Okay, so as of right now, right? >> Do you have any other mother here? >> No, I need to speak with you about what's what's what's going on. >> If anything happens, you need to call her mother. >> Okay. I don't want this to escalate, you know, especially not like you're not with with the child there, but I need to speak with you. Right? So I I need I I >> it if you put her mother on the phone. I will ask her her date of birth. >> I I don't know who that is. I don't have I don't have a phone number. I don't have I don't have a phone on me, right? I need to speak with you. Right? And I'm I'm I'm speaking to you calmly and patiently, sir. I'll speak I'm speak I'm speaking I'm speaking to you calmly and patiently, right? So I'm I'm trying I'm trying to like de-escalate this as simply as possible, right? Cuz the call that we received said that you were you were yelling. Right? It doesn't it doesn't seem like you're yelling right now. All right. So in a in a few moments there'll be another gentleman here who will who will be with the sheriff's office to to back me up on this call. I would have rather I would have So I I No, I would have I would have I would No, that's that's not what's going to happen right this instant. I need to speak with you. If you're not going to speak with me, if you're going to you refuse to like like follow orders based on like what I like what I know of the event the events that transpired up to now, right? If you can't give me your side of the story, or you're not willing to come out and speak with me, then the situation situation's going to escalate. Right? That's That's fine. If you want to do it on that phone there, I'm not going to be calling, right? Okay. Man, no. >> I would really appreciate that. >> I'm I'm not calling any I'm not We don't even You don't even know what's going to happen, right? >> Yes, sir. >> You're being You're being You're being very difficult and not very compliant, right? I just want to speak with you. That was it. No, I I literally just wanted to talk to you. >> I'm sorry, but I can't help you get out there alone. >> You You You You You can step out here to speak because if you don't, then I'm going to have you come out here and it's not going to be a pleasant exchange. So, please, just come out and talk with me. Right? >> Charlie, at this point, if you turn around and walk out >> Is there a towel he can use with him? >> Yeah, she just asked me. >> Let me have a towel, please. Come on. Come on, Charlie. >> Let me grab him. Let me grab him. >> Let her come out and grab him. >> Um No. >> So, what you do? >> I don't know what he had to say but he said that he was very loud before. >> Uh >> Do you want us to remove him? >> I guess. >> Call her mother. >> I already called her mother. >> Okay. Has he been threatening? >> He yelled and made threatening statements or anything? >> He He He keeps threatening. >> No. Okay. What about tonight? Has he made any like actual threats? >> Yeah, he's yelling in our faces and saying that we're immediate worst parents. >> Okay. >> I'm his stepmom. >> Has he been like very loud and stuff? >> Very loud. And she was crying. >> Okay. So, I don't want to lose him. Right. How long um has he lived here with you guys? >> I'm not responsible for her. Her mother is. >> Her mother? >> For her mother says what he's calling about, I think. >> Hey, Jake, is it okay if I come and talk to you? What's going on tonight with you and the parents? >> No idea. We're just squabbling with each other. She was watching her phone. >> Okay. >> We're going to bed. >> You're going to bed? >> Yeah, we're off. Yeah, we're heading to bed. >> Okay. What happened between you and your parents tonight? >> No, sir. >> What's up with all the yelling and stuff? >> Uh no yelling. >> No yelling? >> No, sir. >> Okay. Why would your parents say that there's been yelling and stuff? >> No, sir. >> Okay. Been drinking tonight or anything? >> Yes, sir. >> Okay. How much Well, how much But you No issues drinking. Obviously, you're in a house and you're an adult. Um Anything other than alcohol tonight, Jake? >> No, sir. >> No? When's the last time you have used? >> Used alcohol or Jake? >> Illegal drugs or anything like that. >> No illegal drugs. >> No illegal drugs? Any medication or anything? >> No, sir. >> Okay. Um >> So, if you're like like my shirt or whatever you're wearing >> All right. That's fine. >> So >> I'm talking about stuff that might be like abuse or something obviously. Okay. Is it okay if you come on and talk with us? >> Yes, sir. Right. I mean, yes, it is. As soon as my mother gets here. >> Yes, sir. >> Okay. Can we just >> If you don't mind, sir. >> What's that? >> If you don't mind, sir. Just saying it'll be very short. >> Well, we don't really have time for that. There's only two of us working and there's two of us right here. So, I want to try to get this dealt with. Okay? >> So, is there a ETA for my mother's arrival? >> She's on her way. So, you're saying there was nothing that happened between you and your parents tonight? Th- These are your parents, correct? >> Uh, it's my old [music] man. >> Okay. >> It's stepmother. >> Oh, it's stepmom. >> Yes. >> Is it It's Jim and what's stepmom's name? >> Uh, Diane. >> Diane? Okay. All right. >> Um I mean, she's like I I'm sorry. >> All right. I'll be right back. You want to just sit here and watch TV and I'll talk to them? What happened tonight? Like what What started all this, sir? >> He He has a medical bad drug problem. >> Yep. >> And the only time he sees her is when he does that all the time. And Lexi does some other >> Yep. >> called today and said >> could see we told him it was Friday. And which was fine, so he wanted to be here with everybody and he's I don't think he should have her high or whatever he has he will. And he just gotten mean mean mean, you know. >> When you say mean, what do you mean by that? >> slammed the door, grabbed her and he was screaming at us and calling us [ __ ] He didn't do anything else and >> And when the kid was crying, was it like when he was holding her and yelling and stuff? >> Oh, he said he >> Okay, so you would say his actions probably created that. >> Yes. He grabbed her and then he said he was going to say that we scratched her and stuff like this and then I thought, "Oh my god." >> So typically Lexi has the kid and then she just allows the kid to come here to see you. >> Because she knows she's safe here. >> Right. >> But he doesn't stay here all the time. >> Actually, I was going to ask that because I recognized the truck. Does he usually drive the truck that's in the driveway? >> Yeah. >> Okay, cuz that's >> truck. >> So I've been seeing that at a house that's probably not great for him to be going to. >> What, my mate? >> Yes. >> Mhm. Yeah. >> Well, I just want to ask again, did he make any like direct threats towards anybody tonight like >> No, well, I nothing nothing physically hurt you. He just you're not going to see her thing thing again. That's it. >> never going to see her and then he then he put his hand up and I said, "Don't put your hand up." He goes, "I'm going to say you broke my finger." >> Okay. Um obviously no physical contact between anybody. Like he didn't hit, slap, kick or anybody like that or anything. >> No. >> What do you think needs to happen from this? >> He needs to get higher and sobered up or whatever it is they do to them. >> Yeah. >> I mean we don't want to start all that kind of [ __ ] but >> This is >> he can't stay like this at our house and he can't Right. He just got to grow up. And he's you know he's a nice and decent kid when he's sober and everybody knows him when he's >> I agree with that. I I dealt with him multiple times when he's under the influence and when he's sober and completely different person. Um I'm just trying to determine a couple things here. One if it's a domestic relationship. So anytime adults have lived together, currently or lived together in the past, I can say it's a domestic relationship which can sometimes tie our hands how we deal with things. Um the fact that there wasn't any threats made or um threatening behavior or actual physical violence, it's not a mandatory arrest for us. So it kind of comes down to I would agree that he created a disturbance here tonight. Obviously you guys called us. Um there's a lot of yelling and name-calling and made a kid cry. So he could absolutely be arrested for disorderly conduct tonight if that's something you guys want to see happen. Um the other thing is I can't really force him to leave because he has been allowed to stay here. He obviously has a bedroom here. >> Well >> So I mean is it one of those things where we want him to sober up and maybe just shut the door for the night and try to work things out in the morning or Okay. >> He won't stay in here and sober up. >> Well she's going to take care of these stuff. >> Yeah. Can they get him for disorderly conduct? Who pays to get him for treatment or something? >> No. So that's got to be done through like the court system. So basically what would happen is he'd be arrested tonight. Um it is still technically a domestic relationship cuz you guys live together. He would have to post I think it's a $100 $150 bond, but then he could be released tonight if he has the money. Um and then it's just got to go through the court process. So I mean he might end up on probation. This might get down to a ticket. I mean it's it's hard to say what's going to happen in the end. >> Well, I tell you that the truth I'm scared to death of is like this. >> Right. Cuz I know he has had violent tendencies in the past with other relationships he's had, but I I don't know about you guys at all if he's the same way towards you guys or not. Usually when it comes to parents, it's a little bit different. I understand from your standpoint it's it's hard cuz obviously it's your kid. You Like you said, you don't want to push him on the cold. Is that going to make him do worse things? Is it going to make him fix fix the issues? Who knows? Like I said, ultimately it comes down to what you guys want to do tonight. I I can absolutely arrest for disorderly conduct. One of the things is I'm not trying to downplay anything or make excuses. I'm just laying things out. There's two of us working tonight. Obviously we're both here. If she's coming from Eau Claire trying to separate Jake from is is a big concern of ours. Um just because we don't want to fight him in front of her and we don't want her to get hurt in the process. Um but obviously we can't sit here until Lexi comes from Eau Claire either if that's the route we want to go. >> Where would you take him tonight though? To jail? Is that Is that where you would take >> If we arrested him for disorderly conduct, yes he would go to jail. >> You want to go ask her if you can take time and just hold her? >> If you want to try to talk to him, you can. That's fine. >> That's sad. >> Yeah, I I agree. >> Can I take Please? >> No. No, ma'am. >> [crying] >> I was going to let her get you. >> Do you want to come with Grandma? >> No, >> to get here. Please do not talk to my daughter. Thank you, ma'am. So off, is so cordial. all right? >> She said she wants to come by me and he says, "No way, you're not taking my daughter." "Don't tell your mother comes and don't talk to me and get away from me." >> Let me go try something real quick. >> [clears throat] >> Um >> Well >> If I call Lexi right now and you hear her say that you can go with I'm sorry, Jim or >> Until her mother gets here, sir. I ain't going to If her mother shows up here physically Yes, sir. Any charges against me, sir? >> Okay. So, Jake, here's where we are at. I'm going to ask you to come with us so we can discuss this further. I'm going to ask you to leave Lexi with the grandparents. >> Yes, sir. >> Okay. Then, I am giving you a lawful order. You have to come with us now, otherwise you are going to have further charges against you. >> Am I being detained? >> Yes, you are. >> Okay. Uh may I ask the charges? >> Disorderly conduct. >> Disorderly uh >> Hm? Disorderly conduct, that's the charge. >> How >> So, right now you are teetering with obstruction as well if you do not come with us. And I don't want to have to pull you out of this room because obviously you're But, we are going to do what we have to do. >> Excuse me, so um Sir, did you witness any disorderly conduct? >> [clears throat] >> No, I was provided statements from those two out there. >> Okay. >> [music] >> That's cool. >> All right. >> Did you receive any complaints from anywhere else? >> No. >> Did you receive any complaints from [music] the mother? >> No. >> So based on here, I have reasons to What was this earlier? Sorry. >> The statements that were provided, man. All right. So this is So I want you to think of this as a father. This is something that really does not need to witness or go through. All right? >> Yes, sir. >> And >> until >> So I'm going to ask you again. Please come with us. >> No, sir. Um respectfully until the mother That's why this here and we leave and we'll pick up properly. I, sir, am solely responsible for her because she is in my care. And I will not trust anybody else, sir, respectfully. So until the next she shows up physically, she's probably on the property, sir. I will patiently wait here calmly. Please, sir. Do you know why? >> Okay, we don't have We don't have time to wait here calmly. I'm asking you for the sake of the child not to fight with us in front of the kid. >> Yes, sir. >> Or with the kid on by your side. >> that I was peaceful. >> I'm saying you are going to be coming with us. >> Okay. Yes, sir. >> No, right now. >> Excuse me, sir. But this is Only thing that's important right now. >> Correct. So you need to think of your daughter and let her go to her grand and grandpa. >> Her mother. >> Her mother is coming Her mother is on her way up here. >> My daughter was left in my care. Therefore, I will relieve her to her mother when she shows up or if she's off the property, sir. Respectfully. So until she's further off stairs or whatever it is. Please. Once So, I think what we're going to do is when I have one of them grab the kid, we're going to pin his arms down right away. So, hopefully they can take her and get her out of the room and we'll take her into custody and we'll come. So, we got to do a scene instruction. Um so, here's what we're going to try to do. Deputy Price and I are going to go in. We're going to try to pin his arms down so he can't grab on. Are one of you able to come in and grab and then we can take him into custody. If if that's what you want us to try to do. Otherwise, we're kind of >> I ain't going to >> between a rock and a hard place. Um I mean, I guess Lexi is coming. He'll probably give her the kid when she gets here. >> Um I'm sure he will let me. I used to work in trouble and noise. [ __ ] deer. >> Both of you guys >> Things start going bad, and they go bad. Um I guess we ain't got once twice. >> No. >> Okay. Who wants to come in with us? >> I I I mean, let me talk to her one more time. >> Okay. Yeah, maybe Dad can help, hopefully. Yeah. >> You got them? Hey, sir. Do you have a firearm? >> Yes. >> Hey, sir. Do you have a firearm? >> We're at 103. 103, we have a baby carriage. >> Hey, sir. >> I got to engine >> Attention. >> He's not cooperating with me. >> He's probably going to try to beat me. >> I'm sorry, sir. No, I'm sorry, sir. Please do not talk to me again. >> Well, that's fine. >> [clears throat] >> Hey, sir. Do not talk to me again. Do not talk to me. Do not talk to me. >> I think it's really good that her son will not get her little baby to be safe. >> Come on, John. >> All right. Can I do you a favor? Sit up, Jake. >> Uh you want to search his basement? He's got a bunch of pictures of her. >> Oh, we >> A bunch of pictures of >> Yeah, go ahead. Go ahead, guys. You can search. >> Yes, sir. >> Stand up. >> Yes, sir. Uh miss >> Yep. >> No, I'm just helping her up. >> Are those hands in your back for us? Yes, sir. >> Of course. >> What's what's procedure, Jake? Leave the hands open and closed. >> You want to follow me out this way? >> Yes, sir. >> Uh do you have shoes or anything? Shoes and sandals? >> No, don't worry about shoes. >> All right, stand up. >> Um real quick, I'm going to go make sure Lily doesn't see you walking with the handcuffs, okay? >> Why would it matter, sir? >> Well, I don't want her >> Your interpreter got away from her and you >> I'm going to have you come out then. >> Yes, sir. >> Of course. >> Where are your shoes? Can I make you out of the room? >> I'll go get your car and then transfer her right away. >> I need to walk her like you see me. >> I'll stand and do paperwork. That's what we're doing. >> No, sir. Actually, you know what? Uh you might take it out on a lot, too. I I I'm sure you guys should probably first get all your stuff. >> Yeah, we're going to search you outside. Sir, are you wearing your shoes or not? >> No, sir. >> No, sir. >> I actually have to walk you to me. >> Don't worry about shoes. >> All right. Um just yeah, take everything out of there. Take No, just take everything out of there. >> I don't want to hear >> I don't want him out of here, either. >> I asked you not to. >> Shh, her mother's coming in. >> He said not to come in again. >> All right, let's take him home. >> Sir, I got it. Uh please just drop it off. >> You don't want it here? Or you want it here? >> Just yeah, let him do whatever he wants with it. But I don't have anything to do with it. >> All right, we're going to go to that first car in the driveway there. Um I just have a couple things of paperwork to Jesus, sorry. To go through with you guys quick. It's okay if I sit down? >> Is he gone now? >> Yep, he's on his way to jail. Um he's being charged with disorderly conduct and obstruction since he wouldn't listen to us. >> I hate to see it come down to this tonight. Sorry. >> No, you're fine. This is our job. It's fine. >> Cuz he knows if he gets his dad in here >> It's >> Tell him. >> It says he said it's time for him to grow up. It's unfortunate Unfortunately it has to be this way, but at this point it's him making his own choices. All right. Uh first piece of paper I have here is the crime victim information sheet. Um just lays out your rights as a victim. If he is not able to post bond, which I'm assuming he's not going to be able to cuz he didn't bring his wallet with him. Um. Um, you guys will be notified if the panas released. Like I said, he was charged with disorderly conduct for with a disturbance here tonight and then also obstruction because you wouldn't listen to us and yeah, what not. >> Following the incident, Jacob was arrested and charged with resisting an officer and disorderly conduct. During his initial bail hearing on March 6th, a $1,500 signature bond was set with strict conditions. Jacob was forbidden from consuming or possessing alcohol and was barred from entering any bars, taverns, liquor stores, or other establishments where alcohol sales are the primary business. On March 20th, he entered a plea of no contest and was officially found guilty on both misdemeanor charges. During sentencing, the judge handed down a $500 fine plus additional court costs and a DNA surcharge. In total, Jacob was ordered to pay $2,256.
