them unblock the drivethru so that they can continue to run. You still there? Did you do you have him? Okay. All right. Well, when you get up there, just have them move out of the way so that they can continue what they're doing. >> All right. Thanks, >> detective. >> Now, I I don't want to keep like thinking I have enough, you know? I mean, is when I called you on the way here, he said, "Oh, not for now." So, >> well, I didn't know if you were going to come down here and lie to me and >> come on. Have I been here before? >> No, no, no, no, no, no, no. But but listen, this is my life. You know, this is my life. >> I agree with you. >> And and then you're going to say murder. I'll just go commit suic right now. >> No, but here. So when I said not as of yet, that was because I didn't know if you were going to come down here. And >> see, I told you he's in a trailer cuz he was I understand that. But why? That's why I said on the phone, well, not as of yet. >> But see what I when he called me 3:00 in the morning. Number one, I left here. You know, I got I got hot problems. I got a bad bell. >> Mhm. I'm spoke for open heart. My sugar dropped >> to 40. >> Okay. >> Thank God I made it home safe. Right. So >> probably should have stopped at the hospital. >> I know, right? So when I got home, when you call, >> you know, hold it against you. >> Well, when sugar drops, you know, you don't fully aware. >> One of the best fights I've had in 31 years of doing police work for people with low blood sugar. They fight like crazy. I'm I'm Trust me, I get it. So just need to sign here. This means that we can take the pictures and grab those DVRs, make sure there's nothing on it. And then that wasn't for the cell phones. >> I do appreciate it. >> So yeah, I don't want to lie to anybody. So when I said >> not as of yet, that was because I didn't know how this was going to go. So all right, cool. Um, >> do I have a copy or no? Just >> You got a copy machine? You're more than welcome to make a copy. Oh, I don't have a copy machine on me, unfortunately. >> Well, is it is it in your is in is is it's in your possession. It's >> I promise you. I take uh a lot of cell phones and I always make sure to get them back. Actually, you guys had had your DVR back, but I had assumed that you guys had talked to somebody else that was on the case >> because I never heard back. >> No. And I know that they had uh the CSU guys um are usually good at getting video off there, but the the one of the very good videos of him out front shooting, they couldn't extract it off. >> Hey, S. Who owns that trailer up there? >> Me, right? >> You do? >> Yes. >> Okay. The Brian Lawrence down here is the one that actually owns that trailer. >> Huh? Do you have a problem if we search the trailer to make sure the gun's not in there? >> I don't. They didn't give they He didn't give you a gun. >> No. >> Oh my [ __ ] >> I mean, I was >> I haven't I ain't going to lie to you. >> Does the kid live there? >> No, >> he doesn't live there. >> No, he just stays the night there from time to time. >> So, he stays there from time to time. So, it's actually your place. Yeah. >> Do you live there? >> Yeah. >> Okay. So, if if you don't have a problem with it, I can have you sign a waiver. We can be in and out. If not, we're gonna we're gonna have to get a search warrant to see what the gun's out. I mean, we we got to, >> right? >> We don't we don't have a choice. >> Did Did they ask him? >> Uh, he wouldn't talk. He said he didn't want to talk without a lawyer, so we can't ask him another question. Okay. >> So, like I said, either way, we we'll just have to drop a search warrant and go get a judge to sign it, or you can sign it. We can be out of your hair a lot quicker. It's up to you. He's thinking it. Tell me about it. It is too much. He's thinking about it. >> I said he's thinking about it right now. >> I think we got more than enough to get a search warrant for the trailer because that's where he was >> and huh according to his style here. Where's your jacket? >> He took the gun from here last night. So, that's probably where it's at. If I had to guess, >> so >> I'm about to make a phone call. >> Okay, that's fine. >> He's going to make a phone call real quick and let us know. I'll give you a call back. All right. Bye. Um, I'm going to keep it closed off until our CSU guys get here and do do their thing because we don't want a bunch of cars in the pictures and they're just going to take a picture of it just for for don't come here soon as possible. >> Yeah. Well, we're trying. Believe me, I want to go too. >> I think I think uh I want to go see I want to go see up there. >> It's either in the trailer >> or they dropped it in a safe like they did here last night. >> There's a safe up there. I'm going to go check right now. >> Okay. All right. just somebody over there. >> Yeah. Yeah. The other two guys that were here earlier are over there now. >> And then and then he say no about the about the the search warrant. He got some too. So >> well I don't care about anything else. >> But but just so you know. >> Okay. All right. Well, I will uh I'll I'll tell him I'll play his keys with that. I'll wait till the company out. >> Investigators rush to the company's other drive-thru where they discover 16-year-old Tyler Bartley in a trailer on the property. >> Come out here. You got any weapons on you? >> No. Okay. I'm just going to patch you down real quick. All right, bud. Can you put your hands on top of your head for me? >> Are there any firearms inside the trailer? No. What? >> Uh-uh. >> No. Is this where you live, buddy? >> No. No. That's why I stepped on. >> Oh [ __ ] >> Puppy. >> All right, man. We're going to walk down here. Okay. >> I want present when you guys talk to him. >> That's fine. >> What's your last name? >> [ __ ] Godamn. >> Is there anyone else in the trailer? >> Huh? >> Is there anyone else in there? >> Okay. >> We got some. >> Everybody got my Let's not go in the trailer. >> Just stay out of the trailer, man. >> Come here. Party. Come here. It's cold out, man. >> At least Ty, at least you don't get your friend up like being with a name, right? Come a lot more aggressive with this. You hear me? At least you still got to cool. They don't you keep it that way. You hear me? >> They come, they don't play me no more. They don't come and say, "Hey, you can come outside." They come say, "We got three." Damn. Thought they was here for you, too. >> Oh, hey, look. That's the one thing I told you. I come home to the kids home, man. You know, come over. I've been through all this [ __ ] out in the street. I really like doing all that. I'm detective Aver Cochro. Um, we're here to talk to you about last night. Okay. But this is what we're going to do. Okay. We're going to take you down the station and talk to you. Okay. You cool with that? >> Okay. >> All right. Hell no. >> Huh? >> Okay. >> Hey, can one of you guys transport him out of the station? >> Yes. >> I can go with him. >> Why? He's 16. >> 16. >> He's 16 years old, bro. He's a minor. >> That's why I said I want to be present for you guys. >> Huh? Do we uh need to hold this? Hold this here. >> I'm going to Okay, >> I'm going to read your Miranda rights. Okay. You have the right to remain silent. Do you understand that? Say yes or no, please. >> Anything you say can and will be used against your court law. Do you understand that? You have the right to talk to a lawyer, have him or her present while you question. You understand that? >> Yes. >> All right. If you not afford hire a lawyer, one will be appointed to represent you for any question if you wish. You understand that? >> Yeah. >> You can decide at any time to exercise these rights and not answer any questions and make any statements. Do you understand that? >> Do you understand each of these rights I explained to you? >> Say yes or no. All right. Having these rights in mind, do you want to talk to us? No. >> No. Like >> talk to us. No. >> Yeah. today. >> A lawyer? Yeah. >> If you have a lawyer. >> Okay. Okay. >> It's one of the ones I want to tell a lawyer up so bad. >> How old is Tyler? >> 16. >> 16. >> He's one of the ones I want to tell lawyer up so bad, but right now situation, you know, sometimes you got to >> Mhm. >> I think I can get away from you. I think he might give me a little run, but I might get a couple fences to get some distance. He look like he got me out of nowhere and slam me. He don't look like him. >> No. Uh, no. Not that you slow. I got a little physique up here, right? You little time heavy. I think I get you a little distance and be going. I think I can get you. >> I think I can get you. >> Zia, do be deceiving. Uh, >> nah, I think I might have had that wrong. I'm getting away from him. >> Probably. Get away from here, man. You give me a run. You ain't going to stop. You hear me? You ain't going to stop. Not talking. Stop. You got a little bit later. Yo, >> they leaving. They said they may want the trailer, but they'll let us know. >> They're going to hold the trailer for right now. >> They said they're going to make a phone call. >> Okay. >> Get back to us. Looks like they're getting ready to leave and that was just hanging here for nothing. Yeah, >> they have to make a phone call right now from the car. >> Is that your shift after this? >> That's why I'm all these folks in the trailer. >> We literally just showed up. >> I heard he's working, so I pulled up front just in case he bolted across the street. Yeah, that's my >> It's not going to be that long. >> Once we figure out what's going on here going, I'm trying to figure out my damn [ __ ] >> Back at Borders, detectives drill down on who Tyler is. >> All right. I appreciate your cooperation. Like I said, this kid's like 16 years old. >> How about he is? I mean a kid. You were kid. >> He come here. He come here like, you know, like two, three days a week. Help us out, you know, especially on weekends. >> Look out for him, clean them up. >> Well, I mean, I tried to get my 16-year-old a job, but >> the problem is the problem is is like nowadays, kids like that, they can't they can't just go and work anywhere. You know what I'm saying? No, I go instead of my son couldn't find a job. >> Instead of him stealing, >> right, >> to try and >> get a living. >> No, I took him in. >> I think 16-year-old should have jobs. >> Bought him a coat, you know? He came in, he showed I mean, this kid [ __ ] night and day buses. >> What do you think got into him? >> Got into him? >> Yeah. >> I mean, it's like I said, I mean, it's it's Akan. This is the hood, man. So, I mean, it's it's a doggy dog mentality. You know, no, like I said, no offense to you, but the police don't do [ __ ] >> You know, I've been doing this for 31 years. Nothing offends me. I mean, I'm going to tell you, there's good and bad at everything. So, >> just just like when they were asking me questions about the news report, they're like, "Oh, well, how is the traffic on on Arlington?" I said, "Listen, Archwood and Arlington, if there's not three, four crashes there a week cuz of people speeding, blowing lights, it it it's not normal." But the problem is with with the way things are right now is we got one guy that runs traffic enforcement because we're underst staffed. I mean when my dad came on the police department when I was 3 months old there was 526 officers. We're down like over 100 officers. >> And th those things like that traffic enforcement and stuff like that that goes out the window because they're running call to call. And a lot of that is too where like you'll call about something middle of the road and it will seem like it's getting flown off because there's 10 more serious more serious calls waiting >> and and it's not an excuse and I'm not trying to justify anything but >> I've been here in this department over 25 years and this this city has changed immensely. Listen, man. My store, the store I manage once >> in the last year has been hit. >> People broke into it. >> Burglaries and I don't doubt that. >> And and it took the with the with the alarms on our system going off >> accumulating between the two burglaries took almost 9 hours. You know what I'm saying? >> Mhm. >> Between the two times combined to for responding time. And then that doesn't surprise me because these burglars, they know that we're busy on Friday, Saturday nights. They see us driving up and down the road with our lights and sirens on and they know. >> It's the truth. And and and it's just I wish I could tell you the answer. >> Please. We got to open. I mean, >> as soon as as soon as they're done taking pictures, we're we're gone. >> He's here. The >> Yeah, that's the guy that just walked in here. >> Okay. Thank God. Okay. >> No, no, no. He's here. really easy. A matter of fact, he'll probably come in here in a couple minutes and tell us to get out so he can take pictures. He'll grab that and we're rolling out. >> Oh, excellent. And then and then uh uh so me now I'm I'm fine. You're fine. You're good. >> I swear to God because when you say not for now, I don't know how I got off the exit. I mean I I don't know how I got off the exit. >> They You guys called us last night. >> Yeah. Okay. >> That was me. >> I didn't know it was like a shoot. If it was a shooting, I would have called him right in the middle of the night or his house. I would have told him to come here. >> No, I I That's fine. I I mean, I feel bad waking people up. I I even called Michael that was here last time. I'm like, that dude's a straight shooter. I'll call him and talk to him. See, maybe he'll remember. All we just kn If I would have known he it to him, >> uh I would have called I would have called the >> I know this is how you make your living. I get it. I get it. And that's why we wants to talk to you face to face. >> We don't want no issues here of what happened. >> I'm sure >> we don't want to escalate things, you know. >> I'm sure I get it. I get it. I get it on her. >> We want to make it a safe environment. It's It's possible. >> I get it. >> I'm not going to lie to you. At first, when you guys used to pull people over, I'll be like, "Oh, you know, it's too much." Now, I rather them pulling people over and getting people on the street. I swear to God. That is it's an old theory that it's called broken windows. When you see an old dilapidated building and the windows are broken out, people think nobody gets a [ __ ] that building and they continue to damage it. But if somebody keeps fixing it, they know somebody cares. So if we're out there making traffic stops all the time, you know, when I started my career, I worked for and and I can laugh about it now because everybody's like, "Oh jeez, you can't drive through fair without getting stopped." Literally, >> but there's no crime. >> Because there's constantly officers on I mean there's only two streets. Well, maybe three. Market Cleveland Masselin and and uh you don't get the world for for us. Like I don't care no going to run. I'm not looking for trouble. That's why we like oh why they poke me over. >> They need to come in here. >> He doesn't know that. >> Yeah. >> Yeah. We we'll load out and let you get what you need to get done and then we're good. You already take pictures? >> Yeah. Oh, sweet. You're awesome. >> What's up? >> Get out of here. >> No, I was fine. I just >> We just needed to get him in there. >> We're all just going to hold up. >> I finally Okay. I called I called I She authorized charges for this whole murder. >> Murder. Yeah. We're going to take cameras at the place, >> huh? We're going to take cameras at the other place. >> Police learned that the murder weapon has been stashed at the border's location. I don't think they grabbed their side. They're probably going to ask what crimes or some [ __ ] >> Maybe. >> Is the other person okay? Am I allowed to ask that question? >> We don't know. They haven't told us anything. We just >> I just >> They just asked us to come out and see if Tyler was here. >> Man, this is [ __ ] crazy out here, bro. Acting is too much, dude. Like, this is too much. Acting. >> When did this happen? Last night, >> supposedly. Yeah. I didn't believe this [ __ ] I heard it. >> I didn't either. >> I heard someone put a gun out on him. Got scared. >> I mean, look at that place. Someone just got killed. Literally just got killed on this. This [ __ ] crazy. They don't even That store is too much, bro. >> South. >> Which store? >> Down there. Oh, >> the one that kid just got killed. Like that's this is crazy. >> Yeah. When when the kid got killed, they shut it down. The owners, they would stop running it. They wouldn't be done with it after our son got killed. >> And then my boss decides he's going to [ __ ] lease it out. >> And then he sends me down there. >> Got all of us down there. Everyone's down there. >> Yeah, he's in there. I'm sure. >> He told me to leave out the store. So >> with him in >> If not, just shut the door. It should only be a few more minutes. Once they say they if they want the want to do a search war on the trailer or whatnot or they don't want to, once they say no, then you'll be able to go in and do whatever you need to do. Okay. >> Yeah. I'm not sure that >> we we app I appreciate your cooperation and understanding and all that. >> Yeah. >> So, >> I've been here before, so I know how the process is. That's why I didn't say much. >> Mhm. He came up with a attitude. Like I was I was sitting here didn't say nothing to you. You just sitting here talking over to me with an attitude. Like I'm not about to answer when you have an attitude. >> Well, the detectives. >> Yeah. He he talking about something, are you the one who need to go back in the trailer? >> Like >> you don't have to have an attitude. You could have asked me way quietly. I know you having a hard day. I'm probably having a hard day, too. But don't don't come up like that cuz I do with that. >> Mhm. I like the hard way. All I actually say where the reaction that's why I just stay quiet. I was like, I really don't have to talk to you cuz y'all didn't come here for me. >> Yeah, I just hear the he say she say he say she say. I don't know what really happened. I work here at this drivethru for the most part. Crazy. What did you hear? >> I heard someone pulled a gun out on him and shot him. That's all I heard. I got my boss calling me down there. The owner, my cousins, the manager down there, the bigger white dude scar in his neck. >> I don't I don't really know how I didn't get to talk to him about it per se. I was like I woke up to this. >> Yeah. >> Someone would have gun on Tyler or >> Yeah, that's what I heard. So, he got into a confrontation, but >> the girl that was in the car with the dude >> and I guess dude pulled out a gun and he got scared and shot him, I guess. I don't know. A kid just got killed down there that was working there not that long ago. So, he probably, you know what I'm saying, was scared or something. >> Yeah. I mean, >> but I don't, like I said, I don't know the details. >> I get that. >> Whatever reason, Akan's becoming a very rough city. >> Said Akan's becoming a very rough city. >> Yeah, I agree. I agree. Investigators discover that one of Tyler's co-workers has key information about a possible motive for the shooting. Detectives meet with him to conduct a formal police interview. >> Start by getting your info. So, your name is >> David Reed is reed. >> Reed D. Correct. >> Six minutes to get to >> Timber Trail. Did you live up there when that homicide was up there? >> No. >> Almost there. last spring. >> Oh, yeah. I did. That was our I remember that night with the pizza delivery, >> the door dash. So, we want to talk to you about Tyler and do you know who the victim is that got shot last night? >> If it's the man he got in a fight with that day? I do. >> Do you know that guy's name at all? >> I never knew his name. >> If I showed you a picture, would you know? >> Yeah. Little like older white guy. >> That's him. But his hair was a little longer. >> It doesn't look like Doesn't look like He's a little more deceable. Was more Let me see if I can pick him up. There he is. >> Yeah. So, those are just older phones. >> Those are just older phones. >> Yeah. >> Do you know that guy? >> Yeah, I seen him here. Yeah, he got beat up in my store. >> Okay. Tell us about that. >> About how long ago was it? >> I would say now almost a month and a half maybe. >> Okay. >> Maybe maybe two months. >> Okay. >> Cuz he we talked to him about that incident. >> Talked to who? taldi and I because I didn't appreciate what he had done, >> right? >> And so this probably had to be it wouldn't have >> and um cuz you know we just taken over the store and had the violent thing that happened before and then just taken over and so anyways yeah man so I was working with him that night and um >> working with >> Tyler. Tyler. Okay. >> And that gentleman the day before I had told him to come. I was going to help him u just get some money for food. So I told him he was looking for some work. So I said, "Come back and see me tomorrow. I'll have you clean up the parking lot for me. I'll give you $5, $10, whatever. Just have you eat." >> Well, when Tyler he came to ask, you know, to come and work for me that night. And when Tyler seen him, he just I've never seen nothing like this before. Um, he he literally stopped what he was doing. Didn't care about the store's business. He ran out there. He put a beating on the man. And I I think you seen the video where he kind of dragged him back in the store inside our store. >> We didn't get to see that, but >> uh he dragged him in the store. I got a lineup full of cars. He's beating the tar out. I'm like, "Hey man, that's enough." I called my boss and like, "Hey, man. This dude is beating the out of this guy in this store. What am I supposed to be do? Yeah. As I get off of him, he finally got off of the man. The man was pretty beaten up. Pretty bad. >> Pretty bloody. >> Yes. >> Um, what did Tyler say about it? Like what did he say after everything? Like >> he said that the man I said I asked him like man when I'm trying to be like you can't do this for any kind of reasons. Whatever you got going on in the street said leave it there when you're at work. Take care of that after. But what he tried to say is that the guy owed him some money and I guess this guy and his mother kind of had some kind of involvement and he didn't want him coming back over by his bothering his mother at their house or something. >> So you're saying that the victim was bothering Tyler's mother or that's what he told >> that's what he told us. But maybe his mother was having some kind of dealings with the man and he didn't like it. But Tyler said he owed him money. >> Yeah. That man, he said that man owed him money. Did he say how much? He never told me how much. >> When you said when he saw that guy, the victim, you say like he just >> like he snapped or like it just was he lost. >> So he knew who Tyler knew who this guy was. >> Yeah. >> And he totally lost >> just quit doing what he was supposed to be doing and went directly over and just started. He's just starting to beat the tar out of that man with the He wasn't thinking about He was tunnel vision. Um >> Okay. >> I don't think he had his gun then at that time. >> Does Tyler usually carry a gun? >> I've seen it from time to time. >> Okay. That's what we're hearing and I mean I get it working in a in a situation like that. >> I don't care anymore. >> Well, and and like I said, I don't judge person either way. Um, but it seems to me like you're the type of guy that seems pretty levelheaded and pretty um calm. >> Took a while to get here. >> It it takes us all a long time to get there. I'm with you. I'm right there with you. >> Um, but so you use your words to to get rid of the problems. >> Yes. And I try to be as professional as I can be. And the thing is my job is to be professional. make sure that store is running right when he's not there and do the best I can and treat the people decent. >> You want him to come back, course that's how we make our money, >> right? So, have you ever seen the victim come back in when Tyler was there since since you he got beat up? >> No. And that was pretty funny. So, like I said, I off last night, which would have been Friday. >> Yes. and Thursday he was joking and I was like, "Dang, I ain't seen that man since I have had never seen."
