What happened? >> Okay, a grave mistake. >> Raise your right >> My right hand. >> All right. [music] Do you swear to tell the truth, the whole truth, and nothing but the truth? >> to tell the whole truth and nothing but the truth. >> All right. So, you're packing a lunch, you put the you put the weapon inside [music] of the lunch box, and then what happened? >> And I closed it, and I put it in my passenger side. >> All right, everybody, welcome back to the channel where we as cops break down real body cam footage. This one comes out of Florida from Body Cam Goat, and the title of this one is Mom arrested after sending toddler to daycare with loaded gun in lunch box. That does not sound good at all. Let's jump into it. >> 39-year-old Shinay Davis On March 15th, 2024 Riviera Beach police responded to a call from a local daycare in reference to a discovery inside a toddler's lunch box. Officers learned the daycare staff found the weapon while attempting to prepare lunch for the child, and [music] immediately called police after realizing the firearm was real. Watch what Ms. Davis tells police when she arrives to the daycare, and let us know what you think in the comments below. >> How you doing? >> How you doing? >> Are you the mom? >> Yes, ma'am. >> All right. Come on right here for me. Talk and talk to them, and then I'll come and talk to you. >> Man, that's an ugly colored building. >> I know. >> Hello, how are you doing? >> I'm good. >> All right. First and foremost >> First and foremost, where is >> She She got She took She had She had but let me tell you where >> Where is it now? >> She has it. She did not >> Great. So, the mom's got the gun in back. >> Ma'am, where's the weapon? >> It's in my car. >> Okay. >> Let me Let me get the weapon. >> Can't even get her gloves on, Jesus. >> Okay. >> She's getting her ready. She's getting her ready. Size medium. Still can't get her gloves on. Okay, I wouldn't be be letting her go in the car. She knows the gun is in there. I probably would have gotten the keys from her and got in myself. Let's see what she does. She didn't grab it. >> [music] >> There's the gun. Aggressively? She's not being aggressive at all. Photographing it for court later to show where she found it, good. Her gloves still giving her problems. All right, real quick. You do not need a search warrant to get in that vehicle and retrieve that firearm. It's called the vehicle exception rule. If it were in a building, structure, house, anything, search warrant all day long, but because it was in a car, no need for a search warrant. >> You got a lot of explaining to do. I've never seen that before. Uh only in court. You should never leave a gun in your car anyways. All right, so the mom or I'm sorry, the officer's doing a good job. She's just trying to figure out what happened. Like how did the gun get in the lunch box? We haven't even quite got there yet on how the school staff found it, but nonetheless, this falls out of Miranda, so she wouldn't have to read her Miranda rights to get her statement at this point. She's just trying to there she's just there to investigate what's going on, trying to get like put the puzzle pieces together. So, again, Miranda wouldn't uh be applicable in this situation. So, let's just keep watching. >> I literally I don't My son has never seen a gun before. He's never even seen it before. This is why I put it in his book bag this morning. Put it in his book bag under my arm cuz I don't carry weapons. I don't. That's why I don't even carry the gun on me. >> You might want to start carrying a purse now. >> Right. >> All right. Let me tell you Let me tell you right there. >> All right. >> So, you're packing the lunch, you put the You put the weapon inside of the lunch box and then what happened? >> And I closed it and I put it in my passenger side. >> Okay. >> The whole point was to take it out before and put it in my glove before I bring him to the park and get him out of school. >> Okay. >> That's just stupid. >> locked that door. >> Well, you already know if you have kids, once they lock the door, you can't get in for the rest of the day because they're driving. >> What's What's your address? >> So, then then what happened? >> The lunch time is >> I don't know if I'm really buying this excuse of I was going to put the gun in the little lunch box and then bring it out to my car and then take the gun out like the dude, like that just seems so not smart to me. I mean, the chances of leaving the gun in there like she did is it's just that the probability is there. Like, why would you even want to do that? So, I That right there is just That's just stupidity in my opinion. >> at the clock. >> Um so, >> What do you want for real? >> It's between 11:00, 11:30, something like that. So, I get a call between 11:00, 11:30. And they're like, "We need you to come >> Oh, they just snatched her up now and she's just under arrest. >> Can I at least make a phone call? What am I being charged with? >> I will I will let you know in a minute, but Go ahead. >> Um >> [music] >> That's important. I'm going to stop the real quick. I'll be back. >> All right, they decided to place under arrest. Now, any conversation they have after her regarding the crime that has occurred, she has to be read her Miranda rights. So, now that she's in custody, they have to read her her rights. She told her she's under arrest for neglect. I think there's a whole host of other charges that she's going to be charged with. Neglect is probably one of them, but also bringing a gun to school and all sorts of issues. So, I I don't know. I don't want to see where this goes. You did this. >> And the crazy part about it is I could have just got my phone and went to jail. >> And we would have went to your house and you still would have went to jail. >> Ma'am, sir. >> I'm not going to discuss anything with you at this time. >> Um that decision was already made by a supervisor, so >> Who is the supervisor? Like y'all are not even giving me the opportunity to make a phone call or anything. >> You can make a phone call. Just this is not the >> You can make a phone call from jail. >> I'll get my phone. Ooh, my phone is right in there. Y'all can't see it. And I've cooperated. >> I said it had to wait for Before you go in, let me just >> I don't We have nothing on her. >> This is the whole pity me, poor me attitude. I can't stand this as a cop. When someone makes a mistake, just own up to it. You put a gun in your kid's lunch pail. He brought it to school. Somebody could have been killed as a result of that. A kid, nonetheless. Super dangerous situation. I wish people would just own up to their mistakes. Even if she didn't stay there, the cops would have went to her house or wherever she lives. She still would have been placed under arrest. So, the fact that she's saying, "I stayed here and waited for you guys. I'm cooperating." This is insane. No, what's insane is you put a gun inside your kid's lunch box. What do you expect him to eat for lunch? PB&J, apple juice, and a Glock 9 mm? Doesn't make any sense. >> All right, go ahead. Have a seat. You got to sit down. You got to listen to me. You got to put your legs down, so we can talk. >> I can't believe that my child had to go and get my phone to the office. So, please. >> Ma'am, the decision already had made. The only thing you could do right now is when we go to the station, if there's somebody else you want to speak to, we'll get that supervisor or whoever that is that you want to talk to, but right now you are under arrest. Okay? >> What are my charges? >> We're going to let you know in a few. Is the Are you okay with the godmother picking up your son? >> Yes. I'm a good mom to my child, and I'm about to lose everything because y'all >> I'm not doubting that you're not a good >> There's the victim thing again. >> We have to do our job. >> I know, but this is crazy, like >> I just put a Glock in my kid's lunch, no big deal. >> It's for safety. Yep. And forgot to take it out. >> Nice, one in the chamber. >> It don't work. >> Officers go to speak with the staff of the daycare that discovered the weapon in the lunch box. >> Hello. Hi. So, who found the weapon? >> Um my teacher My teacher I was standing up talking to the teacher. She was She discovered >> So, the yellow. >> All right. So, where were you guys normally when when you when you located it? >> Oh, well, all the kids were at the table all of them getting ready for lunch. >> All right. So, >> [music] >> do you raise your right hand for Do you swear that the statement you're about >> This is supposed to be a Florida thing, raising your right hand like you're in court or something testifying. I don't understand that. I've never seen that. Yeah, freaked out. So, good on the officer. She actually has to collect that lunchbox cuz that is going to be part of the evidence, whether she photographs it, takes it. Probably a photograph would be sufficient, but good catch on that. She's asking the teacher what the lunchbox looks like so she can put the puzzle pieces together and coincide everything. So, if If ever does go to court, there'd be no argument about that. >> The lunch box I got the lunch box the lunch box I looked at them I felt the heaviness of the lunch box so I know it was definitely a real weapon but I wanted to you know make sure so I was pretty gross I put gloves on took it out to make sure that it was a real weapon that's when I realized oh yeah it's definitely real and definitely loaded I put it back I put it back in the lunch box and then I immediately called her to tell her she needs to get to the school. >> Okay and then what did she say? >> I didn't tell her why I was calling her I just said I need to see you at the school and it's urgent she can't ask me why why why I said I just need you here type thing we hung up she said I'm on the way I said maybe 3 to 5 minutes later she called back and that's when she realized why we were calling her and she was like I'm so so >> Show me the area that you guys were in when we waved this child >> Sorry ain't going to cut it. >> This is right here the child sits right here. Hi how you doing? >> I'm good this is Officer Horner with the police department. >> So I I know that you're the owner and the director of the facility So would you like to prosecute as well? >> No I don't prosecute that baby and that baby needs somebody to raise his mom I I I don't want to do that I just thank the good Lord nobody got hurt none of the other kids got guns and I'm going to have to let him put him somewhere else so I'm hoping that will never happen with us again and I I just >> Okay >> All right I can sympathize with what the director is saying I mean the kid I I don't know the family dynamic history of this little boy and his mom who's getting arrested but I mean she's got a good point like boy needs somebody she doesn't want to take the mom away. I can totally sympathize with that. But you're looking at a huge mistake here and the mom does need to help be held accountable. So, at the end of the day, an officer could choose not to take the mom to jail and file a warrant or charges for her arrest at a later time and let the district attorney figure that out. But, I mean, that's a tough call. I I I'll I'll be it Yeah, you don't want to separate parents from kids, but you can't be packing a a Glock pistol in your kids' lunch pail and allowing him to take that to school. I mean, a kid could shot himself. He could have shot another student. A teacher could have got hurt. I mean, this could have been all bad. Doesn't matter. >> Shanice Davis was charged with felony child neglect and allowing a minor to obtain a firearm. >> All right. So, you see the charges there. The mom got banged with a couple felonies. I I agree with that. I mean, again, I've said it already. This whole situation could have gone really, really bad. You've got little kids involved. This is just not a good situation. So, often times, even if someone says they don't want to press charges against you, if you have felony charges, you can still make that arrest regardless. So, that's what the officer chose to do here. What do you guys think? Was the punishment too harsh? Do you think they should have taken her to jail? What do you think she should be faced with? I mean, I don't know. Do I think she did it intentionally? No, I don't think she did. But, nonetheless, she still it still happened, and she still needs to be held accountable for that. I'm thankful that nobody got hurt, and I'm really thankful that the teacher found the gun before the kid dove into it to get his snacks or lunch and someone got hurt. So, that's all I got for you on that. Drop a comment, let us know what you think, and I'll see you on the next video.
