Danger doesn't always come from a stranger. Sometimes it comes from someone you know. >> SHERIFF'S OFFICER KA, COME OUT. YOU'RE GOING TO BE BIT. He said, "You're going to shoot your daddy. Going to shoot your daddy." >> He's He's a good man. >> Okay. >> It's not his fault. >> We have a man who barricades himself inside his home after attacking his own family and tries to summon Satan. >> Say Jesus. >> Take a picture of it, son. >> About say Satan. Say it two or three times. And we have a man who shoots his neighbor multiple times over a dispute about a fallen tree. >> Crazy. >> And I'm like, you don't even know your neighbor's name. And he killed your husband for cutting down a dead tree. >> Very odd. >> But first, cops respond after a son shoots his own father during a violent family altercation. Take a look. >> Stay back. Sheriff's over. >> Sheriff's one. >> Stay back. Sheriff's office. >> Sheriff's office. >> Hold on. Has he got any weapons or anything? >> Yeah. >> What's he got? Seats. Seats. Sits. Somebody come up here with me. STAY BEHIND ME. SHERIFF'S OFFICER, COME [screaming] OUT. YOU'RE GOING TO BE BIT. SHERIFF'S OFFICE. COME ON. YOU'RE GOING TO BE BIT. SHERIFF'S HOUSE WITH KA. COME OUT. YOU'RE GOING TO BE BIT. Find a man. Cool. Go find a man. Go find a man. Stay back in case she comes back out here. Dream. >> Na, find a man. >> He's He's got a door shut. Da fa f come here. Da. Na, COME HERE. DA, COME HERE. FOOSE. FOOSE. She go outside. Check around back. Here, here. Plats. Come here. Plus ain't run out back, has it? Somebody needs to watch the back. SHOW ME YOUR HEAD. SHOW ME YOUR HANDS. SHOW ME YOUR HANDS. >> OKAY. SO, a couple of things that we want to lay a foundation about is we are both going to go through this together. Meaning, we're going to put our investigative hats on and we're also going to put on some tactical hats, meaning that, you know, maybe there's other options that could be available as this situation unfolds. Now, you have a homicide right away and you know that you have an armed suspect, if you will, or maybe an armed victim. Either or, right? We don't we haven't determined that yet. With that being said, yes, it's okay to deploy the K9, but at the same time, he is armed. And so, we want to be very, very careful. And again, these are calculated risk and decisions that you have to make when you decide to go and try to apprehend uh the suspect. So, as this unfolds, let's just kind of think about other things that we could have done. >> MOVE BACK, JERRY. JERRY, MOVE BACK. >> JERRY, MOVE. >> OH NO. OUT NOW. >> JERRY, MOVE. >> COME OUT NOW. >> COME OUT NOW. >> COME OUT OR YOU GOING TO GET DOG BIT. >> COME OUT NOW. YOU'RE GOING TO BE BIT. GET IN. >> GET ON THE [ __ ] GROUND. >> ON THE GROUND. YOU'RE ON THE GROUND. >> LOOK AT HERE. LOOK AT IT. HEY, YOU OFFICER. LOOK AT IT. Look at it. Get him. DON'T YOU LOOK AT IT. >> TURN THAT TASER OFF. TURN IT OFF. Look at it. GET IT. GET OFF THE DOG. GET A [ __ ] DOG. GET OFF MY [ __ ] DOG. GET OFF MY DOG. >> NO. GET BACK NOW. [screaming] GET IN THE HOUSE. GET IN THE HOUSE NOW. >> STAY BACK. GET OFF MY [ __ ] DOG. PUT YOUR HAND BEHIND YOUR BACK. MAKE YOURSELF BEHIND YOUR BACK. PUT YOUR HANDS BEHIND YOUR BACK. PUT YOUR HANDS BEHIND YOUR BACK. GET YOUR OTHER HAND BEHIND YOUR BACK. >> Let me get her out. Okay, so we got a code for suspect in custody with incident. You know, one of the things that stands out the most is what we call tactical planning and communication. And so what you definitely want to have at scene is one person being the IC, the incident commander. And that particular deputy officer, whoever is senior in rank or senior in service, whoever has that command and control is the one that should be giving all the orders, formulating plans and coordinating efforts as to how it is that we're going to apprehend the suspect, arrest team, create that perimeter. All these tactical deployment decisions, look, they're very difficult to make. However, you did hear, you know, non-lethal, right? You got the taser and then all of a sudden you have the K9 being deployed at the same time. So again, these are just u issues by which adjudicators, right, the bosses to be are going to be doing a full analysis and review on this entire incident. >> No, Daniel. NICE. Come on. Get in the car. Good girl. Good girl. Can we not bring him outside? We have any idea who he is? >> I have no clue. >> Where's he shot at? >> The only blood I see that's dried is on his leg. There's a spot back here. >> What about his butt, baby? Can you all get his shoulders and stuff? Three, one, got two, three. >> Where we going with him? >> It's right here. Sh to the butt. What did he shoot him with? >> I don't know. I've not even talked. >> Is it him? The one that done the shooting? >> I don't know. >> Well, this young boy or this boy kept coming out. Coming up there hollering. That's my dad. That's my dad. >> Sheriff's office, I need you to talk to me. We got EMS coming. >> Tell me a dead. >> No. Do you know uh who shot him? >> I did. You did. What'd you shoot him with? >> What kind of gun is it? A 22. You shoot him in the butttocks around in that area. >> Hey, what's his name? >> Josh. This is the gun that Jacob used to shoot that one. And I shot this one up in the air on my back porch just trying to get him off of Jacob. >> Please let me speak to my dad. >> Just hang tight, man. He's What's he on? >> He's not He's not on. >> No, he's he he's he's taking something right now. >> Suboxin. He goes to the suboxin clinic. Well, he may be on something else because >> look, he's he's got into this Bible that he's been reading and I've been reading it with him. He's a good person. This Bible, >> it's like he's like trying to OD on us right now or something. >> Hey, come on. Talk to me. >> Hey, Josh. You having some kind of mental thing or you seeing people? Tell me what's going on. >> Josh, >> still got a strong heartbeat. >> He's high as >> Josh. >> Like the only thing that's happened to him is he where you shot him in the butt or whatever and uh he he got dog bit in the leg. So, that's nothing to make him be acting the way that he is right now. And the reason why he got dog bit is because it's better than the alternative measure of shooting him. >> Hey Josh. >> Hey Josh. >> What's going on with you? >> When EMS gets here and we get him situated out. All right. Well, >> he's he's a good man. >> Okay. >> It's not his fault. >> Is he prescribed like any kind of like medication for like >> Okay, let's stop right here and just look at the u what the video depicts is that you got four witnesses with a possibility of one. I believe the son is a suspect. Now, what you definitely want to do is separate all parties and get independent witness statements, right? Especially the son. He is a suspect. This is an attempted murder scene. It's a critical incident, if you will. So, again, you got to start taping off the area, create an outer perimeter and an inner perimeter. Get a police officer, a deputy to start a crime scene log because you don't want to contaminate, right? And you want to keep this scene very pristine, if you will. >> Here, let me speak to my dad, please. Okay. If if he's able to talk. I mean, he's so out of right now. He ain't even talking. >> I want to see him anyway. >> Okay. Give us just a few minutes, man. >> Josh. Hey, where you hurting at? >> Hey, get ETA on EMS. ETA EMS. >> Here's a gun. It's 22. What's going on with you, brother? >> This is my house and my son broke in. >> Your son broke in? >> Yes. >> Okay. Have you taken anything today, brother? >> No. >> No. What's going on with you? >> I'm trying to get one for you. Are are you prescribed any medication or anything? Have you took too much suboxin today? Do you take suboxin? No. You gain guns in there in the house, brother? >> Okay. >> 322s. My wife Karen Jake lottery. >> Okay. >> Hey, take a picture of my please raise my balls up. >> Why? >> Please. >> What for? >> Y'all got to see it. >> What's wrong with it? >> Just look at it. You all got Don't be afraid. Look at what you all are gifted. Man's got a struggle. Bust wood for his family. >> You [snorts] don't trade nothing for your family. >> We're going to get you some help. Okay, man. >> Am I a threat? Am I a threat? >> Quit moving. Hey, >> moving. >> Quit. >> Quit moving. >> Stop. his condition and stuff, but he's got a gunshot wound back through here. >> Where's our gunshot wound >> on his ass? >> Which side? Left or right? >> I believe it's this cheek right here. >> We have an exit. >> I didn't see one. >> You roll him on the side. >> No, it's this cheek right here. Right there. >> Right cheek. Do we know what he was hit with? >> 22. >> Put him on the back board and uh take him on up there. >> You want him handcuffed in the front or you going to leave him like that? >> He just tried to pull his off. So, it's up to you. >> Let's keep in the back then. >> Okay. with as [snorts] much bleeding as he got, I would recommend against him. >> Does anybody know in here? >> As a son. >> Has a son. Were you with them before all this happened? >> Yes, sir. >> Has he take anything? >> No, sir. >> There's two. >> Yeah. Here's the gun. It's a good thing we didn't come in here, James. Look right there. >> Look what he had waiting. Talking to the Lord while he did it. He's busted every glass in here. >> It's going to sound so stupid, but he's got all of this Bible. >> Yep. >> I'm sorry, buddy. Right now, protocol is we can't have any riders. Broadway saying Jesus look at my take a picture of this. >> You know what? Just something to think about because again what we have right now as the way I see it and maybe you can help me out with this is that he happens to be the victim. Yeah, I kind of get that he's a suspect. Let's go ahead and handcuff him, detain him legally that is. But I don't know. My thinking is is that he is victim to the gunshot the gunshot wound right to the butt. That could be it. So now we got to find the suspect. So essentially what you have is you're going to have a couple of victims and at the same time those victims can also end up being suspects. So these are the kind of issues and these are the kind of thoughts right as you get at scene it's all chaotic uh situations very stressful you know highrung you know and you're trying to deescalate situations where you're trying to figure out what we have here and what the role is of each one of these individuals witnesses statements suspect statements and victim statements. >> Did he actually make it into your trailer? No, he was baking on the door. I thought he was going to break the door down. >> Where did he get shot at? Like where was he at? >> I walked over here. >> Okay. There was a a rifle and a pistol laying in the tub in there where he was at. >> Yeah. >> Yeah. >> It's probably a good thing we didn't go in there. >> Jacob. Jacob had shot in the air first beside his trailer because he had Karen locked in the bathroom. >> Who do he have locked in the bathroom? >> His wife. Karen >> wouldn't let her leave. >> No. We could hear through the wall. Uh he was going to kill her in there. But uh >> and that's his wife. >> His wife. Yeah. >> Okay. >> Okay. So again, there you have it. He is definitely a suspect, but at the same time, he has been victimized of an attempt murder. >> What's it? Oh, >> then he turned on me. >> So he turned on you here? >> Yeah. >> Okay. So he's he's got you at gunpoint in the bathroom. Then Jacob comes in and sees that. >> He put the gun on me a few times. >> So a couple times he pointed the gun at you. Okay. Was it loaded? >> I guess. >> Okay. Jacob knew that he had me in there. And >> I tell you what, let's go in here and talk and I'll get your statement because I don't want him to conflict at all. >> And then he come out running trying to take the gun away from Jacob beating the out Jacob. He said, "You going to shoot your daddy or you going to shoot your daddy?" Jacob had done shot him once. But that's all he shot him was one time. But he was back here on top of Jacob. And that's when I shot in the iron told him, "Josh, don't do this." And he said, "You're going to shoot me." I said, "Josh, I don't want to shoot you. I love you. Yeah, there's blood here. >> Up here on the porch right here. >> Right here. Yeah, this is where he's come on the porch after he's been shot. Right over here is where he was on the ground thinking the crap out of Jacob trying to take the >> take the gun away from him. >> Away from Jacob and that's when I shot in the air on the porch there. He's lost some dollars here it looks like. >> Okay. So, he puts the gun on you a couple times. Was it the pistol or the rifle? >> The pistol. >> Okay. So, he points the pistol at you a couple times. Then what happens? >> Trying to get me to talk about say Satan. say it two or three times, you know. >> So, he wanted like that. >> Was he trying to like trying to get you to summon the devil or something? >> Or he wanted you to play the devil? >> Why? Uh he just wanted to know if I had done any wrong. Jacob come in and they took this outside. >> So, I'm I'm going to stop you right there. Did Jacob see him pointing the gun at you? >> No. >> Did Jacob know that he had pointed a gun at you, though? >> He knew that a gun was probably in there. >> Okay. So, continue. I'm sorry. I stopped. Wait. So, Jacob come and they took this out outside. >> How? How? So, what what was said? >> Well, he said to come on outside. You know, Jacob tried to get him outside. Okay. >> But anyways, they did go outside. You know, Josh was naked and he went they went over there and he had Jacob down. >> So, where did Jacob shoot him at? Where was he at? >> Jacob had shot him somewhere over here close to the trailer cuz they both come running around the side of the trailer here. Josh was trying to take >> Okay. So, even though Jacob is considered to be a suspect, right? At the same time, we are talking about getting statements due to the fact that it might be self-defense. Okay? And you lawyers help me out here where yeah, there's justifications as to why you decided to engage in deadly force. I get all that, but more important than anything is let's definitely lock down this entire corridor around both houses, right? Because you got to keep the scene, not only preserve it, but again, like I mentioned, it's got to be pristine. We don't want to contaminate anything. And let's get those homicide detectives rolling because those are the ones that have the experience to start asking all these questions. It's very detailed questions to get the real story from each individual witness and from each individual statement from the victims andor the suspects. >> Away from Jack on his head at the same time. >> Yeah. Right here's Rick's beating the door. >> That's when I was panicking calling 911 after Murray had already called T. Where's the chaser? The one that you shot him with. Do you know where it went? >> I was running. >> Jacob, what's your last name? >> I was running. I don't know. >> What's your date of birth, brother? >> Do you have a phone where I can get in contact with you if I need to talk to you? >> My name is >> And that's your mom in here. >> But anyways, they did go outside and he had Jacob Bam. >> Did he have a gun on him at this time? >> I don't know if he did or not. You have to ask Jacob. Belinda was out there saying, "Josh, please get off of him." And I had went on to the front door. Belinda come in shortly, seen that she could not do nothing. By the time she got Jacob in, and we locked the doors and called you. >> What was he trying to do after that? What was Josh trying to do after that? >> He was beating on stuff. We could hear that >> in here. >> Mhm. You can see. >> Okay. And when did he come back over there? >> Josh, he didn't. >> Cuz the call we got is he was trying to kick the door in. >> Oh, well, I guess he was. >> So, did you not see him trying to kick the door in or what happened? I was in the house at Mary's. But yeah, he was beaten. >> Beating on the door. >> Mhm. >> Over there. So when did Take me through that. Take me through what all happened with that. >> Well, we had the doors locked and we were waiting on you. >> Okay. When when was the shot fired? >> The one that Jacob did. It was a few [clears throat] minutes before we called you because we knew we could do no more. We had to call you. >> Right. Has he had like some kind of a mental break in the last couple days, weeks or so? >> Yes. That's what I'm trying to say. So, >> the last couple days he's been acting odd, but he's been real clingy to me, you know, and telling me that he loves me, saying a few things that might be off the wall, >> like what? >> Well, he burned a bunch of stuff, you know, that he had been looking for the tree of life. I I I don't know >> what's he normally like. >> Normally, he's uh Okay. >> Do you know of him having any kind of drug addiction besides just painkillers? >> No. So, I'm going to go back through everything to make sure I didn't miss anything. I didn't I don't misquote you or anything like that. So, he was in the bed or in the bathroom, had a gun pointed at you couple times, and he was trying to get you to talk about Satan, say his name multiple times. What was he saying in the bathroom whenever you got here? >> Jesus, Satan, puppies. >> Jesus, Satan, puppies. And that's out of the normal of how he usually talks. >> He's He keeps to himself. He don't let his secrets out. His father beat him to no end. And he promised me he'd never do that to me. And I probably pushed him to this point by being a smartass. >> No, it's No, >> no, it's not your fault. >> No, you can't blame yourself for something like this. >> Again, separation and monitoring is very important. You know, preferably, it would be a better practice to separate both witnesses. And again, you can't rule out that uh Jacob could be a suspect. >> All right, ma'am. Can I get your name, please? >> I still go by here. >> Are you guys married? >> Yes. We'll hang out for a little bit. If I need to ask you any more questions, I'll come back in. I'll give you a break right now. >> Okay. When we wrap up this case, we're going to look at a couple of things here. Okay. Look, the son shoots the dad in the butttock, right? After guns were pointed at the family. Got that? Now, here's the deal. Is that self-defense or the only thing that stopped the homicide? Now, the suspect's in the tub with a rifle and a pistol next to him. Is that a routine domestic or did you lock it down and send the K9 unit first? We'll cover this all in the wrap-up, but first cops respond after a dispute between neighbors leaves one dead. >> What's going on? >> What's going on? >> Somebody's been shot. >> Was that you? >> Let me see your hands. Your hands. >> Got them. Yeah. 32 in custody. >> Is he breathing? >> We're going to Thead is in custody. >> The squad's in. Is this your husband? >> Just hang over there for one second. Okay. >> Breathing. >> I'm going to check him real quick. All right. Just hang out right there. Okay. Talk to her before she run. >> That's stepdaughter. >> Is she leaving? >> That's stepdaughter. But >> what's your hold? >> Okay. So, let's uh build a foundation how we're going to investigate this homicide. As you can tell, code for suspects in custody. Uh let's get him in the police cruiser and take him to the station. Uh we do have that outstanding gun. We got to look for it. So, we got to coordinate efforts to try to find that gun. also family members. You got to assign somebody to just maintain, you know, somewhat of the emotions just flying high, knowing that, you know, there's a deceased there at scene. And let's begin to start taping off uh what I like to call an inner perimeter and an outer perimeter as well. And I'll explain to that a little bit later. Okay, >> you can get I'll be responding. >> 87. That's clear. 982. Did you copy? I did. If you would send me the details, please >> clear 31 males in custody. >> Another thing worth mentioning is also is that depending on the uh size of the agency, right, and I don't know uh how many swarm personnel they have in this particular agency, but all hands are on deck. You got a homicide scene. uh if it ends up being multi-jurisdictional, multifunctional, uh start gathering and asking and notifying other agencies to come and help because you're going to need a lot of resources uh to maintain and manage that scene. >> In custody at 1822, we've got a supervisor in route and squad has been advised to respond. >> Which car? Have you heard it all? >> What are you doing, buddy? Huh? >> I'm taking everything you got. Have you heard it all? >> What do you mean? >> Get in the car. >> Put my belt back on, man. >> Yeah. Get in the car. >> Why are you taking my belt off? >> Cuz I'm taking everything you got. >> No, you're not. >> Sit down. >> Jesus Christ, dude. You're not taking everything I got. >> Next one over. Next one over. >> Yeah. Over here. Next door. Behind this house. >> Hey, we're Hey, come down. Go down. Go down. Go down. >> Oh, I'm looking. right here. >> I understand that, but right now they got they got to warp him. Okay, >> did you guys catch that? Him? >> Yes, it was the neighbor, right? a black shirt. Yeah, he just he shot him like five times. [laughter] >> Is my husband breathing for you? No. No. I can't. >> I want >> I want to be over there. >> I know. But right now, right now, >> another thing worth pointing out is that you don't know necessarily how big you're going to make the crime scene, right? So, when I talk about the inner perimeter taping it out, you make one real close. So you have that location and you also have the other location as well. Uh where the suspect lives compared to where the victim actually lives. Then you got to do an outer perimeter. So you cast that net real wide. And what you actually do is get a deputy to have a crime scene log and start logging every single person that's present when they actually and PE, you know, deputies and other personnel they're going to get there and when they exit for every single person. And right now, what you don't want to do is contaminate that scene. Considering there still is that outstanding gun, >> you got to let them work. Okay. >> I'm going to sit you down over here on the porch. Okay. >> I was right there. I took off running cuz he pulled out a gun and started shooting. >> Okay. Are you okay? >> Yeah. >> Like you not hit or anything, right? >> No. >> We You guys want to hang out with her for a minute? You probably need to get a statement from her at some point. I'm sure. >> They won't take her to CIS. >> Um, see, >> is he coming there, too? >> No, he I'm not sure what the medics are doing. I know that the bad guys in custody right now, so I I'm not sure what the medics are doing. >> They're not telling us anything. >> Well, they don't know anything. >> So, can you Did you Are you the one that called 911? Can you tell me what happened? >> We heard a gunshot. We went over there. The neighbor came outside and I came outside. My husband was cutting the the tree that fell. Okay. and he went over there and said and told him to put the gun away. He should he doesn't need a gun because he came over here. We called the cops on him once before. He came over. He threatened to he was pointing the bow and arrow at me. And my and my husband said, "You're crazy. You pointed the bow and arrow at my wife. You don't need a gun." And he started running his mouth. I said, "Ted, we'll just go call the cops." And Ted's like, "So Ted," my husband started walking away. And then he said something. My husband turned around. He just shot him. Okay. And did you see that happen? >> Yeah. >> Did he get the gun? >> No, I checked him. It's probably I think he lives up in here. So, it's >> Yeah, he said he left and came back. >> What? >> Where did you first see him when he got >> He was standing right here with his hands in his pockets staring. They said he after he shot him, he went back into his house and then came back outside. So, okay. Which I'm pretty sure he lives up here in this building. Do we have multiple GSWs? >> We have two in the left upper leg and three in the stomach and we believe one more in the right ear. >> Do you live around here? You just >> I own this property. >> All of it? >> No, I own it from over I don't own that building. I don't own that house there. I own this place. >> Okay. Do you have a tenant that lives here? >> Yes. >> What's his name? >> Cole Barnesby. >> Okay. Okay. Um, I'm going to ask you if you could stick around and be present for us cuz we're probably going to have to come back and ask some questions. Okay. >> Okay. >> Um, okay. So, >> spin it out there so I'm not the only one. >> This gentleman lives here. His wife is on the porch. >> Okay. >> The female homeowner from here is where? Cuz she's not over there. >> Okay. She might be. >> So, if she's inside, I just want to We just want to make sure a there's no more shooting victims window and see if there's anybody >> if there's any take a breath. >> I'm just freaked out. >> Okay. So you you rent this house? >> I rent this house. >> Okay. Did somebody rent this garage? >> The guy that shot him >> 911 that house. >> Okay. You know. >> Okay. So the guy So the young guy >> What happened? >> Well, we're going to have detectives come. >> I don't want I don't want you to keep telling me five different times. So I'm going to let you catch your breath. Compose yourself a little bit. It's kind of a scary situation. >> Yes. Very scary. >> Okay. >> Very scary. Okay. >> So, the per the deceased actually lives in the house next door. His wife is over there on the front porch. >> This gentleman lives up here. They had an altercation about a tree. He the deceased was cutting cutting up a tree that had fallen down. >> He comes out. They exchange words. He shot him. >> Going into a yard to cut down a dead tree and have your neighbor come out and shoot you. >> Is that what happened? >> She says she says I think his name is Mark. Apparently, >> so this tree right here, >> this tree here is in their yard. He was going out to cut it down cuz you can see it's dead. >> And the guy came out and I guess in the past he's tried to hit her with a bow and arrow. Well, today came out and started a fight. According to his wife, she came out to find out what's going on. He his wife came out to find out what's going on and he went and got a gun and he said, "Put the gun away. this isn't anything you need a gun for, >> right? >> And then he shot him, I guess, three times from what she said. >> And she's the one that called my mom and she said, "I don't know where his wife went. Is she still there?" And I went back. >> She saw the whole thing. >> She did. Yeah. And she called my mom. She goes, "I think his name is Mark." >> Yeah. >> And I'm like, "You don't even know your neighbor's name." And he killed your husband >> for cutting down a dead tree. >> Very odd. That's some really good information from the paramedic. My thinking is that's the paramedic that's treating uh the wife, right, of the deceased husband, you know, the victim. Now, another important duty and responsibilities when patrol officers get there is, you know, old school, we used to actually draw a diagram. You definitely want to draw a diagram and depict the scene, but I'm sure nowadays we still have other resources and tools that can probably do a better job in depicting the actual whole scene. Of course, they started canvasing the area, which is another part of your duties. Canvas, canvas, canvas the area. Door knock all the neighbors. Try to get as much evidence as possible so that you give all that information to the homicide detectives who are going to come at scene and pretty much walk through the whole scene to determine whether or not there is more evidence that needs to be gathered. Now, lastly, we still have to find that gun. Okay. Yeah. Said that she thinks that he came back from the military and just really jumped right in head. >> So start over cutting down a tree. >> Do you know the neighbor at all? >> I mean they've had problems before and they've called the cops on him before. >> Yeah. >> Um not too long ago, maybe two or 3 months ago and um we heard that he just got out of prison and everything and he didn't have his money, but Other than that, but my mom, he's pointed a bow and arrow at my mom before, and I think that's when >> just told me. Yeah. Wow. >> Yeah. I don't think he had at all. >> How long have they lived there? >> He just moved in. He just got out of prison. Um, >> so it's recent recent like 3 months ago. That's all started when he moved here. >> Yeah. >> Heard this guy threaten you with a bow and arrow before, too. >> Wow. >> Is it weird? He's weird. Like you can look in his eyes and see. Crazy. >> Yeah. >> But I didn't know I didn't know he had a I thought he had like a I didn't know he had a handgun. >> Yeah. [cheering] >> His old star ever cutting the tree down. >> No, my Well, my husband was cutting the tree down. Yeah. And we heard the gunshot going over there and he lost his >> And that's all really good information. You know, this conversation we're having. Could it be just because of the tree? Probably not. uh you have to really build that motive and intentions of the suspect and try to get a good story so when you do present this to the district attorney's office or to the state right for the filing right for that criminal filing that is uh you're going to get a really really good picture but again let's get those detectives out there so they can actually do what they do best >> life over >> yeah Nothing. They told me to leave him alone, too. I'm just walking. Call the cops. Does anybody talk to that coward neighbor over there? >> Which one? >> They said they could they couldn't find her. She was right there when it happened. >> Okay. So, I guess I got lost in translation. I was Well, I was assuming it was his wife. So, >> some a female lives in the house. >> Yeah. >> Then he lives in the white garage. >> Yeah. They insults her. He harasses her. She came outside and said, "I'm I'm terrified of this guy. He's got a gun." >> Okay. >> That's why that was today, too. >> Yeah. That's why my husband went over there >> cuz we all heard the gunshot and she was walked outside like freaking out. >> I know they were trying to preserve the crime scene as much as possible before the detectives got here. So, I know that regardless by the end of all this, she'll be talked to. >> So, >> she was right there. >> Did she leave? >> I don't know. >> Okay. >> I don't know. The car fell I right when my husband got shot. I fell on the ground and then he took off and started calling 911 and ran inside. >> I I >> Did he run off anywhere when it happened? >> Yeah, he took off that way and then I So >> I came inside and called 911 and I peaked out my back door and he was shaking my husband. He came back. >> Yeah. >> So he ran off down the street or down the through the field? >> I don't know. >> Just that direction? direction. >> Okay. Cuz I know they have not recovered a gun yet. So >> they haven't recovered a gun. >> That's what I'm trying to figure out where you could have ditched the goggles. >> He Yeah, he took off that way. >> Okay. >> It was a a handgun. >> Okay. Was it black, silver, >> black, all black? >> You step out. We're going to walk through that black door right there. And we're going to walk through a hallway. Ready? I'm going to help you walk since you have your hands behind your back so in case you fall forward, you don't fall on your face. Okay. Nope. It's our department policy. I'm going to come back out and grab your stuff here in a second. It's like your phone, wallet, keys, stuff like that. Okay. >> What you say her name is again? >> Malone. >> Malone. Post Malone. >> Yeah. >> You know his songs? >> Uh, a lot of them. Yeah. >> We're go this way. right here. >> You know, while we're waiting for the suspect to go through the booking procedures and get searched and do all that, you know, just want to share some thoughts about uh the fact that he shows no remorse. Uh the fact that no empathy whatsoever. He just got out of prison. You know, this is the case that you're going to build against the suspect. And in order to do that, you got to get as much as cooperation as you can from the witnesses that were at scene. And again, speaking of the scene, we don't want to contaminate it. We want to preserve and keep it as pristine as possible. >> So, are those murderers or murders? >> Um, murders, right? >> I would assume it's like >> murder >> maybe. >> Uh, I would assume we should probably put him in a a cell. >> Okay. >> Yeah. I'm I'm on Y1, too. >> Okay. Okay. Um, >> I'm not safe. >> Let's go. Get safe and I'll hold it here. Sorry. Okay. Did >> you pat him down already? >> Did he have anything on? >> I got the rest of his stuff in envelope and like >> identification right now. >> Oh, yeah. And then I can't That's I know it's important to you and I understand that. I'm going to I'll make sure it's safe. I'm going to put it in this envelope. I have no reason to keep it. >> I'm going to do a uh more thorough. >> Okay. So, he's going to remove the handcuffs. Here's what we want you to do. You take the handcuff off your whatever hand takes off. Put your hand flat on the wall in front of you. Understand those instructions. Okay. Step back a little bit. Keep your hands on the wall. Yeah. Okay, I'm going to pat you down and I'm going to have you also remove your shoes and I'm going to have you remove your socks. I'm going to check those out. Everything's okay. Put them back on. You understand that? Okay. Practice that. That was hard. What? Practice that hard. >> I've been doing this about 30 years. Put your hands back on the wall for a second for balance. lift up your right foot. >> As far as I unless they want or anything. As far as I concerned, you can have it back. That's not >> That's a That's like a religious thing. >> I understand. That's what I'm saying. I'll make sure if I get back if I get it back to you. >> And also worth noting also, it's a felony charge. So therefore, you have to do a full cavity search, meaning shirts off, pants before the whole thing. You got to search the whole body. They won't show it and won't depict it in the video, but just wanted to let you know for every felony charge, you have to do a full cavity search. >> Get a backup. But for now, I can't have you have anything in there while you're in the cell. >> You understand that? I'm not trying to be disrespectful to your religion or anything like that. >> Okay. Uh, would you like to answer any medical questions at this time? >> No. I can't figure that out. That's fine. So, the only reason I'm asking medical question is something happens to you, you know, who to get a hold of like family wise or something like that. That's the only reason I'm asking stuff like that. I don't I don't know anything about your incident. Want to know anything about your incident? I'm going to ask you anything about your incident. >> So, at knowing that, can you answer some of my questions now? >> Okay, that's fine. I'm not going to I'm not going to force you to do anything you don't want to do. uh good part on that deputy. You know, the jailers, look, I don't want to know anything about your incident. As a matter of fact, there has been other videos that we've done where there's a lot of spontaneous statements that are made at scene. Uh this is an example where you know what, don't ask any questions because he's about to he meaning the suspect is about to go in the box. Okay? You got to remember the formula. Custody plus interrogation equals Miranda warnings. You have to Mirandise him if you want to hear his story. And it's those homicide detectives that have that training expertise and that experience uh to be able to obtain that confession. Okay? Until he actually invokes says, "You know what? I want my lawyer. I don't want to talk to you guys anymore." If that's what happens, okay? So, that's very very important to know the difference between spontaneous statements and an actual confession once you are giving the Miranda warnings. >> Uh go ahead and put him straight away. I got to grab some keys. Put straight away in uh one there with me there. >> There's a sink there. Yep. And a toilet for you. >> Okay. So, as we wrap up this particular case, look, this wasn't a neighbor dispute whatsoever. This was more like an execution. What his intentions and his motives are, we're going to find out. Okay. With that being said, a couple of things worth noting. Uh when we do search for that firearm, let's make sure that we have one deputy, one officer assigned to seizing when we find and locate. Make sure you take pictures and the whole nine that firearm and maintain that chain of custody. Okay, that's very important as well. Now, as far as interviewing witnesses at scene, you know what? Let's go ahead and separate and get more resources to monitor uh even, you know, someone that uh for the outcry, you know, for the family, especially for the family. I mean, come on. Your wife just pretty much watched uh the suspect kill your husband. That's devastating enough as it is, right? Uh look, the loss of life, no matter what, uh is a tragedy in itself. Okay. As far as case number one, the first case that we saw, uh, what I will say is is that is it justifiable for the actions that the suspect took in order to actually defend himself and defend his mom. You know, that's going to play out, too. So, it's very important. Two very important cases, and we're going to be doing more as we get to know what it is to walk through the scene of a homicide. Okay. Joshua was charged with the following: unlawful imprisonment, assault on a service animal, and wanton endangerment. He was found guilty on all three charges and sentenced to a total of 9 years in prison. Cole was ultimately convicted of murder and tampering with evidence and he was sentenced to 24 years to life in prison. Okay, go ahead and click that like button and that notification bell.
