As a cop, you never know what a call will bring. We have a man who shoots his wife during an argument, then spends hours driving around with her in the back of his car. >> Can I come in and talk? And I was like, "Sure." He came in. He's like, "I shot my wife last night." And I was like, "What?" >> Yeah, there's blood on the front porch. >> We have a man who turns a road rage incident into a tense confrontation with cops only to face the officers again two years later. >> GET ON THE GROUND NOW. >> SUP, CHRIS. up and stay. Are you scared? You're scared. >> First cops respond after a man reveals that his friend confessed to shooting his own wife. >> Oh, man. >> Hey. >> So, what happened tonight? >> A buddy of mine came over, knocked on my door. >> And who's your buddy? >> West Finny. >> West Finny. >> Yeah. Um, he said, "Man, can I come in?" He was drunker than hell. >> Uhhuh. >> "Can I come in and talk?" I was like, "Sure." He came in. He's like, "I shot my wife last night." I was like, "What?" >> He's like, "I shot her through the heart. She dropped dead in the kitchen and I was like, "No, you didn't." And he showed me the body in the back of her. >> It was in the back of his vehicle tonight. >> In the back of that vehicle, >> you know his wife, >> Amy Fanny, yes. >> Did it look like her? >> Yes. >> Okay. What happened after that? >> Um, he's like, "Don't turn me in, man. Don't turn me in. What do I do? What do I do?" I was like, "I don't know. I have no idea what to do. I I I've never done this." >> That's not him, is it? >> It might be. I'm not 100% sure. >> That's not blue. >> Well, his is gray. That might be him. >> This guy right here, an Explorer just pulled in the RV park. RP is saying he thinks it's him. Westbound on Broadway. I'm going to attempt to catch up to the vehicle. 104 RP stated that the suspect also drives a vehicle like this. I'm going to do an investigative stop on the vehicle. >> What's going on, guys? >> You doing all right? >> Um, so here's the reason I stopped you. Okay. We [clears throat] just had something that happened in Mount Vernon. Okay. Um the suspect vehicle was described as your vehicle. I just needed to make sure you weren't the guy we're looking for. Okay. Do you have your driver's license on you real quick? I can show me that and we'll get you out of here. >> I'm on my way to work now. >> Okay. Did you just pull into the RV park? >> Yeah, I just pulled in >> and then turned around. >> No, I just I just pulled in and got a bag of ice and pulled out. I'm on my way to work. >> Okay. That's all I needed from you. You guys are good to go. I appreciate you. Sorry for inconveniencing you. Okay. >> Okay. >> Yep. >> Okay. So, before we get started with all the details and the circumstances as it relates to this incident, uh we're all going to be together and put our investigative hats on to kind of navigate this homicide scene. That's what it is. You have the suspect that confessed a murder to his friend. Okay. Now, you can see they did the due diligence and checked out to make sure that isn't the suspect's vehicle. But now he's got to go back at scene and both of us are going to kind of walk through what are the responsibilities and the duties of patrol officers, right? Or deputies that have arrived at scene of a homicide. >> That wasn't him. >> Does he hang out with a Javier? >> Not that I know. >> Okay. Yeah, that wasn't him. >> All right, let's start back. >> I gave my I gave the license plate, too. >> It It came back to a blue, but you said he drives a silver, too, which that's what that was. I'm not sure of the color. It kind of blue silver. >> Okay. It's blue on the return. >> Okay. >> So, he showed you in the back of his tongue. >> He said, "Let me see." >> You said, "Let me see." >> Yeah. And he he opened up the back, >> uncovered her face. >> And >> so, her whole body was covered up. >> Yes. In the blanket. >> Okay. >> And I And you immediately knew it was Amy. >> I could smell the smell of the body first and then Yeah, it was Amy. >> Okay. >> It was Amy. So then what was what did you say to him after that? >> Oh [ __ ] Um he said, "You're mad at me, right?" And I said, "No, I'm not mad at you." I was just trying. I was scared. >> Yeah. >> I I was like, "No, I'm not." I didn't know if he still had his gun on him or not. >> He said he didn't. But anyway, he said, "What do I do?" And I was like, "Dude, I don't know. I I've never been in a position like this. I don't know what you do." >> He said, "I'm thinking Ren Lake." And I said, "Well, that's pretty populated." He said, "You're not going to call the law on me, are you?" I was like, "No, dude. This is none of my business. It's none of my business," >> which was [ __ ] because I called you susar. >> I was scared. I didn't know if he had a gun on him or not. And he was not. He was drunk >> and not in his right mind. >> What was he wearing? Do you know what what kind of clothes he was wearing? >> I don't. I wasn't paying that much attention. >> Okay. Can you Did you see any clothes on Amy? Any type of clothing? Any description on her? >> No, she was covered up in a blanket. >> Do you remember what the blanket looked like? It was it was a dark blanket. Um probably blue. I'm not sure. A dark blue u in the very back hatch. Um she was in the fe I assume the fetal position. He didn't uncover her body all the way. Just her head. And I saw that and I was like, "You guys aren't playing a [ __ ] joke on me, are you?" [snorts] >> You thought maybe she Yeah. >> Yeah. I thought maybe she was >> How well do you know Wes and Amy? >> Uh really well. >> Really well. Where do you know them from? Uh, I've known Wes since um we were 19, 20 years old. >> Okay. >> Uh, >> so you guys been friends for a long time. That's why you felt comfortable with bringing something like that to you. >> Yeah. He said that he wanted my advice. Okay. >> As a friend, I was like, I don't have any to give. I don't know what the [ __ ] to do here. >> When was the last time you were in contact with Wes before this? >> Uh, yesterday. >> Yesterday. >> Yeah. >> So, did he was he acting strange then? >> Yeah. Him and his wife got in a big fight. >> Okay. Do you know what it was about? >> I do not. Other than the fact that I came over there at 7:00 in the morning and it woke her up and she was pissed off about that. >> Why'd you go over there at 7:00 in the morning? >> To hang out for 20 minutes before going to the golf tournament in Mason. >> Okay. >> And um >> and later on that day I called Amy. >> One sec. One sec. >> To tell her sir. >> Okay. Let me interject right here because there's a lot of important details and duties and responsibilities that we should do. Okay. So, first and foremost, that is a homicide scene. What we're going to have to do is create an inner and an outer perimeter. Meaning, let's go ahead and do a crime scene tape around the inner perimeter, right? Which is, as you can see, it's where the trailer, the truck, all around there. And then what you also want to do is create an outer perimeter. You got to be in a crime scene log and start noting every single person that comes into the crime scene and leaves the crime scene. Okay? And his best friend that he confided so that he can give him advice. Best thing he did was call 911 and get the cops there. Right now, that's going to be a very, very material witness in this entire case. Right? We're going to get a statement and lock him in on everything that he's telling the police officers. So just for beginners when you're out there on patrol, these are the kind of things that you have to do. And of course, you're going to make notifications to the watch commander and get the ball rolling with other resources to come to this homicide scene. >> That's Jefferson sitting there trying to >> Yeah, I think he's just sitting there. Henley will let you know if he's want you guys to go out there. 104. All right, sir. We have a ping on the location of the car. Okay. It's just me and another deputy on tonight. So, he's going out there by himself. I'm going to go respond to help him out. Okay. You're going to be here all night, right? >> I'm not going anywhere. >> I will come back and talk to you after we just we figure out what's going on. Okay. >> Okay. >> I'll be right back with you. All right. >> All right. So, it happened in the kitchen. >> I guess he told the RP it happened in the kitchen. Um, >> your camera. >> Yes. Just make sure there's nobody else inside and then secure the the residence. With it happening in the kitchen, I'm sure they'll want me to tape it off, but >> like intentional like >> said that they'd been in a fight all day. >> Okay. So, another quick interjection here. When I mention about the inner and outer perimeter of the fence where his trailer and that truck is, you also got to do it here because this is the main crime scene as far as we know so far. Okay. >> Wrote him and rode him and rode him. So, he pulled out a 9mm Smith and Wesson and shot her in the heart in the kitchen and pulled his his car around the back of the house, drugg her out to the back and kept her in his car. This was yesterday at 7:00 p.m. And then he drove to the RV park. That's his buddy that stays out there. And he's like, "Hey, I don't know what to do. I just shot I shot my wife last night. >> I don't know what we got here, but I don't see any blood or anything. [snorts] Could be what he used to clean. >> Check back. >> Sheriff's office. If anybody's in there, come to the door. So, the residence is secure. Um Pinley's out here with me. We got the back window open and tried to look inside. Nothing obvious. Um, the RP told Hopson when I left that he said the murder happened in the kitchen of the house. He then drove his car to the back and drug her body out of the back door into his car last night at 7:00 p.m. But he cleaned up really well is what he said. We got We got blood on the front porch. >> Yeah, there's blood on the front porch right here >> at the at the house. >> You boys doing all right? >> Yeah, not bad. >> Shoot. Okay, so before we move on to the scene where the actual vehicle, as you can see right now, it's very, very important not to compromise that crime scene whatsoever, your best bet is just to lock it all down, get that search warrant, and you know what? Get those homicide detectives rolling because they're the ones that are going to coordinate, take command and control, and take the lead uh of this homicide scene. >> You want to come with me real quick? >> A little tight right here. >> Well, we'll get them off here in just a second. I'm Detective Titzer. How you doing tonight? >> I'm I'm West Finn. I'm >> I am relaxed actually. >> You seem like real nice guy, man. I am. >> Where you from? >> Mount Vernon. >> From Mount Vernon. All right, let's go back to my car and uh and we'll talk for a little bit and we'll see we'll see what we can do about getting you uh so you do you do know you have a right to remain silent. Anything you say can will be used against you in a court of law. You have a right to an attorney. If you cannot for an attorney won't be appointed to represent you free of charge before if you wish before any questioning. >> You have a right to have counsel not answer any of my questions. You know your rights. You're talking to me. You obviously know that. You obviously know that probably telling your story. >> I already know the story >> in the best light possible is is the way we probably need to go, dude. Let's go over here, dude. So, I'm Justin. Uh, you are >> Westy. >> Okay. I'm a detect. Thank you, sir. I'm a detective with the Jefferson County Sheriff's Department. Um, >> so you know, so you know Justin Osborne then? >> Tit ze r. >> So you know Justin Osborne then? >> I do. >> I [ __ ] up, man. >> Well, tell me tell me what happened. What? Tell me what happened. I'm assuming the dude that [ __ ] busted me out today, he come over to my house yesterday at 7:30 a.m. and Amy got [ __ ] pissed. And then she rode my ass all day long. >> And then she was talking to somebody on the phone last night at like 9:00. She said, "This [ __ ] I hate my husband. He's a piece of shit." This [ __ ] set me off, man. I just I'm We were both drinking and everything. >> Yeah. >> Come on now. >> I feel I understand. I've been mad before, too. >> And and I and and I grabbed my [ __ ] 9 mm and [ __ ] put it put a bullet through. >> Where'd you shoot her at, Bubba? >> Through the back to the through the chest. >> Okay. So, let me So, you did shoot her with 9 millm. Yeah. >> Where's the 9 mm at now? >> It's at my house. >> Oh, it's at your house. Okay. No big deal. >> I'm not going to lie to you, dude. >> No, dude. And And here's the deal. >> My My temper is [ __ ] like real short and it has been for a little bit because >> Yeah. Uh, [clears throat] I mean, she don't work no more because she has liver problems. >> Yeah, man. >> And I work my I bust my [ __ ] balls, you know, and she always asks for [ __ ] like, "Give me this money. I can just give her $400 couple like two days ago, dude." >> And she's like, "Well, you [ __ ] [ __ ] That $400 ain't enough." I'm like, "I still pay my goddamn ex-wife $986 a month for [ __ ] alimony." >> I I get it. I get it, dude. Um >> I'm like you [ __ ] are robbing me. >> Yeah, I understand that, man. So So uh you just you guys have been fighting to run this? >> No, we wasn't even fighting until um Colin showed up at 7:30 yesterday, Sunday morning. Saturday, we everything was great. >> Yeah. >> Come Sunday, he called me and he said, "Hey, hey." He said, "I'm almost on my way to your house." I'm like, "Uh, no. She's asleep. Don't do that." He's like, "Well, I'll take the [ __ ] heat." I'm like, uh, well, I'm going to have the heat the rest of the [ __ ] day on this [ __ ] you know. >> So, when did So, Sunday you shot her? >> Sunday night, 9:00. >> About 9:00. >> Where where were you guys at? >> My home >> in your house. They're on 148. >> Yeah. >> What room were y'all in? >> Like 8:45, I'm guessing. >> Yeah. >> And I said, "Who you talking to?" She said, "I know your [ __ ] business." And I'm like, "All right, whatever." I'm like, "Why don't you just [ __ ] leave? Go [ __ ] do something." You know? Have you talked to any of the other officers on scene? Have they talked to you? Okay. >> Um, can I ask you, brother, what what happened after you what happened after you shot her there on Sunday night at 9:00 p.m. >> What happened? >> Yeah. Yeah. Just walk me through it. >> Got her and then I went to sleep. >> Okay. When did you when did you put her body in the trunk of the car? >> About 4:00 a.m. this morning. >> About 4:00 a.m. this morning. So, Sunday night about 9 900 p p.m. You shot her. You guys, you'd had enough, right? >> Yeah. >> You shot her through the back with a 9 millimeter. Uh, can you can you point where where on the in the back you might have shot her? Yeah, >> I cannot tell you that. >> Okay. No problem. >> Obviously, it was an immediate death. >> Were you were you intoxicated when you when you shot? >> We were both intoxicated. >> And then um you were both drinking. >> Did you pass out or did you just go to sleep and try to think on what you should do? >> Um >> Okay. So, you woke up at 4:00 a.m. >> Right. >> Around 4. >> Around 4. And you put her in the put her in the trunk of your car. >> Yeah. >> And where were you going tonight? >> No, I was just cruising around. >> You just cruising around? is you're >> I didn't know what to do. >> Well, dude, like I said, man, I you're you're being super cooperative, super forthcoming, >> dude. I'm I'm being upfront with everybody. I did. >> I know that. I know this. >> So, had you guys had you guys ever had any uh any prior uh domestics or anything like that? >> Yes. About two years ago, >> you guys had a pretty tumultuous relationship, fighting a lot. He was drinking a lot of [ __ ] Fireball and I kept telling her I'm like, "Hey, you're going to kill yourself doing that [ __ ] you know, >> 100%." [clears throat] >> And we we went to uh Slooh Hospital. >> Yeah. >> 3 weeks ago because her liver is like [ __ ] dead. >> Oh, she was drinking herself to death. Yeah. >> Um brother, >> and she wouldn't [ __ ] listen to me. >> Can I ask you something? Go ahead. >> Would you mind if would you would you give us consent to go get the gun out of your house? It would be okay to give get consent to go in your house and get the gun. >> If you want the 9 millmter, that's my favorite gun, though. [laughter] >> But so you would give us consent to go get the gun? >> That's a $500 gun, >> brother. I know. [laughter] Hey, man. You're helping me out a whole hell of a lot. Um, >> I'm not going to [ __ ] with you. I mean, why not [ __ ] >> No. No. I got a 40 caliber and two nines and a shotgun. >> Okay. And you wouldn't care. You wouldn't care. >> I don't want all of them taken because >> when we go back, >> they were expensive. Yeah. You need something to drink, Bubba? >> Okay. So, before we go any further, uh you just got done witnessing a self- admission, a confession to the murder of his wife. About the only thing that I can add is even though he's asking for his consent for the actual firearm. Uh you know what? Let's go ahead and get a search warrant for the vehicle. Let's get a search warrant for the house. Lock down this particular location. Right. You want to do an inner and outer perimeter. Begin a crime scene lock. As you can see, there's a lot of personnel there. And what you don't want to do is you don't want to contaminate. You have to have complete control of who is in the crime scene and who's not. So, the fact that everybody's gathering around and talking, but what we don't want to do is contaminate anything, especially the car. I mean, the car is again probably your second most material evidence uh for you to search. >> Hey, great job, dude. Thank you very much. >> Absolutely. >> Where you Where you at? >> Christopher. >> Y good. Thank you. >> Here's his card. >> Cool. his um >> and then here was the backup. Primary backup. >> I'm getting old, man. I need some glasses or something. >> What's your name, brother? >> De Fane. >> Nice to meet you. >> Nice to meet you, sir. >> I'm Amy Typton. >> Hi, Justin T. >> Whatever you need from Franklin County, get a hold of me. Yes, ma'am. Sheriff has my number and we'll get you whatever you need. >> Appreciate that very much. Um spoke to him. >> Confession. Uh shot her at 9:00 last night, put her in the trunk about 4:00 a.m. >> Wait a minute. Wait a minute. Back up. Where did he shoot her at? What county was he in? >> Jefferson County. >> There you go. >> Yeah. Um, sorry. >> They they've been arguing all day. He'd had enough. He shot her through the back with a 9mm Smith and Wess at 9:00 p.m. Loaded her in the car about 4:00 a.m. And this is He's been driving around all day trying to figure out what to do. Um, so he has I'm going to have Barnhart write up a search warrant, but he he will sign a consent form for whatever we need in the house. He's being super cooperative. >> Yeah. Get search warrant anyway. >> I'm going to get search warrant. >> I spoke to Featherston. We're going to run everything through uh Jefferson County on this. Search warrant for the vehicle, search warrant for the house. that way we're not having to bounce between agency to agency. >> I don't want anything being inadmissible. >> Uh, you know, right now everything's going pretty good and he's being super cooperative. So, I've got Jay Jay on the search warrants. I got to call him back. I got him secured with Corey right now. And, uh, I mean, just take her slow and put her together. We've got everything we need right now. >> Are you going to need Finny at the scene any longer? >> Uh, no. No. >> Then we can have corn go ahead and >> Yes, sir. >> get him back. >> Yes, sir. That sounds great. >> Out of there. Nice job. Thank you, sir. >> Let me just start off by saying that any loss of life is a tragedy no matter what. When all parties are involved, especially if you're a homicide detective, your heart has to go out to the families and to the loved ones. Okay? So, the fact that you're investigating and having that kind of reaction, I don't know if it's a sign like, "Oh my god, I don't get to do all this work, right?" Or I just don't know. However, it is a bit inappropriate, so I got to call that out. Uh, but just know that everybody has to always remain professional and respectful. >> All right, you can go and get in. >> Are we leaving now? >> No, we're not leaving yet. I got to go make sure we're clear to leave. If once we're clear to leave, we'll go. Okay. >> All right. >> It's going to be warm back there, but I'll get you comfy. I promise. Watch your knee, buddy. >> Got you. >> Hey, you you guys as deputies, you and Perry County's deputies saved this from being a real nightmare. So, thank you very much. anything you need. >> Um, it made it exponentially more easy to investigate, you know, getting the body before he dumped it because I mean, gosh, >> he was probably going to head to one of the numerous access areas and >> dump him. >> But I really appreciate you. >> Absolutely. >> Was he under the influence of anything or just tired? >> Uh, he he uh he said he he had been drinking last night, but I think he was just tired. So, >> yeah. Up all night. I asked him some questions uh month, year, uh who the president was. Asked him if he'd ever had any history of mental illness. >> Yeah. >> Not note that he uh was walking and talking good. Very cooperative. But no, he didn't appear to be under the influence. >> Uh not yet. Now, the reason why he revealed all these questions when they're talking, I I suppose that's either the sheriff or the chief, right? is because voluntary intoxication can be a defense uh to a homicide to a murder. Okay? It can be. And again, you know, I'm not a lawyer. I'm not giving any legal advice. I remember a little bit about crim law when I went to law school back in the days, but just know that voluntary intoxication is uh an issue that needs to be raised. So, that's the reason why you have to ask all those questions. >> They got married about uh three years ago. Wow. And they they had be quick. >> They had had a very tumultuous relationship. She drank quite a bit and um it would cause a lot of fights. So, >> I mean, it's one thing to bring over and say, "Hey, take a look at this new deer I had." >> Yeah. Man, I panicked. >> I didn't know what to do. I panicked. >> Yep. 9mm Smith and Wesson M. >> We'll get back to his charges shortly, but first, cops were called after a woman reported a man trying to hit her with his vehicle. >> Stay in the car. Stay in the car. Stay in the car. Stay in the car. >> Stay in the car. >> Stay in the car. Please stay in the car. >> I say stay in the car. Nope. Get down on the ground. Stay there on the ground. >> Nope. Stay right there. Do not go anywhere. Stay right there. >> I have 91 you. Can you confirm your 20? >> No. Stay right there. Get on the >> knees. Can you confirm your 20 loge? >> I say stay right there. >> Get down on your knees. >> We can figure this out. >> The vehicle. Stay there. Stay there. >> Okay. Get on your knees and stay right there for a second. >> Stay right there. Sir, >> stay right there. >> Sir, can you please >> do not move? >> We'll talk about it. I'll be talking to my brother, please. >> Sir, get back. >> Okay. So, allow me to interject at this point because we just switched from uh uh digital incar video to body warn video. So, a couple of things we're going to be talking about at this point of this incident is tactical planning and communication. It's very very important and you know us cops love these acronyms ABC. What that means for is you got you got to have an actual plan, a backup plan and a contingency plan. Okay? And that right now needs to be pretty much going through the mind of the officer. Also, you got time, right? Time is not of the essence because you want to create that time because you're waiting for your backup, right? You're going code three lights and siren. Your partners are coming to help you out. You also got to have distance and you got to have cover and concealment. That's very, very important. As you can see, he's got the taser deployed. And I'm going to talk a little bit about the taser later on. It's not the end all beall because if you do deploy the taser and it doesn't work, then you got other problems and other situations you're going to have to deal with. Okay. >> Just stay on the ground, bud. We'll talk about it. Okay. Could you please Good. Thank you. Just stay down. >> Can I I need to see my mother. >> Can I see my mother? I can run to her. >> Okay. Not at this moment. Can I run? >> Not at this moment. >> Can I Can I give you everything I have? >> Can I Don't reach for your pockets. Don't reach for your pocket, Chris. >> Can I get nude? >> Don't reach for your p No. >> Can Can I show you? >> No. No. No. No. No. No. Just leave it as is this. >> Don't reach for anything. >> No, but I just I'm showing me my legs, man. Everything I have. I got my shorts on. >> Okay. Don't reach for anything. >> Shirts on. >> I got a Johnny Cash shirt on and I got aunda mata. Don't worry, >> Chris. >> Chris, leave your clothes on. Talk to me. Where you from, bud? >> I'm from Sparks, Nevada. My name is >> Okay, stay right there. Back Chris, back up. Back up. Stay right there. Stay on the ground. >> I know who I am. My name is Okay. >> What? >> I I used to play football. >> Okay. >> I'm just >> Talk to me about football, man. >> My My brain is messed up with football. >> Okay. Talk to me about football. What year did you graduate? >> I graduated in 195. >> Yes, sir. >> So, we're about the same age, bud. We probably played football together. >> What What team were you on? I was out of uh remember that? >> Yeah, man. >> Did you guys used to play for >> I could have played for the I was with the I was I wasn't humble enough. >> Okay. >> And you played at Reed? >> Yes, sir. >> Do you know Crawford Chris? >> Listen, can I just warm up? I want to go. >> No, no, don't warm up, man. Don't warm up. Just go down your knees, please. >> Can I show you my ID and everything? I give you everything. >> Right here to your left. Right here to your left. >> Man, please. All right. >> Don't reach for anything. >> I'm not reaching for anything. I don't have anything. See, look. I don't have anything. >> I got my gun. >> I got this one. >> That's it. >> GET ON THE GROUND NOW. [screaming] >> GET ON THE GROUND NOW. >> STOP. >> OKAY. SO, allow me to interject at this point because I want to say and I believe that the deputy is telling the female officer to stop. Like, you know what? I have the command and control here. I have the rapport with the suspect. I'm the one talking. Because here's the deal, and you've seen this over and over again, and it happens a lot in just a practice when your situation's so escalated and stress is so high where you're given all these commands. You know, drop it, get on the ground, get on the ground. You say it like 50 times and guess what? Nothing happens. Okay, so as soon as we get there, we got to have the non-lethal. I know you definitely want the 40mm for sure. Uh you have the taser, and you also might want to also get a bean bash shotgun because it is very, very effective. Uh, you got to let the suspect know, uh, sir, ma'am, you know what? This is going to hurt. This is the bean bash shotgun. And if you're ready to deploy it, you got to look around to your partners to say, beam back shotgun. Bean back ready. Pop. And it goes off. Okay. Hopefully, that's effective. To do what? What is next is affecting an arrest. You got to go and affect an arrest. Let's see what happens. >> Listen to me. >> I'm not going to lay on the ground. I want to go see my daughter. >> She could give you the keys. Can I give you the keys? >> No. No. No. Listen to me. >> Here. Look, I can swear to you on this rubber. >> Stop. >> Back up. >> Lay on the ground, buddy. >> YOU AND I. YOU AND I. GUYS, STOP. >> TALK TO ME. >> Kill me, please. >> You and I were talking just fine. >> Stop killing me. I just want to go see my mom. Can I run? >> No, you can't run. >> Can I put my shirt on and run? >> Chris, let's talk about this. >> We're past that. >> Can you go down your knees? >> Here's my things. Here's my things. Here. >> This is Chris. Back up. My wallet. >> This is my ID. Chris, >> this is my son. >> Lay down. >> Before we get into this incident that happened two years later, a couple of things to note. It is not considered a critical incident. It is an officer involved shooting. You're going to hear me say OIS. Now, you got six officers involved. You got one shooter and five precipient witnesses. Okay? You got a couple of non-lethals. And by the way, they did have the 40 mil, which is just as effective as a beanback shotgun, but you definitely also would like to have a bean back shotgun if available. Okay, so now there's a whole process that we'll get to a little bit later on, but let's see what happens uh 2 years later. >> Hey, Chris Reno PD. What's going on, man? I'm with the Reno Police Department. I work with your brother. >> Get your hand off your weapon right there, mother. I got my hands right here. >> Take your hat off you. My name is Christopher. You guys shot me 2020. You guys didn't pay me any money. You shot me in my right shoulder. >> We know, bud. >> Chris, what is going on? >> What's going on today? Chris, >> let me do some pull-ups. Get the out of my way. Move away. All of you. All of you MOVE THE AWAY. BACK THE UP. >> Shut the tas. >> You going to tase me? >> I'm in my own apartment. >> Chris. >> Chris, stop it. >> You've got a bunch of your neighbors are calling. You guys trying to take me to jail? >> If I asked you guys nicely, I'm going to tell you guys right now. Whoever could go toe to toe with me, head to head, push-up to push-up. Let's get it. >> Going face to the west right here. >> You're facing I'm not saying I'm yolked. Back up and stay. You scared? You're scared. You're scared. Are you scared or not? Be honest. >> I'm not scared of you, dude. There's >> I know I know you're not scared of me. >> I'm scared of me. >> I fear one man and his name is Do you want to know what his name is? Okay, a lot of different behaviors from Chris. Passive aggressive. He's challenging cops into a fight. Look, what I will say is this. In my other channel, I've talked about when you use force is for these three main reasons. It's definitely to affect an arrest, prevent an escape, and overcome resistance. Now, again, the actual plan, somebody right who's at scene, wherever this senior person is, most likely has to formulate a plan as to how we're going to affect this arrest because he's going to go to the Great Bar Motel. But the question is, how can we do it safely? Secure the suspect without injuring Chris and without injuring ourselves. Sounds to me like, you know what, you got to get it on. You're going to have to do like a dog pile team takedown. And if that's what it takes, that's what you got to do. >> All your weapons. I see them right here. Every single one of you. Especially that guy right there. >> I'm not trying hard. >> Who you think you're hard? >> CHRIS, >> YOU THINK YOU'RE HARD, MOTHER? Think you're standing there hard? Stop. My friend, >> you didn't shoot me because I'm because you think I think I'm better than you. >> I was there when that happened, my friend. Do you want >> Shut the up. You weren't there. >> Yes, I was. >> Did you come up and hit me in the chest, man? Are you okay? >> Did you come up and hit me in the abs? Man, you're g >> DID YOU DO THAT? >> CHRIS, >> did you say I love you, bro? Did you say that to me? >> Chris, >> did my Was my brother there? >> Two, three, four, five, six, seven. >> You're gonna shoot me. I GOT NO WEAPONS. >> CHRIS, what else? >> You want You want to see the slog, >> Chris? >> Want to see this slog, dude? Oh, you real >> you GUYS THINK YOU'RE HARD? >> NAVY Seals are hard. >> Go read your Bible. Shut the >> Stop, boss. >> Chris, can you stop and listen? >> We do need to get your help. You know, get me help. Don't stop. Stop with us. >> Don't shoot me here. >> No, Chris. >> Don't shoot me. I'm going I'm going to get my own help. Stop. >> We're going to stop. We need >> I'm going to put a shirt on and I'm going to get my own help. >> Don't shoot me in the back. >> HEY, >> DON'T SHOOT ME IN THE BACK. ROT, don't arrest me. Don't touch me. >> I HAVE BROKEN NO LAWS. SHUT THE UP. LET ME BE QUIET. LET ME BE QUIET AND GO IN MY OWN HOUSE THAT I EARNED WITH MY BLOOD, MY SWEAT, AND my tears. >> I understand. >> Shut the up. I'm going to go get just shut the up. I'm walking. >> No, >> I just want to go home. Hey Chris, what we can do is we can >> Okay, let me interject right here because it looks to me from the depiction of the video that he's in custody, right? Call for suspect in custody without incident or with incident. What I will say is this because the video doesn't tell us, right? How much force they used, whether it was minimal or whether it was a lot of force. Seems to me like they talked him into deescalated the situation into handcuffs. And you know what? That is the best outcome that you can have as a cop. >> Try to >> Can you guys just issue me a ticket like you did after you shot me and let me go home? >> I promise to be calm. >> Can you have a seat? >> I promise to be calm, guys. >> All right. I appreciate it. >> Sit up. Sit up. Sit up. Sit up. >> See my girl. >> You're okay. You're okay. >> You're okay. You're okay. >> I got Okay, girl. So, I was like, "Okay, I'll go." When I started to go, he tried to hit me and then he waited there. So, I pulled over and he was just sitting there waiting. He wanted me to get in front of him for whatever reason, but the look on his face, he was just I ra. >> Okay, perfect. Can I get a statement from you? >> Okay, so what the uh deputy I believe means by the RP, it's the reporting party. We also use PR, which is the person reporting, and in this case, she's the RP and the victim of this road rage incident. What we don't know in the state of Nevada, whether it's a wobbler, a felony, or a misdemeanor. you can go either or or if it's just a misdemeanor crime that wasn't committed in the presence of the officers. It's a very very important to know you go from a misdemeanor and now you're involved in an OIS. Okay? And when I say you're involved in an OIS, the calvaryary is coming, the bosses, you have the criminal portion of the investigation from professional standards bureau or internal affairs and you also have the administrative. The crim goes first. However, this could be deemed either accidental or negligent discharge. >> No trauma. >> My daughter knows pocket knife. >> Can Can I help? >> You're okay. You're okay. Talk to me. Keep talking to me. Okay. >> Here. You okay? What are you feeling right now? >> I'm feeling I'm feeling comfortable with you. >> Okay. Okay. You >> But if you can >> You were born and raised in Sparks. >> Yes, ma'am. >> Okay. >> And can I please get my >> Where's your family at? >> My family? My Where's the hole? >> Just praying about him. >> Where's the hole? >> I hope I hope >> Stay up. Stay up with me. Talk to me. Talk to me. Okay. >> Let's get out of here. >> Talk to me. Okay, >> Davis. What do you need? >> I'm looking for the hole. >> On the ground. >> He's got He's got cuffs on. He's got cuffs on. >> Put him down on this shoulder on his side. >> Just go slow. Roll over, buddy. >> I got you. >> I got you. >> All right. It's fine. We'll go up. We'll go up. >> We'll go up. >> Can I get some water, sir? >> We're performing, >> brother. Can I get some water? >> Not right now, man. Hey, on the medical side of things. All right, open that up. In the main center compartment, >> there are some uh Israeli bandages and listen to good. >> What's your plan? >> What was your plan today? >> Just watch your knees. There's blood everywhere. >> Don't always right. >> Okay. So, while we're waiting for the RA to respond to rescue ambulance to give a medical treatment, let me kind of set up the scene management for you. Okay. You have I want to say clo I think it's six precipient witnesses. We call those substantially involved. And then you have the shooting officer. Okay. When the sergeant arrives at scene, he's going to give what they call the APSS, a public safety statement. But you also want to bring another sergeant to have command and control. Now, because of resources, chances are that sergeant is probably going to be the command and control, the incident commander until someone relinquishes him from those duties, and then he can go ahead and be the PSS sergeant. And I'll explain that a little bit later on. All right, man. We're going to stand up. We're going to get on the the medical bed here. Okay. >> We're going to bring your leg in. One, two, three. Standing up. There you go. All right. Sit back. >> Sit back. Do we know >> right shoulder, buddy? >> Uh, I don't know. No, I wasn't here. >> This one too. >> Hand gun. >> I didn't have any I didn't have any weapons. >> Um >> I don't have You want to switch him so he can lean back? >> I don't think I have a baseball a little mini baseball bat for my son. >> Okay. >> Um and I have some pine tree smelling things in there. >> Orders um to get down. We came to obviously assist all of us. Well, me, Chico, the female RPD off, RPD officer had their um all of us had our tasers out. Um Chelico tased. It was ineffective. I went around, started screaming at him, giving him more um orders to get down on the ground. He starts walking actually right here. I don't >> I think this one here >> um shot is 32. I'm sorry. What was that? >> This one right here. Shot is 32. >> Which one is that one? That officer? >> Yeah. >> RPD officer. >> RPD. >> Okie dokie. >> Do you want more? >> Okay. So, what you just saw is what they called a public safety statement to the sergeant. So, we call him the PSS sergeant. Okay. Let me kind of walk you through what that process is. Uh, you know, I'm going to read it off for you, but uh what you need to know is that it happens on every critical incident for every OIS. you have to do the PSS or you have to administer the PSS to the substantially involved and definitely the shooting officer. Okay, it's nine basic questions and uh let's get to it. Okay, here they are. Look, let me give you here's the public safety statement. It says, "Officer, I am ordering you to give me a public safety statement. Uh due to the immediate need due to the immediate need to take action, you do not have the right to wait for representation to answer these limited questions." Okay. Uh here we go. Question number one. Were you involved in an OS? Question number two, approximately how many rounds did you fire in what direction did you fire them? Three, do you know if any other officers fired any rounds? Four, is it possible the suspect fire rounds at you? If so, from what direction were the rounds fired? Well, it doesn't really apply in this case cuz he was unarmed. Okay. Five, is anyone injured? If so, where are they located? Six, are you aware of any witnesses? If so, where are they located? Seven, approximately where were you when you fired the rounds? Eight. Are there any outstanding suspects? If so, what is their descriptions, direction, and mode of travel? How long have they been gone? What crime are they wanted for? And what weapons are they armed with? And last, but not least, nine. Are there any weapons or evidence that need to be secure and protected? Right? You you carry this piece of paper on a clipboard and you're the sergeant. You just go out there and you write all the answers, right? Time, date, and all that good stuff. Right? After you give the PSS, you got to give them that gag order. In other words, you're not ordered to speak to anyone but your attorney, your rep, or your commanding officer. Do you understand? And they have to respond and say yes. Okay? Because if you violate that order, it's grounds for insubordination. Now, with that being said, some carry like a pocket card where you can just flip it out and ask those questions. Okay? It's super important to know. It's part of the process. And in addition to all that, and I don't want to take too much of your time, is the monitoring and separation of the officers. If you have two shooting officers, you have to separate them and you got to get sergeants and supervisors or above to monitor them because what you don't want to do is for them to gather up and start talking about what just happened. Okay. >> Uh I'm all right. I'd rather >> I'd rather not until >> he's secured. >> I got you. >> Now I am. >> Yeah. 9 mil. >> 9 mil. Okay. Doesn't really matter. I'm not going to go too hard. I don't want to hurt you, man. >> Dude, as hard as you can, bro. >> I know, but I don't want to hurt your joints or nothing. >> Just I just I need it to break. I need it to pop. >> Chiropractor, so we'll let them UH FIGURE THAT OUT. >> YEAH. >> BETTER. >> YEAH, RENO. >> There you go. >> Okay, final thoughts. Look, cops are in the business of responding to crisis. That's what it comes down to. Now, whether it's uh arriving the scene of a murder and you have no idea that it's going to be a self- admission, a confession, or an accidental discharge of this critical incident being in all. Okay, I'm going to tell you what uh my tactics instructor told me a long, long time ago. You know what? You're never go hungry and you're always going to go home. Okay? Hope you learned something. Okay, so Finny was charged with first-degree murder and was ultimately sentenced to 75 years in prison. His trial lasted only four days after his defense called no witnesses and Finny never testified. In 2022, Chris was charged with disturbing the peace and was sentenced to 60 days in jail. For the 2020 case, Chris was charged with resisting arrest and reckless driving. He was found not guilty for reckless driving and sentenced to one day in jail. Now, the officer who fired that round was clear after the shooting was deemed to be accidental. Okay, let's go ahead and click the like button, the notification bell, subscribe.
