Since Seville closed about 2:45, she's outside of Seville. >> 35-39 >> extremely intoxicated wrestling with that chick. With her? Yeah. 662 Like they were fighting? That girl was trying to keep her from like fighting anybody. Okay, got it. So they move over to that where where we were just now in that parking lot. Actually, you weren't in the parking lot, but in Jefferson and uh Government parking lot, south or northwest corner. Um and there's a group of people and she kept screaming profanity and [ __ ] and approaching the group of people. And then eventually she started swinging on these dudes and literally trying to fight them and they're running from her. Okay. And she's running around chasing people swinging on them. And obviously she's super small, so these guys aren't like you know, they're not Even if she hit them, they're not really going to hurt them, but she's still chasing people around and running from her. Um Same group or different group of people? It's like one group of like maybe six people. And um girl That girl was trying to hold her back the whole time. Restrain her. Restrainer can't can't keep her back. Little This is like 30 minutes of this girl keeping her from fighting people. Okay. And then finally she runs up to one dude and swings on him again and he like [ __ ] I think he hit her in the face and knocked her down and she came back up and started chasing him again and he started yelling at me to get her, get her, get her. I rolled over as I saw it happening. Getting out of the car and he's like, "Get her, get her, get her." And then grab her up. We didn't get his info. No, they took off once we started wrestling. But she wasn't bad until I got her back to the car and then she starts twisting and trying to pull away from me, trying to grab me in my like groin area with her hands cuffed behind her back. And and then I I don't know when you got here, but >> Did you have battery then though, like when she grabbed Attempted. She's trying to grab my [ __ ] groin and my gun belt and [ __ ] And then um And then whenever we went to go search her in Thompson's car, she started I don't know trying her leg up in the wheel well and kicking and fighting grabbing I think she tried to bite Thompson. I'm going to get with her on that. I think she's kicking, too, maybe. So, if she starts fighting me, it's going to be a Marchman but 198 That's it. All right, guys. Cool. Yeah, thank you. Probable cause was clearly established. Under Florida statute 784.03, battery is defined as intentionally touching or striking another person against their will. Officers directly witnessed the subject commit this act multiple times, creating justification for warrantless arrest. Regarding use of force, Graham versus Connor from 1989 established that reasonableness must be judged from the perspective of a reasonable officer on the scene. The court identified three factors: severity of the crime, immediate threat to safety, and active resistance by the suspect. In this case, the subject attacked civilians, endangered public safety, and actively resisted throughout the entire arrest process. Using multiple officers is actually a force mitigation strategy. When multiple officers control a subject, each individual uses less force. The subject demanded only female officers touch her. This raises an important legal question. Do arrestees have the right to choose officer gender? The answer is no. The Fourth Amendment governs the reasonableness of searches and seizures, not the gender of officers conducting them. The subject also attempted to grab the officer's groin area and gun belt while handcuffed. This constitutes battery on a law enforcement officer under Florida statute 784.07. This offense is elevated from a misdemeanor to a third degree felony punishable by up to five years imprisonment. Officers chose to process this case primarily under the Marchman Act, which is civil involuntary commitment for substance abuse, not criminal prosecution. This approach recognizes that severe intoxication requires treatment intervention rather than purely punitive measures. Grading, the primary officer receives a B+ clear legal authority, reasonable force, professional demeanor. Minor deductions for some statements that could be perceived as diminishing the subject, though unintentional. The subject receives an F. Multiple criminal offenses, extreme resistance, serious false accusations. The companion receives a C- good intentions, but poor execution, failed to follow lawful commands, nearly arrested for obstruction. Key lessons. First, multiple officers does not equal excessive force, but rather a tactical force reduction strategy. Second, there is no constitutional right to choose officer gender. Departments may accommodate when feasible, but it's not required. Third, false sexual assault accusations create serious consequences for officers, even when completely baseless. Fourth, resisting lawful arrest only worsens the situation legally and physically. Compliance is the smartest choice.
