He has never bitten anybody. There's no way my dog WOULD ATTACK ANYBODY. WOAH, WOAH, WOAH, WOAH. YOU GOT BROKEN SKIN? >> YEAH. >> All right. Well, ma'am, he bit this officer. >> July 15th, 2022. Elk Grove, California. Animal Services Officer Crystal Mochek is out doing a final dangerous animal compliance inspection. The subject of the inspection is 1-year-old German Shepherd Zeus. 2 months ago, Zeus sent a man to the ER after biting him twice while he was on a lunchtime walk and was deemed to be a dangerous animal. California regulations for owning a dangerous animal require muzzling, a 3-in control leash, enrollment in obedience classes, public liability insurance of $100,000, and a ground-in kennel. Compliance with all regulations had to be proven within 30 days of the notice, or the dog would be forfeited to Animal Services. And today's day 30, and officers arrived to see proof that the requirements have been met. Zeus's owner, Faryal Kabir, arrives to speak with the officers. Her father's comment foreshadows the situation. >> She has a lot of temper, so you know. >> Oh, that's all right. It's not your fault. Hi there. Do I have the 5:00? I need to see your leash. I need to see your kennel. >> Yes, I do. >> Okay, then can you go get it? >> I'm going to get a kennel here? You can come and get it. >> Get the what? I'm sorry. >> I'm not going to get Bring the kennel. It's outside for you. >> So, the kennel should be in the backyard, ground-in. >> Yes, it is. >> Okay, so do you want to grab your other stuff? The muzzle, the leash, the insurance, the proof of training, all that? >> yeah. I have it right here. >> Okay, what What is this? This is just a >> That is a certification for the vicious animal. >> This is for This is not that. This is not even from animal services. >> Certification for the camera, okay. There's the vaccinations. >> Okay. >> I have a freaking badge from them from them. >> Yeah, I've seen I've seen this. So, I need to see the liability insurance. >> I don't like to hear and spoke to them I don't talk about because I don't want the neighbors. That's This is my parents' home, okay? Yeah, I'm at my parents'. >> I don't live here. I need to see all of this stuff. >> that? This is not our address. >> Okay, can I see your liability insurance and the muzzle and the leash? >> Okay, I'm doing this because you're embarrassing my parents. And I'm going to go ahead and No, I'm going to go ahead and uh call an attorney. Just watch. What What do you need to see? >> Your liability insurance, ma'am. >> The liability insurance on my phone here. Look at it. Okay. Go call them. >> We need a copy of that. >> You're all done. Take it from my phone cuz I have the insurance. >> I can't take anything from you. >> Well, this is what it is. This is the liability number for the insurance number. You can go ahead >> to see proof that the liability insurance is at least $100,000. >> That's the proof. >> They put a wrong report against my dog. I wasn't even able to practice being there and talk about my dog and they wrote down that he was chasing the guy. He was not chasing the guy. The guy was right there and I called him three times. Are you okay? Are you okay? And he kept I I felt no blood, nothing. He said he was chasing My dog was chasing him. How can my dog be chasing him? Okay, I'll go and ask these people if they have a camera, a ring camera so that it's going to be proof that my dog was not chasing anyone. [ __ ] ridiculous, seriously. There's a number policy number you can go ahead take down the policy number for the insurance. >> No, you need to show me where it says that your liability is at least $100,000. I'm not going to call them. That's not my responsibility. >> I can't do that. That's what I talked to them. >> Okay, so then you're already in violation there, ma'am. >> What do you mean in violation? How am I supposed to know what the coverage is? They They sent me a >> your responsibility to make sure that the liability insurance is at least $100,000. That doesn't show me that the insurance is $100,000. That's not my responsibility, ma'am. That's your responsibility. >> So, they can talk to you. This is a training I'm supposed to take him on Monday. This is the appointment. They said they don't have anything else. They're going to go ahead and contact them. This is the place. >> This doesn't show me that he has an appointment. This just is your information and Okay, do you have proof of that? >> That's what they say. This is what they gave me, a copy. >> Okay, well, I need to see proof that he signed up for this. >> Well, this is the sign-up sheet. >> This doesn't show me that you have an appointment. >> Do you want me to call everybody so you can talk to them? >> Kabir takes officers around the back to inspect the kennel. >> There you go. This is a sign. >> The dog is inside the house, right? >> He's in the garage. The dog doesn't do anything. Do you want me to take him out and pee? He's not going to bite you guys. He doesn't hurt anyone. Unless the guy called you to hit him or something. No way my dog is going to >> Can you show us where your kennel is? >> What do you mean a kennel? >> You have to have a ground-in kennel in your backyard. >> What is this? >> Yeah. Dangerous animals should be secured in a con- in an enclosure as described. >> I don't know. It's >> So, in this subsection, I have it printed out. I can get it for you, but um there is specifications for a kennel that you have to have in the backyard. It has to be ground-in. >> What do you mean ground-in? Like what? >> Ground-in means it's secured to the ground. So, like your dog can't dig under it or flip it over. >> I going to secure a kennel in the ground? Just dig it. Yeah, like with stakes. You don't put soil on it. You get like stakes or something. >> After stating that she has everything in order, Kabir then claims ignorance on every issue and officers begin to lose their patience. >> I'm trying to get in contact with you. You even tried to come here on Wednesday to make sure that you had everything ready to go. Okay. So unfortunately, unfortunately you don't have everything together. So, can I please speak, ma'am? Okay. So at this point in time, we're going to have to take possession of the dog and he's going to have to go to the shelter. You are in violation of the keeping restrictions. So You don't even have the kennel, ma'am. You don't have proof of your training of the insurance. Okay. So I'm I'm not going to keep arguing with you, ma'am. So we need you to go get the dog and load him onto the vehicle. SO >> [crying] >> MA'AM THIS is why we came here on Wednesday to try and talk to you and help you and make sure that you had everything together, but you BLEW US OFF. YOU SHOULD HAVE TALKED TO HER OVER the phone over the past month and you should have been cooperative with us on Wednesday. I said THIS PAST MONTH, NOT APPLICATION SAID. YEAH, today's the 30 days. Yeah, today is 30 days. Okay. We need you to go get the dog, ma'am, so that this does not escalate further. I understand and I'm sorry for that, but unfortunately this is what we have to do. >> My dog? That he's a freaking vicious animal? >> It's not vicious, it's dangerous. >> He has never bitten anybody. >> Unfortunately, you're going to have to go get the dog. >> Okay, I can go get >> and load him onto >> to drive him there. I don't want you guys to get him. >> You can load him onto the vehicle, but we're not going to have you drive him. >> Why not? I have till 5:00. >> Ma'am, you are not going to get a ground in kennel in this backyard by 5:00. >> what do you know? I can do that. Yes. Within an hour you think I can can't do that? Yes, you can. >> I know you can't do that, ma'am. So, can you please go get the dog and load him onto the vehicle? >> That's not your decision. It's till 5:00, ma'am. I have till 5:00. >> It actually is my decision. >> I can go and take him to 5:00 the shelter if I wanted to. >> No, ma'am. This is on you for not having everything together. >> I want to take him myself. I can do that. And then tomorrow we're going to put him in a kennel in there and that's it. Then I'll bring him back. >> No. >> Yes. That's what's going to happen. >> No, ma'am. >> What do you mean, no? >> I'm telling you no, that's not what we're going to do. >> YOU WANT TO GO GET HIM? COOL. If he bites you, are you going to be okay with that? Inside our house? >> How about you just go get him so that he doesn't get back up. >> Inside a house. What are you going to charge me with if he bites you? Inside the house. >> The good news is everything that the city has told you to get is easily obtainable, okay? >> I I I did everything. >> Well, once you obtain the proof of it, hold on. Hold on, ma'am. Ma'am, I heard you. I know you have papers, okay? Like my partner said, you don't have the proof of the training schedule. [laughter] Okay, hold on. You don't have the proof of the training schedule. You don't have the liability insurance required. Okay, well that's incumbent upon you to provide it. Get it as it as we requested, okay? So the 30 days has expired, okay? It It doesn't have to have to get to this level, okay? This happens I'm not going to say a lot, but it happens to people. They get their, you know, whatever happens, they accumulate what they need and the city says, "Cool, you have met the requirements. Good day." >> Got something watching all of you, you know? Or whoever wrote the report, because he has no no intentions of anything harming anybody. >> Perfect condition to be in. >> UNLESS HE PROBABLY HIT HIM, BECAUSE I don't see that. >> It's okay. >> There's no way my dog could attack anybody right in front of the house. I'm going to get my dog, but I'm just going to tell you guys this is going to be a big huge case you guys okay? >> Perfect. >> I'm sorry? >> Oh, I thought you were talking to me. Woah, woah, woah, woah. >> Yeah. >> You okay? >> Yeah. >> Here in slow motion you can see Zeus attempt to bite and then finally connect and bite the officer in the thigh. >> Close the kennel, ma'am. No, no, the clear one. Ma'am. Lift up on the metal part. On the metal part. You got broken skin? >> Yeah. >> All right, well, ma'am, he bit this officer now. >> Right here, ma'am. >> Because I told you guys let me take him out. >> You did not have control of the dog. All right. All right. You can call your stuff, okay? >> Having bitten two people including a police officer, Zeus was held in the Elk Grove Animal Shelter while his case worked its way through the courts. He was classified as a dangerous animal whose owner had failed to comply with the requirements to keep him. He was sentenced to death and euthanized three and a half months later. Faryal Kabir was not charged with any crime for either bite. The Kabir family later said they had arranged for Zeus to go to an animal sanctuary but that the city rejected that. What do you think? Was this the right decision? Should Zeus have been put down? Could the right owner have trained him? Let us know what you think in the comments and thank you for watching another episode of Justice in America. Stay safe.
