You have your license with you? >> No, I'm going to grab >> Okay, I'm going to have you step out of the car. Hey, you just want to talk to her and make sure she's cool? We'll sit back over here. What's your name? What? >> Dom. >> Dom? >> Yes, sir. >> Hey, what's up? Everything okay? >> Yeah. >> There's not like nothing physical going on in the car? >> No. >> Not like that? >> No. No. >> Okay. So, from my from my experience, like maybe you guys are fighting while you're driving? >> No. No. >> Nothing, absolutely nothing like that? >> Absolutely nothing, no. >> Okay. Who's this in the car with you? >> My girlfriend. >> Your girlfriend? And where are you guys coming Yeah, where are you guys coming from? >> I was at a party with >> She's what? >> At a party with her girlfriend. >> Okay. How much did you drink tonight? >> I like three shots of Patron. >> Okay. How old are you? >> I'm 19. >> 19? >> Yeah. >> So, >> I know I'm underage. So, I know I'm sober still, but I didn't >> He doesn't have it with him. >> I was at home drinking, that's why. Yeah. Drove her right home and said, I want to say we were like at the crib, though. >> Yeah. Are you the owner of the car? >> Uh, she is. >> Okay. What's your first name? D O M >> M I N I C K >> Wait, D O M I >> N I C K >> E Z >> And then Dominic is D O M I N I C K. >> Like Dom and then Nick. >> Yeah. Uh, middle name? Okay. What's your address? You live in Madera, or is that just where you bought the car? Okay. All right, man. Just based off of the driving, I'm going to rate you some field sobriety tests. I'm going to start by asking you some questions, okay? Um is there anything wrong with the vehicle? >> No, not that I know of. >> Uh sick or injured? >> No. >> Diabetic or epileptic? >> No. >> Uh use insulin for any reason? >> No. >> Uh any physical impairments, stiff ankles, bad knees? Okay. Uh when's the last time you slept? >> Like last night. >> And how many hours of sleep sleep did you get? >> Like 9, 10 hours. Cuz it's our off days right here. >> Okay. >> You're from Germany? >> Yeah. >> When's the last time you ate something to eat? >> Today. >> Uh what time? >> Like 11:00, 12:00. I ate McDonald's. >> 12:00, is that p.m. or a.m.? Like the night? >> So 10:00 p.m. to 12:00 a.m. >> Okay. Uh what did you have to eat? >> McDonald's. >> McDonald's? Okay. Where did you start driving from prior to this? >> From my house. Just to see Tyler up by house. >> Okay. Uh do you know where we stopped at right now? >> Right now, no. >> Were you following GPS or >> Yeah. It said go this way, so that's what I followed. >> Okay. Uh you were going to drop her off? Uh you said you had three shots? >> Yeah. >> Of what? >> Vodka. >> Nothing else? >> No. >> Do you remember what time your first drink was at? >> My first one was at 11:00, 12:00. Second was at 12:00. And then like third was at 12:30. >> Okay. Nothing else outside of that? Where was it that you had the drinks? >> My house. I'm in the kitchen with Tyler. >> You what? >> I'm I'm in the kitchen >> the car. >> Okay. Uh you currently feel any effects from the alcohol? Uh you under the care of a doctor or dentist? >> Dentist, yeah. Doctor, no. >> Are they actively looking at you for anything uh like pressing? >> My braces are >> Okay. Any uh medication or drug use? >> No. >> Uh surgeries performed recently? >> No. >> Okay. Do you wear uh contacts? Okay. What I'm going to have you do is just stand up with your feet together, arms down to your side, okay? What I'm going to do is follow the tip of my finger uh down to your side, it's fine. I'm going to have you follow the tip of my finger without moving your head. Just continue to follow my finger just as you understand. >> Yes, sir. >> Okay. Uh next test requires you to do a little bit of walking. So, I'll have you walk this way. You can stand right here where I'm standing. And just uh >> Hands down? >> Yeah. Hands down to your side. What I'm going to do is turn around cuz it's not as wet. So, you can turn around face this direction, but we're going to utilize that line. Okay. What I'm going to do is place your left foot on that line. You can go ahead and do that now. >> All right. >> Yeah. Now, what I'm going to have you do is take the heel of your right foot and place it directly against the toe of your left foot. Remain in that position. Don't move from that position until I tell you to begin. >> Okay. >> When I tell you to begin, you're going to take nine heel-to-toe steps down the line, okay? Nine. It'll look something like this. One, two, three, all the way to nine, okay? >> Can I take my shoes off first? >> What was that? >> This is a ask. >> If you want, you can take them off this way. This way. Okay. So, starting position again, perfect. Remain in that position, arms down to your side. Cool. So, when I tell you to begin, you're going to take nine heel-to-toe steps down that line. One, two, three, all the way to nine, okay? When you get to that ninth step, you'll leave your front foot in place, using your back foot, you're going to pivot around your front foot, like so, rotating until you're facing where you started the test. You will then return back to the line and take nine more heel-to-toe steps. One, two, three, all the way to nine, okay? While performing the test, keep your arms down to your side. Stare at your feet, count your steps out loud, and once you begin walking, do not stop walking until you're done. >> Yes, sir. >> Do you have any questions besides that? Whenever you're ready, feel free to begin. >> One, two, three, four, five, six, seven, eight, nine, that's it. What? >> Perform what you remember. Remember you got to turn at some point. >> 10. One, two, three, four, five, six, seven, eight, nine. >> Okay. You can face me. So, it's >> Nine, okay, cool. >> Okay. Uh next test we're going to do is have you put your feet together and your arms down to your side. In a second here, I'm going to have you perform the test. Just pay attention. I'm going to demonstrate. >> Stand on toes? >> Yeah. Uh just pay attention. So, in a second here, I'll tell you to begin. You'll raise one foot, whatever foot you would like, approximately 6 in off the ground. I'll demonstrate that so you can know see what it looks like for the purposes of the demonstration, I'm going to raise my left foot, okay? So, it looks something like this, keeping both legs straight and your front foot level with the ground, you proceed to count 1,001, 1,002, 1,003, 1,004, and so on until I tell you to stop. Uh while performing the test, keep your arms down to your side, stare at that raised toe, and count in that manner. >> So, on the line? >> Uh >> With or not on the >> It's not super critical to this test, so you can if you want to leave it on the line. Uh which test are you going to raise or which foot are you going to raise for the test? Your right foot? Okay. Uh whenever you're ready, you can go ahead and begin. Uh just go ahead and pick up and continue counting from where you left off. Okay, you can stop. Uh it sounds like you made it to your 25. Okay. Uh you're under 21? >> Yes, sir. >> Have you ever been evaluated for DUI before? >> Before, one time 2 years ago. >> Okay, were you arrested? >> No. >> Um, so since you are under the age of 21, you're obligated to submit to a preliminary alcohol screening test. Essentially, it's an in-the-field test that requires a breath sample. Uh, you understand that since you are under the age of 21, you have to blow in this test. >> I never before before I blew it, I blew a 0.03. >> Mhm. Okay. That's fair. >> I know she she she'll be sober though, so she she'll be able to drive. >> Her? How come she wasn't driving if she was sober? >> Honestly, that part >> It's all right. Sometimes it's hard, you know, she's the guy you want freaking drive for your girl. I get it, but you got to make sure you're doing it safely, you know. >> I thought so. >> All right, put this together and hold onto your side. Create a tight seal, blow as hard as you can for about 8 seconds. >> Okay. >> Go ahead. >> [bell] >> We'll do this twice and I'll let you know where you're at. >> I know she can drive. >> Yeah? >> Yeah. >> This county? >> Yeah. She works in the office area. She's a correctional officer. >> Okay. All right, so she works corrections, so she's out of jail? >> Yeah. She's a She worked this year. She started this year, last year basically. >> Mhm. >> It's like her department thing. >> Okay. >> Yeah. >> That's in Cremonese? >> Yeah. >> The zip code? >> 92630 >> Do you have any tattoos? >> Yeah. Oops, that's it. >> She has a head injury. >> Yeah, put them on the stretcher. I can drive away. If you want to be driving, you can follow us. >> Up like Shaw and They both are fine though. >> I both are fine though. >> Mhm. Makes sense. >> Yeah, 825. I put that for I got a match on that. >> What's up? I thought it was probation, right? >> Where I get like community service though. >> Probation? >> Like community service though, but I get it at though. What's up with this cat? >> Uh probation for what? >> Just anything. >> Just depends. It's all depending on what the judge decides for you. There's no set criteria from from my perspective. I don't believe there's a set criteria to what >> So, if I blow my breath, cuz I breath blow commission breath blow, right? >> Uh-huh. >> And if the breath blow is like that, I could do that? >> Potentially, I don't know. >> Okay. I was asking for that. >> Dude, get away from the cat. Jeez. >> All right, one more time, just like before. >> Yes, sir. 0.01, huh? >> Do you know what the Well, do you know what the legal limit is for somebody that is >> 0.08. >> .08 is for somebody that is 21 years or older. For you, at .01, >> I don't have any alcohol in my system, right? >> That's good, sir. Yeah. >> But, I'll I'll just let you really you're you're up there. >> Really? >> .08 is the legal limit. You're at .21. .217. So, you're like over two times legal limit. Okay. That being said, you've been respectful, and I still have to do my job, okay? And I'm going to still try to work with you where I can, but um what I'm going to do is turn around and put your hands behind your back. So, I believe you're driving under the influence, um and it's unsafe for you to continue to safely operate this vehicle. Um release your hand for me for a second. I'm going to see what I can do for you. Um your alcohol level is really high, so that's what that's one point of concern. Um Does Does she have somebody >> I can pick it up? >> Potentially. >> Yeah. >> Okay. Uh we're going to take a step back this way. Oh, yeah, I should have had you do that before. Are you able to do it now? I'll help you out where I can. Got it? >> Yeah. Let's step up to the front right here. Uh to the front of the car. This front. Okay. So uh because I placed you under arrest for driving under the influence you're required by state law to submit to a chemical test. Um now that you are under arrest, um you have the option of taking a breath test which would be similar to the one that you just did or a blood test which would be performed at a hospital. >> I'll do a breath test. >> Breath test? All right. We'll do it right here. We'll knock that out here. Um we're going to try to avoid towing the car. That's kind of probably going to be the best that I can do for you tonight, but >> No, I understand. Thank you. >> Well, we're going to take it step by step. Uh I got to search you out. Do you have >> Uh I have my phone and my wallet. Not my wallet. Just my phone. >> Okay. Uh I have a property bag here that I'll put it in for now temporarily. Uh face the car, separate your feet. I'm going to take these off. Okay. Um we're going to take a seat back here. Just take a seat back here for now. All right. So just like before we got to do this two uh times successfully. In a second here it'll advise us to begin. All right. Deep breath, just like before. Breathe as hard as you can about 8 seconds. And we'll do a second one here in 2 minutes. Yeah. 0.22 >> Do you have a phone in the car? A phone? In the car? Yeah. Well, I didn't feel it in your pocket. Where did it go? Yeah, I think it's in the car. I'll grab it. I just wanted to make sure. And then you have a wallet in there? Do you have anything else? Just the phone? One second. I'll come talk to you right now. All right. One more time, just like before. A point two two again. >> Okay. So, your blood alcohol level based upon the test is .22 and .22 which is consistent with what the preliminary test read. It's really high up there. That being said, this test doesn't retain a sample that can be tested later on. I have to offer it to you. You don't have to comply. You just have to do one of the tests, but I have to offer to you. If you want to do a blood test additionally, you have the option to do that. You have the right to do that. And the difference is with the blood test, well, it can be tested at a later date. With the breath machine, it takes in your breath, tests it actively, and then purges it. Did you want to do the additional blood test? What's that? Another day? You don't want to do a blood test right now? Okay. It would be Okay. You You can do all that. Regarding us like in it being associated to this because DUI is a crime. I mean, it's a misdemeanor. You can do whatever you want at a later date, but if you wanted to do a blood test now, you have the option to do it. I'm just offering you I I have to offer it to you, but you've already fulfilled your requirements for the DMV. Are you okay with doing just the breath test or just blood test as well? Wait. Do you What? You Well, you just did the breath test, okay? Okay. I just have to offer you the blood test. Did you want to do that one, too? Okay. Because your level is so high, I do have to book you into the jail tonight. Okay? The best I can do for you like in regards to like you've been super cooperative is not tow the car. Okay? And that's given if we're able to find somebody that can pick it up and it's sober and has a license. >> You need her sister to pick it up? >> Well, her sister's on her way. >> So, if her sister's on her way, I can go? >> What? >> It's just like her sister's on her way, I can go out there? >> No. That's to release the car. You We have to book you to the jail tonight. Okay? I'm just telling you that's that's the best I can do for you. Yeah, she's she's she's going to get picked up from her sister and she's going to take the car to you. Okay? Um any questions? Okay. We're going to head out of here shortly. Um we're just waiting on sister. Uh if you have any questions, again, I'm Officer DeAnda, just let me know.
