When a stop turns into a gunfire, officers have almost no time to be safe and get it right. >> Taking a left. Taking a left on Whispering Heels. Wrecked out. Wrecked out. Wrecked out. [screaming] Shots there. Shots there. >> And this domestic suspect crashes into a police motorcycle before officers open fire. He said he wants to shoot out vehicles. >> Shots fired. Shots fired. >> If you want first aid, put your hands up in the air. >> But first, a Kentucky trooper tries to stop a car. The driver runs and what happens next sparks a serious lawsuit. Take a look. RP right now in the driver's seat. We're driver. We're passing right now. >> We're coming up on right now. We're going to go travel. >> Taking a left. Taking a left on Whispering Heels. Let's go back over. Got on mail. Continue on middle road. We're coming up intersection. Whispering hills. Taking right on Whisper Hills. How much? 6 miles. There's light traffic. If I get an opportunity, I'm going to hit. Okay, I'm going to stop right there and just kind of mention the fact that, man, look, pursuits, I've said this before and I'll continue to say so we can educate ourselves. And if you're new to the channel, that pursuits are inherently dangerous, period. I mean, it's probably one of the most dangerous functions uh that police officers can be involved in because you got to take so many things in consideration, right? I mean, you have the innocent bystanders that are walking around. As you can see, this is a residential area. God forbid, you know, a pedestrian walks through just a lot. You might have to um tracking mode like back off, even terminate the pursuit. pursue package normally in a lot of agencies is two police vehicles armed or I should say equipped with lights, emergency lights, right? Preferably black and whites. And so, as you know, and I'm going to tell you from experience, 24 plus years uh with the Los Angeles Police Department involved in pursuits, the way this guy's hauling ass, there is no way that he's just going to put it in park or maybe even TC collide, right, into an accident and come out with his hands up and taking verbal commands. That's not going to happen. And he's going to bail. And now the foot chase is on. >> Negative on that for right now. Turn on Butterwood Way. Turn right. Turn on Brick Shore Avenue. Taking a left on take a right. Take a left. >> I'm not sure right now. Just take a left. Coming up on Hill Green Street. Taking a right on Green Street. Take a left on Caesar Bridge. He's reached in five other units. He's reached in the console. Taking right on street. How close. Take a left on court. It's a cold act today. AND let me stop right there and look, does he have the option to TC so we can stop the pursuit? Of course he does. But then again, you know what? I'm not one to put myself uh in the officer's shoes, the trooper shoes, and to make that decision. You know, you you kind of got to go with the flow. We're following them, you know. And by the way, left and right, that's all great. I tell you, I'm not I never been to Kentucky. And if I'm a new officer in Kentucky, I definitely would want to know if I'm traveling southbound, eastbound, or westbound. Hey, we're making a left turn now, going southbound, approaching the main boulevard. Okay, he just made a left. Now we're traveling eastbound. One of those things. But then again, you know, again, this is third practice. And I can tell you that the way I was taught, my training officers will always say, "Stop telling me left or right. You got to tell me which direction to travel." It's very, very important. So that way units when they are coming to help you uh you know how to COORDINATE THOSE EFFORTS. TAKE A RIDE ON HISTORY. Taking all that on the road. Still on the road about 4 milesPH between 50 and 40 mph traffic. 97 coming out on Veterans Right now. Morgantown Road. Left on Morgantown Road. Coming up on the intersection [music] of Veterans Morgantown Road. >> Look around. Going back on Morgantown Road towards town. Taking a left on Willby Lane. Outstanding broadcasting, by the way. I mean, he's right on him. You cannot let him go. You can't Don't lose him. Right. Right. RIGHT. Stop bleeding. STOP SHORT. [screaming] SHOTS FIRED. I GOT YOU. CROSS FIRE. CROSS FIRE. Show me your ass. SHOW ME YOUR ASS. Let's do this. YEAH. Get on the ground. Show [screaming] me your HANDS RIGHT NOW, MOTHER. SHOW ME YOUR HANDS. SHOW ME YOUR HANDS. CHUCK BIRD. GOT one gun point. >> Shoot you. You son. SHOW ME YOUR ASS. >> PUT YOUR HANDS up now. >> DON'T YOU MOVE. SOMEONE GET IN FRONT SO WE CAN SEE his hands better. [screaming] >> HANDS. Turn the around. >> While the chaos is going, look, adrenaline is so high right now, right? And get it. It's pumping. I got that part. But someone's got to take control and command of having less lethal. If you're going to ask an officer to go to his front to see if he has a weapon, you know what's in his hand. You got to be careful with crossfire. That's definitely definitely an issue right now. How are you going to approach? Right. You got to have an arrest team. Again, have less lethal. Someone's got to take a pretty much command and control and kind of coordinate these efforts as to how we're going to approach and apprehend the suspect. >> ON YOUR FACE. WHERE'S THE GUN AT? >> WHERE'S THE GUN? >> WHERE'S the gun? >> Turn the around. GET DOWN. >> HE'S RUNNING. He been shot. Okay. He's been shot. He shot the guy. He shot him. He has been shot. We've got him. They tell he has been shot. Get in. >> County. All troopers are okay and all deputies are okay. Just all units are 1065. Roll him over. We got to get this other hand. >> Give me the other hand, Chris. Damn, man. I'M I'M SHOT DOWN. [screaming] GIVE ME YOUR HAND. I'M GOING TO GIVE ME your other hand. >> This is dick. This is dick. I think >> this is dick. I think you shot. THIS IS [screaming] >> HERE. I've got this other hand. Give me your other hand. [screaming] >> There you go. There you go. There you go. >> Where's the gun? >> Hey, up there. >> We got him in custody. >> What do you need? >> Uh, let's back here. back here. >> Is an exit wound right here. >> I got to make it. I got >> We're beside me. Thank you. >> Let me get the back one. >> Just like three, man. I got hit three times. >> No exit wound here. >> Hang in there, Chris. >> They're clear to approach. >> How many rounds you fired? Do you know? >> I don't know. I don't got a clue. >> Okay. >> All right. Let's uh roll him toward you, John. >> One, two, three. Hey, stay stay awake. Stay awake. Stay awake for me. Okay. >> I'm about toing do some gangster. >> Hey, we want to make sure you're okay, buddy. Okay. >> We were running this way and heard the shots over here. >> Taser. >> Yeah, he tried to I know. I saw him with a taser out. I think he was around here when he shot cuz we didn't have sight of him. >> Hey, what's your name, man? >> Hey, talk to me right now. >> Hey, don't talk to us. Talk to him, man. >> Don't fall asleep on me. Wake up. Stay awake. Stay awake, buddy. >> Hey, wave EMS in here. >> I need EMS IN HERE RIGHT NOW. CAN Y'ALL MAKE SURE THEY KNOW WHERE WE GO? >> STAY awake for me. >> Chris. >> Chris, talk to Chris, bud. >> Hey, Chris. Stay up. >> Hey, talk to me. >> Don't go to sleep. >> Let's try to find this gun. You start up there. I want you to walk this. Okay. From fence to fence. Okay. And I'm going to start down here. >> Did you see a gun? >> I did not. I showed up after the I was I was I was catching up. They said shots fired. Then I got out. I saw him laying in the yard here. He hopped the fence and that's whenever I uh caught him over here. >> Do you Okay, I'm going to stop here. Also, just to kind of let you know a couple of things. Uh, first of all, this is going to be your classic. I shouldn't say classic. It It's definitely going to be a flee and felon type of OAS with hits. Okay, for sure. Now, as you can see, he's talking to the sheriff. The sheriff is going to be one of the adjudicators, essentially the ultimate decision maker as to whether this shooting is going to be in policy or out of policy. Now, you the way you actually manage this uh scene of an OIS, he doesn't get to walk through it. uh the sheriff or any adjudicator doesn't get to talk to the shooting officers or any recipient witnesses officer that were substantially involved. You don't get to talk to them. They have to be separated and monitored and wait uh for two things. One, uh whether we're going to file criminal charges, if they're clear from criminal charges, then comes the administrative procedure. You can't talk to them. So, it's just best if the sheriff just kind of backs off and, you know, gets uh uh the uh responding units any guidance. uh any resources that the officers need or the investigators need to start uh gathering all the information from the scene of this uh OAS >> physically got got a hold of him. Yes. >> You didn't know he was shot at that point? >> I heard shots fire is all I heard. I didn't know if he was shot or not. >> Nobody. You didn't see a gun and you didn't see a gun? >> I did not. No. >> Yeah. Okay. >> I don't know where you are. I threw it out. I'm just going to go ahead and have you turn your incar camera off and your car camera off. uh gonna cease recording and save as a case. Okay. So, when we wrap up this case, we got to ask ourselves what is the flee and felon rule, right? What are the elements? Okay. Keep that in mind. We'll see uh Christopher's charges in just a minute and take a look at the civil lawsuit filed against Trooper Robertson as a result. But first, Seami Valley officers hunt a domestic suspect who said he shooted out if the police got involved. Take a look. >> 2.12 units on the call. DP said he wants to shoot out vehic. He lost all of our money. He's on something. saying that he wants to kill himself. So he said that if he were to go on a a rampage, he can have a shootout with you guys and then if you were to shoot him, he won't go to >> Okay, while we're waiting for the audio, I'm just want to mention that as you can see the mindset of the suspect, right? He wants to have a shootout with the cops. That's basically it. It's almost as if again he's yearning for this, right? He's fixated with the fact that I want to get into a shootout. Almost like this theory of death by cop, right? where there's a certain criteria, which by the way, there's nothing really concrete besides we're trying to get more cases be known to the courts that hey, when you call 911 and you have these circumstances, this is what the suspect wanted to do is to get into a shootout with cops. So, just keep that in mind because the officer's mindset should be the same is you know what, I'm we're going to stop the threat. We're going to stop the threat. >> Hey Nick, how you doing? Senior officer Min Valley PD. Hey man, I I just need to talk to you real quick. You got a minute? So, just give you a heads up. He's We have camera systems like I was telling you all over throughout all throughout California, right? There's no way to >> I was just going to ask. >> So, we entered that that license plate into our system or whatever. >> So, we know where it's at at like 7 minutes ago. It was down in LA off of Victory Boulevard. >> Good boy. Got eyes. He's first in the freeway. He's on no first. >> Popped on first at the freeway. >> Now westbound 18. southbound on Crosby. Heb. Make sure to lock yourself inside inside the bathroom. Go to the bathroom and lock the door. >> There they are. Okay, I'm going to stop right there because it looks like there is pursuit going on in the residential area in Seam Valley, which by the way, that's that's my backyard. This is California. I don't live too far from Semi Valley. I have some colleagues and some buddies and partners from Semi Valley PD. So, this one uh hits close to home, man. Now, you got this pursuit going on. So, keep that in mind as we proceed watching uh this incident. Offer one set up. >> [screaming] [screaming] >> Westbound Fitzgerald. Westbound Gerald. >> Continuing westbound. >> Go inside please. >> Crosby. >> Hi puppy. >> You found Den. Shots fired. Shots fired. >> Shots fired. Shots fired. Officer needs help. Officer needs help. I just shot at the moving vehicle. But definitely shots fired. Officer needs help. Officer needs help. Let's talk about shooting at a moving vehicle. We'll cover that later on, but just know that, you know, he was taking pretty much uh standing by the uh I suppose the suspect's house, right? Because there's a lot of victims there. Uh it's a good tactic because there was probably information that he was coming back to the house. So, Oh [ __ ] >> TC, >> do you hear the call? >> We need all units in amar. >> You need to listen to us. If you want first aid, put your hands up in the air. If you don't listen to our commands, we can't come help you. He's slunged over to his right. I can't see any hands. He's moving. I see you moving. I see you moving. If you reach with anything in your hands, you're going to get shot. >> Okay, we want to help you. Let us help you. >> Okay, from the looks of it, it looks like there was a SWAT call out uh to go and, you know, apprehend the suspect, of course, and I've said this in the past, preservation of life is key. It's number one. We got to get to the suspect uh so we can render aid, right? I know uh a lot of agencies call it EMS, we call it MT medical treatment, but yes, that's that's number one, okay? And we'll cover that in our wrap-up. But first, Hernando County Sheriff's Office have a warrant on a narcotics case, and things are about to turn extreme. Take a look. This is the county sheriff's office of 8374. Anthony Kati, please exit the front door with your hands up. This is the Hernando County Sheriff's Office. Hurry County Sheriff's Office. Please exit the front door with your hands up. This is the Hernando County Sheriff's Office. residents 8374 coral Anthony and all of the residents, please exit the residents with your hands up through the front door. >> I'm going to stop it right here because I got to let you know that by no means am I some SWAT expert whatsoever. Okay, just want to make that disclaimer right off the bat that these are tactics of SWAT element members practice and train practically every single day. Okay, they're very very good at what they do. Okay, just keep that in mind. Sacramento County Sheriff's Office, resident of 8374 Coral. Please exit the residence through the front door. Anthony Cassad, please exit the residence through the front door. This is the Hernando County Sheriff's Office. >> This is the Hern County Sheriff's Office. >> Watch out. Please with your hands up. >> Pick up. >> Hey, break it. Unlock it. Break. >> Is that guns? Hit. I'm hit. I'm hit. I'm hit. I'm hit. Hey, I'm hit. Hit. I'm hit. I'm hit. I'm hit. >> I'm hit. >> Hey, I'm hit. I'm hit. >> On my arm. Arm. Arm. Arm. Arm. Arm. Arm. Arm. >> Arm. >> Get that on tight, bro. >> Watch right here. We had lights in the garage. >> I don't know if I'm hit anywhere else. >> Now, as you can see, that's priority number one. taking care of your partner. He's been hit. He's wounded. But at the same time, you also have the suspect. Now he's a criminal barricaded suspect. And now you got to start formulating a plan as to how you're going to approach or even approach. Uh is time of the essence. Is it exigent, right? Do we got to get in there, you know, effective arrest? A lot of things going on. So keep all those things in mind. >> Hey, that turkey is not on tight. Get that on. Cinch it down. Cinch that down ASAP, bro. Crank that. >> Crank that. >> I got you. [screaming] >> I got you. I got you. I got you. I got you. All right. >> I'm I'm moving. I'm moving. I'm moving. I'm moving. I'm moving. Let's go. Let's go. Let's go. >> Come on. >> Your arm. >> You got it. >> Yeah. Left arm. Left arm. >> Okay. So, when we wrap up this case, got to ask ourselves, you know, when you serve a search warrant, can SWAT element members use other methods of entry? Right. Are there other options? Okay. Now, we'll get back to that man's charges in just a moment, but first, a woman walks into a police lobby with a handgun and fires toward staff. Take a look. >> What? I'm going to stop right here to say that you have to be out of your damn mind to walk into a police lobby with a gun and then fire off some rounds, right? Is everybody okay? Is everybody okay? Everybody put that down. Bring it down now. Put the glove down. >> I can't hear. >> Put the glove down. out. >> Drop it. >> Drop the gun. >> Drop it. >> Drop it. >> I'm going to SHOOT YOU. DROP THE GUN. >> DROP THE GUN. >> Put your hands out. Stay away from the gun. Let's do an approach. Wait, >> we need code three. We need medical code three. Let's start doing an approach. >> Holster up. Holster up. Okay, that's God, that was so hard to watch uh for several reasons. One, that seems to me, and maybe you can help me out, that that's the outcome that she wanted, right? Uh there is this theory, and I've been talking about this with other videos. When we started this channel, I knew that we were going to get to cases about uh the influence that suspects want to use for cops to to finish them, right? To get involved in an OIS and hope that they die. It's um there's a certain criteria. What we don't do and just want to explain real real quick is that we got to look at the history. We got to paint the picture to the courts about you know in this case Linda what what's the criteria what is Linda all about? You know why did she decide and this is the question right? Why did she decide to come into the police station in the lobby with a gun? You know she wanted a certain result and she got that right and that's just very very unfortunate. Just know that the more of these scenarios, more of these cases are happening, the more that we can present evidence, right, a history, if you will, to the court saying, "Look, I I understand the officer, for all we know, justifications about the only thing for this homicide. But at the same time, we got to look at the behavior, the the criteria, meaning behavior, past history, uh mental illness, been hospitalized, taking drugs, just a host of stuff. to paint the picture to say that that's what the suspect wanted. Okay. Okay. Now, let's go back to the first case that we saw, right? The first video, the first incident. And we asked ourselves a question. What is the flee and felon rule? Well, I can tell you what it is in the state of California. Okay? And you also definitely want to look up the landmark case, Supreme Court case of Tennessee v. Garner that talks about the flee and felon rule as well, but that happened like decades ago. Now, what are the elements? Here they are. A felony has to occur, right? threaten or result in death or SBI, serious bodily injury. The suspect has to be fleeing. That's exactly what happened here, right? Three, officer reasonably believes the person, the suspect will cause death or SBI to another unless immediately apprehended. And last but not least, when feasible or where feasible, the officer shall, prior to using force, make reasonable efforts to ID themselves. Hey, we're the police. We're the police. Stop. Stop. Stop. we're going to shoot, right, as a peace officer, as a cop, and warned that deadly force may be used unless an officer has objectably reasonable grounds to believe the person is aware of those facts. Okay, that's very, very important. Now, this uh warrant was for a theft or something along those lines. You got to take that in consideration, too. Look, if the warrant was, you know, he was wanted for murder or attempt murder or a assault or something of those sort and they had prior knowledge that he was armed, that's a different story. So, and again, I'm not here and this channel is not designed or its purpose is not to tell you whether it's a good shoot or a bad shoot, okay? Giving you some information and some education about the analysis in the examination. Okay? Now, let's go to case two. you know, the second incident that we saw, the second video that we saw, and we ask ourselves, you know, can the officer shoot at moving vehicles and can the officers shoot at an unarmed suspect? He was in the truck. Okay? Look, that truck and the suspect was driving at a high velocity in residential area. You got to take that in consideration. He wanted to get into a shootout with the police. Okay? and shooting at moving vehicles is generally prohibited unless you can articulate and you can justify why you deviated from department policy and procedure. Okay? And I'll leave it at that. As you can tell, that truck was coming right at that motorcycle. And for all we know, he could have definitely done much more harm. Okay. Now, let's go ahead and go to uh case number three, the third video that we saw, the third incident. Uh, when serving a search warrant, can SWAT element members use other methods of entry? Look, I already gave you my disclaimer. I am no SWAT member. I've never worked SWAT. I'm not here to justify or to scrutinize or pass judgment as to the tactics that they deploy. You definitely had the Bearcat. You definitely had a a surrounding announcements, right? They're announcing, they're announcing, they're announcing. Okay. the decision for them to breach uh could be right because uh the suspect was wanted for narcotics. So narcotics warrant, think about it. They're in there and they can destroy that evidence that quick that possible. Okay? So there's other options and I'm here to tell you that the uh SWAT element member, that officer that got shot, definitely they all debriefed the day after. Debriefing and specialized units, it's very, very important. Why? Because we can all learn and get better at it. Okay. Now, before I wrap it all up and say goodbye, definitely got to give a big shout out to Kentucky State Troopers, uh, Semi Valley PD, Henderson County Sheriff's Office, and Port Orange, uh, Police Department for doing an outstanding job in all these incidents, okay? Please, please be safe out there. Christopher pleaded guilty to wanton endangerment of an officer, fleeing, and evading, trafficking, and resisting, and took a 10-year prison sentence. He also filed a civil lawsuit against trooper Grant Robertson for excessive force and that federal case is still moving and ongoing. Nicholas died at scene after crashing into a police motorcycle and the officer involved shooting that followed. California Department of Justice DOJ is investigating and the police later said he was not armed when he was shot. Now that case is still ongoing. Anthony was arrested on 12 counts of attempted murder of a law enforcement officer, plus aggravated battery on a law enforcement officer and firearms by felon counts. Okay. Both deputies that were wounded and shot were released from the hospital. Linda died at the hospital after officers shot her outside the police station. She had already fired inside the lobby towards the staff, then advanced on officers in the parking lot with a gun. Now, the federal department law enforcement is investigating this officer involved shooting and we don't have any public information regarding the outcome of this OIS. Okay, so let's go ahead and click that like button and that notification bell. Don't forget to subscribe. Please comment below because we want to hear from you.
