After being clocked at 47 mph in a 25 mph zone, this intoxicated California driver was stopped by the California Highway Patrol. >> Take it. Where you coming from? But we were visiting her in Taho. >> Well, I'm asking where you're coming from tonight. >> Oh, sorry. We're coming from the casino. >> Oh, okay. Um, so the open containers here in the car, those have alcohol in them. >> The two cups, the one right here next to the >> Okay, so your passengers have open containers. >> How old are you ladies? 21. >> All three of you are 21. >> I need identification from the other two to confirm that. Can you roll down this passenger window? >> Thank you. And then, uh, Caitlyn, have you had any alcoholic beverages while you were at the casino? >> I I had one beer, but >> You did have one beer. Okay. Um, just as precaution, I'm just going to have you step out. We're going to go through some field spray test. Okay. >> Did she give you her? Okay. Thank you, ma'am. >> That's okay. Okay. I just need to make sure you're 21. Go ahead and step out. Girls, just stay in the car. Okay. >> Come over here to the shoulder. >> Yeah, you're fine. >> All right. Is this your first time up here in Tahoe? >> Yeah. >> Okay. >> All right. So, I just want to make sure you're not impaired. Um, >> yeah. I'm sorry. I I have a thing on my car like on the thing that says the speed limit. So, it said 45. So, I like >> All right. It must not have updated cuz it's 25. I I >> goes up to 35 here, but it's okay. Just >> you got to think if somebody walks out in front of you. >> This is my first time being pulled over. I'm sorry. I was like, you're fine. Um, do me a favor. Just take your glasses off. I just want to check your eyes real quick. Okay. >> Yeah. >> So, you're going to follow the tip of my finger with your eyes only keeping your head still. Okay. >> Nope. Don't move your head. Keep looking at my finger. Keep looking at the eye. It's okay. You can blink. Just follow my finger. Okay. If I asked you to blow into a path, would you be willing to do so? >> Yeah, I can do that. >> Okay, let's just do that so I can get you guys on your way. I know you said you had a beer, so I expect to see something, if not anything. Depends on how long ago it was. I like we were we were literally talking about this like we went I like honestly I I lose my gear. >> No worries. Just to to cover me I'm just going to >> have you blow into this if you're willing at night. No worries. >> It's okay. Are you guys having fun up here though? >> Yeah the weekend. >> Oh good for you. >> Nice came for the weekend. >> That's cool. What are you doing for your internship? >> I'm working at PG. >> Oh, nice. >> Hopefully they give you a discount on your your bill. >> I'm just kidding. >> I'm from SoCal, too, so I don't even use PG. >> That's terrible. All right, take a deep breath and then blow long and steady. Okay, wait. Hold on. And when you blow into this, you go hard. Keep going. Keep going. Keep going. Go, go, go, go, go, go, go. All right. The speed limits change a lot on this road cuz I I it said like 45 40 and then it went back to like 45. >> No. Um, so it's they do so it's 45 30 45 maybe 35 and then goes into 25. Um, >> okay. >> Yeah. >> I Yeah, cuz I like I I can't really see this. I mean, I have my glasses, but I like Mhm. >> couldn't see the sign, but it said like on my car like 45 and then it went to 40 and then it went back to 45. So I I wasn't >> And then I I see here it says 45 on the >> the passenger's ID. >> Okay. Sorry, she's 21. >> I have just got to wait a couple minutes. >> Sorry. We We should have had open containers and >> You're okay. Um, so I >> I I wasn't I wasn't drinking it. I swear. We We came from a bar and then we went to the casino. So, but I should have told him to throw it out before we Just a second. Um, so you guys were coming from Casino and you're going to >> We're going back to her house. >> Okay. And that's your friend passenger. Yeah. All right. When's the last time you slept? >> Last night. >> For about how long? >> Eight hours. >> Eight hours. Okay. And then when's the last time that you ate any food? >> Uh, we got food at like seven. >> Seven. What did you eat? >> We had king crab legs. >> Nice. >> Yeah. She she works at the restaurant. We were We had pizza and then we got >> Okay. >> She got a discount, so we got it. >> Okay, nice. Um, and then you said you just had the one drink, the one beer. Yeah. >> Okay. And then what time did you take your first drink of alcohol? >> 5 6 when we got food. >> Okay. And then when did you take your last drink of alcohol? >> Uh, I don't know what time it is right now. I think 1 like 12. 12:30. >> Okay. Um, do you feel the effects of the beer? >> No. >> All right. And then um I we've also waited in my car while we were in the parking lot for like 10. >> Yeah, no worries. >> Um and then you don't take any medications or drugs, anything like that? Do you have any physical impairments? Is there anything mechanically wrong with your vehicle? >> No. >> Okay. Um and then any recent surgeries performed? >> I I have it was like like growing up. >> Okay. All right. And then uh where were you drinking? At the casino. >> Yeah. >> Okay. Um and then you don't smoke marijuana. Anything like that? No. Okay. I'm just going to >> Yeah. This is like literally the first time I've ever been pulled over by the cops. I like just got my car like two months ago and I >> Yeah. So 47 and a 25 isn't very good, especially in the in these areas. >> It said 45 on my car and then I was like Yeah, >> because I was I was keeping track of my speed and then it said 45 and then I >> No worries. You didn't see any signs on the side of the road. Try to try to pay attention to stuff like that, especially when you're in these business areas and can't really see in front of you. >> Very windy here. So, I feel like I was looking a little hard as I should have. >> That's okay. Um, so we're going to take a second one. Okay. So, deep breath and blow long and steady. Okay. Wait just a sec. Sorry. >> All right. Go. Keep going. Keep going. Keep going. Keep going. More. More. More. More. More. Oh, you got to blow a little bit harder than that. Okay. It's on the hood. Okay. Deep breath. Hold on a second. Oh, hold on. >> Are you cold? >> Yeah, a little bit. >> Okay. All right, deep breath. Long and steady. Keep going. Keep going. Keep going. Keep going. And stop. Can I get a jacket for my car? >> Um, well, I'll have him grab it for you. >> It's in the the back seat. >> If you ask the girl in the back seat, she'll probably give it to you. >> Okay. Um, so I'm going to ask you to do a couple more tests. Um, so this next one here, we'll have you stand right on this white line and um, don't do anything until I tell you to. Okay? So you're going to imagine or actually use this white line. I'm going to instruct how you do this test. Okay? So don't do >> that's fine. Just listen to me. Just don't do anything until I tell you to. You understand? >> So once you're ready, you're going to start by placing your left foot on that line with your right foot in front of your left foot, heel touching your toe, just like this. Okay. >> Yep. Go ahead and do so now. Now, put your hands and arms down by your side and hold this position while while I explain and demonstrate the test to you. Okay. So, you're going to take a total of nine heel to toe steps. Turn and take nine heel to toe steps back. So, it'll look like this. One, two, three, and all the way to nine. On that nine step, you're going to turn by taking a series of small steps, keeping this front foot on the ground just like this. Turning around, keeping that front foot placed. And you take nine heel to toe steps back. One, two, three, and all the way into nine. When you begin the test, do not stop. Count your steps out loud. Look down at your feet at all times. And keep your hands and arms down by your side. Do you understand? >> Yep. >> All right, go ahead and begin. One, two, three, four, five, six, seven, eight, five, 1, 2, 3, 4, 5, 6, 7. Okay. All righty. Um, so you're good. You can stand normal. This next test, what I'll have you do is you're going to stand here with your hands and arms down by your side and your feet together. And when I tell you to, I'm going to have you tilt your head backwards. You're going to close your eyes, and you're going to estimate 30 seconds. Okay? When you think 30 seconds has passed, I want you to open your eyes, bring your head forward, and tell me to stop. So, before you begin, I'll tell you when to begin. Okay? Go ahead and tilt your head backwards, keep your eyes open. All right? Now, close your eyes, and begin. Reminder. That was 30 seconds. Okay. So, 29. All right. So, do you know what the legal limit is here in California? 08. Um, so you blew over that. I did. Yes, ma'am. So, I'm going to ask that you place your hands behind your back. You are being arrested for DUI. Okay. Do you have your cell phone in the car? I do. >> Okay. Oh man, your wrists are so tiny. And that's not okay. I don't want your hands to slip out of these. Does that feel okay? >> Yeah, I What happens now? >> So, >> I honestly like I I like I'm I'm not asking like whatever, but I swear to God like he sat in the car and I waited till I felt like I was fine. >> Okay. All right. What happens now? So, I'll explain everything to you. Um, what's going to happen is what we're going to do is you're going to go to the jail and you're going to soap up, okay? For a couple hours, a few hours, and then they'll release you in the morning. So, that being said, just a minute. Just a minute. With that being said, um, everything is a process. So, they'll release you tomorrow. They're going to give you some paperwork and information and then the district attorney's office is going to give you a call and they'll give you all the information on how to handle everything. >> And this goes on my record. >> Not right now. It doesn't go on your record because you're not being convicted of anything. You are just being arrested in suspicion of. Okay. So, there's a process that what the what happens is now the district attorney looks at it and they're like, "Okay, is there enough for us to file on it based off of everything in the report?" Take a deep breath. Just I know you're upset right now, but just It's a lot. Don't overwhelm yourself right now. Okay. >> I've never been pulled over before. This is like >> Okay, I know. Calm down. >> Please stay in the car and we'll come talk to you. I know. Just sit down. Okay. I have a chapstick in my pocket. Let's not freak yourself out. I will explain everything to you. Okay. I know [snorts] this is scary for you. >> Okay, just breathe. Do you have anything else? Do you have your cell phone? >> Do you have a purse or anything like that? >> No, I just have my wallet. Um, so after being arrested for a DUI, you are required to submit to a chemical test, and that's breath or blood. I have the breath test here with me. We could just do it on the scene and just go straight to the jail and just get everything started. >> Can I ask my blue? >> You were a one.11. So you're about close to two drinks over the legal limit. Okay. Um so like I said, you're here. Like I said, um you we give you the option for breath and blood or you could do both. I have the breath test here. We can do that on scene. That way we can just get everything done and get to the jail and get the process started with that stuff. Um, if you want to do blood, we go to the hospital, they draw your blood. Um, and again, you have the option to do both. As long as you give me one, that's all you need to do. You'll meet the requirements. >> Is there one that can like help me not get in trouble? Like, am I going to be screwed either way? >> I'm not saying that you're screwed. Um, >> I But I >> it doesn't matter which one you do. What what matters is if you were to like refuse either, then there's consequences for that. Okay. >> But is there like consideration to the fact that like I mean I'm not saying I passed it, but like I stayed on the line and I I don't think >> all that's taken into consideration. Okay. All of that is so all that's going to be laid out in the report. I don't sit I'm not sitting here lying. I put everything that I see and that will all be in the report for the district attorney's office to look at. Okay. >> Right. I just I I I would never we were talking about this like we all because we we were drinking at uh my friend's place that she works at and we all like I I wasn't supposed to be but I was the most sober and I we waited at the beach then we went to the casino and then I had a drink but we all made her like >> I know I 1.1 but I watch your head I know I genuinely didn't feel it and honestly like mistake was I my car read that it was a 45 and I I I don't know any of the roads here and I just >> and you all of this you can I all of this you can explain. Okay, you can give your side, right? Um are you okay? >> Yeah, I'm fine. I I literally just got my car on my dad's insurance. This is like Sorry. I would never drink and drive and like this is I've never even gotten a ticket or like anything and like >> I know you've been nothing but cooperative with me. I appreciate >> Did you want to do a breath test or a blood test? >> Is do you recommend one that would like help me not be in trouble like >> So it's either way is going to like whether you do the breath test or the blood test the results could vary by very minor numbers. Um, so it's really up to you. Do you prefer prefer needles off of what I already did or is it like sober up in an hour and then like >> No, it's from the time that I stopped you and everything that I saw before. Um, >> well, I did a DUI and it'll go on my record and I'll be in trouble if you use the breathalyzer. Like I honestly don't mind either one if it like >> No. So it doesn't matter. Um, and I can't sit here and like Are they hurting my wrists? Are you twisting them? >> Digging into my my wrist. >> Okay. Try not to twist them too much. You have your wrists are very small, so try not to like rotate them because they're like meant like ovals. >> So holding it to me. >> Okay. I can adjust them here in a sec. Is it like causing you a lot of pain? >> If it's very painful, I'll re I'll adjust them. Um, so as far as like the breath test, the only difference between the breath test and the blood test is the breath test doesn't retain a sample for later testing. Okay? The blood test gets sent to DOJ and they retain a sample. That's the only difference. Um, the breath test gives us an instant result. The blood test gives us a result in about I'd say 6 to 8 weeks. Okay. You want to do the breath and like I said, you can do both, but you just have to do one. All right. So, give me just a minute. Um, I'm going to get >> But you said everything else gets taken into consideration. >> All of it. Yeah. >> All of it does. It >> all goes in the report. So, give me just a sec. Okay. Are you okay? >> Yeah. >> Are you sure it's not hurting you? >> I'm I'm not in pain. I'm just >> Okay. I know. Give me just a sec. I need the time of stop so I can check the 15. No. Did you see this one up here? No. Leave here. So, we're going to have to uh safekeeping. Um, unless we park it and then have plaster see if plaster would be willing to do a transport for us. >> Okay. Well, they just they just drove by. >> I know. Did you even say anything? >> I just give him the four. >> Let's just see. Hold on. Chico 811 Charles inquiry. 281. Charles, can you inquire with PCSO if they'd be willing to do 1148 times 2 X-ray? So, take a deep breath, but long and steady. Okay, keep going. Keep going. Don't stop. Don't stop. Awesome. Just going to count down. We'll do a second one. Okay. I'm gonna do what we can to try to keep from having to impound your car because I can't leave it here with the girls and I can't let them just walk off here. Um Oh, come back here. >> You know what? I saw that car over there. I wanted to stop it. What do you want me to do? >> Their friends walking. How far is the >> That's a mile away. We'll just We could probably just take them. Is that up Grand Balcon? >> Uh, yeah. >> It's just one road past Grandma. I actually probably take Grandma. Are you okay with us leaving your car here? >> Well, if we leave it here, the idea is to not tow it. We have a tow coming because we can't just leave it and leave your friends. >> Like if it's not going to get ticketed or anything, that's fine. >> Okay. Um with that being said, with us leaving it here, we can't just we we're not liable for it. So, if anybody or any animal breaks into it, that's not on us. Okay. Um, unless you want us to send it up to Truckucky for safekeeping, you just have to pay the travel fees. Um, as far as your friends, we can try to give them a ride home so that way we can make this as less painful for you as possible. >> You okay with that? >> Okay. >> Let's cancel the toe and we'll leave it here. >> If you don't have extra keys at her house or anything like that, the name. >> I don't I don't really know where we are though. Like >> it's okay. They're just up the road. Not too far. >> Yeah, but I like tomorrow to come get my car. Like I don't >> You can see if there's a tart bus. The the jail will kind of explain everything. I'm sure your friend >> My friend can drop us off. She has a car, but I don't know where we are. >> They can send a pen or something like my car. >> Well, I'm sure they'll they're familiar with the area, right? >> Your friend is okay. They were drinking so I don't know if they >> Well, tomorrow they're not going to be able to do anything till tomorrow. >> Okay, second test. Take a deep breath. Long and steady. Okay, keep going. Keep going. Keep going. Almost there. >> Is this going to be sent to like my dad's like the owner of my my car? >> I'm not going to send anything to your dad. That's not anything that's going to even be >> Is this going to go on like my public record? >> Um >> I'm like in my last year of college and I'm like trying to apply to jobs and like if this is on my record like >> my whole career is over. >> Nothing's going to be on your record right now. Okay. Um so what's going to happen is everything goes through the process. So, if you are convicted of anything, okay, with the district attorney's office, um likely they're going to do what's they're going to plea something down, meaning they're not going to charge you for all of it. Okay. Um >> is there anything I could do to like talk to them? It's like tomorrow or one day you can call them. >> I would never try to drive. We're going to Uber like I know >> cuz even yesterday too like we were drinking and we just we just Ubered home and like I I swear I was fine and I know >> Monday you can call the district attorney's office and talk to them, okay? And ask them how it all works, okay? I'm sorry. I swear like drinking, but I I would not ever drink. Like I would not get behind the wheel if I was >> if I was not okay. >> Take a deep breath. Okay. All right. Give me just a sec. Okay. I
