I WOULD LIKE MY LIKE MY ON MARCH 19TH, 2024, Tampa Airport Police responded to an intoxicated passenger refusing to deplane after being ordered by flight crew. Before officers arrived, off-duty Philadelphia police officers, acting as passengers, physically restrained the suspect. This incident raises critical questions about Federal Aviation Authority citizens arrest powers and the legal consequences of interfering with flight operations. Under Title 49, United States Code Section 46,504, interfering with flight crew members is a federal offense carrying up to 20 years imprisonment. The statute applies when someone on an aircraft assaults or intimidates crew members, interfering with their duties or lessening their ability to perform [laughter] those duties. Additionally, 14 Code of Federal Regulations Section 121 .580 prohibits any person from assaulting, threatening, or intimidating crew members in performance of their duties. Here, the suspect yelled, cursed, confronted passengers, and refused multiple orders to deplane, clear interference with crew duties under federal law. Flight crews have absolute authority to remove passengers who threaten safety or security, regardless of the passenger's race or other protected characteristics. The crew followed proper escalation, multiple verbal requests, captain notification, supervisor intervention, then physical removal. Thank you for coming. Well, police are here, so just com- comply or work out, all right, my man? As long as you get a lawyer for me. I Yo. Yo. That would be illegal, so it's legal. Are you standing up? I want a lawyer. I'm just Okay. So, innocent Innocents don't mess with us. All right, you got Jesus says that. Don't mess with innocents. You have a California No, I'm talking. California license plate? Uh what driver's license do you But, I have a what? And what? What? I Yeah, good for you. You're You're a fan of me. I see it. You're You're a fan of me. So, you have a California driver's license, but your address is on this card. >> It is in Florida. It is in Florida. It is in Florida. But, you have a California driver's license. That's right, and I'm also a USA naturalized citizen. So, do you live in >> And will you add that part? Will you Will you add that part? Will you say? >> live in California or do you No, no, no. The address The address says Florida on it. Read it right. Read it right. Read it the right way. Well, I just want to see if you were violating Florida state No, no, I'm saying I got Hit. I got I got hit by one of those. I got hit by one of those one of those Okay. air air gas of the airplane. I'll tell you that much. Want to check his socks. Want to check his feet first. Make sure there's nothing in his socks. Move forward. Kick your shoes off. Kick your shoes off. >> Yeah, I will if you let it go. Bend your leg back. What? Bend this leg back. Hi. Hi. Can we get stuff off? Do you want to step off? No, no, no. It doesn't matter. So, what what exactly happened? So, we were standing here boarding. We started to yelling down the jet bridge. We can't step off once we have passengers on. Um So, people were like, "Hey, that guy's screaming back there. He's yelling curse words." He's yelling something crazy, blah, blah, blah. He comes on angry. We don't We don't know who this person is. Um they are in lockdown. You can call them. Um He got on. He started talking to her, getting in her face, pointing at her, just like, "You guys What do you say you're so disrespectful?" And I said, "What?" I go, "What is he talking about?" I never figured out who he is. Yeah. That's always the problem. They treat me differently. They look at me. People with skin like you. Your kind of skin. Then he goes, "Look at the skin and your skin." What did you tell him? Because you're always It's always you that Look at me like, "You this and you that." And then he he turned the corner and goes, and they tell me they just assume this is my father. And so, I didn't think the guy was with him. The guy that's supposedly his father. And he walked away from his dad and just feeling like that. It was the weirdest thing. Okay. We can find out. So, now passengers are coming over after him going he's not well. Something's wrong with him. Yeah. I don't know how he got past the gate. Under Florida statute section 901.15, private citizens have authority to arrest when a breach of peace is committed in their presence. The off-duty officers witnessed disorderly conduct, trespass after the suspect refused to leave the aircraft, and potentially battery if physical contact with crew occurred. Their use of force must meet the reasonableness standard established in Graham versus Connor, judged from the perspective of a reasonable person on the scene. They restrained the suspect without apparent injury and held him until proper authorities arrived. This appears to satisfy the reasonable force required. However, citizen's arrests carry significant risk. Even when legally justified, private citizens lack qualified immunity and face potential civil liability if force is deemed excessive. Under Florida statute section 810.08, trespass in a conveyance occurs when someone remains after being ordered to depart by an authorized person. Flight crew as agents of the airline had clear authority to order the suspect off the aircraft. His refusal made him a trespasser. The suspect's claim through his father that he was hit first is legally irrelevant. He had no right to remain on the aircraft after crew orders. Any force used to remove him was privileged as part of a lawful citizen's arrest of a trespasser, not an assault requiring self-defense. He was causing a ruckus over here, right? Yeah, he made it all the way back there screaming and yelling. And then I was like, "All right, I'm going to go ask him to get off." Um I got back there and he was already stuff off. Once I got back there, people were already starting to board. The whole time he was Was he getting into a seat? He was yelling and cursing? What's your phone number? So, basically, from what you two said, you got alerted before boarding. People were boarding saying, "Hey, there's a guy back there." >> We could hear screaming. We just didn't know who it And it was in the jet It was in the jet And then he came up here. He started like it was her. Started with her. But, then continued down the aisle. >> Yeah. And as you were going >> Okay. And when you followed, what happened? I followed. I asked him to get off. He said no. I asked him probably three or four times. And then at that point I was like, "Okay, I need some help." So, I went and got her. Okay. And then And then that was basically it. Pretty much it until other people started getting involved. So, then how did he get off? The other passengers They They posted other passengers off the plane. So, how do you know him? He's my son. Okay. Do you know what was going on with him? Do you know why he was so angry? I have no idea when we entered. Were you on the plane with him or not? I was together. Okay. >> All the way. So, can you can you tell me what happened? Just when we entered when we went inside, someone on the back told somebody something. They talked about it. And then maybe he got to say Talked about what? How can I say? Maybe Maybe something related to racism or something. Oh. Directed toward him? Something like that he must have heard about it, and then he just got into argument. Okay. And then he went inside, and then again he got into argument with somebody on the same issue, and then Were you with him when this happened? All All the time. Okay. He had a few drinks. Okay. All right. Any idea Has this happened before? Never. Never? Okay. This happened one time? This is the first time. Okay. Well, he is being arrested right now for battery cuz he did strike somebody on here. Um they're taking his stuff off the plane. They're going to put it in baggage here, okay, at the airport here. So, when he gets out of jail, he can come get his stuff at the baggage office if it's open. Because I understand this is an international flight. Is that right? >> Yeah. Okay. We have a connecting flight in the All right. Do you have a driver's license? Thank you. Um thank you for clearing that up. It's It's good to know a little bit more to the story. >> Yeah, but he didn't uh you know, he didn't hit the person first. The person actually pushed him [laughter] first. Well, they asked him to leave. They asked him to leave numerous times on the plane. >> They did that, okay. Cuz he was yelling and screaming. And he didn't want to leave. And they asked the captain and the gentleman on the jet bridge went on and asked him to leave as well. He wouldn't leave, so they had to escort him off. And that's when it got physical. >> Yeah. I got passenger hitting first, so that's why I think that part was worse. No, no, no. His just his bags, I believe. Oh, so my bag uh Are you still flying? I I have to at least see what happens to him. He's going to Orient Road Jail. He's going to jail. He's going to Orient Road Jail. And uh you can try to post bond for him there. You can try to bail him out, post bond at the Orient Road Jail. You can call a bondsman. Bail bondsman, you know how that works? Do you know how that works? How bail bondsman? He's going to go to jail. He has to bond out of jail if he wants to get out. Um somebody has to pay money to make sure that he goes to court in the future to get him released from jail. And if he doesn't post bond, there's what they call it, then he stays in jail. It's up to you. He can post bond himself. He has a probably a wallet, cell phone with him. He can post his own bond, or you can do it for him. So. You need a shoe. You can put that shoe on. Put your sock in his pocket. Shoe back on. Bend this leg back. Put your other shoe back on. Just put it in your pocket. Uh we made sure that he was going on off. Yep. Get that ticket back to me. I I had a flight at 10:00. Get on the car. Turn around. You got to go through this. Watch your head. Watch out. Watch out. Let me call Gina. I don't even know. The suspect was charged with battery under Florida statute section 784.03, which requires intentionally touching or striking another person against their will. He was also charged with disorderly intoxication under Florida statute section 856.011, which has three elements. First, the person must be intoxicated. The suspect had been drinking at an airport bar. Second, they must endanger safety or property or cause a public disturbance. His yelling, cursing, refusing crew orders, and physical confrontation clearly establish endangerment and public disturbance. Third, this must occur in a public place. Airports and aircraft are public places under Florida law, making all elements satisfied. The suspect immediately invoked his right to an attorney upon police contact, stating, "I want my public defender right now." Under Miranda versus Arizona, suspects must be advised of their rights before custodial interrogation. However, officers were not questioning him about the offense. They were conducting a search incident to arrest, which is lawful under the Fourth Amendment without any Miranda warning required. The search incident to arrest doctrine allows officers to search an arrestee's person for weapons and evidence without a warrant. Officers checked the suspect's shoes, socks, and person, all proper under this exception to the warrant requirement. The suspect attempted to claim racial discrimination, stating crew members treated him differently based on skin color. However, all witness accounts indicate his removal was based solely on conduct. Yelling, cursing, confronting passengers, and refusing lawful orders. Courts consistently uphold crew removals of passengers when based on behavior rather than protected characteristics under civil rights law. Federal aviation security is a compelling government interest that justifies crew authority to remove disruptive passengers regardless of race, religion, or national origin. The suspect receives a grade of F for comprehensive failure to comply with federal aviation regulations and state law. He consumed alcohol before his flight, created multiple disturbances, refused lawful crew orders repeatedly, and engaged in physical confrontation. His conduct delayed an international flight, endangered aviation security, and demonstrated complete disregard for crew authority. The off-duty Philadelphia officers receive a grade of B plus. They had legal authority under Florida's citizens arrest statute. They used reasonable force, achieved control without apparent injury, and maintained restraint until proper authorities arrived. The minor deduction reflects the inherent risks of citizens arrests and incomplete information about every moment of the physical confrontation. Tampa airport police officers receive a grade of A minus for exemplary professionalism in a complex aviation security incident. They conducted comprehensive investigation, interviewed all parties, maintained constitutional compliance, and showed compassion toward the suspect's father. The minor deduction is based solely on the absence of a visible Miranda warning before transport, which is best practice even when not legally required. Flight crew receive a grade of B plus for proper exercise of federal authority and appropriate escalation procedures. They made multiple verbal requests, involved the captain and supervisor, and only resorted to physical removal after all verbal attempts failed. The grade reflects limited direct information [laughter] about their specific actions and unknown de-escalation efforts. Key lessons from this case. First, flight crews have absolute federal authority to remove passengers who threaten safety, backed by criminal penalties up to 20 years. Second, consuming alcohol before flying requires extra responsibility. Intoxication combined with disruptive behavior leads to criminal charges. Third, citizens arrests are legally permitted but carry significant risk. Even trained law enforcement acting as citizens face potential liability. Fourth, claims of discrimination must be based on actual discriminatory conduct, not used to excuse violations of safety regulations. Finally, refusal to comply with crew instructions transforms a minor incident into federal criminal exposure and permanent consequences. This case demonstrates how quickly poor decisions in aviation environments escalate into serious legal consequences with lasting impact on travel privileges and criminal records.
