to cream tonight. So, I had two there and then I had one there and then another guy bought me one. So, that would be four. >> You're not putting your shoes on. >> I didn't I just don't want to drive with them home unless you're going to take you. >> That's um so I just want you to take a deep breath and blow into the straw. Okay. >> Thank you. On September 10th, 2024, officers from the Benton County, Arkansas Sheriff's Office were dispatched to a Waterburger restaurant after being contacted by the drive-through staff in regards to a suspected drunk customer. Upon arrival, the officers approached 41-year-old Brook Lee Julian, who was sitting in her car in the parking lot. After having her exit her vehicle, the responding officers questioned her and later requested that she perform field sobriety exercises to prove she was capable of driving safely after her answers and actions left them suspicious of her abilities. >> I um I looked at her and I could actually smell the alcohol. So I was like, "Okay, how much she hasn't drank?" And she was like, "What? I I thought some like you did not I did not speak to you, ma'am." >> Okay. All righty. Well, I'll pull up here and check out that you're good. Thank you. 957 chicken vehicle. I'll be a waterburger with a silver BMW standby for the 28. Hello. How are you? >> Good. >> Hey. Um, >> I don't know what I want my order to be at Waterburger. >> Oh, okay. >> I got one of those like patty meal mushroom and Swiss. >> Mhm. I got you. >> Yeah. Why' they Why did they call them? They told me to park here. >> Oh, no. So, they were they were want me to check on you. They said that they you just kind of seemed a little off to make sure that you were okay. >> I just didn't I felt bad cuz my husband's on the phone from the Mississippi. He's the crew chief. And I was asking him I was like, I don't know what to get like at the water burger. >> Yeah. >> And then I don't know. Sometimes I get breakfast, sometimes I get dinner. And I usually I stayed with the bar staff >> all night at Bors Nest and then I came home. And so I called him. I was like, I don't know what to get. And I think that the people that I was with, they were like, >> "Okay, >> but I'm from here." So >> I mean, if you want me to get out, do whatever. >> Have you had anything to drink tonight? >> I had a couple drinks earlier at Boris Nest. Actually, no, not at the Boris Nest. At the um Creed concert. >> Oh, okay. You went to the Creed concert? two. Yeah, I had two. >> Okay. >> There. And then I went to Bors. That's like my family. That's where my mom went. >> I got you. >> She died. And then that's where I go. >> I got you. >> And then I was like, I'm going to go home, but I'm hungry. Like, I haven't ate anything. >> Yeah. >> So, I didn't know what to pick out. >> I got you. Well, hey, do you care to hop out and just do a couple tests for me? Just to make sure you're good to drive. Chip, >> are you going to see anything? >> Yeah. >> All right. Can if you want. What is like that sound? >> That's a alarm over here at one of these banks. See, I almost took a Uber from Strangers. I didn't work >> from Boris and I was like, "No, I'm good. >> I want to drive myself. I've got it with me. I got I take care of my dad, too. >> Where is it coming from? It's one of these banks over here. >> That's crazy. I'm going to find it. This is my mom's like wallet. So, >> do you have to use the concert? >> No, I used it at like Well, I mean, they don't need it there, but I always have it there. >> Do you want me to check for it while he's doing that? No, I can look for it. But look, that's my daughter. Me? My dad probably. No, me is my unmarried name. >> My husband. >> Is that it? >> No, that seems like that's my daddy's. >> That's your dad. Okay. >> Yeah. He has your uh He >> has dementia. Is that your social? >> Was that in there? >> I'm sure it was. >> Yeah. If I I can get that right there and just get your date of birth. >> I think it's in here. I don't know. I carry all my dad's stuff in the car. >> Okay. Rookie. >> Yeah. >> Okay. What's your date of birth? >> 2883. It's a brownie and a cookie. >> Okay. >> I say this to everybody. >> That's said 28 of 83. >> Yeah, that's what he said. >> Sorry it's taking me so long. >> That's okay. You don't need to look forward anymore. He He's just going to use that to >> figure out. >> I don't normally go out. I literally was sitting down on like my sweatpants and my friend Christine, she was like, she's like my second mother to me and she was like, I got an extra ticket to CER. Do you want to go? And I was like, >> why not? It's >> I don't know. I don't know. I was sitting down though. Actually, it actually took her a while to get me to go >> cuz I was like, "What?" And then she called me back. She's like, "I can't find anybody at Borsmith." And then everybody that worked there was supposed to go. So, >> so you said you're from here, so you got a license out of Arkansas. >> Yes, sir. >> It has to be here. I never lose. >> That's okay. Hey, look, we don't have to worry about it right now. Okay. >> Well, he's asking about it, >> right? Yeah, but he he got your name. >> No, but I'm worried if I have it. Gotcha. So, does that mean like people like broke into the building? >> Uh, no. It's just it's been malfunctioning all night. >> This is really bothering me. >> Is it in your pocket? >> Never. Oh, [ __ ] >> There you go. That's what I did. >> Sweet. Here, you can have that back and I'll just hold on to this for a second. Okay. >> All right. So, do you wear contacts or glasses? >> You wear contacts or glasses or anything like that? No. Okay. Do you feel comfortable wearing What kind of shoes are you wearing? >> Oh, they're t I don't normally wear them, but you want me to take them off? >> If you feel more comfortable taking them off, you can take them off. >> I mean, I could, but I feel kind of stupid cuz I'm a tomboy. >> It's your personal preference. >> I feel like freaking idiot. But that's okay. >> Yeah, those got a little bit of heel on them. >> I'm not you. I can't like walk in stilettos. >> I can't I can't I can't either. So, it's okay. We got that in common. All right. So, I just want you to put your feet >> walk on a line or >> Yeah. Well, first I want you to just put your feet together, heel to heel, toe to toe, just like my feet are. See how my my toes are touching and my heels are touching? >> Yes, sir. >> And then arms down to your sides. And then just stay like that until I tell you otherwise. Okay. Do you understand all that so far? >> Do you understand all that? >> Yes, sir. >> Okay. So, follow the tip of my eyes with your or tip of my finger with your eyes and your eyes only and try your best not to move your head. Okay? Try not to move your head. Okay? Keep your head straight. Try and keep your arms down to your side. Okay. >> Sorry. >> That's okay. Try not to move your head. Okay. >> Sorry. >> Also okay. >> I I feel like I just been in court. I was for my sister. >> Okay. Heat. Heat. Okay. Um, if you want, we can How about we do this? All right. So, I want you to imagine a straight line coming out of your left foot. Can you do that for me? >> You can just use your imagination. Okay. >> Okay. >> All right. So, can you imagine a straight line coming out of your left foot? >> Coming out of my left foot? >> Yes. >> Yeah. >> Okay. >> What What do you want my arms like? >> So, right now we're just imagining a straight line. >> Already like unequal, but whatever. >> So, what do you mean you're unequal? >> I don't know. I'm just unequal. >> Okay. So, all I want you to do is imagine a straight line coming under your left. Can you do that? like that. >> You're just imagining >> my left foot. >> You're just using your imagination to imagine a straight line. We're not walking just yet. Okay. >> No, we're not. >> Nope. >> All we're doing is imagining a straight line of your left foot. >> So, if you're looking at your foot, imagine there's a string that goes >> imagine a straight line going that direction. >> Thank you. >> Okay. So, put your right foot in front of your left. Peel the toe just like this. >> All right. >> I've never been in jail. But you're making me nervous. >> I've never been to jail ever in my life. >> Well, no one's going to jail right now. Right now, we're just doing a couple tests. >> You're making me nervous. >> I'm sorry, though. Nervous. I don't know how to help. So, you see how my heel is touching my toe? >> Yeah. >> Get in that position. >> Do you mind rolling your pants leg up? >> That's I think the problem. >> Maybe. >> I have Taylor Swift on. I didn't know Taylor Swift. >> Had to get some of those for my wife. >> Friends with a friend of mine is a helicopter. So, sorry. >> All right. So, right foot in front of the left to just like that. And all I want you to do is just get into this position. I don't want you to walk. Okay. >> So, put your right foot in front of your left. There you go. Arms down to your side. And then just stay like that until I tell you otherwise. You understand? >> That's hard. All right. So, stay like that until I tell you otherwise. >> Do you understand? >> Yes, sir. Okay. >> So, whenever I tell you to begin, you're going to take a series of nine heel to steps, counting out loud. Once you take your ninth step, you're going to get your lead foot on that imaginary line. Take a series of small steps first direction you just came from, and then take nine more heel steps. It's going to look like this. One, two, three. I'm only doing three for demonstration purposes. >> Nine. >> One, two, three. Again, I'm only doing >> nine from 8 7 6 5 4 3 2 1. >> Yeah. So, exactly like how I demonstrated counting one, two, three all the way up until you get to nine. >> Yeah. >> And then >> you will get to nine. >> And then you're just going to start over. One, two, three. >> Yeah, that's what I'm saying. >> Yes. Okay. And so, while you're doing this test, keep your arms down to your side, eyes on your feet. Okay, count your steps out loud and don't stop the test until the test is completed. >> All right, do you have any questions for me? >> Do you have any questions? >> Um, give me a second. We'll answer that. >> Okay. >> Hey, I'm just trying to get a [ __ ] night out. >> I got you. >> I have a hard [ __ ] life. Kind of got ripped away from me, >> but you hear that all the time. So, Ready? Let's go. >> Okay. Do you have any questions about the test? >> No. Right. Step first, right? >> No. This is the >> right foot. >> This is the starting position. >> So that Oh, so you want me to walk up there? >> No. You You're fine where you are, but you're fine. >> Starting position. >> You're fine where you are right now? >> Am I okay with thinking this is the starting position? >> So by starting >> it's a fool. So, by starting position, all I mean is that your right foot is in front of your left with your right track. Starting position is, >> you know what I'm saying? >> Okay. >> Do you know what I'm saying? >> Do you know what I'm saying? Whenever I say starting position, >> starting position is here. >> Correct. Yeah. >> Even as a normal human being, like it's hard to stay in here for like 30 seconds. >> I I was literally standing like that the entire time we were talking. And >> I'm sorry. >> Okay. So, it's not that difficult. I've never been to jail. But >> again, no one's going to jail right now. Right now, we're just doing a test. >> I'm [ __ ] embarrassed. Like, I've never had this. I just My life just seems to keep unfolding for worse things. >> Okay. >> I'm not going to cry. >> Okay. >> Okay. Let's do this. >> Okay. >> Shake hands. >> I don't want to shake your hand, ma'am. I don't >> shake my hand. >> I don't usually shake hands with people now. >> Oh, >> sorry. I was just saying like I agree to you and you agree to me. Respect. >> Okay. We we can respect each other without without touching each other. Okay. >> A lot of Okay. >> Okay. So, do you have any other questions about the test? >> Yes, sir. >> Do you understand the test? >> Yes, sir. >> Okay. So, before you begin, I need you to get back into that starting position with your right foot in front of your left. Arms down to your side. And whenever you're ready, you can begin. >> Like, where do you want my hand? >> Arms down to your side. Whenever you're ready, you can begin. I messed up at the end. >> That's okay. Keep going. >> Do it again. Back. I'm trying to make my toes. >> All done. Yes, sir. Okay. All right. So, you can go ahead and just face me, >> sir. >> Feet together, heel to heel, toe to toe, just like this, sir. >> Arms down to your side. And then just stay like that until I tell you otherwise. You do you understand? >> Yes, sir. >> Okay. Whenever I tell you to begin, you're going to pick a foot, whichever foot you feel most comfortable with, and you're going to lift it approximately 6 in off the ground. Okay. >> The whole thing. >> Yep. Standardized field sobriety. There's three tests. >> Okay. So, your leg will be straight. >> My daughter's in that stuff. Okay. So, your leg will be straight, your toes pointed forward, your foot's parallel to the floor, arms will be down to your side, and you're going to count out loud. 1,001 1,002 1,003 and so on until I tell you to stop. Okay? It's important that while you're doing this test, you keep your eye on the foot that you raised. Arms remain down to your side. You count out loud. And if for some reason you put your foot down, just pick it right back up without me having to tell you to do so. Okay? Cuz I'll tell you whenever the test >> good at that. Hold on. Can I get my like my spot? I don't like that. >> So, do you have any questions about the test before you before you before you begin? >> Yeah. >> Like I'm just not like parallel. >> Okay. So, don't I'm asking if you have any questions. I don't >> Is that okay, though? >> Yeah. I don't want you to start the test. I want to fall and look like an idiot. >> I don't want you to fall and hurt yourself. >> You're looking at me for an answer, but I'm trying to do the best for my children and my husband, so I don't know. >> I don't know either. I'm out. >> A lot more drunk people driving by, but um >> Okay. >> So, I'm going to lift up. But you guys are doing amazing. I love cops. I love blue line. >> Okay. >> [ __ ] >> Okay. So, >> but I just want to make sure like I don't stand up like I have horrible balance with my kids even. They laugh at me. I make Tik Tok videos. >> Okay. >> Like I'm so horrible. >> Gotcha. Okay. >> So, what's the best way to keep yourself balanced when you're like that? >> With just your arms down to your side, your foot parallel to the floor, toe pointed forward, legs straight, >> right? >> Approximately 6 in off the ground. Yep. I did it while I was demonstrating it to you. Okay. >> Okay. So, >> wait. I'm not going to go now. I'm going to [ __ ] in jail. >> So, are you wanting to do the test? >> Oh, yeah. I want to do the test. I don't want to go to jail. >> Well, I not doing the test is not doing the test is not going to force you to go to jail. Okay. >> Well, I'm a good person. Like, I just want to do what you want me to do. >> I I'm not forcing you to do these tests. Okay. >> I know that you're not, but I feel like you have other ideas, but Okay. Do you have any questions about the test? >> Yes, sir. >> Okay. Do you understand the test? >> Do you understand? >> Yes, sir. >> Okay. So, be Whenever you're ready, >> I got that. >> You can begin. Whenever you're ready, you can begin. Okay. I >> can't. >> Look down at your foot. Okay. Count out loud. >> It's hard. That's really [ __ ] hard. >> That's okay. Keep going. >> I can't even wear like high heels with the stilettos. >> Hold on. >> Did you say it's better to look down? >> All right, you can stop. >> I don't feel like it's better to look down. Well, that's just part of the test. So, if you want, you can put your shoes back on. Okay. >> Get your shoes back. >> Go ahead and put your shoes on. Okay. >> Are you >> not put taking you to jail right now? Put your >> in jail. I've never been to jail. >> Just put your shoes back on. >> I've never had a DUI or anything. I never did anything like people do. >> Do you have to sit down to put your shoes on or can you do it standing up? >> I don't want to wear them. >> Oh, okay. All right. Hey, can you step over here real quick so I can shut this door? I don't have any broker of any sort. >> I just come from a bad night. I have to go for a sentencing of my sister cuz I lost my mom to cancer and she died in front of me and now I take care of my dad. >> So you said you were a boy's nest. >> Yeah. And they all know me and they don't let me drink at the certain time like they knew my mom. >> Yeah. >> What type of drinks did you have? >> Um just beer. >> Just beer. >> Yeah. I went to Creed tonight, so I had two there and then I had one there and then another guy bought me one. So that would be four. >> You're not putting shoes on. >> I still don't want to drive home unless you're going to take it. >> That's um So I just want you to take a deep breath and blow into the straw. Okay. >> I don't want to. >> You want to? >> I'm afraid. I don't know cuz I drank at the concert. I had two and then I had two at quartz nets and I don't want to I don't want to blow a weight. I've never been in any trouble ever. >> Okay. So, do you would you willing to blow into this PBT or no? >> Open my husband. >> Can't get back in the car right now. >> Okay. >> Okay. >> Okay. >> Julian, last name Julian is Julian. >> You're going to take me in jail, so I'll blow in. No, I'm asking if you want to go into this. >> If you want me to. >> I'm asking you if you want to. >> I don't want to. I'm scared cuz I don't know. I'll never hurt you driving or anything. >> Okay. So, no, it's just yesterday. >> I feel like that's what you want me to say. >> I don't want you to say anything. I want you to I want you to give me >> I run into I guess >> I've never blown into a blower. >> It's very simple. You just take a deep breath in, put your mouth in the mouth, please. >> Okay. Very simple. Okay. >> Yes, sir. >> So, deep breath in, mouth on the mouthpiece, and blow. Blow nice and hard. There you go. You're good. You can stop that. >> It's reading. >> I got you. Okay. All right. >> Is it like illegal? >> Do what? >> So based on So based on the test that we just did. Okay. >> So it's >> I believe that you're over the legal limit. Okay. Just based on the tests, all your mannerisms and stuff. Okay. So I am going to be placing you under arrest for DWI. >> You're going to place me under arrest >> for DWI. Correct. >> I've never been under arrest. I'll walk you through the process. Okay. >> My husband works up shore. He can't get to me. >> Okay. I >> So, for right now, I would like for you to just put your hands behind your back. Okay. >> I have two kids at home. >> Okay. We'll talk about it. Is there anyone at the house with the kids? >> No. >> Okay. >> Like, I just go out for a little bit. Come here. >> Miss Julian, I understand this is very emotional for you. Okay. But but I need you to start listening to me because if you don't listen to me, I'm gonna have to treat you as hostile and I don't >> I would never be hostile. Don't act like that. >> Not listening to what I'm saying. >> Just turn around. Put your hands behind your back. Okay. >> You know, can I get my phone and tell my husband about my kids? >> We'll we'll get him. We'll talk to him. I'll promise to you. >> I've never gotten like >> We're hurting for money. >> Let go of your hands. >> Oh my god. Okay. Do you have anything in your pockets at all besides the credit cards? >> No. No medication or anything like that? >> Okay. Out of your car, what do you want me to grab? Your phone, wallet, keys. >> Is it going to stay here? >> Okay. I'm asking you a simple question. No, I'm just ask asking you. I'm just going to stay here. Like I can just have my friend come pick it up and take it back home >> where my kids are. >> Your car is not staying here. Your car is getting towed. >> So you're going to impound it, >> correct? >> On top of what I already have to pay for my sister and my dad. >> I have no idea your history. I don't know anything. >> I know you don't. >> Thank you, though. >> So, are your children home alone without any supervision? >> They're 15 and 10. >> Okay. Does your >> I never like I only left for the concert and I was coming home. >> Okay. Does your 15-year-old have a phone? >> He does, but he won't answer it until morning time. >> Okay. I'm just making sure that if there was an emergency, your 15-year-old has a way of contacting emergency services just in case. >> So, your 15-year-old does have a phone and he's mentally competent. Like there's no learning disability or anything like that. >> So you can roll your eyes at me or you can answer a very simple question. >> No, I can't. We're >> okay. >> You see that? I'm not at all. I promise I'm not rude at all. >> Okay. All right. >> I'm like a southern bell. >> All right. >> No, I am. I'm not. >> Don't be rude. >> Is my car going to stay there? >> No, your car's going to get towed. >> Oh, great. It's going to get impounded and that's going to cost money to get out. >> I've never done this before. >> So, left foot first. If you'll step up, use that step right there. >> I waited until I was 40 something. >> You got it? >> Yeah. Yes, sir. >> Thank you. I'm sorry. I didn't mean for you to think I was being a smartass at all. I promise. >> I'm not offended. >> Here, lean back a little bit. >> I know you're not. >> Thank you. Thank you. [snorts] >> I'm usually been an ambulances, not this. >> You need to go over the other side. >> Can you slide towards me just a hair? I don't have to get >> There you go. >> There we go. All righty. You can slide back now. does this in this house. >> Yeah, I think she's taking something else, too. >> Well, you hear the list of medication. >> Yes. >> Uh husband's still on the phone in here as well. >> Hello. Hello. Hello. >> Hi. Are are you Brook's husband? >> Yeah, but it's Chip. >> Okay. I Sorry, I don't know who Chip is. So, >> I'm her I'm her husband. >> Okay. >> What's going on? >> So, right now your wife is being placed under arrest for DWI. Okay. >> Was she driving? >> Uh, yes. She was in actual physical possession of a motor vehicle. She's at the water burger right now. So, >> but she's in the parking lot. She wasn't driving, right? >> Well, I don't know about you, but cars don't magically teleport places. So, >> don't what? >> So, I'm just I'm doing this as a courtesy to inform you that your wife is going to be at the Benton County Jail for the next 8 hours. She'll be released on citation at 11:00 in the morning. Okay. >> Okay. What about the car? >> The car is going to be impounded. Even if I have somebody come pick it up. >> Correct. >> Okay. I don't I don't understand. She's in the parking lot. I mean, did you guys pull up? Did you guys pull her over? >> Well, Chip, all of that can be argued in court. Okay. So, >> Okay. You're Okay. >> Okay. Did you have any other questions? >> Did she Did she take a breathalyzer or I mean, how did What's >> Nope, we haven't done any of that yet. Okay. >> Okay. So, she's under arrest without a breathalyzer. >> Okay. Do you have any questions that pertain to where your wife is going to be tonight? >> Yeah, I do. Uh, can I speak to your supervisor, please? >> You can call the Bentonville Police Department. You can talk to him. It's Lieutenant Boothman. >> Lieutenant Booman. >> Boothman. >> Boothman. Is he there on site? >> He's not on site. He's working though. He's on shift. Would you like me to give you the number to the non-emergency line for the Benville Police Department? Well, I'd like to have his number if you got it. >> I'm not giving you his cell phone number. >> I can give you the number to the police department and dispatch can get you in contact with my supervisor. >> All right. Well, so what's how do you have suspicion over DWI? >> I'm not answering that question right now. Do you have any other questions, sir? >> No. Okay. What was your name? >> It's Corporal Reinhardt. >> Corporal Reinhardt. And your badge number? Badge number is 929. >> Okay. I'll be in touch with the supervisor. Thank you. >> Okay. >> So, I had a very pleasant conversation with her husband. He advised that he was going to call and probably complain about me arresting his wife because she wasn't driving. and I arrested her without doing a breathalyzer. >> Okay. >> So, remember, >> it's okay. I'll walk you through the process. Okay. >> So, go ahead and step out for me. >> Really? I'm not used to walking like this. It's weird. >> So, >> okay. >> There you go. All right. We're going to go to that great order to your left and I'm going to take you out of those handcuffs. Okay. >> All right. I'll take you out of these handcuffs now. Okay. So, you don't have to have your hands behind your back anymore. >> Okay. >> You can take your arm out. There you go. Okay. All right. So, this is Officer Barentos. So, I didn't do a a search of you because you're a female and I'm a male and I didn't want to search you extensively. Okay. So, do you have I asked you before, do you have anything on your person whatsoever? >> Just some ID. I think >> I have your ID. Yep. >> Yeah. It's right there. >> Yep. I have your ID. Okay. >> Yes, sir. Okay. >> Okay. You have anything sharp? >> Are you wearing this bra and underwear? >> Um, I have a No, no bra. I have to eat in there. >> I know everywhere from the I have urologist. I'm not allowed to. >> Okay. >> Sorry. >> Sorry. >> Okay. I'm going to have you stand up and you're gonna look inside this camera, right? >> Yes, ma'am. Okay. And then can you put your left shoulder on that wall and look that way? >> That way. >> Put put your other shoulder on the wall. >> Turn around. Oh, this way. Yeah. There you go. And then face the wall, please. Just look at the wall, >> sir. >> There you go. >> Okay, cool. Well, whenever we get to that point, we'll do that. So, for now, come on in here. Okay. >> And then you can just stand over there again. You can sit, you can stand, you can do whatever you like. >> Did I do everything? Basically, you wanted me to jail and it's >> Yeah. So, >> it look bad. >> No. So, here's your test results. >> Was it bad? [snorts] >> So, you provided two samples. Your first one was a 084. Your second one was a 086. Your final result is a 184. It's >> over. >> Correct. That's over twice the legal limit. >> Right. >> Okay. >> I'm sorry. >> So, we're going to go down to where it says part two to be completed >> after you uh take all my tests in part one. So, having taken the officer's tests, you have the right to additional tests or tests to determine the alcohol controlled substance or other intoxicating content of your breath or blood. Do you want another test at your own expense? >> Yes, sir. I can't argue with you. And then if you want one, yes. If you don't, no. And regardless of your answer, please sign. Nope. >> Wait, should just check. >> That's fine. >> Sorry. >> I prefer initials, but checking is okay as well. >> No, this is like X. There we go. What about this last one? >> Uh, we don't do blood draws on consent.
