I didn't call fire arrest, sir. >> No, not but I I did. >> You said what? >> I did because apparently there there might have been a or something. >> Yes, >> he asked my my my husband's to me. He slammed me on the ground. >> I was walking away from him. He slammed me on the ground. Then he went in there and told them a whole bunch of lies. My dad me out. I couldn't do it. >> No, I didn't. No, I didn't. >> And I have barks on my arm. I have marks all I can show you. I don't have to lie, sir. I got marks everywhere. Literally all on my legs. >> Where'd you get I think >> it was like over here somewhere. Oh, when you got to come >> and he's going to lie and I could not breathe. I screamed. He me harder and harder and I want to press charges. I'm done. What's your name? >> Zaria. >> What's going on, >> sir? I was Here's my ID. >> I was looking for my police commissioner identification that I could not find. I'm an elected official. I guess you've heard it all. So that's not here or there. Didn't know that. But you can run me and say I was sleep. We leave today. We've been here since Tuesday. My daughter and her son. I was I was asleep and all of a sudden screaming and I'm like what? [clears throat] And she's I don't use those expletive you. And then she come screaming running. She went to the drawer going to pull out and coming. I'm like, "What are you doing?" >> Where was she coming at? >> She came through New York cuz they're in that guest in the pool house. And my daughter, I'm like, "Serious, stop it. Stop." And she got that up. And I grabbed holder cuz I'm like, "I don't know. I don't want nobody there." I'm calling the police. You all I can't breathe. You all I'm calling your You all are going to jail tonight. I said, "Please call me." Who is she going for? Was she trying to >> I don't know if she was trying to get at her husband or if she was trying to go to go towards us, but we're the ones who were block of her. >> I was like cuz we're trying to separate them too like cuz we're all going to scream. Well, she's screaming at him. He's coming in here trying to get away from your stand. >> I am so embarrassed. I cannot >> Where's her? I don't he had power to the marriage. So he may be the baby girl. Okay. So we going to talk about >> he said he woke up to her punching him then she woke up and went through his phone >> and I guess like >> that's what >> and I'm like zer what are you doing and I just said I'm so tired sir I'm so tired of all of this we came out they've been on some TV show love So, just to get the the story again, you and dad are having an argument. >> No, me and my husband decided he ran away. He took his daughter and ran away. >> Your husband ran away? >> Yes, because he's a fell. He's scared. He started >> Is that his vehicle? >> No, that's my dad's birthday. >> So, this over here is complaining that she got hit by her dad by her dad. She does. I don't think you know what argument my husband I was walking away slam my head on the pavement by the pool and I started screaming my dad comes out and starts screaming at me I'm telling him like leave me alone he comes in there he comes in the kitchen. He starts me and I couldn't breathe. I'm screaming. Then then my sister comes and attacks me. My mom, they literally all jump on me. And I should tell you the truth. I don't even have this other one by my leg. And everybody start jumping out. Where are we right now? I don't even >> You want to check out at all? >> Yeah. What was my name? >> What's your address? >> Um when he gave up, I was like not You always >> Hello. >> Oh, hi. >> How are you? I'm hungry. >> You looking for the husband? >> Pardon me? >> The husband >> of the young lady. >> You looking for him? >> Mhm. >> Oh, he's not in here. I was checking on the baby. I was I don't know where he is. >> Is somebody in here with the baby? >> No, nobody's in here. >> Sheriff's office. Anybody know where he went? >> No. >> He was out there when I went to my room. So, I don't know where he was. Is he in the house or he's not sure? >> Okay. >> Sheriff's office. >> All right. Well, I'm going still check cuz something took place in here and uh we got to figure out what happened. >> Let me So, where she leave today, right? >> Are you guys leaving today? >> Yeah. >> You left according to her. So, husband primary primary Okay. So, you and Mr. Dale were in an argument and then somehow got pulled out and then he slammed your head on the pool. >> He slammed my head on the pool first and then I came in >> like in the water or >> No, on the side like he was about to. >> Okay. And then I came in cuz I'm screaming and my dad came out. He started yelling at me and I'm like and he starts blaming me. My husband saying that I was being disrespectful and trying to justify his action. So I'm upset like what are you talking about? You literally just hit me and my dad's not doing anything. He's continuously yelling at me. So I'm like okay like what what's going on? And I'm like trying to get to the front door. My dad grabs me and he literally goes like this and me and I'm like, "Dad, screaming." Then my sister jumps on top of me and I'm like, "I can't breathe." My dad talking about some, "Oh, you can breathe. How can I breathe?" Like, literally, I'm telling you, I'm turning red. And he kept going harder and harder and harder. Like, he was going to me and he like, "Call the police. I don't care. Nothing's going to happen to me." >> What's your dad's name? >> Henry. >> And mom was in there, too, or no? >> I didn't even I couldn't see anything. be in trouble. >> So, anyone else in there that witnessed it? >> No. >> So, really, it was you, Mr. Dale, and Mr. Henry? >> Yes. >> Okay. From my apartment, finish talking to whomever he's talking to inside. You have any idea where Mr. Dale would have gone? >> I don't know. Probably walking around. He don't have a car. >> Do you have a picture of him? Did Mr. Did Dale say anything when he was leaving? >> I didn't even know he was. >> What injuries did you sustain today? So, it was >> my ankle and I have bruises on my leg. >> Okay. >> I do have to take pictures of you. Is that okay? >> Why? is I'm documenting this incident. So since domestic violence related incident, usually have to take pictures of the complainant and or victim. >> I don't want to take pictures. >> Okay. Hello. >> Oh. Um, well, when you go to talk to him. Um, wow. Hopefully uh we we're going to try to get in contact with her husband, see where he's at. >> What flavor is that? >> I don't know. I just got these down here. And in this it's all going to bring me smear him before the angel and she know >> can't hear you. >> He is. >> He is. >> Yes. >> Talk to him. Yeah. I know. >> Okay. popped up. So from the beginning, my wife decided to go through my phone while I [clears throat] was sleep for whatever reason that transpired throughout the day and didn't had nothing to do with us. But for whatever reason, it pondered on her mind. Well, I wonder what's on his phone. So this guy go to my phone, woke to her, woke up to my phone in my face, literally like what's wrong with you? She's storming off, walking up. I follow her out. What's wrong? What's wrong? She tell me, "All right, I don't have no shoes on." I come back into Airbnb. She comes back in the room, packing her bags, storming, making all this noise, wakes the kids up. What are you doing? Oh, I'm leaving. Okay, cool. So, now tell me, my daughter gets up. She leave. I'm telling her, sit down. I'm going over to events with her, telling her you're wrong. You know what I'm saying? You're doing all of this. You're wrong. I'm telling you why you're wrong. She don't want to hear nothing that I got to say. So she leaves. She comes back again doing the same thing, turning on the lights. She took a shower, you know, banging, slamming. So now I get up and I leave. Put my stuff on and I left. Grab my bag. I left. Come back in the room. She's gone back and grabbing things and she's leaving out. Stuff is right there by the door. The stuff she's packed. So now she don't like what I had to say to her. She leaves out the room. She got injuries because she walk and the all the beds have this the frame in the front and she keeps banging her leg on it while she walk. That's the other side. Anyways, so now she's outside and screaming for whatever reason. >> Outside your room. >> Yeah. Out there screaming talking about some you doing this. I didn't do nothing to you. Her father came outside. I ain't do nothing to her. She's sitting there screaming trying to get in the door because I had the door locked. And then that went from buku [clears throat] crazy to her coming in here. And that was that's all she wrote from there. Nobody attacked her. Nobody put their hands on her. They were trying to calm your crazy ass down. As simple as that. Everybody was trying to interfere to calm down to see what's going on. I've been quiet this whole trip and I told everybody that I'm going to speak and I said what I said. I apologize for cussing, etc. I don't I don't get like that. But I just I'm I'm just getting fed up because like so I was if justifiably if I would have woke up rung her neck all around within the first 45 seconds of me waking up I'm not in my right state of mind. You getting somebody slap you in your face. You get left be like what the going on. You don't know what's going on. I just did that to somebody. Woke him up. Yo get up. He got up running scrambling and the situation is right here in front of him but he's running out there because he's not in his right state of mind. You just getting waking up out your sleep. be like, "Yo, what the excuse my language. What is going on?" So, no, it's it's a bunch of family bull crap that don't need to be going over our on vacation where none of us is from here. We're miles and hours away from home and no police, none of that. Shouldn't even be here to begin with. She need to stop doing she not she shouldn't never even called y'all because of what she did. And you want to try nobody attacked you. Of course, y'all going to come now. You said, "Oh, somebody jumped on you." That's of course that's the quickest way to get y here. But nobody jumped on it. I was wrong doing it. >> So did anything physical happen back in the room? >> No, ain't nothing physical happened. But besides her hitting me with that phone, she's she's a she's a light-skinned woman. You see the the only bruise she had on her. But if unless she fell on the floor or something like but before that, the only bruise she got is on her leg because she hit the keep hitting the headboard of the bed. Every time she walks off, it it jolts out. She keep hitting her leg on it. And she told me that >> she literally had like two or three bruises literally from the day. And I got I got video proof of her even saying that. She was on live earlier. Look y'all. Y'all see this bruise? Look, I got it from hitting it on the bed. It I should sue these people cuz that bed is Yes. Just tell her to stop lying. Nobody attacked her. >> I do have to ask, was a knife ever like pulled on you? >> Pulled on me? Oh, no. On me. Absolutely. Did you see enough ever come into the equation? >> Yeah, sure did. >> What happened up? >> So, she picked up >> Yeah. >> Okay. >> Now, her intentions with it, I don't It was about her. >> She wasn't going to do nothing out of her scare tactics. It's just like nobody got time. >> Okay. May I interject? >> One second, sir. Or one moment. I >> We're still trying to get further information. Okay. >> Where were you when you saw here? We were standing facing over here get my brother-in-law >> to try to help diffuse the situation cuz he's a bigger guy. So I was like, "Yo, they my sister-in-law was telling me, please go and get him. Please go and get him." So I went and got him and that's just what it was. I came back. It was trying to basically disarm her and, you know, calm her down at the same time. Her sister and her father, I was trying to calm her down. >> Yes. >> You did want to say something, Mr. Yes, >> it's of my Okay. >> It's of my opinion. >> Okay. >> It was just a matter of creating it just chaos. She just gets into these chaotic so that then she becomes the focal point. Everybody trying to and I [snorts] was like What? Why aren't you going back to him? I need to go and get my stuff. >> Right now, you're going to get detained. Okay. And so we continue figuring out what's going on. >> That's crazy. Yo, not running. It's literally my son is in the back by himself. No, he's >> not your sister. One female detained. going to take these cuz they go can't go in there with you. Do >> you have anything in your pockets? Laggers, bears, grenades, nuclear bombs. Use the back of my hand. >> Right now, you're not under arrest. You're just being detained. All right. So, What? He was in the room with y'all, right? He was in the room with me and my daughter. He was asleep. He don't even know what's going on. I don't even want to. That's going to make him flip and go crazy. He's hysterical. Please. No. And then his mother is going to be in jail right now, bro. No. >> For months. >> May I? >> Okay. When you get a moment, can you all come in just or tell me to come out? >> No problem, sir. >> We're not out here, please. Our flight is coming. >> Speaking to him could help us make an arrest determination. You know, we just want to find out if he knew or if he saw anything or heard anything that might disprove or prove anything that happened between you and I can't force you to bring him. Oh, you want to see if he was back there with me and her? >> I just want to know what he planned something because just like my partner said is like, "Hey, >> let father make that decision." I f I'm his father, but I got to let his grandfather make that decision. I can't tell. >> Mr. Henry, >> I have a question for you. >> Mr. D says that we got to ask you if it's okay to speak only because he was in the room. So for us before for state statute >> he was over there >> the baby. >> Okay is not going to go to jail. Like literally my flight is in a couple of hours. I have a newborn. I have a child. I have five luggages. I literally cannot carry all. What? What the am I going to do? This is my livelihood. Like this is like she she's she's she's wrong. Okay, good. Just give her a break. She she knows she's wrong. This should I hope this should be enough. Just her being in the car should be enough. She can't go to jail. >> So I hear Mr. Dale and normally for misdemeanor crimes we can do a whole bunch of things but a felonious crime happened one and secondly for domestic cases. Former Governor Rick Scott made it a thing that all law enforcement officers will take the person who is the primary andor if a predominant aggressor was identified the predominant aggressor to incarceration for whatever time the magistrate decides. But it she don't need to be taken to jail. It's not that serious. No. >> No worries. So if anything, Mr. D just hang out on the on the front porch or side. >> Listen, at the end of the day, we like I just told your sister, this ain't the first time we dealt with this. It's probably the second time I dealt with this ever where one family kids got into a fight. or take one to the juvenile detention center. Mom had to stay or either mom or dad had to stay because they don't live here. They live in Kentucky. And like we said, there's nothing we can do. I can't. We honestly if I wish we can let y'all go. Like I told her, I wish I could have just let y'all go. But I wouldn't trust none of y'all if from the fact that we left that nothing would have happened again and then would have got serious. And then now we on CNN and all the know because one of y'all decided to the other one in the neck with and we was already here when we could have just did our job cuz that's what's going to so it's all going to boil down to she already made detention that she went to go grab that's good enough for us like we ain't got time to play with that. Too many people died in domestic my cousin died in domestic that it's serious and it may not have happened. Thank God that her father and them grabbed her. I know she's on medication, but it doesn't over supersede the crime. So, what we're just trying to do is she's going to get arrested anyway. So, we rather keep it to that and let her go when she when they when they let her out cuz obviously Jud's going to read the he's going to read the PC and everything. He know all y'all from going to be from New York. So, they probably going to make plans for her to get out so you can go. But at the same time, it's better than us correcting her cuz remember it's a hold for 72 hours cuz you just admit she taking medication, everything. Now we just went from a day to 72 hours on hold. Now she's staying longer. And to the fact she has a crime that she still have to go to jail for. See what I'm saying? So we can make the process longer. We trying to make the process shorter. All right. Either way, it's going to suck because now y'all got to switch your plans up with baby and ticket and everything and that [ __ ] suck. And I'm sorry, but somebody is kind of sorry. I I know you got what? One, two. You have two kids with her or just two kids and >> No, that's three kids, but the the older kid is going with the grandparents. I have my daughter and our son. >> Okay. >> My daughter, I got to get her back to Buffalo. We live in Syracuse. I drove to Buffalo to go get my daughter. So now you got to >> to bring her out here cuz that's where I'm originally from Buffalo. So we drove to Buffalo to go get my daughter. I all my stuff is in Buffalo. Like >> so your plans to be just fly back, take her. But you still have your son. Most likely she's going to get out um she see the judge most likely cuz y'all don't live here and she's going to have to just find a ticket and fly back or try to do redo her ticket. Um like I told her the same thing. That [ __ ] sucks. But we cannot there's nothing we can do for that. Like it it just sucks. I hate that y in this situation. But sometimes people got to think before they act and we can't control that. So I rather it's like this than you know we picking up somebody body on a stretcher bleeding from the neck and everything cuz it has happened. So >> Oh my father's upset. Y'all was down here for Christmas. >> Yes. This is Christmas vacation. I have to work tonight. I'm going to th lose my job because of this [ __ ] Like I don't have no more like me seeing the rules and moving. Thought that sign see when y'all get back the grandparents can help out if they don't work. See if we can get that help for now. We can so she can get out of here situation. >> Not necessarily not because y'all already been through it. We can't let y'all talk to each other after y'all just after we're here for y'all. >> Yo, bae, I love you. You got me tight, dude. As just listen to him. I be This why I tell you to listen to me all the time. This is why I tell you to listen to your husband. I'm mad as [ __ ] man. >> How long y'all been together? >> I've been with my wife for 6 years. To see her, bro. I don't like to see this [ __ ] from nobody cuz I know how I feel. I've been incarcerated. You know what I'm saying? I just did 7 years of my life in prison. That's how I found her. That's how I met her. Know what I'm saying? My glory always. It's like bad situation. You know what I'm saying? This is not good on all parties. Like this this this don't mind me asking what you do seven for? >> I do seven for criminal possession of a weapon and second attempted robbery in charge. in New York. >> Yes. >> And how your relationship been off and on as far as like I mean we had the dates we don't always >> Yeah. That's our relationship. >> But overall I mean [ __ ] we got we just had beautiful son in 4 months. >> Mhm. >> You know we live pretty all right. We both work [ __ ] the maintenance worker driving machine. I do the graveyard shift so I don't have to take child care and then she worked during the day. So I had a baby during the day. She had to put me in night time. You know, we split them in in the evening time for the most part. We can run the TV show. >> No. >> Mhm. That's another reason why I don't want to actually go to jail. She don't get [ __ ] I don't got time for that [ __ ] God damn immediately. So it's like that's immediately I don't want her doing the same. I want her in the back. >> Ain't nobody going to know unless somebody put information out. She has a very very unique name. >> Yeah, I know. You just you just got to hope nobody looking at the uh booking block. He said love out the lock up. I don't know that. So I'm brought up to speed. So as of right now you are going to be placed under arrest for simple battery. Okay. Um due to the multiple accounts inside the house >> going under arrest. Okay. >> Please, sir. My son can't get home. >> He's a newborn. He can't I I It's under my thing and I can't They can't change it if I don't talk to him. >> You have family in there that's going to take care of him. Okay. And And but I don't In the state of Florida, we don't have discretion when it comes to domestic violence. >> I didn't I didn't hit anybody. >> I didn't hit anybody. We have account. We're being told that >> you hit your husband in the face with the cell phone. >> No, I didn't. I didn't. But there was nobody. It was just me and him. How are you just going off of what he said? >> And I have bruises on me. >> Okay. How'd you get those bruises? Where the bruises on your knee? On your legs? >> Yes. >> Okay. [clears throat] And what's up with that? >> You said what? >> That was an airplane. I didn't touch any. I was literally being >> Okay, give me one second. Okay. >> Please, sir. I have a newborn. Please. Please. I've never been arrested. Please. Um, I need to Can is there a way you can get a message? My mom my my newborn is on my Southwest. We're supposed to be leaving in a couple hours and Southwest will not let her change the thing and and he she won't be he won't be able to leave. >> So she can't So she won't be able to fly the newborn out because he's on her ticket? >> Yes. And they they're on standby. So it's just me. He's the only one that's on my ticket. All right, I'll let her know >> cuz if she calls someone, she doesn't have any of my information or anything like that. They won't change it because it's under my >> No, because she she doesn't have a ticket. She's on standby. So, she's flying through United. So, he literally will be stuck here. >> Well, you got to be stuck. So, >> they're all flying in United. >> I understand that. What I'm saying is the baby just ain't going to be here without nobody watching. >> But I'm saying who is going to watch him? >> It's going to be either your mom, your sister, or somebody in the family or his his dad. Is that his dad? >> Yeah, but they don't But he's not on the the flight information. >> He's going to have to figure that out. They're going to have to figure that out. Long as he has the the accessories like the milk and all that. cuz he can't do that, right? >> He can't change anything. It's under my name. >> He's going to have to just purchase him, too. I mean, honestly, you I don't I wish I could give you more information on how to fix this, but you know, like 6:00 in the morning, y'all going at it. It's not the ideal thing we're doing. We have to leave, >> right? That's why I was trying to get away. That was it. That was all I was trying to do is get away. I kept leaving and now it's being blamed on me. I literally called reached out. Well, we here because whatever verbal y'all had got more than verbal and it got physical and now we have to step in. I wish we could just let y'all go. But that wouldn't have been good enough either cuz I wouldn't trust none of y'all that if we would have left that y'all would have got into it again and we'll be back in the same spot. >> Right. But my Uber was I called the Uber. I was literally talking to the the fire people and they were like, "Why don't you call the Uber so that you can be able to leave? My bags are already packed." >> Yeah. Honestly, we all we all should have kept it at that. if you were going to leave and all that, she just stayed with it. Not get not get back into it cuz y'all know y going to say things that a y'all ain't going to like and y'all got back into it for no reason. Cuz what y'all could have dealt with could have dealt with at home. Not in another state talking to stranger stranger ass deputies and stuff. I'm pretty sure that was the last thing y'all want to do on y'all trip. Take care baby. Take care of my baby. Babe. Babe. Huh? Take care of my baby. Please take care of my baby. >> I didn't do nothing. You told them I hate you. That's why you were sleeping. I didn't tell. I didn't knock >> him. >> He was knocking. >> No. >> Yeah. Is it possible that she can turn my phone? I need my phone. I need to use my phone. >> No, the phone was off. The phone was off. The T-Mobile turned it off. >> Huh? >> T-Mobile. Our phones. Our phones got shut off. I was supposed to pay it this morning. She said she [ __ ] pass. >> Huh? >> You take off that pass? >> Yeah. Well, like I was supposed to pay it like I got paid this morning to pay it. It was due on the 24th. >> AT&T. Like he can't >> it's under my name. >> It's under your name. >> Like he can't he don't have the >> He not going to be able to do nothing. He not going to be able to get on the plane with the baby. Like he's not going to be able to do nothing. situation. I got to stop. >> You told him. You told him. What did she say? What did she What did she was? You unlock it. I'll be bringing you to the jail. Can you grab one bracelet? Bracelet. Still got a couple bracelets on if I need to. Go ahead and face the car, please. Thank you. Lean forward cuz if I pull this, it's going to be uncomfortable. >> Where's your different ones? >> Yeah, these are smaller cups. So, >> you're special, huh? Put your hand on the hood of the car, please. Um, take your bracelets off while you have the puffs off. What's up? >> I'm talking to myself. >> Yellow one, two, three. Oh, yeah. It's on that thing. Have to click it and then take it off. We'll deal with those in a minute. Do you have anything else on you that I need to worry about? You have press on nails. I'm tired up here. I've got acrylics on, too. All right. All right. Put your hands I'm sorry. Let me do this before I put the other on. Yeah. Put them together like the prank. Yeah. Won't be as uncomfortable. >> Yeah. Do you have any hair ties on or anything? >> All right, go over here. >> My um ankle is like rolled on a little bit. So, >> okay. This hurts. I had an ice pack, but I think it's f. We're going to go on the other side. Which ankle is it? >> The left one. Well, if you're walking on it, that's a good sign. Yeah, >> I think I like roll. You know how you roll? >> Probably just irritated it. >> Yeah, just lean back on me for just a minute. Change positions. Where's the bubble? Right. I'm usually uh pretty good at getting this on the first try. Let's try that again. Oh, please. >> No, if you sit in the car, you can sit. You can sit up in the car. I have >> scoliosis. So, my back is like >> Okay, >> that's why you're quick. I turned around like, "Oh my god, what is >> I'm a wizard." >> Can I ask you a question? >> Yeah. >> Um, what am I being charged with? >> What are you going for? Domestic battery. >> What is >> Domestic assault? I'm not really sure what the charge is, but it's domestic. >> Um, what is that in Florida? >> I'm sorry. >> What type of charge is that in Florida? >> I don't know what he charged you if it's a misdemeanor or felony. Um, but for any domestic cases, you have to go in front of a judge in the morning. So, you'll talk to the judge tomorrow morning. >> What do they Is it like I don't know. Is it different here? And I'm from New York, so that's why I'm asking. Is that to like defend my case or like >> No. So, it's um >> arraignment. >> It's like your arraignment basically. The judge will look at the case. um he'll either RR you release you or he'll keep you until your 30-day court date or whatever they decide. Um he'll talk to you in the morning about it, but it's not it's not for your actual hearing. It's not for the court hearing. It's the state attorney going forward with the with the charges that they have. It's your f I'm sorry. It's first appearance is what it's called. >> Would I get bail? >> I'm sorry. >> Would they say like >> issue a bond or a bail or bail amount? >> Okay. >> That's us that's when they do that. Um, and then do I get a phone call? Cuz my my my son is he's a newborn. >> Yeah, you call. So when when they bring you in that first floor, when they bring you in, they book you. You can call anybody you want. As many people as you want. >> Okay. >> They give you a pin to call. Don't give anybody else that pin cuz they can. A lot of people like to trade pins. >> Yeah. How bad is your ankle? Cuz if it's if you're walking in there limping, they're going to send me back out to take you to the hospital to medically clear you. >> I I won't limp. >> Huh? >> I won't limp. >> It's It's on you. So >> I don't want to go to the hospital and prolong everything. >> Let me know cuz they they're very strict there. So if you if you are hurting, you got to let me know. >> I'm okay. >> Okay. And he never read me my Miranda rightites. >> What's that? >> He never read me my Miranda rightites. He's >> No. So, I'll explain that to you in a second. >> Okay. >> I have 31's 1015. I'll be 51 to CJ. >> So, the only time we're going to read you, Miranda, is if we're going to question you about the case, like anything incriminating if you're in our custody already. So, like if you're in handcuffs and we need to ask you any questions, we have to read it to you. But if we've already made a decision on our investigation and we don't have to read we don't have to read it to you because we're not asking you anything. >> Okay. >> That's the only time we have to do that. >> Okay. Thank you. >> I know on TV it seems like >> you have to read it for everything. Put you in handcuffs. It's a very movie. >> I never been arrested. So >> you never been arrested? >> Mm-m. I had like a prior felony but it was um dropped to a misdemeanor. >> Were you a juvenile? Um, no. I was in my early 20s and I thought that it would be cool to keep claiming unemployment and working a part-time job. So, um, they ended up calling me in or whatever, but they just rared me when I got there. And then um I went probation, paid the restitution all off, and then the judge just put it to a petty larseny instead of a felony. >> Where are you from? Is that where you're born? >> Yeah, but I'm I live in Syracuse, New York. I was down here visiting my brother and my I just had a baby. uh se uh August, so he's four months. And um it's his first Christmas. So I took the kids and my family or whatever and we stayed. >> I have two I have a 12year-old. His birthday is actually in 2 weeks and then um my newborn. >> Do you have kids? >> I don't. >> Oh, okay. Let's keep it that way. [laughter] They're a blessing, but it's a lot. >> Yeah. >> So, it doesn't even m the you all have determined based on like who you talk to who basically is going to be the one to get arrested. Yes, we talked to everybody. Even if only we were involved in some kind of >> so because I Yeah. Mind you, this this all this this all started because and I know I shouldn't have did this, but I went through my husband's phone while he was sleeping and I just reacted, you know, like it was just one of those split moments where it's like I start yelling at him out his sleep and then he got upset because, you know, he's being woken and then we start arguing and then that was just my parents got involved cuz we were in the pool house so they hear us yelling and things like that. So I'm thinking like because in New York something like having you get into an argument you call the police they'll figure stuff out and then like they'll talk to each person calm them down and then that's it. It's not like how it is. You know what I'm saying here? So, so we do not. But if anybody utters any kind of >> Yeah, I know. >> any allegation of physical violence, it changes the game. >> Yeah. My Yeah, my mom. And you know who it was? It was my mom. She was just like she was spazzing and one thing left in another and I guess my husband said that she had said something and then that cuz they were going to let everybody go and then I guess they talked to her and then that was that was it. Whatever she said which was crazy because she wasn't even involved. That's why I'm like how do people that aren't even in like my dad was involved my husband but my mom wasn't even involved. So that's just the only thing. >> Yeah, we get calls for verbal time. We go there, we try to make a peace, see if someone can leave at least for a little bit to let things cool off. >> And that's what I thought. I'm like, "Okay, let me pack my stuff." And the fire guy was like, "Why don't you just, you know, take the Uber or whatever?" >> Yeah. >> So that's what I'm thinking. And then I'm like, I'm walking to the back because at that time I wasn't detained. So I'm walking to the back to like finish get my stuff. And then that's when they detain me thinking that I was trying to run, but I'm I was literally just going into the pool house to >> just get away. >> Get away. >> Yeah. >> Good morning. I have an adult female. >> I'm just praying that the judge gives me some grace cuz I can't be away from my baby. I don't even know if he's going to be able to get on the plane cuz I have my phone and they don't have access to the plane tickets. Yeah. And my parents, they're on standby so they have no plane ticket at all. >> Your parents live here or >> No, everybody lives >> lives here. >> Yeah, but my brother's number is on my phone. I don't have my brother's number here. I just have my parents. I'm sure you could call someone and call someone. Call someone. >> Yeah, I thought it was just one phone call. So, >> start with the statute that controls everything here. Florida statute 741.2901 requires law enforcement to arrest the predominant aggressor in any domestic violence call where probable cause exists. There is no discretion. Officers cannot separate the parties, give a warning, and leave. Once the elements are established, someone goes to jail. That is the law. The family kept saying it was not serious enough. The husband said he did not want her arrested. None of that is legally relevant. The mandatory arrest obligation belongs to the officer, not the victim. The knife is what elevated this from a misdemeanor domestic to a felony. Florida statute 784.021 aggravated assault with a deadly weapon does not require that the weapon be used. The threat alone is sufficient. The husband called it a scare tactic. That characterization does not help her legally. Intentionally displaying a knife toward another person in a manner that induces reasonable fear of imminent harm satisfies every element of the statute. Florida courts have consistently held that a knife qualifies as a deadly weapon, per se. The charge carries up to 5 years in prison as a thirdderee felony. This is not a minor enhancement. The misdemeanor battery charge runs parallel. Florida Statute 784.03 requires only intentional non-consensual touching. Striking someone with a cell phone clears that bar without dispute. Now, the Fourth Amendment question. The arrest was warrantless, conducted inside a private Airbnb rental. Deputies entered with apparent consent and remained in common areas. No Fourth Amendment violation on these facts. The probable cause standard under the Fourth Amendment was satisfied by multiple consistent witness accounts and the subject's own admission during voluntary conversation that she had confronted her husband and that the knife was present. She also raised a question that comes up constantly. Why was Miranda not read at arrest? This is one of the most misunderstood rules in criminal procedure and Deputy Bradford handled it correctly on camera. Miranda versus Arizona, decided in 1966, requires advisement only when two conditions are both met. The person is in custody and they are being interrogated. Arrest alone triggers neither requirement. The Supreme Court defined interrogation in Rhode Island versus Inis in 1980 as express questioning or its functional equivalent, meaning conduct specifically designed to elicit an incriminating response. Deputies had completed their investigation before handcuffing the subject. They were not asking her anything incriminating in the transport vehicle. The conversational exchange does not meet the inis standard. Miranda was not required. Television has made people believe Miranda is read at every arrest like a ritual. It is not. The rule exists to protect against coerced confessions during custodial questioning, not to formalize every arrest. The Baker Act came up as a potential alternative. Florida statute 394.463 authorizes law enforcement to initiate an involuntary psychiatric hold for up to 72 hours when a person poses a danger to themselves or others. The deputy noted accurately that Baker acting her would have meant a longer detention than the criminal arrest path. Given that the conduct was clearly criminal rather than purely a mental health crisis, proceeding with charges was the correct call. On use of force, the deputies used verbal commands and soft empty-hand control to place the subject in handcuffs. Under Graham versus Connor from 1989, force is judged by what a reasonable officer would use given the threat level at that moment. A knife had been reported in the residence and not yet located. That fact alone justified a measured but firm approach to taking custody. Nothing observed exceeded that threshold. The predominant aggressor determination is where the legal complexity concentrates. Florida law directs officers to weigh four factors: injury severity, history of violence, the likelihood of future harm, and whether either party acted in self-defense. The subject claimed her husband slammed her head on a pool deck, a separate battery allegation. If true, that is its own offense, but it does not cancel out the knife. Both can be true and both can be charged independently. That allegation against the husband was not visibly pursued on camera. This is a real gap in the investigation. Dual victim dynamics in domestic cases are common and require both directions to be documented, not just the arrest decision. At first appearance, a judge found probable cause on both counts, issued a no contact order, and set bond at $4,000. A state-to-file hearing was scheduled for January 29th, 2026. The no contact order means she cannot communicate with her husband, the father of her infant son. That is the downstream consequence of a domestic violence classification. The statute does not allow exceptions for child care logistics grades. The deputies receive a B+. The legal framework was applied correctly. The force was minimal. and the explanation of Florida's mandatory arrest law given directly to the family was accurate and clear. Deputy Bradford's conduct during transport was a genuine example of procedural justice, explaining the process honestly, acknowledging the difficulty and preserving dignity without compromising the arrest. That matters. The deduction comes from two things. The transport conversation occasionally drifted into personal disclosure territory, and the husband's pool deck allegation was not visibly followed up as a parallel investigation. The subject receives a C. She cooperated. She acknowledged going through her husband's phone and starting the confrontation. That kind of self-awareness is genuinely rare on a body cam, but the knife is the record. It cannot be explained away. The father receives a C minus. physically intervening in the dispute may have crossed into battery under Florida law, regardless of intent, and identifying himself as an elected official and a bishop during an active domestic call raises a concern about attempting to leverage status. The husband receives a Bminus. He was cooperative and consistent, and he did not attempt to weaponize the process against his wife, but he left before deputies arrived, and his own alleged conduct was never fully examined on camera. lessons from this case and there are a few worth keeping. First, jurisdiction matters. Florida's mandatory arrest statute operates completely differently from the discretionary approach in most other states. What ends in a warning in New York can end in a felony charge here. Second, the weapon threshold is lower than most people think. You do not have to use a knife for it to become a felony. Displaying it during a confrontation is enough. Intent to actually harm is not an element of aggravated assault in Florida. Third, calling the police during a domestic argument is not a neutral act in a mandatory arrest state. Once officers respond and find evidence of physical violence, the arrest decision is out of everyone's hands, including the callers.
