On the 31st of May 2021, a chaotic shootout erupted outside Prime 112 restaurant on Ocean Drive in Miami Beach, Florida. The incident involved the entourage of rapper the baby, including bodyguards and label associates during a postcon outing. What began as a verbal confrontation escalated to gunfire, wounding at least one individual and prompting a massive police response. This bodywn camera and radio footage obtained through public records captures the immediate aftermath and witness interview. Two men faced attempted murder charges while the baby was detained and released. Case number 202156310. Um, today's date is June 1st, 2021. The time is now 2:03 p.m. Present here today is myself, Sergeant Javier Fernandez, Metro ID 10:34. Um, also present, um, is Detective Alberto Porro, Metro 1055, and, um, Mr. Michael Aui. Uh, Mike, um, just for the record, if you could just say your name, please. >> Michael Au. >> What's your date of birth? >> 88. >> Your address? >> Lane. >> Got it. Um, Michael, I know we've gotten to know each other. Um, let me ask you, do you understand the way I speak? >> Yes, sir. >> Are my questions clear? >> Yes, sir. >> Do you understand my questions? >> Yes, sir. >> Okay. If at any point during this interview, if you do not understand my questions, please stop me so I could better explain. >> Okay. >> Understood? >> Yes, sir. >> Okay. Do me a favor. Raise your right hand. Do you swear to tell the truth, the whole truth, and nothing but the truth? I'll help you God. >> Yes, sir. >> All right. Mike. Mike, um I noticed that you're from North Carolina. Um what were you doing here in Miami? >> Um work. >> Got it. When did you get here? >> We got here. What's today? >> What is today? >> Today's t >> Tuesday. >> Tuesday. We got here like Friday. >> Okay. Friday. >> What was the purpose of you coming to Miami? Um, work. >> Got it. >> Uh, he had a few u music videos he had to do, you know, just work. >> Okay. Let's get into your work a little. What do you do for a living? >> Uh, I'm a bodyguard. >> Okay. For who? >> The baby. >> Baby. And is that part of is is that part of a record label or you just work directly for the baby? >> For the baby. >> Got it. Um, and when you guys travel down here, was it the entire record label? >> Yeah. >> What's the name of the record label? >> Uh, Billion Dollar Baby. Got it. >> Sergeant Javier Fernandez of the Miami Beach Police Department, begins the formal interview at 203 p.m. on the 1st of June, 2021. Michael Leota, a bodyguard for the baby from North Carolina, raises his right hand and swears to tell the truth. This custodialike questioning occurs hours after the shooting, where Looda provides a firsthand account. Under Florida law, such interviews require no Miranda warnings for non-suspect witnesses, but statements must be voluntary to avoid fifth. The water recounts the group's arrival around 8:30 p.m. The entourage, including the Baby and Associates from Billiondollar Baby Entertainment, exits vehicles outside Prime 112 after a performance at Hard Rock Stadium. Some members smoke in the street, a minor public nuisance under Florida statute section 877.03, but not escalating yet. Officers later detained the group on a causeway bridge for matching vehicle descriptions. A black Cadillac SUV invoking Terry v. Ohio standards for investigative stops amid an active shooter scene. As the group approaches the entrance, Lakota hears shouts of, "I'mma kill you." in an accent he identifies as Cuban Spanish. He turns right and witnesses associate Marcus wearing a blue shirt and jeans shot in the back by an unknown male in a white tank top and colorful shorts. The suspect draws from his waistband and fires without warning. This initial act raises questions under Florida's justifiable use of force statute section 776.012, which permits non-dely force only against unlawful threats. Lakota experience with firearms from range training describes the shot as targeted and remorseless. Chaos ensues with multiple calibers firing rapid bursts suggesting rifles and handguns like 40 or 45. Under Graham versus Connor, any return fire by the entourage would be judged for objective reasonleness based on perceived threats. Florida's stand your ground law. Section 776.013 eliminates retreat duty if deadly force prevents imminent harm, potentially justifying the response. The shooter steps back, enters a white SUV briefly, then locks eyes with Loa before fleeing in a black Chrysler 300 with North Carolina plates. Lot attempts to open the passenger door but finds it locked. The vehicle speeds through police lines. This evasion could support resisting arrest charges under section 843.02, though self-defense claims may apply. Officers bridge stop of the debab vehicle later relied on matching descriptions lawful. >> Um, so did all your the artists belonging to that label uh travel down here? >> Yeah, everybody everybody in the label traveled down. >> Okay. when you say that you guys were here for work. Um, just so we're on the same page, everybody under that label is a rapper. >> Yes, sir. >> Okay. So, they were performing down here. >> Yeah. >> Where at? >> Uh, Hard Rock. The big Yeah. Hard Rock uh uh theater or you know. >> Got it. Got it. >> Yeah. >> So, [clears throat] there was like a concert there. >> Concert. >> Got it. Got it. And then uh when was the concert? concert was two days ago. >> Got it. >> And you guys decided to stay after to what? Just to enjoy Miami. >> Yeah, just enjoy Miami. You know, relax. >> Got it. Got it. And where are you guys staying at right now? >> Uh hotel. >> Okay. >> At the JM Marriott. >> Got it. What room number are you staying in? >> Uh 2123. >> Got it. Got it. Um, so how did you end up here in Miami Beach last night? >> Uh, we had uh the whole record label. We had went out to get something to eat. >> Got it. Um, did you guys take a taxi down here? >> No, we had our we had uh No, Uber. Like three of the three of the trucks were Uber, but one of one of the trucks were ours. >> Okay. Okay. And which is the truck that you rode in? Uh, I rode in Uber. >> Okay. >> That's the truck we was in. >> Who was in with Who was in that truck with you? >> Me, my brother, the baby, his brother, and my other brother. Got it. >> And the cameraman >> with the dreads. >> Got it. Do you remember the name of your driver? [sighs] >> I don't. He was a Spanish dude [clears throat] from Cuba. >> Got it. Got it. So, he picked you up from the hotel. >> Mhm. >> Okay. And he drove you straight down to the restaurant. >> Yes, sir. >> Okay. The restaurant we're speaking about, do you remember the name of it? >> Prom something. Prom something. >> Got it. Got it. So, what happens when you arrive at the restaurant? >> Uh, soon as we arrive to the restaurant, we step out the car, about to walk up to the restaurant. I look to my right and I just I hear um some I hear somebody yelling, talking about he was going to kill you. I'mma kill you. I'mma kill you. And then [clears throat] I notice a dude right behind my partner pulls out a gun, shoots him right in the back. And soon as that happens, I instantly try >> Let's slow down a little bit. So when you guys arrive, you guys What happens? You guys exit the car. >> Mhm. >> Okay. And what's going on when you ex when you exit the car? >> Um >> I know some of the I know some of the entourage what we've gathered so far, some of them were smoking weed in the middle of the street. Um, were you hanging out? Were you talking to anybody? >> Soon as soon as I hopped out the car, everybody just going straight to the restaurant. >> Okay. >> And like [clears throat] I said, we were >> When you say straight to the restaurant, you were talking about the main entrance. >> Yeah. >> Got it. So that's where you were headed to the main entrance. Okay. >> So what happens there after? So, [snorts] so as I'm about to take the first step, I look to my right and then that's when I notice I I just hear somebody yelling, "I'mma kill you. I'mma kill you." And then I And as I'm like trying to >> Let me ask you, let me ask you going back to what they were saying. Um, okay. So, in North Carolina, um, you guys talk a certain way. It's a natural thing. You know what I mean? It's like like in New York they talk a certain way, >> right? >> You know, you understand what I'm saying? It's like an accent thing. You know what I mean? [clears throat] >> Um, >> in Miami, we talk a certain way. Like, I'm Cuban. We're Cuban. >> I'm sure you noticed a slight Spanish accent in the way we the way we speak. >> Mhm. >> So, when you heard those phrases being thrown out there, >> what what were they again? >> What he said? >> Yeah. >> Is I'mma kill you. I'mma kill you. >> Okay. Did did you were they one of somebody that voice that you recognized from your group >> or >> No, I didn't I didn't I didn't hear nobody's voice but that voice. >> Okay. >> And that's what made me look to my right. As soon as I heard him yell heard somebody yelling, I looked. >> So, how would you best describe that voice? >> He he was Spanish descent. >> Spanish. >> Mhm. >> Okay. So, you've dealt with Spanish people before? >> Yes, sir. >> Okay. And you feel as if he was Spanish? Yeah. >> Okay. I'm sorry, sir. Go on. So, you heard that and you turned, right? What did you see? >> I I see my partner Marcus standing facing the white truck and the guy >> Do you remember what Marcus was wearing? >> Yeah. He had a blue shirt. >> Okay. >> He had some jeans and some boots. Some like tan and blue boots. >> Got it. And then what else did you see? And um that's when I seen the guy right behind him pull out the gun and instantly shoot him in the back. >> Okay. When um [snorts] when you say you see the guy, was that the first time you saw the guy? >> Mhm. >> Okay. What was he wearing? >> He has some he had uh some shorts on and a all-white beater. >> Got it. Got it. Um what color were the shorts? the it was like a white, orange, like some crazy colors. >> Got it. Got it. Um and you see him pull out his gun from where? >> From his pants. >> Got it. Um and what does he do from there when he put Does he threaten anybody with it? >> No, he doesn't. He doesn't even say a word. He takes out the gun and boom, shoots him right in the back. >> Okay. Do you have any experience with weapons, with firearms and stuff like that? Yes, sir. >> Okay. Do you shoot frequently? >> Uh gun range? >> Yeah. >> Yes, sir. >> Okay. So, you know the whole the whole philosophy about, you know, aiming, shooting, and stuff like that. >> Yes, sir. >> Um based on your experience and what you interpreted from what you saw there, um do you feel as if he was targeting Marcus? >> Um yeah. >> Why is that, if you don't mind me asking? >> Because it's just the way he pulled out the gun. He was right behind him and he just boom. It's not like he was trying to aim at nobody else. He just pulled it out. And maybe he he just looked at him like he was a big dude. He didn't want to scuffle with him and he just did it so quick. No remorse, no nothing. Like >> what did he do after he shot? >> After he shot him in the back. >> Was it just one time? >> I can't even I I don't know because after he shot him seconds later that's when I heard gunshots. So, >> did you see from where they were coming from? >> It was so loud. I just instantly try to take cover. [clears throat] And as I'm taking cover, I'm trying to make sure Marcus is all right from a distance. I see him laid out, his arms is laid out on the floor. So, I'm thinking like, damn, he's dead. You know what I'm saying? But I'm I'm still trying to make sure he's good. I'm trying to get get to him. So, as soon as I hear the fire shots, I'm I'm just I just took cover. >> Got it. >> So, then what happens? You take cover. >> Yeah, I take cover. And then as [clears throat] I'm trying to run towards Marcus, the guy that shoots him, hops in the car, hops back out, runs in front of the white truck, looks at that's when we lock eyes, looks at me, and then runs full speed into the the Chrysler 300. >> Okay. So, just just so I could get this straight, there was a white car parked, >> white truck, like a Jeep, >> like a Suburban. I think it was like a Suburban or a >> So, so let's So, safe to say it's an SUV. >> Yeah. >> Okay. Um, so he shoots Marcus. He runs back to the car. >> No, he shoots him and steps back. >> Got it. >> He takes like three steps back, looks around, and then that's when he runs back in the truck, hops back out, runs in front of the >> You see him doing anything inside the truck when he goes inside? >> Mm- It was like so dark. I I I don't know what he was doing. >> Got it. >> But I know he hopped in the truck and hopped back out. >> Okay. And what are you what are you seeing at that point? Like what are you just keeping your eyes on him? >> Mhm. >> Okay. >> Cuz I wanted to make sure like I wanted to lock eyes with the person that shot him. I'm trying to, you know, get get his description and everything like trying to lock eyes with him so I can know how he looks. So as he as he walks in front of the white truck, that's when we lock eyes. So when we lock eyes, I'm thinking like he about to take out his gun again and shoot me because I'm seeing it. You like we locked eyes and then he instantly runs into the Chrysler 300 going around. >> When you say you locked eyes, um Mike, how certain are you that you will be able to recognize him if you were to see him again? >> 100%. >> 100%. >> Yes, sir. >> Okay. So you locked eyes with him and then what happens? And then as we lock eyes, I don't know if he got scared, but he just instantly runs full speed into the Chrysler 300. Hops in the car. He hops in the car and tries to speed off. And as he's trying to speed off, I'm trying to run towards the car and try to like, you know what I'm saying, open the door or something. >> Where are you? Where are you at this point? >> I'm like in front of our vehicle. >> Okay. >> Hold on. The second vehicle cuz you know it's four. It's four trucks. So I came in front of the second truck, you know, just peeping like, you know what I'm saying? That's when we locked eyes. As soon as he gets in front of the white truck, we lock eyes. And then when I when we lock eyes, I'm thinking like he about to pull out his strap and shoot me cuz I seen it. So he puss, you know what I'm saying? So >> Mike, one thing I didn't ask you, were you armed? >> No, I'm not. >> Okay. Okay. >> I was not armed. [clears throat] >> So go ahead. Sorry for stopping you. So, um, so as soon as he runs in front of the white truck, we lock eyes. As soon as we lock eyes, I take cover. I'm like going like this cuz I'm thinking like he might pull pull the strap out on me and shoot me cuz I seen what happened. So, he instantly gets scared and runs. This is the car. This is the white truck. He sees me. I'm right here. He instantly runs around the 300. Hops in the driver's side. closes the door and speeds off. And as he's speeding off, I'm trying to run and open the door. You know what I'm saying? That I don't know why I did, but I was just trying to, you know what I'm saying? Trying to open the door. You know what I'm saying? I'm like, that's that's Marcus's car >> from where? From the driver's side or the passenger side? >> The passenger side. Okay. >> Trying to open the door [snorts] and the doors was locked. He speeds off. And at this time, as he's speeding off, police is already ahead. They're already ahead. You know what I'm saying? I'm thinking like, you know, they going to get him. I didn't know if the police got him or not, but police was like damn near blocking the whole street and it was like a lane in between the police. He speeds right through there and that's it. We hop back in the car and then we we drive off. >> Is there a reason why you guys didn't wait for the police? >> No, it's just I don't know. >> Scared? >> Scared? Really? They were shooting. I I heard about a good like good 20 50. I don't know. It must have been It It was a lot of shots. It was a lot of shots. And only thing we was trying to do is just get away cuz we didn't know where the shots was coming from. >> Did you see anyone else fire a weapon? >> No. >> Okay. >> I didn't see nobody firing arms. Did >> you hear different sounds of different calibers? >> Yep. Yep. >> Yep. >> In your opinion, what were they? Were they rifles? >> I don't know. It was It was It had been cuz it was like D and then another set of five um of shots. It sounded like a handgun like a sounded like a damn 40 or 45 or something like I don't know. I can't really tell you, but it was it sound like three different kinds of shots. You know what I'm saying? >> So, I'm not sure where these shots are coming from. We just trying to get out of there. >> So, when you guys got in the car, who was in the car with you? Uh my brother, my two brothers, the baby, his camera, his um his brother and the cameraman. >> Got it. And what happens with the vehicle takes off where? >> Which one? >> The the one that you're in. >> Oh, we go we go straight ahead. >> You know, go straight ahead and we just >> started driving. >> At what point did you get contacted by the police? Um, we didn't get in contact by the police as we're heading. We was on that bridge and I guess the police stopped. I guess they stopped traffic or whatever. I guess looking for whatever car that was involved in this situation. So that's when they got they told us I guess the description was of the of the truck was um Cadillac truck. You know what I'm saying? And they told all of us to get out the car. Um they told us to sit on the side the street. >> Got it. >> As they searched our car >> and then you ended up here. >> Yes, sir. >> Got it. >> Um Pete, you got anything? >> Um no. >> Mike, uh have you understood all my questions? >> Yes, sir. >> Okay. Um do you have any questions for me? >> Um no, sir. Is there anything you want to add to this interview that maybe I didn't ask you that you feel is pertinent? >> Oh, sorry. >> All right, Mike. I appreciate your time, man. >> Yes, sir. >> The time is now 2:20 and this concludes this interview. >> Radio traffic reveals a wounded male later identified as a suspect shot in the shoulder outside Prime 112. Rescue dispatch for the three male injury. No officers fired avoiding Tennessee versus garner scrutiny on deadly force limits. Florida Statute Section 776.06 permits officers deadly force only against imminent threats or escapes a threshold not crossed here. The response prioritizes containment over engagement. On scene, officers collect shell casings under cups to preserve evidence while directing crowds through the restaurant. Tactical positioning avoids the fatal funnel near vehicles. Lew explains the entourage's flight as fear-driven, not evasion. Hearing 50 shots from unknown sources, fleeing a crime scene without violence does not automatically violate section 843.02, 02 but hinders investigation. The baby SUV is stopped on the causeway occupants ordered out per Pennsylvania vim's authority during traffic stops. A search yields no weapons leading to release. This detention balances Fourth Amendment protections with officer safety in an active manhunt. No probable cause for arrest, but reasonable suspicion from vehicle match sufficed. Units detain a suspect near South Point Drive, matching the Chrysler description. The white Honda Civic fleeing westbound on Second Street adds to the multi-vehicle pursuit. Under Graham versus Connor, the takedown's reasonableness hinges on perceived flight risk and armament. Florida's policy requires deescalation where feasible evident in commands to show hands. The interview concludes with Lakota confirming understanding. Radio confirms no ongoing shots when detained. Following the incident, Wisdom Aoot and Christopher Urana faced attempted first-degree murder charges under Florida law. The baby was released after questioning. No officer discipline reported highlighting effective response amid >> knows everything right. 943. We're going to need aviation. >> He's fine. Kiss them.
