This road race shooting lease officer stuck between two stories that do not match. >> He was following this guy for miles trying to like run him off the road and everything. All right, cool. And he went he grabbed a gun and that's when I fired. >> Pulled the firearm on him. He's pulled a firearm. He shot first. He shot last. >> Shots are fired after a road rage fight. Both drivers take off and cops have to figure out who shot who. Take a look. >> I got a black Dodge Ram right here by my shoulder. He's waving me now. >> Show me your hands. SHOW ME YOUR HANDS. Step away from the car. Hey. Hey. Hey. Where you going? Where you going? STOP MOVING. STOP MOVING. STOP MOVING. Get on the ground. Get on the ground. >> We got one at gunpoint in front of the melodian. Put your hands behind your back. >> Vehicle. I got one detained, dude. Stand up. >> What happened? >> Uh, okay. I just got off the phone, my friend. I didn't know what to do. So, these two guys were these guys were going crazy in the intersection. Some guy was doing I don't know what happened. >> Where did this happen at? >> Right here at this intersection. >> At the intersection. Left side, right side. >> Well, listen. Listen. Uh I was coming back from the gym and I was I was they were coming down for like two miles in front of us. They were going crazy road rage type thing. I don't know what the was going on with them but then they got they found the person shot 1376 Dres. I'm going there first. It happened in front of my truck and I started honking my horn for them cuz we're in the middle of the intersection there. >> Ask him he's got any other weapons. >> 100. the other Jeep took off and the guy that was that was being aggressive towards the other guy, the guy in the Jeep, uh, he started becoming aggressive towards me, following me around. He was following this guy for miles, trying to like run him off the road and everything, and he started doing the same thing with me. >> Where was someone shot at? >> Right here at this right here at this intersection, and he got he got in front of my truck, slammed on his brakes in front of my truck in the middle of the intersection. He approached my vehicle, and I I carry with me all the time. I was in the middle. >> Where is your gun now? >> It's in the It's in the truck. Hold the phone for a second cuz you just heard one side of the story, right? So, we don't know if he's the victim or the suspect, right? And here's the deal, and I say this a lot on my other channel. When you call 911, you're either the PR, the person reporting, or the RP, the reporting party. Or you can call 911 and be the suspect, and you can definitely call and be the uh victim. Right? So, when you have a road race type of incident, been there and done that where we investigate, someone's got to call 911 and it certainly wasn't him because it seems as though again he might be the suspect, right? Uh he's got a gun and it looks like it got to the point where there was some shots fired. Trying to figure out now we have information and knowledge to know that the other party is at another location. So, let's find out to see what happens, man. Because we got one story, we need to hear the other story. drive. >> All right, sir. My name is Matt. I'm a police officer as well as a paramedic. I'm going to take a look at you. Okay. Where are you shot? My arm. I don't know. I can't find. I think it's going to be his arm. Hand me a tourniquet, John. I was in the military. I carry on me for protection for [ __ ] like this. He came at me. He came out my truck. I pointed it at him like, "Dude, go away. I saw what you were doing. Go away. I will shoot you." He's like, "Oh, you want to pull a gun on you? You want to pull a gun on He ran back to his uh his white SUV and he's like, "All right, cool." And then he went he grabbed a gun and that's when I fired. >> Okay. All right. Too easy. >> You're going to walk to my car right here. >> All right, sir. You're going to feel some pressure in your arm. It's going to hurt. Okay. >> Oh [ __ ] We got to get him somewhere fast. Like no blood. >> Got ATX right here. Mark, please. Hey, do me a favor. Tell him two tournaments applied to you. So we got a time to 12 minutes out. All you going to do, buddy, you going to just sit right here. Okay. >> Okay. Uh, multiple gun travel. >> Did I hit him? Did I hit him? Uh, >> I don't know, buddy. I've been here with you. Give me a minute. Gun. >> We got the gun in the bag along with the magazine. There was one round left in the chamber. And there's two uh showcase scenes here at least on the windshield. >> On the windshield. >> Yeah, he's passing over that floor right now. >> So, I imagine C's coming. So, >> so he was outside of the car. Lost more outside looked over. >> Yeah, there's nothing on that. >> Let me stop right there to uh kind of let you know that I don't know what C stands for uh critical incident division or criminal investigation division. You you got detectives rolling out. Now, the good thing about working patrol is at times you're the initial investigator. So, the more investigating that you do makes it much smoother and better for the detectives to do their follow-up investigation, right? So, as you can see, we're going to canvas the area. We're going to try to get as many witness as possible. We're going to tape off uh what I always like to say, the inner perimeter and an outer perimeter. Uh yeah, that you're at a scene of um I suppose aggravated assault attempt 18 attempt murder. we call 187 cuz here in the state of California, murder penal code is 187. Okay. So, I apologize for that. But what all that being said, there's a lot of investigating that we have to do. >> Did he say he was shooting from inside the vehicle? >> I didn't I didn't dig too deep. >> Oh, I got you. >> How many you got? Two. >> I got one round and then two casings right here. >> Yeah. Okay. Two casings. >> How many does that gun hold? >> 10 round capacity plus one in the chamber. So, we're looking at it for 11. We got two there. One >> 10 to 11. Yeah. >> We can get off the road though and open this up. I guess >> we can get him off the road. Leave that car right there by the truck that got shot. >> Yeah. Yeah. >> Cuz I was there when it >> I saw it. Get his >> Is he all right? >> As far as I know, he's all right. >> Cuz I don't see how >> he's got two tourniquets in place. A chest seal decrease on the left. >> I was behind that vehicle. I don't know. >> Behind this one? >> Yeah. Real close to it. And I heard >> Do you know which way >> he was headed? >> Yeah. What? What? Which way was he head? Was he on North Drew or P Street? >> North Drew. I think >> might been four shots to his windshield. >> Okay. To his windshield? >> Yeah. >> So, >> his windshield was shot up. >> You guys find a gun to >> No, those are all his clothes. Everything has been cut off. Now, we have not done a detailed search of the car. >> Take a ride on the beach. And that's when I heard bang bang bang bang like four or five shots and you know everybody was ducking. There was guys on the sidewalk. >> What vehicle did it come from? >> Did it go in or out? I don't know. >> Oh, you Oh, you don't even know which who shot where. >> No, I just heard the band. >> They stopped in traffic or they stopped. >> They stopped at the red light. That red light SUV stopped at the red light >> and the SUV was in front of the truck. >> SUV was in front of the truck. So then the guy get out the truck and he just like he didn't go around. He just stayed with where it was open. He kind of had his gun and just started shooting at the SUV. >> So he was sitting in the truck. >> No, he was out of the truck. >> He was out of the truck. >> He was out truck standing. Shoot. >> Okay. Did you see anything that led up to this? >> I didn't see nothing. >> So I can't tell you if there road rage or nothing. I was just surprised like he was trying to shoot back or nothing. He I don't even know if it was a he or she to be honest with you. I don't even know who was driving. >> Was you on the driver's side or the passenger side? >> I was on the passenger side. >> He was on the passenger side. >> Yeah. Okay. >> Those look like entrance. >> Those are kind of hard to tell. >> I got one more. >> He's bleeding all over the place. >> So, I actually followed the vehicle. >> This one? >> Yes. Down this street. It took off and went to a parking lot. empty one on the right somewhere down here next >> and then >> like this parking lot >> like pulled in here to the right. >> Yeah, maybe that's the one it was. And then I just kept going and I turned around and then the driver door was open when I came back around. There hasn't >> So basically he would have gone right into this dentist office parking lot and then come back out onto LJ and >> No, it was parked inside there like it was stopped. >> It's kind of hard sometimes. How many gunshots you think you heard? I think I heard about four or five. >> Uhhuh. >> But I only But when looking at his windshield, I only saw like three may maybe four. I'm going to say three. Three holes in his windshield. And I'm sitting there thinking this is he had to got hit. He had to got shot. It's cuz he was >> So the truck was behind the SUV. >> Yes. >> But there was holes in the SUV's front windshield. >> Yes. Cuz the truck was shooting at the SUV. >> Okay. got the story. Uh it seems as though the driver of the truck, right, he seems to be the suspect. Hey, you're looking at a assault. You're looking at attempt murder, if you will, right? And you're looking at some serious violent criminal charges, uh for that matter. And before we go to that follow-up location with the other witness, you know, material witness right here, that's the person that you're going to have to get all the information, try to get a statement. And I know he's getting all his information and I understand it's probably on body warn video, but you want to lock him in on a statement, make him feel as comfortable as possible. Uh, and just say, "Sir, you know what? If you have time, can we go back to the station and, you know, really get a a really good statement, but we definitely need your cooperation and we appreciate it." >> From behind, from the back going through the front of the windshield. >> Yeah. >> Yeah. We're checking going to be transporting the gray head to the log. Oh. Did you hear anybody yelling or anything of that nature? >> I didn't hear nobody. Only thing I just noticed is a lady. She like she going to return. She was scared. She backed up and hit somebody else car. >> But I guess they didn't call police car >> 115 101. Do we have the the victim's vehicle down there? >> What kind of vehicle is it? And uh where are the bullet holes? >> The ones we see so far are going to be two in the glass in front. >> That uh matches up with the with the witness that we were saying. >> Whoa. Stop. You can't go this way. You see the crime scene tape? >> Huh? >> You can turn in there and turn around. Were you inside or outside of the vehicle when the >> I was inside. I'm not wearing shoes. I was just standing outside. And I figured if I got out of the car, I would have turned me into like an aggressor or whatever. So something happened. >> Okay. >> My thing was while he was shooting, I was praying to God. He didn't see. I got a witness. I got to take him out from cuz I'm where I'm where I was at. There was nowhere for me to run or nobody. >> No. Well, I mean obviously he wasn't trying to shoot at you. All he heard was gunshots and he looked up and he noticed that there was bullet holes in the back of this car. He then followed this car cuz he thought somebody got off inside of the car. So he was like, "Oh, they're going to dump the body somewhere." So he followed the car. >> He followed the car all the way up here and it turned into the parking lot here. >> And that's why the other guy that was here said that he that this car almost hit him because he came out of there and then turned back on to Dresd. >> You want You don't have to carry that around. >> No food in there. Nobody going to get it, is it? >> No. This Atlanta mic just >> I'm down to get that Big Mac, man. Look, what I will say is this just from experience because I've done some of these investigations where work patrol where uh it's a bit strange and kind of odd when you have a victim who decides to leave the scene and start rolling to another location. There's got to be a motive or intentions why he's leaving the scene, right? And we haven't found that out yet. Uh, but that's important to know because what you're going to do is call 911 immediately, especially if you've been shot, right? >> I don't think they're going to try. >> They wouldn't make it far, though. You're standing over here. >> I'm standing right there. >> Right there. >> Shoot me right here. >> That's how you can see the front windshield, everything. >> Okay, sir. >> Yeah, buddy. >> I uh doing uh when you were going crazy when the other truck was involved, I have I started recording. >> You started recording on your phone? >> Yeah, I have on Snapchat. I don't remember if I deleted it or not, but I started recording on my phone. >> That'd be fantastic, man. >> Hey, Dad. >> Hey. So, was there really 12 people shot? >> I don't think so. Here, I have you on speaker phone with Officer Edwins. >> How you doing, Officer Edmond? >> Good. How are you, sir? >> Uh, would you mind coming with me to police headquarters and hanging out and we'll wait with a detective there. Probably a whole lot more comfortable for you. >> Whatever you guys need to get this, >> you don't mind? >> Yeah, whatever you need. >> All right. Right on. Appreciate you, buddy. Are you Have you talked to the guy in the black pickup truck that probably shot that guy? >> I haven't talked to him. I'm on the other scene. I'm on the scene with the white vehicle. >> Okay. Because if the guy in the white truck got shot, I mean, I'm not saying anybody deserves to be shot, but that guy deserve to be shot. If he's still alive, he's lucky to be alive, okay? Cuz he was a maniac. He almost killed people driving up Peach tree the wrong way. >> Okay. >> He was pursuing the other vehicles. He was following the truck. He >> The truck was trying to get away from him. The truck he this white uh it was like, if I remember it was like a white 4ERunner or something like that. >> Yeah, that's correct. >> And it was a a white guy in it. And uh he was coming up the wrong way right there between Drew Hills and Dresden. And he was on the wrong side of the road. Almost hit five or six cars uh trying to get back over on the right side of the road to go after the black pickup truck. The back pickup truck was down in the martyr parking lot. Well, when the white 4ERunner stopped, it was between uh Dresden and where you turned in to go to the martyr station cuz he had kind of and that's when I noticed the black pickup truck cuz I could tell that that's what he was looking at. And the guy in the pickup truck was just trying to get away from him. >> All right, Jeff, you want to put your shoes on? >> You ain't going to be able to slide these on, are you? All right, cool. It's been Orlando. >> Well, the guy stopped on Peach Tree in the middle lane like at a 45° angle waiting and watching to see what that black truck did. And I guess when the black truck took off, he shot down Dresden Road and went after it. So, the guy shot him. I mean, I would say he shot him in self-defense, you know. >> Okay, good witness. Now, you [snorts] have self-defense as it relates to the criminal actions of the uh driver from the black truck. I get that part, but still uh we need to find out why is it that the victim uh that got shot uh actually took off and ended up at another location. That's kind of important too. And by the way, this particular incident, right, they haven't read him his Miranda rightites, which is great. You know what? Look, what I will say is this, like I say in my other channel, is when you have custody plus interrogation equals Miranda. Okay, remember that. But for whatever reason, uh there's a lot of these uh law enforcement agencies where they practice uh mirandizing at scene of a traffic stop or or any other service call, which is fine. It's a good practice. I get that. It might be policy by the department, but now you're talking about aggravated assault, attempt murder. Leave it up to the experienced detectives to get that confession, right? to go ahead and sit them down, make them feel comfortable and see if they wave Miranda and they want to talk. So, >> get your work done, bro. >> Uh, my best friend was a shot, so >> Oh, for real? >> Work. You might as well get it. >> It's pretty sick. You going to make a left, man? >> I mean, he was driving like a maniac. I mean, and I did see the guy cuz he stopped when he stopped right there. He wasn't like right beside me. He was all the way over to the right. And I was in the turning lane and I could just kind of tell that this guy had like, you know, lost touch with reality or something, you know. >> Well, when the the light turned green, it was weird because the world started shifting, you know, and he ended up in my me, this is what started everything, honed him off >> and then started and then mind at me. And um what that's what initially started. >> No, I no. >> I shouldn't have investigated. >> So wait, so you don't know what kind of car that was? >> Um I know the guy was in a black truck. >> Traffic got started to go and then he got uh he didn't go. He didn't go. He just stopped right there in front of my truck like he did like he was doing to the other guy. And I started honking my horn and he got out of his vehicle. That's when he got out of my vehicle. uh some I don't know what it looked like could have been like Hispanic guy, Asian guy had his hood on, started making his way he left his door open, started making his way to my to to my truck. >> And where were you at this time? >> I was in my truck. I was uh >> still sitting in the driver seat. >> Still sitting in the driver's seat. My window was already rolled down. My I usually keep my pistol holstered inside of my my small pocket in my bag. >> What kind of gun is it? >> Uh it's a Ruger 9 mm. Um it's a security 9. I pulled it out and then I unholstered it. I pointed it with my left hand out the driver's side door and I rested my hand on the on the the mirror and I started yelling. I was like, "Dude, you need to stop. I'll kill you. I'll shoot you." >> Did he have did he have a weapon or anything? >> I didn't know what he had on him, but I wasn't going to shoot him. I wasn't going to do anything. But then he was like, "Oh, okay. You want to pull a gun on me? You want to pull a gun on me?" And he started walking backwards to his truck. And then he didn't like he didn't get in, but he leaned in and like started reaching for something. He pulled out something and that's when I fired and then I took off. >> He had his door open. Driver's side door was open. He was in a shooting stance and he was right where the driver's side mirror is just like this. I didn't expect that. >> This was the black truck behind him. >> This was the Yeah, my door was already open towards him. So, there's nowhere for me to hide. I could see the bullets coming through the back of my 4Runner. One, two. I can still see it just coming through on the left side. And as it came through the I think the fourth fifth shot it hit this one where like you could see the blood squirting out of me and then more shots proceeded miss and then it hit the other side. >> You at this point you didn't you didn't know if he had a gun on him or not. I >> I swear I saw a gun. He he reached back into his car >> after he went in the car. >> Yeah. Like he he leaned he didn't get into his car but he leaned in there and I don't know if he put out his his waist or something like that but I saw him grab something. He was messing with something and that's when I fired. >> You didn't know if it was a You couldn't describe You can't describe what it was? >> I I looked like I saw a gun. >> I had a I I had a scenario where I either call 911 or call my daughter and say goodbye. I was bleeding very bad. I I went up a couple blocks, I don't know, four, five, six blocks. But as I went now, I'm past where he is. I uh I was thinking if I call 911 and I die right here, I it's going to take them days or weeks to find out cuz nobody's in Atlanta. >> Mhm. >> They're all in Arizona and Texas. Yeah. >> Did he make any threats to you other than, oh, you going to pull a gun on me? >> Yeah. He's like He's like, "You going to pull a gun on me? All right, I got you." >> That's what he said. >> But he never said, "I got you, you know, I'll shoot your I'm kill you or anything like that." And this is I'm asking you these questions because this this is important. We just need to see, you know, exactly what was said. I do know for a fact that you did tell him like, "Get away from my car, back. I'll shoot you." Yeah, that's I'll shoot you, dude. >> And at what made you feel threatened just him walking up to your car at that point? >> Well, yeah. That and like what he he was harassing that guy for miles. He kept trying he got out multiple times trying to do whatever to that guy >> and then he's tried to do it to me. >> Got you. And I I don't know who he is, what he's capable of, what he's going through at that point in time in his day or whatever. >> I was going to take a chance. >> You felt you felt threatened. >> Yeah, I felt threatened. Like that guy could come up and I didn't want to fight anybody in the middle of the intersection, you know? I wasn't going to get out and like go through all that. >> So, I was like, I I got to protect myself somehow. >> Yeah. >> Okay. So far, you have conflicting stories right now. Did he act in self-defense? That's definitely a big big question. And then for the victim, how come you didn't then call 911 right after you got shot? Right? That's what the reasonable, prudent person would do is call 911. Now, with all that being said, here's where I need your help. Uh, let's all look at the criminal statute in the state of Georgia, right? Brook Haven, Georgia. I think it's the Cole County or one of those counties, but let's just say the state of Georgia. And we need to find out what are the elements of an aggravated assault or attempt murder. My thinking it's attempt murder. You tell me what you think. >> Listen to me. Listen, I'm not taking sides. I respect your authority, but Okay, let's put it Let's put it on the other situation. I shot you on a road rage. Okay. 10 times I shot you. No matter what happened, I did. I never pulled the firearm on him. >> He's pulled a firearm. He shot first. He shot last. >> I got I hear you, man. I hear because he's white. Because he's >> Listen to me. You're white, too. >> No. No, sir. Listen to me. >> You automatically >> Let me stop right there. Look, here's the way this goes down. I don't mean to sound dismissive, but what I will say is I don't need to be hearing this story. Look, just for future reference and been a cop for 25 years, you're not going to get anything out of sharing your frustrations uh with the cop about this case. You know what? Take it up with your attorney and and go to court, argue before the judge, and that's exactly what you're going to do. You're going to testify. You're going to have your day in court. But the fact that you're trying to make it a race issue, the fact that you're frustrated with, you know, maybe lesser of a charge, you're thinking that, hey, we should have charged you with attempt murder or something along those lines. I get all that, but there's no need for this Q&A volley that you have going on with the officers. That's just my opinion. >> Will you let me talk? >> I don't want to talk to you. >> That's fine. >> You try. >> He was here first. That's the only reason I said for you to wait outside. You started the words with him >> and then you start to pass up. I know. recognize him, right? Threatening, not >> you started to pass your phone off to whoever is with you, your mom or whoever it is, I don't know. Okay. But we're not going to have anything happen. And and what sounded like to me was almost an idle threat that you're going to take care of him. >> What was threat? >> This is why you're not going to jail. You were careful with what you said. >> Oh my god. Let me talk to the officer. >> It almost sounds like an idol threat when you said you're on a mission and you're going to take care of this. Okay. >> Listen. Hold on. very careful. Do not lie with the words. I was very careful. >> This is why I'm not putting you in jail. So, what needs to happen is let bygones be bygones. Let the courts handle the process. >> But you'll you'll wait with her. I don't know who this is to your mom or not. Wait with her until he's done inside here. >> They're charging him with He almost took my life. What if it was happening again? >> I'm not investigating the case and I was not there. I wasn't there either, Duck. And neither was the officer. I don't mean to sound dismissive like I just said, but enough is enough. you know, you're you're taking it to another level, kind of being a little disrespectful. Your mom is there. You're better off just going home and you know what? Let the criminal proceedings take care of it all. >> He shot 10 times. >> And thankfully, listen, you could have died and I'm thankful the officer saved your life. >> Him. They saved. He was trying to kill me. >> Correct. Correct. Now, let justice be handled and you don't take anything into your hands. We don't want there to be any other altercation. I understand that you're upset, but I don't think you're in a position medically that you need to be in this elevated state. So, hang tight with your mom in a car. We'll come get you when when when it's it's safe, right? >> It is a mere coincidence. >> I was very careful with my wife. >> He came to get his stuff just like you. All right. >> Just hang out in your car. Once we get him out of here, we'll get you stuffed to you with a release form. >> Can I talk to them? Mom, >> okay. I talked to you when you texted Maldonado and he even he even appraised me. He even praised me because I saw him go into the >> That doesn't have any bearing on anything today. I understand you're upset, but we can't have a situation. We can't have a situation just unfold in our in our lobby. That can't >> How I look at the situation with ours is that I try to let the legal system do its thing and now it looks like he's getting released. >> He's going to get a light that's got nothing to do with us. It's got everything. >> I thought I did the right thing by just driving away, calling 911 instead. >> I thought about it and I thought really hard about it. I drove away. I talked to Detective 911. That's why I came here to see him. Also, I want to hang Let's hang out in your car. Once we get him out of here, we'll we'll get you. >> I already moved him to the front of the line >> as a human being. >> So, he'll get out of here. >> I reacted. He didn't expect me to walk out of the hospital in a couple days. >> I'm glad you're okay. >> I had those 10 seconds, sir, to think about what to do. I was bleeding with that. Should I go get this guy? I'll probably never see him again on it. Or should I call the police? I thought, you know what I did before calling 911, sir? I called my daughter. >> I called my daughter. That's why I went and I I thought about it. I drove a while and I was like, "God damn it. Let me call my daughter." I talked to her on FaceTime and then it's all on my phone record and then I called 911 and I almost bled out. >> Not to dismiss and and I empathize, but you got to take some accountability. All right. You're the one who started the road rage. The other guy just decided to kind of take it to a whole another lever and shoot you. Okay, that that's what we got going on right here. So, let's not excuse the fact that your behavior kind of you kind of created uh the exigency, if you will, right? to the point where, you know, the other guy, according to him, he's self-defense. Maybe his story, I don't know, he said he saw something. And again, that's all going to be flushed out, talked about with specificity when you get to court. >> All right. Here's the thing. You can't actually leave, >> okay? Because you have a warrant for your arrest. >> Really? >> Yeah. >> Okay. >> All right. That's a felon in possession of a firearm. >> Okay. >> Okay. >> I expected it. I'm I'm completely okay with putting the handcuffs in the crime. Um, >> you know, I think they told you you had the charges coming. >> Well, well, here here's the thing. Detective M, that's why I wanted to speak with him cuz he actually told me in the ICU and uh he actually committed me for not using the weapon, so it would have been worse. >> Um, >> agreed. >> Now, I I've been in one trouble in my whole life. I was uh 19 years old. Never before that. Yeah, that was what happened with that. So, I expected this, but it was going to be used and just in case my life was at stake. Even though my life was still at stake, I still didn't use it. So, I'm okay with talking to the judge about that. That's part of his fine. >> Is this your brother or >> this is my cousin? Uh, but I do have medication cuz I'm just he has your medication in the car. >> Go get it. Uh, CVS um and bring it to me because I'm not even supposed to be out of hospital right now. If I'm in a cell, >> do you have a do you know what your medication is? Do you have the script? Cuz the jail has medication. They have a clinic. They have >> It's really uh serious medication. Like uh like >> I mean it's it's they have doctors and a clinic and everything at the jail. >> Yeah. >> Just set your stuff in your pocket. >> Okay. But then you got to pack it up. >> You can drop it on the floor if you want. That's fine. >> Here. I'm I'm going to handcuff you in the front, man. Okay. >> Do you remember anything that >> All right. Here. Just put your hands together in the front. Okay. Excruciating pain right now. >> I got you. So I'm not that. Look at me. This is why I'm handcuffing you in the front. This is not normal to you before. >> I knew this was going to happen. That's why I wanted to see the detective before all this happened. >> I turned red guys and I had a firearm in my brother so mad. >> I had my my phone was right underneath me. I got out of the vehicle. I took one or two steps. >> Yeah. I'm going to stop right here cuz this is the part uh if I was his uh criminal defense attorney representing Duck, stop it. Let's just not talk. Uh it's over and done with the uh you're a prohibited processor of a firearm. That's what you are. That doesn't require any specific intent, if you will. And if we're going to keep talking about this road rage incident, you have to talk about it from the beginning. Meaning that you got to take some accountability for your actions. >> He had the door open. He had gun. I'll never forget this cuz it's so traumatic. He had his gun on top of the driver's side mirror pointing at me and he was like, "Get back in your car right now." And I saw a car and he said that I started stepping towards him so he fired and that's a complete >> All right, guys. >> Sorry, man. Guys, I just been shot up and appreciate. Sorry for keeping you guys. >> Let's get this char on the road with >> bullets. He'll tell you, buddy. >> No, we didn't shoot him. >> No, we're not. >> All right. Don't forget to buckle up. >> Seat belt. >> With bullets. Yeah. >> Not our bullets. >> About to say all the [ __ ] >> You're a lucky man. >> I don't like good. >> Yeah, he do. But >> I don't like guns. >> When he say does he have an attorney? You know what he said? >> He got a good one. Won't let go. >> All right, let's go. Come on. Hold on. Make sure everybody look. >> This extended stay here was not our fault. And I'm sorry. I'm going home now. There you go. >> There you go. Okay, let's go ahead and wrap this case up. Uh, final thoughts. Uh, first and foremost, big shout out to Brook Haven PD for conducting a very thorough investigation. Like I always like to say, my mantra is no stone goes unturned, okay? Uh, gather witnesses, were able to locate both the victim and the suspect. You know, this is one of those incidents, and I appreciate this one, where you get these conflicting stories. Uh, and this is the biggest lesson of them all, is when you have these conflicting narratives, right, from the victim. Well, hold on a second. Maybe/suspect. I don't know. You got the PR, the person reporting, who's calling 911. And this all stems from a road rage. Okay, that's the biggest lesson of them all. We got to do better when we have our frustrations just get to a level to where we got to get out of the car and just start popping off on people. You know what? Learn to control your temper because these road rage incidents can have criminal consequences. Okay? Please be safe out there. Duck was charged with possession of a firearm by a convicted felon and sentenced to 15 months of probation. Now Joshua, he was charged with aggravated assault, possession of a firearm during the commission of a felony, aggravated assault, and possession of a firearm by a convicted felon or first offender probationer. However, there is currently no official sentencing information available for either individual. Okay, so let's go ahead and click that like button and that notification bell.
