As a cop, you never see it coming. You never know how quickly a routine call can turn into a deadly confrontation. We have a man who opens fire on cops during a heated standoff. >> Came out the front door, I think shooting at me. >> Drop the gun! >> We got gunfire. >> Down! >> I can't see him. >> He's shooting the propane tank. >> And we have a suspect who sets his own home on fire before officers make a deadly discovery. >> He's got my house on fire. I said, "Yeah, your house is on fire." >> Hello. >> Anybody in there? >> Got it in the truck, backed it up, and backed out of the driveway, and took off down the road. >> What's going on here? >> Well, that's what we're trying to figure out. What happened to your hands, sir? >> But first, cops respond to reports of a man firing his rifle near an apartment building. Take a look. >> I know who is it who's shooting? Okay. And his last name? And his address? >> Okay, what is he shooting at, ma'am? >> The apartment. >> In what apartment? And who are we dealing with? >> We're dealing with Floyd or I do not know the apartment number. >> 600 units are now being involved. He is outside the building, has a rifle, and is in a wheelchair. >> I thought it was the I thought there was another apartment complex, a blue building. >> No. What's this guy's name? >> Natasha. >> 2430, can I get the first name of the subject? >> It's Floyd Floyd. >> Picture get covered, bro. >> 5753, if you get him on the ground, don't cuff him, just keep him at gunpoint till everybody else gets there. >> Copy. 343, my rifle is >> jammed in the lock. >> At the apartment building, have you actually seen him have the door open? >> Here. Here. There's a window right there. Here. Here. Down. Stay. You want me to keep that? Come Come this way. I don't see anything. Thought they're in a wheelchair. Is there a door on the back, DJ? Boyd is out, Frank. Good work. 10-4. Hey DJ, I got this trailer open. Please, if you're in THE TRAILER, COME OUT. [screaming] He's in the house. He's in the wheelchair. I got him in the window. In the window, DJ. Okay, go back over here, bro. Can you guys see this front door so I can move to the back? Hey, we need to get a PA on this. I got somebody yelling in this window right in front of where I'm at. Hey, I'm here. On me? On you. Sheriff's office, PUT THE GUNS DOWN AND COME OUTSIDE. RIGHT THERE. DOWN. DOWN. Got him, Johnny? Nope. HE'S DOWN. DOWN. >> DROP THE GUN. >> CROSSFIRE. GET BACK. HERE. HERE. He just shot at me. 284, shots fired. Shots fired. You good? Yep, I'm good. 57, we have several shots fired. Here. Down. Down. Watch your crossfire, guys. >> You got to assess what you have. >> high-power rifle who is just blasting from a position of advantage. And one of the things you got to take in consideration is exactly that. If he kind of is barricading himself, you got to know how you're going to set up the perimeter as units start responding and you start formulating this plan as to how is it that you get him to drop the gun. I mean, that should be the goal. That should be the outcome is for him to drop Drop the gun. Drop the gun. You got to give those warnings as you engage in deadly fire. >> I have a rifle. >> Drop the gun! [ __ ] >> Crossfire. Crossfire. >> 24 forest. Get cert page now. We got gunfire. >> Get behind some cover, boys. >> Here. Here. Here. Here. Here. Come here. >> DJ, you got a rifle. Grab this uh He's up front. He just pulled out the front and was shooting at me. >> Get cert page now. >> Here. >> Shots fired. >> Down. Good boy. >> Which window is it? >> He came out the front door, I think, shooting at me. >> Johnny, you need to fall back to this house. >> Cover me. >> Here. You cover. >> Just wanted to add that uh it seems as though DJ has the AR-15, the assault rifle, which you need him right up front. What stands out a lot, and I know it's easy to kind of just critique, which I won't do. All I'm just saying this is that we need other resources. I wish they actually had them. Uh I'll give you an example. A drone would have been perfect for this because now you can send out a drone and get a really good clear picture of the surrounding perimeter of I should say the quadrant, right? Of where the suspect happens to be. Uh you know, it's easy to say, but you don't have those necessary resources when time is of the essence and you're just involved in a major major gunfight. >> WHO'S SHOOTING? HERE. >> MY DOOR'S UNLOCKED, SO DON'T LET HIM GET TO THAT CAR. >> Let's go around. >> No, we're good. We're good. >> This is horrible. >> He's in the doorway, Johnny. >> No. I don't >> [snorts] >> I can't shoot with them guys over there. >> No. >> We can't be here. There's that tank here, bro. >> 20 4, I don't know if you copy, but crossfire, crossfire. >> 5 7 4, notify 5 1 bolt >> As a reminder, always look out for crossfire. Crossfire, crossfire, crossfire. And you know what? Cover and concealment. Cover and concealment. Very, very important to know. >> Current officer discharge of weapon. >> Babbitt, you good? >> Where is he? >> Behind your squad? I think somebody's behind your squad. I don't know who it is. >> You want me to work around the back? >> No, stay right there. The other guy's got the other corner. He can't go anywhere. It's my heat alarm. >> 10 4, I'm going to work around the >> It's my squad. >> Hey, shut your car. It's overheating. >> Yeah. >> We had bad crossfire. We're behind uh Palace right now. I'm going to work around this fence to try to get a front front angle on him. >> You good, Trevor? Deep breath. >> 10 4, side of the house, need air. >> He's armed. >> Can you shut this thing up? >> GET INSIDE THE HOUSE! GET OFF THIS ROAD! >> COME ON, GUYS. >> DOWN, DOWN. >> Third window, DJ. >> I can't see him. >> the propane tanks. >> That ain't >> 19 4 He's out of the propane tank, yeah. Across the road up >> I think I got him. He's in his wheelchair up front. Let me see your hands! >> Do you think he still has the rifle, Babbitt? >> I can't tell. The last shot, he dropped forward and he dropped something. I I I can't tell. He hasn't moved since I shot last. >> Is he in the front of the building cuz we can work up to this corner? >> Yeah. You >> you me to work this? >> He's down the front steps. >> You want to work up this building then? >> This way. >> Stand by for approach. In my car there's binoculars. Richard. Get my binoculars out of my car. >> Besides? >> Yeah. >> 387 out of 300s. I have eyes on him yet. He's still in his wheelchair. >> Does he have the rifle? >> Hey, somebody's got cover I can grab my binoculars. >> I got binoculars in my car though. >> If anybody wants them. >> He doesn't have the rifle, right? >> AR style rifle at his feet. I believe the rails facing the red car. There's something wrong with his something there. >> We can approach him. >> You want to make contact? >> Yep. >> If you guys can see, you guys can approach. We'll stay here. >> Do we have the most cover though? They got to come through that front yard. >> The barrel it's on the floor it's on the ground and it's facing this way. You want to work up a little bit? I just don't know is there anybody else in there? The shooting stopped. >> Shooting stopped. I had an individual who I got here was running down there. >> Hold on, hold on. >> I don't got gloves Richard. >> No, I got my own. >> We want to turn the kids right? >> I can't see him. >> We got a propane tank here. You need to stay behind cover right now. Go to the fence. Yeah, I know. The guy's we we got to get make sure he's in custody. >> Oh, okay. >> All right boys, we're going to go right to the right to the apartment and straight across. No, I'd go apartment and straight across and we have a little angle on him. >> What do you from here to straight across? >> Go, go. Cover that. Get to that bush in the by the apartment and then we'll work our way across. 244s we're going to start approaching. >> They're moving up. >> They are? >> I'm just going to cover the house then. Once we get him secure we'll have to go get some first aid stuff to get him in the car. >> 244s we're going to go back. >> I don't have a vest for him so we're clearing the building he's not going in. His vest is at my in my office. >> Police scanner Sheriff's Office. You're under arrest. >> Orange County Sheriff's Office. Orange County Sheriff's Office, you're under arrest. >> All units 10-34, we're moving in. >> Orange County Sheriff's Office. Don't reach for that gun. Sheriff's Office, don't reach for the gun. >> I'll get the gun. Got it. Weapon secured. All right, let's get him out and see what we can do. >> Okay, they got him. Let's move up. >> I got it. Yeah, that's right. He's on the ground. >> This is going to end up being a multi-jurisdictional, multi-functional unified command type of incident. Uh where there's going to be multiple shooters. Just a very, very complex post-management OIS investigation. Look, what I will say is this is that it's all heroic. Gosh, think about it. It could have ended up much, much worse. You know what? I'm going to leave you with this. You don't get to choose the OIS because the OIS chooses you. All right? We'll find out what happened to him shortly, but first cops respond to reports of a house fire. >> Hey, did you all see which way he went? Who what what way? Is that your house? No. There wasn't a There wasn't a truck just There wasn't a truck There wasn't a truck that just left? >> I didn't see anything that just left. >> No. >> I heard people yelling and that's that's about it and then >> Yeah, I got you. You don't know who lives there? >> I didn't even try to know who lives there. It's the drama house, but >> The drama house? Yeah, I got you. What's going on, man? You live right here? >> Yep. >> Okay. What did you see? Or what do you know, I guess? Looking at a someone posting. >> I'm right going live. >> What's that? >> Someone going live on YouTube. >> Who is? >> One of the neighbors rolled up and said that he passed another white GMC Sierra. >> Is that him? >> Yeah. >> It could be him. Is it just what do you you live right here, right? Is it Who all lives in here? Just one guy? Okay. >> Nobody's in the house. >> He's saying there's no one >> What? >> He's saying there's no one in the house. Did you guys see anything other than just >> The god damn house was on fire and I get woken up to the house was on fire. >> Okay. >> I saw fire. I didn't know what was it that was that guy's property. >> I've seen it. >> And his house was on fire. >> take off like a Okay. >> Which is my brother. >> That's your brother? >> Yeah. >> What's your name? >> Kevin. >> May be detained? >> No, sir. >> Uh no, you're not, sir, but you are going to be a material witness uh to this arson investigation, right? >> I'm just making sure everyone's good. >> You're free to go back to the car. >> Yeah. You weren't involved, right? You just woke up? >> It was on fire. >> I pulled up. >> One porch was on fire. I told her about it. And then I came out and I looked again and I yelled for him. He came around the corner, back side of the trailer, came around the corner. Oh my god, my house is on fire. I said, "Yeah, your house is on fire." Anybody in there? And he got in the truck. He said, "I can't find my phone." >> Uh-huh. >> He got in the truck, backed it up cuz he was getting close to it. The flames were getting close to the front porch. I backed out of the driveway and took off down the road. The parents were behind him. >> Here guys, hey, let's scoop down cuz those are rounds going off in that house. You don't know anything about that guy? >> Other than he's a troublemaker and he creates a bunch of >> Okay. >> [laughter] >> Awesome. Yes, and what did you say, ma'am? What did you just say? >> Yeah, I heard his brother come out and say, "What?" and scream at him and say, "What did you do?" >> Is that his brother? Does his brother live behind him? >> Behind him with his mom. >> Yes, sir. Okay. >> Unless you bring him his GPS monitor. >> No, we don't I don't think we have access to that. That's the probation officer. >> He's not on probation. He's on retainer. >> Oh. How do you know he's up by 7-Eleven? >> I'm just getting the information when I get it. >> Okay. I appreciate it. Won't argue with you. You got anything on you, man? You got nothing? What's going on tonight? You didn't do nothing? Get Close the door. Close the door. >> I didn't do anything. What did I do? What's going on? >> Don't reach. >> I just want to >> I'm going to come pat you down. >> Okay. >> All right, put your hands on the car for me. >> What did I do? >> Put your hands on the car for me. >> I didn't do anything. >> All right, you got anything on you at all? >> No, what the heck is going on? >> What happened? So, what happened at the house, man? >> I was what? I was listening I was listening to music. What the heck is going on? >> That's what we're trying to figure out. What happened to your hands? I had to go with her to the hospital. What happened? I was listening to music. And all of a sudden I started seeing a fire. All of a sudden I started seeing a bright light. >> Stand in the vehicle for us. >> I'm just I'm just Let me just say it out. What I'm doing. What the hell is going on? >> That's what we're trying to figure out. So, keep explaining. >> Anyways, um I was listening to music. All of a sudden what woke me up I see light, fire. And that's all It was on the outside. So, I don't know what is going on. I called earlier. I I'm on my phone. I'm just um I I made a call. Uh someone is with me. I I called and they said someone was in my house. >> Okay. >> Remember I I talked to him. >> No, it wasn't me. >> Um my uh baby's mama. So, I figured she was at but she's supposed to have a cop come there if she wants anything. >> Okay. >> So, I and I saw the fire. >> You probably have enough PC and enough probable cause to believe with a set of articulable facts that he committed that arson. We're not quite there yet to cross that threshold, but we're getting close. One of the options that you have, you got to cuff him up, detain him, and you know what? Take your time. Let him get all nervous and gather his thoughts because we want to hear the story as to why you left your house. >> I don't know what the fire I have no clue. I was I was listening to music with him. And all of a sudden I'm not serious. >> So, you have no clue and you just decided to leave while your house is on fire? That's what we're trying to put together, man. >> What do you want me to do? >> You can wait for the fire department. >> My mom is It's her property. So, it's just my house. >> So, you >> So, you live there? >> Yeah, I did I don't >> So you saw a fire? >> What's all like I'm really okay Get this straight. I'm running >> Well, we don't know. I mean we we got you here instead of at your house. >> Let me back this up real quick. >> Okay. >> I got an ankle monitor on. So if I'm running >> Right. >> I've got the [ __ ] off. >> Yeah. >> Yeah, no I get it. Right. I wasn't running. >> So you got an ankle monitor. Are you supposed to be out this late? >> Yeah. >> Uh-oh, bro. >> Yeah. I'm actually meeting my son. >> Your son's coming here? >> Yeah, Junior. Yeah. >> Okay. >> I was calling my son to call my mom. >> So you got no idea how the fire started? >> I have no clue. >> So you just saw the fire >> to >> So let me get this straight. >> I really don't. >> Let me get this straight. >> I was listening to music. >> I understand what you're telling me, but you're telling me that you saw a fire and you just left. >> was starting to get bright. I tried to >> Did you call Did you call fire department? >> No, I I wasn't down there. I tried to put it out. I got I got a bucket and I tried I pushed the thing out the window. It was the thing I pushed. I tried to get it out. That's the start. >> I don't know. You have no clue. >> I have no [ __ ] clue. I really don't. >> Did you report it to >> I was in and out of there cuz I was trying to get some stuff. And I got to get him. First I got to get him to 55 minutes East. I guess I was gone. >> I want to question the owner of the property. Who's that? The older lady or the one with the black hair? Okay. Is that Mom? >> Yeah. >> Okay. >> I'm here. >> Can I talk to you real quick, ma'am? All right. What's What's going on? Like y'all just wake up to a fire? >> I heard some banging around 12:00 or so. >> And he's He told me at 5:00 that somebody was on top of his roof. He thought it He said it was his ex-wife or ex-girlfriend or whatever was on top of the roof. >> Trust me, unless he built a stairway, she ain't getting on no roof. >> Okay. >> Yeah, I'mma call BS on that. He's just making up a story. Now you got multiple witnesses. Now, what you definitely want to do is the officers that are at scene, right, of this arson have to be communicating with the officers that are at the 7-Eleven because you want to be able to relay all this information so that you do build enough PC to go ahead and cuff him and take him to the station and then Mirandize him, right? >> What's that? >> I said everything >> Yeah. So, did he Uh do you know how the fire got started? >> He did it with the gas can. She seen him the other day at the gas station. the other morning when I was there, he was filling up the gas cans. >> Okay. >> But he was going to burn the house down with >> He said that? >> Yeah, several times. >> When did he say that? Like today or >> No, not today. I didn't know to expect anything today. >> My mom then she said she said something, yeah. Exactly. That's what it is. They don't want me there cuz the last time. >> Right. >> [snorts] >> That's what this >> Have you been having issues since then? >> Huh? >> Have you been having issues since then? >> No. >> You've been staying out of trouble since then? >> Yeah. I don't know I can't I don't know I don't know I can't cuz I don't know I don't know what I don't know what to do. >> Why'd you panic? Huh? >> Cuz my house was burning on on us. This this cuz you guys did what you did, you caused me problems. The last time you guys >> Why'd we pull up on you last time? >> Cuz my mom. Remember? >> Mhm. >> Yeah, them. I had that house when I was 17. >> Yeah. Were you having any psych issues today? >> No. >> Seeing things at all? Nothing like that? Do you know what today is? >> Yeah. I believe it is Tu- Yeah, Tuesday. No, it's Monday night, Tuesday. >> Do you know what day it is? >> It's uh April 7th. >> Like today? >> Uh April 7th. April 7th. >> Okay. Do you know who the president is? >> Yeah, Trump. Or >> Okay. >> Yeah, yeah. No, >> If I gave you five quarters, how much would you have? >> A dollar 25. No, I don't know. They didn't want me but it was they didn't want me back there. So they've been actually a lot they've been letting me out of my time. >> Very bad. >> Huh? Huh? >> What are you doing? >> They rolled up on me and scared the [ __ ] out of me. >> You got anything on you at all, man? Just if you want to be over here. Weapons or anything? Mind if I pat pat Mind if I pat down real quick? >> Go for it. >> All right, turn around, face away from me. I asked him the questions. He doesn't want to hurt himself, doesn't want to hurt anyone else. He doesn't seem like he's going through any type of sort of psych thing. He said he's not seeing things, he's not hearing things. He's says he's been staying out of trouble since the last time we interacted with him. He says he panicked once he saw the fire start, tried putting it out, realized he couldn't put it out and just left. Yeah, that's what I'm saying. >> Trying to find my house. >> Mr. Mr. William, this is the first time I've ever met you, man. I I Like I said, I don't know any past issues. >> Right. >> We're just out here because somebody said like obviously the house is on fire. That's first off for all we know. >> Yeah, it wasn't me. I wouldn't Why would I burn my own house down? Seriously, why? I've been trying to get my Yeah, I want to. >> That's the question we're trying to figure out. You know what I mean? >> And then all these >> We're just trying to figure out who did it. >> I have no clue. >> Or or or why. >> They've been putting me next door. I had called I had called earlier. >> Look at this. >> They were I was I was I was they're bothering me. So I did the right thing and called you guys, which I don't know I don't >> Which I do appreciate that. >> I don't like calling you guys at all. >> Okay. >> So what does that tell you? I don't want to get in trouble but you guys rolled up on me like this. Hear this. >> Like I said, >> That's cuz they I had like 18 cops they all had a bunch surrounded young surrounded and everything. >> Like I said, this could completely been a natural fire. Nobody We don't know yet. >> I was going to the store to get a cigarettes. >> You know, I'm going to call BS on the man. Push the BS button because there's no way that we are led to believe that this is just a natural fire. >> I know. I swear to god if I was guilty, you sure would think I'd cut that thing off, right? >> Yeah, if you were running it. >> Am I Am I right? I lost lost my house when I paid when I was 70. >> I mean, running with a ankle monitor would be the smartest thing. >> That'd be the stupidest. >> They can easily track you. >> They know. That'd be the stupidest thing to burn my house on fire. >> Yeah, no. I see how they're all rolled up. I'm like, "What the Look like you murdered somebody. >> I know. >> We've had We've had some serious reports of this. >> I thought >> I don't know all the reports yet. >> They really busted in like, "No, this guy ain't running." >> Let's Let's put the Let's put the weapon on the ground. >> My bad. My bad. >> I'm just messing with you, dude. >> I'm just messing with you. >> Oh my god, really? Yeah, I'm so violent. >> No, I'm just messing with you, dude. >> Something else to point out, maybe you can help me out with this, is uh his hands might be contaminated with gasoline fuel, okay? So, if you had him in custody and take him back to the station, you can request and notify CSI to come out and swab his hands to see if you get any type of match of gasoline fuel that ties him into the house with the gasoline, right? So, just a point of thought. What do you think? >> Yeah, I got um >> I mean, technically it's a weapon. Could be used as it. Okay. >> But anyways, he accused my dad say "For being My dad was with me." And he said he seen him in the house having >> You? >> Mhm. >> Okay. >> That him? You're not my fiance. Where is Brian? >> Oh, I'm sorry. I'm sorry. I didn't hear. I thought you were pointing. My My apologies. >> There's Brian. He'll tell you about all that. >> Well well we'll come back to that in a minute. >> They've been wanting They've been wanting me gone. They wanted us all gone. He'll tell you. I didn't even want this to happen. >> Who wants you gone? >> His mother My mom's other half. He wants us all gone cuz >> Your mother's >> Which one? Her husband? Both? >> Both of them or whatever. >> Both of them or whatever. >> Got you. >> I don't like him. That's what caused all this last time. >> Yeah, step parents usually aren't the best. >> He don't like me, so that's why. >> No one saw anything tonight other than the house is up and he gets in his >> him running with the gas can too? >> I did not see anything. >> I thought I seen a gas can back there, but I'm back there and he's leaving. I didn't even call the cops. We got him. I mean park >> vehicle on this property which he's not supposed to be at all. >> Can I have a bracelet? >> saw him walking away. >> He's got an ankle monitor on him. >> Okay. >> Cuz I've been up uh court this morning and I was getting ready to go to bed. Cleaned up, gave him dog food, cleaned this one, you know, did my thing. And all of a sudden I seen the porch light coming up from uh outside the door and I tried to uh >> What's the Did you actually see it? >> I haven't been down there yet. I got my other crew down there. >> Probably nothing like it, but um I tried to put it out myself. >> Okay. How did you do that? >> I I I was um I took >> Hey, what was that thing? >> Uh the window frame. >> The what? Was that metal by the window? Metal, right? There's metal I threw the metal >> I threw this like a metal frame. I pushed it out of the way. >> Okay. >> tried to put the water on there. >> Where did you get the water from? >> The sinks are here. That's where it started at, yeah. >> Okay. >> So I I I I before the fire Yeah. >> Have you had any weird electrical issues lately? >> Yes, I've been having um they keep popping. >> Breakers? >> Yeah. >> Okay. >> Well, yeah. They got >> They keep popping. Um what else? >> I >> I I I >> And and oh, it was leaking in there, too. >> Okay. >> In the like the breaker box. >> Okay. >> Yeah. >> What? >> The breaker uh breaker box. >> Was leaking what though into it? What was leaking? >> Water when it rains and stuff like that. >> Okay. Got you. Um do you Do you remember hearing any noises before you saw the fire? >> what I heard pop. I heard popping and I seen flames. That's what That's But I've been hearing the the what? And I don't call He'll tell you. I don't call guys at all. When do you ever have a call from me? So >> So let me let me just be straight up with you. >> Okay. >> I've never met you. You've never met me, right? >> Yeah, I know. >> Is there any reason that you would have had any accelerants where the fire lit? >> I was No, I was in the house. >> Okay. Um I'm going to ask you just straight up, did you light the fire? >> No. Why would I? >> I I'm just asking. >> I'm not saying that. >> It's Hey, any fire case I have to ask, okay? It's a standard question. >> Do you think he started the fire or did the >> I'm not sure. >> I'm not >> I'm not >> No. >> Do you see me in bunker gear? >> In what? >> Bunker gear. >> Bunker gear? >> No, sir. >> All right. Okay. And before I leave here, this is the only opportunity you're going to get to talk. >> Okay. >> All right. >> It's a 30-minute drive for me down there. And if I get down there and I see this there's evidence and it looks like it was intentional, there's not going to be another chance to talk about it, okay? Did something happen by accident to cause the fire tonight? >> I had put the gas can in the house. That's all I did. The gas can. >> That's all I did. Yes. That's all I did because like I I called earlier. So I put it in the house. I was uh trying to uh fix the lawn mower. I was >> The lawn mower is a push mower. That's all. >> So let me explain something to you real quick, okay? >> And I And then I I probably wasn't thinking right. >> No, probably not. >> But >> you know >> Bad things happen. It's easy to make mistakes. >> Yeah, but I did it. >> You're tired. You got a lot going on mentally. You're drunk. You got a good head on your shoulders. I would never do that. So you're saying you saw the Facebook post the other day. I just arrested her the other day because she flicked a cigarette in your house and let it on fire. All right, it's a serious thing. And so in in my position I've investigated a lot of fires and I'm I'm not telling you what evidence is there, but one of the things that we look for it's not just a gas can being there, it's the slick around it. It's like a rainbow colored gas slick around it and that indicates the gas was dumped out and then lit, okay? And and I have a feeling that what I'm hearing that might have happened and that doesn't that doesn't happen from the gas can itself being lit. That's it's poured out and then lit, okay? I'm just trying to give you an honest chance here before I leave. Is there any chance that you might have spilled some gas and accidentally lit it? Not necessarily. What what's up with the statements that you made within the last week or so about burning the house down? You running You running You running Do you have any insurance Do you have insurance on the house? No. No, why would I? Right. Okay. All right, so >> And again, for the record, I just want to make clear that they are having communication, right? We are all working together doing an outstanding job. The only thing that I would do different or another option I should say or the best option should be cuff them up, give them Miranda warnings and lock them in on a statement, confess, right? If not, he's full of BS is what it comes down to. So three things happen when you're trying to get a confession. You're either going to tell the truth, which often times you're not going to get that, right? Or they're going to lie or they're going to invoke their Fifth Amendment right to self-incrimination, so and they're going to ask for a lawyer. Wow. What is it? Got you. So it's your brother? Yeah. But you know his house burned down this weekend too. So I said if he gets if you guys find him he definitely needs to Did he say if anybody did it a name or did he tell you? He didn't say like Okay. All right. What about you sir? Did he say anything to you? >> When I walked out here this front porch was already a blaze. >> This front porch? >> I started walking out towards the hose and I said what the hell did you do Billy? I said you burned down your own house and he says to me what the do you care? That was it. I got He didn't deny it. >> Right. >> He didn't say he did it either. >> Okay. >> That's all That's all That's all he said. >> Are you father >> Let me interrupt right here because that statement alone, that's your independent witness regardless if he's related to the mom, right? His stepfather, the boyfriend, whatever the case may be, that is factual. If that's exactly what he said, you have enough. Relay that information to the investigator over at 7-Eleven, cuff him up, take him to the station. >> No, I'm her I'm her other house. >> Okay. >> Her fiance. >> Fiance? Okay, awesome. Okay. Do you have an ID on you sir by chance? >> Sure. >> Awesome. >> That is awesome. >> No, that's fine. So what do you What do you think kicked off or started like what made him Did Did he burn his own house down or did something happen? >> him that he did not do it. >> Told you? >> He told both of us he didn't do it. >> After he >> Me mostly. He told me >> Did he call you on the phone to say I didn't burn >> He was in the yard when he called and told me he I was up here and he was in the yard and he told me he didn't do it. >> Okay, while the house is on fire. >> Yeah. >> Okay, he didn't do it. >> No, but he said he has said before that he was going to burn the house down. He said there's ghosts in there and there's voices telling him to do stuff. >> Okay. >> Okay, so whatever what's happening in his head. >> Did he say that today? >> Oh, he's been saying it for all of the time. >> Okay. >> Bryant continues speaking with deputies alongside the family hours before he would be found stabbed to death near a second blazing structure on the property. Back with William, officials are about to make a determination with deadly consequences. >> Up here, so I didn't have my phone. >> Okay. >> I didn't think I had >> I want to go down there and take a look for myself and and we'll be in touch, okay? >> I was I would have burned the house down if I would have tried. >> Okay, I understood. >> Strange things have happened, okay? And that's what I'm saying. That's why I'm telling you, sir. I don't I don't think that you meant to do anything. I'm asking if there's a chance that there might have been an accident that caused it because an accident's a lot easier to explain than you saying you didn't do it and then the evidence there saying you did. You know what I mean? I was just trying to give you this opportunity to to open up to >> I do smoke, so I know >> What do you normally do with your cigarettes? Throw them on the ground? Yeah. Do you have an ashtray or no? >> I I I Whatever it was, I just came home. You can check the GPS. I just came home and I was just smoking. >> Is it possible that maybe you accidentally dropped a cigarette in the area where you put that gas can? Maybe? >> Maybe. >> Okay. I mean, that that that makes sense to me, man. >> Well, yeah, it was outside though. That's what had happened. I just came home. >> But you said you put the gas can inside. >> Yeah, yeah, but the gas can Yeah, yeah, it just had barbecue. >> Okay. How much gas Was it a 5-gallon can? >> No, it was >> One of the small ones? >> Yeah, small one. >> Okay, but it had gas in it? >> Yeah, there wasn't much. >> Not much, just a little bit. Okay. Did it smell? Did it smell like gas? >> was going to Yeah, it was just enough to start the >> Be straight up with me. Am I going to find a Maverick cigarette near the gas can? Is there a chance that I'm going to find it there? >> Okay. >> I don't know, actually. I don't know. You don't know? >> No. No. No. No. >> So, is there a chance >> Doesn't mean that it will be there. Is there a chance >> is. I No, I don't think it would be. >> Okay. All right, there would not be. No. >> Do you have a valid license right now? >> Okay. >> All right. See you. >> No. >> Yes, he does. >> No, he does. I I don't. >> So, he's going to drive home. You all are going to your place. Truck's locked. Truck's locked. [snorts] Do you have the keys? >> They're in the vehicle. >> They're in it. Okay. You'll figure it out. >> Yeah. >> Is your window cracked? >> Yeah, a little bit. >> You want me to try and get it on >> The best thing is to detain him. Don't let him go. Put him in the backseat of the police cruiser, make him sweat, make him nervous, make him really think for hours, if that's what it takes. Take him back to the station because the evidence is going to pretty much paint this entire picture for you to go back in and begin the interrogation in the box. >> I'll do it for you. >> If you want. >> Yeah, I can do that for you if you want to. >> Just right here on our body camera, I need you to say that if something happens to your truck, if I scratch it, something like that, you're not going to sue me. >> Yeah, I'm not going to sue you. >> All right. Give me 1 second, okay? >> All right. All right. >> See, it wasn't that bad. >> I told you he's not going to >> Okay, final thoughts here. If you have reasons to believe with a set of articulable facts, all these witnesses, the fact that he said that he had a gas can, the fact that his hands might have that residue of gasoline, and all other types of evidence, you're better off just going ahead and detaining him, right? Legally, take him back to the station, get him in the box. Custody interrogation equals Miranda, right? That's when you can Mirandize, give that warning. If he decides to invoke, that's a whole different story, okay? And it takes a lot of experience, training, and a lot of classes, right? That science-based interrogation course that all detectives should take, especially if you're working arson homicide and a lot of these violent crimes to get good at your craft, okay? Okay, so Floyd was fatally shot during the altercation and died at the scene. The investigation conducted by the Wisconsin Department of Justice Division of Criminal Investigations, known as DCI, concluded that the officer's use of deadly force was fully justified, okay? No charges were filed against any of them. Okay, so Welling was charged with the following: first-degree premeditated murder, second-degree arson, tampering with an electronic monitoring device, and battery on a law enforcement officer.
