I just I just hit him. >> An airline refuses to board a passenger it says is too drunk to fly. Officers walk her out and then wish her a good night. 30 seconds later, she is face down in handcuffs. It's >> too easy. >> I can smell it from here and they don't want you on the plane with it. So that's >> The officer has just said twice that the smell of alcohol carries from where he stands. Under title 14 of the code of federal regulations, section 121575, an airline may not let an apparently intoxicated person board. The refusal is a federal duty on the carrier, not a discretionary insult from the gate staff. Whether that duty can also justify what police do next is a separate question. >> 173. >> Okay. Well, we're going to go back down this way. >> These [ __ ] just should haveing let me sleep on the plane. >> It don't work that way. >> It works. It works that way. It works that way. Oh, she's in the cabin. >> Oh, okay. >> She's in the cabin. >> I would use another hazard pay. >> You do need hazard pay. At least in the medical field, we have perfect. >> Yeah. So get >> I didn't do anything to go wrong >> this way. >> You're going to go to jail. >> Why? >> For disorderly conduct. Let's go. >> What? >> What? >> An officer has just named the reason for jail. And the words used are disorderly conduct. Florida statute section 87703 reaches conduct that corrupts public morals or breaks the peace of people who witness it. Florida courts limit it to fighting words or real disorder. So profanity alone cannot carry the charge. What happens next will decide whether that charge was ever the real one. >> Let's go. >> I didn't do anything wrong. >> Keep moving. >> So I'm going to jail first. So, I'm going to jail for this order, right? You know what? >> Let's go, man. >> I didn't do anything wrong. >> Can you hear me traffic? >> Well, here's the deal. We got We got the >> airport. Listen to me, man. We got the airport >> operations coming out >> and they're going to ask you to leave. All right. If you fail to leave, >> but I'm not going to jail. >> All right. I don't want to take you to jail. So, >> I'm not going to jail. >> All right, let's go. >> I didn'ting do anything wrong, >> man. You can't go that way. >> It says do not enter, ma'am. If you >> 289, >> we're done. You have a good night. All right, ma'am. >> 239. >> You're almost there. Keep moving. >> Don't even shut up. Get on the escalator. Let's go. I have to see where my left is. >> Get up on the escalator. >> I have to see where my left is. >> Up into the right. >> How about you? Shut the up, you stupid ass. >> Let's go. You're almost there. Stop. >> I didn't do anything. >> Officer, where'd you go? Go to jail. >> Stop. >> I got the legs. >> Are you really Can I get my glasses? I can't see anything. >> You don't hit an officer. >> The officer has just said one short sentence twice, and it is about hitting an officer. Florida statute section 78407 turns a simple battery into a thirdderee felony when the victim is a working officer. An intentional touch is enough. So a shove or a slap can reach 5 years in prison. What exactly her hand did at the escalator is the fact everything now rests on. >> I got my glasses. >> I can't see and Oh, you really? >> Really? Really, guys? >> Yeah. Really? >> Can I Can I get my glasses? >> I'll get your glasses. >> You're really going to You're going to >> Oh, yeah. Stop. >> Can you not do that? >> Roll to your side. >> Can you not do that? >> That was not >> Roll to your right side. >> You hit me. >> You hit me. >> Bring your knees up. >> You come on. Bring your knees up. >> There we go. >> You got up. You hit first. >> You have the cam on, right? >> Get your shoe. >> You have the cam on there. >> One more. Get the shoe. Put your foot in. >> Can you Can you pay somebody? >> At least it's not Poke County. You got kids here? >> Yeah, I do. >> There's so many elevator. There's so many criminals here. >> I know. I know, right? >> You're doing good. Keep going. >> Come on. >> How are youing off? >> Keep going. >> I didn't do anything to you. >> You did. >> You hit me first. >> No, ma'am. You did. >> You got level, too. >> I changed my hand. An officer has just answered the accusation by naming a force level and an open hand. Florida statute section 77605 lets an officer use the force reasonably necessary to make a lawful arrest without retreating. Resistance does not require an officer to back off and the amount allowed rises with the resistance. Her own account of the same seconds will arrive later and it does not match. >> It's okay. You wanted to arrest me. It was fine. >> You had every opportunity. >> It's fine. It's fine. >> I just did this to you. >> Stop. >> Here we go. >> Well, this one I know everybody. You're a resident. >> Not a person. >> Why are you Why you >> face the wall? >> Thank you. >> Yeah. Uh yeah, cuz uh Sam's probably one here. We're going to level two and escort her out. We're coming down the elevator right now. [sighs] >> It hurts. It hurts. >> Yeah. Stop moving. Stop moving. Quit trying to stop moving. Stop moving. >> Why you Why are you bending my hands? I just want to put my hands down. >> Keep walking. You're going to change it in just a minute. Walking. >> What the is wrong with you? Why are you bending my arm? Let me put it down. >> I'm holding your wrist. >> I hear you're bending it. >> Nope. Come on. >> Keep going. >> What the is wrong with you? >> What the is wrong with you? The white assumption. Let me put my hands down. >> Keep moving. >> What is wrong with you? I didn't do anything wrong to you. I want you to bend my hand. Go ahead. Bend it. Break it. Go ahead. Break it. Stupid ass [ __ ] Break it. Break it so I can sue you because I didn't do anything wrong. >> I will sue you. I'm going to sue you. I have money and I'm su you. You don't even know who you're talking about. Right. Right. You know how much money I have? >> Yeah. Go ahead. >> What's your name? Doing a report. >> What's your name? >> Keep moving. We're almost there. I'll get it on the police report. I'm going to leave. I'm going to sue the [ __ ] out of you. >> I didn't do anything. I didn't do anything wrong. >> Okay, >> dude. You're right here. >> Right here. Yeah, we got it. >> Right up against the car. Wait. Right here. >> I never fought. >> Okay. >> I never fought. Just stay right here. >> This white m I never fought. Do you want to talk to my husband? You're not charging nothing. I didn't do anything to you. Heat. Heat. You know what? I think you hurt my neck. >> She is already handcuffed and in custody and she has just reported pain in her neck. Under city of River versus Massachusetts General Hospital. Government owes medical care to a person injured during an arrest. The duty is satisfied by summoning help promptly and it does not depend on whether the complaint is genuine. What the officers do with that complaint in the next few minutes answers that. >> I think you hurt my spine a little bit. I think I need to go to hospital. I need an MRI. I need to go to the hospital right now. I need to go to the hospital. You hurt my You hurt my neck. >> Okay. My leg hurts. >> Check your camera. >> It hurts really bad. >> Really, really bad. >> I didn't do anything wrong. There you know out there. I could give you one. You want me to give you one? All we had is >> the cops are staying on. >> We had the escalator. >> I'm going to get your vital blood pressure. >> We were walking. She stopped turn. >> Do you know who John? Do you know who Uno is? >> See you there. >> So pretty for that bug shot. >> Keep moving. Don't do that to me. That's not nice. >> Keep walking. >> You know what? Break my wrist. >> Keep break it. We go back in the hospital. Be nice. >> Just keep walking. >> Wow. What the are you doing? >> I'm right here. >> Ow. >> Keep moving. [ __ ] >> You're hurting me. >> You're hurting me. You're hurting me. Oh. Oh. >> All right. Watch your step. Step down. >> Don't touch me. I can sit by myself. >> Yep, you can. >> I can. >> Okay. as far as like helping you out in jail, the safe the safe book, they'll have all that. You stay on for the transport. >> The charges filed afterward named two offenses and only one of them was mentioned inside the terminal. A gate agent who decides a passenger is intoxicated is not making a customer service judgment that can be appealed on the spot. Airline staff are barred from boarding a passenger who appears intoxicated. So, the gate has no discretion left to argue with. The only thing still available at that counter is a seat on the next day's flight, which this passenger already had. Much of the first three minutes went to a document that said not valid for travel in plain print. A reservation becomes a boarding pass only at a ticket counter on the day of travel. And an agent said exactly that. Asking a second time for the same piece of paper only burned the minutes that could have ended the night quietly. The officers ended the escort out loud, told her the walk was finished, and wished her a good night. Less than a minute later, a hand landed on an officer at the escalator, and the night restarted as a felony. Nothing that happened before that moment would have produced a felony charge, and the record is clear about the order. Three times at the patrol car, she insisted there had been no fight, then added that she had hit him. A denial and a confession in the same breath is still a confession, and the camera keeps both halves. Everything said while handcuffed was recorded, and the loudest denials sat beside the clearest admission. After the handcuffs went on, she reported a sore neck, a sore spine, dizziness, and a lump on her head. The transport pulled off the highway so medics could take vital signs at the roadside before the jail. Every one of those complaints is now documented on camera, which helps whichever side the medical records favor. The record runs about 21 minutes, and for nine of them, nobody was going to jail. Two charges followed, one with a $500 bond, and one with no bond at all. The second one was added in the last 30 seconds of a walk that was already
