When someone deliberately sets a fire, every second counts. Officers have to move fast before it gets worse. >> GREAT HOUSE. >> THIS house on fire, too. >> Keep your hands right there. >> Division. >> And this church fire looks like an accident until investigators realize the secretary is missing. >> Oh, check [music] that out. Oh, I'm so sorry. That's awful. Like, it really is. Look at that. [music] Damn. >> That's a hell of a fire right there. >> But first, neighbors screamed that a man forced entry, dunk gas, and set the place on fire. Take a look. >> Can you confirm that the house is on fire? Cuz she's saying that >> they're yelling it's on fire. I can't tell. >> ARE YOU SURE? >> I'M GETTING A FIRE. I'm getting Who did it? Here we go. >> Somebody's house is on fire, so I got to go. 215. I'm 108 from here. I'll be in around there. HE POUR GAS IN MY YARD. HE WENT TO MY YARD. >> IS IT THIS GUY? >> NO, NOT HIM. NOT HIM. THAT GREAT HOUSE. >> THIS HOUSE ON FIRE, TOO. The house on Sixth Street's on fire as well. >> HEY, STOP. STOP RIGHT NOW. STOP RIGHT NOW. >> He's taking off in a Chevy Suburban. Damn near ran me over. Heavy said Hispanic. The house on Sixth Street's on fire. the front. >> We're uh westbound on third. West third. West third approach your main just ran the red light and made in third. >> This one too. >> Okay. Thank you. Okay, while we wait for the fire department to respond, code three, light and sirens and get there to put out this fire, uh, you got to mention the Pete word. We're in pursuit. High-speed pursuit, that is, cuz that suspect is taking off, man. He's gone, right? He's not going out without a fight. At least that's the way I can see it. And just from experience, I can feel like the chase is on. Now, with that being said, yeah, you have a couple of uh uh moving traffic violations, but what you really have is an arson suspect. So, you got to get on the air and broadcast. We have an arson suspect, arson suspect, and we're in pursuit. I need all units back up. Give me an airship if possible. Give me all the resources to have the cavalry respond as quick as possible. Right. Code three, lights and siren. We got to get there and we have to stop this suspect. Okay, let's see what happens. 1020 return on a blue 99 >> headed west on central south on Tmont 200 block of Tmont headed south coming up Prospect. A male Spanish driver with a beard. >> Heavy set. county unit close by. >> No, we're stopped on division. No. Get out of the car. >> Keep your hands right there. Treemont division 3. He's going to be southbound on southbound. I tried getting in the back door, but it's blocked. about the car. I GOT Stay back with beard and glasses. >> Stay back, guys. Stay back. Move the car back. >> Hey, move the car back, GUYS. >> I understand. I'm going need you in the car back to bring more fire trucks. Okay. >> Prospectction division. >> Headed back north. >> Watch out, buddy. You got to move the car. Come here. >> Too bad. I know, buddy. I know. You okay? >> You all right? Is this your house? >> Yeah. Okay, let me stop right here real quick cuz couple of things worth mentioning. As you may know, you've seen a couple of these videos on this channel. Pursue so much uh emotions and just the adrenaline rush, right, is skyhigh, right? The stress is super super super high level. But with all that being said, there's a lot of decisions that you have to make as a primary unit, right? Pursue package, minimum two cars, right, and a supervisor. But it depends on the circumstances. You might need more additional units. Uh you got to take in consideration uh the road, right? Meaning, are we in a residential area? Are we on the freeway? Innocent bystanders. It's inherently dangerous enough as it is. So yeah, tracking mode like back off or someone can actually terminate the pursuit because it's just way too dangerous. But a lot of decision- making and it it's just not easy. I'm going to tell you right now just from experience, it's not okay. >> Aware coming to a stop coming to a stop in the uh get up off the road, my man. All right. Hey, I need you to sit up, buddy. Okay, we got fire truck as usual >> right here in front of you guys. Silver truck. Your driver. Call 911. It's Roberto. He is going to be driving. >> I know. I know. Watch out. >> Oh my god. We're eastbound on division approaching that curve back. >> He's slowing down. >> He got back on his pill and he's been >> he's been off. No, he's been on it and then he got back on. >> Right. But see, he's not He hasn't been acting right. >> Around in there. Be careful. >> I tried kicking in the back door. Is there something blocking the back door? >> Can you please get my cat? >> I'M GOING TRY TO, but I need you to stay here. Let these guys do the job. I can't go in there. Okay. >> He's moving around in there. Be careful. >> Are you clear and come to this pursuit? pulling off over here. Where you guys at? >> Uh, affirmative. We're trying to get right now, guys. >> Northbound on main speeds 32. Not only do you have an arson in charge, but you do have uh Robert here, right? Roberto, in a state of mind that's just uh it's, you know, he's he's just not all there, right? I'm I'm being as professional, as nice as I can be. With that being said, we always say things like you got to be out of your damn mind to start an arson, right? To start a fire on I believe his house and the neighbor's house and just take off and have the police chase you, right? So yes, uh his mental capacity is diminished. It's it's just one of those situations where yes, you got to keep that in mind, but at the same time, you have to stop him, right? You have to terminate that pursuit somehow someway. And when I say termination, meaning it's got to come to an end before it even gets worse. Turning eastbound on second bebound on east second. Eastbound east second crossing walnut will be semi. We're headed north. North on east street. Northbound East Street for third. Still northbound crossing fifth street. We're going to be turning westbound on six by fire trucks. He's coming around all the fire trucks. You're going to have to call. We're pulling out your yard. He's going around back. >> He's going back north. He's going back north. He's going towards Cernovich. He's going around the back of Cernovich headed the back way towards seventh. He's going to be coming up on the on the railroad tracks. He's going to be stuck right here. He's peeling out. Go, go, go. Stop. [screaming] Stop. Stop. Stop. Yeah, he's frantic, man. He doesn't know what to do. It's been past practices in pursuits, right, where you see the suspect just going around in circles around the neighborhood because they don't know where to go, right? And there is some pursuits, well, they just take off, get on the highway, right? Freeway, highway, whatever you want to call it, and next you know, they just take off for like a long ride through city to city to interstate to another state. Okay. So, this is a situation where he's just completely losing his mind and he's so frantic that he doesn't really know what to do. >> Go back around. Go back around. Watch over these streets. >> Jesus. He's behind the resident on Fifth Street. Gun point. Point. He just ran into the squad. Back to the yard. Standby. This is pretty on the back side. Coming back on Grace. South on Grace. Coming to uh Third Street. West on third towards PD. >> Lock them in. Just ran my squad on Third Street. South on Elm. South on Elm. Still south on Elm. West on central or first. West on first. North on main. North on Main. North on me to cross the tracks. Still north on main. Speed's over 60. Still north on main heading past northeast. >> Does anybody know where the vehicle is? I don't see it. >> We're passing northeast. >> North on 78 going past Sailborn Road. Take a right on 900 North. 900 North. Yes. Yes. 900 north. He stopped. He stopped. 900 north. I'm waiting for backup. Wait. Just wait. Just stop. Yes. Yes. You You You got to stop. You got to stop this. YES. BUT YOU GOT YES. JUST >> YES. MATT, let me TAKE THIS. MATT. HEY. STAY. NO. STAY RIGHT HERE. DO NOT LEAVE. STOP. NO. DO NOT LEAVE. STOP RIGHT HERE. Damn it. Looks like we're moving here. >> Should we box them in? We can. I don't know. We're supposed to or not. We need to stop. >> We're just off of uh We're just on right now. We're slow rolling right now. >> Stop. Stop. Got to box this guy in. He's going that slow. Is his car breaking down? >> You got to stop this guy from trying to Can we get in front of him to stop him? We're heading back towards Kiwani on East Street extension. Anybody get in front of him? Trying to get stops. We're still slowly heading north. >> We need to try to get this guy stopped before he gets back into town. He >> killed a lot of people already. >> I'm going I totally agree. You know what? Your best tactic thus far is going to be to box him in. Right. I try to get a vehicle in front and somehow some way box him to the point where he has no angle. Uh take it out and then from the back as quick as possible. and all this back and forth. Under these circumstances, this is just me. I'm giving you my opinion. You cannot terminate the pursuit. So, any boss, any incident commander that says, "Hey, you know what? Let's just back off tracking mode or just terminate the pursuit. You don't know what he's capable of, right? He's very uh unpredictable, if you will." >> I agree. He slowed down several times. I get around him. We're going to have to box him in. He's at a high rate of speed still heading into town. coming up towards Gesca Street. Steve's over 80 fire and be careful. He might be heading back towards him again. >> He told us he wanted to say goodbye to his kids, so there's a good chance he's heading back there. Just passing street heading south on east. He just jumped the corner. He's heading north or south again up towards the house. He's going to turn back on by the liquor store. He's trying to get back off this street. West on east fifth. And when you guys if you guys stop, you got to pin them. Driving two yards again. He's back at the residence on sixth, right? Almost ran over some kids. He's over on the fifth street again behind the residence behind Virgil's. GO ON THE GROUND NOW. ON THE GROUND NOW. WE got hands. WE GOT BOTH HANDS OUT NOW. BOTH HANDS DOWN. [screaming] TASER. TASER. TASER. BOTH HANDS OUT NOW. HANDS. I GOT BEHIND YOUR BACK. >> TASER'S TASER. I'm done. I'm done. >> It hurts. Stop resisting. I'm done. >> You got left hand. >> I'm off. I'm off. >> You guys off. I can't breathe. >> Just relax. Get them off. >> Okay. What happened once I start a video today? I can't even tell you guys. But listen, SHUT YOUR MOUTH. >> OUT OF HERE. STAND UP. >> OKAY. YEAH. Emotions are flying high, man. Your best bet is just to be quiet. Just don't say a word whatsoever. Uh call for in custody. You got to do use of force report for uh deploying the taser. uh little bit of a takedown, but just know that when you actually handcuff or you're trying to handcuff the suspect's arms in the back, it it's not easy. It's not easy at all. Especially when your adrenaline is pumping and you got like four different deputies, right? Four different officers all saying the same commands, verbal commands. Put your hands behind. Give me your hand. Give me your hand. And I'm sure in his mind it's probably distorted, but they accomplished the goal, and that is to go ahead and handcuff them. Code for in custody. We're good to go. Now, uh what do you have? You have a pursuit, right? You got a use of force investigation. You definitely have that arson investigation as well. And um we'll see what happens to Robert, right? >> But you're good. >> I feel BAD FOR YOU. YOU'RE TRYING TO KILL A BUNCH OF PEOPLE. Shut your mouth. >> They were part of me as all these kids. >> He almost hit me. Stay back. 43. I have a very angry citizen up here that is demanding to speak with one of you two about yourself. >> We'll be up there as soon as possible. >> I've never done anything bad like that. >> Always die, bro. Tell him to stay away from my kid and don't ever touch him again. Damn, I'm stupid, right? Baby, you wouldn't let me leave. I told you I wanted to leave. You told me not to. So that I would lose, but I'm not. You guys stay happy. Take care of your mama. Make sure the doors are locked at night. I'm very sorry. I can't breathe. I couldn't do another night of that. >> All right, I'll tell you what happened real quick. So, they started me on your medication. And that's not excuse. Not excuse me. I don't want to talk. >> I'm not in front of that dude right there. >> No, I know. We're going to move you to my car that was not involved in an idiot. >> Huh? Damn. That was an adrenaline rush, huh? Let me just tell you, that's the craziest thing I've ever done in my life. The pain, right? They're trying to make me hallucinate. Of course, they're going to get away with it. This is the stupidest way to prove me. I'm an idiot, DUDE. AH. ALL RIGHT, I'm calming down. I told my kids I got there and stuff and I told them go ahead and go to their grandpas and so they weren't in the house or anything cuz I love my kids. So, I told them go ahead and head to grandpa's house. And then I just didn't want no one to live in that house anymore, dude. The neighbors, they kept me up so loud and clever. Kept going back and forth over there. Get them to stop assing us. It don't matter. >> All right. >> Sorry about that, bro. Do me a favor for the kids. Go back and hang out with them. >> I'm going to hang with you. Actually, >> that's fine. Okay. >> It wasn't easy. >> He needs He needs to be put. >> It's okay. >> Oh, I know. I know. I feel the same way. The nozzle after he had set fire to it, he had, I think, thrown it over there and she didn't want it there, so she had put it into the garbage can. I'll show you which one. Are you the property owner? >> Do you want to pursue charges? >> Uh, yes, I do. He dumped gasoline all over my yard. Where did you see the fuel nozzle at? >> I picked it up because I was going to let my dog out and I didn't want my dog at me. >> Okay, >> put it in there. >> Yeah. >> Okay. >> I came outside cuz I heard yelling. He pulled up behind the van and I asked him what he was doing. He's like, "I hope everybody's out of the house because I'm going to set this [ __ ] on fire." So, my oldest was standing in the street and as he was coming around, >> that's good enough for me. I don't necessarily need uh to ask if you want to press charges or not. I can tell you here in the state of California with my beloved LAPD, I'm here to tell you that in arson, especially with these circumstances, it's a felony 100%. So, there's no need to ask whether or not you want to press charges or not. Every single felony, you got to get statements and do a major thorough investigation to write everything on your arrest report, the probable cause, and all that other good stuff. Okay. >> Driving. >> He almost hit my my 11-year-old. >> Do you want to pursue charges for that? >> Yeah. >> Okay. So, before we wrap this case up, one question and one question only. Look, when do police officers decide to terminate a high-speed vehicle pursuit? Okay, we'll see Roberto's sentence in just a minute, but first, Athens officers work a church fire that turns into a homicide investigation. Take a look. >> Oh, check that out. Oh, I'm so sorry. That's awful. Like, it really is. Look at [music] that. Damn. No wonder them firefighters were coming from the next town over. Damn. >> Thing's rolling, ain't it? God dang. Look at that. This thing ising rolling. Hey, when they get up here, we'll shut it down on the sides. >> Go, go, go, go, go, go. Good. Look at that. That's a hell of a flame right there. >> Oh, hey. We need to get these people back. >> Yeah. Guys, GUYS, GET BACK. GUYS, GET BACK. Get over there. Do not get close. >> Come on, man. I can't put it out. >> There's a lady with the car up there and they don't know if she's in there or not. >> Linda, you can Hey, do you know her? >> I'm the pastor of the church, >> man. Definitely heartbreaking. I mean, just the local church, right, on fire and you have a possible, right, murder, maybe. We don't know yet, right? Uh with all that being said, the little did I remember uh in law school about specific intent crimes, what I do know is that arson's one of them, right? So when we do apprehend and catch the suspect slashar arresty slashdefendant, either he confesses or we're going to go to trial with all this evidence to prove, right, that he specifically intended to cause this fire and as a result and in addition to that, you have uh a possible homicide as well. Okay, let's see what happens. >> He said that the lady in there might be a lady in there that >> Yeah, I know. We tried to make enter and got pushed out. >> She's in there. >> Yeah. Well, we guessed. We don't know for sure. >> They said they tried to call her, but they couldn't. >> We've got another call on the line of that. They believe they seen a spark from a power line that fell on the church is what possibly started this. >> I know y'all want to see, but if you will, just get on the other side of the building. Okay. Let the fire handle this. Okay. Come on. I know, pastor. >> I know. But we don't want you to get hurt, okay? All you can do right now is pray. Okay? I've asked multiple people and they don't know what happened. They just saw it. >> They said something about fire power line. >> And then they also said that where that's at, that's also the kitchen. >> We need y'all to stay back here, please, in case something goes boom. And we don't want that to happen. We want everybody to be safe. Stay on the side of the building there. Okay. >> I guess you stay up here and keep them pushed back and I'll go back down here and search. Looks like you're oldest person now. >> Start riding dig down. >> What about what these people over here? >> He said they were on this hill. >> We're about to start blowing. >> How many times we got to kill these people? Especially this guy in the blue. Y'all need to stay over here. >> I know. I work with the wife. I'm going to see you. >> I know, but you need to stay over there, too. >> It's a safety issue with power lines and everything falling down. >> I just want to see this water flowing cuz I ain't never see it come out the top of the truck like that. I always see them do that. >> I know. Stay over here. I work for the Y. >> He said what? >> She said she work for the Y. >> That's why she was walking over there. I don't do work for gas over there. >> No, even we had to back up. Even Casey back up cuz about to start spraying water. Yeah, I knew it was bad when we was coming down Jackson way down there and I started seeing smoke. I was like, "Oh god, this thing's gone." That's so sad. >> I hope that woman wasn't in there. >> What woman? The >> woman in that white car. They said she was in there. >> What's gone? >> Do they know that she was supposedly in there? Yeah, I told Lil about it and he said uh he tried to they tried to make entry and got blew back out and she was a sweet woman, too. >> God, that's just so sad. Look, uh one of the duties and responsibilities as you're in that perimeter is to definitely try to get as many witnesses as possible. In other words, canvas the area, maybe perhaps evacuate because of the smoke, right? So, get other resources. Uh maybe it might become uh multi-operational uh jurisdiction where you have all these multifunctional departments working together. Uh and start asking about this lady that's missing, right? The secretary uh that's uh that used to work there. People might know her, maybe her last whereabouts, all that good stuff. But definitely start getting as much info as possible and create a witness list along with a crime scene log that you're going to need because like I said before, you're going to need an inner perimeter, right? And you're also going to need an outer perimeter, right? Cast the uh the net real wide uh so that you can preserve as much evidence as possible, if any. >> There it goes. That ain't close enough, buddy. That ain't making it. That's just spraying them. I'm gonna tell Casey that that woman might have been in there. I don't know if he knows >> we our warehouse. A guy came in while we were getting an air conditioner. Busted through the door. >> Busted. This is at 7:00. Fire. Ask for water. He's sweating his ass off when he came over here. >> He came to the back door. I'm going to let Eric sit here as my supervisor, my immediate boss. He can tell you more. So, yeah. I don't know if he was involved, but But what he said, he used to work for Danny, which is our immediate boss. So, we should probably get his identity as well. >> She's in the church. >> Well, I didn't know if they knew her name. >> Yeah, >> did you hear what that guy was saying? >> She's not what they told me. >> Well, no, that >> she was in the church right before this and then another guy came asking for water and came here to run. >> Lee, Lee, come here. >> Tell him where she would be if she's in there. >> That's Linda. Yeah, she would have been in the hall of my office. >> It's bad, buddy. >> Yep. >> Don't like that at all. >> It's not only bad, it is reckless, grossly wanton disregard of life, right? It is so inhumane to know that uh you're going to start a fire and maybe perhaps a suspect had knowledge that the secretary was in there, that she was injured, right? A person was in there, an individual. So, yeah, this is uh it's just tough to swallow, you know? It's hard to watch. Hey, we got a fully engul church over here right beside city hall and they're thinking that there's a lady that was in there and Casey said to go ahead and call you. They said that some guy come over here and said that and said he's pouring sweat and acting all frantic and asking for water and they ran him off and they said then he walked over here to the church. They were just about to I think try to make entry to where she was at. When they tried to make entry like earlier they were like blown out. They've had to just sit here and spray it and spray it. So her car is here unlocked. The keys are not in it. The guy I talked to said his boss is on the way to give me a description. And he said that his higherup boss that the guy said he used to work for him, so he might know who he is, but they're on their way out here to talk to me. >> My supervisor, we were here before all this probably about 7:05. So we were here and some guy pops into my building and he's like, "Hey, I just went for a run." He was in a white shirt, half unbuttoned, pretty clean haircut. >> Disheveled as hell. >> We had thought we heard something downstairs. So I was like crackhead just try to jump in on. So we tried to kind of push him out of the door. I said I have nothing for you. And he's like I'm just looking for water. He said you got a bottle I can get from you or something. I said hang for you get out here whatever. He's like well maybe I can find some God's water and he's just digging around getting trash and can I get God's water? So he left. So I got my keys and all locked up and I was like yeah this guy's weird. So I came back outside and I saw that same guy. He was right here at this door knocking on the door. 100% same guy, white shirt, whatever. He didn't get anywhere, whatever. I locked up the van, turned it around, pulled it back, and before I went inside, somebody let him inside. Somebody let the mother I wish I wanted to church here. >> So, somebody let him inside. He did not burst in or nothing crazy. Somebody opened the door. He went inside. I thought, well, somebody let him in. So, I guess they're giving him water, whatever he needs. I don't know. >> And then he said he said he worked for Danny. I didn't think he would know who that is. >> Without us saying anything, he said our boss's name. I used to work for Danny. It's I used to work here. It's like, >> okay, you don't boss. So, he did say for Danny. >> So, there's a chance that we could probably identify him. >> I I guarantee if I saw that again, I >> I swear, not trying to I think every one of his like arms and legs were shaved. Like, he was clean. >> He looked clean. >> He looked like he was geeking out. >> Do y'all have your IDs with you? >> And what's the uh what's your phone number for you? >> 4233. everything. >> I hope he didn't. I hope he didn't have something they come in. We got to get everybody back cuz this is now an arson murder. So I don't need anybody that ain't supposed to be here. >> One of the girls said cuz Miss go every Thursday with the pastor. >> Did you have somebody go down there and look >> in the basement? In the church? >> Yeah. >> Because they couldn't get in the church. >> They can't even Yeah. >> They can't even get into the basement. My heart breaks if he's in there. >> I know. more than that. >> I know that's why I went ahead and accepted it. But still, I got pretty much everything that I think that they know. They said white shirt, half buttoned up. It was either short sleeved or rolled up. They said he's really clean cut. I thought his arms were shaved, maybe. >> Said that he would get God's water. >> Why do I feel like I'm going to die over it? Like it's just making me so was in the church being a sweet little old lady and open the door. I >> mean, Englewood on a wall here. Bradley County Chief's here. Steve Harvey's here. Steve Harvey. >> Damn, this guy's got tanks coming out of his ass, don't he? They're feeling him on that trailer over there. Oh, >> let me ask you a question. Has >> anybody ran the tag yet? Figure out who that belongs to. >> That's a older older female. Everybody's got to call her. Can't nobody get in touch with her. probably puppy. >> Hey, good puppy. Good puppy. >> What's going on, man? >> Huh? >> You hear me? >> Yeah. >> Remember whenever you was missing? >> Yeah. >> Doing all right? >> Yeah, I'm doing all right. >> I was just checking on you, man. I'm like a followup. >> Yeah, everything's good. >> Yeah. >> Okay. I'm going to stop right here because it's worth mentioning that uh here we are, right? It's a followup. were able to identify who the possible suspect is, right? And that's what we're going to get into this encounter uh with the uh possible suspect. But just know that these detectives uh are very good at what they do, right? There's an art to building that rapport and not really saying much uh without saying much, if you know what I mean, right? In other words, uh, less is more. And we're going to try to place you at the scene of this arson/homicide. So, let's see what happens. >> Check on you. >> Come on, Sarah. Come on. She's good. She knows. We watching the show. >> What show you watching? >> Uh, Picky Blinders, I think it is. >> Oh, that's pretty. She's all right. She's all right. >> Yeah, I like South Anarchy, but I watched that all of it years ago, so no, we're watching this anyway. But, but yeah, everything's been good. Everything's been real good. Okay. >> I mean, you can talk with her. She was the one that was worried about me in the first place. I really just ran off for two days. >> It's all good, man. It's all good. >> I'm saying I just ran off for two days. >> Need a break. >> Yeah. I just needed to get out of my own head for real. You know what I mean? You need to go out there in the woods and you do it. >> Hey, and we all have bad days, man. You're good. >> All right. Well, everything's good. But >> yesterday, you happen to go over to the golf field. >> I run around here all the time. Yeah. >> You run yesterday, too? >> I Yeah. Oh yeah, definitely. I ran today. >> Yeah. Why do you end up Did you go talk to the dude at the maintenance shift? >> Maintenance shed. >> The blue building up there. >> No, I I usually run to the soccer field, get that free water. I usually just walk around here. You see me around here all the time. You know what I mean? Walk my dog. I don't cause no problems. >> You ever go through that? >> Matter of fact, if anything, I'm a vict. I just wonder cuz some dudes over there at the maintenance shed said some dude came and talked to him yesterday. >> I talked to a couple people yesterday. I run around here all the time talking people about God. They had sent you guys up over to the Walmart over there first saying I was talking to kids and this and that and I was over there trying to preach. Can I go back in the house? >> Yeah, dude. All right. >> I was wondering why you were coming again twice to check on him when you already checked on him. Mhm. >> Hey Kyle, would you be cool if uh you don't have to do this? Would you be all right if I took some photos of your tattoos and put in your face just to show your picture? >> Yeah. This is crazy. This is crazy. I mean, >> I mean, this You don't have to. I'm just asking. I even saw some dudes and so what's going on? What happened? >> Why are you here? Did you go to other people's houses and do this, too? I'm not trying to be >> We have gone to scaring out of me, dude. It's just some dude to match your description came running from up top. >> I'm not even from here. >> I'm not even here. >> They spoke to some people at the uh maintenance shop at the university right there near the church. The dude kind of looks like you. >> No, all I know is a Danny. I talked to anybody from Tennessee Westland was a Danny. >> He said our boss's name. I used to work for Danny. I used to work here. It's like >> headed Danny. Really? >> He was my boss. We're just we're just rolling everybody out. So, like >> we're just we're just talking. We talked we talked they've talked to several people today all day long. >> The reason I asked about a photo is just to show the guys at the maintenance shop like, "Hey, does this dude talk to you like right around this time?" And they can be like, "Yes, no." >> I wish I could be more help. >> I mean, I appreciate your time. >> If you're walking around, that doesn't mean you're going to talk to somebody. That doesn't mean you're starting a fire either. >> No, it doesn't say. >> So, taking the one and doing the other, you let us know. I mean, we never find anybody if we don't ask questions. You know what I'm saying? >> I know. I get it. I understand. >> I appreciate it. Thank you, ma'am. >> Okay, let's stop right here. First of all, I got a question for you. Do you think the wife has knowledge about her husband being involved? What do you think? You think he told her about what happened? I don't know. You tell me. Now, with all that being said, look, she knows about the fire. Athens to me, and you can help me out, seems to be a very small town, very small community. So, everybody knows everybody's business. Okay. And I'm going to call BS because he doesn't want to take accountability and he certainly is not going to confess. I don't know that. But my thinking is, yeah, let's get a search warrant. Actually, let's get an arrest warrant because we have enough evidence to prove with all these set of facts, articulable that is, right, to know that you were at scene. We can place you there. You talked to uh two other witnesses that saw you go into the church and next thing you know it's on fire and unfortunately there was a lady there. So that's a homicide. You got a murder and an arson so far. Okay >> Kyle, you need anything? Reach out. All right. >> To be straightforward with you, Tennessee Bureau of Investigation that we're we're wanting to do a consent search of your residence to see if there's anything related to what we think possibly uh Kyle may have some knowledge about. I'm not going to give consent. I don't I cuz I don't know how confused he's getting and he's on medicine that he's been stopping and all kinds of stuff. >> You're a Dragon Ball fan or just got a shirt? >> Oh, yeah. Fusion Fortnite fan. Really? >> I ain't never done that. >> You don't play Fortnite? >> No, I don't play Fortnite. >> Fortnite's good. >> A little bit everything else, but not Fortnite. >> Hey, cops. I can go. We'll talk to you about it. >> What? >> So, look, you give us verbal consent. We look in your house and make sure we don't find anything. And I just want to make sure. >> Yes, sir. Yes, sir. >> Are you good? >> Yeah, I'm good. You're >> okay. And just to be clear, right, a lot of facts, I should say articulable facts to get that arrest warrant, right? To actually place Kyle at the scene of the arson, right? Let's go with the search first because if we're able to find more evidence, then we can go ahead and arrest them and forget the warrant. So, yes, consent's number one. And then if not, then we're just gonna have to get that search warrant and get it signed by the judge and go in there and just ransack the entire house to find more evidence. >> Yeah. >> Yeah. >> Kyle agreed, but his wife refused, forcing investigators to apply to a judge for a search warrant, not knowing if it would be approved or not. >> We're not arresting you right now. >> So they they want to search your home. We're going to apply for a search warrant. Judge grants it. We're going to search your house. Once we're done searching your house, you'll be free to go back in. But until then, it's we're going to have to wait. >> Don't give us any problems. We'll keep you handcuffed in the front. >> Oh, yeah. I won't give you no problems. I was raised right. Y'all kind of freaking me out. I talked with somebody from the TBI. I did a DNA swab and everything. I did all kinds of stuff. Search my house and everything. Well, what's this over? What's that thing? K. My Bible. >> Sorry. >> My Bible. 3-hour ride. >> We've got it up there. >> Okay. So, let's go ahead and wrap this case up. Uh, case number two, video two. And before we get started, you know what? Big shout out first and foremost to Athens PD for conducting a really good investigation and TBI, right? Obtaining that search warrant, getting more evidence to prove that Kyle was the one who started the fire and then uh committed that murder as well, right? What I will say is this, and I'll leave you with this. It's not so much of a question. It's the fact that the gravity of the loss, right? Both the destruction of that historical building, that only church probably in Athens, and the tragic murder of a community member. You know what? It's got to weigh so heavy on all parties involved, on all lenses, right throughout this entire investigation. So, my heart goes out to uh to the city of Athens and all involved. Okay. Now, let's go back to the first case. And the question we asked ourselves is, when do police officers decide to terminate a high-speed vehicle pursuit? Like always, first and foremost, a big shout out to Henry County Sheriff's Department. Look, the fact that you were involved in this wild crazy high-speed pursuit and nobody got hurt and you got out of your car a couple of times or you exited your vehicle and I know at some point you broke leather, right? Drawing exhibiting and you probably were thinking that you know what, I want to shoot him. I want to shoot this vehicle to stop it. But you know what? There is a lot of policies as it relates to shooting at a moving vehicle or shooting from a moving vehicle. I can tell you a lot of policies across a lot of police departments uh it's generally prohibited. Okay. So it's a good thing they maintain their composure and continue with that pursuit and never gave up. Okay. Now to answer the question is when do you decide well you know what it depends on the circumstances and I can tell you under these circumstances uh the suspect was circling back and forth. You can tell uh his mental state of mind was diminished right wasn't really all there not at a capacity where he know what he was doing. Frantic was on meds. didn't take his meds or took his meds. Just a mess to know that thank God that no one got hurt. Uh no one died, right? And as a result that you can tell he gave up at the end and he didn't go on on foot pursuit and try to take off and flee from the cops. So from that perspective and from that lens, from experience, and believe me, there's been a lot of high-speed pursuits. One too many in the city of Los Angeles. Henry County Sheriff's Department uh deputies did an outstanding job uh in this entire incident. Okay, please be safe out there. Roberto Martinez pleaded guilty to three counts of attempted first-degree murder and residential arson. Okay, he was sentenced to 18 years in prison with a 15-year arson sentence running concurrently. He is required to serve at least 15 years and 4 months before becoming eligible for release. and he was ordered to pay $7,693.25 in restitution and an additional $5,000 to the Henry County Sheriff's Department. Okay, so McMain County jury convicted Kyle Hickox of first-degree murder, arson, and abuse of a corpse. He received a mandatory minimum sentence of 51 years before becoming eligible for parole.
