Under Terry versus Ohio, a specific report of a disruptive described person is enough to detain briefly. The airlines call about an intoxicated passenger who threatens staff supplied that reasonable suspicion. Being drunk in public is itself an offense in Georgia when it turns loud or profane. Georgia Code section 161141 covers public drunkenness shown by boisterous or vulgar conduct. Once staff asked that she be escorted out, refusing to leave raised a second issue. Georgia Code section 16721 makes it criminal trespass to remain after a lawful notice to depart. Her insults toward the officer, though, were mostly protected speech, not a crime. George's disorderly conduct law, section 161139, reaches only true threats and fighting words. The line was crossed not by rudeness, but by her threats to beat the gate agent. That distinction traces back to Chaplain versus New Hampshire and the narrow fighting words doctrine. When she pulled away and refused to walk, a further statute came into play. Georgia Code section 1610-24 makes it obstruction to hinder an officer in his lawful duties. Finally, the takedown and handcuffing are measured under Graham versus Connor. That standard weighs the offense, any threat, and whether the person actively resisted. When an airline asks that a passenger be removed, a terminal gate is private ground, not a public square. staff can withdraw permission to be there. And once they do, staying becomes trespass. The place to contest that call is later with the airline, not by planting your feet at the gate. When anger rises, insults and threats are treated very differently by the law. Cursing at an officer is usually protected, but threatening to beat a bystander is not. One is speech. The other can be charged as disorderly conduct or assault. When an officer says, "Walk with me." Objecting out loud protects a person far better than pulling away. Physical resistance can convert a minor removal into an obstruction charge in seconds. Nothing about her situation improved by refusing to move. The charges only multiplied. When alcohol is in the picture, judgment on scene becomes an unreliable narrator. Decisions made while intoxicated in public can themselves be the crime before any resistance begins. Sobering up in a cell is a far worse outcome than a quiet ride home would have been. An escort off a concourse is a small thing easily survived by simply walking. The heaviest cost here came from words and resistance, not from the original call. Knowing when to leave is often the most powerful ride a person holds.
