As a police officer, you roll up on a simple concern call and in seconds, everything can go sideways in a heartbeat. >> Freeway get your person on location. >> Stop it right there. >> And we have a woman who shot her roommate during a heated argument, then calmly tells officers she didn't mean to. >> I know I'm I'm not going to flip out or nothing. >> I know. I know, honey. >> Yeah, no signs of life. Her Her head is smoking, literally. >> First, cops respond to a welfare check after a concerned daughter raises concern about her father. >> Hey, William. >> take them out. >> Hey, William. Why don't you hold up for 1 second? Explain to me what's going on. >> Uh They left supposed to be. I want their ass out. They left supposed >> Thank you. >> I want their ass out. They [ __ ] my house up. They have [ __ ] up my all my tractors, my vehicles, everything. I want them out of here. >> Who Who's they? Just those two? >> Yep, they're >> Hey, William. Where are you going? >> I'm going to go try and find a hat and some underwear that I can wear that they stole all my clothes. >> Are you just Are you grabbing it out of this truck up here? All right. Well, I'm just going to come Is that okay if I walk with you? >> Go ahead. You can check every damn thing you want. >> Well, I don't need to look through anything. >> Well, what are you doing? What do you want to go to the truck for if you're not going to check it? >> Oh, I just want to make sure you're not going anywhere. >> Why? I got a driver's license. I'm legal. >> Uh >> Okay. >> Insurance, everything. >> But, William, with what I just walked up on, I want to know what's going on. >> I want them to leave. >> Okay. >> Simple as that. I'm not doing anything. They're in my house sleeping. >> Okay. >> I can't find my hat. Can't find my underwear. And they stole everything. And the only reason the grass is cut is cuz they did it with a damn push mower because they [ __ ] up my tractor. >> Okay. >> Turned off the electricity. They got electricity cuz they switched it in their name and shut mine off. I'm sick of this [ __ ] >> And they they sold all your stuff like your uh underwear? >> Yes, they did. You you're aware of it. Don't play stupid. I'm done. >> I need doors. >> The back door. What about the indoor? You want the indoor outdoor? I'm insane. >> So >> You're all the same. >> Do you feel like there's some mental or not anything? >> All you have at this moment is a wellness check, right? And you can tell maybe he's suffering from a mental illness, he's having an episode where things are not just making sense. However, there is no reasonable belief that we can legally detain him, right? No reasonable suspicion to believe that he's involved in any type of crime or has committed a crime. So therefore, he's free to leave at any moment. >> Um for right now, can you guys maybe take off? Cuz that's kind of what he's requesting and I'll try and talk to him and I I'm not entirely sure what's going on. >> me up, but I ain't going to jail near. >> Well, I have no intention on it, right? >> you. And I don't give a reason. Or I turn the lights on, they come in and make >> I ain't done anything. >> I ain't doing a [ __ ] thing wrong. >> Motorcycle parts, chains, shocks, and rods. [ __ ] god damn suspenders are [ __ ] off. I'm sick of it. >> So William, I told them they're going to take off right now. >> Yeah, thanks. >> Can we maybe have a conversation, please William? Well, I Can you Can you explain the situation to me how You said they're uh >> You Do your hand and wand and all that [ __ ] is old lady coming >> Okay. >> get my ass and me up and >> Okay, who's >> now. >> Yeah. >> Sounds crazy, don't it? >> I don't know the whole situation. That's why I'm if you could explain it to me. >> Yeah. I want to feel I got to get some food cuz my refrigerator is is [ __ ] up. >> Well, you What's William, what's going on? >> I don't need You know it all. >> No. >> And if William >> don't know it all, >> William. >> then I can't make a report cuz you guys won't open up your door. >> Excuse me. >> William. >> Excuse me. >> Please, officer. >> William. >> You are stopping me from going on my property and I'm not doing nothing wrong. So, I've got to go. >> You're >> I'm low on gas. I got to put gas in. >> William. I need to talk to you. I'm asking. Please, talk to me. >> Is there a reason you don't want to? >> Excuse me. Excuse me. >> And that's his choice. If he wants to leave, he's free to leave. You got to let him go. There's no reason to detain him legally whatsoever. >> And is that black truck? >> Yeah, he's headed north bound on 35 right now. Like you can try and get a stop on him, but I have a feeling he's going to take off on you. >> 23 Vernon, I'm attempting to stop right now. Lights and sirens. It's like we're pulling over here just off of Janola Road. >> All right. So, he >> Now, look. Just to be a little bit critical, and of course, you know, it's easier for me to look at this video, flush out all the details, and have a full body discussion about this incident. But, if we're going to learn together, it's just me putting my investigative hat on and my adjudicator hat on to determine whether or not, you know, there is reasonable means to stop him or not. Now, you're conducting a traffic stop. What you care the most is about his well-being. And that's what's going on. However, remember what you have only is the mental wellness, you know, you have a welfare check, if you will. That's all you have at this particular moment while you're conducting this traffic stop. >> Someone else is pulling him over. I'm going to take off Take off up there, okay? >> I copy. I'm going to be right around up there. >> Go ahead and see your hands. I was asked to stop you for a minute. What's going on? Go ahead and shut your truck off there for me. Can you please explain that to me? Hey, well, why don't you hand me the keys for right now? I don't want to arrest you. Are you saying you want Are you saying you want to go to jail? Can you tell me what happened? Can you have tell me what happened with your daughter when I was pulling off? Okay, you're not Okay, well, I just I mean, I understand she was in your house. So, when I when I pulled up your daughter came outside crying. I mean, I understand they were They were on your property and you wanted them to leave. >> Yeah, and I want them to stay off. >> Okay, what was said? >> I walked away, officer. >> You just walked away? Okay, yeah, I mean, that's what you were doing when I pulled up. You were walking away. >> I don't know what was said. >> Well, I mean, you were there. But, all these questions are very, very good because there could have been a possible crime, right? Maybe he got into an argument with his daughter. It probably raised it to an assault, maybe a battery, who knows. But, again, these inquiries to investigate whether or not there was a crime, then you have grounds to legally detain him, but we're kind of getting there, okay? >> Why did they Why did they shut your electricity off? >> Cuz I'm late. Cuz I couldn't pay my electric bill. Come on. I'm getting out of here, boys, okay? You can deprogram me at You know, uh gas station. I'm not going nowhere cuz I'm not against the law. >> me your keys. >> You're against the law. Give me your keys. >> Give me your keys, right now. >> You're going to have to take them. >> I'm asking you for them. >> And I'm telling you you're going to have to take them. >> Okay. You're going to try to drive away? >> No, I'll try and drive your nose through your face. >> Is that a threat? >> I'm sick of it. No, it's not a threat. Not a threat at all. That is a [ __ ] promise. >> Oh, okay. >> You're not the the law. You're a bottom law, and I'm not going to go. >> Okay. So, what do you have for him? >> I'm just trying to talk to him to understand what's going on. I need to ask you. And get some food. >> You're not free to leave. Get your keys out of the ignition. Seriously? >> No. Oh, [ __ ] Get Oh, my god. >> STOP IT, RIGHT NOW. STOP IT, RIGHT NOW. STOP IT, RIGHT NOW. >> NO, I JUST WANT TO GET >> STOP IT. YOU. GOD DAMN IT, STOP. STOP IT, RIGHT NOW. JESUS CHRIST, YOU. GET GOD DAMN IT. 43 SHOTS FIRED. STOP. [ __ ] JESUS! DUDE! GOD DAMN IT! >> [screaming] >> HE TOOK OFF WITH ME ON THE VEHICLE, REFUSED TO STOP. Refused to stop. Uh we had a 10-50 here he hit 20's vehicle. He's out. He's out. >> Shots fired? >> Shots fired, dude. >> Did you call shots fired? >> Yes. I don't know if they heard it. Yeah, they got it. >> Did you get EMS? >> That's Driving right into [ __ ] traffic. >> [sighs] >> Do we Do we have Can we apply pressure or anything? Do you have gauze? I got I got in the first aid kit. I can't get into the rear of my car. >> Allow me to interrupt at this point right here because if you didn't know that we as police officer are mandated by law, it's pretty much across the nation, the majority of states, to render medical aid. You have to do it. >> Do you have gauze? Something? >> nothing. I have nothing. 20-30, we need EMS here stat. Come on, dude. Come on. >> You got anything You can't get in your trunk? >> I can't get in the rear of my vehicle. >> Here, let's There's got to be something we could stuff it. Here. How do we pull him out? >> How do we him Jesus Christ. >> [panting] >> Run back to my car. We can get the first aid out of it. It's in the trunk. With the empty. Okay, so some final thoughts. What's going to happen now post management scene of an OIS is going to be fully investigated by the criminal team and the admin team, okay? Once all the investigation is completed, then the adjudicators, the bosses, command staff, the levels of review are going to have to scrutinize and make judgment on everything that led up up until the point where you used deadly force. In other words, the totality of the circumstances, the tactics applied, and or up until the point where they used deadly force. So, we're not just going to take quote unquote the moment of threat. When you use deadly force here in the state of California, uh the acronym AOI, which is kind of similar in other states. The A stands for the present ability, the O is the opportunity, and the I is for the apparent intent. Once you do a full examination of what the officer believed to be the present ability, the opportunity, the apparent intent, then you can determine whether or not it's going to be in policy or out of policy shooting. So, hey, we'll find out what happened to him shortly. But first, cops respond after a woman admits to shooting her roommate. Come out. Come up. Come up. Okay. Okay, you're good. You're good. Come up. Come up. Come up. You're doing fine. You're doing fine. Come on. Where's the gun at? >> The gun's inside. >> Okay. Go right over to him. Go right over to him. You're doing good. Just go over to him. Walk over that officer right there. >> Okay. Okay. >> Riverside Police Department, come on out. Hands up. Come on. Nobody's going to get hurt. Come on. Come on. Come on. Come on, sweetie. Come on. Come on. Who else is in the house? Come on. You're doing good. Come on. You're doing good. Nobody's going to hurt you, okay? You're doing okay. No one's going to hurt you. All right. All right. Just hang on a second. I just need to secure you real quick. Okay. Okay. All right. Okay. Just relax, honey. Just relax. Just Just sit down, sweetie. We got to get got to get medical attention and everything else going, okay? All right. Come with me. Come with me. You're safe. You're safe. You're safe. >> I know I'm I'm not going to flip out or nothing, sir. >> I know. I know, honey. Relax. Just relax, okay? Put your hands around like this. What's your first name? >> My name's Haley. >> Okay, Haley. Just relax, okay? I know. Just relax. >> Oh, that she's an old lady. She's 60 years old. I'm the one that pulled I'm the one that did it. She's 60. My baby My baby He He's on oxygen. >> Who else is in the house? >> He's downstairs with the girl. >> Yeah. >> Yeah, I know. >> OKAY. >> I LOVE YOU. >> JUST RELAX. OKAY. Just relax, okay? You're okay. Just relax. >> This is what they call on scene spontaneous statements, right? Uh we're We're to have to end up Mirandizing her, right? Custody interrogation equals Miranda, which means that we've got to get her back in the station, put her in the box, and have that homicide detective probably end up getting a confession cuz that's what it sounds like. However, the main focus is right now is to preserve and try real hard not to contaminate the crime scene considering there's a gun inside, there's people inside, we still have a lot of work to do in order to secure that scene. >> Can you come out so we can GET THE AMBULANCE UP HERE? >> NO, THAT'S THE OLD LADY. SHE'S 60 years old. I'm the one who called the police. She's 60. >> She won't come out with the baby? >> get my baby cuz she's on oxygen. >> Who else is in the house? >> He's downstairs with the girl. >> Okay, he wants to go. We got to go. Yeah. Yeah, I know. >> All right, so let's move up. >> Yeah, let's go. >> Where's the gun? >> Somebody else called. >> Here it is. Go. I just got out of the hospital. I take care of this. Basement. Basement. >> gun? >> It's in >> No pulse. >> Okay. You want to do CPR or >> [sighs] >> This is Get the medics in here. >> Okay. >> Yeah, no signs of life. I mean, her her head is smoking, literally. >> Um >> Just Haley. >> I just want to let you guys know I'm on mental meds. My boyfriend has them in the house. Can you grab them for you like when >> Yeah. Yeah. Yeah. Just relax. You're going to be fine. You're going to be fine, okay? Just take a deep breath. Take a deep breath, okay? You're doing fine. We'll take care of everything. >> How old are you? >> How old are you? >> I'm I'm 19 years old. >> years old now? >> Yes, sir. >> Been doing all right? >> Yeah, I've been good. >> Okay, I haven't seen you for a long time. >> Yeah. >> Since you were much younger, okay? Who's this little guy? Is this yours? >> This is my son. >> How old? >> He's two. >> Okay. But you me a favor, let's walk over by this cruiser. Get Get that baby in the sun where it's a little bit warmer, okay? We're going to walk right over here. Do you know what happened? >> Yes. >> Okay. Hi there. >> Hello. >> Hi. >> I'm her grandpa. This is my daughter. >> Okay. All right. Just hang right You can just hang right here with us, okay? >> All right. Where's >> What the heck? >> What happened? >> We're We're sorting it out. We got to make sure everybody's safe first, okay? >> All right. I need to make sure my daughter's okay. My daughter can't She's very mentally >> Okay. Hey, listen. >> talk to my daughter. Yes, she's my >> I'm I'm I'm taking care of her. She's taken care of. >> She's been doing things so crazy. >> Yeah, she's fine. She's fine. Okay. So, if you would uh she's safe, okay? I have her in my car. >> Cuz it was it was it was She came out >> Okay. Well, she came out at her first. >> You weren't here, so I'm going to need to talk to him, okay? So that we don't have our stories all Can you take the little one for a little bit? And then we talk to All right. >> My granddaughter >> Okay. >> My granddaughter, I think, is in there. >> Is your granddaughter in there? The little one? >> She's the the baby. Uh hey, listen. This is my daughter. I promise I >> You hang here with Officer Brewer, okay? I'll be right back. >> Somebody have Somebody left >> Uh it's just worth noting right now that one of the things that you definitely want to do as you're preparing this crime scene, right? Of this homicide is you definitely want to get tape and create a big outer perimeter of the outside, as as wide as possible. And then you're going to tape up and create an inner perimeter. And you definitely want to get a police officer or assign a cop, right? A crime scene log. So for everybody that comes into the scene and out of the scene, you have to log it. Time in, time out. Everything has to be very, very detailed. And set up the scene so that when the homicide investigators get there, they have a somewhat of a picture of how they're going to be investigating further for this homicide. So. >> I have shooter in the back of my car. Shooter in the back of my car. You okay? Are you hurt anywhere? Okay. Okay. >> I don't sir, I'm so shocked. >> Okay. >> Like >> All right, I just need to get some basic information for you. What do you know your social security number? >> life? >> Honey, I don't know. I don't know anything. I just need to get your information so I know exactly who you are, okay? >> Why can't I cry? Weird. I'm just shocked. >> Okay. Can you tell me your social security All right, are those two your children? Okay. >> And my dad has my dad can take them. I mean, or they they can stay with dad, too. >> Okay, yeah. Yeah. They're fine. I just wanted to make sure we got them out and they're fine, okay? >> no children services is going to take my babies from us. >> Just relax, okay? I just need to make sure I know who I'm talking to. When I got there, no signs of life whatsoever. >> Okay. >> Gunshot wound to the head. >> Yeah. >> Yeah. Yeah, we we waited a minute cuz we there was a grandmother with a baby standing at the front door that she wouldn't come out with. >> Did she say? >> Yeah. >> What's wrong with me? >> Hailey Lynn, right? What's your date of birth? >> Hey, I hate to interrupt for 1 second, but can I get her name? The lady that shot. >> Shyanne. I don't know her last name. >> Do you know where any of these cars are hers? >> No. No. None of the cars I heard. >> Okay. I'll see if I can get a last thing. >> That's fine. Thank you. Thank you. Has anyone coming out said anything of what happened? >> Her boyfriend told me what got you his name? What boy? >> Okay. >> Victim's yes, he is the victim's boyfriend. >> Okay. >> He said he left to go get cigarettes. >> Yeah. >> Was either coming back or walking and his mom he could hear his mom yelling bro. >> Who's the mom? >> The old lady that you brought out here. >> So he goes running in and she tells him that Haley shot his wife. So he goes downstairs >> And that's his wife? >> Yeah. So he goes downstairs and finds her. >> Okay. >> "Who's the gun belong to?" He said, "My brother, the one that was standing up, the younger one." The one that was standing there, I don't know his name. So it's his gun. I cuz I asked him, "What kind of gun is it? What does it look like?" He goes, "I don't know, it's my brother's gun." And I said, "Who has it?" "I don't know." I said, "Is it downstairs?" "I don't know." I said, "Were you down there earlier?" Cuz "I don't know." That's the thing. I shagged him, we shagged her. >> everybody >> Right. >> And you >> It's >> Can I just put my arm around you and tell you about the situation? >> Yes, Haley. >> Has anyone said anything? >> Huh? >> Has anyone said anything to you? >> Yeah, hang on a second. >> We were >> And no one has told that she passed. >> Okay, here. >> I haven't said anything to So he doesn't >> And that's his wife? >> That's soon-to-be wife. They're boyfriend. >> Okay. I just say he didn't have enough information on her. >> No. I got my phone. >> Uh um >> I don't need your phone. >> This is >> Good. Good. >> She was just blurting >> They all work for all of them. >> Okay, great. >> How? >> Who was >> You know, I'm sure. If she's okay, you know, I can't let her go to prison for life. That kind of stuff. >> Sorry, what did you say? >> I'm not going to prison for life. You know. >> Okay. >> she? That kind of stuff. So it'll all on my body cam. So, >> you'll have all of that. So. >> Uh you know what? Uh go and canvas the area. Go knock on all the witnesses' doors and see if anybody heard or saw anything. Get their information and get their statement, okay? >> Okay. So, we don't want to take Brian back right now. We'll put him in Rocco's car and then I'm taking my computer back. >> Yes. >> Okay. Where do you want her hanging here for now? >> We're going to work on getting her back to the PD. >> Do we know Do we have any idea of what happened yet? >> Yeah, for sure on that. >> Very, very vicious disagreement in the basement. And from what I've been told, possibly said that or I'm sorry. Said that um Haley or Cheyenne attacked Haley first and somehow there was a shooting, but I don't know any manner or anything like that. Haley's dad's still here. I'm going to talk to him or go again because how he ended up here all of a sudden. >> Well, I'm sure she probably told him. >> Yeah, but I want to know what he said. >> Did she uh Does anybody have all Cheyenne's info? >> I don't know. >> No, we have Cheyenne Mitchell is all we got. I don't think Mitchell's her last name cuz they're not married yet. >> I don't know. No, he didn't I don't want to talk to him. He didn't know Cheyenne. >> What are we doing? You going to get a search warrant? >> Going to get a search warrant and then >> He'll be coming in when they get here. There is one mag upstairs on the table to the right as you walk in the door. >> Where's the gun? >> Don't know. >> Nobody's found it. >> That's the only thing I can see and I can't tell if it's a real mag or not. I just see the mag there. It looks like it is. So. >> in the backyard. >> Yeah, but we were all >> I moved my guy to your car so that I can go back and get the search warrant going here, so. >> So. >> Did you double check him? >> No. got it. Okay. >> I was searching the car but >> that uh she Haley went upstairs to get a gun. So, any force Yeah. >> It's story. So, they got in a scrap and Haley went upstairs to get >> All right. So, I'm going to take her back and put her in an interview room and babysit her. >> Boyfriend and girlfriend? >> She's actually found a drink. I want to go and get her comfortable and and take care of that so we can keep our >> Um cross that path when we get it but we don't even have We know what the end result is but we don't know how we got there at all. So, we don't even know necessarily about the uh you know, she claimed it's hearsay but self-defense to the dad and everything. So, we'll just try to see where we can get to there. So, I can't promise like once the interview is done that hey, we're just going to take her to jail. We might just be hanging on to her until we kind of have everything complete or have an idea. >> Can you tell me if she's okay? >> I don't know yet. I'm still working on her, okay? Me and you's going to go to the police department. I'll get you something to drink and then get you a little more comfortable. Get you away from here so you don't have to see anything. >> over there. Am I allowed to hit it before we >> I have it I have all I have your stuff. Yeah. I got stuff. I told you I'd take care of it. >> Did she get Did they already take her to the animal hospital? >> I I honey, I don't know. I was I was dealing with you and your kids making sure you guys were safe. I don't I don't know anything about her right now. As soon as I know something, I'll let you know though. >> Are you even allowed? >> If I find something out, I'll let you know, okay? >> I swear I'm not a killer. I swear. >> Okay. Come on out here and get you something to drink and There you go. Okay, I'm going to go up here and I'm going to hang on to you. I'll go up right over here. Go ahead and look at that red dot right over there. All right. Now you can come on in. I want you to go straight ahead. >> Straight? >> Yeah, straight up right here. Okay. All right, in here. Okay. You can just take a standing for a minute and I'll take the handcuffs off. >> Standing? >> Yeah. Get you out of those handcuffs and let you You have anything else in your pockets, right? We'll check you real fast, okay? I'll turn your pockets inside out. Your pocket over here? Okay. I'll get to those in a second. Thank you. Okay. Nothing up here? Okay. Okay. Can you face me just a little bit? Okay. Okay. Water work for you? >> Yes. >> Okay. I'm going to come in and we'll take some pictures of you here in a minute while you're injuries, okay? >> Uh just to kind of give an idea about that crime scene log, for example, you have this particular officer, what you're going to write down in that log is I arrived at scene at 6:25 p.m. Uh took the suspect from the scene at 7:15 p.m. Then you're going to have to write arrived at the station at a certain time and so this particular officer is solely responsible for this part of this homicide investigation. So, each officer has a certain role and it becomes very, very important as the case goes through the criminal proceedings. >> Turn around for me. Okay. I'm here. Okay. Okay. All right, just relax for a minute, okay? Relax. >> Hard to relax when >> I know. Just have a seat for a minute, okay? I'm going to get you something get you something to drink, okay? All right. Listen, I know there's nothing that I can say to you right now that's going to make you feel better, okay? But I am going to try to tell you this. We are going to get to the bottom of this, okay? We're going to figure out what happened. And justice going to be served. You understand that? We're not we're not new at this and we're good at what we do, okay? So, give us a chance, help us as much as you possibly can, and we'll get to the bottom of this, all right? There will be life without her, partner. I know it's hard to say right now and it's easy for me to say, but there will be life without her. And there will be good things from it. I'm Haley. Hi, I'm Detective Todd and this is Detective Richie. >> I don't want to speak to nobody without a lawyer. >> You don't want to speak to anybody without a lawyer? Okay. All right. You want You your water there? We'll just hang out for a little bit, all right? >> Okay. >> All right. >> I just have one question. Did she Is she fine? Is she okay? >> I'm not going to talk to you about the case. You already told me you don't want to talk about it, so >> want to make I just want to know that she's alive and okay. That's all I care about. I just know that it's safe on my behalf to ask for a lawyer before anything, just, you know, to have my back. >> Okay. >> I did not mean to hurt her like that. I swear to God I didn't. Just wanted her to leave. >> [snorts] >> Still, those are all spontaneous statements. Look, she has a right to self-incrimination. She invoked Miranda. And so, yeah, we're going to have to right to counsel, right? Part of your Sixth Amendment, that is. So, we're just going to have to wait until we build this case with all the evidence that we're gathering from the scene, from witness statements, and all the forensics, right? Go to the DA's office, present that case, and if we get a criminal filing for a murder charge or manslaughter, whatever the case may be, then yeah, she's going to have her day in court. >> I don't know what's going on with me. It's like I don't have no more emotions about it. I just don't I didn't expect THE GUN TO GO OFF. I don't know what to do. I just prayed that she'd be okay. Everything I got, I prayed. >> All right. Well, we'll uh >> So, when will I find out anything? When I go to like I don't know. >> Well, I can't talk to you about it because you asked for a lawyer, which is your right. I'm not So, I'm not saying this to be >> I see I see what you're saying. I see what you're saying. >> Yeah, I can't I can't get into you know, anything about it with you because of that. And that's your right. I'm not trying to be rude or, you know, mean or anything about it, but that's just kind of how where we're at with that, okay? >> Okay. >> So, >> And when can I call like I know my dad said he was going to get a hold of an attorney, like when do I get a call? >> As you can see, there is so many duties and responsibilities as it relates to the scene of a murder, okay? A couple of things that you don't want to happen is to contaminate the scene and preserve as much evidence as possible.
