Okay. Has this happened before where he he had a gun? A while ago. After backup arrives, the officer decides it's time to enter the home and make contact with Marcus, unsure of what to expect. Do you think he'll talk to us? I hope so. Okay. Can we go in and Okay. Where is he right now? Downstairs? No, he's sprayed in the living room. As EMTs step in to treat the effects of the bear spray, Marcus remains erratic and agitated. But the officer remains calm and attempts to get his version of events. It's bear spray? YES, HE GOT BEAR SPRAY. OKAY. OKAY. OKAY. All right, go go in there. Come on. He is a whole ass bro. He don't even live here. He ain't got a he he he He got to get you milk first. He not on a [ __ ] lease. He don't own [ __ ] bro. I told this dude to leave me the [ __ ] alone. And he just SPRAYED ME. OKAY. OW. OW. >> PUT SOME THINGS IN YOUR EYES AND WE'LL talk about what happened. >> OW IS MY ASS. I WAS IN THE TOILET. OKAY. I It's It's my You got to calm down, bro. What do you mean? I've been [ __ ] [ __ ] BY A DRAGON IN THE FACE. I'M NOT TRYING TO HIT AT I KNOW. [laughter] WE WE'VE ALL BEEN THERE, MAN. I KNOW. FOCUS. This all started because he's been You got water. I just want you to lay back. Woah. Woah. Woah. Come on, bro. Pour that [ __ ] bro. Lay Lay back down, man. Chill out, dude. I know. Just don't be wanting to do things. Yeah. Just don't be wanting to do things, y'all. I'm not 100% with uh with that being battery, though. I need to go No, I So They said they don't have anywhere else for him to go, but I mean like he can't stay here, but it don't doesn't it's enough for a domestic battery. No. With the man unable to calm down and explain the details, the officers are left to discuss who may have actually been the aggressor. He attacked me. He said The dad said he came he he kept saying he assaulted me. I said, "What did he do?" He kept saying, "Well, he assaulted me." I said, "How did he hit you?" >> That guy that guy would be on the ground bleeding. >> Yeah, and he wasn't he doesn't have his laundry and he just not explaining to me how he was battered. Well, if he would calm down, I would get a statement from him, but he's just [clears throat] not. I think maybe he was going to be the first time. I think he was. What would have battered the guy? That guy would be knocked out. Yeah. After finally settling down, at least a little, the officer takes another run at getting Marcus's side of the story. Hey Marcus, do you think do you think you could tell me a little bit about what happened? Are you okay enough now? I'll tell you what. He said he got ass [ __ ] by dragons and breath. That's all. I I need to know what's going on. Interesting. I have messages. I have everything in [ __ ] that was sprayed or was it hairspray? Right. Hairspray? You spray good if you step on the hot you can't breathe. He does not he's not on the lease. >> Who is he? Who is he? Scott. Is that mom? Mother's husband. >> Okay. What happened was is I was sitting in my bedroom. I don't bother nobody. Okay. >> I swear I don't. He thinks he got some type of control because he helped her. Right. >> I pay half the rent. Okay. Which is $2,200 a month. I paid $1,000. Okay. So so how did this escalate to to someone getting bear sprayed? Is what I want Because he's a [ __ ] Okay, I need to let you finish your story first. >> SOMEBODY WITHOUT A BEAR? I MEAN YOU LOOK like a bear. I yeah, I don't care. I was never sprayed. I give you that. I give you that. You're the bear. I give you that. I give you that. But but for real though, why did he bear spray you though? Because I told her move out of my face. Why not? I paid $2,200 a month. I paid $1,000. Restroom is I don't want to be in the problem. Who bear sprayed you someone I don't know what the hell I'm saying. Excuse you, sir. I was having a conversation with the lady. >> The fireman's trying to get through here. He didn't ask me, you did. Yeah, I was looking Do you want him to Do you want my name? I do, yeah. What's Well, you're right. Okay. Real quick, what's your What's your first name? Is it m a r c u s? >> Oh, my bad. m a r c u s. Is this what a bear goes through? Where do you live? You guys are racist against bears. Marcus is consistent with his story, insisting he was bear sprayed for no reason, claiming the entire incident was completely unprovoked. I need to know what happened here because I need to know if somebody was battered. No, nobody was battered. He just started spraying the whole space up like he was [ __ ] roaches. Why did he spray? Why Why do you think Why do you think you're going to do something? BECAUSE HE THREATENED UP THE BEAR. I AIN'T GOING to lie, I am. I am, yeah. We established you're the bear. But me and him have a long history. You didn't get That's what I'm saying. If I get my phone, I can show you how much I hate you. >> Okay, what are we going to do tonight, Marcus? I'm going in the house that I pay rent for. He's going to where he lives in Koda Ocean. They getting the [ __ ] out of my face. >> Okay, cuz your mom said she don't want you staying there tonight. Is there any other option? My mother said I can't stay in the house I pay rent She didn't say you can't. No, no, no, no. She didn't say you can't. That's fine. I'm not even going to argue with it. I'm not even going to argue with it. I just need my phone so I can call my uncle who stays right on this outside and I tell him to come >> I'm going to get that for you. I'll be happy to Okay, okay. We'll come back to Marcus in a moment, but with doubts about his story, the officer heads back inside to get more details from the parents. Okay. Um Yeah. I got to read this girl's crap so I can air the house out. Yeah, I know. I was doing like verbal announcements and I was like choking on it. Um It's not It's not too bad, but I can [clears throat] feel it when I talk. Um So, he's He's calmed down quite quite a little bit now. I mean, he's still very vocal, but he's He's talking to me, okay? And he's He's like He's actually not that bad if you get him to calm down. So, uh but when he came out running like that, we're like, go, He's not really directly like telling me what happened. He said that you sprayed him, but he said like he didn't do anything. So, where I'm at right now is I'm trying to get him to give me like a better statement than that. What I'm here is to get the rest of the story from you to see if there was a battery. Cuz if there's a domestic battery, just make an arrest. Okay, so so what provoked the the spray though is what I'm not getting at. He jumped on me. He jumped on you? Okay. Yeah, and that got knocked over and you can see the dirt on the floor. >> that. Yeah, I saw that when I was digging in there. I actually hit him I have a little pocket knife. Okay. [laughter] I actually hit him with that first. >> With a what? A little pocket spray. Oh, okay. Okay. >> Yeah, that that this one right here. Back outside, Marcus continues to share his version of events with the assisting officers. Bro, I didn't hit He bear sprayed though. [ __ ] no. Hold the [ __ ] Where were you when he sprayed you? In the [ __ ] kitchen. He got this white privilege. He got He talks to me. He literally calls me Okay. And the minute I walked the door So, let me get this right. You guys are He sprayed me and my mama. You guys have been feuding for a while because you want him out. I've told this man You don't want him to live here. He sprayed you because you guys were arguing about that. All I did was come around the [ __ ] corner. So, you're saying it was unprovoked. You were only kitchen Look at me and look at him. I know. I know. That's why I know. If [snorts] you would have hit him, he'd be Come on, bro. Dude's a [ __ ] He literally stay here all day with nothing to do. He lives in Conyers, Georgia. Go the [ __ ] home in a big ass house. Big ass house. Four, five bedroom house. He's He been here for the last [ __ ] month. Come on, man. Are you serious? You're ready for your >> [snorts] >> bear bear spray. What do you want me to do? Do you want him arrested or not? Yes. Yes. But calm down. I want his ass put under the jail. I'm just asking what happened. I'm just asking. >> put a white dude in jail? Not to say that cuz I count you as a black. If they commit a crime >> Do you like fried chicken? Yes, I love fried chicken. There it is. >> [laughter] >> There it is. I got I >> oh, I got I'm banned. >> Yeah, I don't want bear spray on me. So you want to I got 12 hours left in the shift. I don't want me tearing up. Let's briefly head back inside the home with the officer to get more insight into what may have actually happened. He he's been drinking. Well, let me let me finish. So he was in her face and and then >> Yeah, he said it started out with mom having her privacy, right? Yeah, because we're trying to hold him accountable. Right. Okay. So I asked him to please back [snorts] up from your mom's face and don't get in her face cuz he's getting a little [clears throat] too aggressive. And then that's when he walked over slammed me into that wall and then jumped on top of me over here and uh that's when I sprayed him. He, you know, Okay, so you sprayed him because he jumped on you and you're in belief that he was going to battery you. Well, he was battery me. I was on the floor. >> [laughter] >> That that's what I have to figure out here is this if this this is like I mean she come if this is a thing cuz I mean like if there's any kind of contact here and ask what state Okay, yeah. And then I was over here. I was confused. He was standing here. Okay. >> I was sitting right here and he was being friendly with me, right? So he got up and walked and I said, "Hey Marcus, you cannot attack him." And he got up and actually struck me. Okay. Okay. Back outside, Marcus adds a little more context. Maybe more than he should. I literally got the message where I said, "If you [ __ ] leave, I'm going to bury you in the ground." Oh, is that what you said? That's what I said, like but then he leaves. So he leaves when he's under threat, right? When's the last time you threatened him that you were going to beat him up? 10 minutes ago. I got you. So I have to threaten you to tell you to leave in a house that you don't you don't pay no rent in. You don't do nothing for. So today you were in the kitchen and unprovoked out of nowhere >> I walked around the corner, he sprayed everybody. What you mean me? It was everybody. Ain't everybody getting sprayed? The dog is sprayed. calling on her. Okay. The female officer is talking to your mom right now. >> You're telling me my mother is choosing to get rid of me over this [ __ ] Listen, listen. Just hear me hypothetically, right? >> I'm listening, yeah. You stay somewhere and somebody randomly who you don't [ __ ] with, who you never [ __ ] with since you were 8 years old, comes and try to tell you you got to pay him rent. But, you already paid the rent. Ask me how much. A month? How much? A thousand dollars a month. The rent is $2,200 a month. I pay $1,000 a month. But, guess what? Every day I get home, that [ __ ] sitting on the couch. The officer wraps up inside and a final decision is made. Like I said, then he started screaming in her face. I asked him to back up. That's when he jumped on me and jumped on top of me and that's when I initially sprayed him with a little spray. Okay. And then I like said, he took his swing at [clears throat] me over here. I think it hit my eye right here. Yeah, you definitely do have injuries. So, with visible injury that is that is grounds for an arrest tonight. They're going to take him and I'll be right back with just some just some paperwork and some information for you. Um, okay. All right, so what am I supposed to do? Am I done here? Not yet. We got to get your clothes and stuff on you. That was my blanket, bro. That's that's the essence of me. What happened to protect and serve? First of all, this is fleece chinchilla rat something. >> chinchilla rat. I don't know what it is. I ain't going to lie to you, but it's warm. There we go. Oh, oh no. No, you ain't got to Bro, I'm not fighting. I'm not fighting none of that, bro. I'm not fighting. Come on, man. Come on, man. Can you zip me up? You know what I mean? In the front. You want me to zip you up? Yeah, just It's It's It's a simple sweater. Yeah. I'll zip you up. Appreciate it, bro. Are we cool now? Yes, sir. Appreciate it, bro. You're not You're not that short no more. No. No. You're actually like [ __ ] You might be a Viking. Who knows? I might be. >> [laughter] >> Go to the bear, right? >> All right, where am I going? I'm Viking. Can you say something? Yeah, of course. I'm Viking. That's going to stick forever now. >> [laughter] >> I got your heart in your abdomen. I will never never do you like that. All right. Thank you, sir. Yes, ma'am. Probably one of the nicest guys I've met all night. I'm feeling it big time, and this shift just started. What the [ __ ] It's going to be one of these shifts tonight, fellas. Just so y'all know. >> [laughter] >> According to the police report, officers observed scratches on Scott's neck, which he wished to have photographed, though he declined to provide a written statement. While both parents stated they did not wish to pursue charges, they did want Marcus out of the home. Despite that, Marcus was ultimately placed under arrest by officers on scene and transported to the Waukegan Police Department, where he was charged with domestic battery. What began as a verbal argument over unpaid rent quickly escalated into a physical confrontation involving bear spray, injuries, and an arrest. What are your thoughts on this case?
