For what? FOR WHAT? WHAT AM I GOING TO JAIL FOR? Let me go. I have my American right. What am I going to jail for? What am I going to jail? >> So, when are you uh This is the third because I saw it. Yeah. Hey guys. >> Hey buddy. Do you have a tab here? >> Yeah, I know. Okay. All right. So, we already talked to you about this. All we have to do is leave. Don't go back. Come back. Yeah. No, I'm not coming back. I was on there. Whatever. It's not apparently so. one of the girls on their shoulders earlier first time on top. Can we get somebody? >> I already told her. I don't know where she's over there. to make sure you know you're busy. Somebody starting three times three times. Whoever whoever the tab who's under the tab whoever it is coming. Um so somebody's working on the tab right here. Do you have this? >> Florida statute section 8 to 10.08 defines trespass as willfully remaining on premises after the owner or agent has warned you to leave. Officer Lopez served as that agent. The two-minute ultimatum with an explicit arrest warning constitutes lawful notice. The charge is legally supported. Florida statute section 877.03 disorderly conduct covers disruptive behavior that disturbs the peace of others. Staff issued repeated warnings before the officer arrived. The charge reflects conduct that preceded the body cam footage. Florida statute section 843.02 O2. Resisting without violence applies when a person opposes an officer in the lawful execution of a legal duty. The subject verbally refused handcuffing, then physically struggled. Both acts independently satisfy the elements of this charge. >> You're dumb. You're done. >> That's the truth though. >> I mean, don't you want more money? Your money is not as valuable as my other. >> Oh, I'm just making observations. Pretty smart. >> I mean, you guys thought it was done. >> You have two minutes. Listen, you have two minutes to get ready. And if you're not done, I'm taking you to jump. So you have 2 minutes. That's >> I don't care to use. >> That's ridiculous. >> Oh, you can't take time hack. Let's go. 2 minutes. >> Time hack. I love it. I love the time hack. It's so cute. He he say that he doesn't mean that but you know you guys know that we don't actually we have been Yeah. Heat. Heat. Heat. Heat. Heat. Heat. Heat. We do not Well, that's like nothing. I did nothing. >> FOR WHAT? FOR WHAT? WHAT AM I GOING TO JAIL FOR? Let me go. >> I HAVE MY American right. What am I going to jail for? What am I going to stop? >> Come on, let's go. >> Let's go. >> I want 105. What am I trespassing for? >> And gave you two minutes to get your stop and leave, but you wouldn't. All right. >> You said that you didn't care getting arrested, so here we are. Oh my. I didn't do anything, sir. I didn't do anything. >> Up against the car. >> Up against the car. Place your feet apart. I've done this before. My parents are bossing me. >> 70. Come on. Can I have another unit? >> I've done this before. I swear I'm >> I didn't do anything. I'm >> Don't move. >> I'm not prison. >> Don't move. >> I'm not the person you want to arrest, sir. >> Why is that? >> One wrong slang myself. One wrong word. One wrong way. That's right. >> There's a problem when another person is Hold on. Stop. Stop talking. When there's another guy trying to help you, he's trying to take you away out of the problem. And now you are telling him to step away, which that's why I stepped in. >> Okay. So now you are about to start a fight with another guy because he's trying to help you. >> I'm not fight. And I gave you instructions >> to put your hands behind your back. You said no. >> Listen, I will listen. Please. >> We are beyond that line right now. >> We are. >> Please don't. >> I give you a chance. >> Please. >> Sorry. >> Do you have anything on you? >> Please don't. >> Do you have anything on you? Anything sharp? Anything illegal that I should know? >> I don't. >> You don't? >> Please. Please. >> Step back. >> Understood. Do you have any property here that I need to that I need to grab? >> I can't do anything. >> I'm asking you a question. Is there any property that I need to collect for you >> and the property? >> What do you have? >> Nothing. >> Nothing. Okay. >> All right. Let's go this way. >> Please. >> Right here. Up against the car. up against the car. >> Sir, please stop. Please, please, please, please, please, sir. Please. All I said was one word. Please please don't >> get in. >> Look at me. Please >> get in. Watch your head. Now put your legs inside. Put your legs inside. >> I don't deserve to be here, dude. Please. Please. Do you have her property, phone, wallet for her to take to the jail? >> She's drunk and she's an idiot and she shouldn't have done that. I was closing out our tap. I should have grabbed her and brought her out. I failed her. Listen, I I think you did the right thing trying to help, but then it was becoming either letting her bite you or >> please please >> or not doing anything. >> If we can help any >> Do you have her wallet or or phone? >> We're we're we're working on this. >> Sir, is there any way? >> There's nothing you can do for her. Do you have your ID with you? >> Yes. Yes. >> Okay. I need I need your ID. >> Mine? Yes. Can I ask why? >> Because she is getting arrested for trespassing. I had to intervene because she was about to get into a fight with you because again, you did nothing wrong. You were trying to help her. You did the right thing. You are involved in this crime. So, I need your identification so I can document that you were there. Obviously, that's going to be on camera, but I need it for my report. >> Sir, I love that woman. Is there any way we can just let her kill me and then she will be out of here? >> I did my best. I did. I did. >> You did, too. But here we are now. >> I didn't deserve this stupid. >> I have no clue what happened. >> I don't know either. Apparently, apparently I yelled at some guy and I got that. I >> love you so much. I did nothing. I have no shoes. Can you get me shoes? >> I'll get >> I had shoes. I had shoes right there. >> Can I give you one second? I did nothing. I yelled at a guy. That's all I did. I'm so sorry that I yelled at a guy. I'm so sorry. I'm so sorry. Another charge on my record. I'm so good. I'm sorry. I'm so sorry. >> I'll go talk to your boyfriend, but at this point, I don't think I don't think there's much I can't do. >> I'm so sorry. Sorry. I'm sorry. >> What's that? Okay. >> I love you. >> I love you so much. >> Please, sir. Please. I'm so sorry that I got caught up in this stupid [ __ ] I'm so sorry. My life. Oh my god. Please for the love of God. >> I don't understand how this goes. So they're not pressing charges as the staff has said. So, what I don't know the next steps forward for how I she's in jail, right? Listen, I told whoever she is to you, I told her she had 2 minutes to give her stuff and leave. Out of all the people that were doing the same thing, she was getting very confrontational with them. I'm like, 2 minutes, fair enough for her to get her stuff and go. 2 minutes went by. I don't know what happened to you because I remember you being Hold on, let me finish, please. You went somewhere. I don't know. You came back after the 2 minutes were up. Okay. So now you picked her up trying to take her away from the issue. The right thing. Cool. I was, you know what? I'm like, okay, this might work out. But then when you were close by the gate, now she is she's about to get physical with you. She told you leave. Let me go. Now you either go to jail for battery or kidnap him because you are holding somebody against her or his wheel, right? So or or what? I just stand there and not do anything. Is either she go I mean at that point she was going to jail for trespassing. But now I have this in front of me. You grabbing her trying to help. You can possibly go to jail for that. If somebody tells you, "Let me go and you let them go." I know that you are trying to do the right thing, but I'm doing the best I can to help you, too. This is not something that I wanted to do to begin with. I was just standing there watching them do their thing, letting people know, okay, you got to go, whoever. She was not even the person that they had the issue to begin with. The guy left peacefully. Very nice guy. And then your friend or girlfriend came around and this happened. >> This is out of my hands. >> Sir, I swear in sir, >> can you hear me? Can you hear me, sir? >> Okay, I'm sorry, but I swear I'm the sweetest soul, dude. I'm the [ __ ] sweetest soul. I cannot H God me my life like the boyfriend nearly earned a second arrest. Florida statute section 787.02 false imprisonment applies when a person restrains another against their will without lawful authority. When the subject said let me go his continued hold crossed that threshold. Officer Lopez's legal warning was accurate and it worked. Under Graham versus Connor 1,989 force is judged from the officer's perspective at the moment. The takedown response to active physical resistance was proportional. Under Atwater versus City of Lago Vista, 2001, a custodial arrest for a minor offense is constitutionally valid. The arrest survives fourth amendment review. Terry v. Ohio 1,968 required specific articulable facts for detention. here. A business complaint, observed behavior, and the subject's own on camera statement that she did not care about being arrested. Terry's threshold was met before the first handcuff was reached for. Officer Lopez receives an A minus. 16 minutes of deescalation before a single arrest. His post-arrest legal explanation to the boyfriend covering false imprisonment and battery exposure is the highlight of this footage. Gray dropped slightly. The 2-minute countdown began while the tab was still open. Defense will examine that timing. The subject receives a D. Staff warnings. A police warning with a countdown. 2 minutes to leave. She declined verbally. She resisted physically. Her own words. Another charge on my record indicate this is not a new pattern. The boyfriend receives a B minus. Right instinct, wrong method. Physically restraining someone who demands release creates criminal exposure regardless of intent. His immediate compliance and cooperation spared him an arrest. Three lessons. First, a trespass warning with a defined deadline is legally operative. The 2-minute ultimatum was not a courtesy. It was law. Once the window closed, the arrest was authorized. Second, saying, "I don't care when told you will be arrested," removes all ambiguity and goes on the record. It becomes part of the probable cause analysis. Do not make the prosecutor's case for them. Third, good intentions do not override false imprisonment law. In Florida, let me go means let them go. Physically restraining someone who invokes that right creates real criminal exposure immediately.
