She tried to do it, and then you started acting up again. We asked you to leave. You came back two, three times. Your whole mess would have been avoided if you would have just left the first time. Come back here, sleep for an hour, and go back out. But you weren't You Once you get canceled, you have no business here. >> think you understand how the [ __ ] they act. You don't understand how the [ __ ] they act, period. How who act? Under Federal Aviation Regulation 14 CFR Section 121.580, airlines have mandatory authority to refuse transport to passengers who appear intoxicated. This is not discretionary customer service. It is a federal safety requirement that supersedes any contract of carriage. Spirit Airlines properly exercised this authority and offered [laughter] accommodation by rebooking the subject on a later flight the same day. Once denied boarding, the subject's legal status changed. Under Florida Statute 810.08, trespass occurs when a person refuses to depart after warning by authorized personnel. The statute reads, "Whoever is warned by the owner or authorized person to depart and refuses to do so commits trespass. Both airline staff and police gave explicit warnings. Each refusal elevated the legal consequences. The subject argued that purchasing a ticket created an absolute right to board. This reflects a fundamental misunderstanding of contract law. A ticket is a contract for carriage. But that contract includes terms permitting denial of boarding for safety violations. Federal regulations make airline compliance with safety standards non-negotiable, regardless of payment. Officers demonstrated exceptional de-escalation. They spent over 10 minutes using verbal commands, explaining consequences, and offering opportunities to comply. This exceeds most department requirements and shows commitment to resolving the situation without physical intervention. When the subject photographed officers, they responded correctly by identifying themselves and permitting the recording. The First Amendment protects the right to photograph police in public spaces. As established in Glik versus Koniff, this right does not, however, override trespass law or excuse refusal of lawful commands. Under Graham versus Connor, use of force must be judged from the perspective of a reasonable officer at the scene, not with 20/20 hindsight. The Supreme Court established three factors: severity of the crime, immediate threat posed, and whether the suspect is actively resisting. Here, officers faced active resistance in a security-sensitive airport environment. After exhausting verbal options, officers properly escalated through the force continuum. Presence, verbal commands, physical escort techniques, and finally, takedown. Force was applied only after the subject actively pulled away and fought against control measures, constituting active resistance. No strikes, impact weapons, or punitive force were used. The response was proportional and controlled. Under Florida Statute 843.02, resisting arrest occurs when a person opposes an officer executing lawful duty. The statute distinguishes between resisting without violence, a misdemeanor, and resisting with violence, a felony. The subject committed both by refusing commands then actively fighting during a physical arrest. Florida Statute 784.07 makes battery on a law enforcement officer a third-degree felony. Any intentional physical contact during arrest satisfies this statute. Injury is not required, only touching against the officer's will. The subject's physical struggle with officers during arrest established this charge. Officers immediately requested fire rescue to evaluate injuries, demonstrating proper duty of care to arrestees. This protocol protects both the subject's welfare and creates documentation of his condition, which benefits all parties. Fort Lauderdale police officers receive a grade of A minus. They demonstrated exceptional professionalism and legal knowledge. Their extensive de-escalation efforts, proper force escalation, and respect for constitutional rights exceed standard requirements. The minor deduction reflects that earlier arrest might have been tactically justified in a high-security airport environment. The subject receives a grade of F. What should have been a 4-hour delay became multiple felony charges. Every charge was avoidable. At any point before physical arrest, voluntary compliance would have resulted in zero criminal consequences. Intoxication and grief over his sister's death may explain his behavior, but not excuse criminal conduct. Spirit Airlines staff receive a grade of A for proper exercise of federal safety authority and professional attempts at accommodation. Three critical lessons emerge from this case. First, purchasing a service does not create absolute rights when safety regulations apply. Second, comply first and contest later. The proper forum for disputing decisions is through complaint processes or courts, not at the scene. Third, understand escalation costs. Each refusal to comply increases legal stakes exponentially. In this case, a minor delay escalated to potential years in prison and a permanent felony record.
